26:35 – 27:000

Immediate impacts on safety, infrastructure, and the existing character of the neighborhood. My primary concern is safety. This is already an active residential street with steady vehicle traffic, limited parking, and consistent pedestrian movement throughout the day. Most importantly, it's a designated school bus route where children are picked up and dropped off every morning and afternoon. That means there's regularly young students walking, crossing the streets, and waiting.

27:01 – 27:390

Adding a significant increase in vehicles, residents, and congestion in this environment directly increases the risk of accidents in a way that can't be ignored. There's also serious concerns about whether the current infrastructure can support this level of added density. The water sewage and waste systems are already in regular use and functioning for the existing neighborhoods. There has been no clear detailed plan presented showing how those systems will be upgraded or how the increased demand will be managed without negatively impacting current residents. There are essential services, and they should not be stretched beyond their intended capacity without full transparency and planning.

27:40 – 28:110

Another important issue is a financial burden, a financial impact on surrounding homeowners. In many cases, potentially developments like this can lead to reassessments of nearby properties, which can potentially result in higher property taxes. For long time residents, this isn't just like a small adjustment. It can become significant and ongoing, and this is a decision that they had no role in creating and do not directly benefit from. I also wanna address the immediate property directly next to the proposed site, which is home to horses.

28:12 – 28:520

These animals depend on a quiet stable and low stress environment. The disruption from construction alone, heavy equipment, noise, vibration, dust, it would be significant to them. The level on construction activity combined with the long term increase in noise, traffic, and overall activity raises legitimate concerns about their safety and well-being. This is a long standing and valued part of the community and it should not be overlooked. Finally, there's a broader impact on the neighborhood itself, extended construction, increased noise, traffic congestion, and general disruption would affect residents' daily lives for an extended period of time without clear evidence that these impacts have been fully considered or mitigated.

28:52 – 29:040

At its core, it comes down to balance. Growth should be thoughtful and responsible, not something that shifts the burden onto existing residents and compromises safety, stability, and quality of life. Right now, this proposal does Your

29:041

time is up.

29:072

Thank you very much. And if you would please come up and grab a card and put your information on it, I'd appreciate it. Thank you. All right.

29:151

Do we have any other speakers? Okay. Thank you.

29:192

All right. With no other speakers, this public hearing is now closed. Is there any further discussion by the commission or may I have a motion?

29:33 – 29:573

Motion to approve master case number 21Dash00011 I'm sorry. 06R1 design review number 21Dash000042DashR1 and the public hearing item, number PHB master case number 21Dash10R1.

29:582

Alright. So we have a motion by secretary Lozano.

30:024

Can we bring it back for discussion? You don't mind. I have a couple of questions for staff.

30:092

Okay. So if there's no further so go ahead, commissioner.

30:144

Yeah. Yes. Alright. Thank you.

30:152

Just bring it back for discussion.

30:165

You're open.

30:17 – 30:284

Thank you. First question I have is regarding traffic. Was a traffic study done on this project?

30:286

Yes. So back in 2021, when the project was originally being reviewed, they provided a traffic memo and the daily trips did not trigger any further analysis.

30:404

Thank you for that. My next question is utilities for the project. Were those also researched and did they meet the requirements?

30:49 – 31:056

Yes. So those are reviewed by building safety and engineering. Engineering focuses on drainage, so they did review that. And they are expected to have utility access as required by the California Building Code.

31:06 – 31:214

Okay. And then my last question for you, and I appreciate you answering my questions. Thank you. I think you did say this, but were notices sent out to the residents when this this, initially went out?

31:216

It's sent out to the property owners. Property owners. So, that is the requirement. Yes.

31:352

Director?

31:365

Yes. Thank you. I just wanted to note that there's also a noticing board that goes out in front of the property with public hearing information on that board at the property line, at the front.

31:464

Okay. Alright. Well, thank you. That's that's all for me.

31:547

I can hear him.

31:57 – 32:136

Yes. What the applicant was at we actually did send them to the occupants as well for this one. The applicants sent a mailing list that included the occupants as well, which we don't typically do, but it was a large stack that he gave us and we sent them out.

32:14 – 32:262

Okay. Thank you very much. So moving back, is there any further discussion by the commission? No. Alright. Yes, director?

32:265

I just want to note, can we confirm that the motion includes the modification to the condition of approval?

32:322

Yes. She did say PH21Dash0, I mean 21Dash106DashR1.

32:425

With the modification to condition number 43 that allows the tractor parcel map being recorded prior to the final certificate of occupancy.

32:54 – 33:102

Yes. Thank you. Alright. So moving forward, if there's no more discussion by the commission, may I have a motion? Okay. So may I get a second?

33:101

You need a second.

33:112

Thank you.

33:124

I'll second that motion.

33:132

Alright. So we have a motion from secretary Lozano and a second by vice chair Quintana. Let's go ahead and place our votes.

33:241

Three in favor, motion passes.

33:34 – 34:092

All right. That takes us to our next item, public hearing Item C. I will open the public hearing for master case number 19Dash000016R1 development agreement number 19Dash000002R1, a request to approve the first amendment to the Goodman Logistics Center Fontana three development agreement to extend the terms and add subs sustainability features. City clerk, do we receive any written correspondence on this item?

34:091

Chair, we did not. You can't just speak out like that?

34:172

Yeah. You can't you can't you need to make a request for public speaking.

34:241

If you yes. Yeah.

34:282

If you're talking about the prior item, we've already moved past that item. But if you'd like, you could come back either. Is there

34:400

any staff member that could

34:425

soon as this item's over with, we'll have staff people that can discuss. Okay.

34:46 – 35:012

We'll have a staff member speak to you after. Alright. Moving forward. So master case number wait. I'm sorry. City clerk, do we have any written correspondence for this item?

35:011

Chair, we do not.

35:032

Alright. So with no written correspondence, Reyna Lu, senior planner will provide the staff presentation.

35:14 – 36:167

Thank you, Planning Commission Chair and members of the Planning Commission. This item before you is a revision to the development agreement. The applicant is g l c Fontana three LLC, and this project site is generally located between Cypress Avenue and Juniper Avenue, north of Haroopa Avenue. And this, proposal before you this evening is a request for the first amendment to the development agreement to the Goodman Logistics Center Fontana three development agreement. Just to give you a little history on this project, in '20 on in June 2020, the city council approved the development agreement, and that was approved along with the approval of the entitlements for an industrial commerce center development that's comprised of three buildings on this property.

36:17 – 36:457

And then in April 2021, the planning commission approved an entitlement to subdivide a portion of this property as well as to establish a tractor trailer parking lot. So before you is a proposal to amend the development agreement. And the development agreement amendment has two components. The first component is to extend the term. So currently, the term is ten years.

36:45 – 37:257

However, the applicant has proposed ten additional years, which would give it a total of twenty years until 03/09/2041. The second component is that, the project will include new sustain sustainability features. And the list is provided below in the PowerPoint. So the first one would be a requirement for a truck routing plan, additional signage, larger trees, zero emissions would be required for on-site motorized operational vehicles. In addition to that, light colored and solar ready roofs.

37:26 – 37:547

EV conduit infrastructure for future charging stations are also included. Cool driving surfaces are included as well. Larger electrical rooms. And also a requirement for lower VOC paints and coatings. And then also the the development would would be required to incorporate the highest available CARB tier rated for construction equipment.

37:55 – 38:477

And also an implementation of both a recycling program and a property maintenance program, as well as an incentive program for operators that would include the Carl Moyer program, the Vulture Vulture Incentive program, as well as the US EPA smart way program. In the staff reports, as well as in the attachment to the staff reports, the city planning department received a written public comment requesting to change a land use designation of another property on another site. However, this application does not include any development. It does not include any changes in land use designation. Therefore, as part of this application before you tonight, it would not be appropriate to change any other land uses.

38:47 – 39:067

So with that, staff is recommending that the planning commission approve resolution number PC2026020 to approve the project. That concludes my presentation. I can answer any questions you may have.

39:14 – 39:282

Okay. Does the commission have any questions they would like to ask staff? Alright. With no questions from the communication, is the applicant here? And will the applicant step to the podium and state your name and state whether you accept the conditions of approval?

39:358

Good evening, commissioners. My name is Jeff Hamilton with Goodman. And, yes, we do accept the conditions of approval.

39:472

Okay. And then is there anything you want anything else you wanna share with us about this this change?

39:53 – 40:078

No. Staff and Rina did a did a great job. She explained, everything that we're looking for, an additional ten years of the development agreement. And in in exchange, we would be adding a significant amount of sustainability requirements to the future buildings.

40:09 – 40:252

Okay. Thank you. Are there any other questions for the commission for the applicant? Alright. City Clerk, did we request are there any requests to speak on this item?

40:251

Yes, Chair. We have one request from Mr. Jose Tinojero. Would you go to the microphone? And you have three minutes.

40:41 – 41:169

Hello, everybody. Thank you for the opportunity. My name is Jose Tinagero, and I'm located on 11229 Cypress Avenue, just south of the project. And yes, when Amazon opened their their doors, we got a high volume increase of traffic, which is causing us a few problems. Our driveway has been blocked so many times, and I do have pictures that I have taken through the time.

41:17 – 42:059

And now that the charge was open, we got a higher volume of traffic, and we I like to suggest the developer to widen the street to the four lanes that it was supposed to do before the warehouses because of the the danger of this street is becoming. To go out to get the mail, to bring the trash cans out is just a little too much traffic. So I can imagine opening all these business. Now it will become a little too much traffic for for Cypress Avenue. Thank you.

42:071

That concludes our speakers, Chair.

42:09 – 42:202

Okay. Thank you. All right. This public hearing is now closed. Is there any further discussion by the commission?

42:232

All right. If there's, no further discussion, may I have a motion?

42:304

I make a motion to approve master case 19Dash00016R1.

42:372

I have a motion made by commit by, vice chair Quintana. Can I get a second?

42:4310

Second. That motion.

42:452

Second by Secretary Lozano. Go ahead place your votes.

42:561

Three in favor, motion passes.

43:02 – 43:172
