1. Agreement to Terms

Welcome to Hamlet. By accessing or using our civic intelligence platform at myhamlet.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Description of Service

Hamlet provides a platform for searching and analyzing publicly available government meeting transcripts, including city council meetings, planning commission hearings, zoning board sessions, and other public governmental proceedings. Our Service enables users to:

  • Search across thousands of government meeting transcripts
  • Set up keyword alerts for topics of interest
  • Access video recordings with synchronized transcripts
  • Export search results for analysis
  • Track regulatory discussions across jurisdictions

All content indexed by Hamlet is derived from publicly available government sources. We do not create, modify, or editorialize the content of government meetings.

3. User Accounts

To access certain features of the Service, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Subscription and Billing

Hamlet offers various subscription tiers, including free and paid options. For paid subscriptions:

  • Billing Cycle: Subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select.
  • Automatic Renewal: Your subscription will automatically renew unless you cancel before the renewal date.
  • Price Changes: We may change our prices with 30 days' notice. Price changes take effect at the start of your next billing cycle.
  • Refunds: We do not provide refunds for partial subscription periods. You may cancel at any time, and your access will continue until the end of your current billing period.
  • Free Trials: If offered a free trial, you will not be charged until the trial period ends. You can cancel at any time during the trial.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others, including privacy and intellectual property rights
  • Harass, abuse, or harm another person or entity
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Interfere with or disrupt the Service or servers connected to the Service
  • Transmit viruses, malware, or other malicious code
  • Collect user information without consent
  • Use the Service for any illegal or unauthorized purpose

We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including removing content, suspending or terminating accounts, and reporting to law enforcement.

6. Intellectual Property

Our Content: The Service and its original content (excluding government meeting content), features, and functionality are owned by Hamlet and are protected by international copyright, trademark, and other intellectual property laws.

Government Content: Government meeting transcripts, videos, and related documents are generally in the public domain or subject to open records laws. Hamlet does not claim ownership of this content but provides value-added services including indexing, search, and analysis.

Your Content: You retain ownership of any content you submit to the Service (such as saved searches, bookmarks, and notes). By submitting content, you grant us a license to use, store, and display that content as necessary to provide the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • The quality of any information obtained through the Service will meet your expectations
  • Any errors in the Service will be corrected

Transcript accuracy depends on the quality of source materials and automated processing. While we strive for accuracy, you should verify critical information by reviewing original government sources.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAMLET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

9. Indemnification

You agree to defend, indemnify, and hold harmless Hamlet and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party right, including intellectual property or privacy rights
  • Any claim that your use of the Service caused damage to a third party

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us or using the account settings in the Service.

Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
