Thank you, Vice Chair. My name is Tawanda Mutunga. I'm the new Community Development Director. I come to this wonderful city of Selma with close to 20 years of planning experience. And I used to work for the County of Fresno in the planning department there. But I look forward to this journey ahead. And I definitely look forward to working with your commission.
Thank you so much. We're very happy to have you. And I love the name. Okay, we're on to the public hearing, which is what everybody's here for. We'll now move to our first item of business. Oh, we'll now move to the public hearings item of this meeting. This hearing will be orderly and courteous. During the public hearing, I will ask for staff's comments and reports on the item being discussed. After staff's presentation, I will then open the hearing to public testimony, beginning with the applicant. We invite all interested parties to participate. Anyone? This is the time that you want to get up and talk.

So the planning commission will then discuss the matter amongst themselves and take action on the item being considered. So staff has a report for us to review.
Good evening, commissioners. Thank you for introducing us. So we're here tonight for a public hearing on a development application filed to the city requesting approval for a commercial development on the northeast corner of the Dinuba and McCall intersection. um this location is right at the top edge of our current city limits it's currently zoned c3 and the proposed commercial development which all three are permitted uses in the zone is for a nine pump fuel station um a 4 600 square foot convenience store a 1500 square foot car wash AND THE CONDITIONAL USE PORTION OF THIS REQUEST IS LIMITED TO THE SALE OF ALCOHOLIC BEVERAGES WITHIN THE CONVENIENT STORE. THE APPLICANT FILED THIS DEVELOPMENT REQUEST CONCURRENTLY, SO IT'S BEFORE YOU TONIGHT AS A PROJECT AS A WHOLE. ORDINARILY, THE THREE COMMERCIAL USES AND DEVELOPMENT WOULD BE PROCESSED INTERNALLY AS A SITE PLAN REVIEW, WHICH IS A NON-DISCRETIONARY REVIEW PROCESS. As I mentioned, the location is the northeast corner of the Dinuba and McCall intersection. The land currently is vacant. I think it's an area of town that we're all very familiar with and have some eager anticipation for improvements on this side of town. The site itself is about 2.1 acres. It's undeveloped. And yes. So this is a street view picture just to be more familiar in case somebody did not do a drive-by or is unfamiliar with the site. As it sits, it's largely rural, vacant land. It is recently, somewhat recently, annexed into the city and zoned. So it is sort of a newer side of town that we're seeing development on on the north boundary line. This is the first commercial development request in this area that is otherwise surrounded by higher density residential designated lands. So staff has reviewed the proposed site layout, the building placement, parking, access, circulation, landscaping, lighting, and other site improvements for consistency with the general plan, the municipal code, and applicable development standards of the zoning ordinance. Staff has found that the proposed development is consistent with all applicable criteria and has proposed in the staff report pretty substantial, but also very standard conditions of approval that would support approval of the project as proposed. In addition to reviewing the application under the terms of our site plan review process, staff has reviewed the proposed alcohol outlet and the the conditional use request in relation to this location's proximity to other residential buildings, churches, schools, hospitals, playgrounds, parks and existing alcohol outlets. And staff has found that this that that part of this proposal is too consistent with the requirements of our municipal code. The proposed convenience store, which is where the alcohol sales is proposed to occur, is located more than 600 feet from the nearest sensitive lands. And based on surrounding land uses, the separation from the nearby sensitive receptors and proposed conditions of approval, staff finds that the proposed alcohol sales will not adversely affect neighborhood residents, will not detrimentally affect nearby neighborhoods, and is generally compatible with the surrounding area. So part of our request before you tonight is also a CEQA determination for environmental compliance. Staff has found that this project is categorically exempt from CEQA under section 15332 class 32 infill development projects. And the requirements of this exemption are that the project is consistent with the applicable general plan designation and and the underlying zoning district. It is located on approximately 2.1 acres within the incorporated limits of the city. It is substantially surrounded by urban development, has no value as habitat for endangered, rare or threatened species, and would not result in significant effects relating to traffic, noise, air quality or water quality, and can be adequately served by existing public utilities and services accordingly the project satisfies the requirements of the sequest section so staff is recommending that the commission find or uphold the notice of exemption that this is not subject to sequa based on the finding that The use is allowed outright in the zone. The land is already designated for commercial use. This is a commercial use that is being proposed. And the city has a certified environmental impact report that analyzed this section of town and took into consideration the commercial development of this site. So staff's recommendation is that the planning commission consider adopting the attached resolution with a few corrections. As we were preparing for tonight, we noticed on page 26 in the conditions of approval, which is exhibit C in your staff report packet, The appeals deadline is not August 11th as listed. It is September 8th, which would be 15 days from tonight's date if this action is approved. And that the contact party, if anybody wishes to appeal, should be directed to the planning division or the city clerk, not a specific individual within the city. The other correction would be in the resolution that was provided in the packet, noting that the chairperson is Vice Chair Standridge and not Chair Corey, and that the attesting party would be Tawanda Mutunga, the Secretary of the Planning Commission. Otherwise, staff's recommendation is approval, determining that the project is categorically exempt, as discussed, and the approved site plan and conditional use permit, which is number plan 2643, should be approved subject to the conditions of approval contained in the record with the corrections noted by staff in this presentation. So I'm happy to answer any questions and address any community concerns that we have.

Yeah, I have a question. So you mentioned a McDonald's. So will the other original McDonald's still be open or will that one be closing?
I don't have an answer to that. I believe they are two separate parties. So this would be a second McDonald's location. We have not heard otherwise.
Okay. Will this also intervene with the traffic signal light that's coming?
Yep. So this project would be impacted with the McCall Danube intersection project, the engineering department and public works have reviewed the proposed development and assigned comments accordingly. So part of the conditions of approval, you may see additional right of way acquisition is required by this applicant Kent in order to obtain building permits. And that is to help facilitate that traffic signal project for the city.
Well, the power lines on Dinobah Avenue be relocated. buried or whatever.
Yeah. So the city has an undergrounding ordinance requirement. Um, that's, there's another condition of approval from the engineering department relating to power pool relocation or undergrounding requirements.
Has there been a traffic impact, uh, report done on Dinuba Avenue or McCall?
As part of the proposed development, no, because this is a non-discretionary use in the zone. It's permitted by right and it's exempt from CEQA. They were not required to go through a traffic study. The project is leaning on the city's certified environmental impact report that was adopted 2010, I believe, and studied this area at that time.
And is Dinuba Avenue proposed to be four lanes?
It is. So in preparation of these kinds of questions, I have some additional information that may be helpful in the future. And our general plan, which is our guiding document for what Selma will look like in the future or what we want it to look like in the future. Our circulation element classifies all the streets and roads in our community, tells us what type they are and how they should be built out in the future when there's enough development to support that level of service. Both Dinuba and McCall Avenues in this project area are classified as major arterials. They do not exist today as a major arterial, but that is ultimately what they will look like in the future once the city accommodates or expands and the growth increases. In this part of town requires this level of street improvement. So you can see major arterials will be improved to six lanes. There's some flexibility on the city's part to allow variations and intersection design and arterial design. to alleviate special traffic problems where necessary this project site is about 600 feet away from the mccall village mobile home park so in the future the city might consider a variation to the major arterial standard median requirement to allow for larger mobile units to be able to be brought in and out of that facility but at this time you know the street standard exists this is what it will look like eventually once development is brought to this part of town And at the time that the street improvements are considered and put in by the city, that's when any kind of variation to support existing surrounding development should be considered.
It would be very difficult if there was a median like that, you know, that couldn't be crossed right there across from McCall Village. If they put a median east of McCall Village, that would... that wouldn't affect anybody, you know, it wouldn't hurt. But anyway, but we're not talking about that tonight.
Yes. So also part of our general plan, and these are existing policies within our current circulation element, is an extension when McCall Avenue, when land is annexed on the north side of town, McCall Avenue shall be built out to a four lane divided arterial, which is a variation from this major arterial cross section that we see in our plan today. But as a four-lane road, it will hopefully better serve the future residential uses that are planned as part of our long-range plan for that area.
Will the car wash recycle water? Is that any kind of requirement for water services?
So Cal Water is part of our external review committee for new developments. They did not provide comments to us. So a general condition of approval is proposed in this application before you that the applicant shall conform to all requirements of Cal Water. I'm not sure what their operationally, whether that's a requirement that they may have, but it is something that they could condition approval.
I know the other car wash in town advertises that they recycle their water. I don't know how they do that, but somehow they do.
Yeah, so other things that I thought may be relevant for us tonight to consider in the in the location of this project is there are some capital improvements that the projects that the city is actively working on. And sorry, we're gonna have to just move this toolbar around. So you can see on the top image, the subject property on the northeast corner of the Dinuba and McCall intersection, we've mentioned that traffic signal project, that this property and this development is required to dedicate additional right of way, which will help facilitate completion of that traffic signal. There is also a street rehabilitation project that has been received construction authorization actually just last month. And so that will be, I believe, a repaving and road repair project of Dinuba from Thompson Avenue. CLEAR DOWN TO DOCKERY. SO SUBSTANTIAL STREET IMPROVEMENTS ON THE HORIZON THAT OUR PUBLIC WORKS AND ENGINEERING TEAM ARE DILIGENTLY WORKING TOWARDS AND TRYING TO COORDINATE WITH THAT SIGNAL IMPROVEMENT PROJECT.
DO YOU HAVE A TIMELINE ON THE ADDITIONAL LANES THAT ARE GOING TO BE COMING IN BY ANY CHANCE?
I DON'T. SO AS A LONG RANGE PLANNING FUNCTION, THE REQUIRED STREET IMPROVEMENTS AND THOSE UPGRADES ARE GOING TO FOLLOW DEVELOPMENT THAT'S PROPOSED IN THE AREA.
Just for clarification, because I know the signal light is a huge topic, right? Everybody's been asking for it. I live in the area as well. So I know I'm impacted by the traffic as well. So that has to be put in first before this project is put in, correct?
No. No. No, it would not be a requirement for the signal to be installed. Dedication of the additional right-of-way to help facilitate the city completing that capital improvement project is a proposed condition of approval for the proposal, but the development could proceed prior to that signal project. There are some other conditions of approval that's before you tonight that may, you know, the applicant, the timeline may work out very close there's a land division that would need to be create or completed prior to receiving building permits there's grading permits encroachment permits all of those things so the actual development schedule may align very closely but ultimately two separate projects and tracks and as it is now this development The existing streets, while we know that there's a traffic issue there, especially at peak times of day, and we know we need a signal there, having the development installed prior to the signal, we know that there's a potential for there to create some delay, but it will help facilitate completion of that signal project.
On McCall Avenue, as you come out of the gas station, it's going to be very difficult to make left turns there, especially with all the traffic that is typically on McCall Avenue. Could it be looked at that there is maybe like a two-way turn lane, a lane in the middle so that people can go and wait until they can take their turn?
I believe part of this, to answer your question, there is a restriping requirement from our engineering department in McCall and Dinuba avenues to eliminate some on-street parking stalls that are impacted by the driveway approach prior to grading. Yeah, if that's a condition of approval that the commission would like to add, that's certainly within your scope of the discretionary review process.
Yes. We're not up to a vote yet, but can we add the condition when we get ready to
Yeah, so I think the condition, it sounds like maybe to complete to the satisfaction perhaps of the city engineer, a left-hand turn lane or right-hand turn only from the complex onto Dinuba Avenue.
Yeah, but then there needs to be a place for people to be able to make a left turn. I don't know how easy that's going to be on McCall Avenue, but if you've got that center median lane where cars can go into it wait for their time and then go, you know, so they're getting across one lane of traffic at a time. It's a little easier to make a left turn that way. I also read in here that the developer shall provide striping plan for South McCall Avenue and East Dinuba depicting on the removal and restriping of on-street parking stalls. I think it would be very difficult if there was any on-street parking on either of those streets. I don't know, anybody?
Yeah, so I think the intent behind that condition of approval is to remove any on-site, on-street parking in those locations.
To remove it. Okay, that's good, but it doesn't read that way to me, but that's great. Yeah.

My name is Sukhvinder Singh Sidhu, and I'm from Danuba. I live at 3721 Alberta Circle. Also, we do our own business in Danuba by the Walmart 517 West Almonte Way, similar to this business. I do have Circle KC store. Also, we have Dogo Sandwich, Frozen Yogurt, Chicken Shack, Mexican Food, a bunch of other franchises, like Juice It Up, stuff like that. We own around the community multi-business with franchise. So this time we like to move forward for my nephew. He just graduated from high school. So he finished his education, his degree, his diploma. So this is actually for him and he picked this city Selma. The reason we picked city Selma, the property was sale and we noticed nothing that side. everything around here this side and that side feel like empty and there are a lot of community and a lot of developing a lot of traffic day and night coming to Manning through freeway and coming back and we notice we watch day night morning then we decide to discuss our family what can fit in there so we actually working more than three four year with the this idea There are so many C-stores, so many gas stations. Why do we have to have other gas stations? It has to be something different. So we put together, take a little time, three years, four years, Megan now and Morgan now. And I believe that was two year ago, we sent the plan, then we changed some things. So we talked to McDonough and Carlos Junior, Starbucks, other stuff, a food chain, we want big food chain, the area because it's nothing. Then we talked to Circle K, other this and that. So take little while. So our decision now we putting McDonough and Circle K Car Wash together same time actually. McDonough waiting for us for today the processing, and they purchase the property from us. We have to do parcel, line adjustment, all that. And they are actually in the application. So McDonough and Circle K, gas station, C-store, car wash going to be same time soon, depending the city or planning and council and the community, how they help us. We here asking your help to move forward. So let me explain about your C-Store. A C-Store is not going to the same circle that you have in town or you have an extra mile or you have Arco MPM or the liquor store. If you want, you can visit to Danuba. I think many people go there. And when you go there, you don't feel like the C-Store or liquor store or alcohol store. So really welcome. I have grandpa. And grandma, they take their grandkid to go, let's go have frozen yogurt there, you know. And they sit there, they eat there. They don't feel like liquor store. And they feel like welcome family business is going to be same thing. And also our merchandise, when you walk in, it's going to be floor plan, big different compared to other. Also merchandise we offering. And you know, find the local stuff, what you're missing. And Danuba, you have to go, Venco or C-Mart, like other store, way from your town. For example, Firestone, Dust Bowl, IPA, a lot of local stuff from Tulare, from Clovis. So we have a lot of vendor local. They grow here. They sell here with Dhanaji or Valleywide. And another Benno beverage, we have a relationship with them. It's going to be big different your alcohol beverage. And it's not like same, for example, for older people, you know, wine selection and beer selection, seltzer is going to be big, big. more than 200 different items just for alcohol. And we don't display alcohol for students, for kids outside. We have special room for that. You go inside and you see everything inside. Not like display outside or, you know, like other store. Why? Because I especially work with the school district students. I see when students getting what their mind. So we really work with the teenage, make sure they're happy. Also, we want to make sure their parents, mom, dad happy. Oh, my son and liquor store over there. or with sabi or circle k they call circle k they don't feel like oh they don't worry about when when they they hang out there and you know it's a big different service personal touch and also believe me or not And we have dining in Danuba. We don't have dining here. We have dining for McDonald's only. My C-store have dining. Sometime parents late from their work, or they say, let's go to Sidhu or Circle K, stay there, I pick you up. And kindergarten students, elementary school students, they come to us. They sat down, they got a cup of water, whatever they need, they eat or drink. Parents don't have to worry about anything. This is the service we're going to bring this town. And I believe, you know, have the service with the other store, this and that. And another thing that's going to be beauty for the Selma when you coming from with the McDonald color, and also with the Circle K new color. Circle K have whole new concept inside. It's not, they change big time. So we have a bigger canopy for the gas station. As we going to be offered digital regular gas and E85 and other stuff there. California have couple other service we are looking into. That way you can get what you want and you're local in the corner, you know, in the neighborhood. so the other thing we work with the students teenage make sure we don't have beer run we how we change their personality when they walk in and we have training and my employee and whoever work there make sure and in januba i've been there since 2004 not even one beer run Only my store, if you call other one, other store have. Why? Because we work with the different way to with our guests, especially with teenage. And also the parents, they love coffee and older people, they love coffee. We have a coffee and we share the money with the community. Like sometime you purchase the coffee. We have this month you purchase coffee and dime per cup go to the students or maybe in the local community. And we work different, different things. We just don't take the money to go home. And we work with school district sponsoring and we work with the Kiwanis and we work with notary club. We're going to rejoin all the club. It's been fun for us, and you're going to see after. Today, we're just talking about we're going to approve, and please accept us. If anything needs to be done, change, requirement, you know, safety, we talk about, I'm not engineering, but we have city engineering here, you know, that you're talking about left turn in Macau. And all my life, I'm in the C-store, in the parking lot. This is the first thing I see. If grandma coming to my store, like 95 year old, I want to make sure she is safe to go home. And when I work, he, grandma, can you make right turn? She say, why? Oh, don't make left turn this hard, okay. So your question for the left turn McCall, if I go there, I no need to go McCall to make left turn. I'm not engineering, but just common sense. So I can go Danuba. If I need make turn, I no need to go McCall. And we have a driveway in the Danuba Avenue. So we go there and have stops and make left turn. So easy. So this is top sign going to be there. And I think we do all your requirement, anything. So anything. Also, we have a special guy here. He's the professional engineering. He can answer. I just want to, again, thank you for Megan, your report. You're great. We bother you like almost three, four years every day, this and that. Morgan, Joe, and other guy, I think he left yesterday. But we are looking for opportunity to move forward in your town. Please welcome us and community if any question. I have a question. What type of gas are you selling?
Good evening. I'm Alex Cuevas with AGC Design Concept. We are the architectural firm for this project working on the engineering. And actually, Megan, the presentation that you did, I do a lot of projects. I do similar to this, big ones, and you're amazing. You didn't even look at the paper. You just had everything in your brain. That was excellent. Anyway, to answer your question regarding the gas, we'll have 87, 89, 91, and also we will have, what is it, E85. And what else are we going to put in? And diesel, of course, the diesel. So we're going to have all type the gasoline on site.
Is that what it said, Circle K? Is it Circle K?
Yes, it is. Yes, Circle K. And actually, this project is very unique. We do a lot of gas station truck stop, but I think it makes a big difference having McDonald's together with us because it's just a different kind of clientele and it's going to be light up. It's going to be very safe for everyone. And the other McDonald's in the city is not going to close. That's one of the things that we know for sure. It's not going to close. question that you have earlier for the recycling of the water. We do recycle water. I mean, everybody claims a hundred percent that's not true, but isn't about 85% of the water. It goes to like three process that goes into one of the containers. This is under the ground and then it goes to the next one. It gets clean and clean and clean and it returns.

And you reuse it. There's about 80% give and take of what is reusable. You had another question. Something about it was not clear on the left turn and what have you. Yeah. It seems to me what they're talking, I mean, not the left turn, I'm sorry, the parking. It seemed to me what they meant to say was to remove the striping when we do the dedication.

That is correct.
Automatic. It doesn't require a person to stand up.
No, it's unattended.
Is it noisy?
No, it's not. And on top of that, the noise that is coming from the car wash, it comes from the blowers, the dryers, and that's facing the street. The noise ambience is more on the street.

And you said the original McDonald's is not going to close? No, it's not going to close. And what will be the hours for the new McDonald's?
It's... We don't know exactly the time, but they open very early and they close. They're just waiting for us to get the okay from you guys, so that way they can proceed. Same with us for the construction documents.
I might have missed it earlier, but you said Circle K. Do you own the other Circle K in town? Okay. It's corporate owned, but this is basically going to be private owned and just, it just a franchise, but privately owned.

yes yes if i may make a point of clarification the mcdonald's application that is shown in this in this application site plan it is a completely separate project and permit so it's not affiliated it's shown in here as sort of a shadow plan because they have shared circulation and there are some conditions of approval that are proposed to accommodate for that but it's an unrelated application and project There's also, regarding noise and the hours of operation, there is a condition of approval proposed that if any portion of the approved development operates outside of normal business hours, which per the noise ordinance would be 7 a.m. to 10 p.m., All operations, equipment, and activities shall comply with that noise ordinance, which has specific levels of allowed decibels. And there's a condition requiring a nine foot tall block wall on the northern property line to separate this use from future planned residential use.

Teresa Salas, 1701 Dinuba Avenue. I'm going by what the staff report said. It said a 24-hour car wash is I was concerned with the noise level because the dryers, that kind of thing, if it's 24 hours and if there's going to be residential around the area, I would be concerned with that. That also said it was a 24-hour sale of alcohol, a full line of alcohol. This is, I'm just going by what the staff report said. It said 24-hour sale of alcohol, and it was a full line of alcohol. The conditional use permit approval was needed. We do have a liquor store just across the street from there, and so I'm concerned. I know that when I was on the planning commission, there was a, the Mercado wanted to start selling... The grocery store, I mean, that's just the gas station and the convenience store. It is going to look like to be able to accommodate that much traffic that goes out of the front along with a lot of you.
So I'm just trying to see the good and the bad in this and for the future. And I might not even be around much when all the homes come.
