like to call the order of the planning commission meeting. It is 4:30 on Thursday, July 31st, 2025. First order of business is the approval of the minutes from the May 29th, 2025 meeting. minutes have been approved. Um the next item is the simple lot division at 1300 Oak Street City. Okay. The um applicant in this case is um Glenn Wake. the legal description. Um, we simplified it a little bit and are just calling it part of Mount Lot 174 and 175. Uh, the property is located north of Oak Street and east of Raymond Drive. Um, deadline for a decision on this matter is September 22nd, 2025. The land use designation in the comprehensive plan is low density residential. Surrounding land uses in the comprehensive plan to the north is low density residential. To the east is low density residential. There is no industrial. That is a mistake. Uh to the south is low and high density residential and to the west is low density residential. The zoning designation for the property is AOS, agricultural open space. The surrounding zoning is to the north is AOS. To the east is RT2 AOS and R1. R1 being a single family residence district. To the south, it's um R1 and R4, which is highdensity residential. And to the west it's AOS and R1. The um current site use is property is

vacant. Um area land uses uh include to the north it's vacant and then a farm site to the east vacant and then single family dwellings. To the south single family dwellings and multifamily dwellings and to the west it's vacant and single family dwellings. Notice none is required public comment none received to date. Um Glenn Wake is the owner of all or portions of all lot 174, 175, and 176. Mr. Wake is proposing to sell portions of 174 and 175 to Bradley Alman at all. I might note that the at all includes Lisa Langanger. So, she's here representing um the um applicant. Um the Alman property is legally described as lot one block one third edition. That lot fronts on Oak Street. Land to be purchased would match the side property lines of the existing lot. The rear property line of the current property is very steep. The acquisition of the property to the north would expand the size of the lot. The total amount of land being sold is approximately a half acre. Access to the property would be from both the wake and from the uh property itself. There are no buildings on the property. Approximate dimensions of the property are 200 by 100 105 ft. Uh the

proposed legal descriptions can be found on exhibit A. There are five attachments. Um attachment one is the simple lot division petition. Attachment two is a site location map. Attachment three is the zoning map. Attachment four is a site map. And attachment five are ground level photos. And John has on the video monitor. Um an aerial photo of the property. You can see Oak Street at the bottom of the uh page. And you can um the blue shaded area is what would be acquired in the area in between the street and the u blue shaded area is the um applicant's uh property. Um staff would recommend approval of the simple division with conditions since it complies with city code requirements. Um there are conditions. There are actually five of them. Um the first is that the approval is subject to the applicant recording the resolution authorizing the simple lot division with the Brown County Recorders Office. Number two is that parcel A and would have to refer you to the exhibit one where the legal descriptions are. Parcel A will form one parcel of property for tax and building purposes with lot one block one wakes third edition. Number three, parcel B will form one parcel of property for tax and building purposes with lot one block one wakes

Number four, parcel A and B and lot one block one awakes third edition will be confin combined to form one lot and will be so platted with the next plat adjoining any part of this property. This is a condition that we have uh used in the past. And number five is that parcel A and B will be reszoned

to R1 and that um again should be done with the next reszoning that takes place in that particular area. That's also an action the planning commission could take itself if it's so desired. Um there are two motions. One is to recommend approval. The other is to recommend denial. And that would conclude the staff report.

Explain the reasoning to me one more time that we could take the initiative now to the the plan planning commission can initiate the reszoning of property. You have that um that's one of the um authorities or powers that you have. Um um and um or we can wait until some other property in that area that adjoins it were to be petitioned for resoning and then what we would do is just attach it with that.

That's um that's up to you if you would would like to do that. Um there there's really no compelling reason at the present time since no action's going to take place. Sure. I'm Lisa Langanger and uh we would be the purchasers of this piece of property. So, if if you came to my house and you looked at our yard, you would say, "Well, this makes all the sense in the world." Um, and I think some of the pictures as you go through it, um, demonstrate that we're already planting a garden and flowers and with Glenn's approval, it's it's just a steep hill side. So, but it we had a variance when we built our house. So, we're like 5 ft from the back of that, you know, property line. This would just

questions on it. I mean, it's pretty straightforward. you know, it's just adding on to the property and it's in the same format. There's nothing, you know, unusual about it, you know. So, look, that's a that's a good space for the garden. Is there currently access from the back side of the property? I there's a note in the report that there's access from two ways and I don't know. There must be off the gravel road behind some way to get in. Is that what they're saying?

Well, Glenn Wakes driveway goes above so you can see it, but there's an old road going down. But our driveway goes up the side. Okay. On the left side and then comes comes around back sort of circles. Does it um it it curves around and puts a garages on that back property there. Okay. I I I think it's an unusual neighborhood, but the application's pretty straightforward. 4:30. Next item on the agenda is city city city council decisions concerning planning commission matters in June. Okay. um at the July 15th one, but um not the uh July 1st one. So, we'll give you a July 15th.

It works. Um at that particular meeting they held the public hearing on the final plat of the Highland Apartments edition that is also referred to as the keepers project. The address is 901 North Highland Avenue. Um there were four lots, one outlot and one street. And I believe that they closed on that uh property today since uh we uh had to provide a number of um resolutions uh for that purpose. Um they had um the final plaid of um there they had a public hearing on the final plat of Land Haven Edition. That's at uh 2211 Jacob Street. That is a property that will be subdivided into 28 lots, two out lots, and one street. Remember, it's a kind of a private development. Um and that project is um proceeding. We're in the discussion of the development agreement at the present time. And that's really the last item. Um we had um second consideration of ordinance number 2025-109 that is for project spark that is um located on South Minnesota Street uh behind the Riverbend school. Sure.

That's for tiny homes, 15 of them. Um they had the um second consideration and well no that's excuse me uh they had a request for additional tax abatement assistance by M andD Properties LLC and that would be at 2229 North Highland Avenue. Uh currently they have uh six uh town home units there and they're proposing to build a second row of houses behind that and there would be I believe yeah as I said six uh six six more. They currently have I think eight units in the um first row. Um they also had a um council um approve the development agreement with Highland Apartments Edition. Again, that's at 901 North Highland Avenue. Um and then finally, they had a request for tax abatement assistance from River Haven Housing. That's the project at 1800 North Highland Avenue. Also, um has some frontage on Maplewood Drive. Uh there's 118 units and there's some u fairly large numbers with that project. uh $980,000 uh to um River Haven for both project expenses, also some street expenses for the um new services that they have to put in place. Then the EDA would get

$120,000 and that is for providing the money uh that was used to purchase the property. And if you give me just a second, I cannot find it. That would conclude the report. Thank you.
