You can see from all the corners that come here, it's a new place that the Cuban community, also the Nicaraguans, Venezuelans and others, can come and join us and ask for freedom.
My father made this sculpture in 1984. It's a monument to the patriots who fought for the independence of Cuba. Ciudad Los Ramos did an excellent job. I am very proud of the work they have done and very happy.
Today we are doing the ribbon cutting of the new code compliance office as well as my district office here in historic Overtown at the Overtown shopping plaza and code has a permanent office. They are no longer displaced. They will be able to serve the Overtown community right in its backyard as well as my new district office and I'm so excited.
For the first time, GSA got to do some work where we actually get to give something back to the community that they touch on the regular. Normally we do internal service, but this is the one time that we got to give them a fresh new space, fully renovated, and they can come and have an essential place to come and answer all of their questions.
We're extremely grateful for this amazing space. It gives us the opportunity to work alongside the commissioner's office and service the community right here in the front yards. So it works out for the both of us and we plan to utilize it to the best of our abilities.
We are celebrating the newly renovated community center and office for Chairwoman Commissioner King. It was done by our general service administration department. This is also an enhancement for our parks and the community. They'll be able to use the new center.
This is a park that is very busy during the summer with lots of our student programs and summer programs for the kids. It was very important for the chairwoman that this park be tended to and given some love and GSA was brought out from the woodwork and we got to redo the finishes and renovate the park to better suit the community and the kids that we serve.
So this is something that we have been working on for quite a while. Our desire to serve the community in the best way we can. This is going to have a huge impact on the community, on the kids that come here to do their homework.
We did a lot of the community rooms and spaces, and I think it's so great that they can come here to their new renovated community center.
We are cutting the ribbon, christening this new community center for the kids and for the community. GSA did a fantastic job of renovating this space, updating it. The IT department also updated, internet connection, 12 laptops were donated for the kids. It's also my district office on the other side, but the bathrooms have been renovated, the floors have been renovated. The kitchen area was renovated. Staff's offices were renovated. It's just a space that everyone can be proud of.
We submitted our application for 10 units to be renovated and these are the first two units being delivered of the 10. These homes are completely renovated top to bottom. They are completely brought up to code, to hurricane code and energy efficient standards. They're 455 square feet. They have Energy Star appliances, granite countertops, tile bathrooms and a washer and dryer in each unit.
The Department of Housing Community Development served as the project manager for this project, monitor the construction and make sure that the monies are put to good use.
We now are able to offer most persons who normally would not be able to afford housing in this area an opportunity to move into Grove and many persons who moved away desire to move back to Copeland Grove area. An awesome feeling to be able to know that we're in a position to be able to offer some people that opportunity.
Couldn't be more proud to be here launching the first two of 10 units of the Hibiscus Project. First of all, we took a few dollars from our pandemic funds, and we dedicated it to affordable housing right here in this neighborhood. In partnership with Dragonfly Investments, Amanda DeSenta, and AME Christ Episcopal Church, we've come up with these units, which will make affordability in a historic district in the Grove, Little Bahamas, a reality for folks. Well, we are here to honor the memory of Margarita Faroy and the House Faroy and what she represented in the community.

These hearings are conducted by the City of Miami Hearing Officer, the purpose of which are to give alleged violators the opportunity to appeal the decision of the code enforcement inspector, which resulted in the issuance of a civil violation notice. These hearings are conducted in a quasi-judicial manner, and I am the hearing officer assigned to hear today's cases. My responsibility is to act much like a judge in court, that is, to hear the evidence in cases presented by the code enforcement inspectors, and then to hear the evidence presented by the alleged violators. These hearings are open to the public. It is required that all persons who are going to be testified be placed under oath, which you all were already, as to the facts placed into the record. The code enforcement inspector in each violator will be placed under oath. These hearings are not conducted in accordance with the formal rules relating to evidence and witnesses. Any relevant evidence will be admitted if I find it to be competent and reliable, regardless of the existence of any common law or statutory rule to the contrary. All documentary evidence must be submitted for placement in the hearing file. No documentary evidence will be considered unless the alleged violator or code enforcement inspector submits a copy for the hearing file. Each party shall have a right to call and examine witnesses, to introduce exhibits, to cross-examine opposing witnesses on any matter relevant to the issues, even though that matter was not covered in the direct examination. you will have a right to impeach any witness regardless of which party first called the witness to testify and to rebut the evidence against any witness. It is my responsibility to make findings of fact based on the evidence of record. The fact-finding determinations of the hearing officer are limited to two. Number one, whether the violation did occur, and secondly, if so, whether the person named in the civil violation notice can be held responsible for that violation. In order to make a finding upholding the code enforcement decision, I must find that by a preponderance of the evidence indicates that the alleged name violator was responsible for the violation of the relevant section of the code as charged. If I affirm the decision of the code enforcement inspector, my order will specify, number one, the amount of the civil penalty, and secondly, the amount of the administrative costs of the hearing. You are hereby also warned that failure to comply with the violation by the date upon which the violation must be corrected will result in automatic referral to the code enforcement board, which may result in the imposition of additional fines The alleged violator or the city of Miami may seek to overturn the order of the hearing officer by making application to the Miami-Dade Circuit Court Appellate Division within 30 days of the issuance of the order of the hearing officer. After the code enforcement inspector has presented his or her case and you have presented your case, I will consider the evidence and then render a decision. We will now commence with the proceedings, and the clerk will call and introduce the first item on the agenda.

Correct. summons for today which they got because they're here so that's good and also the affidavits for that yes we have a copy of their appeal yes i'll leave it there very quickly i'm not quickly on pages uh nine and ten so you can read it all right i'll read it into the record okay after you received the citation you um filed an appeal of this matter correct
And part of the appeal, you wrote, I would like to appeal because I did not receive notice of the citation until August the 4th of 2025 when the inspector posted a notice on the gate of my property. As of today, I have not received a notice of the citation on my mailing address. Such important notice like this should be posted on the front of the property. Number two, sent a letter to the mailing address of the owner's property. Considering that one and two did not occur during the 30-day lapse period, therefore the citation was not issued according to the rules of the county and cities. For this and other reasons that I will clarify later, I am appealing the citation and humbly request that the board grant a hearing on this inappropriate ticket. The pile of trash located across the street from the property had always been there and collected once a week by the city employees. I just replaced my old to a brand, I guess you replaced your old roof with a brand new roof, which was done by a licensed contractor who was hired by All American Waste Disposal for their trash on November 27, 2024. The trash inspected across the street together with the non-moving car is still there as of August the 5th of 2025, has nothing to do with my property. Was that your appeal?

It shows that there are tiles on the property that you own that's being leased out by a tenant, and that some of those tiles also appear across the street in the pile. So what the city is saying is that not everything in that pile came from your property. They're saying that those tiles that were on the side of your property are also the same ones across the street in the pile.
Okay, so that's exactly my confusion here. How do we exactly say we are the same people that put those tiles in the trash?
Well, first of all, I don't think they're saying you did it, okay? But as the owner of the property, you're responsible, okay? It seems that it's very, if you wanna use the word coincidental or odd, that the tiles that appear across the street in the pile are also located on your property. Now, if they weren't on your property and they were just across the street, I think you would be absolutely correct. How do you know that it came from your property? But the fact that it shows on this photograph that those same tiles are on your property. So one can conclude that those tiles came from your property.
That's why we're saying that we didn't even do any work about tiles.

And I call, I call City Miami 12 times already to tell them they have to stop the people in this area to dump on this area because those people is living. When I spoke to my neighbor, they said they don't know anything about it because the people is coming at night to dump those things.
I don't deny that, and that's the problem, is that when people see an area where there's a lot of debris... they figure that it's a free-for-all and they can just throw stuff there too, that the city will just come by and clean it up. So do you have any other questions of the code officer?

Okay, when she came to my office to ask in reference to the ticket, I explained to her, she explained to me that the neighborhood do put trash there because it's in front of an empty lot. I explained to her, we do not have a community dump, this is not a little, you cannot put that there because you're putting it in front of someone else's house. I explained that part to her. Now, anything that has to do with construction, this pile did not only come from her, but there are portions that came from that property. No, no. And the roofing that she did was in 2024. We're in 2025. The ticket was issued in 2025. Her roofing was from 2024, and when she showed me, it was one of our illegal haulers because we do not work with that hauler. But she did it. It happened. She... was able to go and do her roof, but this was in 2024. Now we're in 2025. They do it anyways, knocking your door, asking for $5, which we don't do that anymore. But we grew up there, and that's an ongoing issue. Around that time, two days prior, he had a knee replacement. He's already disabled, but he had a knee replacement, so he had to be on bed rest for like a month or two. My stepmom, which is his wife, doesn't speak no English at all. She's not from here. And as she was outside, I think she was cleaning the patio in the back, a homeless person approached her. She didn't understand him. Obviously, he's probably asking to take the trash out for money. They're tussling over the trash can at this point because she doesn't want him to take it. Got aggressive. You know, any logical person would let go. It's a safety issue at that point. He took it. She went upstairs to tell him, but it's just them two. They live alone. We don't live with them. So he couldn't really do nothing about it because he can't get up. And we ended up finding a notice and seeing that he dumped it, I want to say, a street and a half from where we live. We couldn't do nothing about it at the moment because, again, we don't live together. And we also have the proof with the whole surgery and him getting out of the hospital two days prior to that.
Okay. I just want you to understand one thing. The city's not saying that your father put that trash there, okay? Do you understand that? What the city's saying is that trash that's located in this photograph came from your property. Yeah, 100%. So even if the homeless person did it, ultimately it came from your property. Now let me ask a couple questions here. Where do you keep your trash? In a trash can. Okay, and where's that trash can located?
In front of the gate where we're instructed to leave it at. Okay, what days? Okay, I didn't get to explain. So it's a gate, she's inside our gate, and the trash can has to remain outside in order for the waste management to pick it up. It's outside, so it's easy access to the people.
When are your pickup days? Monday and Thursday. Thursday.

so it must have been there for a little while but this was on a Wednesday and you don't know what day this occurred honestly we ended up if I believe I can't remember correctly we didn't even end up finding the trash can until days later we didn't know where it was dumped at because he took off again if I was there none of that would have happened but At this point, it's a safety concern. I don't think anybody in this room would go back and forth with a desperate homeless person over a trash can. I'm pretty sure any logical person would let go.

No, he did. Oh, he 100% did. Yeah, he did. But that's what they do. I've grew up there since I was a baby. That's an ongoing issue there. They would do that and expect them to get paid and get aggressive. They don't. And again, they know me there, but they don't know her because she don't come outside much. She travels a lot back to her country because of her peoples over there. With me, it wouldn't have happened, but with anybody else that they're not familiar with, they will try to play those games and try to muscle you into getting what they want. It's an ongoing issue, and it's a safety issue at that point, and I wouldn't blame anybody for letting them take the trash. But our concern is that I get that it was our trash, it was inside our trash can, but if you're repeatedly telling the people that continuously do these things over and over, I don't want you doing that, I don't want you doing that, and they continue doing it, It's a respect thing that they don't respect, and it's kind of out of our control, unless we start getting physical, and we're not trying to do that.
No, no, and I'm not suggesting that you do that, but let me ask you this question. Are there any cameras on the property?
Yes, which we actually called, well, my brother called, to try to get the cameras, I believe, is... an apartment building in the front. He went in. They didn't want to give him access. And I'm not sure if someone in the corner, he also called. I'm not sure what number he's called. He's not here. He had to take his wife to work. But he also did call. He can't get access. But there is cameras. If you guys can probably get access for us, you would see that it's a homeless person.
Okay. Well, the problem that I have here is the city has, let me tell you what I'm faced with. The city has a document that clearly came from your property. I know that you didn't put it there. That's your testimony, okay? And that your father didn't put it there. But it came from your property. And you don't have, number one, your stepmother here to tell me about the situation. You're relaying it to me. It's considered hearsay, number one. Number two, there are no photographs or cameras or anything showing that there's, you know, that somebody else took the garbage from you. Do we know, Inspector Harris, about what time they come and pick up garbage, or does it vary on Mondays and Thursdays?
So this would actually fall under our bulky waste, which is picked up on Tuesdays in the area. However, that is a city lot, so that would require essentially someone from our operations department to go and service our lot.
No, no, no, I'm talking about their property. Right. Not where it was found, but their property.
So their property is severed for bulky waste on Tuesdays. Okay. When you say bulky waste, is that just regular garbage? No. Bulky waste refers to larger items such as a fridge, a mattress, things of that nature.
What about for the regular garbage? Let's just assume these documents got there on their own, not everything else.
If it was regular garbage, it would be Monday morning and Wednesday. Okay. Not Thursday. I'm sorry, Monday and Thursday. Okay. And the time frame, it's generally between, the trucks start at about 7. So somewhere between, I would say 7 and 10 is normally when they would service most of our containers.

You hear that? May I add two things? Sure. One, you said that there's no cameras. We try to get access. I mean, I think it's out of our control if they don't want to give us access or certain processes you've got to go through to get that type of camera angle. And two, I would like to ask, how will we go forward with an issue that is uncontrollable on our end and can continue to happen And then we're not really getting no help as far as in that neighborhood as to control that aspect of it. Because, again, it's a free fall in some areas. Again, it's a lot of homeless, a lot of drug addiction, a lot of alcoholics. So how do you move forward? Because we can say, okay, we'll pay it now. And it happens while, let's say, he's gone. And it happens again. And we don't know what happened. Maybe they returned the trash can at this time, and they go and dump it somewhere else with his name and stuff on it, with trash, like here. How do we move past at that point when it's a continuous... Did the container ever come back to your house? No, I believe we found it. I believe we found it.
Oh, okay. So you didn't have to, like, call the city and ask for a new container, right?
I don't think anybody would have came. If we've had issues like this, nobody would have came.

First time, okay. So it appears that this doesn't happen a lot. What I would suggest to you are a couple things. Number one... You may want to invest in getting cameras. We did. So if this occurs again, the inspector is telling you that the garbage is picked up on Mondays and Thursdays, and your father has confirmed that from roughly 7 a.m. to 10 a.m. I would suggest not putting it out on a Saturday night or leaving it out there Monday or Tuesday to pick up on Thursday. Okay. You may want to, I don't know what time he gets up in the morning, but to try and put it out outside the gate at those hours, because you know when your pickup is. But this, to me, clearly came from your property. I don't know who did it. I don't hear anybody here saying they saw a homeless person, they were confronted, they were concerned about their safety. And that's the problem I'm having. Your stepmother's not here. You don't have any cameras. And I will tell you, if you get cited again for this and you have a camera and it shows somebody actually comes onto your property and takes your stuff and it gets found elsewhere, you're going to have a very good defense showing that you should not be held responsible for it.
Can I add something? Sure. And this is without due respect. Her being here in person, would that have made a difference? Sure. Of her saying, I did it? I mean, you guys are clearly saying, and this is without due respect. I don't mean to sound, come off disrespectful, but you guys are saying it clearly came. It's a safety concern. If a homeless person that is desperate for some money is getting aggressive with you over a trash can, Let it go.

So I'm willing to find that the violation did occur, that the person named in the citation is legally responsible, the violation is affirmed, and the amount of the penalty is $300. Okay. It appears that your property, located 3570 Hibiscus Street, was cited by the city for container garbage, trash, industrial, other waste placed in the right-of-way. I guess you cleaned it up back in September of 2025. You were issued a citation for that, but the citation remained unpaid. And the citation was a $79 citation for keeping the... trash containers in that location. How do you plead to that offense? Guilty or not guilty? Not guilty. Okay.

No, that's how they always kept the containers. And prior to that, I issued a warning that the container cannot be placed there. Also did an educational blitz with me and two other coworkers where we went around different areas where the containers were always kept out on the street. I posted the educational blitz pamphlet on their gate. And on the day that I went by again, I saw the contact, which there's a lady that she sends in different locations all the time. And theirs was one of them. So that's why I went previously went by that location. And this is the, this is the property itself. Correct.

And the bins would be, is that off to the right, right, right there to the public right away, right there, right here. Okay. And so, And you've been by there and just seen the bins there, pickup day, non-pickup day. It's just where they're being kept. Correct. Is that correct?

So I have a picture of the way we place the bins when the trash pickup is coming. So here's the
Oh, I can see them.
You're claiming that you put them in the street area. Well, we don't put them by the curb because the way the street is constructed, there's a tree planted here with a retaining wall around it. It's not really a right-of-way. Nobody walks there. Nobody can park there. Nobody can even ride a bike there because there's a little section of curb about one meter wide there. That's all. then a retaining wall the trash pickup truck cannot swing into the curb to pick up the trash because our driveway is there there's a car parked there all the time so we put the bins out on this um rain runoff uh you know the where the rain runoff goes and that's never been a problem we always remove the bins right away after trash pickup um And our family was away all summer. We were out of Miami from the end of May until August 18th. That's apparently when the educational blitz was sent. When we came home, we found it. It's a piece of paper. It says, please remove the bins away from the curb after trash is picked up. And I was confused because I say, this is where we leave our bins. We always move them away right after the trash is picked up.
And where do you remove them to?
Well, the picture that the court officer took is similar to one I took. This is the way that we had the bins placed. It's been at least a year we have been doing that. Nobody's ever mentioned it's never been a problem. When I saw the paper that said, please remove the bins from the curb, I was confused. I thought, where is remove the bins? This is some kind of mistake. And I put it aside. I didn't think about it. And then when the code officer was there, I found the car there. She was doing something. I asked, excuse me, what are you doing? I wanted to understand what the situation was. She didn't want to tell me what she was doing. And that's how the confrontation that she mentioned started. We don't need to go into that. I ascertained that she's writing a ticket for improper placement of the bins. I tried to plead with her not to write a ticket because we didn't understand what was wrong with where the bins were. I think any reasonable person would say that this is not physically a right-of-way.
Well, I don't know what a reasonable person would say, but I will tell you what property records show. If you get a survey of the property, clearly that is a right-of-way.

He comes back out with a paper that he say he threw away. He says, is this what you're referring to? I said, correct. That's it right there. And as I posted the ticket on the gate, he snatched it down.

So I said, sir, I need to take a picture of that. And if you'll see in one of the pictures, he's holding it for me to take the picture. Okay.
Does your documents show when you gave warnings?
It's not included in this one. We can, if you want to.
Right, and he says that no one was there. There's a lady that lives in the house, she has black hair. I've seen her several times walk down the street and put tree trimmings.

And I wanted to show one other thing. These are examples of two other houses on our street, Franklin, our houses at Hibiscus and Franklin. This is two examples of bins that are left out. These pictures were taken on Monday morning. So that is 24 hours before trash pickup.
Okay, well, two things. Number one, you don't know if they were cited. I'm just saying. They may have been cited. I'm just saying.
This is something that we see regularly. This is a typical week.
Well, that's the problem.
And any week you come, you would see the same thing.
Well... that's what the officer is saying, that that's a problem in this neighborhood, is that people are leaving them out, and that's why they've tried to do an educational course.
Well, we understand that, finally, and we bring the bins inside, inside the gate now.
Madam Magistrate, the property owner has already admitted that he doesn't understand what the public right-of-way is. That's his issue. That's not the city's issue. This is clearly in the public right-of-way. It is on the other side of the sidewalk. He's got them there. You can't put your bins out 24 hours in advance. It's supposed to go out the evening before the pickup, and then you remove it 24 hours afterwards. In this particular case, even for the Friday pickup, this wasn't... The blue bin should not have been there, and the green bin certainly had been there. He admits they kept them there, and they pulled them back. The property is guilty of the violation, whether he understands or not.
I understand your position. Sir, do you have anything else that you want to say?
Well, I understand that it should have been a warning that we understood... to bring the bins in. There was no chance to receive or respond to such a warning. So I believe it's not warranted to give a fine.
Are you denying the fact that you were warned beforehand? Are you saying that you were never warned?
We weren't given a warning. Because the paper that we read, it says, remove the bins away from the curb. And in this particular case, the bins aren't on the curb. They can't be at the curb for the trash pickup because of the way the wall is created there. So we always remove the bins away from the place where they were for trash pickup.
He's not entitled to a warning. Please, please. The problem that I have here is that your pickup is, according to the inspector's testimony, is on Mondays, I'm sorry, on Tuesdays and Fridays. This photograph was taken on a Thursday, and that's for your garbage. Your bulk or your recycling, which is the blue can, is picked up, I believe she said, the fourth Tuesday of every month.

This is not where we even leave the trash for pickup. The trash comes in a truck and they have an automatic arm that takes them and puts them in. It's impossible for them even to take the trash from where they are. They're at that next to that wall.
Okay, but these items, they came from your property. They're your garbage containers. Are you telling me now that maybe somebody put them there?
No, I'm saying that that's not where they are for trash pickup.
He thinks this is about where he's putting them for pickup. I understand what he's saying. He's saying that he does not put them there on the days of pickup. I get that. But they're put there and they're stored there on non-pickup days. That's what it looks like to me.
Well, we didn't understand, neither I nor my wife, that that was an inappropriate place for storage.

Okay. Well, a couple of things. Number one, there's no requirement to give warnings. That's number one. Number two, I find that you did know and you did have a piece of paper. And if you didn't understand it, I am almost positive there was a number on there or contact information. You should have done your due diligence, and you should have contacted the inspector and find out what is this all about. Even if you were gone all summer, and I believe you were. You said you were, and I trust that you were. But these items cannot remain stored here. And from what I'm seeing, it looks like on a non-pickup day for either garbage or for bulk, which is a Thursday... Those items were there. I don't believe that the officer moved them and put them there. I don't believe that the garbage department placed them there. That's where they were being stored. It's a lot easier for you to come out of your gate and dump it in this container than constantly having to roll these things back and forth. But unfortunately, that's what the law is and that's what's required. And it sounds like there was no enforcement for a very long time in this area. And all of a sudden now the city is cracking down and enforcing it for whatever reason. Maybe it's becoming a traffic hazard. I don't know. Maybe it's an aesthetic issue. I don't know. But clearly these items should not have been there that day. So I'm going to find you guilty. I'm going to fine you $79, which is the citation amount. And I am going to also assess prosecution costs of $50 for this, so making it a total of $129.
Why are you assessing prosecution costs for me when you waived it for everyone else?
Well, I hear each case on a case-by-case basis. I think that you knew that this was wrong, that you should have done something. And you didn't do it.
No, we absolutely didn't know. That's what I'm saying.
