You can see from all the corners that come here, it's a new place that the Cuban community, also the Nicaraguans, Venezuelans and others, can come and join us and ask for freedom.

0:15 – 0:30Speaker 6

My father made this sculpture in 1984. It's a monument to the patriots who fought for the independence of Cuba. Ciudad Los Ramos did an excellent job. I am very proud of the work they have done and very happy.

0:42 – 1:05Speaker 28

Today we are doing the ribbon cutting of the new code compliance office as well as my district office here in historic Overtown at the Overtown shopping plaza and code has a permanent office. They are no longer displaced. They will be able to serve the Overtown community right in its backyard as well as my new district office and I'm so excited.

1:06 – 1:21Speaker 29

For the first time, GSA got to do some work where we actually get to give something back to the community that they touch on the regular. Normally we do internal service, but this is the one time that we got to give them a fresh new space, fully renovated, and they can come and have an essential place to come and answer all of their questions.

1:22 – 1:37Speaker 27

We're extremely grateful for this amazing space. It gives us the opportunity to work alongside the commissioner's office and service the community right here in the front yards. So it works out for the both of us and we plan to utilize it to the best of our abilities.

1:46 – 2:02Speaker 17

We are celebrating the newly renovated community center and office for Chairwoman Commissioner King. It was done by our general service administration department. This is also an enhancement for our parks and the community. They'll be able to use the new center.

2:02 – 2:21Speaker 29

This is a park that is very busy during the summer with lots of our student programs and summer programs for the kids. It was very important for the chairwoman that this park be tended to and given some love and GSA was brought out from the woodwork and we got to redo the finishes and renovate the park to better suit the community and the kids that we serve.

2:21 – 2:34Speaker 38

So this is something that we have been working on for quite a while. Our desire to serve the community in the best way we can. This is going to have a huge impact on the community, on the kids that come here to do their homework.

2:34Speaker 35

We did a lot of the community rooms and spaces, and I think it's so great that they can come here to their new renovated community center.

2:41 – 3:16Speaker 28

We are cutting the ribbon, christening this new community center for the kids and for the community. GSA did a fantastic job of renovating this space, updating it. The IT department also updated, internet connection, 12 laptops were donated for the kids. It's also my district office on the other side, but the bathrooms have been renovated, the floors have been renovated. The kitchen area was renovated. Staff's offices were renovated. It's just a space that everyone can be proud of.

3:24 – 3:46Speaker 36

We submitted our application for 10 units to be renovated and these are the first two units being delivered of the 10. These homes are completely renovated top to bottom. They are completely brought up to code, to hurricane code and energy efficient standards. They're 455 square feet. They have Energy Star appliances, granite countertops, tile bathrooms and a washer and dryer in each unit.

3:46Speaker 15

The Department of Housing Community Development served as the project manager for this project, monitor the construction and make sure that the monies are put to good use.

3:55 – 4:16Speaker 8

We now are able to offer most persons who normally would not be able to afford housing in this area an opportunity to move into Grove and many persons who moved away desire to move back to Copeland Grove area. An awesome feeling to be able to know that we're in a position to be able to offer some people that opportunity.

4:17 – 4:56Speaker 1

Couldn't be more proud to be here launching the first two of 10 units of the Hibiscus Project. First of all, we took a few dollars from our pandemic funds, and we dedicated it to affordable housing right here in this neighborhood. In partnership with Dragonfly Investments, Amanda DeSenta, and AME Christ Episcopal Church, we've come up with these units, which will make affordability in a historic district in the Grove, Little Bahamas, a reality for folks. Well, we are here to honor the memory of Margarita Faroy and the House Faroy and what she represented in the community.

5:11Speaker 4

These hearings are conducted by the City of Miami Hearing Officer, the purpose of which are to give alleged violators the opportunity to appeal the decision of the code enforcement inspector, which resulted in the issuance of a civil violation notice. These hearings are conducted in a quasi-judicial manner, and I am the hearing officer assigned to hear today's cases. My responsibility is to act much like a judge in court, that is, to hear the evidence in cases presented by the code enforcement inspectors, and then to hear the evidence presented by the alleged violators. These hearings are open to the public. It is required that all persons who are going to be testified be placed under oath, which you all were already, as to the facts placed into the record. The code enforcement inspector in each violator will be placed under oath. These hearings are not conducted in accordance with the formal rules relating to evidence and witnesses. Any relevant evidence will be admitted if I find it to be competent and reliable, regardless of the existence of any common law or statutory rule to the contrary. All documentary evidence must be submitted for placement in the hearing file. No documentary evidence will be considered unless the alleged violator or code enforcement inspector submits a copy for the hearing file. Each party shall have a right to call and examine witnesses, to introduce exhibits, to cross-examine opposing witnesses on any matter relevant to the issues, even though that matter was not covered in the direct examination. you will have a right to impeach any witness regardless of which party first called the witness to testify and to rebut the evidence against any witness. It is my responsibility to make findings of fact based on the evidence of record. The fact-finding determinations of the hearing officer are limited to two. Number one, whether the violation did occur, and secondly, if so, whether the person named in the civil violation notice can be held responsible for that violation. In order to make a finding upholding the code enforcement decision, I must find that by a preponderance of the evidence indicates that the alleged name violator was responsible for the violation of the relevant section of the code as charged. If I affirm the decision of the code enforcement inspector, my order will specify, number one, the amount of the civil penalty, and secondly, the amount of the administrative costs of the hearing. You are hereby also warned that failure to comply with the violation by the date upon which the violation must be corrected will result in automatic referral to the code enforcement board, which may result in the imposition of additional fines The alleged violator or the city of Miami may seek to overturn the order of the hearing officer by making application to the Miami-Dade Circuit Court Appellate Division within 30 days of the issuance of the order of the hearing officer. After the code enforcement inspector has presented his or her case and you have presented your case, I will consider the evidence and then render a decision. We will now commence with the proceedings, and the clerk will call and introduce the first item on the agenda.

Morning, sir. Morning. Were you sworn in? You were a little late, right?

37:25Speaker 25

Could you raise your right hand? Do you solemnly swear or affirm the testimony you are about to give today is the truth, the whole truth, and nothing but the truth?

37:34Speaker 37

I do. Thank you.

37:36Speaker 25

Sir, could you state your name and address for the record, please?

37:39Speaker 37

Nelson Sayegh, 3611 North Prospect Drive.

37:42 – 38:09Speaker 21

Okay. Mr. Sayegh, it appears that your property located at 3611 North Prospect Drive in the city of Miami was cited by the city for tree removal, trimming, root pruning without a permit. The citation was complied back in May of 2025, but the civil monetary amount remained unpaid. You've had an opportunity to speak with the city this morning regarding this matter, and you wish to settle it with the city, is that right?

38:10Speaker 21

And after speaking to the city, you've agreed to pay $250 to settle this case?

38:14Speaker 37

That is correct.

38:15Speaker 21

And did you freely and voluntarily enter into that agreement with the city?

38:20Speaker 21

Okay, then based on your representations this morning, I'm going to sign an order settling this matter for $250. Thank you. Thank you. And if you come forward, you can get a copy of the signed order.

38:30 – 38:49Speaker 22

Okay. That's the end of the settlement. We have no trials.

38:53Speaker 20

All right, so if you want to just give us a few minutes, I'll call them up so they can go ahead and look at their cases.

38:58Speaker 21

Okay, can you just tell me which ones they are, please?

39:01 – 39:35Speaker 20

All right, so we're going to have, it'll be page, I'll just give you the page numbers. Page 41, page 84, page 93. Wait, 84. 93. 93, got it. 107 and 100. So I'm going to call up the address, and then I'm going to show you your case so you see it before we start the trial. It shouldn't take too long for everybody. So anybody who's here, it should just be that. 771 Northwest 4th Avenue.

39:37Speaker 22

You want to come take a look at your file right now?

39:45Speaker 20

No, no, come over here. No, no, I'm not.

41:28Speaker 20

1742 Northwest First Place.

41:42Speaker 19

Hi, how are you?

43:16Speaker 20

176 Northeast 56th Street.

45:42Speaker 20

Next one is 3570 Hibiscus Street.

46:17Speaker 25

Next case, page 84, case number 00125775, property address 176 Northeast 56th Street.

46:32Speaker 2

Good morning.

46:34Speaker 21

Okay, could you state your name and address for the record, please?

46:38Speaker 2

176 Northeast 56th Street, Miami.

46:45 – 47:16Speaker 21

Thank you, Mr. LaFranc. It appears that their property located at 176 Northeast 56th Street was cited by the city of Miami for dumping littering on right-of-way alleys, sidewalks, or on private property. The area was cleaned up back in May of 2025, but the civil citation remained unpaid. You've had an opportunity to speak with the city this morning regarding this matter, is that correct?

47:17Speaker 21

And after speaking to the city, you wish to settle it for $100, is that right?

47:23Speaker 21

And did you freely and voluntarily enter into that agreement with the city?

47:28 – 47:44Speaker 21

Okay, then based on your representations this morning, I'm going to sign an order, which I'm doing right now, settling this matter for $100. And if you come forward, you can get a copy of the signed order. Here's one copy. Thank you.

48:44Speaker 21

Yeah, I'll send them to you as soon as I get home. I don't know where.

48:49 – 49:07Speaker 22

But what I did was I went through my calendar and every, this is the second Thursday of every month, I went through the entire year and said when I would not be available. So just don't, yeah, because what happens is you're all gone.

49:21Speaker 20

Okay, we're ready. I think we're back down to four. Yeah, we're back down to four. We went up to six or seven, but now we're back to four.

49:30 – 49:41Speaker 20

So our first one is going to be page 41. 7711 Northwest 4th Avenue, Inspector Merida-Guildo, case number 00132970. Okay.

50:07Speaker 21

Can you state your name and address for the record, please? Can you get closer to the mic, please?

50:20 – 50:36Speaker 21

Your property was cited for dumping littering on right-of-way alleys, sidewalks, or on private property. The area was cleaned up back, it looks like, November 3rd of 2025, but the civil citation was not paid. Is that correct?

50:37Speaker 26

No, Your Honor.

50:38Speaker 21

Okay. And how do you plead to this offense? Guilty or not guilty?

50:43Speaker 26

I am not guilty.

50:45 – 51:15Speaker 20

Then we'll proceed. Inspector, please state your name for the record. Brenda Marigoldo, Salvation. Did you cite the... Hold on. We'll go somewhere else. Sorry. Did you cite the aforementioned property for evaluation of 22-6 of the city code on September 6th of 2025?

51:16Speaker 20

Okay. And you put together pages 1 through 22 of composite exhibit A. Is that correct? Yes.

51:23 – 51:59Speaker 20

So I'm showing the citation that was issued to the owner, the mailing, your affidavit of posting and mailing. Correct. summons for today which they got because they're here so that's good and also the affidavits for that yes we have a copy of their appeal yes i'll leave it there very quickly i'm not quickly on pages uh nine and ten so you can read it all right i'll read it into the record okay after you received the citation you um filed an appeal of this matter correct

52:01 – 53:38Speaker 21

And part of the appeal, you wrote, I would like to appeal because I did not receive notice of the citation until August the 4th of 2025 when the inspector posted a notice on the gate of my property. As of today, I have not received a notice of the citation on my mailing address. Such important notice like this should be posted on the front of the property. Number two, sent a letter to the mailing address of the owner's property. Considering that one and two did not occur during the 30-day lapse period, therefore the citation was not issued according to the rules of the county and cities. For this and other reasons that I will clarify later, I am appealing the citation and humbly request that the board grant a hearing on this inappropriate ticket. The pile of trash located across the street from the property had always been there and collected once a week by the city employees. I just replaced my old to a brand, I guess you replaced your old roof with a brand new roof, which was done by a licensed contractor who was hired by All American Waste Disposal for their trash on November 27, 2024. The trash inspected across the street together with the non-moving car is still there as of August the 5th of 2025, has nothing to do with my property. Was that your appeal?

53:39Speaker 21

Okay. Now, did you have an opportunity to look at the notices that were sent?

53:45Speaker 21

Okay. And you're saying you never received them, is that correct?

53:50 – 54:09Speaker 26

I'm not living on this property. I rented this property. I'm living under other address. When the officer put the paper in the gate, but I didn't know. But the people who are living on the property, they never called me to tell me I have the... Yeah, that's a problem.

54:10 – 54:28Speaker 21

It's a big problem. But let me tell you something. That's between you and your tenants. You know, the law requires, because you're listed as the owner, to mail at your mailing address. Now, let me ask you this question. What is your mailing address with the county?

54:28Speaker 20

I'm going to get to that in just a minute. We're just not there yet. I have it up here.

54:34Speaker 20

Can we just add something?

54:37Speaker 21

Sure, I'll let you speak. First of all, state your name and address for the record.

54:42 – 55:08Speaker 32

It's Junior Breeze Vincent, and this is my mom. And I just want to say there are two things that we don't really understand. And this is the fact that it says it's an illegal dumping for construction debris across the street. And what we just saw as the image was basically not debris from constructions at all. Because what we did, we did it properly by hiring the right people to do it legally. So I don't understand.

55:08 – 55:28Speaker 21

I understand that. But maybe those people didn't. I don't know. I haven't heard the rest of the case yet. But if you hire somebody and they break the law, that's a contract between you and them. You are ultimately responsible as the owner of the property. But I'm going to hear the rest of the case and find out exactly what happened here.

55:28 – 55:41Speaker 20

Okay. Here's the property appraiser report. Is that correct? Yes. It was the mailing address of 671 Northeast 141st Street, correct? Correct.

55:42Speaker 21

Okay, ma'am, is that where you live?

55:47Speaker 20

And then we go back to the notices that you sent, which were sent to 671 Northeast 41st Street. Correct. Okay.

55:57Speaker 22

Did you receive the green card?

55:59Speaker 20

We don't get green cards back. It's all electronic. Okay. All right. Yeah, the days of the green card are over.

56:09Speaker 21

Okay. Okay. But it shows it was delivered at that address, correct?

56:14Speaker 20

It says it's mailed. Okay. Yeah. Whether they accept the certified mailing is up to them.

56:21 – 56:33Speaker 20

Because it says certified. So if they don't accept it, they don't get it. Showing you what's page 12. Is this the pile of trash that was seen?

56:36Speaker 20

Inspector. Inspector.

56:40 – 57:01Speaker 21

You can look at the as she's scrolling through she's showing pictures now I Understand that that looks like that's the property across the street But the issue from what I'm hearing so far is that that stuff there They found items that belong to your home.

57:01Speaker 32

That's that's what they're saying Okay, which is not a proof that it's from our just by the way

57:07Speaker 21

Well, we're going to find out.

57:13 – 57:27Speaker 20

This is their property, is that correct? That's my property. Correct. And that's across the street? Correct. This is another picture of it. What was the debris that you found in there?

57:28 – 57:44Speaker 23

Flooring. Flooring, well, inside the bags, there were construction debris. It was flooring as well. And also, if you look inside their property, the same floor. We're going to get there. Okay. But there was a lot of construction debris.

57:46 – 58:07Speaker 20

Now, this photograph, this is the side of the owner's house. Is that correct? Correct. And this debris you saw at their house. Is that correct? Yes, ma'am. Does this look like the same debris that was found across the street? Yes, ma'am. Can I say something?

58:08Speaker 21

Not yet, but I'm going to give you an opportunity.

58:11 – 58:27Speaker 20

And here's another picture of the debris. Is that correct? Correct. This is the property as it's posted.

58:28 – 58:45Speaker 20

Yes. Sorry, let me make it smaller. And that's for today's summons as well, correct?

58:45Speaker 23

Correct, yes.

58:46Speaker 20

This time the city would seek to admit exhibits, composite exhibit A, pages 1 through 22 into evidence.

58:53Speaker 21

Okay. Okay. Do you have any objection to this? What's your objection?

58:57 – 59:12Speaker 32

We want to know, like, we see a bag closed with no indication of what's inside. The next thing we know, it is from our house. I don't understand. How is it exactly? How do you know these are constructions, debris from our house?

59:13Speaker 21

Well, do you have, let's start step by step. Do you have an objection with the city using these photographs?

59:22Speaker 32

Yes, we do, because this is not in front of our house, and this is not from us.

59:25 – 59:37Speaker 21

Okay. Inspector, did you take these photographs? Yes, ma'am, I did. And do they fairly and adequately depict the condition on the day that you took these photographs?

59:38 – 59:55Speaker 21

Okay. Over your objection, I'm going to allow these photographs to be entered, okay? And we'll go from there. So I'm going to enter... exhibits, I think it's A through D, pages one through 22 into evidence.

1:00:01Speaker 20

Inspector, there's a lot of different trash in the pile, is that correct? Correct.

1:00:07 – 1:00:28Speaker 20

And you testified that certain parts of the trash across the street was the same Hold on, I went the wrong way. Was the same trash that you saw here on the property?

1:00:29Speaker 20

And that's why you cited it, is that correct?

1:00:31Speaker 23

Correct, that's why I cited that property. The same trash that was in the pile was the same trash that was inside the property.

1:00:37Speaker 20

And you didn't see anybody do this, correct?

1:00:39Speaker 23

No, I didn't see anyone do that.

1:00:41Speaker 20

Just based upon your visual observation of the garbage on the property and the garbage across the street? Correct. Okay, nothing further.

1:00:51Speaker 21

Do you have any questions of the inspector?

1:00:54Speaker 32

Yeah, that's exactly what we're trying to understand. How does that exactly relate to all of those debris that's from us?

1:01:01 – 1:02:00Speaker 21

Okay, I don't think that that's the testimony that all of the debris is from your property. That's not what she's saying. Do you understand what she's saying? What she's saying is that there are some tiles, white tiles that's being shown on the picture Does it have a number, Ms. Dooley? That is on page 16. Page 16. It's up on the screen right now. It shows that there are tiles on the property that you own that's being leased out by a tenant, and that some of those tiles also appear across the street in the pile. So what the city is saying is that not everything in that pile came from your property. They're saying that those tiles that were on the side of your property are also the same ones across the street in the pile.

1:02:01Speaker 32

Okay, so that's exactly my confusion here. How do we exactly say we are the same people that put those tiles in the trash?

1:02:10 – 1:03:08Speaker 21

Well, first of all, I don't think they're saying you did it, okay? But as the owner of the property, you're responsible, okay? It seems that it's very, if you wanna use the word coincidental or odd, that the tiles that appear across the street in the pile are also located on your property. Now, if they weren't on your property and they were just across the street, I think you would be absolutely correct. How do you know that it came from your property? But the fact that it shows on this photograph that those same tiles are on your property. So one can conclude that those tiles came from your property.

1:03:08Speaker 32

That's why we're saying that we didn't even do any work about tiles.

1:03:12Speaker 21

I understand you didn't. Okay. Is your tenant here? Your tenant?

1:03:19Speaker 21

Okay. Have you spoken to your tenant about this?

1:03:23Speaker 21

And they've denied doing any work, right?

1:03:26 – 1:04:44Speaker 26

I fixed my property. Not them. Okay, but you said you- I have a lot of proof. First of all, the first paper she's put it on my gate, he said I dumped some construction things. Great. But I have a proof. I paid the company to come to do my work. And they has a dumpster. I rented a dumpster to get all the garbage to put it somewhere. I don't know. And I know I have my property in this area, I have to leave this area clean. I'm not supposed to put, since I bought this property 2014, and those garbage every day you go there, this garbage is on this area. It's not the first day. All the time, since 2014, I bought the property, and those garbage is on the same place. And I call, I call City Miami 12 times already to tell them they have to stop the people in this area to dump on this area because those people is living. When I spoke to my neighbor, they said they don't know anything about it because the people is coming at night to dump those things.

1:04:44 – 1:05:04Speaker 21

I don't deny that, and that's the problem, is that when people see an area where there's a lot of debris... they figure that it's a free-for-all and they can just throw stuff there too, that the city will just come by and clean it up. So do you have any other questions of the code officer?

1:05:04 – 1:05:17Speaker 32

No, that was only the indication that we had, because what we're looking at was debris from constructions, and the constructions we did was only roofing, and that for me is the confusion on how... Do you have a document that says that it was roofing, or...

1:05:18 – 1:06:39Speaker 23

Okay, when she came to my office to ask in reference to the ticket, I explained to her, she explained to me that the neighborhood do put trash there because it's in front of an empty lot. I explained to her, we do not have a community dump, this is not a little, you cannot put that there because you're putting it in front of someone else's house. I explained that part to her. Now, anything that has to do with construction, this pile did not only come from her, but there are portions that came from that property. No, no. And the roofing that she did was in 2024. We're in 2025. The ticket was issued in 2025. Her roofing was from 2024, and when she showed me, it was one of our illegal haulers because we do not work with that hauler. But she did it. It happened. She... was able to go and do her roof, but this was in 2024. Now we're in 2025. This construction debris, when I was looking around the whole neighborhood to see where it came from, unfortunately, I looked down at the pile. As you can see, what's in the pile is exactly what's inside the property. It's not even outside the property. You understand? So that's how I linked. that it came, not to say that the whole entire, but they're not the only property around there that has got tickets because they like to put their trash in front of that vacant lot.

1:06:41 – 1:06:55Speaker 21

All right, do you have any questions of the inspector? All right, so tell me now it's your turn and you have the opportunity to tell me why you should not be held responsible for this citation.

1:06:59 – 1:07:38Speaker 32

The reason why I don't think we should be responsible for this, it's the fact that just because you see debris of tiles in front of, like, in the sideway of a house, why should we be the one responsible for the same thing they've been doing for years in the city across the same street? And I get the fact that you're saying that we're not the one because we don't live in the house because there is a tenant and everything else. But doesn't mean because it's the white tile and the same lookalike tile, and the debris towers as well too, it's the same one. It could be anyone else doing the same type of work in a different house and drop it there.

1:07:38Speaker 26

Your Honor, the picture I just saw on the TV right now, this is the new one. The one she gave it to me when I go into her office, that's a different thing.

1:07:49Speaker 32

Yes, it was two different pictures. Yes. Wait.

1:07:55Speaker 22

Okay, when were you given the citation?

1:07:59Speaker 21

The ticket. When was the ticket given? What's your statement?

1:08:05Speaker 32

Should you say?

1:08:11Speaker 20

I have it up on the screen.

1:08:14Speaker 23

Your Honor, I gave her the same pictures that were in the case. It's the same exact. I just printed it out of there.

1:08:21Speaker 21

Do you understand that this has nothing to do with the roof? You understand that, right?

1:08:26Speaker 32

No, no, we do. Yeah. Okay. Yeah.

1:08:29Speaker 26

Okay. All right.

1:08:39Speaker 21

Let me see that one that you're looking at.

1:08:42Speaker 20

I printed the ticket up. It says construction debris across the street. That doesn't talk about a roof.

1:08:55Speaker 26

That's another one.

1:08:57 – 1:12:42Speaker 21

Okay. I'm looking at that was received by Ms. Joseph. It's the ticket citation that says that the ticket was issued on June the 6th of 2025. Your roof was in 24. Okay. Okay. But this ticket was for 662025 for dumping littering on right-of-way alleys, sidewalks, or on private property. And it says illegal dumping of construction debris across the street at the vacant lot behind 401 Northwest 77th Street. Same construction debris inside the yard of the property. Okay? Okay? And what they're referring to is, I'll give this paper back to you, they're referring to those tiles. I understand and I believe that you may not have personally done that, but I think by a preponderance of the evidence, the fact that As you can see on the screen right now, there are broken tiles. There's a couple of photos showing those broken tiles. And they are, I find by a preponderance of the evidence that those tiles are the same tiles that were found across the street. You may not have done it. Your tenant either did it or your tenant hired somebody. And if not, Maybe it was there for a very long time. I don't know, okay? But you said you've owned that house since... And then why has your tenant or you not cleaned this up? That's all you had to do. If you would have cleaned up your property and there would have been no tiles there, there is no way that the city could have linked those tiles across the street. I'm just telling you. But I find that those tiles did exist on your property that you own... the same in and of themselves that was found across the street. And as a result, I'm going to find you guilty of this violation. I am going to find you $525 for this violation. I will waive court costs. You have 30 days to appeal this decision if you think it wasn't right or it wasn't fair or that I did not or that I did not look at all the evidence or listen to you, but I'm finding, you know, pictures, the old story is pictures are worth a thousand words. And the fact that those tiles were located on your property and those same tiles were located in a pile of junk across the street, somebody put them there and I find that those items that were in that pile clearly came from your property that's located at 77 11 Northwest 4th Avenue. So that's my ruling. I'm going to enter an order to that effect. And as I said, that the violation did occur, that the person named in the violation is legally responsible. The violation is affirmed. The amount of the penalty is $525. And I will waive the prosecution costs. Again, you have 30 days from today to appeal this order to the Miami-Dade County Court Appellate Division.

1:12:50Speaker 20

We have a settlement.

1:12:51Speaker 21

Okay, one second, please.

1:13:04 – 1:13:46Speaker 21

Okay. Give me a second here. Okay. Okay, we're done. If you come forward, you can get a copy of the signed order.

1:14:02Speaker 25

Next case, page 100, case number 00141900, property address 3421 Northwest 6th Avenue.

1:14:25Speaker 18

Morning, sir. Good morning.

1:14:28Speaker 21

Will you sworn in?

1:14:30Speaker 21

Could you state your name and address, please?

1:14:32Speaker 18

Dustin Roman, 3421 Northwest 6th Avenue.

1:14:37Speaker 21

I'm sorry, what is your name?

1:14:38Speaker 18

Dustin Roman. 3421 Northwest 6th Avenue, Miami, Florida.

1:14:44Speaker 21

It's not Dawson? Is that what you're saying? Dawson, yeah.

1:14:47Speaker 18

Dawson, okay. Like Boston, but with a D, yes.

1:14:51Speaker 18

Boston with a D. Yes, yes.

1:14:53 – 1:15:18Speaker 21

Okay. Mr. Roman, it appears that your property located at 3421 Northwest 6th Avenue was cited by the city of Miami for dumping littering on right-of-way alleys, sidewalks, or on private property. That violation was cleaned up back on September 11th of 2025, but the civil citation remained unpaid. You've had an opportunity to speak with the city this morning regarding this matter, and you wish to settle it. Is that correct?

1:15:19Speaker 21

And after speaking to the city, you wish to settle it for $250. Is that right?

1:15:24Speaker 21

And did you freely and voluntarily enter into that agreement today?

1:15:28Speaker 21

All right. Based on your representations, I'll sign an order settling this matter for $250. Thank you. Thank you.

1:15:36 – 1:15:51Speaker 20

All right, next trial case is page 93, Inspector Harris, case number 00106731, address 1742, Northwest First Place. Again, case number 00106731, page 93.

1:15:58Speaker 21

Good morning, sir. Good morning.

1:15:59Speaker 10

How are you doing?

1:16:00Speaker 21

Good. Now, you've agreed to interpret on behalf of this gentleman? Yes, it's my father. Okay. Could you state your name and address for the record, please?

1:16:09Speaker 5

Eden Mejia, 1742, Northwest, first place, Miami, Florida, 33136. Okay.

1:16:15Speaker 21

And since you're going to interpret for him, everything that I say, you need to explain to him.

1:16:22Speaker 10

He understands English. He's speaking it, but he understands it.

1:16:25 – 1:17:15Speaker 21

Okay. Okay. Do you give your son the authority to speak on your behalf? Yes? Okay. It appears that the property that your dad owns, 1742 Northwest First Place, was cited by the city of Miami for dumping littering on right-of-way alleys, sidewalks, and or on private property. The area was cleaned up back on April of 2025. but the civil citation remained unpaid. Okay? You had an opportunity to speak with the city today, and you spoke to them, and you decided not to settle with the city. Is that correct? Correct. All right. So how do you plead to this offense? Guilty or not guilty? Not guilty. Okay. Then we're ready to proceed.

1:17:15Speaker 20

Inspector, can you please state your name for the record?

1:17:17Speaker 30

Good morning, Inspector Harris-Soloway.

1:17:20Speaker 20

Okay. Did you cite the aforementioned property for illegal dumping on the public right-of-way alleyways or sidewalks under 22-6 of the city code?

1:17:30Speaker 30

Yes, that is correct.

1:17:31Speaker 20

And the citation was issued on September 25th of 2024? Yes.

1:17:39 – 1:18:01Speaker 20

Some of these are backlogged from prior cancellations. Did you put together pages 1 through 37 composite exhibit A for today's hearing? Yes. All right. So we're going to go ahead and go through that. And what we see in the beginning pages here, this is the ticket that was issued and showing the mailing versus certified mail to the owner. Is that correct?

1:18:01Speaker 30

That is correct.

1:18:03Speaker 20

Copy of the order. This is your affidavit of posting and mailing on the property. Correct?

1:18:14Speaker 22

Do you have a copy of the order?

1:18:15Speaker 20

Yeah, we have a whole bunch of extra things in there. We also, now we go to the summons for today. Is that correct?

1:18:20Speaker 30

That is correct.

1:18:21 – 1:18:37Speaker 20

Sent as well to the owner and who's here. So they got the notice. And here is on pages 15 and 16, the appeal by the owner. Is that correct?

1:18:37Speaker 30

That is correct.

1:18:38 – 1:19:27Speaker 21

All right. Let me just read it into the record. Um, You filed an appeal. Your dad filed an appeal, right? Correct. And in the appeal, it stated they posted a notice on my mailbox saying I had debris on my property, but they said they found the trash with someone of my address on it between 18th to 19th Street, but I live on 17th Street. The homeless people that live in the area took out trash down the street and dumped it without our knowledge. I had surgery the 17th of September on my knee, so it was impossible that I dumped the garbage one to two streets down the house. I have proof of my surgery and documents. I would like to appeal this because I cannot pay this outstanding amount, especially at this moment of crisis. Okay.

1:19:32Speaker 20

Okay, Inspector. And we have a copy of the deed for the property.

1:19:39Speaker 30

That's correct.

1:19:45Speaker 20

And then we're coming down to, this is the pile area, is that correct, on page 24?

1:19:50Speaker 30

That is correct.

1:19:51Speaker 20

This is not at the property address?

1:19:54Speaker 30

No, that is on the city lot, which is, no, it is not.

1:20:02Speaker 20

And is this what was found inside?

1:20:06Speaker 20

Okay, in that trash pile.

1:20:07Speaker 30

That was found inside the pile.

1:20:20Speaker 20

And on it, it shows a ready by 8-4 and a delivery by 8, looks like 8-6 of 2024, yes?

1:20:27Speaker 21

Yes. I'm sorry, when was this violation issued? September, hold on a second. I know September 24, but.

1:20:37Speaker 20

Hold on, September 25th, 2024. Okay, thank you. Uh-oh.

1:20:51Speaker 20

All right. So that's the, that's the trash pile, correct?

1:21:04Speaker 20

And then you have another, is this another?

1:21:09Speaker 30

Another piece of evidence that was also in the pile.

1:21:12Speaker 20

Okay. Which has the beginnings of the numbers of the property?

1:21:17Speaker 20

And also an E.D. ? I am? Yes, you know, up there.

1:21:25Speaker 20

And that's a separate piece of trash, right?

1:21:26Speaker 30

Separate piece of trash, yes.

1:21:29Speaker 20

And this is the proof of posting on the date you issued the ticket at the property?

1:21:43Speaker 20

And then we have for the...

1:21:44Speaker 30

Proof of posting.

1:21:46Speaker 20

The proof of posting for the summons as well for...

1:21:51Speaker 30

Yes, that is correct.

1:21:52Speaker 20

For today. Because it was said a couple of times.

1:22:02Speaker 20

All right. At this time, the city would seek to admit pages 1 through 37 as composite exhibit A. Okay.

1:22:12Speaker 21

Do you have any objection to me considering these photos?

1:22:16Speaker 10

Yes, so... Like I said, two days prior, he had a knee replacement.

1:22:22 – 1:22:43Speaker 21

Okay, before you get into your position, the city is admitting these documents showing that a citation was issued, that your property was posted, and showing as well as testimony from the inspector that the items with your address on it came from this pile.

1:22:44Speaker 10

Yes, but we didn't end up with that.

1:22:46Speaker 21

Okay, okay, I understand that. I'm going to allow this to be considered, these documents.

1:22:54Speaker 20

Okay, go ahead. Inspector, did you ever have any contact with the owner of the property?

1:22:59Speaker 30

I spoke with the son, actually. After I posted the ticket, he called to state his rebuttal of the ticket.

1:23:10Speaker 20

Okay. But that was it?

1:23:15Speaker 30

I believe we spoke twice. I know we spoke once for sure, but more than once at least. All right.

1:23:21Speaker 21

Nothing further. Do you have any questions of the inspector?

1:23:26Speaker 10

No, no questions for him.

1:23:27Speaker 21

Okay. Now it's your turn to tell me.

1:23:30 – 1:25:00Speaker 10

OK, so my case. OK, so not sure you're familiar with the area, but it's an ongoing problem with a lot of homeless people looking for a payout, drug addicts looking for $3, $5 without asking to take the trash out. They do it anyways, knocking your door, asking for $5, which we don't do that anymore. But we grew up there, and that's an ongoing issue. Around that time, two days prior, he had a knee replacement. He's already disabled, but he had a knee replacement, so he had to be on bed rest for like a month or two. My stepmom, which is his wife, doesn't speak no English at all. She's not from here. And as she was outside, I think she was cleaning the patio in the back, a homeless person approached her. She didn't understand him. Obviously, he's probably asking to take the trash out for money. They're tussling over the trash can at this point because she doesn't want him to take it. Got aggressive. You know, any logical person would let go. It's a safety issue at that point. He took it. She went upstairs to tell him, but it's just them two. They live alone. We don't live with them. So he couldn't really do nothing about it because he can't get up. And we ended up finding a notice and seeing that he dumped it, I want to say, a street and a half from where we live. We couldn't do nothing about it at the moment because, again, we don't live together. And we also have the proof with the whole surgery and him getting out of the hospital two days prior to that.

1:25:00 – 1:25:32Speaker 21

Okay. I just want you to understand one thing. The city's not saying that your father put that trash there, okay? Do you understand that? What the city's saying is that trash that's located in this photograph came from your property. Yeah, 100%. So even if the homeless person did it, ultimately it came from your property. Now let me ask a couple questions here. Where do you keep your trash? In a trash can. Okay, and where's that trash can located?

1:25:33 – 1:25:53Speaker 10

In front of the gate where we're instructed to leave it at. Okay, what days? Okay, I didn't get to explain. So it's a gate, she's inside our gate, and the trash can has to remain outside in order for the waste management to pick it up. It's outside, so it's easy access to the people.

1:25:53 – 1:26:05Speaker 21

When are your pickup days? Monday and Thursday. Thursday.

1:26:06 – 1:26:20Speaker 21

And what day was this trash taken? This right here? Where's your father's wife? Why isn't she here?

1:26:21Speaker 10

Well, she don't really know English and she's... Well, you could have interpreted for her.

1:26:25 – 1:27:03Speaker 21

I mean, if she had something to say, she should have been here. I'm just saying because technically what you're telling me is what's considered hearsay. And there's no way to rebut what you're saying because she's not here for me to ask her any questions. Okay? Yeah. Okay. It looks like this item, first of all, may have been there for a little while because it was dated in early August. But this is a Wednesday. Yeah, it was dated August the 4th or the 6th. I see that.

1:27:06 – 1:27:35Speaker 10

so it must have been there for a little while but this was on a Wednesday and you don't know what day this occurred honestly we ended up if I believe I can't remember correctly we didn't even end up finding the trash can until days later we didn't know where it was dumped at because he took off again if I was there none of that would have happened but At this point, it's a safety concern. I don't think anybody in this room would go back and forth with a desperate homeless person over a trash can. I'm pretty sure any logical person would let go.

1:27:35Speaker 21

Are you telling me he took the whole can?

1:27:37 – 1:28:31Speaker 10

No, he did. Oh, he 100% did. Yeah, he did. But that's what they do. I've grew up there since I was a baby. That's an ongoing issue there. They would do that and expect them to get paid and get aggressive. They don't. And again, they know me there, but they don't know her because she don't come outside much. She travels a lot back to her country because of her peoples over there. With me, it wouldn't have happened, but with anybody else that they're not familiar with, they will try to play those games and try to muscle you into getting what they want. It's an ongoing issue, and it's a safety issue at that point, and I wouldn't blame anybody for letting them take the trash. But our concern is that I get that it was our trash, it was inside our trash can, but if you're repeatedly telling the people that continuously do these things over and over, I don't want you doing that, I don't want you doing that, and they continue doing it, It's a respect thing that they don't respect, and it's kind of out of our control, unless we start getting physical, and we're not trying to do that.

1:28:31Speaker 21

No, no, and I'm not suggesting that you do that, but let me ask you this question. Are there any cameras on the property?

1:28:38 – 1:29:05Speaker 10

Yes, which we actually called, well, my brother called, to try to get the cameras, I believe, is... an apartment building in the front. He went in. They didn't want to give him access. And I'm not sure if someone in the corner, he also called. I'm not sure what number he's called. He's not here. He had to take his wife to work. But he also did call. He can't get access. But there is cameras. If you guys can probably get access for us, you would see that it's a homeless person.

1:29:05 – 1:29:53Speaker 21

Okay. Well, the problem that I have here is the city has, let me tell you what I'm faced with. The city has a document that clearly came from your property. I know that you didn't put it there. That's your testimony, okay? And that your father didn't put it there. But it came from your property. And you don't have, number one, your stepmother here to tell me about the situation. You're relaying it to me. It's considered hearsay, number one. Number two, there are no photographs or cameras or anything showing that there's, you know, that somebody else took the garbage from you. Do we know, Inspector Harris, about what time they come and pick up garbage, or does it vary on Mondays and Thursdays?

1:29:53 – 1:30:05Speaker 30

So this would actually fall under our bulky waste, which is picked up on Tuesdays in the area. However, that is a city lot, so that would require essentially someone from our operations department to go and service our lot.

1:30:05Speaker 20

No, no, no, I'm talking about their property. Right. Not where it was found, but their property.

1:30:11 – 1:30:29Speaker 30

So their property is severed for bulky waste on Tuesdays. Okay. When you say bulky waste, is that just regular garbage? No. Bulky waste refers to larger items such as a fridge, a mattress, things of that nature.

1:30:29Speaker 20

What about for the regular garbage? Let's just assume these documents got there on their own, not everything else.

1:30:35 – 1:30:53Speaker 30

If it was regular garbage, it would be Monday morning and Wednesday. Okay. Not Thursday. I'm sorry, Monday and Thursday. Okay. And the time frame, it's generally between, the trucks start at about 7. So somewhere between, I would say 7 and 10 is normally when they would service most of our containers.

1:30:56 – 1:31:58Speaker 10

You hear that? May I add two things? Sure. One, you said that there's no cameras. We try to get access. I mean, I think it's out of our control if they don't want to give us access or certain processes you've got to go through to get that type of camera angle. And two, I would like to ask, how will we go forward with an issue that is uncontrollable on our end and can continue to happen And then we're not really getting no help as far as in that neighborhood as to control that aspect of it. Because, again, it's a free fall in some areas. Again, it's a lot of homeless, a lot of drug addiction, a lot of alcoholics. So how do you move forward? Because we can say, okay, we'll pay it now. And it happens while, let's say, he's gone. And it happens again. And we don't know what happened. Maybe they returned the trash can at this time, and they go and dump it somewhere else with his name and stuff on it, with trash, like here. How do we move past at that point when it's a continuous... Did the container ever come back to your house? No, I believe we found it. I believe we found it.

1:31:58Speaker 21

Oh, okay. So you didn't have to, like, call the city and ask for a new container, right?

1:32:03Speaker 10

I don't think anybody would have came. If we've had issues like this, nobody would have came.

1:32:06Speaker 21

Have you been cited for this in the past?

1:32:09 – 1:32:20Speaker 10

I'll be... Yeah, this is first time.

1:32:20 – 1:33:40Speaker 21

First time, okay. So it appears that this doesn't happen a lot. What I would suggest to you are a couple things. Number one... You may want to invest in getting cameras. We did. Okay, you have cameras now? Yeah. Okay, so that will help you. So if this occurs again, the inspector is telling you that the garbage is picked up on Mondays and Thursdays, and your father has confirmed that from roughly 7 a.m. to 10 a.m. I would suggest not putting it out on a Saturday night or leaving it out there Monday or Tuesday to pick up on Thursday. Okay. You may want to, I don't know what time he gets up in the morning, but to try and put it out outside the gate at those hours, because you know when your pickup is. But this, to me, clearly came from your property. I don't know who did it. I don't hear anybody here saying they saw a homeless person, they were confronted, they were concerned about their safety. And that's the problem I'm having. Your stepmother's not here. You don't have any cameras. And I will tell you, if you get cited again for this and you have a camera and it shows somebody actually comes onto your property and takes your stuff and it gets found elsewhere, you're going to have a very good defense showing that you should not be held responsible for it.

1:33:41 – 1:34:32Speaker 10

Can I add something? Sure. And this is without due respect. Her being here in person, would that have made a difference? Sure. Of her saying, I did it? I mean, you guys are clearly saying, and this is without due respect. I don't mean to sound, come off disrespectful, but you guys are saying it clearly came. Yes, I clearly see the name is Edomahir 1742. But again, this has been an ongoing issue. Have they been cracking down more on being more stricter with the trash being out, 100%. Obviously, it's being gentrified where we're from, so they're going to try to clean it up. But there's been going an issue where you tell them, hey, don't touch my trash can. There's been times where I've almost got physical because of the disrespectful things that continue to happen there. It's things you can't control. And again, anybody here, it's logical. It's a safety concern. If a homeless person that is desperate for some money is getting aggressive with you over a trash can, Let it go.

1:34:32 – 1:36:36Speaker 21

No, I hear you. I'm not saying that, but I find that this item clearly came from your father's property located at 1742 Northwest First Place. I'm going to find you guilty of this offense. I understand that you have an ongoing problem there, and that may have occurred, what you're telling me. I don't know. I don't have the person here to testify. And so... What I'm willing to do here is find you guilty. I know that the fine is $525. You probably were offered a settlement this morning that you decided not to take for whatever reason. So I'm willing to find that the violation did occur, that the person named in the citation is legally responsible, the violation is affirmed, and the amount of the penalty is $300. No prosecution costs. If you're not satisfied with this ruling, you can appeal it to the Miami-Dade County Court Appellate Division within 30 days of today. And you're going to get a signed order. But I clearly find, by preponderance of the evidence, that that document came from your father's property, located 1742 Northwest First Place. And you're just going to have to be more diligent. You know that there's an issue there. Inspector Harris can be your new best friend. Call him up. Talk to him. If it's an issue, he'll help you. He'll help you do what needs to be done in order to stop this, because it's not fair to you. Okay, I understand that. But it's also not fair to the community to have, and that's a picture of the bins? Was that a picture of the bins?

1:36:36 – 1:37:27Speaker 10

But I wouldn't want to address it. No, this is the next case. I wouldn't want to address it. If it is an issue for the community, I think that should be took up with the city, not with... finding people 500, 300, 200 for things that have to be addressed within the city, not people who are hardworking or disabled civilians. So I agree, it is not fair for the city and the people who live in the area, but it's also not fair to the people who have to suffer that we've been going through that for years since I was a kid there. So I think it does have to be addressed with the city and we would need more help for those things not to happen because Clearly, it's been happening for years and years and years. So I do agree. I think if we can get more help from the city to prevent those things, half of these people won't be here, especially people that come from where we come from.

1:37:27Speaker 21

Okay. Well, you have Inspector Harris's information. Feel free to call him. He's your inspector.

1:37:34Speaker 30

Yes. I was just going to say on the record, have you reached out to the neighborhood resource officer? Mm-hmm. Copy that. Okay.

1:37:44 – 1:37:55Speaker 21

Yeah, yeah, we'll talk. Okay, thank you. Can you come forward, though, and get a copy of the order? Thank you.

1:37:55Speaker 20

Our last one will be page 107, case number 001421413570, Hibiscus Street. Again, page 107, case number 00142141.

1:38:24 – 1:38:36Speaker 21

Yes, yes. Thank you. Morning, sir. Morning. Were you sworn in?

1:38:37Speaker 21

Okay. What is your name and address for the record, please?

1:38:40Speaker 11

Brian Kaczynski, 3570 Hibiscus Street.

1:38:44 – 1:39:18Speaker 21

Okay. It appears that your property, located 3570 Hibiscus Street, was cited by the city for container garbage, trash, industrial, other waste placed in the right-of-way. I guess you cleaned it up back in September of 2025. You were issued a citation for that, but the citation remained unpaid. And the citation was a $79 citation for keeping the... trash containers in that location. How do you plead to that offense? Guilty or not guilty? Not guilty. Okay.

1:39:21Speaker 19

Inspector, please state your name for the record. Inspector Mills, City of Miami Solid Waste Code Division.

1:39:27 – 1:39:45Speaker 20

Did you cite the aforementioned property for violation of 22-2E of the City Code for leaving the bins on the, the green and blue bins on the public right of way on September 11th of 2025? Yes, I did. Okay. And did you put together pages one through 31 as composite exhibit A for this hearing? Yes, I did.

1:39:45Speaker 20

And I'm going to show you, we're going to just flip through it. This is the ticket that you issued, correct?

1:39:53Speaker 11

You see up here, that's the ticket.

1:39:54 – 1:40:17Speaker 20

Yeah, the $79 ticket. Okay. Mail to the property and are at the same address where the ticket was issued. Correct. The summons, which was also certified mail and then posted on the property. And then on pages 9 and 10, we have the appeal. Actually, page 9 really only has the language.

1:40:18 – 1:40:34Speaker 21

Okay. And the appeal states, we follow instructions to remove from the curb garbage and recycling bins. Our street is constructed differently, and I will provide photo documentation that the sitecation is unfounded. That was your basis for appeal, correct? Yeah. Okay.

1:40:42 – 1:40:54Speaker 20

And then we have the property appraiser report as required. And we have this starting on page 19, the photographs, is that correct?

1:40:55Speaker 20

All right. Um, Is this the, you know, you took this photo on September 11th. Is this the only time the bins have been out?

1:41:03 – 1:41:44Speaker 19

No, that's how they always kept the containers. And prior to that, I issued a warning that the container cannot be placed there. Also did an educational blitz with me and two other coworkers where we went around different areas where the containers were always kept out on the street. I posted the educational blitz pamphlet on their gate. And on the day that I went by again, I saw the contact, which there's a lady that she sends in different locations all the time. And theirs was one of them. So that's why I went previously went by that location. And this is the, this is the property itself. Correct.

1:41:46 – 1:41:57Speaker 20

And the bins would be, is that off to the right, right, right there to the public right away, right there, right here. Okay. And so, And you've been by there and just seen the bins there, pickup day, non-pickup day. It's just where they're being kept. Correct. Is that correct?

1:42:00 – 1:42:31Speaker 20

And pursuant to the city code, the bins come out the evening before pickup. The second and fourth Tuesday of the month. Right. And they come out before pickup and then... And 24 hours back in. And then they go back in by the next day. Correct. Okay. All right. This is the posting on the property as well. Is that correct? Correct. All right. Is this a single family home? Yes.

1:42:33Speaker 20

And, um, all right. And this is when you were posting it. Obviously the owner was there. Yeah.

1:42:39Speaker 19

It was a confrontation with the owner.

1:42:41Speaker 20

Okay. We don't have to worry about that. Okay. But all right. They're offering skincare services.

1:42:47Speaker 19

Yeah, they do massage. That's a home business that they have where they're doing massages and Botox and things like that, which I reported that to COLD as well. Okay.

1:42:57 – 1:43:10Speaker 20

All right. All right, nothing further. Actually, the city would seek to admit exhibits, composite exhibit A.

1:43:11Speaker 21

Sir, do you have any objection to these photographs?

1:43:15Speaker 11

Those are correct. This is a correct representation of the bins.

1:43:19Speaker 21

All right. Then I'm going to admit the composite into evidence. Do you have any questions of the code officer?

1:43:27Speaker 11

No. No questions.

1:43:28Speaker 21

Okay. Okay. Tell me your story.

1:43:34Speaker 11

So I have a picture of the way we place the bins when the trash pickup is coming. So here's the

1:43:45Speaker 21

Oh, I can see them.

1:43:47 – 1:45:01Speaker 11

You're claiming that you put them in the street area. Well, we don't put them by the curb because the way the street is constructed, there's a tree planted here with a retaining wall around it. It's not really a right-of-way. Nobody walks there. Nobody can park there. Nobody can even ride a bike there because there's a little section of curb about one meter wide there. That's all. then a retaining wall the trash pickup truck cannot swing into the curb to pick up the trash because our driveway is there there's a car parked there all the time so we put the bins out on this um rain runoff uh you know the where the rain runoff goes and that's never been a problem we always remove the bins right away after trash pickup um And our family was away all summer. We were out of Miami from the end of May until August 18th. That's apparently when the educational blitz was sent. When we came home, we found it. It's a piece of paper. It says, please remove the bins away from the curb after trash is picked up. And I was confused because I say, this is where we leave our bins. We always move them away right after the trash is picked up.

1:45:02Speaker 22

And where do you remove them to?

1:45:03 – 1:46:01Speaker 11

Well, the picture that the court officer took is similar to one I took. This is the way that we had the bins placed. It's been at least a year we have been doing that. Nobody's ever mentioned it's never been a problem. When I saw the paper that said, please remove the bins from the curb, I was confused. I thought, where is remove the bins? This is some kind of mistake. And I put it aside. I didn't think about it. And then when the code officer was there, I found the car there. She was doing something. I asked, excuse me, what are you doing? I wanted to understand what the situation was. She didn't want to tell me what she was doing. And that's how the confrontation that she mentioned started. We don't need to go into that. I ascertained that she's writing a ticket for improper placement of the bins. I tried to plead with her not to write a ticket because we didn't understand what was wrong with where the bins were. I think any reasonable person would say that this is not physically a right-of-way.

1:46:01Speaker 21

Well, I don't know what a reasonable person would say, but I will tell you what property records show. If you get a survey of the property, clearly that is a right-of-way.

1:46:12Speaker 11

Well, the fact is that nobody walks there. Nobody can park there. Nobody can...

1:46:17 – 1:46:34Speaker 21

I understand, but I assure you it is dedicated as a right-of-way on the deeds and on a... on a survey. So that's number one. Let me ask you a couple questions, sir. What day is your pickup?

1:46:34Speaker 11

Tuesday and Friday.

1:46:36Speaker 21

Thursday and Friday?

1:46:37Speaker 11

Tuesday and Friday.

1:46:38 – 1:46:55Speaker 21

Okay. So if this photo, and it clearly says that's on the screen, Thursday, September 11th at 9.50, and your pickup is on Tuesdays and Fridays,

1:46:57Speaker 11

Then it's within 24 hours of pickup. That's another thing.

1:47:10Speaker 11

I also have some other pictures.

1:47:12Speaker 21

Well, it has to be removed. It says removed 24 hours. Not that it can be put out there.

1:47:18Speaker 20

You don't put it out 24 hours in advance.

1:47:22 – 1:47:40Speaker 19

He also... If... Oh no, I know, I know. He also has the garbage and recycling, which garbage is every Tuesday and Friday. Recycling is every second and fourth Tuesday of the month, which both containers are out there every day.

1:47:40 – 1:47:55Speaker 11

Well, R is not correct. I understood what she wanted us to do. Now we put them inside the gate. There's no problem anymore. The problem is before September 11th this year when we didn't understand what the city wanted us to do.

1:47:57 – 1:48:57Speaker 19

Also, I would like to state that he says that the confrontation was because of me getting out or something. I was sitting in my car with the windows up and he pulled up and he got out with the baby and he was bamming on my window. So I rolled the window down and he says, why are you here? And I said, I have the right to park here. And he says, why are you in front of my house? So I said, since you asked, I'm gonna explain to you that I'm about to give you a ticket because I've given several warnings and educational blitz, and he says, oh, what you mean? And I said, the paper, I even highlighted everything. He says, oh, I don't read that. I don't read junk mail. Okay, well, that's why you don't know. He goes in the house as I'm getting out to post. He comes back out with a paper that he say he threw away. He says, is this what you're referring to? I said, correct. That's it right there. And as I posted the ticket on the gate, he snatched it down.

1:48:58Speaker 19

So I said, sir, I need to take a picture of that. And if you'll see in one of the pictures, he's holding it for me to take the picture. Okay.

1:49:06Speaker 21

Does your documents show when you gave warnings?

1:49:13Speaker 20

It's not included in this one. We can, if you want to.

1:49:17Speaker 19

Right, and he says that no one was there. There's a lady that lives in the house, she has black hair. I've seen her several times walk down the street and put tree trimmings.

1:49:28Speaker 22

All right, but we're not here on tree trimmings.

1:49:29Speaker 19

But I'm just saying, someone was there all summer. Okay. I just wanted...

1:49:36Speaker 11

I'm sorry, nobody was there in the house all summer. Is she saying that somebody lived in our house this summer?

1:49:45Speaker 21

Well, I have this one. Okay.

1:49:52Speaker 20

But if they do a paper warning, it's not going to be in the system.

1:49:59 – 1:50:15Speaker 11

And I wanted to show one other thing. These are examples of two other houses on our street, Franklin, our houses at Hibiscus and Franklin. This is two examples of bins that are left out. These pictures were taken on Monday morning. So that is 24 hours before trash pickup.

1:50:16Speaker 21

Okay, well, two things. Number one, you don't know if they were cited. I'm just saying. They may have been cited. I'm just saying.

1:50:26Speaker 11

This is something that we see regularly. This is a typical week.

1:50:29Speaker 21

Well, that's the problem.

1:50:30Speaker 11

And any week you come, you would see the same thing.

1:50:32Speaker 21

Well... that's what the officer is saying, that that's a problem in this neighborhood, is that people are leaving them out, and that's why they've tried to do an educational course.

1:50:42Speaker 11

Well, we understand that, finally, and we bring the bins inside, inside the gate now.

1:50:47 – 1:51:23Speaker 20

Madam Magistrate, the property owner has already admitted that he doesn't understand what the public right-of-way is. That's his issue. That's not the city's issue. This is clearly in the public right-of-way. It is on the other side of the sidewalk. He's got them there. You can't put your bins out 24 hours in advance. It's supposed to go out the evening before the pickup, and then you remove it 24 hours afterwards. In this particular case, even for the Friday pickup, this wasn't... The blue bin should not have been there, and the green bin certainly had been there. He admits they kept them there, and they pulled them back. The property is guilty of the violation, whether he understands or not.

1:51:23Speaker 21

I understand your position. Sir, do you have anything else that you want to say?

1:51:28 – 1:51:43Speaker 11

Well, I understand that it should have been a warning that we understood... to bring the bins in. There was no chance to receive or respond to such a warning. So I believe it's not warranted to give a fine.

1:51:43Speaker 21

Are you denying the fact that you were warned beforehand? Are you saying that you were never warned?

1:51:49 – 1:52:09Speaker 11

We weren't given a warning. Because the paper that we read, it says, remove the bins away from the curb. And in this particular case, the bins aren't on the curb. They can't be at the curb for the trash pickup because of the way the wall is created there. So we always remove the bins away from the place where they were for trash pickup.

1:52:09 – 1:52:40Speaker 21

He's not entitled to a warning. Please, please. The problem that I have here is that your pickup is, according to the inspector's testimony, is on Mondays, I'm sorry, on Tuesdays and Fridays. This photograph was taken on a Thursday, and that's for your garbage. Your bulk or your recycling, which is the blue can, is picked up, I believe she said, the fourth Tuesday of every month.

1:52:40Speaker 19

Second and fourth Tuesday.

1:52:40 – 1:52:56Speaker 21

Second and fourth Tuesday of every month. So with these items being here on Thursday, September 11th at 2025 at 9.50 a.m., this is a violation. Okay, you may have cleaned it up, but this is a violation.

1:52:56 – 1:53:09Speaker 11

This is not where we even leave the trash for pickup. The trash comes in a truck and they have an automatic arm that takes them and puts them in. It's impossible for them even to take the trash from where they are. They're at that next to that wall.

1:53:09Speaker 21

Okay, but these items, they came from your property. They're your garbage containers. Are you telling me now that maybe somebody put them there?

1:53:20Speaker 11

No, I'm saying that that's not where they are for trash pickup.

1:53:23 – 1:53:38Speaker 21

He thinks this is about where he's putting them for pickup. I understand what he's saying. He's saying that he does not put them there on the days of pickup. I get that. But they're put there and they're stored there on non-pickup days. That's what it looks like to me.

1:53:38Speaker 11

Well, we didn't understand, neither I nor my wife, that that was an inappropriate place for storage.

1:53:48Speaker 11

Because the warning was not material. It didn't address the specific case of our situation.

1:53:55 – 1:55:42Speaker 21

Okay. Well, a couple of things. Number one, there's no requirement to give warnings. That's number one. Number two, I find that you did know and you did have a piece of paper. And if you didn't understand it, I am almost positive there was a number on there or contact information. You should have done your due diligence, and you should have contacted the inspector and find out what is this all about. Even if you were gone all summer, and I believe you were. You said you were, and I trust that you were. But these items cannot remain stored here. And from what I'm seeing, it looks like on a non-pickup day for either garbage or for bulk, which is a Thursday... Those items were there. I don't believe that the officer moved them and put them there. I don't believe that the garbage department placed them there. That's where they were being stored. It's a lot easier for you to come out of your gate and dump it in this container than constantly having to roll these things back and forth. But unfortunately, that's what the law is and that's what's required. And it sounds like there was no enforcement for a very long time in this area. And all of a sudden now the city is cracking down and enforcing it for whatever reason. Maybe it's becoming a traffic hazard. I don't know. Maybe it's an aesthetic issue. I don't know. But clearly these items should not have been there that day. So I'm going to find you guilty. I'm going to fine you $79, which is the citation amount. And I am going to also assess prosecution costs of $50 for this, so making it a total of $129.

1:55:42Speaker 11

Why are you assessing prosecution costs for me when you waived it for everyone else?

1:55:47Speaker 21

Well, I hear each case on a case-by-case basis. I think that you knew that this was wrong, that you should have done something. And you didn't do it.

1:55:57Speaker 11

No, we absolutely didn't know. That's what I'm saying.

1:55:59 – 1:56:53Speaker 21

Well, then you have an opportunity to appeal my ruling. But I think you knew. I think the city gave you ample opportunity. And that's my finding. And if you don't agree with it, which is your prerogative, you can go and appeal this matter to the courts. And I would suggest that you talk to the inspector, because it sounds like you may have in the future some other violations. And maybe she can explain to you what they may be. And so what you need to do in order not to be fined again for other violations.

1:57:31Speaker 22

Is there an address for the appeal if he wants to appeal this? Is it 73 West Flagler? They're moving, huh?

1:57:39Speaker 20

It's the Circuit Court of Appeals for the 11th Judicial Circuit.

1:57:43Speaker 22

It's the appellate division.

1:57:45Speaker 21

Okay. Come and get a copy of the signed order. You have 30 days to appeal this decision.

1:57:59Speaker 20

There are no other cases? Yes.

1:58:02Speaker 22

Are you ready to go through the list? I'm ready.

1:58:26 – 1:58:41Speaker 20

Well, if they left, they left. We'll just start from the beginning and go through for the no-shows. You can just page number, address.

1:58:44 – 1:58:56Speaker 25

Page 32, case number 00137280. Property address 3200 Elizabeth Street. No-show.

1:59:00Speaker 21

So the appeal is denied and the

1:59:03Speaker 20

Yeah, so anything that's a no-show, the appeal's denied. I believe pages 37 and 39, people checked in, but they're not here anymore, so that'll be a no-show.

1:59:15 – 1:59:27Speaker 25

Page 37, case number 00137050, property address 1521 Northwest 31st Street, no-show.

1:59:28Speaker 21

Well, the only problem that I have is that they were here. They left.

1:59:32Speaker 22

What? I understand that they left because they're not here, but I don't know why they left.

1:59:37 – 1:59:56Speaker 20

Do we know, were they told that they had to remain? Yes, everybody's told they have to remain. When you check in, they're told that they're given a number. They're told to have a seat, wait for that number to be called up, and do that. Okay, sorry.

1:59:56Speaker 22

And these weren't a situation where there was no proper... power of attorney that you know of.

2:00:02Speaker 20

They never spoke to anybody. If, in fact, these are the people actually signed in or if it was somebody else signing there for somebody else who was here, who knows? Okay. Yeah.

2:00:14 – 2:00:50Speaker 25

Next case, page 39, case number 00139151, property address 650 Southwest 35th Avenue. No show. Next case, page 73, case number 00140590, property address 28, Northwest 32nd Street, A, no show.

2:00:51Speaker 21

And you said 70 was a no show as well, right?

2:00:54Speaker 25

No, 70 was a, sorry, let me read that case.

2:00:58Speaker 20

70 is a reset. It's a reset. Sorry, page 70 was a reset.

2:01:06Speaker 20

Not only that, we did have, no, not only that, somebody actually did show up, but they didn't have a good power of attorney, so.

2:01:12Speaker 35

Okay, okay, there we go. But it was reset anyway, so it worked out.

2:01:19Speaker 25

Next case, page 91, case number 00140586, property address 402 Southwest 18th Avenue. No show.

2:01:38Speaker 21

Okay, wait one second, that was?

2:01:41 – 2:01:54Speaker 21

Got it, okay. And I believe that's it. Let me just go through here real quick to make sure.

2:01:58Speaker 21

Only a few no-shows.

2:02:00Speaker 22

Okay, that looks like covers it all.

2:02:04Speaker 21

Thank you all very much. This concludes the ticketing appellate special master hearing for Thursday, November the 13th, 2025. Thank you.
