So to put it in perspective, that company owns the building, but they leased the building to the shareholders who run eight clinics from that building. Understood. So here's what we would say. Number one, the tree was not harmed. We have a picture of the tree that I can show you. I can put it in the record. We also have an arborist report, no damage to the tree. We didn't act intentionally to violate the law. We hired a company that was licensed to do the trimming. They clearly violated the rules per the hearing. But McClendon didn't go to that hearing. I don't think that he understood the issue, that that was an issue. But again, they didn't act individually. They hired a company to do it. In addition, my client didn't ignore the obligation to get an after-the-fact permit. They hired a company by the name of ARC back in 2022. They filed the application. He thought they were handling this application as it was. It got dismissed six months later. They didn't follow through until we got a letter from the city attorney saying, hey, you owe all this money. We contacted them, and they filed the application both for mitigation and for the property. This property, the fine, is clearly 50% or more of the value of the property. These guys... We're just trimming trees. Somebody mentioned this about your code 1711 says you don't need a permit to trim trees.
That's not correct.
Hold on. Hold on. I didn't finish. You don't need it unless you don't comply with the guidelines of A300, very general guidelines. But that's neither here or there because my client said, Made a mistake. He didn't show up to that hearing. And so he's liable. He's liable for the fine. We're not contesting that because we can't. But we can say that the tree is in fine shape. We didn't intentionally do the harm. $900,000 is just an unreasonable fee. We would ask you to give us the lowest fee that you can, which is $15,000. So interesting, I found out about this through one of the six people who were selling a house, and the lien came up. Otherwise, this thing would have went on forever. So just a little background, we never got notice. So what happened is the notice address is to one of the people who are 90 years old. He went into an assisted living. My office sent to the county a change of address for my office. The county never changed it. And what the county did, what we found out after all this, is they sent a letter back to the old address saying, we can't update your address without a partnership agreement because there's six people. So we never knew about this property. Now, as far as posting, so I'm actively involved since all the owners were in their late 80s, 90s. There was a manager, a property manager, who was also helping us with the property. He was there four or five times a week. We had a big homeless problem there. We were working with the police officers. I have emails back and forth. We even went to court because there was a drug deal and we had to testify. So all the notices would get ripped down. We have pictures. So we even tried to lock the back gate so they couldn't get in the parking lot. But then the police officer said, do not do that. We can't help you. If it's locked, we can't get in there. So we were in constant contact. In fact, I have an email. So the property was cleaned like five times a week. So when the code of compliance went down there and I spoke to her, I think in late 2024, she saw some garbage from the homeless people. Well, that was cleaned a few days later. But we never knew. Eventually, she put a notice, I think in March, saying you have until May 25th. Well, I have an email from the property manager saying, I just cleaned it. That was like three days earlier. At that point, I know the property was fine because it's a medical center. And we got a lease. We finally got a lease. So from September of 24 until April, we signed a lease. So the people started coming in early June. So we had a roofer out there. So in May, so right around the time. So she drove by on May 25th.
