Code Enforcement Board - Regular Meeting

Wednesday, July 22, 2026

The Code Enforcement Board granted numerous extensions of time for property owners to comply with code violations and significantly mitigated fines for several properties, with some liens reduced from hundreds of thousands or millions of dollars to thousands or even zero. 0:18 – 2:16Speaker 7

Good evening. Everybody who's here tonight is either here for an extension of time, which means you're asking for more time to comply, or you're here for mitigation, which means you're asking this board to reduce the fines that have been imposed against your property. When your case is called, please come to the podium and state your name and the address you're here on behalf of. If you're here for an extension of time, go ahead and explain to the board what you've done so far and how much time you need. The cities will make a recommendation as well, and the board will determine how much time you need to finish complying and whether you're going to get that time based on what you've done or haven't done so far. If you're here for mitigation, there was a chart that was provided earlier, and if you haven't gotten it, please come up and get it while you wait. That is what the board is authorized to mitigate to. They cannot mitigate any further than that. That is what the city commission has authorized them to do. When you come up, state your name, address, tell the board why you believe the fine should be reduced or mitigated to the lowest possible amount. The board will make a determination. They'll make a vote. I will walk over to the city attorney. I will pick up a order. The chair will sign it. You come and wait for me over here and I'll hand you the order with the amount that you have to pay and the instructions to pay. There's going to be a paper that you're going to get. Okay, so just wait for me here so you can take that piece of paper. And all orders of the board are appealable to the 11th Judicial Circuit Court of Florida within 30 days after it today's hearing. And if you have not signed in or have not spoken to me about your power of attorney because you haven't signed in or spoken with a clerk, give her a chance and stand over here and I will talk to you on an individual basis. All right.

2:19Speaker 28

3:15Speaker 22

So far, we have worked with an engineering firm for about 10 months now on getting these permits. We have two different process numbers, one for the fence, one for the driveway.

I'll motion for extension time, 120.

5:16Speaker 28

All those in favor? Aye. Thank you, ma'am.

6:03Speaker 28

You're more than welcome.

6:04 – 6:15Speaker 21

And don't forget, you can request an extension of time just so you don't need anything. Yeah, you can take it the exact same way you did it before. If you lost your paper, then take it again. If you still have it. Awesome.

It's been a safe side. Move to 120 days. I get a second? Second. All those in favor? Aye. Aye. Thank you, sir. 120 days. 120, yeah.

6:54Speaker 21

7:35 – 7:59Speaker 36

Well, we did. Not realized it was expiring. We're in the process. We have requested reopen that master permit. We just received the sub-approval finally after two years of the driveway process this past week. From Public Works? Yes. We're asking for 120. No objection. We have closed out one of the sub-permits, so I think it's more than enough time.

7:59Speaker 28

I move for 120. Thank you. Second? Second. All those in favor? Aye. Thank you. Take the paper up there if you need the extension.

9:54Speaker 34

Hi, my name is Lakevia Harris. Property is 1320 Northwest 68 Terrace. Okay.

9:59Speaker 21

Properties in applicant corrections. Yes. So you would recommend 120. Okay.

10:03Speaker 28

10:07Speaker 21

You good with 120? Okay.

10:29Speaker 22

Good evening. For 576 Northeast 63rd Street.

10:35Speaker 21

Okay. Their plans were just approved, so... City recommends 120.

10:40Speaker 23

Move for 120. Second.

10:43Speaker 28

All those in favor? Aye. Thank you, sir. You have 120 days. Take the paper if you need it again for an extension, okay? Thank you. Have a good evening.

11:09Speaker 20

Good evening. My name is Dianely Perez, and my address is 3080 Southwest 17th Street, Miami, Florida, 33145.

11:17Speaker 21

And how much time do you need?

11:19Speaker 21

Okay. We don't have anything in the system.

11:23Speaker 20

Last time I was here, I had to fire the person that was doing everything for me.

11:28Speaker 21

Oh, okay. I remember the address.

11:30Speaker 21

I didn't remember your face, but I remember the address itself.

11:33Speaker 20

So I'm just working right now. I just paid. For a new person to do everything again.

11:39 – 11:50Speaker 20

But I know that they did like the, I don't know how to say that, like the survey. The plans. Yeah, and we're like in the final. He was telling me that he was in the final.

11:50Speaker 21

Okay, they haven't uploaded any plans yet, just so you know.

11:53Speaker 20

Yeah, because it's a new person.

11:55Speaker 21

A new person and they just did the survey?

12:00Speaker 23

Hopefully, you got a survey recently?

12:02Speaker 20

I would say maybe like two weeks ago.

12:05 – 12:16Speaker 28

Okay, that's fine. Make sure the survey is only good for so much time. I have a motion that was probably made for 120. I have a second. All those in favor? Do you have any objection?

12:16Speaker 21

No, no city objection.

12:18Speaker 28

Aye. Aye. Aye. Thank you.

12:20Speaker 20

All right, thank you so much.

12:21Speaker 28

You're welcome.

12:38Speaker 25

My name is Jamal Scott, 812 Northwest 55th Terrace.

12:43Speaker 21

I don't want to crush his thunder, but it's ready for inspection, so the city recommends 120 days. I'll take your recommendation.

12:51Speaker 18

Move for 120. Second.

12:52Speaker 28

All those in favor? Aye. Thank you. Good luck, sir.

13:14Speaker 28

Good evening, sir. Good evening, how you doing? I'm Rene Martinez, 925 Northwest 58th Street. How much time do you need and what have you done? If I could get 120 days, we'll be great. Okay.

13:23Speaker 21

They're in applicant corrections. Okay, perfect.

13:26 – 13:39Speaker 28

Move for 120. Second. All those in favor? Aye. Thank you, sir. Appreciate it, thank you. You're welcome. Yes, grab the paper just in case. Just in case.

13:41Speaker 2

Yep. Page 67, property address 1636 Southwest 9th Street, case number 00126794. Good evening.

13:52Speaker 29

Good evening. I'm Joseph Parra, Coral Grove Development. Okay. The property address is 1636 Southwest 9th Street.

14:00Speaker 28

Wait, I just want to make sure we're on the right page. What's the page? Yeah. 67. 67. And what was that, Judge?

14:06Speaker 29

1636. There it is. 9th Street.

14:09Speaker 28

Thank you. How much time do you need? What have you done? 120 days. Okay.

14:13Speaker 29

I got the plans approved. I just got to pay the fees and then start pulling the permits. Okay.

14:19Speaker 21

They haven't resubmitted.

14:21Speaker 29

They haven't? I have the package here. It says approved.

14:26Speaker 21

There's no objection to the 120, but make sure that they...

14:29Speaker 29

Okay, because, yeah, on the plan.

14:31Speaker 21

They're not in iBuild. That's what she was saying. She couldn't see some stuff.

14:34Speaker 29

Okay, I got it from Project Dogs where the department just said approve, approve. I just got to pay the fee, which is like.

14:41Speaker 29

I move for 120.

14:42Speaker 28

Second. All those in favor? Aye. 120, sir. Thank you.

14:45 – 15:04Speaker 2

You're welcome. Page 62, property address 321 Southwest 21st Road. Case number 00084944. Page 62.

15:08Speaker 33

Good evening, sir. Good evening. Armando Sandra, 321 Southwest 21 Road. Gotcha. How can we help? We resubmitted plans. We're waiting for new comments.

15:17Speaker 21

They're an applicant correction, so 120 days.

15:21Speaker 18

Move for 120.

15:23Speaker 18

All those in favor?

15:24 – 15:41Speaker 28

Aye. Thank you, sir. Thank you. You're welcome. Great evening. You too. That was last EOT? Perfect. Oh, you want to do mitigations? All right, mitigations. Let's go.

15:43 – 15:54Speaker 2

All right. Page 115, property address 4353 Southwest 2nd Street, case number 00089136.

15:54 – 16:11Speaker 21

This is a single-family home. It is not homestead exempt. When I checked, The lien ran to $98,250. So the minimum is $10,000, or with a unanimous vote, you can go down to zero.

16:11Speaker 23

What's the page number again?

16:13Speaker 18

115. And you said there's no homestead? Because our book shows here it does have it.

16:17Speaker 19

Do you live in a property, sir? No, sir. Good evening to all.

16:20Speaker 28

Good evening, by the way. My name is Adrian Henriquez. Okay. So you don't live in a property, so it's a rental.

16:26 – 16:51Speaker 19

No, no, we've just been trying to get the property up to date. Where I messed up is last year I was here and asked for an extension because my plans were getting approved. Once my plans got approved, I didn't think I had to come back because there's a permanent number that expires. So I never came back to the... So the other extension, I wasn't sure I had to come back. So that's kind of where I messed up. But if you see every month, we've been complying. It's been a long process.

16:51Speaker 21

He did get his permit. He did everything else timely.

16:55Speaker 19

My driveway permit took five months. I paid engineers that took money from me. People will come help me because I'm still trying to understand the process. It's very difficult.

17:04Speaker 21

Are you guys going to move into the property?

17:06Speaker 19

It's been such a nightmare.

17:07Speaker 21

This is the shape that it was in, so you can see. They got it.

17:13Speaker 19

I think we should, you know. We complied with everything, driveway, grass. And what are you guys going to do with the property now?

17:20Speaker 25

What's your intention with the property?

17:23 – 17:34Speaker 19

We're still not sure. There's a lot of money, and especially depending on how much I have to pay on this lien, we'll make a decision upon that. If you guys can help me, I'll greatly appreciate it.

17:34Speaker 28

I see you got your family here with you. I'm sorry? No, no, I'm just seeing who you got your folks with you in the audience and stuff, so yeah. Thank you.

17:43Speaker 19

You know, maybe God is with me today. We could get a hearing and someone could help me. It's very hard times right now. And today's, you know.

17:52Speaker 21

Again, the minimum is $10,000 or by unanimous vote, you can go as low as zero or anywhere in between.

17:59Speaker 19

Yeah. I'm not asking for zero. If it is, I greatly appreciate it. But if you guys could please help me out. Yep.

18:06Speaker 28

Yeah, but we're human. We understand. Thank you so much. Going through things and stuff like that, especially if you hire somebody to do something, they run off with your money.

18:14Speaker 19

It's happened to me multiple times, and I have proof of receipts. I even thought about getting an attorney, but that even costs money as well.

18:22Speaker 18

I would move to reduce the fine to $5,000. I'll second that.

18:37Speaker 28

Okay, so there's been a motion that's been probably made and seconded for $5,000. All those in favor? No.

18:46Speaker 28

All right. Can we get a new motion, please?

18:51Speaker 23

If we can really, really, really, really help them out, make a motion to make it zero.

19:00Speaker 28

I'll second, if I can.

19:03Speaker 23

Yes, you can. I'll second.

19:08Speaker 28

No discussion? All those in favor?

19:12 – 19:26Speaker 28

Aye. Aye. Motion fails. Motion fails for lack of majority. So, I mean, unanimous. So, let's call for another motion. So, where are we at? We said no to 5,000. We said no to zero. So, we're somewhere in the middle.

19:26Speaker 25

I'll move for 2,000. 2,000.

19:28Speaker 28

I'll second that. I'll second that, too. All those in favor? Aye. 2,000 sounds good.

19:33Speaker 19

Thank you so much, guys. No problem. I really appreciate it.

19:35Speaker 28

God bless you all. All right.

19:38Speaker 28

Have a good one, okay? Yeah, wait for your... That side. Yeah, wait for them to sign off on it for you.

19:56 – 20:11Speaker 2

Thank you. Yeah. Page 122, property address 1215 Southwest 37th Avenue, case number 007. 23-158. All right.

20:14Speaker 21

This property is a commercial property. The lien ran to $915,000. All right. The minimum is $15,000.

20:24Speaker 28

Gotcha. Good evening, sir.

20:26 – 22:28Speaker 17

Good evening. My name is Alfred Gonzalez. I'm an attorney with Gunster with Officers 901 Ponsonable. Okay. I'm here representing the... the owner of the property, CYA Acquisitions. So to put it in perspective, that company owns the building, but they leased the building to the shareholders who run eight clinics from that building. Understood. So here's what we would say. Number one, the tree was not harmed. We have a picture of the tree that I can show you. I can put it in the record. We also have an arborist report, no damage to the tree. We didn't act intentionally to violate the law. We hired a company that was licensed to do the trimming. They clearly violated the rules per the hearing. But McClendon didn't go to that hearing. I don't think that he understood the issue, that that was an issue. But again, they didn't act individually. They hired a company to do it. In addition, my client didn't ignore the obligation to get an after-the-fact permit. They hired a company by the name of ARC back in 2022. They filed the application. He thought they were handling this application as it was. It got dismissed six months later. They didn't follow through until we got a letter from the city attorney saying, hey, you owe all this money. We contacted them, and they filed the application both for mitigation and for the property. This property, the fine, is clearly 50% or more of the value of the property. These guys... We're just trimming trees. Somebody mentioned this about your code 1711 says you don't need a permit to trim trees.

22:28Speaker 21

That's not correct.

22:30 – 23:10Speaker 17

Hold on. Hold on. I didn't finish. You don't need it unless you don't comply with the guidelines of A300, very general guidelines. But that's neither here or there because my client said, Made a mistake. He didn't show up to that hearing. And so he's liable. He's liable for the fine. We're not contesting that because we can't. But we can say that the tree is in fine shape. We didn't intentionally do the harm. $900,000 is just an unreasonable fee. We would ask you to give us the lowest fee that you can, which is $15,000. Understood. Now.

23:10Speaker 28

Yeah, it's 915,000, and today's your lucky day. That's a lot of training. A lot of money, but it's a minimal amount. What's the use of the property?

23:19Speaker 17

Here's a picture of the tree.

23:20Speaker 28

Yeah, we understand. Okay. Yeah, I mean, there's a threshold that we have, so we understand.

23:29Speaker 17

Fortunately, that, and we contributed to this, and we understand that, too. Understood.

23:34Speaker 21

It was four trees. It wasn't one, it was four.

23:38 – 23:58Speaker 28

Yeah, there's some other notes on the back end. They're all standing. Yeah, but it's okay. Here we are. The minimum is $15,000. Gotcha. Can I get a motion for $15,000? I make a motion for $15,000. I get a second. That's the lowest we can go anyway is $15,000.

23:59Speaker 18

Sir, what's the use of the property now? Sorry.

24:02Speaker 17

The used property is an office building, and they run their administrative offices for clinics that they own throughout the...

24:09Speaker 18

So it's owner-occupied? No, it's an office building.

24:12Speaker 17

Yes, it's owner-occupied.

24:14Speaker 18

But it's owner-occupied?

24:16Speaker 18

So they were there when they were cutting down the trees and everything?

24:19Speaker 17

I don't know if they were there because they're running clinics, but they hired somebody to do it. They just simply didn't do the job the way they should have done it.

24:26Speaker 28

Right. Yeah. Any other questions? Can I get a motion, please?

24:41Speaker 26

Yeah, try again.

24:45Speaker 28

Well, I'm asking for a motion of 15,000, so can I get a motion?

24:53Speaker 25

Any more discussion? Yeah, I'm just looking at this because it's a lot of trimming.

24:59Speaker 30

It's a lot of, and your client's still responsible ultimately.

25:02Speaker 25

I mean, he can hire who you want, but ultimately he's still responsible for what happens on his property.

25:08Speaker 18

And it was four trees, not the one that you showed. It's not just trimming.

25:10Speaker 25

I mean, you saw the pictures.

25:12 – 25:23Speaker 17

But every tree is in good shape. The arborist also responded to that in his report. And in the end, we were just trimming trees.

25:24Speaker 25

I would move to $20,000. I'll second that.

25:27Speaker 28

That's not a bad discount. Yeah. So we've got a motion for $20,000. I second. I'll second.

25:36Speaker 26

All those in favor? Aye.

25:39 – 25:51Speaker 28

All right. Thank you. Good evening. No problem. That's an $895,000 discount. Okay. Thank you. Next case.

25:57Speaker 2

This is an add-on from CityView, so it's not going to be in your package.

26:01Speaker 28

Is it mitigation?

26:02 – 26:15Speaker 2

Yes, it is. Okay. Property address 4101 Northwest 11th Place. Case number CE2018-022910. Right here. Property address 410 Northwest 11th Place. Mm-hmm.

26:21Speaker 28

We don't have it.

26:23Speaker 27

Good evening. Good evening. My name is Frank Acosta. My address is 705 Southeast 13th Circle, Homestead, Florida.

26:29 – 26:42Speaker 28

Okay. Give us a second to get some background on this since we don't have it in front of us. Madam Attorney. 4101. Yes. 4101 Northwest 11th Place.

26:46Speaker 27

So the property. One second. Yes.

26:50Speaker 21

He can go ahead. I just need to...

26:52Speaker 28

Okay, so you're still looking for it? Okay.

26:54 – 27:10Speaker 27

The property is now vacant. When the fire started, right after the property burnt down. Okay, so cleared it out. I don't know how the chart worked for us, but it was a single-family, non-homestead. Gotcha.

27:10Speaker 28

Single-family, non-homestead.

27:12Speaker 27

Now it's a vacant lot.

27:14 – 27:31Speaker 28

Now it's a vacant lot. Yeah, immediate use should be single family outside of that. But it's non-homestead, so you guys are not living in there or anything like that. Now it's a vacant lot. Now it's a vacant lot. Before it was non-homestead.

27:31 – 28:02Speaker 21

The issue with this property is, if you look up at the board, and we have a collections matter since 2024 on this property. They owe us $22,507 because it was the city who demolished the property and brought it into compliance. And we're owed a total based upon that and the tickets, plus all of our interest and fees that we've accrued, not including the amount that's owed on this case, is $25,742. Okay.

28:05 – 28:16Speaker 27

Yes, I have the updated payment for the demolition. For the $25,000? Yeah, which we know we have to pay that. You paid it already? We're going to pay that.

28:16Speaker 21

We're going to. See, they haven't paid it.

28:18Speaker 27

Yeah, but more important is to mitigate this before we move forward paying anything else. Oh, well. I believe. Well.

28:26Speaker 25

What's the other fine, Madam Attorney?

28:29 – 28:44Speaker 21

So there are, so you see there's. What's what? What's the total? The total on this one is $363,300. Okay, so. It is vacant land. The city did the demolition in 2023, which brought the property into compliance.

28:45 – 29:18Speaker 21

The demolition cost $22,507.79. Yep. There are two tickets of $200 each. There's $2,834 owed in interest fees, postage, and title lien search fees. And the city hasn't received any payment towards that or agreement to pay it. We don't have anything in writing. And generally we request that it be paid in full before they get mitigation.

29:18Speaker 25

Yeah, I was going to ask you if that can be contingent on any mitigation be contingent.

29:22Speaker 21

So you can order this mitigation amount, but only that this amount is, you know, paid within the amount of.

29:32Speaker 23

Twenty seven. Twenty five.

29:33Speaker 21

It's twenty five thousand seven hundred forty two dollars and fifty four cents. And I don't know, you know, pay within 30 days.

29:39Speaker 23

You need to pay that first.

29:41Speaker 21

If you want them to pay it first and then have them come back, we can do that too and put them on the September calendar.

29:47Speaker 23

Because this is non-negotiable. This is something the city did. You have to pay the city. It's a help, I guess.

29:54Speaker 18

Have you guys had any help with insurance or anything after the fire?

29:58 – 30:12Speaker 27

If I could explain. Yeah, go ahead. Mr. Austin obviously has not complied with anything. I'm new here to help him. And we have a business plan. So I'm going to pay this.

30:12Speaker 6

I'm going to pay this. That's $25,000.

30:16 – 30:27Speaker 27

But I can't pay this unless we mitigate this so everything gets paid at once. Why? It's going to be. Why? Are you selling it? The property is going to be transferred, yes.

30:27Speaker 21

You're selling it. So you want to.

30:29Speaker 18

You need to mitigate the fines.

30:31Speaker 21

You want to pay the fines out of the proceeds of the sale.

30:35Speaker 21

Do you have a copy of your contract for sale?

30:37Speaker 27

Yeah, I was going to say. I am the buyer. You are the buyer.

30:40Speaker 21

So where's the copy of the contract for purchase that will include that these monies are going to be paid?

30:45Speaker 27

Okay, I have it in an email.

30:49 – 31:00Speaker 21

The city would ask that this be reset to September 3rd because you can come with a contract that says the city's going to be paid the money that's owed out of it. That way... We won't object.

31:00Speaker 27

It's going to be a cash deal, and I don't see why it won't be paid in 30 days.

31:04Speaker 21

Okay. That's the city's request.

31:07Speaker 23

I move to do what the city requests. Yeah. Before we take a motion.

31:10Speaker 27

What is the request? Can you explain it again? I didn't understand. Yeah, so the request is going to reset it to September.

31:16 – 31:34Speaker 21

Well, no, that he's got, he says he's buying the property, he's paying cash for it, but for some reason he doesn't want to pay the outstanding money cost. The city's actually out before he can get mitigation, which is The minimum is $7,500. It was a home before that. There's wiggle room on that.

31:34Speaker 23

Hey, we'll help you on that.

31:35 – 31:47Speaker 28

We just need to know the exact number. But here's the thing. We wouldn't give you mitigation without knowing that you've paid for what is owed. So I think that should be a good sign for you that we're even considering it.

31:48Speaker 27

Okay, so... This could be paid.

31:51 – 32:05Speaker 28

And then we can consider to help you, yeah, because the previous use of the property was a single family home. Right, it was a home, right? Now it's a vacant site now. Yeah. Yeah, so that means it drops it down. We can go as low as potentially zero, right, Madam Attorney? Yes. If we wanted to.

32:05Speaker 27

The closing office that we hired is the one that says that nothing should be paid until there's a square number.

32:11Speaker 21

Well, then you need a contract.

32:12Speaker 28

Yeah, that's what we're asking for.

32:14Speaker 21

If you're using closing attorneys, then you need a contract. But then you're saying you're paying cash. Why should you have to have a contract?

32:20Speaker 27

We have a contract. You say you have it in the email.

32:24 – 32:46Speaker 21

Then put in the closing contract that the money dispersed will be this amount to the city of Miami and then the closing agent. will have to pay the city that money, and then they're going to give you your mitigation if you don't pay in cash before closing. And you can come back in September with that document that's signed by everybody. September 3rd.

32:46Speaker 28

Is there anything sooner?

32:49Speaker 28

There's no hearings in August. Today would have been a day for you to bring everything that you needed to bring, because there's no more hearings after this one until September.

32:57Speaker 27

We'll just go ahead and do the closing and then come back.

33:00Speaker 18

Well, that's up to you.

33:01Speaker 28

That's on you on that one. But yeah, but I mean, look.

33:04Speaker 18

You can ask for an extension on the closing.

33:08 – 33:19Speaker 28

We can, yes. Yeah, if you want to make sure your money is good before you do anything else, maybe that's the best course of action. We can't give that type of advice here, but we can offer you the mitigation once everything has been cleared up.

33:19Speaker 27

So we're looking at $75,000? Is $7,500?

33:21 – 33:33Speaker 28

No. So it could be $10,000 or possibly lower. Yeah. Okay. Okay. And actually, it would be considered lower.

33:33Speaker 21

It could be $10,000 or lower. Or lower because you're a property.

33:36Speaker 27

It doesn't matter whose name the property is in when I come out.

33:40 – 33:51Speaker 21

No, what matters is its current state or in the case of whether if it was a single-family home or duplex, if that was the use at the time of the violation.

33:52 – 34:06Speaker 28

Was that homestead at the time of violation? No, it wasn't. No, it was not. It was just a single family. That's all. So, yeah, like I said, we can potentially go lower than the amount that's there, but we're not going to do any of that until we know you've resolved those issues. We're here to help.

34:06Speaker 27

But we're here to help. We want to make sure that we're not going to be tagged on the hundreds of thousands of dollars.

34:14 – 34:38Speaker 21

Well, that's the dice you roll, or you can put it in your sales contract, extend your closing, come here with a signed contract stating that the closing agent is going to remit money from the closing agency in the amount of the 25,000 and whatever that was, to the city, plus pay whatever is ordered by this board. And then you haven't expended money in advance, but you're coming here showing us the contract.

34:38Speaker 18

You can even have the... That will be September when?

34:41Speaker 21

September 3rd.

34:42Speaker 27

September 3rd, okay, thank you.

34:44Speaker 21

Ms. McCloud, this case is going to get reset for September 3rd. Okay.

34:48Speaker 28

Do we need a motion for that, just to be on the safe side? No? No?

34:54 – 35:07Speaker 28

Do we need a motion for that to reset this case? Okay, thank you. All right, next case. See, you know, we want to help, but, you know.

35:08Speaker 2

Page 48, City View, property address 644 Southwest 4th Avenue, case number CE2020-010-539. Is that 44 or 48? 48.

35:23 – 35:34Speaker 21

Page 48. This is vacant land. The lien ran to $509,500. The minimum is $7,500. Okay. Okay. Hi. Good evening.

35:38Speaker 1

Good evening. My name is Gabriela Moya. I'm here with my husband and our lawyer. Okay.

35:44 – 35:57Speaker 28

Do you want them to speak on your behalf at any point? You can put your name and address on the record. Yeah. Hi. My name is Rob Hyman. And do you want to speak or no? Oh, there you go. No problem. We just want to make sure. Okay.

35:57Speaker 9

110 Southeast 6th Street.

35:59Speaker 28

All right. Thank you.

36:00Speaker 9

Okay, ma'am.

36:03 – 37:02Speaker 1

Our case is that we recently, in June 2026, we received a letter telling us we have a line set in 2020. We didn't know about it. I have here they've been sending to the wrong address or to the back-end land where nobody could receive. in our zombies it is said our our address our mailing address we have not received anything and we just find out about this 10 years after so that's why it's so high i have all the pictures that the property have been maintained over the years okay and if this happened in june i don't know if the person that we hire he skipped one month or because it was COVID time. I'm not sure about that. But we are responsible. We've been keeping this property and we are...

37:03Speaker 28

Okay, so let me ask a couple questions.

37:05 – 37:21Speaker 21

The property appraiser report, as you can see here at the time, they listed the mailing address for the property as the vacant lot. Now, because it was a corporation, the city also pulled the Sun Biz registered agent. So we have to mail it to the vacant lot because that's required by law.

37:21Speaker 21

And then this was the registered agent, Brad Hacker, who was also sent the mail.

37:29Speaker 28

One second. You know who that is?

37:30 – 37:45Speaker 9

Can I interject? Yes. So the registered agent was receiving notice. There's no question about that. The issue is when these folks bought this property and the company was formed, they were living in Ecuador. They didn't know the registered agent, the person who put the company together, listed this person as a registered agent.

37:46Speaker 21

I don't know that that's the issue here, but the minimum is $7,500. Yeah.

37:48 – 38:39Speaker 9

I understand, but we're trying to present why we would like you to mitigate it from that large number to the minimum. And so the point I'm making is that they didn't have any connection to this registered agent. They were new to the country. This was their first property that they owned. Properties since that and subsequent to that, they have listed a registered agent who they have interaction with. They pay their taxes on the property because they get notice of Whenever there's an issue, they have lawn maintenance folks who take care of that. And so it's an issue of making, not a mistake, but not understanding the significance of having a registered agent and then coming to a country and living the American dream, God bless, but not realizing that this was out there. Had they had notice from the registered agent, then this would have been taken care of as far as an official response saying, hey, this was taken care of back in 2020 or 2022.

38:40Speaker 23

So they have a different registered agent that existed before?

38:45 – 38:57Speaker 9

No, no, I'm sorry. The present registered agent is still the registered agent, and so we're realizing that there's an issue here. They just got notice of this, and so obviously they recently, as of yesterday...

38:58Speaker 23

The same registered agent that was sent all the information prior?

39:01 – 39:16Speaker 9

I'm sorry, I misunderstood your question. Yeah. For any other properties... It is not this registered agent. Okay. This was the sole property for the other properties? Yes. Okay. Different registered agent. And the current registered agent for this property will be replaced, I'm assuming, by me.

39:18Speaker 18

And that name is Brad Hacker. It sounds like maybe an attorney. Could it have been an attorney that formed it?

39:23Speaker 28

You don't know.

39:24 – 39:36Speaker 1

Okay. We did all this through a realtor. She advised us how to do it. She sped it out, everything. Understood. I understand. We were in April.

39:36Speaker 21

And you're Gabriela?

39:38Speaker 21

And you're Edgar? And you have, in 2020, you also had an address in Boca Raton?

39:44Speaker 1

Yeah, it's the same address.

39:45Speaker 21

Hey, okay. So the minimum is $7,500.

39:48Speaker 25

I moved to reduce it to $7,500.

39:50 – 40:01Speaker 28

I second. So we got a motion that's been made and seconded to reduce it to $7,500, which is a discount of $502,000. $400,000 or something. No, $500,000.

40:04Speaker 23

Of 502,000? Yeah, 502,000.

40:07Speaker 9

This is the part where skilled lawyers say absolutely nothing.

40:09Speaker 28

Okay. But thank you. We appreciate you. And the American dream.

40:13Speaker 9

All in favor? Aye.

40:16Speaker 9

Thank you all very much. Appreciate your time.

40:18 – 40:39Speaker 28

Thank you. Wait for your signing, okay? Oh, not bad. Big Dixie. Big discount. I know. Too slow. I know. Too slow. Too slow. We have a heart today.

40:39 – 40:51Speaker 2

Page 102, property address 528 Southwest Fifth Avenue, case number 00076248. Hey. Good evening. Good evening.

40:51Speaker 31

Good to see you again. Good to see you again as well. Much shorter than the last person said.

40:56Speaker 21

This is a commercial property, apartment building. Lean ran to $421,500. The minimum is $15,000. All right. I told Mr. Marrero not to be long-winded.

41:07 – 41:46Speaker 31

Okay, so I have a lot to say, but I will honor Rachel's request. Essentially, our clients bought this property with the understanding that there was a violation. They met with the city before they closed on how to fix it. And unfortunately, they got some misinformation. They were advised that they just had to obtain a permit. Ultimately, they were trying to do that, and then they got cited for an unsafe structure violation related to the same work that they inherited. That created all sorts of holds. You know about the approval quagmire that can sometimes happen. All this time, the fines were running. They thought it was a two-week fix. It ended up being a multi-year fix. They spent a significant amount of money, so we're asking for the $15,000. We think that's fair here.

41:46Speaker 28

I move to reduce it to $15,000. Second. That's a discount of $406,500. All those in favor?

41:53Speaker 31

Aye. Hope I was short enough, Rachel. Thank you all, have a good evening. 10 seconds over.

42:02Speaker 28

Last mitigation?

42:08 – 42:21Speaker 2

Page 31, property address 460, Northwest 25th Court, case number CE 2019-021107. That's City View? Yeah, City View.

42:22Speaker 28

Go, Paige. 31. Thank you. Good evening. Good evening.

42:26Speaker 21

This is a duplex with homestead exemption.

42:30Speaker 21

The lien ran up to $501,500. The minimum is $5,000, or by unanimous vote, zero.

42:39Speaker 28

Good evening, ma'am. State your name and address for the record.

42:41Speaker 36

Yes, I'm sorry. Marisol Gonzalez, 460 Northwest 25th Court.

42:46Speaker 28

Thank you. You currently live in a property?

42:50Speaker 25

Can I get any other questions here? No, I moved it to zero. Can I get a second? Second. All those in favor? Aye.

42:58Speaker 28

That's why I look forward to having you homestead, folks. Thank you. You're welcome, ma'am. Have a good one.

43:08 – 43:21Speaker 2

Page 21, property address 737 Northwest 22nd Court, case number CE 2018-006912. Page 21, City View.

43:21 – 43:48Speaker 21

This is a duplex. It does not have a homestead exemption. The lien ran to $719,000. I believe this is not the original violating owner. Right. And the minimum is $10,000. Or by unanimous vote, you can go as low as zero. It was for a failure to maintain and an encroachment. I probably have, like, a shed.

43:48Speaker 28

Yeah. Good evening.

43:49Speaker 3

Good evening. My name is Inwin Pineda. Okay. Address 737 Northwest 27th Court.

43:57 – 44:41Speaker 3

I purchased this property in January 2020. I didn't know anything about the violation until 2025. I received a postcard. And I contact with the city of Miami, and they didn't give me a complete answer until six, eight months later. So I went there physical to check out, and they told me there's a lien. And they say the lien has a violation back in 2018. Okay. which I don't own the property and I don't know what's wrong with it. So that's why I come here for the mitigation. Okay.

44:41Speaker 25

And what are you currently doing with the property? Are you renting it?

44:46Speaker 3

No, now it's only one unit. One is vacant.

44:57Speaker 23

When did you buy the property again?

44:59 – 45:36Speaker 3

I bought the property. It's from the previous one I have. I do the 1031 exchange. Smart. Yes. 2020, right? She bought it in 2020, two years after. Yeah, 2020, I bought it. So I went through the title search company, and I paid the title insurance. And they even searched, there is, there was a case back in 2018 from the 2018's owner, not even 2019 has another owner. He purchased from 2018 from the previous owner.

45:37 – 46:16Speaker 3

through the auction then he remodeling it after all his permit closed and he also in the closing agent he provided all the documents the title is clean everything is paid off there's no own and I have all the proof from my title agent give it that to me so I don't feel I'm obligated to anything because I didn't do nothing wrong. I tried to purchase the property to help me to my retirement. I'm a very old lady and I don't work now. I retire and I'm a widow.

46:17Speaker 21

The lien was recorded in 2018. Yeah. So it's recorded and as of record.

46:23Speaker 23

Yeah, so you are responsible. It's your property, but we'll try to help you out here. Thank you. But you are responsible. Can I get a motion? I'll make a motion to bring it down to zero. I'll second.

46:35Speaker 28

All in favor? Aye.

46:37Speaker 3

Thank you so much. You're more than welcome. I'm a good citizen. I pay my duty for the 40 years. Understood.

46:43Speaker 28

I appreciate you. Thank you, ma'am.

46:45 – 46:57Speaker 2

Okay. Page 106, property address 2059 Southwest 7th Street, case number 00031502, page 106.

46:59Speaker 21

This is a three-unit apartment. The lien ran to $186,250. The minimum is $15,000.

47:08 – 48:24Speaker 6

Good evening, sir. How you doing, sir? My name is George Martinez. Yes. I represent the deceased. Okay. Okay. It's a long story, so I'm going to try to keep this simple because I've had a whole bunch of issues myself. My aunt hired an unlicensed contractor, I think in 2021. I'm not sure the date. Charged her $30,000, did the concrete, did all that stuff there. They got a violation. When she got a violation, I had just lost my brother. Moving forward, My mom got sick. I was starting to represent her, so I got her a contractor to try to finish this. That contractor, we didn't give a deposit. I was dealing with what happened to me. I was in contact with Roberto Santos, that was the director at the time. So trying to do this short with my memory too. And my mom passed away in 2023 in my arms. So I hired a contractor myself. I think it was in 2024. I have the dates here. This is not a simple permit because you're on 7th Street.

48:25 – 49:18Speaker 6

So you had to get another permit also. So we finally got the both permits. Along the way, they finalized this. But in 2024, I lost my dad after 64 years of marriage. Didn't want to live no more. Dealing with that. Take your time, sir. So I finally closed this out, and Trueto Santos is no longer the director. He told me, George, take care of this violation. I sent him my mom's birth certificate. Along the way, I got hit by an 18-wheeler. So I got eight screws, and I'm glad to be alive. And I'm here to represent them to take care of this. Trueto Santos has been on top of this case. He's no longer the director. I have over 24 emails to him.

49:19Speaker 6

He told me, don't worry about it, George. When you resolve it, we'll take care of this and we'll put this to peace. And that's why I'm here now.

49:30Speaker 28

Madam Attorney, where are we at with this?

49:33 – 49:44Speaker 21

The minimum is $15,000. It was $186,250, so 20% wouldn't be less of the $15,000. Yeah, that's the lowest we can go, unfortunately.

49:44Speaker 25

I'm sorry, man, I can't hear you. That's the lowest we can go is $15,000 to reduce it down to $15,000. We don't have any...

49:52Speaker 21

The three-unit apartment building, it's commercial.

49:54Speaker 25

Unfortunately, that's commercial.

49:57Speaker 6

Even with the emails that I have from Roberto Santos, he said I wasn't going to have an issue with this lien. Because I have all the emails here.

50:04 – 50:36Speaker 21

Mr. Santos can't promise you anything, even as a director. And I'm sorry that that happened. because things like that shouldn't happen. For some reason, and you had a lot of things going on, once nobody appeared at the hearing and didn't request an extension of time, the lien was recorded in March of 2024 and it ran. So I can't speak for why anybody would make you promises that they can't legally keep, but the code itself requires that the minimum is $15,000.

50:38Speaker 6

Even with the extension of time he gave me through the email?

50:41 – 51:11Speaker 21

There is no extension of time through email. That doesn't exist as a matter of law. I don't know what that means. That's not valid. And I know you've been here a lot, and I've known you for years, and I know everything that you're saying is true, and it breaks my heart to hear what you've been going through. I mean, it really does. But nonetheless, this is where, for us, we're stuck. As much as I would like to say, gosh, can't we just zero this out? I can't. Yeah.

51:12Speaker 25

We don't have the authority to.

51:14 – 51:32Speaker 21

Now, if there's bad notice issues, I don't know if there's something going on. You want us to look into it? I'm more than happy to do that. We can reset it for September. But other than that, you know, like we would do with anybody if they think there's some issues that went on. But promises in an email, I just.

51:33Speaker 6

But what's the amount that they have to pay?

51:35Speaker 21

The minimum is $15,000.

51:38Speaker 21

Fifteen. One five.

51:39Speaker 6

One five. How long do I have to pay for that?

51:41Speaker 21

Thirty days.

51:43Speaker 6

Can we get an extension of time for September like that I can talk to them like that they have time to pay?

51:48Speaker 21

You want to come back so that they have time to put the money together?

51:50Speaker 6

I don't have an objection to that if you guys want to do that. Can I pay that before that? No.

51:56Speaker 21

Well, it won't count.

51:57Speaker 6

Just put it yes.

52:00Speaker 6

Okay. No. I want to go ahead and be done with it.

52:03Speaker 28

You want to be done with it?

52:05Speaker 6

I'll talk to them and then.

52:07Speaker 28

And just deal with it that way.

52:08Speaker 6

And then we got 30 days to pay for it, correct? Yeah.

52:11Speaker 21

Or at least start making a payment. So let's say if you don't have all, at least get a payment in.

52:15Speaker 21

And then follow it up with the remainders. But you can get interest charged on what's still due and owing. That's why the 30 days.

52:22Speaker 6

And who do they send the payment to?

52:24Speaker 21

They'll give you the information. It'll go to finance. But once they'll send you the email with how to pay it.

52:30Speaker 6

Okay, I appreciate all your help. Thank you. Okay, well, we can make a motion. Hold on. Sorry for getting so emotional.

52:36Speaker 28

Hold on. Let's make the motion first so we can get the order. We're not done.

52:39Speaker 25

I move to reduce it to $15,000 so we can go. Second.

52:43Speaker 28

All those in favor? Aye. Okay, so wait for your order so we'll sign off on it, okay?

52:54 – 53:05Speaker 2

This is an add-on and code check, add-on two, property address 7619 Northeast Third Court, case number 00140272.

53:11 – 53:31Speaker 21

This property, the lien is a commercial property. The lien ran to $15,500. The minimum is $15,000, but... I already did the math in advance and with a calculator. 20% of $15,500 is $2,100 as the minimum. Gotcha.

53:33Speaker 28

Good evening, ma'am.

53:34Speaker 36

Good evening.

53:35Speaker 28

State your name and address for the record.

53:37Speaker 36

Thank you. You're here for mitigation?

53:46Speaker 28

Okay. So as of right now, what's the amount again?

53:52 – 54:14Speaker 21

It was $15,500. Because you can do 20%, obviously $15,000 is the minimum. But you also have the caveat of you can give 20% to any lien. That would take it under the $15,000 to, I'm sorry, $3,100. The 20%. The 20%, yeah.

54:14Speaker 28

3,100. 3,100, yeah. So right now, with the mitigation that we're offering, it'll be $3,100 from the 15,500.

54:26Speaker 18

I think that's the lowest we can do. I'd like to see when people come in and actually respond to these things, so I'll make a motion to reduce it to the $3,100.

54:34Speaker 28

I second. Okay. Do you want to say anything?

54:39Speaker 2

I wish it could be lower.

54:41Speaker 28

Yeah, it was two, but there's a threshold we have that we can't go below that one.

54:48Speaker 26

Yes, there are...

54:49Speaker 15

They're not going to...

54:55Speaker 25

No, no, no, no, no.

55:03Speaker 28

You said 3,100? 3,100, yes. Okay. All those in favor?

55:08Speaker 28

No, no, no, no, no. One second here. Let's see what's going on.

55:31Speaker 22

He has no problem paying the $3,100.

55:33 – 55:53Speaker 28

Okay, thank you. All right, just wait for the order. All right, thank you. Next case. Is that the last of the mitigations?

55:56Speaker 28

Oh, there's more.

55:57Speaker 21

I'm just going to start calling ones out loud. All right, all right, all right. Got to get moving.

56:06Speaker 28

I like mitigations, so bring them on.

56:09Speaker 2

Page 28, property address 4865. What calendar is that? Oh, City View.

56:17 – 56:28Speaker 2

Property address 4865. Northwest 7th Street, CE 2021-008-234. They also have another case out here. Excuse me, I'm sorry.

56:30Speaker 28

What page is that on?

56:32Speaker 2

This is an add-on, add-on 2 in City View.

56:35Speaker 28

All right, so we'll deal with that one second because we can't see it. You might want to do it together. No, I know, but I'm saying we'll wait until you pull it up.

56:41Speaker 21

So this is a vacant lot?

56:44Speaker 28

What was the immediate pass you used?

56:46Speaker 21

The vacant lot. The vacant lot. The minimum is $7,500. Okay.

56:49Speaker 28

Gotcha. Good evening, sir. Good evening. And good evening, ma'am. You state your names and address for the record.

56:54 – 57:06Speaker 35

Ibrahim Gantous on behalf of Martin McCarthy, who's the attorney of record. I'm an attorney myself, but he's at a funeral today. Understood. Thank you very much. This is for 4865 Northwest 7th Street.

57:06 – 57:28Speaker 28

Okay. And you can pull the mic a little bit closer to you. Maybe that's better. Thank you. All right. So we have the first case. And my name is Alitza Weiss, 3187 Royal Road. Okay. Thank you. The first case, the lien ran to $435,250. And this is a... It's a vacant lot?

57:28Speaker 21

Yeah, it's a vacant lot. It's always been a vacant lot. The other property is the same as well.

57:34Speaker 21

Vacant, always vacant.

57:35Speaker 25

Okay. Can I make a motion on both cases, Madam Attorney?

57:38 – 57:49Speaker 21

Well, no, they haven't called. I can call it up. Add-on number two, 4875 Northwest 7th Street, case number CE-2021-005024 is the other one.

57:49Speaker 20

Rachel, weren't there three?

57:53Speaker 21

No, you have one that's not complied yet.

57:56Speaker 29

But the inspector said it was in compliance.

58:03Speaker 21

Maria Zink. Okay, so you have two cases on.

58:08Speaker 28

Yeah, you have two cases currently right now.

58:09Speaker 21

You can speak to the other people that you've been talking to as well. They've received the emails. So there are two cases here today.

58:17Speaker 28

All right. What's the second amount for the lien?

58:20Speaker 21

The second amount was, the total was $438,250, and the minimum is $7,500. Again, they're vacant lots. They were vacant lots before. All right, so they're both at $7,500.

58:33 – 58:47Speaker 25

So I moved to reduce property address 4865 Northwest 7th Street to $7,500. And then I moved to reduce property 4875 Northwest 7th Street to $7,500 as well. Thank you.

58:48Speaker 28

Can I get a second? Okay, you guys understand? We're good with that? Yeah, it's fine. Very much. All those in favor? Aye. Thank you. Okay. That's a very big discount.

58:58 – 59:12Speaker 2

Yeah, finish. Page 111, property address 169 Northeast 69th Street, case number 00010614. This is a vacant lot. It ran to $310,250. I believe it's got new construction going on now.

59:12 – 59:32Speaker 21

The minimum is $7,500. Has the house been CO'd on the property?

59:33 – 1:00:37Speaker 14

Good evening, first of all, Gus Bravo. Thank you. 999 Fairfield Meadows. Thank you. I'm actually a lawyer, but this is not my cup of tea. It's my father's company, so I'm here kind of out of obligation. They're building a duplex right now, and they have the permit. And this is a little bit of history. We were here in February of 2022 on an issue of noncompliance, and we got 48 hours to comply. We did that. We got an affidavit of compliance. A few months later, an issue came up about, I guess, a roll-off container that my father put on the property that he got a permit for. And so I was in communications with the inspector. I have emails to corroborate that, asking, look, do we need to, because she said we needed to remove it. I said, do we need to remove it? We have a permit. Went back and forth, back and forth, between May of 2022 and July of 2022. At no point did she mention anything about any fines, let alone a hearing. We were not aware of the hearing. I'm the registered agent of the company. I don't have a record of that. We would have shown up. There was a hearing apparently in July of 2022.

1:00:37Speaker 21

And you're Gustavo Bravo?

1:00:40Speaker 21

At Bonaventure Boulevard?

1:00:41 – 1:01:13Speaker 14

That's me. Correct. And so, look, I have no doubt that they were sent. I'm just letting you know. We didn't know. We would have shown up. That being said, the hearing, I guess, from 7-12-2022 gave us 10 days to comply. And we did. Actually, on 720, I have a video. We didn't realize it was about this issue until a few days ago. So I was just able to find a video. We provided photos to the folks who would be dealing in the city. But I have a video on 720 that my father took where the container's off, property's empty, everything's out.

1:01:13 – 1:01:34Speaker 14

So... I know that it's $7,500, but I mean, our position is it was complied within the 10-day period. So frankly, we would request it be zero. It's being developed as a duplex. I don't know if that changes the analysis, but we would ask for some leniency given that it was complied within the 10-day period. I'm happy to show you guys the video so you can see for yourself of what the property looked like.

1:01:35Speaker 25

There's no CO on the property yet, right?

1:01:37Speaker 14

Is there a CO? No, no, I'm sorry, it's being developed right now. It's being developed right now. Yeah, yeah, it's under construction.

1:01:42Speaker 28

Yeah, Madam Attorney, that's pretty interesting. What do you think about that one? I think that it was complied and, I mean, were they...

1:01:49Speaker 25

But there was no affidavit of compliance.

1:01:51 – 1:02:21Speaker 21

The affidavit of compliance was not issued until 2025. But if you say you have the video... The affidavit of noncompliance was issued... on July 20th of 2022. He's stating they have a video. That's great, but I don't know who took that video. They never called anybody out to confirm the compliance, which is part of the requirement. And so, you know, if they want to meet with the code inspector to see, I mean, I don't know if they might have, did you email somebody on the 20th and say we're in compliance?

1:02:21Speaker 14

I did. I have the email to the inspector saying.

1:02:23Speaker 21

That's not something I can deal with here tonight.

1:02:25 – 1:02:36Speaker 14

We can reset it. We reset it. I mean, can we just lower it to 75 at a minimum and then I can deal with that number and then deal with the minimum is 7,500, but you're not going to get a refund after that.

1:02:36Speaker 21

If this gets lowered to 7,500, that's the end.

1:02:38Speaker 14

Let's kick the can down the road. That's what we're asking. All right.

1:02:43Speaker 21

So reset it for the end of September.

1:02:45Speaker 21

What's the, what's the date in September? September 22nd.

1:02:50Speaker 14

All right, for my birthday, hopefully.

1:02:52Speaker 21

There you go. Thank you. So in the meantime, you can come and get her card or my card, and then we can go through. And if you have stuff where you reached out, we will take that into consideration.

1:03:03Speaker 28

Thank you. Next case.

1:03:07 – 1:03:27Speaker 2

Page 122, property address 1215 Southwest 37th Avenue, case number 00023158. We already called that one up. Oh, sorry, code check? We call a code check?

1:03:32Speaker 21

You said 122? Page 122 was lowered to $20,000.

1:03:35Speaker 25

That was the one with the trees. With the commercial space with the trees.

1:03:46 – 1:04:01Speaker 2

Page... Sorry. 87, code check, property address 4015 Northwest 7th Street, case number 00092892.

1:04:04Speaker 21

This is a commercial property. Lean rent of $587,000 and minimum is $15,000.

1:04:11Speaker 28

Good evening, sir. Good evening.

1:04:13Speaker 21

And do you want the minimum?

1:04:15Speaker 28

On behalf of ownership. Okay, you want the minimum?

1:04:20Speaker 25

Yes. Okay, move for $15,000.

1:04:23Speaker 28

Can I get a second?

1:04:26Speaker 28

All those in favor?

1:04:27Speaker 28

All right, that's over a $500 and some thousand on the discount. We'll wait for your case.

1:04:51 – 1:05:07Speaker 2

Page 14, City View, property address 3811 Northwest 2nd Avenue, case number CE2015-005-466. Oh, 14. This is a commercial property, ran to $221,000. The minimum is $15,000.

1:05:07Speaker 21

Good evening. Good evening.

1:05:16 – 1:06:31Speaker 16

I am Vilma Biagi, and the corporation that holds the property is Stormy. Okay. I bought this property many, many years ago, and I was going to do a music venue, and I came to the city, but we found so many obstacles to get the permits for that, and I'm a physician, and I got super busy, so I leased the property to a very nice tenant. And we had kind of an epidemic of graffiti. And he painted the building several times, and the graffiti kept on happening. And I guess he had a violation. He did have a violation for graffiti. And he fixed it, repaired it. But I think he was not aware there was a fine existing. Neither did I. And now, I want to go back to my dream of the music venue I have pianos in my office, and I want to move them there, to have a nonprofit music school for kids. And it's the perfect property. And getting the 40-year certification, we found out that this was existing. This is there. Until then, I was not aware.

1:06:32 – 1:06:44Speaker 16

But evidently, he complied with repairing the graffiti, corrected it, but I guess there was a remaining fine that multiplied to this number.

1:06:44Speaker 16

And I just became aware.

1:06:46Speaker 21

All the notices were sent to the owner and the registered agent.

1:06:50Speaker 21

So, and posted at the property. Right. The minimum is $15,000.

1:06:55Speaker 25

The lowest we can go is $15,000. So, I'll make a motion for $15,000. I second the motion.

1:07:01Speaker 23

All those in favor? Aye. Aye. It's the lowest that they let us go.

1:07:07Speaker 16

What is the lowest?

1:07:09 – 1:07:41Speaker 16

That's a lot. Yeah. I would love to use that money for this purpose of teaching music. I have an existing association, which is called Miami International Piano Festival, that we are going to do this at home, and I'd much rather use that for... I am not a poor person, and I appreciate you being very gentle with... The city code doesn't allow it to be lower than 15,000. That's the minimum.

1:07:46Speaker 25

Since it's a commercial property, that's the lowest we can go. We don't have authority to go any lower.

1:07:51Speaker 18

Is maybe a nonprofit organization? But it's not yet. Not yet? It's not yet.

1:07:55Speaker 28

If it was, it would have been different. But it has to be at the time that we're doing it.

1:08:00Speaker 25

But right now, the discount that we have is a $206,000 discount.

1:08:03 – 1:08:15Speaker 28

I'm aware. Okay, now I just want to make sure of that. We're trying to help, okay? It's a very good discount.

1:08:16 – 1:08:40Speaker 21

If I would have been aware of the fine. No, I believe you. The notices went to Alan Marcus as your registered agent for Stormy LLC, which is the owner of the property, right? Yeah. So notice went to you, to your corporation. And unfortunately, your registered agent didn't tell you and your property was posted and maybe your tenant didn't tell you either. And that's unfortunate.

1:08:41Speaker 21

But the city code has a minimum, and they can't go any lower.

1:08:45Speaker 25

Yeah, there's a matrix we need to follow based on the type of property it is, and that's just the lowest we can go. We don't have authority to go any lower, unfortunately.

1:09:04Speaker 28

Well, once we get here, it's only mitigations. We can't relitigate the cases.

1:09:09Speaker 25

Yeah, it's been adjudicated already.

1:09:11Speaker 28

Yeah, it's already been decided. It is what it is. I'm glad to help with the $206,000. The best we can do.

1:09:17Speaker 18

And good luck with the organization, with the music.

1:09:19Speaker 35

And I would like you to come and see the place. Okay.

1:09:22Speaker 28

We got the address, 3811 Northwest 2nd Avenue.

1:09:26Speaker 28

I look forward to it.

1:09:27Speaker 16

It's a warehouse.

1:09:28Speaker 28

Okay. Well, thank you very much for coming. Thank you.

1:09:32Speaker 2

Page 34, property address 170 Northeast 68 Terrace, case number CE2020000528.

1:09:42Speaker 21

It's a duplex. It does not have homestead.

1:09:46Speaker 2

Wait a minute.

1:09:48Speaker 21

Make sure I got the right one.

1:09:50 – 1:10:01Speaker 21

Duplex, not homestead exemption, ran to $449,500. The minimum is $10,000 or by unanimous vote, choose as low as zero. It's not homestead, correct?

1:10:01Speaker 13

It's not homestead.

1:10:02Speaker 21

Okay. Okay. All right, good evening. So it's $10,000 or less by unanimous. Gotcha.

1:10:06 – 1:10:39Speaker 13

And city council, I'm here. My name is Alexander Arlovsky. It's 767 41st Street in Miami Beach. I work with Ignacio Navajas, who's the manager. We've requested the zero, but we will take the $10,000. This is a property that was purchased in 2019. We found out there was an illegal unit. We started originally with the permit. The first architect left us. The second architect died in a horrible bike accident on Key Biscayne. It took, on the bridge, it took forever. Everything's been legalized. We'd request zero, but we will take that. It defines 450 right now.

1:10:39Speaker 25

And currently, the property's being rented, the duplex, both units are being rented?

1:10:43Speaker 28

Everything's been legalized. We need a motion for 10,000.

1:10:46Speaker 25

I will move to reduce it to 10,000. Second? Second.

1:10:50Speaker 28

All those in favor? Aye. Thank you, board members.

1:10:52Speaker 11

You're more than welcome.

1:11:10 – 1:11:23Speaker 2

Page 109, code check, property address 1119 Southwest 1st Street, case number 00109147. Good evening, sir.

1:11:24Speaker 37

Bruce Hornstein. I'm the attorney for the owner and I'm also a trustee for one of the six owners. Okay. It's a family that's owned the property for 50 years. Okay.

1:11:33Speaker 21

It's a commercial property. The lien ran to $117,500, the minimum. is $15,000.

1:11:40Speaker 28

Right, so it's $102,500 discount.

1:11:44 – 1:14:37Speaker 37

So interesting, I found out about this through one of the six people who were selling a house, and the lien came up. Otherwise, this thing would have went on forever. So just a little background, we never got notice. So what happened is the notice address is to one of the people who are 90 years old. He went into an assisted living. My office sent to the county a change of address for my office. The county never changed it. And what the county did, what we found out after all this, is they sent a letter back to the old address saying, we can't update your address without a partnership agreement because there's six people. So we never knew about this property. Now, as far as posting, so I'm actively involved since all the owners were in their late 80s, 90s. There was a manager, a property manager, who was also helping us with the property. He was there four or five times a week. We had a big homeless problem there. We were working with the police officers. I have emails back and forth. We even went to court because there was a drug deal and we had to testify. So all the notices would get ripped down. We have pictures. So we even tried to lock the back gate so they couldn't get in the parking lot. But then the police officer said, do not do that. We can't help you. If it's locked, we can't get in there. So we were in constant contact. In fact, I have an email. So the property was cleaned like five times a week. So when the code of compliance went down there and I spoke to her, I think in late 2024, she saw some garbage from the homeless people. Well, that was cleaned a few days later. But we never knew. Eventually, she put a notice, I think in March, saying you have until May 25th. Well, I have an email from the property manager saying, I just cleaned it. That was like three days earlier. At that point, I know the property was fine because it's a medical center. And we got a lease. We finally got a lease. So from September of 24 until April, we signed a lease. So the people started coming in early June. So we had a roofer out there. So in May, so right around the time. So she drove by on May 25th. I don't know what she saw, but it wasn't anything from before because it was cleaned up a day or two earlier. I don't know if it was the roofer stuff. So I don't even think the violation existed. But the worst thing is we never got noticed. If it was posted, the homeless people ripped it down. And if it was mailed, it was mailed to an address that my client wasn't there. And the other six owners never would get, it was only going to the one address. But my office sent the change of address to the county.

1:14:37Speaker 23

Sir, you just said change of address to the county. It had to be to the city.

1:14:43 – 1:15:07Speaker 21

So here's how it works. We get our addresses from the, we get the address from, and we're required by law to mail it to the Miami-Dade County Property Appraiser Address. For us, we've mailed it correctly. And in January of 2025, the address was 1865 Northeast 117th Road.

1:15:10Speaker 25

The city can only mail it to the address they have.

1:15:13 – 1:15:42Speaker 21

That's right, and if there was a corporation, we'd mail it to the registered agent pursuant to SunBiz. The hearing was in February of 2025, so it still had condition issues at that time, or it wouldn't have gone forward. And I don't think that's, again, the minimum is $15,000.

1:15:45Speaker 18

Are you stating you want to challenge the notice?

1:15:48 – 1:16:14Speaker 21

It's too late for that now. One, you don't have jurisdiction-determined notice. Two, the fact that they don't maintain their property or know that people are ripping things down, well, that's, again, that's a property owner's issue. They have a problem with the county. They can seek redress against the county, but the city followed the code in terms of requirements for mailing and for postings.

1:16:14Speaker 25

They met their burden.

1:16:16 – 1:16:30Speaker 21

On several different occasions on the property, even at times when they're saying the property was occupied by somebody. And you can see at some point it's occupied, right? So they got tenants there, right? That was that physical therapy?

1:16:31Speaker 37

No, there was no tenants there at that point. There was no tenant there.

1:16:36Speaker 21

Well, you were talking about having leased it out.

1:16:38 – 1:16:50Speaker 37

No, no, no. And when she gave the violation, because there was a compliancy, at that point, we signed the lease. The tenants moved in a week after she gave the violation. It was vacant from September.

1:16:50Speaker 21

Right, so again, we were posting the property when you had tenants there, and obviously your tenants... No, there was no tenant there.

1:16:58 – 1:17:15Speaker 21

The tenant didn't come until... Sarah, we didn't post your property only one time. No. We posted it three separate occasions. On what dates? Huh? No. Three separate times. But what dates? The last one was for the hearing was in December of 2024 for the hearing in January of 2025.

1:17:15 – 1:17:34Speaker 37

There was no, there was vacant. It was vacant from the summer of 24 until June of 25. And we had a property person go out there five times a week. We were dealing with the police. I was speaking to them. I even signed an affidavit. I'm not saying you guys did anything wrong. We mailed it.

1:17:34Speaker 21

Again, the city's position is the minimum is $15,000 in this particular case.

1:17:41Speaker 25

Either way, that's the lowest we can go.

1:17:44Speaker 37

I mean, it's a shame because they never knew I would have dealt with it. Understood. I make a motion.

1:17:49Speaker 21

That I understand, but the city followed all the requirements of the law.

1:17:53 – 1:18:07Speaker 37

And we followed everything. It's one of those unfortunate situations. Yeah, this is one of those. You don't know about something, and then you have to pay $15,000, and you're doing all the right things. Well, you could pay a lot more.

1:18:08Speaker 28

Yeah, the lowest we can do it right now is drop it down to $15,000, which would be a discount of $102,500.

1:18:15Speaker 23

I'll make a motion to bring it down to the lowest of $15,000. Yes.

1:18:20Speaker 28

All those in favor? Aye. So, you know, that's the best we can do at this moment, okay? And thank you for continuing doing what you're doing, you know?

1:18:30 – 1:19:04Speaker 2

The next constituent have two cases. I'm gonna call the first one. It's on City View, page 99, property address 425 Northeast 26th Terrace, case number 000582222. And then the next case is on page 37 in City View. Property address 2655 Biscayne Boulevard, case number CE2020-014985. I had to do math for the first one for the code check case. On page 99, it's vacant land. The lien was $12,500.

1:19:04 – 1:19:55Speaker 21

So the minimum would be $7,500 or 20% of that is $2,500. And that is for the one on page 99. The second one on page 37. Is that on City View? Let me get over to that one. Yeah. On 37, it's the vacant land as well, ran to $395,500, and the minimum is $7,500. So the minimum is $2,500 on the code check case and $7,500 on the City View case. Sir, your name for the record?

1:19:55Speaker 25

Sir, your name and address for the record, please.

1:19:57 – 1:20:08Speaker 10

My name is Nicholas Newman. I'm representing Edge Inn 5 and Mosquito Properties, all owned by the same people. Let's start with the lower one. Which are the two addresses?

1:20:08Speaker 25

425 Northeast 26th Terrace.

1:20:11 – 1:20:37Speaker 10

Okay, 425. So that is actually a bundle of properties, and we were actually over here in January 10th. Well, January 10th, 2024 is when we were informed. And we got this cleaned up in February 19. All of the folios were cleaned up except for one. I believe this is just a procedural issue with the city of Miami. And I have some emails here.

1:20:38 – 1:20:54Speaker 25

Okay, on that one, the fine ran to $12,500. So the lowest we can go would typically be $7,500, but we can also reduce 20% of the fine. So that would bring it down to $2,500. That would be the lowest we can go based on the type of property that it is.

1:20:55Speaker 10

Even though this is a procedural issue, because... I don't know what a procedural issue means.

1:20:59Speaker 25

Do you want to explain? Yeah, what issue do you want to raise? I mean, at this point.

1:21:03Speaker 10

These are six folios, all back-to-back.

1:21:07 – 1:21:19Speaker 21

Right, but each folio counts for itself. You don't get to have... Just because you have six folios stacked together doesn't mean it counts all as one. Each folio has to be dealt with separately. I don't know what your procedure is.

1:21:19Speaker 18

And each violation carries to each folio as well.

1:21:22Speaker 10

Whatever, I'll take the 20%.

1:21:25Speaker 25

Okay, do I have a motion for property 425 Northeast 26 Terrace?

1:21:30Speaker 18

Yeah, a motion to reduce from 12,500 to 2,500. Is there a second?

1:21:36Speaker 25

Can you repeat the motion?

1:21:38Speaker 18

Yeah, a motion to reduce from 12,500 to 2,500, which is the minimum. That's a 20%. That's a 20%. Do we have a second? Second.

1:21:48Speaker 25

All those in favor?

1:21:49Speaker 23

Aye. Aye. Okay, so the next one is...

1:21:57Speaker 21

The next one's also a vacant lot, went to $395,500. The minimum is $7,500. Yeah, case 14-985. Is this the same assemblage of properties? Yes, well...

1:22:12 – 1:22:52Speaker 10

Yes, this is in the front of Biscayne, right? The other two were in the back. Okay. The owner of this property is in her 80s. Back in 2021, I believe this is when this was issued, she was still in her 80s. However, she didn't get noticed. We were informed in mid-March 2025 when she brought the letter over to my office. On April 2nd, 2025, we did a follow-up with the city of Miami. We got a little bit more information from Inspector Lauzerique, And then on April 15th, we corrected it. So there's a big gap there from 2021 to when we actually received the letter. I don't know what to tell you guys.

1:22:52Speaker 25

The owner is very- The minimum $7,500. The lowest we can go on that one, 7,500.

1:22:57Speaker 21

And the land value in 2020 was, what was that? $3 million?

1:23:06Speaker 25

Is there any discussion or do we have a motion? Motion for 7,500. Do we have a second? Second. Are those in favor? Aye. Thank you.

1:23:19 – 1:23:30Speaker 2

Page 95, code check. Property address 126 Southwest 8th Avenue. Case number 00064372. Page? Page 95. 95, right? 95? Yeah. Thanks, sorry.

1:23:38Speaker 21

This is an apartment. The lien ran to $348,500. The minimum is $15,000.

1:23:47Speaker 28

Station name and address for the record.

1:23:49Speaker 24

Sandy Fonseca, 126 Southwest 8th Avenue. Thank you.

1:23:53Speaker 28

And the lowest we can go is $15,000.

1:23:56Speaker 24

This is a non-profit organization with the county.

1:24:00Speaker 25

A non-profit what, I'm sorry?

1:24:02Speaker 28

It's a non-profit with the county. Okay. Put your name and address on record. Yep.

1:24:07Speaker 26

Alex Bolaños, 701 Northwest First Court, Miami-Dade County.

1:24:12 – 1:25:01Speaker 26

So this is an asset that is owned by the Miami Beach Community Development Corporation. They are a winding down operation. So this property operates for a person 62 years and older. And we serve households at 50% or below of AMI. In order for the property to be acquired by the county, it has to come with clear title. The current sponsor is winding down operations. They don't have the funding to pay these fines. The county has made a capital advancement to remedy the property as far as addressing the water intrusion, painting the assets, repairing all of the life safety systems, stabilizing operations, and now we are ready to convey the property to the county to preserve the affordability.

1:25:01Speaker 21

You have a copy of your 501c3 paperwork? Yes.

1:25:04Speaker 28

Do you have it?

1:25:05Speaker 26

Just need to see it.

1:25:06Speaker 28

Just so we can admit it.

1:25:08Speaker 26

So the tax exemption is public record. If you look at the property, you'll see there has a tax exemption. You can provide me the copy.

1:25:15Speaker 28

If you got a copy, just quickly.

1:25:18Speaker 26

I may not have a copy on me, but we can provide that expeditiously.

1:25:23Speaker 21

Well, we have to have it today.

1:25:24Speaker 28

Today would have been the day.

1:25:25Speaker 21

Okay, so yes, we can pull it up.

1:25:27Speaker 28

Unless you want us to reset.

1:25:29Speaker 21

No, I think they want to sell it. To the county.

1:25:31Speaker 26

Yes, so, yes, so.

1:25:34Speaker 26

Actually, you know what? We have the MOU here. You need the tax certificate or you need documentation to show that it's a nonprofit.

1:25:42Speaker 21

What says that R-U-D-G-M-B-C-D-C-1-L-L-C is a 501c3 corporation? Yes.

1:25:50Speaker 28

Yes, that's. Whatever with that name needs to show it.

1:26:12 – 1:26:36Speaker 21

We'll see what the deed says. So it's a Florida limited liability company whose address is care of the development corporation.

1:26:36Speaker 28

That's the CDC. That would be normally a non-profit, that's CDC.

1:26:42Speaker 21

Who is, how is RUDG?

1:26:46 – 1:26:57Speaker 26

So it was developed through a joint venture. So RUDG was the development partner that actually has the capacity to develop the improvement.

1:26:57Speaker 21

Right, but how are they a nonprofit?

1:27:00Speaker 26

Well, RUDG is not a nonprofit. The entity, NBCDC, that is the nonprofit.

1:27:08Speaker 28

But that's not the entity that owns the property.

1:27:11Speaker 25

Yeah, but that's not the entity that owns the property.

1:27:16Speaker 21

This is where it helps to provide things in advance. I said it helps to provide things in advance so people can look at stuff. Because I can't.

1:27:23 – 1:27:38Speaker 26

Miami Beach Community Development is a... That's a non-profit.

1:27:38Speaker 20

Yeah, that's a non-profit. All right, so.

1:27:40Speaker 21

That's a non-profit. All right, that's a non-profit. Hold on. Where's my little thing? All right. It takes a while to get there.

1:27:48Speaker 28

No, we got you. We established it.

1:27:51Speaker 28

In the future, bring your daughter. All right.

1:27:54Speaker 21

An eleemosynary organization may be treated as a single family or duplex residential property. Right.

1:28:01Speaker 28

Which means we can go as low as zero.

1:28:02 – 1:28:15Speaker 21

Which means you can treat them under subsection D1, which means you can treat them... I guess as it doesn't say whether it's probably not homestead exempt, but 10,000 or two zero, if you wish.

1:28:15Speaker 28

Could you stay for the record? What is the use of the West with the cell and transference? What will be the use of the property going forward?

1:28:23Speaker 26

So it's to preserve the affordability of 24 households for elderly at 50% or below of AMI.

1:28:29Speaker 28

Thank you very much. Need that for the record.

1:28:32Speaker 25

24 out of how many units?

1:28:34Speaker 28

That's just 24 unit development. All for senior citizens. Okay. Can I have a motion?

1:28:40Speaker 18

Yeah, I'll motion to reduce this to zero. Second. All those in favor? Aye.

1:28:44Speaker 28

Thank you very much.

1:28:45Speaker 26

Thank you, thank you.

1:28:49Speaker 28

Wait for your order.

1:28:52 – 1:29:05Speaker 2

Yep. Page 85, code check. Property address 1755 Southwest 23rd Avenue. Case number 00070626. Page 85, code check.

1:29:06Speaker 21

This is a single family home with homestead exemption. The lien ran to $396,000. The minimum is $5,000 or to zero with a unanimous vote.

1:29:17Speaker 21

Good evening. State your name and address for the record.

1:29:20Speaker 20

Rachel Elizabeth Cooper, 1755 Southwest 23rd Avenue.

1:29:26Speaker 28

Gotcha. And I see everything has been complied. You currently live in the property, correct?

1:29:30 – 1:29:42Speaker 28

Thank you very much. Okay. Okay. Understood. We understand. Well, thank you for being a resident here. Can I get a motion? I move to reduce it to zero.

1:29:42Speaker 29

Second. All those in favor?

1:29:44Speaker 28

Aye. Zero. Zero.

1:29:48Speaker 28

You got your ma'am. This way. That way. Wait for your order, okay?

1:29:51Speaker 2

Page 73, property address 2231 Southwest 17 Terrace, case number 00067268.

1:30:03 – 1:30:15Speaker 21

Property is a single-family home. It does not have homestead exemption. The lien ran to $425,500. The minimum is $10,000, or as low as zero with a unanimous vote.

1:30:17Speaker 28

What page? 73. 73. Thank you, thank you, thank you. Good evening. State your name and address for the record.

1:30:22 – 1:31:53Speaker 32

Samuel Cain, 2231 Southwest 17th Terrace, Miami, Florida. I would like to give you guys a real... I've just been sitting here and watching the compassion of all of you. Very, very respectful. This is a home that's been in the family for three generations. It was my grandfather's home. He gave it to my mom. I grew up there, and I used to always tell my mom, one of these days you're going to have the nicest home in the neighborhood. She never made it to actually see some of the improvements, but a lot of the improvements were cosmetic. We put a nice fence up in the front yard. Unfortunately, we didn't think we needed a permit, but we did. But when I came here the last time, I hired Alejandro here to help me with getting a contractor, and we did. And I just assumed everything was fine. Paid them $2,500 to get the permitting. Because like I said, it was largely cosmetic. It wasn't anything structural. And so unfortunately, I would respectfully ask if your compassion would extend to me. It was done in an effort to make the property look a lot nicer. And we eventually complied. Thank you.

1:31:54Speaker 25

I'm sorry, I missed it. This is Homestead's property?

1:31:57Speaker 32

Non-Homestead? No. Okay.

1:31:59Speaker 25

And so who lives at the property now?

1:32:01 – 1:32:21Speaker 32

We have it leased to some medical students. I'm from New Mexico. But it's eventually one of those where it's very sentimental. Like I said, I grew up there. I grew up walking down to Shenandoah Park, playing tennis with my parents. And just one of these days I plan on moving back there. That's it.

1:32:23Speaker 28

Okay, so as of right now, it's 10,000 or with unanimous? Potentially take it down to zero.

1:32:29Speaker 32

If you guys could zero it out, man, I'd greatly appreciate it.

1:32:33Speaker 28

Well, we'll take a motion if someone wants to make one.

1:32:36Speaker 25

I mean, based on the fact that it's being leased, it's not owner-occupied, I would bring it down to $5,000. $5,000?

1:32:43Speaker 28

I'll second that.

1:32:44Speaker 25

Which is a single-family non-homestead, or a single-family homestead, actually.

1:32:48 – 1:33:08Speaker 28

And let me just, before I call the vote, because I don't want us to go back and forth, so Right now, the minimum was initially 10,000. We've lowered it down to 5,000. And what I don't want to do is have a back and forth, vote, vote, vote, vote, vote, because we're going back and forth. And so I think 5,000 is like a consensus from what I'm seeing with our board members. Nope.

1:33:09Speaker 28

So all those in favor, say aye. Aye. Thank you.

1:33:13 – 1:33:26Speaker 28

Okay. Okay, so I just wanted to save you the time, but five was probably going to be the lowest we would have went because it's also now homesteaded as well. Okay. Thank you. Thank you very much, sir. Madam Attorney.

1:33:30Speaker 2

Page 75, 328, Northwest 54th Street, 00121644. Madam Attorney, you see what I said? Let me just call the vote. Okay.

1:33:44Speaker 21

Okay, no consensus. This is a commercial property. The lien ran to $165,000. The minimum is $15,000.

1:33:52Speaker 28

Okay, good evening, sir. Oh, you said 328?

1:33:58Speaker 21

Yeah, what's the property? 328 Northwest 54th Street.

1:34:01Speaker 28

Oh, it's a vacant lot. It's a vacant lot right now?

1:34:03Speaker 21

Is it vacant now?

1:34:05Speaker 5

It is vacant. It's a vacant lot. What was the previous use? I was renting it for, I mean, I was to rent cars or sell cars. Okay, so it's just a lot. All right, hold on.

1:34:15Speaker 21

Let me just check.

1:34:16 – 1:34:33Speaker 28

Maybe I just... Yeah, let's just verify to make sure we give you the right... Yep. The page number was... 75. 75. Yeah. Ran to $165,000 for the lien, so let's just make sure we got the right usage here.

1:34:34Speaker 21

It's a parking lot.

1:34:35Speaker 28

It's a parking lot, so it's always been vacant.

1:34:39Speaker 21

Well, no. So it's permitted as a parking lot? Yes or no?

1:34:46Speaker 5

It's a vacant lot right now. My tenant was trying to use it as a parking lot, but he didn't get the permit, so he ended up leaving the lot. Okay. Okay.

1:35:00Speaker 21

Let me look at this.

1:35:02Speaker 28

It's vacant. Then they were trying to do a parking lot on it. Couldn't get the permit to do it.

1:35:06Speaker 18

And then he was fined for parking.

1:35:07Speaker 28

Then he was fined for trying to do parking. Hold on.

1:35:14 – 1:35:25Speaker 28

And then it looks like it ran as a result. Just give us one moment. Let us check some background stuff on it.

1:35:26 – 1:35:38Speaker 5

The tenant was trying to get the premise and did the surveys, plans, and he was, I don't know why, he was denied at the end. He decided, I mean, he stopped paying rent and he walked away.

1:35:38Speaker 21

Okay, yeah, I can see it now. All right, yeah, vacant lot. Vacant lot. Never mind.

1:35:45Speaker 28

7,500. 7,500 is the lowest we can go. All right, so that's the absolute lowest. So from 165,000 to 7,500 dollars.

1:35:55Speaker 23

Make a motion for $7,500.

1:35:57Speaker 28

Second. All those in favor? Aye. That's over $159,000 discount. Yeah, big discount. Wait for your order, okay?

1:36:07 – 1:36:19Speaker 2

Page 79, property address 1014 Northeast 84th Street, case number 00148249. All right, I had to do math again for this one.

1:36:19Speaker 21

Go ahead, your name?

1:36:20Speaker 30

Good afternoon, everybody. Luciano Pieri, 1014 Northeast 84th Street.

1:36:24 – 1:36:40Speaker 21

All right, so this is a three-unit apartment building. Okay. It ran to the grand total amount of $19,500. Okay. As a three-unit triplex, $15,000 would be the minimum, or 20% of the total, which would be $3,900. Yes.

1:36:42Speaker 28

3,900 is the lowest we can go. I'm sorry? 3,900 is the lowest we can go.

1:36:48Speaker 30

Oh, it's a vacant land as of now. We completed the demolition already. Oh, you completed the demolition.

1:36:55 – 1:37:17Speaker 21

Well, but it still ran to 19,500, so then your minimum would be 7,500, but 20% of the 19,500 would still be 3,900. Okay. so yeah it works works best for you to be so no matter what either way it's 20 20 of the 19 500 is going to be the lowest year they can go legally what were you looking for zero

1:37:19Speaker 30

We never got the notice. I think it was because we failed to register the property as vacant.

1:37:25Speaker 21

Well, that's why you got the violation.

1:37:27 – 1:37:58Speaker 30

Correct. Oh, that's one of them. It was an honest mistake. We never got the notice for the violation. We were in the process of getting the demo permit approved without knowing that we had to register the property. We didn't get the notice. I know it was posted. We got it afterwards. We also failed to get the notice of the hearing. So honestly, it was an honest mistake. We're in the process of redeveloping.

1:37:58Speaker 21

Your address was 4960 Southwest 72nd Avenue, Suite 206?

1:38:03Speaker 30

That's the registered agent's, yes. He probably got the notice. We never got it.

1:38:10Speaker 21

But you're a corporation, so that's who gets notice for the corporation. If you have an issue with your registered agent, then notice is good.

1:38:19Speaker 30

I'm no complaining that.

1:38:21Speaker 21

So the minimum with the 20% is $3,900. I'll move for reduction to from $1,900 to $3,000. How much? $3,900.

1:38:25Speaker 18

Second. All those in favor? Aye. Thank you, sir. Wait for your order, okay? Yes, sir.

1:38:41 – 1:38:54Speaker 2

Page 17, City View, property address 137 Northeast 47th Street, case number CE-2021-006897. Hi, how are you? Good evening.

1:38:55Speaker 12

Good evening. My name is Nicola Rubino, owner of 137 Northeast 47th Street.

1:39:02Speaker 21

All right, might be the winner for the day. This is an apartment building. Okay. The lien ran to $3,740,000.

1:39:12Speaker 21

The minimum is $15,000.

1:39:14Speaker 28

Already I can tell you the discount is going to be $3 million.

1:39:17 – 1:39:43Speaker 12

That's a lot of money. It's a good story. Okay. I bought my, this was my first property. It was for me. Yeah. In 2019, I didn't vote under my name because I wasn't in that time a resident to put it on their home set. Understood. Yes. And the recommendation for a title company was to buy on their LLC. So that's why it's on their LLC.

1:39:44 – 1:42:16Speaker 12

I moved to the property and then COVID hit and I wasn't able, I lost my job and I wasn't able to pay the mortgage. So I rented the property on February or March 2020, and the tenant started to do illegally short-term rental. And Inspector Migot, which has been amazing with me during the whole process, put a violation to the tenant, but that tenant, without my authorization, he did Airbnb and the illegal short-term rental, and he never sent me the notice. My registration on the LLC was on my of my office at that time and the office was closed because of COVID as well. So I never saw the notice. The person continued to do Airbnb and Inspector Miguel put again another violation and that was the repeat violation of the illegal Airbnb and that was the reason. So I started the eviction process, but eviction was not allowed on Airbnb, and he keep doing Airbnb without my authorization, and I called several times to Airbnb to put the listing down, but because I was not the owner of the account, it was impossible. Correct. And eviction were not... a lower also so i had my my tie hands my hands tied and i didn't have the possibility to do nothing so i haven't do the extension request extension to solve it because i never received that notice as well so Also put other things in the violation that is the illegal unit that was in the 1950. I bought the property like that, that the garage was converted to a to. Living unit, yeah. So I put all my savings again to put the property up to code. I got the affidavit. I met with Director Robert Santos, with Inspector Miguel, and Inspector Dennis as well, that in 2023, mitigation for property under LLC were not allowed. So I'm here today. to see if you can help me because I want to move with my family to that property. Gotcha. But it's not stable to move it in this condition. I don't know what can happen with a $3 million lien.

1:42:17Speaker 25

Well. And the minimum, Madam Attorney, is $15,000?

1:42:21Speaker 21

It's $15,000, yeah.

1:42:23Speaker 12

Quick question. Why is it commercial if that property is a duplex? Oh, it's a duplex.

1:42:29Speaker 25

Yes. Because based on his testimony, it didn't make sense.

1:42:34 – 1:42:47Speaker 12

It's not a building. It's not a triplex? No, no. That's why it was converted. The garage, it was a living unit, the garage, and they put it as like a garage again.

1:42:47Speaker 23

Oh, it was a triplex. So it probably got into a commercial.

1:42:50Speaker 12

It was not legal. So that's why I don't understand how it was a triplex. It was not legal. Right. It's truly a duplex.

1:42:59Speaker 23

It's truly a duplex.

1:43:03Speaker 28

Let's get some background real quick just to make sure we can verify.

1:43:06Speaker 21

It has four living units.

1:43:08Speaker 12

He said it was three because of the rush.

1:43:11Speaker 21

You know what? The property appraiser says it's four. Which means if you have less than that, then you need to speak to the property appraiser in the city because nobody's...

1:43:22Speaker 12

So that was the thing that I spoke with Inspector Migot. Why is it illegal if the property search is for a place? No, no, no.

1:43:31 – 1:44:06Speaker 21

That doesn't mean it's legally can be four units. That just means that the county's charging you for four units. Oh, right. And they'll charge you if you get the money, not because that's what it is. So if you have an updated... And if you did all of your permits, the property appraiser comes out and reassesses. I did. All I did was an outside pergola. And also some guy from the county is knocking on my door. I just want to see if you have it covered, because if it's covered, I get to add it to your square footage of your house. Thankfully, it was not. And I wouldn't do that because that would be wrong to do to a pergola. But but I didn't even know they were coming. I was like, let me in your backyard.

1:44:07Speaker 21

So, you know, just because my permit closed out, so I'll look in GIS and see what it says.

1:44:14Speaker 28

Okay. So as of right now, we're still at 15,000.

1:44:17Speaker 21

Yeah, I mean, if you can... Uh-oh. Oh, Lord. We either died.

1:44:23Speaker 18

What's happening with the property right now? Is there anybody in there? What's with the property now?

1:44:28 – 1:44:50Speaker 12

It's rented. I'm paying the mortgage with the rent. But I want to live with my family over there, but with that $3 million lien, I don't know if it goes to foreclosure. I have two babies and my wife. I don't want to stabilize on a property and then move out if it's a problem. So I want to solve this first before moving it and convert it to my primary home.

1:44:50Speaker 28

We're not going to let you go to foreclosure. I'll tell you that.

1:45:02Speaker 21

Hold on. Battery low. It's plugged in.

1:45:06Speaker 28

We just want to check something real quick.

1:45:09Speaker 12

Because the difference, if it is a duplex, can be lower, right? Potentially.

1:45:14Speaker 28

Well, I don't know. It doesn't look good right now. We don't know. Potentially.

1:45:18Speaker 21

Nothing looks good right now. Let's see where we are. I am using required thing. It is plugged in.

1:45:25Speaker 28

This is like the third or fourth time now this year you've had complications.

1:45:32Speaker 21

It's only the second time. The last time this happened, I didn't actually have it plugged in. That was my fault.

1:45:37Speaker 28

This one is not my fault. I wonder if you've been talking bad about the electronic.

1:45:43 – 1:46:05Speaker 21

GIS says that it's a 4.2 as well. So all we can say is if you have documents showing that it's not, You know, we can offer you to come back on the September date, and I'll give you my card. You can send the documents in. We can see what it is. But right now, we can't say that it's not a 4-2.

1:46:06Speaker 12

And what would be the difference if I come back with the document?

1:46:09 – 1:46:32Speaker 21

If it's a duplex and you're living in, well, it's a corporation, so it would be $10,000 or as low as zero. And this minimum is $15,000. So it could be a $5,000 difference. It could be a $10,000. I don't know. You could go... From 15 to zero. I don't know. You have to decide.

1:46:32Speaker 23

You would have to go to the appraiser office first, get that fixed.

1:46:35 – 1:47:01Speaker 21

Well, he can get us whatever. I mean, we just don't have them in advance. You know, sometimes if we don't know what their issue is, sometimes people reach out in advance and give us a lot of information that we can process beforehand. I just don't have that here. So we would be able to look at the building records to see what that shows. If it shows it's been converted from four units into a duplex... Obviously, that makes a big difference if all you have there is the duplex.

1:47:01Speaker 12

Can you provide that document? Do you have any documentation? Also, I have it in the email, but I would need five minutes. I don't know if I can.

1:47:07Speaker 21

Yeah, but we're going to have to research it with our own records. What do you have in the email?

1:47:11Speaker 28

So what we can do is we can reset this case for our September date, if you're okay with that, because that could be the difference for us considering maybe even a lower amount.

1:47:22 – 1:47:53Speaker 12

save you a lot of money but is there a way maybe to like to approve that 15 000 and i come back to september then to reduce no no once we go okay i need to start from zero yeah okay yeah once we say what what do you have to show that it's a two unit the full permit the conversion of the garage from the living to the garage, showing that this is just a single family with efficiency. You have it there with you? Proved from the city? I need just two minutes.

1:47:53Speaker 28

She still needs to do research. So, look, wait, before you do it.

1:47:57Speaker 15

You put a permit with the city of Miami to do a conversion? The permit? Yeah, with the city of Miami? I need to...

1:48:04Speaker 28

Hold on, because she can pull the permit.

1:48:05Speaker 21

Why don't we pass this? She can look at it. My computer's officially dead. Okay, give us a second.

1:48:11Speaker 28

We're going to call another case, and then we'll come back to you, okay?

1:48:14Speaker 17

Yeah, go right here to the director.

1:48:15Speaker 28

Page 11, property address 1846 Southwest 22nd Terrace, case number CE2020-002955.

1:48:19Speaker 2

What's the address?

1:48:33Speaker 18

1846 Southwest 26th.

1:48:35Speaker 16

Can I get the page number again?

1:48:38Speaker 28

11. 11. State your name and address for the record. You can state your name and address for the record.

1:48:43Speaker 4

My name is Isabel Pineda, 10427 Northwest 64th Terrace.

1:48:48Speaker 28

Thank you. And we have a lien that ran to $247,050. This is page 11 from... City View. City View.

1:48:57Speaker 21

All right, so it went to 247-050. Single family home with homestead exemption. Minimum is $5,000 or to zero with unanimous vote. Gotcha.

1:49:06Speaker 28

How long have you been living in the property?

1:49:08Speaker 4

No, I'm not. I'm representing the owner.

1:49:10Speaker 28

Okay, the owner's not here.

1:49:11Speaker 21

Yeah, the owner lives there, though. Yeah.

1:49:14 – 1:49:33Speaker 4

I don't know why. For some reason, I can say the coffee because I don't know exactly what he started in the process. He submitted two building permits, only one building permit for the fence and the pavers. They messed up with the building permit. They, I think, revoked the permit. Yeah. And he contacted me in order to submit the property.

1:49:33Speaker 28

Right. Everything is compliant.

1:49:35Speaker 21

Yeah, they just had to finalize it. They had stuff. They never finished it.

1:49:38Speaker 4

But I have to do a rollover again. Everything with the plans and everything, which is fine. We got the approval. We closed the case. We received the affidavit with the inspector.

1:49:48 – 1:50:02Speaker 4

And, of course, by the time flight, and they accumulate the amount. He spent a lot of money with the permits, honestly, because I'm going to be in charge for all the plans and everything. But, yep, I'm coming here.

1:50:02Speaker 28

Can we get a motion for zero?

1:50:03Speaker 23

I'll make a motion to bring it down to zero.

1:50:07Speaker 28

All those in favor? Aye. Thank you. Just wait for your case. Okay?

1:50:15 – 1:50:37Speaker 2

The next constituent has four cases, and they're add-ons on CityView. Aye. L Shopping, LLC. The first property address is 300 Southwest 12th Avenue, case number CE 2020-018-698. Good evening, everyone.

1:50:37Speaker 21

Do you want to do all of them together? Yeah, that works. Because they're all basically the same properties right around each other.

1:50:43Speaker 2

The second one is 1229 Southwest 4th Street, case number CE 2020- 019354.

1:50:50Speaker 18

The other add-on is 5 on City View.

1:50:55 – 1:51:11Speaker 2

Property address 1220 Southwest 3rd Street. Case number CE 2020 019251. The other add-on is 6. Property address 1220 Southwest 3rd Street. Case number CE 2021 004697. All right. So that's our four cases.

1:51:20 – 1:51:56Speaker 21

Add-on number, the commercial properties. So the minimum's $15,000 each. The properties were involved in protracted litigation as things were going on, actually between the city and the property owners. Right. The add-on number three was $875,500. The add-on number four was $875,500. Add-on number five was $870,500. That's a parking lot. And then... Add-on number six was $422,250. Again, all commercial, minimum $15,000 each. All right.

1:51:58 – 1:53:11Speaker 11

Good evening, everyone. Good evening. My name is Jackie Beta. I represent L Shopping LLC. I'm the attorney for the property, both here and in the protracted litigation that Ms. Dooley referenced. The reason for the large number is because of that protracted litigation, because it took a long time. It ultimately ended in a settlement agreement and Part of that settlement agreement is that we got a master permit. The master permit covers the entirety of the property, including all folios. So we have no objection to the $15,000. I understand that's the minimum, and if that's what you all are willing to do, we'd be happy with that recommendation. The only request that I make is that the first three, 300 Southwest 12th Avenue, 1229 Southwest 4th Street, and 1220 Southwest 3rd Street, even though they're different violations, they were resolved... through the same mechanism, which was one master permit. And so if the cure is one thing and it resolves everything, it's really the same violation. So we would ask that for those three, you lower it to the 15,000. And then I understand for the fourth one, 324, that's for no BTR, which was also resolved, that would be a separate 15,000. So we'd ask for the first 315, And for the fourth one, 324, also to reduce to 50. Is that possible?

1:53:11Speaker 18

Are they separate folios? No.

1:53:13 – 1:53:35Speaker 21

I mean, I understand the request. However, if you want your properties to be treated as one, then you should have unity of title. They do not. They are... Unfortunately, they're... And I know council was going to... We already talked about it before. They're three separate folio numbers, and therefore, that's the only way you can cite all three of them. Gotcha. And so... It would be $15,000 on each.

1:53:35 – 1:53:49Speaker 28

All right, so here's the good news. Yeah. The good news is that this account is going to be over $3 million. The bad news is it's $60,000 total that you have to pay. I'm not going to fight you too much. Okay.

1:53:49Speaker 11

But understand logically what I asked. It's one permit. That's why I asked. Yeah, I got you.

1:53:55Speaker 28

No, only because of the lack of union title. I understand. It's only going to work. Can we get a motion for the $15,000 for each of the four wheels?

1:54:02 – 1:54:22Speaker 18

I'll move to make a fine of $15,000 for 300 Southwest 12th Avenue. Additionally, $15,000 for 1229 Southwest 4th Street. Additional $15,000 for 1220 Southwest 3rd Street. And $15,000 for 1220 Southwest 3rd Street. I second that motion.

1:54:22Speaker 28

All those in favor? Aye. Thank you. Thank you all. Thank you very much.

1:54:30Speaker 19

I got the thing working again.

1:54:31Speaker 21

Page 17. We can recall that one.

1:54:33Speaker 28

We can come back.

1:54:34 – 1:55:05Speaker 21

Yes. It's good to have Director Haynes here. Yes. She was able to confirm looking through the building permitting system that it is two units now. It is not homestead exempt. It is two units, not four. And so the minimum would be $10,000 or by unanimous vote, lower down to zero, anything down to zero. And that's page 17 on City View.

1:55:08Speaker 28

All right, sir. Just again, state your name, may I just for the record.

1:55:13Speaker 12

Nicola Rubino, owner of 137 Northeast 47th Street.

1:55:19Speaker 28

Can I get a motion or if there's any more discussion? We know it's a minimum of 10,000.

1:55:24Speaker 25

Just for the record, you've never lived in the property, right? You've been renting it?

1:55:29 – 1:56:12Speaker 12

2019, I moved to the property just two months and then hit COVID. I lost my job. You rented it and it's currently still being rented. I moved again with my family because I haven't... You used the rent to pay the mortgage. Right now, yes, but I want to move with my son, my family over there. And I just knew... that the rules changes and now LLCs can be mitigated. So that's why I'm here today because I tried to do in 2024 with director Robert Santos. He was trying to help me, but the law didn't allow him to mitigate an LLC. So in that time I was, I haven't had the opportunity to do it.

1:56:18Speaker 25

I would make a motion to reduce it to $5,000.

1:56:21 – 1:56:38Speaker 28

Second. I will second that. Is there any discussion? All those in favor? Aye. So reduce it from $3,740,000 to $5,000. Thank you so much. You saved my life. Thank you so much. Thank you very much. All right, wait for your order.

1:56:42 – 1:57:00Speaker 2

We don't have any more mitigation. We do have two special appearance. I'm going to call the first one. The first one is on 127. Page 127, code check. Property address 1742 Northwest 42nd Street. Case number 00109135. All right. 127. 127? Good evening, everyone.

1:57:10Speaker 8

Trent Alvarado. I am the listing agent for the property address 1742 Northwest 42nd Street and 1736. Okay, so there's two properties? Yes.

1:57:20Speaker 25

What's the page number?

1:57:23Speaker 25

You remember them? You remember them from last time?

1:57:26Speaker 5

Yes, Emiliano Villafranca.

1:57:29Speaker 1

He's the owner.

1:57:30Speaker 28

Yeah, yeah, yeah. I remember. It's the violating owners here. Yeah. We remember. We remember. We remember.

1:57:36 – 1:58:40Speaker 8

All right. So the reason we're here is our previous, the previous time we were here, we were told that we needed to show proof that we're trying to bring everything into compliance. Yes. I just wanted to have a reminder that the property that is being sold that's under contract is the property adjacent to it that is in compliance. But since our last meeting on June 24th, we've had, we've submitted the necessary plans to the city. We've been in constant contact with Pont de Jour, the code compliance officer, who had told me to actually mention his name and to let you guys know that that has been occurring. Our title attorneys have emailed Nicole Bailey and Alicia to confirm the steps that have taken place, and we've had engineers visit the site as well. So we're just pleading to have... mercy of the board to allow the sale that's under contract, which is property address 1736. We do have a bona fide buyer that's ready to go. Our closing date is on July 28th. And this property is stopping the other sale.

1:58:41Speaker 23

Madam Attorney, can we do...

1:58:47Speaker 18

So are you guys seeking a release for the other property?

1:58:50Speaker 8

Partial release. Yeah, partial release, yeah.

1:58:54Speaker 18

And if I remember correctly, it was to sell that one to bring this one up to compliance or something like that?

1:58:58Speaker 8

So yeah, it was just the adjacent property, which is the one that's in compliance on their contract. He's going to use those funds that he will receive from that to bring this into compliance.

1:59:10Speaker 21

So yesterday, yesterday.

1:59:13 – 1:59:28Speaker 21

Yesterday on their 2025, on their 25 applicant upload, 2025, they uploaded something else. Yesterday. So it's up to you. What's the address for release?

1:59:28Speaker 25

1736 Northwest 42nd Street.

1:59:30Speaker 8

Is that right? Yeah, 1736.

1:59:32 – 1:59:58Speaker 21

So it's, you know, he's a violating owner under the city code. You know, there's no, you know, the city code doesn't provide for that. So obviously we, you know, the city's position is no. You know, the reason to have a lien that extends to other properties is to make people do what they were supposed to do because sometimes they won't otherwise do it. But it is entirely up to you.

2:00:00 – 2:00:12Speaker 8

We also have a document. I'm not sure if it's ever submitted. That was a certification cancellation, canceling the notice of lien for 1736. I don't know if it was ever submitted, but it was from the city.

2:00:12Speaker 21

Well, we're here on 1742, not 1736. 1742 is bleeding into 1730. I know. Yeah.

2:00:15Speaker 8

Yes. Yeah. Yeah.

2:00:27Speaker 25

Well, right now there's the fines up to $75,500. It says here on the violating property.

2:00:33Speaker 28

That's what it says. It's a lien of $75,500.

2:00:36 – 2:00:47Speaker 25

Yeah, it'll keep running. It'll keep running. But their position is that, correct me if I'm wrong, that you guys can't correct or comply with the violating property until you sell this property because you don't have the funds to do so.

2:00:47Speaker 8

Right, and then it's also a title objection on the sale that's coming up on 1736 preventing anyone from buying it.

2:00:58Speaker 21

Are there money set aside from the sale of the property that are going to be paid directly to bringing it into compliance, or the money's just going straight to the owner?

2:01:08Speaker 8

It's going straight to the owner, but he's not leaving the residence that's not in compliance. He's still staying there. Yeah, he's still staying there. It's his residence.

2:01:16Speaker 25

Yeah, that's his homestead, it looks like, right?

2:01:18Speaker 8

Yeah, exactly. He plans on paying everything necessary, and I can say it in Spanish so that way he understands as well. But yeah, he understands that very well.

2:01:34Speaker 23

So it's that property there? Yeah.

2:01:39Speaker 28

Partial release.

2:01:39 – 2:01:53Speaker 18

Yeah. And what's the work that's required again? Can you just remind here? I see maintaining a structure, encroaching, illegal units. Is there like a demolition that needs to happen and a new building coming up? Is it like a massive project?

2:01:53Speaker 21

He's got an unsafe structure case, so if they don't get this fixed soon, he could lose the entire structure.

2:01:59Speaker 21

You can see the property is a one-story single-family home.

2:02:04Speaker 25

Is this the one with two bedrooms and one bath?

2:02:08Speaker 21

And now we know it's got a lot more than that.

2:02:10Speaker 8

Yeah, we've discussed it.

2:02:12 – 2:02:36Speaker 21

There are legal structures on the property. Yeah. You know, I remember this property. It's not from that long ago.

2:02:38Speaker 21

I don't know why he didn't request an extension of time. Had he done that, there wouldn't be a lien. Chose not to. We have this illegal additions in the back.

2:02:48Speaker 25

And that's what you guys had already demolished, right? What was that? I believe from last time you guys came here, that illegal unit in the back, you guys removed it?

2:02:57Speaker 8

Yeah, that was the plan, but he's decided that.

2:02:59Speaker 25

They don't have any permits to do anything. Well, yeah, that's what we talked about last time.

2:03:02 – 2:03:35Speaker 21

He doesn't, you know, I guess, I get he wants to sell one, but you also have the issue of, you know, he comes here, he's been here, I'm going to do this, and nothing happens. Last May, May of 2025, they did an applicant upload, and then nothing until July 21st of 2026, the day before they come here, now we're going to upload something in. That applicant upload just means I put my name and stuff in there. We don't, there's not plenty, there's nothing, you know? So again, it's up to you, but.

2:03:38Speaker 25

Chicken and egg situation. But yeah.

2:03:41Speaker 23

Does he, does he understand what's happening? Does he understand what the bottom attorney just said? I think we need the interpreter. Wait a minute.

2:03:51Speaker 21

Does he need an interpreter?

2:03:52Speaker 8

Well, I'll translate for him.

2:03:53Speaker 23

No, you're not going to translate for him.

2:03:54Speaker 28

No, he's a certified interpreter.

2:03:56Speaker 23

We need the interpreter.

2:03:57Speaker 28

Interpreter. Just to make sure.

2:03:59 – 2:04:19Speaker 23

Yeah, it's only, yeah. Let him know, does he understand that he has not done anything since the last time he was here? Just doing an upload, like Madam Attorney said, it doesn't mean anything. You need plans, you need stuff. There's a lot of things he needs to do.

2:04:52Speaker 4

So the plans have been given. They were requested to demolish, and that's what we gave away.

2:04:58Speaker 23

Madam Attorney, they requested to demolish the property?

2:05:03Speaker 21

I don't know what they're doing. They're in applicant upload again.

2:05:08Speaker 18

Do you have the plans that you submitted?

2:05:19Speaker 1

All documents are here.

2:05:20Speaker 23

Ask them as they upload it into the system. I'm not going to know what any of that means.

2:05:24 – 2:05:36Speaker 21

But here's the thing. I don't read plans. I'm not a contractor. I'm not an engineer. I don't know what those plans mean. I don't know what they're doing. That's what was uploaded yesterday. I have no idea.

2:05:36 – 2:06:17Speaker 25

The problem is for him to understand that they keep uploading the day before they show up here and then nothing happens after that. Yeah, just for him to know that that's what she's saying is that The last couple times they've come, they seem to upload something right before the hearing, and then nothing gets done after that. There's no progress. Let me ask this question here.

2:06:17Speaker 28

Is it simply... They can't really do anything because they don't have the money to do it unless they sell the property.

2:06:23Speaker 8

Right. And then basically it's becoming an issue to just sell it at all.

2:06:29 – 2:06:41Speaker 28

Right. It's a rock and a hard place. It's one in compliance, one not. But the one that he's trying to sell, he can't do anything with it because of this one. And they can't fix it because he doesn't have the money to fix it.

2:06:41 – 2:06:57Speaker 8

And what he wants to do is not cheap. He wants to actually have the inspector go in. The inspector already told us it's going to take a lot of money. So he'd rather use that money to bring it into compliance no matter how long it takes.

2:06:57 – 2:07:09Speaker 18

What's the cost of his new project? Has he received an estimate? And he's clearing that from the sales and all of his expenses?

2:07:09 – 2:07:23Speaker 21

It hasn't been uploaded. You've uploaded for new construction. So I'm just letting you know it's not uploaded correctly. You've uploaded for new construction for storage laundry and for new construction windows.

2:07:24Speaker 28

It seems like he needs help, and I don't think they know what to do. Because it's not necessarily a new construction. It wouldn't be a new construction.

2:07:33Speaker 21

No, it's remodel and repair. So it's not even uploaded. They're going to have to change the upload.

2:07:40 – 2:07:52Speaker 23

Can you explain to him? He's got a lot of problems. Can you tell him that he, what Madam Attorney just said, they put new construction and what he needs is repair and remodel.

2:07:52Speaker 21

It's just, it's repair or remodel, right? So he's not building something new, right?

2:08:06Speaker 4

It's a little apartment behind the property.

2:08:10Speaker 21

But you already have an illegal structure. What are you doing with that one?

2:08:14Speaker 23

Peggy wants to legalize it.

2:08:15 – 2:08:34Speaker 28

He's trying to legalize it. He's trying to legalize the little one that's there. He wants to legalize it. How old is he? How old is he? How old are you? 64.

2:08:34Speaker 15

The building department has a concierge service that will walk him through his permit and process. Instead of you guys. He needs the help.

2:08:42Speaker 28

They're going to walk him through this process.

2:08:45Speaker 15

It's on the first floor of the Miami Riverside Center. As soon as you walk in the door.

2:08:49Speaker 28

Yeah. I got you. But you as the owner. You got to let the city help you with this one.

2:08:59Speaker 18

Additionally, like with due respect to him, like he's uploading things not correctly. So if they were to walk him through it, he would have the proper guidance to get this actually resolved and move forward.

2:09:09 – 2:09:23Speaker 28

He could be there to assist, but let the city help you walk it through because we have a concierge for folks of a certain age. It's free. Yeah. Yeah.

2:09:26Speaker 21

So what do you want to do on the partial release? I mean, we're talking about his building issues, but are you granting it or not?

2:09:41Speaker 21

He has homestead exemption on the property.

2:09:43Speaker 28

He's requesting the partial release.

2:09:44 – 2:10:01Speaker 25

Based on his homestead, obviously he lives there. And we'll take his word that he's intense to come to compliance. I would move to issue a partial release to the property 1736 Northwest 42nd Street. Hopefully that'll help him get everything in order and in compliance.

2:10:01Speaker 28

Can I get a second? Second. All those in favor? Aye. All right, so we've granted the partial release.

2:10:06Speaker 21

I will draft that and send it to the clerks tomorrow.

2:10:09Speaker 28

Right. Okay, so she's going to draft it, so wait for tomorrow. Tomorrow she's going to send it to the clerks. We don't have it today. Tomorrow you'll have it.

2:10:18Speaker 18

Additionally...

2:10:20Speaker 28

No, no, you don't have to come back. It'll be at the clerk's. And we'll remember if he comes back for mitigation. Sir, hold on, hold on, wait.

2:10:27Speaker 21

The clerk can't assist you. You need to come over here.

2:10:31 – 2:10:42Speaker 2

The second special appearance is on page 124, code check, property address 911, Northwest 63rd Street, case number 00121398. Yes.

2:10:50Speaker 15

My name is Louise Legle.

2:10:52Speaker 28

Yes. The owner of 911 and 901. Gotcha. And I see here we have a lien that ran to $104,000.

2:11:01Speaker 21

Excuse me? Yeah, she's seeking a partial release for the property next door at 901 Northwest 63rd Street. Is that correct?

2:11:09 – 2:12:18Speaker 15

I have a shed on 911. That's an open lane. I have put the shed in there just to put my personal use when my husband passed that's was it and then the Inspector passed by because one of the neighbor call and then she told me to If I have the permit for the shed and I said by the city code the Shed is not a house. It's a shade I buy it and then they give me the of the tag and then That's what it requires a permit I was like, no, I need a permit because I know each of the property, it's legal to have a shed in the backyard. And the property is open. It's an open land. There's nothing in there. And 9-11. So when I'm trying to get the loan to have my wolf done, and then that's the time I find out she put a lien in 9-01. 9-01 is not the same partial with 9-11.

2:12:18Speaker 28

It's two different partials. One second here. It's not as if she's saying it's a vacant, one of them is a vacant property with just a shed sitting on it?

2:12:28Speaker 28

That's what she's saying.

2:12:32Speaker 25

Picture show, numerous cars.

2:12:34 – 2:12:53Speaker 21

She's here for a lien that's on 911 Northwest 63rd Street. She wants you to give a partial release to 901 Northwest 63rd Street from the lien on 911 Northwest 63rd Street.

2:12:53Speaker 15

Do that legal to do that? That's two different partial. and two different honor.

2:13:00Speaker 21

Look, you're the one here who's for, look, you're here for this, the partial release.

2:13:04Speaker 28

Partial release, right. What do you want? Yes. You're here for a partial release.

2:13:08Speaker 15

And also, I don't know why she put a lien in 9-11.

2:13:12 – 2:13:27Speaker 21

Well, that's not what we're here for. You have a lien on 911 Northwest 63rd Street because you had a hearing for violations on your property for all of these things that you see, trucks, cars, everything else.

2:13:28Speaker 15

And I clean it. The day I spoke to the lady, and then I was in the hospital, and then when I called her... Well, you'll need to meet with code.

2:13:38Speaker 21

That's why you have a lien on that. What is it you want to do about that lien?

2:13:44Speaker 15

I really don't know.

2:13:47Speaker 15

I need to get my roof done because I went to Miami Dade.

2:13:50Speaker 21

Which roof? The roof on 911? 901, that's where I stay. Okay, so you live on 901? Yes, ma'am.

2:14:00Speaker 18

And which property are you trying to take the loan on at, 901 as well?

2:14:06Speaker 23

Where the shelter is.

2:14:08Speaker 18

So you're trying to encumber that land at the loan, and when they pulled the title, they told you you can't get the loan because of this?

2:14:13Speaker 21

So she wants the partial release for 9-0-1 from the lien on 9-1-1. 9-11, yeah. Right.

2:14:23Speaker 28

And who's doing the roof? Is it the county that's doing it for you? Is it the county that's doing the roof?

2:14:30Speaker 15

No, they tell me they cannot help me. They don't have no money in the fund. They're lying every time they say they're going to help. They don't help in nothing.

2:14:38Speaker 21

So who doing your roof? She is. That's why she's getting the finance.

2:14:42 – 2:14:54Speaker 15

A private contractor's doing your roof? I was trying to get a company to do the roof, and then I'm not qualified because of the lien. I wasn't know I have a lien in the house.

2:14:55Speaker 18

Have you complied with the other violations yet, or have you been at work with yes the same week the lady called?

2:15:01Speaker 15

And I told her I'm gonna go out there and see if it's complied so the shed is no longer there.

2:15:07 – 2:15:18Speaker 23

It's not about a shed It's about a lot of things so the trucks the buses are no longer there She told me to put

2:15:24Speaker 21

You can't park any of those vehicles there like that. They can't be there.

2:15:31Speaker 15

You have a few violations.

2:15:32Speaker 21

You need to meet with code and you need to have an inspector come out.

2:15:36Speaker 15

Okay, anybody could come to see where the cars park. There's no car in the grass. I am not a liar, and I could be.

2:15:45Speaker 21

Nobody's saying you are, but you need to call somebody.

2:15:48 – 2:16:05Speaker 15

No, no, I called the inspector, and she told me she will come the next day. So I cannot stay because she's coming for me to don't get the chemo to keep me alive. I told her, and she told me she's coming. And I went to the city the next day, and then she wasn't at the office.

2:16:07Speaker 21

Do you want to grant the partial release?

2:16:09Speaker 15

I need the partial release, and I also need the lien off in 9-11. Well, you're not here for that. You're not here for that.

2:16:17 – 2:16:28Speaker 23

You have to address one thing at a time. What I suggest is you call the inspector, have the inspector go there, come next time, and maybe if you have everything resolved, we can take care of everything.

2:16:28Speaker 15

Okay. Let's be fair.

2:16:34 – 2:16:50Speaker 21

You know, I don't think the property's complied. Or I think there's probably some other issues. So I don't know if you want to vote on the partial release now. She can get the information so that she can call code compliance out to the property, take a look at it.

2:16:50Speaker 28

Do what needs to be done.

2:16:52Speaker 21

When that gets complied, we can bring it back for mitigation.

2:16:55Speaker 18

Correct. I would move to reschedule this to the second or the third it is.

2:16:58Speaker 21

You just want to reset it? Well. She's trying to get her roof. No, she's trying to get her roof.

2:17:02Speaker 23

It's up to you. I'm trying to do the release. Yeah, she's trying to do a partial release. She's trying to do a partial release.

2:17:07Speaker 28

We can deal with the other stuff on the next one because we can check it.

2:17:12Speaker 23

Okay. I get a motion. Make a motion to give it a partial release. And then for her.

2:17:20Speaker 28

We'll do a mitigation later. Nothing we can do on that right now.

2:17:25Speaker 18

So it's a motion to give it partial release on 901 West 63rd Street.

2:17:33 – 2:18:08Speaker 28

Yes, that's the motion. Second. Second. All those in favor? Aye. Okay, so we've given you the partial release. Wait for your order. She's going to draft up your order for the partial release, and then you can take that to show that you have the release done so that way it's not being held. And then you can finish applying for the loan to do the roof. We'll deal with the lien for the other property once the inspector goes out there and issues a compliance of affidavit saying you've done what you needed to do. If you did everything. If you've done everything, okay?

2:18:09Speaker 28

That's what we'll do, okay? No problem.

2:18:13 – 2:18:27Speaker 2

We have an extension of time. Page 52, property address 642 Northeast 69th Street, case number 00079-345. Page 52, code check. What's the page? 52.

2:18:27Speaker 28

52, good evening.

2:18:40Speaker 28

Can you state your name and address for the record?

2:18:44Speaker 34

Patricia Estramadoiro.

2:18:45Speaker 28

Thank you. And what are we here for? This extension of time. So how much time do you need? What have you done?

2:18:53Speaker 34

Yeah, just an extension of time. We're still dealing with HEP department. So environmental department.

2:19:02Speaker 28

120 days. Gotcha. Can I get a motion?

2:19:04Speaker 25

I move for 120 days extended.

2:19:06Speaker 28

Second. All those in favor? Aye. Thank you so much.

2:19:10Speaker 25

There's a paper there if you need more time.

2:19:12Speaker 28

Yeah. There's a paper at the podium. Yeah, okay, there you go. Don't leave yet. Why?

2:19:23Speaker 2

There's probably no more.

2:19:24Speaker 28

Yeah, no, grab, oh, you have more cases?

2:19:26Speaker 21

No. One more, one more.

2:19:30Speaker 2

What do you, what?

2:19:32Speaker 21

There's no paper. Guys, are there any more cases?

2:19:35Speaker 2

One more, page 65, code check. Property address 1710 Southwest 32nd Court, case number 00140976.

2:19:43Speaker 9

Good evening, and I hope to make this quick.

2:19:49Speaker 21

The city recommends 120 days. They're trying to do a legislative change to take care of this issue.

2:19:55Speaker 23

Make a motion for 120 days. Second.

2:20:01Speaker 21

Sign in next time. Sign in?

2:20:03 – 2:20:19Speaker 9

Yes. Oh, did I forget to sign in? Yes. It was strategically unwitting on my part. I got a lot of work done. What are you still doing?

2:20:20Speaker 28

Hanging. Sorry. 120 days. Yeah, we already voted. I got paid by the word.

2:20:27 – 2:20:39Speaker 9

Thank you very much. Good night. So we're good for honor before 120 days, right?

2:20:39Speaker 28

Motion to adjourn.
