To new business, we do have four items underneath new business. The first being a State Road 8 Auburn Outlets rezoning. This is PC zoning 2026-6. I'll go ahead and open the public hearing and turning over to staff for the report.

I MADE A REQUEST FOR THE MEDICATIONAL ZONING MAP TO BE CLASSIFIED AS A ZONING OF A LITTLE OVER 22.7 ACRES OF PROPERTY. IT'S LOCATED EAST OF COUNTY ROAD 19. IT'S SOUTH OF STATE ROAD 8. IT'S CURRENT ZONING IS I1 LIGHT INDUSTRIALS I10. The property also lies within our core board of state gateways. i know the uh 2040 plan that each of the ladies plans designation of the property is i'll have an employee that's the entire draft and we'll call all the properties by the way west state 19. a few photographs of the property this is an agricultural currently used agricultural land that extends all project advisory so as i mentioned the property currently illustration on the screen this is the intended use for the property the reason for the requested zoning change so what we see this is the primary plan which is the next item the agenda but i need to use it for reference purposes the lots that are available one through five along standpoint are proposed to go to C2, a general conversion. He's been asked about seven, which is the southeast portion of the property. That would be, again, three of the three western zoning classifications. It's important to take a moment to talk a little bit about the future layers of that. How do we prevent this property? What's happening around it? How do we get to the... the status quo perhaps so if you look back um to the early 2000s the entire area of the west of the interstate was all classified itself that was the future intent of all the play at the west of the interstate and of course it's an interchange a significant interchange among the interstate and the state highway so you'll see over time several tracks of land have been changed from industrial to commercial that started in the 869 subdivision which was reclassified to general commercial the astrolabe author facility reclassified from industrial to institutional so all that is significant We've seen a series I thought it was important to really stress what is happening in this area of the city over time and how it should be. This is the zoning district classification for most of the state of Ohio, as you can imagine now. The wall development, you see with all of those facilities, they're all zoning.
The correct, I've identified the development standards that will apply to the C2 class.
The M3 district is a fairly new classification.
We added this district to our code a few years back. BASICALLY A PART OF THIS COMMUNITY. SO THIS IS SPECIFIC TO A PART OF THIS DEVELOPMENT.
THAT IS WHAT WE'LL BE FOCUSING ON IN PLACE SEVEN OF THIS PARTICULAR DEVELOPMENT. AND I'VE GOT A PLATFORM CALLED . I MENTIONED WITH THE DRAWING, THAT WAS A PRIMARY PLATFORM IN CLOUD, WHICH DID IT WITH THIS DISTRICT PLATFORM. AND WITH SUPPORT,
with that application. So rezoning was a series of steps. So rezoning has to occur before any other development would come to mind. So we're going through the steps of rezoning. Of course, you would make a recommendation to the council.
They would ultimately make a decision on the use of the property and the standard of the property. What is the staff recommendation? I, again, have already touched on it. I see this request as a continuation of the change
was happening with land use in this particular part of the city. There is considerable pressure, indeed, for commercial products to be developed. If you think about the schedule A, we have made a lot of long schedule A.
The newest development that Ramsey Corp did is when the sign was built. It was one line that was sold out. You approved the development plan.
It is always hard to give up.
We need industrial land in the city to be able to have land that attracts industrial developers. We do have a considerable amount of land zoned for industrial development at this time in the city. And we've had discussions with the property owner that is going to be bringing forward an industrial subdivision for their consideration in the very near future. So we see things happening in other parts of the city. The standard we looked at for this location and should be looked at, it's that close to the interchange as industrial is not the highest resolution for this kind of work. So we do support the request. We also support the request for lead apartments. So if there is a need for a high-end or class-A type apartment community, we do not have that, especially at the interchange. So we do support the request of rezoning and recommend that you afford this to counsel with a favorable recommendation.

My name is Jeff Suttle, 4527 County Road 9.
I have a property owner that's going and I see that it's been recommended to approve, but I don't know that all the facts are at hand, mainly the fact that there's my neighbor and myself who live directly next to this, and I understand that we need change and we need properties, and I'm not disagreeing with that. I have no objection to most of this change, especially along state road, commercial, I absolutely agree with that.
The apartments, I agree with.
What I don't think was considered... May I move over here?

This would be across neighborhood. That's fine. I own this property right here. My house is right here.
They're proposing changing this to commercial lawn here. My bedroom window is 80 feet. the proposed change and it almost ideally would make my home more livable if let's say my worst case i can think of is if that becomes a larger restaurant type thing with a drive-through i understand they can't put business buildings any closer than the setback track to commercial and throw myself and my neighbor extremely close to something we hadn't ever planned on and it being industrial the way it is now the setback would be greater on the larger property which would i felt i had some some frame of no worry there but now with it becoming a smaller lot and becoming commercial that kind of really affects me and my neighbors What I'm proposing is the adjoining property to both my neighbor and I here. I mean, wherever it directly connects to me, just leave it industrial. Not a major problem that I can see, but with two residences that close and approving or allowing certain type of businesses in there to make my home unlivable is the best way I can put it.

even if we're just two people in your city, I don't think that's fair. So I'm asking that there be a revision, not changing the zoning on the two properties that adjoin this, leave them additional.

Just real quick. So along your east property line, there's a city electric easement that, is I think closer to the property line. And then there's also a city water main. They run parallel. Well, those two utilities are in the ground right now and there's a city utility easement for those. I can't recall if it's a 20 or 30 foot. So I can tell you that nothing's going to be built closer than the 20 or 30 feet. And I, believe, and the engineer could comment on it, that there's also going to be a sanitary sewer and a storm sewer proposed. And if I recall, that's like a 50 foot utility and drainage easement. So theoretically nothing could be built closer than that 50 foot without a variance utility agreement. So I don't know what would make you feel comfortable.
Comfortable would be no change.
Well, as far as how close something could be built to the property line.
Let's say there is a call box.
What is too close? A drive up or drive up window.
To me, any of that I don't think would be acceptable to any of you next to your home that you had only lived in 25 years. It suddenly becomes a drive-thru, basically.
And I don't know what the setback is for industrial. Do you know offhand, Jim?

100 feet, where what they're proposing is only 30.
Is that correct? That's correct, but the primary plot does show the 50-foot east, so it'd be a 50-foot setback.
So, yeah, I mean, there is some differences between commercial and industrial.
Even if they remain at the 100 foot setback, that would be an improvement for me. I mean, I'm hoping for something to not have people right there at my back door facing the bedroom window.
Harvesting back is my bedroom window on my residence. Now, I chose to set it to the back of the lot thinking the future, that was the
best place to be.
One, this might be a concession for you to think about. Your property is currently not in the city limits. Someday I think it will be. There's those three properties or so that are outside the corporate limits and someday they probably will be annexed. And when we annex any property, we have to provide sewer and water. Right now the sewer runs along your property. Or sorry, right now the water runs along your property. I believe the proposed plat would bring sewer within close proximity to your property line, which would be a good thing. You know, I don't know, you're currently on septic. Right? But you're on septic system? Well, there's two kinds of septic systems in the county, according to the health department. ones that are failing and ones that will fail, according to the County Health Department. I agree with that. So having a sanitary sewer close proximity, I think, is a good thing. And they're proposing to do that.

That's correct, yeah. As part of development plan for once we know the use, there's screening requirements.
I mean, if it's going to be developed one way or the other, whether it's industrial or commercial, would you be happier with screening?
Happier with industrial.
I think the odds of it being offensive to me would be a lot greater in industrial.

OK, I'm going to go ahead and close the public hearing and turn it over to the Planning Commission for discussion. I would like to mention, though, also, I don't know if you went back to when Gafkin Chiropractic went there when you went through all the changes. But that, I think, was the first commercial thing that went in there. And that was a very long time ago. And that's right adjacent to the east side of that property. So there's already the basis for the commercial there and then also the apartment. In addition, you've got Astral right next door, very similar, but for the elderly. I mean, I think it's a good fit and transition for both the commercial and the residential. So I think it's a very good use. I don't know what anybody else has to say about it.

No further discussion? Can you flip to the last page? I know this doesn't have any findings of facts, but there are items to consider when we do a rezoning and the five are mentioned here. So the comprehensive master plan, the conditions and the characteristics and structures and so forth, and everything's there. So if there's no issues with that, there's also no conditions, correct? So you just need to make, I need to have a motion either to forward this to the common council with a favorable recommendation, unfavorable recommendation or no recommendation. So at this point I'll entertain a motion.
Can I say something first? Sure. I just want to make sure we recognize their opinions, but I think Mr. Ramsey answered them pretty well. We don't know what that development is that's going to go in there, but based upon all the development we've seen, West's 69 commercial does seem to make the most sense, and I understand their concerns. I want to make sure we're not just ignoring them, but your time will be best used when the development actually comes when he is, and he's coming here a lot. He has worked hard with the property owners when they have issues to make sure that they're happy. I mean, you're not going to be over thrilled that anything is getting developed there. And I get that, but he has made sure of it a lot. So I just wanted to make sure you were ignoring you guys.
Correct. And it's the screening and that type of thing will be the development plan, not the rezoning or the primary plan. It will be the other development plan for the lot.
So with that, I'll make a favorable recommendation for PC zoning 2026-006 to Florida Council. I'll second.

Next item on the agenda, following up with that, is PC Primary Plat 2026-3. This is the primary plat for the Auburn Outlots. I'll go ahead and open the public hearing and turn it over to the staff for the staff report.
Thank you, sir. Again, the applicant, Dr. Ramsey, representing the property over at 4 Ramsey Properties.
This request is for primary plat approval. It would be accepted by the subcommittee. A couple of photographs just to point out. The primary plant does show north-south of Oak Lake.
This is actually, I mean, a lot of the state subdivision will be north, so the access to the new subdivision will be across from this location.
So I'm stating their driveway to their industrial site. And this is the location for the access to the development for the state buildings. This, again, just looking along Glendora Lane towards the current condition of the property.
The proposed property plan, we briefly showed that the rezoning
This is the seven lots. Again, lots one through five have frontage along Steer Road 8. Lot six has frontage along Menorah Lane and Newham Lane. Lot seven is the apartment community lot. The plan was routed for review through the city and county agencies. We last met on September 2nd. There is still a need. We're still reviewing a resubmitted primary plan. There were some comments. review comments that need to be addressed. We do have that revised plan drawing up for review at this time. The project advisory committee met back on September 3rd to review this application. The primary plan to submit at QC was reviewed based upon the rezoning being approved. So that is going to be a condition.
the primary plan would not comply with the current industrial zoning requirements. So staff did look at it, and we asked the planning commission to look at it as if the rezoning does get approved.
That action, in order for the primary plan to be valid, rezoning must go through the city council and be approved.
I did add about what the different standards are for lots, setbacks, et cetera, all of the C2 and F3 districts. There are site utilities to the property. They were installed as part of the positive state's development and the extension of the lower lane.
As the city engineer mentioned, there is a proposal to extend the It will provide sanitary sewer service for those plots that are not within the city or county road 19. Water is available to the site.
It will also bring water all the way to the state of Maine. any development within this primary cloud will be collected into the storm sewer system that will be channeled out to the existing detention basin that was built as part of lots of mistakes. That pond was built as a regional detention basin that employs each little commercial island as its own detention. The storm water can be collected and distributed to the larger detention basin. But any runoff plan from
Any subdivision, whether it's residential or commercial, has to have connectivity, both pedestrian and vehicular connectivity.
There are requirements for this development habit, and the connection of the North South Roadway provides that. There is an existing sidewalk along Menorah Lane. There'll be five foot sidewalks interior up the new streets.
It'll also have to be an eight foot sidewalk trail, long standing lane, so right now, We have a small portion where siding is. Sidewalk development.
As these developments occur, both Black's Car Wash and Credit Union, this development, will eventually get connected to the old state road with a tram system. The streets are proposed to comply with our standard 32-foot width.
Again, I mentioned the alignment of bullpen. White through the subdivision was proposed to state road 8. There is a condition that there will be no correct access for any lot to state road 8. All the access will be from the interior roadways. It does show the cul-de-sac east west. That is the access for all the commercial lots.
So similar to what you see at Auburn and Cross City, or even at the side, because they have a prepared access. That's what's proposed. showing access on to or a department community will have interior access to that's a we're not prohibiting access but there is no access
and what the intersection is aligned where it is.
For safety reasons, that was the best location.
I mentioned briefly, a development plan is required for any development of any slots, including the apartment. So the chase and copy order will be notified when one of those slots is developed for commercial purposes. And then we'll know what the user is, we'll know what the site will look like,
screening and lighting and things of that nature at the time of the development plan so with staff recommendation again the primary plan complies with all of our udo requirements we do recommend approval of the primary plan subject to four conditions the first one is the approval of the reclassification of the zoning that's requested the second condition is approval of the storm They have submitted a revised primary plan.
We are reviewing it.
There were some minor comments that had to be addressed. But we want to make the approval contingent on those changes that have been made being acceptable to the routing committee members. And then the fourth condition is there being no direct access from plus one to five to student eight. For our findings of fact on the primary plan that we have submitted for your consideration,

Yeah, something I don't know is how do we communicate with NDOT with regards to say a stoplight at County Road 19 or whatever might be needed because it's already bad there. And with this addition, there seems like there'll be a greater need. And I know it takes a while for NDOT to plan all this and do it so.
other projects that are happening along the state of the course right now with the median project there's also discussion and also been happening with the interchange there's also been discussions about the hospital being located there uh potentially uh the uh the current uh three you know the current intersection with small's way here
Not a whole lot other than NDOT is fully aware of the development along State Road 8. They've met with the mayor recently. They're looking at the County Road 19 intersection. They've talked with Mr. Ramsey on this project, let them know where they could put this entrance due to site distance and all that. But NDOT has actually taken a, good interest in Auburn over the last 10 years or so. And they're definitely looking at the West side there.

I believe one of the staff members is a former resident of Auburn. I think he went to DeKalb high school. And I think when they went through the project that they're doing now, currently he was the one that presented it. So yeah, that kind of helps too.
Yeah. When they get to that interchange, I sure hope they make a pedestrian way, a trail underneath that interchange along A10.

Commercial on state road 8 makes a lot of sense. But the fact that we're going to get some high density apartment complexes in that area. It's already adjacent to the residential R3 just below that. It seems like a natural segue with the senior living facility by it. I think as that pushes south and slightly west, that's a good, soft transition through that area with commercial. I think it's a really good fit and something we really need here at Auburn, so.

So this request, DeKalb County Sexuality Act School District requested the development plan approved.
THE HIGH SCHOOL FACILITY LOCATED AT 3424-1427. THIS IS A DEVELOPMENT PLANNED FOR PUBLIC HEARING.
THE ADVERTISEMENT STARTS AT 21 INCHES OF PROPERTY OWNERS.
NOTICE OF THE HIGH SCHOOL PROPERTY THAT'S AFFECTED HERE IS OUTLIED IN RED. THE PROPERTY IS CURRENTLY ZONED INSTITUTIONAL IN OUR ETJ AREA. THE BUILDING ADDITION PROPOSED FOR THE NORTH SIDE OF THE BUILDING, SUPPORTS THE MIDDLE SCHOOL BUILDING. WE ALSO HAVE AN ILLUSTRATION THAT SHOWS THE RED MOVE PORTION OF THE BUILDING. THAT IS THE PROPOSED ATHLETIC FACILITY ADDITION. BY THE HIGH SCHOOL, THE AREA WHERE THE EXPANSION WOULD OCCUR HAS BEEN This is actually showing the end of the existing gymnasium with the addition of one step. So with the development plan, the routing committee did review the plan and we had some comments that necessitated a revised drawing being submitted. That has been submitted and is under review. There were a couple of comments from the water departments that are currently looking at a revised plan. Project Advisory Committee did meet that with a third to review this.
We have had no public comments on this request.
So the addition is proposed as a little over 440,600 square foot size in the north side of the high school. So the addition includes a carrier corridor that connects the existing
The lobby area is going to be a new entrance, a lobby area to this facility.
There will be new concessions, restrooms, tea rooms. There's flexible activity space and associated storage you see in the end. The large gymnasium portion of this has four courts where they have a building in its size. The parking lot is also going to be reconfigured and the parking space is going to be oriented. dual striping, so during the daytime, buses will park off and pick up the children. And there will also be striatory vents, so it's a dual purpose parking lot, so when you have your beds in the evening, there will be a bus-based parking space, a plug-in parking space is available. When you look at the total number of spaces currently available in the future, it really is a wash. a couple spaces. It actually appears that there's an increase in the number of spaces striked from buses along with the new orientation of the parking area. The internal access remains the same, so the driveways come down before 2017, made the same. There will be, as part of the construction process, this is kind of the first part of the high school improvement, you'll be seeing in a future meeting,
Marks edition. So as part of those two projects, there will be a temporary new access drive coming off of 4027.
It's really going to a staging lot, a construction lot. Also it will be temporary, just during construction.
That will
the students enter and the staff enters. It'll be a separate entrance for construction. That'll be off of floor 27, between the two existing access drives.
I think that's actually a good thing to do.
There will be some utility work on the site, relocation of private water main, so that's on the site. All the utilities serving the addition will come from the existing building. The stormwater runoff, they're doing a little bit of a change with the stormwater control because of the reconfiguration of the parking in the building. So all that will be put into an underground storage pipes that will direct water to their existing stormwater detention areas. Parking lot lights will be relocated.
And I mentioned the performing arts building. Overall, as we looked at the development plan, it doesn't apply with all the standards of the UDO. We accept that as part of it.
We do recommend that you accept the staff proposal by the fact that it's a development plan application. In approval, we do recommend three conditions. Yep. The school's growing. Enrollment's increased this year, so that's a good thing. And athletics is on the upswing, so I think this will just continue to help do that. It's not just athletics. It's an activity center as well. There's other activities there, so it's not just for athletics. So it will be very good, very good for the school and the community as well. Fourth item underneath new business, the request to authorize a UDO amendment number seven.
This does not require public hearing, but I'll turn it over to city planner for...
Thank you, sir. The statute indicates that our Unified Development Ordinance, our zoning code in essence, can be, the text of it can be modified by either the Common Council or an application request from our Planning Commission. So staff is here this evening asking that we officially file the Seventh Amendment to the Unified Development Ordinance. This would be inclusive of a couple of minor revisions as we annually look at the code and try to see is there a tweak that needs to be made, et cetera. But also we had a larger discussion at your last meeting about housing, what the state has mandated for the cities to look at and county to look at for housing affordability. So from that public hearing we had at your last meeting, we have drafted a A few proposals to consider. So what I'd like is authorization to file the amendment officially, not going to set schedule a date. It won't be on your next meeting, for example, for public hearing. but it will trigger the committee to meet. So our Unified Ordinance Committee, which are members of the commission plus public members, to go over what we propose as staff as changes, and then we would bring it forward to you probably at your November meeting for some type of action. That's everybody up in that office that does a phenomenal job. And we really do appreciate it and wish you the best of luck.

You've been very friendly to me outside of here. When we sat down and went over stuff and I'm echoing everything they just said, but I know it seems like I don't talk, but Jim does such a fantastic job. Anytime I think of a question, he answers it before I get to it. So I just wanted to let you know my appreciation as well.
And your job has been monumental. If you think of the growth we've had over the last five years compared to the prior 20, I mean, it's been a lot. And you've been here to guide us through that. And I can't just say how thankful I am that you have been here for that.
When I first came here, I came from a very, very fast-growing community outside Kansas City, and I was worried when I took this job. Yeah, I knew a little bit about Auburn because I was raised in Indiana. I was concerned, but it has been steady growth applications. Auburn is doing very well, and you're situated perfectly for moving forward. So it's been really enjoyable. It's good to see all the things happening and what is going to happen.
