Alright, it is 6 o'clock and I would like to call the City of West Melbourne Council Meeting to order. Please stand for the clerk. And a moment of silence please. All right, welcome to tonight's meeting of the City Council. Members of the public are welcome to speak on any topic, whether it is on Trump's agenda or on any issue that is important to you. Each person that wishes to speak should come to the speaker's card, which are located by the glass doors, and submit it ahead of time to the city clerk, who sits at the end of the dial. After you have been recognized to speak, please use the microphone at the podium and clearly state your name and address for the record. Please address all your comments to City Council rather than to individual members. Direct all questions to the chair. Speakers will be given up to three minutes. Welcome. We are all here. There's no one absent here today. And our first order of business is a new employee introduction to Mr. Piccarello. members. We have 3 billion employees for the city's public works. We have one clerk for the public department. We have two individuals for season drainage. This is Joe Connetto. It comes from us from Iowa. He's been here about two months now, trying to get back the money to our brother. So we have to get this there. He makes Perth Department complete with the number of people. So we're very happy to have him. He's a fan of doing this. He's a heavy equipment operator. He's retired from the city of Georgia and comes down to us. And he's our new Lindsay operator. The owners of Shilpa, who is local, is employed here, raised? No? No? No. Okay. Wow. Very funny. So there are three individuals that are not from Florida. They're making homes here, so we're really happy to have them. Thank you. Thank you for coming. My first Christmas will be down here this year, so I'm pretty happy. You're welcome. Our next speaker will be Lacey Villareal. Step up to the microphone. State your name and address, please, and speak under the microphone. Hi, there. My name is Lacey Villareal. I live at 3165 Berta, over in Crystal Heights. I'm a veteran this year at the U.S. Air Force, intelligence analyst. I'm a large work out there. My husband's currently in service. My father retired from the service, and my siblings are still at the service. So, big military family, big service-oriented family, and speaking to give back a little bit more. They've attached my HOA training for a couple years now, so this is sort of a step up from that HOA for the city recently. So, yeah, looking forward to it. Well, thank you. Thank you very much. All right, the next speaker is Deborah Sandberg. I'm here with council members. My name is Deborah Sandberg. I live at 2432 Woodfield Circle. And I wrote an email this morning about the issue of the island on Mitten Road and Harry Jones Boulevard. If I can get the mic. We've lived here since 2023. I'm sorry, 2003, so it's 23 years. And it's not in our covenants for Woodfield to take care of the islands. Woodfield is responsible for the center island, and Bookshire was supposed to be responsible for the front And there was a gentleman's agreement made in 2003, and we looked for a covenant. I have them with us. Nowhere in there does it say that we're responsible for either island, but we do take care of it because we love living there and we want it to look nice. Well, it doesn't look nice now. And if you drive by there, you will see that it's just rapidly deteriorating quickly. cars, I have our products. I do sit on our board, local board for Woodfield. We are not responsible for any of our items on city property, or just city property, I should say. So I just hope that you all would maybe look into this and try to get to the bottom and address this so that it doesn't continue to deteriorate. Because as it goes forward, garbage is being collected. It's very difficult when you come up to the area to look at roads, even where there's a traffic light, because now it's overgrown. And certainly, and obviously, you'll have the kids going back to school. So I just wanted to make sure you all were aware of that. Thank you very much. Thank you, Ms. Sandberg. Next speaker, is it Dina or Diana? Dina. as in what's in place. I'm here on behalf of concerned residents from Greenwood Village Communion Association. Many of whom are elderly, some are disabled veterans and are on extensions and are deeply worried about the financial stability of our community. Our community is facing serious concerns involving both financial irregularities and building safety issues. Earlier this year, we reported that over $500,000 of reserve funds were immediately loaned to a vendor. No contract, and the amount has not been fully restored. Approximately $793,000 reserve funds, and never seen a dollar was used for roof repairs. No accounting to be seen. The financial documents we have received change from one version to the next, with deposits, withdrawals, and balances altered or replaced. The Board has dispelled financial records. One example includes two large withdrawals, selling over half a million dollars, were omitted entirely from the financials they provided. One person on the board controls $1.7 million in Treasury Direct account with no oversight, no pain control, and no access for a significant amount of the activity. We pay thousands of dollars on building maintenance. We have photographic proof that an exterior structural wall in one of our buildings is missing just two-by-four studs nearly three feet upward from the floor, which is a serious life safety hazard. In March, we reported these concerns to West Lincoln Police Department. We were told the matter was about their pay grade. and was not referred to detectives. The Boudoir County Sheriff's Office and FDLE both told us that we must begin with West Melbourne Police. We are now caught between agencies and no one will take jurisdiction. I submitted a public records request for the body cam footage from the day we reported this matter. I paid in full for which again I was told that I was next in line. It's been over 60 days and I still have not received the footage or any update. We are here tonight, as you can see, as residents of the city, asking for your help, ensuring that our police department engages with us, responds to your welcome public records request, and provides direction so this matter can properly We want to protect our homes, our elderly neighbors, our veterans, ourselves, and I ask you for your accountability and support so this does not continue to fall through the cracks. In terms of the financial documentation, is that something, Mr. Roby, does the city have any sort of ability to work with the organization in terms of their financials on the board? It's DPTR, isn't it? Yeah. There is a COA and DBPR, which has been involved, but they're not the ones who, when we were contacted to make the report, were the investigative part of it, missing money from the accounts. Sue? I figured as well, but so, fortunately, you're a legit client. Yes. And how can I assure you that our police That is not something, we do really good work here. I'm sorry to hear that, but I can assure you that Keith deserved your I'm happy to look into that. As far as the legality of how the group is set up and who has authority to spend money on that, that might not be something that we can forcibly change, if that's what the language is. But if there is fraud, in other words, if somebody put a dollar in their pocket that doesn't have authority to put a dollar in their pocket, that's fraud. I think we're all cute, right? And so I'm not trying to point the finger at anyone getting in trouble. That is not my purpose tonight. I also know that we have new police officers. I don't know what I don't know. I would like to say, in the interactions I've ever had with Les Milburn, I've spoken with Bruce Alexander's office many times. We used to receive our public records immediately, quickly. I've interacted with several of our so willing to help and assist. I just think that there's a way somewhere where we need your assistance. I think you deserve it. I'm not sure which one's first. This is request for an aluminum buildable panel trench box. Thank you. Yeah, so our build box panel trench box, we sent it out recently. Franklin as a secure property in the same state. The dates were not confirmed, so it's a bit of something less than a new property. The work is being built. As construction started, the construction trees were being locked in the gate when we were leaving. We ended up removing our day, putting up another day. We just wanted to continue it. So it was just a construction site coming down, and we basically had no control over it at that time. We went to Junefield a couple weeks ago to transpire to this Arizona trailer. It's a 24-trailer. It sits underneath the pavilion to keep it out of the weather. As construction workers come in to do work, obviously, they park around. This is not the train that's in the park. So they would park around it. And actually, they asked us if they could eat in front of the pavilion or the train or the store. And they said, yes, you can do that. So we're looking to replace it. I'm an insurance company. contract of the Transparency Safety Company for us to purchase $34,140. We did receive $24,419 from our insurance company, so our official impact would be $9,721.38. Thank you. Ms. Adams? Thank you, Mayor. I'm sure it's frustrating for you when things go missing when they're not supposed to. They don't. And actually, in my life and the house, it's just the first time anything has happened on my property. I understand, and I know it's partially because we have a lot of construction happening in that area. Knowing that we're looking at replacing this trench box, are we changing anything about that area or the processes to make sure that the center of the order does not be the same thing? We'll get it to our site. in our own building. So that's how we did it. We actually, we had our four portable generators that were stored on the outside of our pavilion. Those aren't cleaned up. This is a, you know, as I said, this is a 22 trailer with, you know, a couple thousand pounds of material in it. Well, and knowing that we're going to be expanding that part-time area in terms of not just storage, but also with different things coming in and out of that area for city services, are we going to be looking at enhancements for that area or security measures moving forward once actual construction and things like that are done? That's a great question. Keep in mind, there is a high level of security for a lot of things. Two-year access only once is our site. One of our challenges with the team construction project, so the B&I, the fuel plant, needing to run the life of underground utilities. We needed to cut up the dry area of the public worksite, fuel plant, and so a lot of vehicles had to access the side of our facility through Park Hill. of having so many contractors doing so much work because there's a lot of keys on that lock and a lot of contractors and subcontractors, as much as we try to secure the facility, there's always that next guy or that next subcontractor who wants to work late and we've got a trust and that then locks things up and that's probably where the ball gets We walked the site when the project started to make sure that we had everything that could walk away on us that would have value. And this one, we just felt the value. Understood. And I hope that never happens again. Thank you. And I do miss your samples. Thank you, Mary. I was thinking that, can we talk earlier, you said that there were cameras down there At the time, the Police Department was looking through all the settings. Yes. One of the challenges is a lot of footage, and it's in an area that we have camera coverage, but not that ideal camera coverage, and so it's a combination of trying to take the resources on, watching that footage, missing and start putting some things together. It's going to be a tough case to solve because of the time that's elapsed. You know, typically when something gets sold, you know, someone says, you know, I was there yesterday and it's gone today. So it's a small window of time to evaluate all the other factors and just like because of spelling time and the way it's found on the clear, it's really hard to be able to see when parts and pieces sort of go in different. So we're pleased to probably continue to offer that, but it's an uphill battle. was there when the next thing was gone and we could start questioning all the cars that were in the parking lot and start getting all the knowledge back. It's a little bit harder to replace it again. We have about 60 laborers with the two projects coming and going every day. So, you know, if a lot of cars come and go, you know what, somebody will find them. I believe that to be true. Thank you. We have a motion on the floor from Mr. Franklis. Mr. Gutierrez, Chairman of the Sanitary Force, may I note, David, that when we are in the public? So, apparently, the force made the Chairman of the Sanitary Force, may I mention him, a person out there with the department contacts, started listening when we were contacted. They were able to sleaze the air band, kind of come and force me. And when they exposed the pipe, or when they exposed the pipe, they found out the pipe was in the way of Doug's marks. And they said, well, the rest is in there, whether they're installing it. And that was part of it. we will provide. There's only part of a week, but we're pleased to accept the plan. The second part of this is this coming first week runs from 12 hours, 12 years down, and there's numerous restrictions that are tied into this first week. So for us to do this What we're going to do is drop the ZALs in so we can keep the other forest names out of most of those Ys as we do this repair. And this ZALs and CIRDASALs will help us, even in the future too, because if there's a problem, we can isolate some of the substations instead of having them all rely on this unit's forest name. So we went on for bids. We have three bids. to do the work once through the repair, which has given us utilities that came in at $49,988. The end is urgent. The duty list is aiding for the company With that, I'll make a motion to approve and award the contract to Daniels Utilities to prepare the essential resource made accurately. Thank you, Mr. Bentley. Is that not something we would seek to cover, or we don't expect at that point? I'm not sure what it is. Usually when they install a pipe, we use the site circuit to make sure there's no issues. Whether they get it back and remove something, Wait, I just didn't know, before you cover all pipe history, because someone does a visual on it. No, just to clarify, our pipe runs through their property, and so our pipe was there first, if you will. And so when they were doing their project, if they were letting that pipe for a house, we would be there to inspect it. If this pipe was ours, they are. And so what Brian said is, you know, we're out there all the time. You know, we're out there for games. We want to show, you know, a person standing there. So there is a chance that during the building of the parking lot, a guy was, you know, a contractor was digging and hit that pipe and just burned it. And so don't go over there. Don't dig there. There's a pipe. So it's not a case of, like, you know, everyone's going, this pipe's for us. existing and until it was marked through the construction process at some point, somebody decided to do it. She just feel like I'm going to attempt to do better than she did. So, as you all know, we passed a resolution to set the council meetings in advance. So, we were contacted by Brevard County election supervisor, and they want to use this particular building again. We don't have a primary election, however, the county does. And so, the date of that election is Tuesday, August 18th. We have two meetings that night. We actually have our CRA and the regular council meeting. The personnel from Supervisor of Elections is going to be here Monday, and they'll be setting everything up. The election happens Tuesday, and they run around like crazy people and take everything down immediately. And so Wednesday is what staff is suggesting, and this will so kindly need to approve. All right. The color of what you're using doesn't matter. If we wanted to move our National Night Out traveling tour, which typically happens the first week of August, to the third week of August, and do the meetings, and so do the National Night Out tour instead of the council meeting on that Tuesday night, that could be an option. That wasn't in me. That was brought to our attention by a new police chief who said, you know, I remember we did a national night on tour with that work. So that was a new idea on the fly. We do have two meetings in August. As you recall, a couple years ago we had to scramble because we typically can't take one August meeting. and talked about cancer, and the idea that our code says we have to meet at least once per month, but if it accounts for being We could also postpone this and talk about it at the workshop. Yeah, I'm going to risk termination. I think if we talked about it at the workshop and you took the discount as a fix, that's still something we'd want to do, but I might be launching that then. Motion carries. We have table that, 7-0. All right. 8-D. All right, this is Mr. Carey regarding the, I'm sorry, regarding the micro-magnetic devices and e-books. Thank you, Robert. That was really helpful. And then, as well, someone wants to know, like, the first e-books were mentioned. Whether you wanted to... I would say from a global perspective, no, it's first. We decided to bring it forward this week, and though we felt by the time it reached its second reading, we know what's happening to it. We don't expect it to take place. We think, oh, well, I think it's too soon. We should always, you know, rethought this and adjust before second reading, which we do have. which itself, you know, there's kind of a lot going on here, as I guess you explained, You could literally go to do something like, you know, say, oh, we want to drive on the left-hand side of the road in the city, and the other whole road is out of clearance, and we could do that. I mean, just kind of create chaos. The state decided long ago that it would make more sense to have rules of the road that were consistent statewide, but there are still aspects of, you know, Section 316 kind of takes the opposite approach that most states take, in that it generally preempts everything, but doesn't give you a long, long list of things that we are allowed to regulate. One of them says the state sports that we assign a remiss penalty may enact an ordinance to permit, control, or regulate the operation of vehicles, golf carts, mopeds, motorized scooters, electric bicycles, and electric personal-assisted mobility devices on sidewalks or sidewalk areas where such measures are permitted. in places with maximum speed of 15 miles an hour in tutorials, you will note that in the ordinance that we brought forward, it's 10, and I know it's going down a little bit, but that could go up to 15 as long as we're not pedestrian-controlled. And then there was another anti-corruption, which is solid. It says, local governments may not provide a minimum age requirement to operate the distributors or make room for like pre-entry missiles, we may conduct an urban sheltering operation of mobility devices and scooters on streets, highways, sidewalks, etc. under legal maintenance jurisdiction. So this will be the city's road to an urban sheltering station over the state of the town's roads. So all that as a background. We have daily emergency We've got to set the guidelines for it. Does that make sense? Does it make sense if we're not appropriate? And what we feel about this is, you know, we feel there's no support in the platform. It's okay if anyone doesn't like it or the policy isn't creative, you're free to let us know. And we've had a number of success in reading. We're just trying to do our best to bring forward elements that we think could be broadly acceptable by you, but obviously, know us now. Gordon says several things, and I'll take, you know, even one of the classic French affirmations, some of which in the U.S. state, and then the state doesn't expect people to sort of do modern technology with it. There's, the U.S. ordinance generally does several substantive things, but it requires bicycles that make time to be equipped with waxing doors like this, micro-mobility devices that may be allowed on like 10 miles an hour on the sidewalk. And number one, which is not consistent with what the state laws say, however, the state law that we have to speak to, I need to affect in a couple of weeks, says that the 10 miles an hour would be in 50 feet of pedestrian. So we could also come back to that language and increase it to 15, which would sound really electric personal assistant mobility places. And I'm going to just quote through one of those segues. Those are limited streets that are close to our national or economic or workplaces. a legal domain, you will also have minor outbreak or even a case of abduction here, which creates a vulnerable presumption that the minor is permitted to use the in particular, to bring success to Thank you. That was a lot to say. Thank you. Mr. Francis. Thank you, Mayor. A couple questions. Under the Fair Board on 8D3, under the electronic personal assistant and ability devices, what, in the second line there, says ordinance to F in streets. What does that mean? But not, I'll get that out of the way, sir. I will, I will not for a second believe anybody's point of development. I wrote through all this again and missed some, so I'm sure I'll blurt it out for one of you. The next one down here talks about no-tanks. Now, down around the city streets or sidewalks. Then the next bullet down, it talks about no-tanks, or ideally being a the speech, which kind of implies that no country allowed, no books aren't allowed, so I don't know what you're going to include in there in my life. It's still like that, but older. Now that may be one of those things that when we I would be okay excluding no-peds but scrapping it from the next sentence down because it implies that they're allowed if they leave it in that sentence. However, if the council wishes to leave no-peds in, we need to scratch the line above it. So, none of the other questions. If legally no-peds aren't allowed on the street, I think we need to scrap the second My other question is, state law allows for golf carts to be included, but we don't list it in here, and I would love to see it in here, because I see golf carts driving down the sidewalk all the time. And the reason we left that out is because it was a separate golf cart group. vehicles still unregistered, but in most places we don't even worry about them. So, they would fall on the same lines as golf carts, but if they're registered they can be on the roads up to 25 or 35 miles per hour or so. But I worry about them. I know in my community we have a bunch of these LSDs. Actually, to get it together, I'd rather look. There's a few areas that I'd like to see us discuss a little bit. I didn't want to have to work with, but you see what I'm trying to do. For example, this year, I'm not going to write about the state. I'm not going to say, no, that's your place to put us through it. And I completely agree with that. I put that within the sidewalks and I don't set a time. I just think that we do have a sense of responsibility to the pedestrian in the sidewalks. I think that some of them do slow down, but the thing that you can't do on the ground, you know, regularly by climbing along the sidewalk. If you look at, for example, and I realize that probably you can't refer to the city, but for example, you know, for example, if you go down the parkway, I also had a past poem that is an open sidewalks guy. You've probably never seen a person walking like this. I had no problem. Robbers have no problem talking about how I don't have a bicycle. I also do the same thing on that road. I run away, not obviously, but you're free when you're crossing a street. you need to get down to some pretty low 20 or so, but that's what I think. But I think, and I think from what I see people, what they're right, 50 to 20, I'm sorry, but in those streets, no better driveways or something like that, you don't really need to get to these countries to be. For example, I went to big, big Australia. There, I think since, you know, it turned out, I don't know, I was, I don't know if I did that, I could wait too far away, and it almost makes it work out right again. Should we? Yeah, maybe go throughout the whole time. I mean, I could also look at column 87, 87, it's mentioned throughout here about speed, and in fact, I'll talk about speed and the city manager today on this topic, and we probably will send this message that I think that's what this is for, and show us what kind of change. And so I would ask that we I don't know the speed on our airfaces, sidewalks, or something in a place like the corner. I would also agree that if you're getting near a pedestrian from back or front, four down to five, I mean, I don't care which one, but then I'm always pissed off because there's no way to alarm or put anybody on rest. And so, you know, we're just doing the same sidewalk. I said, if no one's there, you're kind of working on this thing too. You know, there's been kind of mentions that you have to sound a device if you're coming up on someone from a higher direction. I agree, coming from below, but I have a device I'm not used to doing that. I don't see a need to incentivize someone by writing a bill or whatever when you're right in front of you. I mean, you can see them get confused coming from, well, I don't want to scare anybody out of a particular reason. So I would ask that the council sort of allow them to be, no matter how old you are, find them to be witnesses, like the state does, or there's hope in Australia. So if you want to make it $53,000 private price, I say that when you're paying for real pedestrians, and so give them added signal before overtaking a passing pedestrian. So I think, based on the way that's worded, I think we could So we can certainly adjust passing them if you can pass them in front of you as well. I think overtake implies coming from behind. So you wouldn't use that verb if you're talking about something that's going towards. people out there that have been very stuck in their phones and they go out there and they're not going to see you, you could give them a walk right in your telephone calls because they're not listening. I mean, the other way you're going to scare them to the state law is kind of a feeling, not a floor, so it's the state law requires you to do it when you're overtaking someone and passing them. I think that wouldn't complete you from doing it the other direction, which is what we did in the ordinance, but it's obviously up to you. I don't see, what's the difference if they see you coming and you're going around? I guess some people I think can actually divert to you, where they can sort of see, you know, they can't see it. I mean, I'd rather go around this front, really. Okay, well, I would point out, I mean, on 8B7, for example, I would point someone to, it says... that it doesn't mention what percent is coming from Biden, I would pretend it just says approaching the press week. I'm thinking it's seven. It doesn't tell you. I don't know that you just put it in there. Yes, and that was a policy decision that we made to the House of Commons. I certainly know they're going to come in. But again, that's policy decision by one member to by law. So if I were in here, I wouldn't be hearing it. By the way, I just think it wouldn't be necessary to take a seat. But if you say, again, it was yours, talk those words. Fine. I just, I get it first. It says, not everybody likes you until you win your ballot. And it's just a one-shot call. I don't know, win a year, win your faith. You know, behind that, I've never had anybody say anything. I've had people look at me like, does he need to do that? And I say, you know, I just feel pretty safe. But if you tell me I have to all go out, that's fine. But the thing is, I think that they're not so good at what I do, so I'll just be the enforcer. Please, maybe. So can you, one thing I was wondering, and I was wondering about this, is there a predominant What was your question about, how is your analysis speed enforceable? It means it is for a vehicle. Radar, radar, we can pick bikes up, bicycles. If somebody starts complaining that it's happening all the time and there's school zones or whatever, we can, we can start a course and set up little radar tracks. Oh, great, great. But that is stationary than inside vehicle, right? So, okay. I didn't know they picked up that slow speed. Do you want it to be five miles per hour or ten miles per hour? Ten seems still pretty fast to me, right? Well, because as I go by, so I go more than you can imagine, I would ask just, I think, 50 miles an hour is probably, I don't know if it's a good description, but it's probably okay on a sidewalk. And so, you know, I want to be fair with that. Science is 15, but all the others never go over 15. I want to find out, because there's just so much stuff going on. Sorry, I will be okay. Just ask me for a five-mile-an-hour increase here. No, I'm going to be okay. It's a connection. I'm going to go down the slide. Mr. Carey, one thing, and I have a question on here, is the, so the caliber of weathering devices we have for the electronic personnel-assisted weathering devices, would that caliber get a new kind of mobility speed or something like that? I would have to really look at the state definition again to see if it applies. I don't think those high-dose computers go fast enough, but I know this would really be interesting to go, because I don't think they go over 15 miles an hour. But I'm not bothered about that. I didn't have any question I had on that. It was to do with sections four, which are the channels. There's a, in some instances, the only operation of those vehicles could be from a dressing room or a parking lot. So they're not allowed in, like, a few blocks. And so we have, like, a paid job mobility experience. My question is, like, are we preventing So I have to dig into what this is going to say to science, what kind of To piggyback off of your comment and just turn it off the top, generally electric wheelchairs will go anywhere from 8 to 10, sometimes up to 12 miles an hour. unless you do some additional modification to your wheelchair. I have never done that to my wheelchairs. My brother could say it was 20,000 for me, but usually they're not going to find one, at least a market electric wheelchair, that can go over 50. So without saying you can't find one if you work hard enough, but generally that's not going to be my relative concern. Yes. And, you know, more importantly for the folks in this Most of my questions at this point have been answered, so I appreciate all that input. I don't know if this question is more so for the chief or if the city manager wants to weigh in. Are most of the drivers that you've seen or experienced in the last number, are most of them drivers of these types of vehicles? Yeah, this is for you too. I would say, aside from Mr. Bentley and myself, the majority of them are tribunals. And in terms of the current case that was discussed by the city attorney in terms of kind of taking that responsibility out with your minors out with the mobility device and what that means, I'll use a little bit different words than we have for these, the micro mobility devices. Have you seen from other cities that have instituted any type of ordinance with this where parents are then coming back and saying, you know, what happened if I didn't know that my child took their computer or device out? Does that then kind of waive them from that, or is it automatically assumed based on how it's written, and is that enforced upon them? they would be able to sort of apply testimony, and if their testimony was credible, they make it over from the presumption. The purpose of doing a presumption is, we generally assume that if you're a minor, and you have a bike like this, that you kind of know about it, and that they should be responsible for making sure that you use it according to the law. And, you know, again, this is a criminal category, it's a sign, and the hope is that if you kind of make a little bit of a mistake, That's why we don't know whether there's a decimator that's been filled out, because what's been filled out is important. Okay. And in terms of, as we move it forward with some of the adjustments that are discussed in the second reading, we've already struggled in terms of educating people on some different safety issues. And I think this came about because of the discussion about safety. I mean, where does that fall under an education de-cycling system, you know, their own devices? Is that then on us as a city, and this is something that we've created, therefore we're going to be pushing it out? Is that tied into, if it comes forward from the state government? Yes, I, hopefully, you know, there's a, we have always had a hope that the governor will sign it. issue. This is, if you don't know, there is definitely an education issue, not because they're new, but kind of because they are confusing to a lot of people who purchase them, as far as what the rules are. And so we're hopeful for that, but I did talk to a lot of these, and the last word that she got was that the government could The governor has got 15 more days or 14 more days to either sign it or it becomes long, so we've waited. We've been waiting. Now we're at a point where we can move forward. Definitely education. I think one of our second or third most popular Facebook posts that the PD did was the e-banking model. to classify this as what we call the Mrs. which can't win or the Mr. which can't win. And so, it's definitely on us to keep that education piece being posted and trying to get the word out as best we can because we'll have students and parents that don't quite understand the rules. The child wanted something, they got what the child wanted, and now they're finding out but they can't use it. They sit in rooms that go along with it. And so education, I think, will continue to be the forefront of this, and having this ordinance allows us to tie the definitions with, carry the district, so to speak, the definitions with some of the policies that go along with this use of these devices. There's always going to be a struggle with the education, because if you go on a bike ride with one of these devices, you know, many people in our community do. If you're on for a half hour, you've probably been on three different jurisdictional roads, city, county, and state, and you've probably been on two or four jurisdictions, different municipalities. And so education is, you know, one of the reasons we're trying to don't care so little about county and community is to be consistent. But the other reason is to hope that that good institution piece will resolve our institution piece will be forgiven. And how much for these riders is assumed, correct? this under 16, right? But in terms of we are expecting, because it's included in here, we can then enforce if you're not wearing one or not. So we can. We can. So just in the end, from a safety perspective, my personal opinion on Mr. Bentley's change in the speed, just because I think about what happened A minor is not wearing a helmet, and they may be coming up to a pedestrian. If they know the rule to slow down, that's great. If they don't, they may pass by a pedestrian, which I know they would be in the wrong, but they may be passing that pedestrian at 10 or 15 miles an hour. That's pretty fast. I think I can, you know, if somebody doesn't pay attention or steps the wrong way, I've done that before when they came past me on the sidewalk. Sometimes they're just not sure which way are they going. You both go in the same direction, and then you have a problem. Doing that at 15 miles an hour can cause a problem for both of them. So it's my opinion I'd rather keep it at the 10 and then drop it down to 5 as you're passing, just to keep the slower speed for safety reasons. But if the rest of Council thinks 15 is manageable, then I will support that. Thank you. Thank you, Mr. Bentley. Thank you. Can we address a question here? I don't remember the penalty. So we all live in different areas. So 10 or 15 miles an hour on the sidewalk would be fine. Most of the sidewalks that we have here, like on Windy, where we have people out there, they're walking their dog in the morning, right? When you're physically going to school, you've got the dog, and then you've got four feet, maybe four feet at least, and then you've got the person. They take up most of the sidewalk. And then, sort of, on the farmhouse, or on the road, or... And that brings me to my next point. This is a 78th ordinance. It's hard to get people to read something this lengthy. with the different speeds other than having it posted on the side of the road like we do for cars, how are kids going to know about the different speed changes? Is there something we can do to work with the schools for education in the schools since this is where they're riding in? Hold on. I'm out of here. When I say that they can't go in the parks at all, if kids are riding their bikes on the sidewalk and they're going from Saddlebrook to Wingate, that sidewalk goes right through Westbrook Park. It's like a bike park. They use the bikes in the street park too, right? I don't think it takes you much of it to not even have a half a million bicycles. You know, I want to listen to those other petitions. There's no way the way it goes is authorized to be a government park. and you've got an upstairs circuit, a microwave, a bus, an off-road vehicle, a moped, an electric, there's no system anywhere in the place. So it's not a car, it's not a bicycle, it's not a bike, it's no one can do something. But there are e-bikes, so, and they were not allowed, they're not, because they can't go through the park on the sidewalk, but if they go on a highway with e-bike, they're on the roads with their cars. For example, in Westbrook, if you need a Hollywood sidewalk, you are legal. If you are the Wingate sidewalk, you are legal. But if you bring the bait into the park, then you have to put off the bait. You have to walk the bait. But there is no sidewalk next to Hollywood between Wingate and Saddlebrook. It's just grass, dirt, and road. The sidewalk is in the park. that you cannot ride into the park. All right. Well, there's have to be more. Yeah, but they have to go next to the road, which is... Or take the sidewalk. Or take the sidewalk. I know. Yeah. And they have to walk their bike, if they can't get their bike in there at all. Well, you can walk your bike. Oh, that's who you want to be. It's not a design that the e-bike is banned from the park. The e-bike is banned from riding in the park. So we have a lot that we're going to have to get people to learn. And that's a lot. That's very good. The good news is just about every community member of our county has passed something this and that to this. I don't really care. I'm doing this. I'm just saying. But the good news is it's a lot of education. It's a lot of education. And it takes you out of the garden to the park to park. It's a drive to the park. And again, I'm dating myself a little bit. When I went back to school, you couldn't ride your bike on the playground. So you got off the playground, you had to go off your bike and walk it to the bike rack. And I was like, I'm a hundred years old, but with my square tires, my square stone tires, you weren't going to be able to do that. And so that would be very similar to this if you were coming to the park and you had a bike, you could ride it on the sidewalk, take it out of the park, and then you'd be able to walk It's education, right? We're, you know, keep in mind, we're not looking to, we're not looking to write 100 tickets to kids. We're not, you know, there's an education piece, but there's also violators. Mr. Bentley. Mr. Bentley asked, at least the attorney, the attorney, the attorney, the attorney, the attorney, the attorney, the attorney, the attorney, the attorney, the attorney, the attorney, the attorney, So if you think about the communities, parks, for example, they could ride their e-bike up to six years with the sands on a crane park. The slippery slope is there are a lot of kids climbing. There's a lot of clouds with the small kids. Their presumption is that That's the whole purpose of our parks, is that that's a safe place to come, and they're not going to have to deal with anybody coming 10, 15 miles an hour through the park. And so that's a great slope that you're getting to, is I wanted to say, boy, you were searching cakes for a ride, now you're going to a park, that's a great place to ride a park, and that's a great place to ride, it's safe, well, get that from and our rest now is kind of leaning on the side of the small shoulder and the people playing in the park and not having to worry about some kids. The question came up about Westbrook, because I know a lot of kids will head around Westbrook Park in terms of getting to the schools. The ones who are currently using bicycles to get to those schools, are they giving us their bikes and walking them through the park? Right. I'm just asking, if we move this forward, the bicycles are included, up to the e-bike one, sorry, not the manual one. So the pedals, the pedals, the pedal bikes. Okay, those are the only ones I use. I have not used the other ones, so this is all new. The pedal bikes, since they are not included, let's say with the friends or riding from home to their school, the ones on pedals will be able to ride through the park. The ones on all of the other devices will then have to get off and walk. I see that in a perfect world. And I don't see it going that way. I see especially kids saying, well, my friend is doing it. We're all just going to do it. And see if we don't get in trouble. And my fear is there's only so many. How many times can you? find a parent when they ultimately say, well, this bike is allowed, but this one is not. And I understand that in a present world, looking at it from a safety perspective, could there be an option where we analyze especially our parks or areas near the schools where we know this could be an issue? Because I don't know the situation by something like that. the School for Science, can we wait at where sidewalks may need to be added to close that loop, and then we don't have that issue? Could we be proactive in that way? Is that an option? I know sidewalks fall into totally different places. What's the problem? We're going to that slippery slope of trying to keep people from running. Yes, an area that's intended, you know, let's call it for school-age kids who have pedal bikes and can't ride e-bikes. The pedal bikes can ride to the park, but that doesn't mean you can't. The problem, while that might seem unfair, the issue is if you allow e-bikes or you notice in the park. We're back to that super slow pace, trying to protect the small children. know any bikes and even know those traveling in the park. And so your scenario is an interesting dilemma for a youth to move out and to go back and walk the bikes and to go home. It's an interesting line. But again, we, and again, up to the council, but we care about the side of what's in the Do we have the availability to analyze where our sidewalks are to see if there's other sidewalk connections we can make to make this easier where minors are seeing each other? More so in the world. But do we have connection gaps in terms of design? We certainly could have done that. I would say store together a school zone and work it away. priorities, we're going to look forward with looking at how we pass the ordinance on that. But this is my thoughts on that. And then I did see on 8D7, which one is this? This is B8. It talks about not doing a wheelie or a trick or maneuver in a manner that's close to others where it causes harm or injury. To Mr. Bentley's point, looking at San Joaquin Park to have that spine connection from start to finish with that park entrance, Would that also apply for engines, not a truck or a wheelie, for riders who just decide to ride back and forth and make that a fun experience? It's a parking area for cars to park and that sort of access, but I don't know about everybody else, but I've seen them going just back and forth from one entrance to the other. Does that then become a safety hazard or is that permissible because it's where cars are entering the engine? Does that make sense? part of the park. It is, but it's also a parking lot. Right. Okay. So maybe we should have one more time on You've got the two entrances to the parkway. And you've got the micromobility devices in the e-bikes, especially those that want to utilize the entrance and exit. They're riding their way through the entire parking lot, turning around and coming back. And that becomes the play area. It's part of the park, but it is a parking lot. The cars are coming and going. I see that being a danger area. But they are not necessarily doing a trick, a wheelie. Where does that fall? And they're not in the park. Are they just... It is not allowed at the park. Right. They're not coming to the park where the car is driving back and forth. I would say that's permissible under our current, under this version of the current ordinance. But that's permissible. I just wanted to, I'm missing, how do you understand it? I think at some point, you know, if they're endangering the public, or the people pulling in and pulling out, then it would be the police officer to stress them. wanted to wake up and head on flying again, then drive through the spiral itself, and reach and repeat that 30 times. I thought, yeah, it would be you would be with your children? Well, I was asking because while my son has played at the park, I've seen people doing it, and I am less worried about the cars. The cars are coming in slowly. You know, I think if one of these devices hit them, the cars aren't going to take significant damage. I'm more worried about the individuals, especially knowing most of them are minors, interacting with a car. I think that's going to turn out worse for them than it is Yeah, I think the reverse of that is if you were riding your e-bike to the park. Right now, you could take the sidewalk and say, we're fighting. You could ride, you could get to the spine road, you could ride the spine road to, let's say, one of the skate parks. And then you'd have to get off at the skate park and walk it the rest of the way. If you were to bend down in front of the parking lot, Yes. I don't think that makes sense. I just wanted to raise the concern about knowing that our police officers have this flexibility to say, you know, this is maybe not a safe manner for either the vehicle or for the person utilizing the micromobility device. city doesn't make bicycle paths. So if there are any particularly wide sidewalks that make sense for these kind of vehicles to go on, you know, if it doesn't make those bicycle paths, then maybe that's a good idea right now. I don't think we have a deterrent way to go about this. So let's treat that possibility as if, I mean, you know, they said you're, you know, are we going to be evaluating some of the paths that may be part of the evaluation? And, you know, if this one would be appropriate, just a three-feet wide, and we say that the Yes, getting back to Westbrook Park and that very issue, maybe we could widen that sidewalk there, because I would rather have kids on the sidewalk there than on Hollywood Boulevard with cars going 45 miles an hour. And they have things that they turn in. They turn around and come on to Wingate. And so that would effectively, those kids would be coming down into that lane as cars were coming down. And I think it could be an issue. But if we could, I don't know how wide the sidewalk is there, but if we could widen that in, I don't think it would take that much, but it probably would be a much safer thing for the kids to go through. It would be a faster solution than running for Hollywood to get to Orlando. Yes. It would definitely be a faster solution. Yes. Thank you. Thank you. Well, I thought I was okay by saying that. I'm stumped because almost every active bike that I have seen, and I can only think of one of those who's out there, they don't have pedals. Everyone. Are we talking the same language? I'm not. So, if I'm pedaling to get to a rest, but there's no downhill going on, if you're saying bicycles can go anywhere, there's no way. as you may or may not decide to think about. I don't know how many of you think that that's electric, right, that they're running to a target 5 miles an hour, or that's a pure panel, right, that they're running to a 5 miles an hour. The risk is the same, but they're going 5 miles an hour, or whatever sort of thing. I don't know. I'm just curious. So this is a panel that we own at those. You know, we, by defining this e-bike, whether it has to load or not, And yes, you're not allowed to. No, you're not allowed to be involved. Because it does not tell us whether to be involved or not. So you're saying that we're going the same speed, not maybe on purpose, but you're going the same speed one by cloud and another by cloud. And this doesn't mean to the individual that's walking silent. Are you using these policies as knowledge? I understand that there is knowledge in the market. I have a question, and you can look at it like Tyler was. To your point, both of them could go 5 miles an hour, be safe, and appropriate.
