Okay, we have quorum, so I will call the meeting officially to order. We'll start with the approval of the minutes from the previous meeting, which was April 30, 2026. Those have been sent for review if they have any additions or revisions that need to be made. If not, I'll entertain a motion for approval of our previous minutes.

We'll start with county conditional use permits, DSD, Razorback Division, dump site, high-capacity dumps. High intensity. High intensity CUP. Thank you. I was struggling there. Let's start with staff report, please.

The applicant is requesting a high intensity conditional use permit to operate a construction spoils dump site which will bring the subject property into compliance. The applicant is actively working to meet all county regulations and ordinances and ceased operations upon notification of noncompliance. The subject parcel is 18.35 acres in total, with the project occupying approximately 10 acres. Operating hours are Monday through Friday, 8 to 5, with occasional Saturdays. One employee is on site during business hours. The property is fenced with gated entry, and a sign is located on the front gate. No structures or parking areas exist on the property, and no utilities are currently present. The project site receives spoils from construction sites throughout Northwest Arkansas. Materials include unsuitable soils, aggregate, and similar materials from construction sites. No trash or waste is accepted. Contractors typically lease dump trucks or use company-owned dump trucks to transport materials to the site, and customers pay a fee per load. The onsite employee manages the placement of materials, brings the area to grade, and ensures proper compaction. The number of dump deliveries varies based on demand, but the site averages 15 to 25 trucks daily or up to 600 loads per week during peak demand. If approved, the project will be required to undergo high-intensity, large-scale development permitting. To date, planning staff has received two complaints regarding the dump truck traffic and the road condition.

The property owner is actively engaged in the process to meet all county ordinances and regulations. The hours of operation are Monday through Friday 8 to 4 and Saturdays 8 to noon. The property owner is the sole employee. The project site consists of an 80 foot by 50 foot shop which is equipped only with electrical service. The property owner's residence is located on site and provides restroom facilities. No additional utilities are proposed for the shop at this time. The business averages two to three customer visits per operating day and receives approximately one to three lumber deliveries per month. Gravel parking is available near the shop and is sufficient to accommodate both customers and deliveries. No signage or outdoor lighting currently exists or is proposed. Planning staff has not received any complaints.

The owner's here if you have any questions for him. He's had this since 2021, just didn't know he needed a permit for it, and went to apply for electric service and found out that he needed this permit, so called us and That's about it.

is there treated lumber on site uh there potentially could be but there's not any currently okay any other questions of the applicant or at this time okay thank you does anybody in the public like to make public comment on this request OK, seeing none, I'll close the comment and bring it back to the board for action.
Just the treated lumber kind of question gets me. The fact that if it's a pressure treated or any kind of chemical treated lumber, on site, does that do anything as far as the packet that we put together?
As long as it's stored to a specific temperature and that's not leaching chemicals on the ground, it's elevated, so that would be fine. Yep.

I really just buy materials and then I sell it just like this.
You're not doing anything with chemicals there or anything like that. You might just be housing from time to time if a product you're working with is a treated piece of lumber.

So there's an existing structure of barn on track B, there's no septic or anything associated with that building? Correct. Okay. And then ingress and egress to track A is through the easement, is that right?
That is correct. So there's an existing 60-foot access and utility easement for tracks that adjoin this property to the north and to the east. And then we have provided a 30-foot access and utility easement for track A. Okay. Both tracks did also perk out for standard septic systems as well.
Okay. It looks like there's an asphalt drive on the, I assume that's the north side of track A? Correct. Okay. That goes to a different property? That does. Okay. Does that need to be designated as an easement?
It already lies within that 60-footer as well.
