Uh good evening. Uh today is Wednesday, November the 12th 20 uh 2025 and the time is uh 5:00 pm. The regular meeting of the city of Victorville planning commission will come to order. Madame clerk, will you kindly take the role? Commissioner Marshall here. Commissioner Thomas here. Vice Chair Messen is absent. Chair Marsh here. We have quorum.
Okay. At this time, uh, the invocation will be led by Commissioner Thomas and then the, uh, pledge of allegiance will be, uh, led by Commissioner Marshall. Heavenly Father, we come before you this evening. First of all, thanking you for your many blessings. Father, we ask that you give us the guidance that we need as we ponder, we go through these issues that come before us today. Help us make decisions that are wise, that will benefit the city long term and short term. Father, we ask blessings on the staff of this city and each and everyone in this room. In Jesus name I pray. Amen.

For uh now we have uh public comments. Now this will be the time for the public to speak on on agenda items or on issues not posted on the agenda providing those issues are within the subject matter jurisdiction of the planning commission. Those who desire to uh comment on a public hearing item may wish to reserve their remarks until that particular public hearing has been opened. Uh madame clerk, may we have our first speaker?
Yes. Our first speaker is Kelly Mlaclin on a non-aggendaized item. Good evening. Thank you for the opportunity to speak before you. My name is Kelly Mcofflin and my husband and I are here on behalf of MWF Solutions. We manufacture galvanized steel fencing products in Fontana, California. In 2021, we saw the new fire laws changing for um new home construction for the zone zero and we realized that there were very few options for fireproof fencing to meet these new requirements. So, we developed our line of galvanized steel fencing products. We have been installing these products for about two and a half years with a lot of success. We've um installed for individual homeowners, for commercial projects, and on new tracked home developments. Um, our product um is um meets all of the standards necessary to meet the the codes for zone zero. We are the only fencing product listed on Calire's approved uh fire resistant building materials list. Um our product installs very easily. There's no bolts, brackets, or screws. That might make you think that maybe our product isn't strong. It is extremely strong, much stronger than vinyl fencing. We have had our product approved in lie of masonry throughout San Diego County. And that is part of the reason we're here today. Um we will this product will be offered in Home Depot in the spring of 2026. So according to people at the California Fair Plan, come January 1st, 2026, most homeowners in high fire severity zones will be faced with
um pardoning their home doing the zone zero. They could go to Home Depot and purchase our product or they could purchase it directly from us via our website or come to our facility in Fontana to purchase the product. If a contractor wanted to purchase it, it's available at Merchants Metals um distributions uh centers out throughout California. Um we're here to have you consider our product. I did bring some brochures with photos and a link to our If you're interested, we can hand those out. Again, thank you for your consideration.
Our next speaker is Mike McLaclin on a non-aggendaized item. Thanks for the opportunity. As my wife said, we're manufacturing down in Fontana, California. We're sourcing our coil, our steel coil from California Steel Industries. that's been in business since the early 40s. Um, and the the coil we're getting is all Americanmade. There's no tariffs on any of this. It's uh has a 45 year lifespan. It's we've proven with ICC reports it's stronger than masonry walls and it reduced the cost by about 45%. What we're looking for is not only to provide it for the the existing homes in the high fire severity zones, but also we're looking for to get a an amendment to the um the masonry wall plan that exists in uh the municipal code that exists now in in Victorville for the new home construction. We're not asking to replace the masonry walls on the main arteries that you've already have established within all the existing tracks, but we're hoping to um have a replacement or have an alternative replacement for the home builders on the interiors on the front returns and the sidelines. Like I said, we're not coming with an inferior product right now. You guys are you're allowing Proto2 Wall. Proto2 Wall does not meet our standards. Proto2 Wall does not give you a 45-year written warranty. Proto2 wall has a max wind speed of 110 miles an hour. We're at 130 130 m sustains at two 200 mile gust. We have a superior product and we're locally based. We made it for California and Victorville rightfully so banned wooden vinyl fence seven years ago which we have seen all
throughout Southern California and we've gotten our product approved in all cities all counties as an alternative to masonry in these high in the high fire wind high fire zones and the wind areas that uh city of Montana has banned Chino Ontario they also don't like the vine so we're just looking for you guys to recommend an amendment to your municipal to the city council so we can pro proceed with allowing the new home construction to use. Okay, with that I'll close the public comments um and we'll move on to uh our first order of business is to approve the minutes u approve the approval of minutes for the August 13 2025 regular planning commission meeting and the September 3rd 2020 2025 adjourned uh regular meeting. of the minutes for the approval of the minutes. Okay. So now we'll go to the uh uh our next item is agenda item uh agenda item number two. a site plan and conditional use permit with a mitigated negative declaration to allow for the development of a Bertech construct uh construction, waste and demolition, waste processing facility on property zoned M1 light industrial totaling approximately 6.09 gross acres. Mr. Havi, uh would you kindly introduce that item? Thank you, Mr. Chair, members of commission. Agenda item as uh number two, as you noted, is case number PLN24-000019 is a site plan and conditional use permit uh that will allow for the development of a construction and waste demolition processing facility. Uh this project is located north of and abuing Abby Lane between East Abbey Lane and Stodder Wells Road. And for reference, this project site is uh located just east of uh the existing Victor Valley materials recovery facility here in the city of Victorville. Uh in this proposal, Bertech Waste Industries is requesting approval to allow for the development and operation of a large volume construction, demolition, and inerts processing facility uh on an approximately six acre site. As you noted, uh, this proposal includes the construction of an approximately 40,200T industrial processing facility that includes administrative offices that facilitate the recovery and processing of materials generated from construction and demolition activities. A 2,000 square foot shop building is also included on the site um that is
designed to receive and sort incoming loads of construction and demolition materials that originate at construction sites. And this includes materials such as wood, metals, plastics, drywall, brick, and inert materials such as concrete, asphalt, and dirt. A conditional use permit is required for this proposal. However, given its location uh east of and abuing the existing Bertech materials recovery facility um the lack of similar recycling facilities in the Victor Valley surrounding industrial zoning and development and uh this project's support of the city's and state solid waste diversion objectives staff supports this discretionary use as proposed and appropriate findings are included in the conditional use permit resolution uh the draft resolution I'm sorry pursuant to title 16 standards. With regards to the proposed site development, the project, as noted, includes an approximately 40,500 square foot industrial processing building designed to house sorting equipment for the recovery and processing materials, a two 2,700T office building that contains administrative offices, employee break rooms, locker rooms, and restrooms, and a 2,000 foot maintenance shop at the northeast corner of the site. Additionally, the project accommodates a future scale house and two 70 foot long truck scales. Access to the site as proposed is provided by three driveway entrances. There are two located along East Abbey Lane and the third driveway proposed off of Abbey Lane. The project meets or exceeds uh existing development standards related to parking, building height, lot coverage, and setbacks. Additionally, with regards to the industrial design guidelines, the project is designed uh to coordinate with existing industrial development in this area and it provides sufficient
perimeter landscaping and parking area landscaping throughout the site in accordance with the industrial design guidelines. The project's environmental assessment uh included an initial study and a mitigated negative declaration uh which has been prepared for the project in accordance with section 15070 of the California Environmental Quality Act and all the proposed mitigation measures have been included within the proposed conditions of approval for the project. These mitigation measures include measures for biological resources, cultural resources and tribal cultural resources. Additionally, the project received comments from the Department of Resources Recycling and Recovery or Cal Recycle and these comments are addressed accordingly within the conditional use permit resolution, specifically condition number four, which addresses the comments received from Cal Recycle. Um, with reference to condition number four within the conditional use permit resolution, uh, before you this evening is a late resolution, uh, I'm sorry, is a late memorandum updating the resolution for that item clarifying condition number four which inadvertently included incorrect references to uh, California code of regul regulations and victory municipal code which have been uh, resolved in the attached update to the planning commission. With that, staff recommends that the planning commission conduct a public hearing, receive testimony regarding the proposed project, and take the following actions. Adopt the attached mitigated negative declaration with the mitigation monitoring and rep reporting program for the project and adopt resolution number P-25-033 approving the conditional use permit portion of case number PLN 24-000019 subject to the attached conditions of approval as well as the revised condition of approval number four as discussed and finally adopt the
resolution number P-25-034 approving in the site plan portion of case number PLN24-000019 subject to the attached conditions of approval. Staff remains available for any comments you have. Thank you.
Okay. All right. Thank you. Um are there any technical questions from the planning commission uh from planning commissioners regarding this item? We'll start with uh Commissioner Thomas. So this is going to be a uh processing facility to recycle construction uh byproducts and so forth. Uh and what what processes I guess are going to take? Is it going to be just breaking material down or is is there going to be burning? What what are we doing?
Thank you, Commissioner Thomas. Um the facility is and as much as we t don't currently have a facility such as this in Victorville, uh project proponents are forced to either um take them down the hill with a with a approved uh transportation um hauler or contract with BERT to to provide that service where they're ultimately taken down the hill. Um it's my understanding that the the materials will be broken down into manageable sizes and loads where they can then be either sold off or recycled. Uh the applicants representative Mr. Gary Coons is in the audience this evening. If there are further questions on the techn technicalities of what is done with those, I would default to the project applicant.
Commissioner Thomas, you have any uh any further questions? No. Okay. And then what uh um Commissioner Marshall No further questions from my side and I don't have any qu I don't have any questions. Uh so I'll open the public hearing. Uh madame clerk, are there any requests to speak? No, we don't have any requests to speak on this item. So I will it it does look like this person wants to speak.
Good evening. I'm Gary Coons of Bertech Waste Industries. Let me give you a quick overview of really what's going on up there. First of all, the green code and cow recycle regulations require all jurisdictions to recycle at least 65% of all waste coming off construction and demolition sites. Right now, there are no those none of those facilities up in the high desert. Right now, the only thing we can do is load it in the rolloff boxes and drive it all the way down to Fontana. Very expensive. Your city council saw this as being an issue back when we were negotiating our last franchise agreement and he actually wrote into our franchise agreement that we're going to build one of these. So, we're abiding by by our agreement with the city council to do this. It's a very high-tech system for this kind of of type of material. Uh we get mixed box basically you take a rolloff box, put it out at a construction site and the contractor throws everything in it. So you got a mix of wood, metal, plastic, all sorts of stuff. So we take those rolloff boxes, bring them here, weigh them so we know what we're starting with, dump them on the tipping floor inside an enclosed building, and then we process it. It's basically the material material goes over two sets of screens that screens out differentiz components because we have different uh markets for the different kinds of like inerts like rock, concrete, gravel like that. There are certain things we can do with it that make it marketable. After that, it goes over a sort line where we have pickers who are assigned to pick wood, drywall, plastic, whatever. And the nice thing about manual laborer like that is if something changes, we say, "Okay, we don't want to pick this anymore because there's no value or or the market's changed and now we can go pick something else." So, it's a very versatile system. And right now, we're required to do 65% recycling at CND. We're confident this can easily hit that and probably exceed it by at least another 10 15%. So, it's a very high-tech system. Uh it's we've
got four or five of these already operating throughout Southern California. So, we know what we're doing. We got an entire division that does nothing but CND processing. So, I mean it's a great system. Do you have any questions based upon this? No, just just I guess followup. So you said that these materials once broken down that they would go to various uh thank you they would go out to uh various uh purchases and and will the purchases come up here to get them or do you ship them? What do you do?
We typically ship things like any plastics, metals, things like that would go across the street to the MURF and we consolidate them into those loads. Wood we'd either take somewhere else like we're working on like painted wood. you really can't do a lot with it. But we're working with some of the cement kils in the high desert and they're starting to use it as fuel. So we would haul rolloffs or even transfer trucks over to, you know, take that kind of material to them. Uh clean wood, lumber that's not painted, we probably go over to the compost facility and we grind it up in the wood chips and sell it for landscape products. So there are different definitely markets for all this stuff. Some of the fines that come off that are kind of messy that have a little bit glass and things in them. the landfill actually can use that as an alternative daily cover that we get recycling credits for. So, there's a lot of things we can do out there. We're not really breaking things apart. We're just sorting them out and then consolidating them into nice clean loads of each kind of material type.
Thank you, Mr. Cons. I appreciate it. So, we have reviewed the conditions of approval and the mitigation measures. We agree with everything is submitted and we like you to approve this project for us. Thank you. All right. Thank you. I actually have Uh, one more question for Mr. Kun. Um, in terms of uh, how many jobs will this create? It's in the report. I think it's at least 25.

All right. So we uh we have now taken action uh to approve staff's recommendation as presented on the agenda. Um, our next item is a public scoping meeting in preparation for a draft uh environmental impact report for a site plan and tenative parcel map to allow for the development of two industrial warehouse distribution buildings uh totaling approximately 1.7 million square feet on 113 acres on three undeveloped properties zoned M1 light industrial. Mr. Hadigi, uh, would you kindly introduce this item?
Mr. Howdy, if you can wait just one moment. I didn't want to interrupt you. Um, but you you indicated that we had approved staff's recommendation as presented on the agenda. It was staff's recommendations as pre presented on the agenda, but also as revised in the memo. Okay. Yes. All right. Thanks. Sorry. Thank you. Thank you. Thank you, Mr. Chair. Uh, senior planner Travis Clark is the author of this item and he will provide an overview accordingly.
Uh, yes. And thank you, Chairman Marsh. Fellow commissioners, item number three is case number PL24-000016. uh as noted by the chairman uh is a request for a public scoping meeting in preparation for the development or draft environmental impact report uh to allow for the development of two industrial warehouse buildings uh totaling approximately 1.7 million square feet on 113 acres of undeveloped property. Uh this proposal is located east of and abuing Stoddard Wells Road approximately 260 ft south of Osborne Road uh in the northernmost section of the city. Uh today staff is recommending that the planning commission conduct a public scoping meeting for this project uh to receive a project overview presentation uh with the presentation led by the applicant's uh senior environmental consultant Cindy Hoover uh to take public input regarding the project and lastly to provide the commission's own comments uh regarding potential environmental impacts or concerns. Uh the city as the lead agency under the California Environmental Quality Act has determined that a draft environmental impact report should be prepared for the project uh based on the potential for the development to cause adverse environmental effects. Uh the city issued a notice of preparation on October 24th, 2025 uh to notify and solicit comments and suggestions uh regarding the preparation of the draft environmental impact report and to provide agencies and interested or affected members of the public a better understanding of the project. Uh with that uh I will return it back to the planning commission. Uh should the commission choose uh the applicants environmental consultant is prepared to make a presentation uh on the proposal. uh and to provide an overview of the environmental review process. Commissioner Thomas, uh I believe you said that you would bring uh someone forth to uh to discuss what you know what this is. Uh that is correct. Um the uh applicants environmental consultant is available to do a presentation for you should the planning commission choose to hear. Yeah, that'd be good. Yeah, if we can go ahead, we can look at that presentation. that presentation.
Good evening. Thank you commissioners for allowing me to be here tonight um to conduct the scoping meeting for the Inland Empire North Logistics Center Victorville project um also known as NLC Victorville. Um a brief over overview of my presentation and the agenda for the scoping meeting. Um, we'll go over the purpose of the scoping meeting, a bit about the proposed project and the environmental document, and then the commenting process. My name is Cindy Hoover and I'm here on behalf of Due. We're an environmental consultant that's preparing the environmental documents and studies for the NLC project. Um Dudek is working under the guidance of the city of Victorville who is the lead SQA agency for the ANLC project and um the project applicant is FGFW4 LLC um represented by Synergy Consulting. The main purpose of the scoping meeting is to provide information on the proposed project, outline the overall SQA process um that the project will follow, and receive scoping comments on environmental issues that should be further analyzed in the environmental document under SQA. The California Environmental Quality Act um was adopted in 1970. It emphasizes public participation and requires publicized environmental information and disclosure. A lead agency is required to conduct a scoping meeting when they have determined an environmental impact report would be required for the proposed project and as um discussed that was determined to be the appropriate document for this project. The purpose of the scoping meeting is to discuss the scope and contents of the
environmental impact report. Um this meeting is not a hearing. Um and no decision should be made tonight. It'sformational only and um an opportunity to provide input on the environmental analysis. Um the scoping comments can be provided either orally or in writing to the city um for consideration in the preparation of the EIR. The project site is located on the west side of Interstate 5, um, east of Stoddard Wells Road, uh, approximately 2.3 miles north of Dante Road and 1.8 miles south of the Stoddard Wells Road and Quarry Road junction. Um, and access to the project site would be taken from um, I-15 at the Stoddard Wells Road. Um, coming from south at Stoddard Wells Road or coming from the north at the Corey Road exit. The site um as discussed is approximately 113 acres. Um it is bounded by I-15 and Stoddard Wells Road. It's currently vacant and undeveloped and is zoned M1 light industrial. The project proposes the construction and operation of two industrial warehouse buildings. You're going to hear this a couple times. I apologize. Um totaling approximately 1.66 million square feet um or 1.7 as Travis discussed. Um the project also proposes roadway improvements to Stoddard Wells Road and construction of utility and storm water infrastructure. As noted previously, the project site
has a land use and zoning designation of light industrial. The project would require the approval of the site plan for the construction and operation of an approximately 1.66 66 million square foot industrial warehouse facility including the associated infrastructure and roadway improvements. Uh certification of the EIR uh the appropriate SQA findings and the mitigation monitoring and reporting program that would be required if mitigation measures are um adopted. Additionally, the project may require permits from the California Department of Fish and Wildlife Regional Water Quality Control Board and the Mojave Desert Air Quality Management District. Now that you know a little bit about the project, I'll move on to discuss more about the purpose of SQA and the process um being followed for this project. SQA informs decision makers and the public of the project's potential environmental effects and describes ways in which feasible mitigation or alternatives will be incorporated to avoid or reduce impacts. The purpose of SQA is to also increase public understanding of the project and the ability to participate in the environmental review process. On this slide, we have a very simple flowchart flow chart showing the overall uh environmental impact report process. Um an EIR is the highest level of environmental review under SQA and that is what's being completed for this project. As you can see, we are at the very beginning phases of the long environmental review process. Uh once the scoping process is complete, DUDK will incorporate any information received during this process into the draft EIR. And the draft EIR will circulate for a 45day public review period. Any comments received on the EIR will be responded to and provided in the final EIR, which is sent to all
commenting agencies and interested parties. The project will then go before the planning commission for a final decision and a notice of determination will be filed with the county clerk and state clearing house. This slide shows the environmental issues that are anticipated to be addressed in the EIR and include in potential impacts to biological resources, air quality and greenhouse gas emissions, noise, transportation and public services. Uh we are seeking comments from agencies, interested parties, and your commission um on these and other environmental issues that should be considered in the EIR. As Travis noted, a notice of prep of preparation was issued on October 24th, 2025. The NOP identifies issue areas that will be focused on in the draft DIR. The NOP circulates for public re and comment until Monday, November 24th, 2025. And scoping comments can be submitted orally at this meeting or in writing. And the city encourages individuals who submit oral comments tonight to also submit their comments in writing. comments can be provided to Travis Clark at the email or address um provided on this slide which is also on the NOP document itself. That concludes my presentation. um okay at this point are there any um further questions or comments from the commission starting with we'll start with commissioner Marshall
yeah this is this is kind of a comment also a question for staff um do we have a sense of where the um the Bright Line West train station stop is going to be in relation to this and and the answer might not come tonight. It might to require a little bit of of research. I'm just curious like where the um the you know I know it's supposed to be in Apple Valley. Um but I'm wondering if um yeah I'm just wondering if if slash where the stop is going to be. And then the second part of that question is if there are any plans in discussion for developing community um or housing around um around that stop. Thank you, Commissioner Marshall. Um, it it is in fact in Apple Valley where the ultimate station will be located. Um, where it's at exactly in relation to this project. Um, we would have to probably bring back back to you for clarification. Um, it is on, of course, the opposing side of the interstate. Um, we're, yeah, I just don't know exactly where it is in connection to this particular project. Um, on the city of Victorville side within our city's limits. Um the zoning in this area is largely industrial. Uh there are some residential zoning allowances uh so for h future housing potentially on uh the southwest end of this northern portion of the city. Uh but the majority of the zoning in this area is at least in Victorville's district um is for industrial or commercial.

And being that this was a scoping um um presentation, uh I go ahead we'll go ahead and move to the next um the next uh agenda item which is number four. Um, it's a continuous request for case number P uh PLAN 23-000023, a site plan with a proposed mitigated negative declaration to allow for the development of two industrial warehouse buildings totaling approximately 174,000 square feet on two vacant M1 light industrial zone parcels totaling approximately 8.5 acres. Uh Mr. Howy uh would um introduce this item.

Uh chairman Marsh, fellow commissioners, uh yes, item number four is a continuence request for case number PL23-000023. um as noted by the chairman is a proposal to allow for the development of two industrial buildings uh totaling approximately 174,000 square feet uh for warehousing and distribution with each building comprised of 80,85 square ft of warehouse space and 6,910 ft of ancillary office space uh provided across two floors. Uh the project site is located north of and abuing the logical extension of Cactus Road and bordered by the extension of Mesa Linda Avenue on the east and Lassen Road on the west. Uh this case is being presented uh to the planning commission at this time as a continuence request. Uh during the SQL review period, uh several comments were received. Uh one from Blum Collins and Ho LLP attorneys at law uh who expressed concerns with the adequacy of the environmental document. a second from CALR uh requesting uh the AY's standards be incorporated into the traffic study and lastly comments from the California Department of Fish and Wildlife uh pertaining to the pro proposed biological mitigation measures. uh to provide staff and the applicant time to formally address the comments received and provide a response for the planning commission's review. Uh the applicant and staff have agreed to request a continuence to the December 10th uh 2025 planning commission meeting. Uh therefore, staff uh recommends that the planning commission conduct a public hearing uh receive testimony regarding the proposed project and continue the public hearing uh to the planning commission's December 10th, 2025 hearing. Uh staff is available the planning commission have any questions?

Okay, so we have uh we've we've now taken action to approve staff's recommendations as presented on the agenda. Uh we will now uh move on to our presentations u by uh commissioners and staff. And we'll start with uh Commissioner Thomas. I just uh again want to uh continue to applaud uh staff and in preparing reports and so forth and uh appreciate all that you do. The uh things that have been going on in the city are commendable. I mean the uh Halloween celebrations and so forth, you know, were very nice. So, I appreciate living in a city where there's a feeling of community. So, uh I thank our council and all of you for making those kind of things possible. U and uh that concludes my remarks.

Uh, yes. Thank you, Mr. Chair. Two small items. Um, on December 6, Saturday, December 6th, the city is hosting the winter festival and treelighting ceremony. Uh, the winter festival is from 10:00 a.m. to 400 p.m. It includes snow snow play, ice gliding, kids activities, and vendors. And later that evening, the treelighting ceremony takes place from 5:00 pm to 8:00 pm. Uh they will be there will be visits with Santa. Some of those same rides and and ice gliding may still be available um as well as lighting of the tree. So that is uh Saturday, December 6th here at city hall. And one item to update the planning commission on uh with the recent um uncertainties surrounding the supplemental nutrition assistance program or SNAP benefits um from the federal government, the city did provide an updated list of available local food resources to assist Victorville families. Um the city also awarded additional CDBG funding to High Desert Second Chance, which is the High Desert's Regional Food Collaborative. um those food resources. If um you're wondering, it's vivv.c cityfoodresources and it lists all the available vendors um that are providing uh food to those in need within the city of Victorville. Nothing else to report.
