Yes, we are, Your Honor. And again, Mr. Michael Neary is here as well. We are ready to proceed on this one. This has been a long-going one. We've had an opportunity to speak with Mr. Neary this morning, and I'll let him speak for himself, but at least to give Your Honor, we will be requesting fines be put in place. However, based on what Mr. Neary has discussed with us, we would not want any fines to start until july 1st um because i believe mr neri is now working with a contractor to get everything corrected and um so we want to give him we don't want to keep you know continuing but at the same time we want to give if it's i think we're closer to resolution finally and through a through compliance it's probably helpful okay sorry

1:56 – 2:21Speaker 2

Yes. I apologize. Normally I have it in my case.

2:23Speaker 5

Oh, sorry about that.

2:37Speaker 3

Your Honor, I can speak to brief testimony.

2:42Speaker 4

Basically, this was continued. Can you identify yourself for the record?

2:45 – 3:36Speaker 3

James Davis, supervisor of community resource officers. This has been continued multiple times. The last hearing, myself and CRO Brown both brought Mr. Neary to permitting, tried to work out the details with permitting. Since that time, as of this morning, our last conversation with Mr. Neary was that he is entering into a contract with a an actual contractor for me would not allow him to get the permit because he did not qualify as owner builder. At this time the House remains in the same condition. It hasn't worsened but it still remains an unsafe property in this concludes my testimony.

3:38Speaker 5

Mister neary do you have any questions of officer Davis. The city wish to present anything further.

3:46 – 3:58Speaker 4

Uh, the only thing, uh, does the city have a recommendation for the amounts of fines, uh, that is seeking here today? Sorry, what's the recommendation of the amount of fine?

3:58Speaker 1

Uh, when 50, $150.

4:03 – 4:28Speaker 4

And based on the discussion with Mr. Neary and his efforts to bring the property to compliance, when is the property, what is the date that we are seeking to start in the imposition of fines? July 1st. Okay. So our compliance date would be June 30th, just for the order, but the fines would not start until July 1st is our request, Your Honor.

4:29 – 6:18Speaker 5

All right. Any questions based on that, Mr. Neary? Is there anything you'd like to say? I know you do. All right. Uh, then I will conclude this hearing and enter the following order based on the sworn testimony evidence presented. I find that the respondent has not brought the property into compliance as previously ordered on October 8th, 2025 for the violation of chapter 88 building regulations, section 3.2 responsibilities for residential properties. structures, vacant buildings, vacate structures, and vacant or unapproved lots of the city code of ordinances. A fine is hereby imposed in the amount of $150 per day beginning on July 1, 2026, and terminating on the day the property is found to be in compliance by the code enforcement officer. In determining the amount of the fine, I have considered one gravity of the violation two any actions taken by the violator to correct the violation and three any previous violations committed by the violator a certified copy of this order shall be recorded in the public records of sarasota county florida and thereafter shall constitute a lien against the subject property and upon any other real or personal property owned by the respondent that concludes this hearing thank you mr neary i hope I hope I don't see you in July. Okay, so there's nothing else on the docket for today. Our next special magistrate hearing is July 1st, 2026 at 10 a.m. If there's nothing else to discuss, we are adjourned. Thank you all.
