some revenue lines that are overperforming um but they've just recently billed so it was prior i submitted this paperwork prior to that knowledge so okay um is that something we don't have to do it now but maybe between now and the regular meeting could we say where the 100 000 is specifically coming from

Well, right now, as the schedule states, it's coming from the appropriated fund balance. That's the revenue line.

Yeah, again, so the hopes are that we'll never tap that based on what I'm seeing as the current billing going out should overperform the existing budget line. yeah i think you follow what i'm saying here um and then uh for the consultant services ambulance billing can you just give us a high level introduction to what that is that's to cover the um ambulance billing line right so that that's basically the result of a um oversight in the budgetary process unfortunately Um, we had a consultant services line that was been zero for years, but there was a, um, 0.81 account that went through committee. Unfortunately should have been picked up on my part. I have to own it. Um, so unfortunately.

So this is an anticipated expense. It is.

It's something that's just there, yes.

So looking at the supporting documents, section two references the property review committee. I was just curious when that committee met.

I don't know.

The only reason I'm asking is because I'm supposed to be on that committee and I wasn't aware of a meeting being held to review these properties.

So I think when I wrote the ordinance, I followed the code. I'm not sure if everyone else followed the code, but I mean, I just recited the procedure and the code. So I thought that the property review committee had met to discuss those.

Because this was done by auction method, would that negate the need for the property review committee to meet?

So the code separates what the committee does in order to determine whether a parcel should be sold or not. And then the method of sale is different. For years, we've been using just the proposal method sale. I think you can tell from the prices that were received on this that we're selling them at greatly undervalued. And because of the new state law, we need to sell them at auction. at the highest price that we can get for them in order to compensate the prior owner if there is a surplus so the short answer your question is i think the property review committee might have a role before in determining whether or not a parcel should be sold. So I didn't know that the assessor in that committee did not meet. But as far as they could recommend also, I guess not taking a bid, if the bid was from a person who they might have deemed irresponsible or wanted to make some use of the property that was, you know, not consistent with the city's goals and purposes.

Is this a matter that we should update the code on then since the state law has changed? Is this something we should address?

I think we can update the code to make it clear as to how to proceed with auctions in the future, when the committee should meet, things like that. But I don't think... I thought the property committee had sort of blessed these sales. If it didn't, I'm sorry. I mean, I put that in the ordinance because I thought they had followed that procedure. I don't think it would make a big difference, but if it does to you, then you're free to vote any way you want on this ordinance. right I reached out to Sharon today she may be on vacation she did not return the call um but um she asked me if if she thought if I thought she had to be here I said no I would try to answer your questions but I didn't expect that question I'm sorry um I think all these sales are pretty good but that's up to you to make the ultimate decision Sometimes we do have a glitch in our processes, but that doesn't mean it was intentionally cutting anyone out or anything like that.

Council Member McLaren, did you have a comment?

Well, it sounds like at some point the property review committee would have needed to meet to decide which properties to put up for auction whether or not they had to be present for the auction and deciding on which bid to take is different but it does sound like somewhere along the way in the process they should have been included and whether like you said i don't whether that's

because the assessor did not that I don't know I mean this is this the city hasn't had a property auction in close to 10 years or so so I'm not sure if even the assessor is familiar with how to do it anymore I think at this point since this has gone through thus far

I think we ought to follow through with this. However, I do think we need to clarify the process in the code and within the administration so that we have a clear path forward. I think that if the code says we have a property review committee, we need to use the property review committee accordingly.

I don't think anyone disagrees with that. I just think that because it was an auction, it's basically a new procedure for this administration and it would have been for the prior administration too we just haven't done auctions in a long time also we conducted it ourselves so just are there any other questions council president council member I'm going

I could be mistaken about this, but reviewing the lists that were published before, it looked like 28 Cobblestone also was put up for auction.

It was. And there wasn't a – There was a bidder. I think that's the one where the bidder backed out.

Actually, it wasn't sold the first time. Then the bidder – actually, someone in the audience requested that it be put up again because they wanted to buy it. And then there was a successful bid for it, and then the bidder backed out.

I don't think it is actually budgeted yet, but we'll have to find the money.

You're authorizing a purchase, and we'll have to come back to you probably for the authorization for a budget transfer unless there's a fund available. Okay. But it's a really good deal.

I would agree with that. I just don't know why it can't be done at the same time, and then we can speed it along.

I, it's, I mean, we have spare parts. We, we've run strictly American low Francis, uh, since 2003 and we've started to replace them in 2019 with Rosenbauer's and Suffins but we typically have one or two apparatus for parts vehicles we typically have one sitting out in back of the garage on Campbell Ave which we use strictly for parts and they go out to auction and we replace it with the latest version okay that was one of my questions you know and we have we and we have

10 years old. Right.

And we do have a supply room. I haven't checked with the mechanic specifically, but we do have American LaPrance parts in there also.

Okay, great. And yeah, I noticed that they said... know i googled it and i asked you know what would um you know a model like this go for at this point and they said between 35 000 and 85 i think it was yeah 85. uh so it does sound like you you did got a decent price thank you pretty good thank you

Is it, are we buying it for 45,000 or for 50? 50.

I initially put a proposal in for 45 and it came back with 50.

Gotcha. I just, I think it's, you know, I know it's been an issue knowing that your backup was so old. And so I don't know how this came about, but I think it's great out-of-the-box thinking.

About two years ago, our mechanic at the time, there was another local fire department that had American La France for sale. It was more than this one. He recommended that we look into it, but we were hoping that the squad last year would have passed. We might have been able to get through, but so now, you know, a year or so, year, year and a half later, and it's wearing, and then this came available, and there's always vehicle, there's always apparatus for sale, but they could be out in the western part of the state or the western part of the country, and you really have no idea about them, but we have a pretty good, we have a pretty good feel for this one, April Park, and we myself the assistant chief and our mechanic went out you know looked it over and we thought it was a pretty good deal okay now we just passed um the resolution to purchase the new pumper correct and so delivery is like six years out from now about three oh three three yeah it's the contracts is you know third i think it's 32 or 34 months uh you know that could be extended out to supply chain and all that stuff. So, uh, our last engine two was, was seven months behind where it was supposed to be. So, you know, we're, we're probably looking the area. I would, I would imagine 36, 38 months.

So this is two big fire trucks in the last couple of months here. I'm wondering, are there other plans to purchase more trucks? Are we low on fire trucks here? Or is this just a unique situation?

Want me to give it a history of the apparatus of the Detroit Fire Department. I'll be honest with you. When I got on the fire department, we were borrowing trucks from Albany and Cohoes. We were in bad shape. In 99, 2000, Senator Bruno gave us distressed cities funds, and we purchased several apparatus within three years. From 99 to 02, we purchased a lot of our apparatus. And when you purchase them at the same time, they all... come do at the same time. So we have been since 2019, we bought a new engine, we call it a rescue or a pumper, I should say, pumper in 2019, pumper in 2020, 2021. We have five frontline pumpers, one frontline rescue squad, two frontline truck companies. So we have to keep the rotation going. So right now, our oldest frontline piece is a 2019, that's engine one up in Lansingburg. But our spares are 2000, we have a 2009, but the other ones are 2003s. So we wanna get the spares kind of bumped up too, so.

I get it, makes sense.

And the prices have doubled over the last three years or so. we used to uh we received engine six which in 2021 for 680 just around 680 000 and two years later it was 950 000 and now it's probably one million dollars one million one point one million okay well it sounds like it's a good deal Council President Council Member Favreau one last question is there a market for resale for this 2003 or is that something that you're just going to use for parts we'll probably go out to auction with it when it finally is at the end of life it's still operating but we we have uh you know it's 2003 leaks oil it's got seals leaking stuff like it's still operating but my concern is over the next three years I don't I don't think it's going to make it three years

Just echoing what everybody says. Sounds like a great deal. Just curious what we were doing with the old one.

Before Josh goes into his brief presentation, more importantly, if the council had any questions, I really want to emphasize how Josh popped in at the last minute last year. Obviously, you heard and I informed you, unfortunately, of the arrest of the prior coordinator and Josh came in while I mentioned it at the last minute and really did an amazing job with the turkey trout last year. We wanted to get him on board even sooner this year, but here he is. And I must tell you, last year, we surpassed registrations compared to prior years. We appropriated more money to our nonprofits, and we even added, if you recall, Unity House, who had the fire fund. And we're able to even provide more money to Unity House. Bringing Josh on at this period of time will allow him to hopefully get more sponsors. Pioneer became a signature sponsor last year, and that was the first time that we've had a signature sponsor for the Turkey Trot. And as you know, the Turkey Trot, this is a world-renowned event. We attract not just runners from all over the world, but we also have so many people watching. We have families that come down, and it's a true tradition here in Troy. We're very proud of our turkey trot. We thank the council last year for bringing Josh in at the last minute, and this year bringing him on board in June. We'll be able to hopefully get more sponsors, and I think we'll even see a better race. One of the things that I also like that ARE and Josh's team brought on new technology. And if you notice the packet pickup, this was my 11th race running. The packet pickup was awesome. They turned it into an event over at RPI. We also have volunteers from LaSalle and other places to help out. They brought in Fleet Feet at RPI. They had a DJ. They had a bunch of swag that we've never seen before in They've really freshened up the turkey trot. So I want to commend ARE. I'd love to hear what's in store for this year. I know a few things that we've asked for, and I really have to compliment ARE, their team. We did talk about just how ARE is really the only game in town. They do races all over the world, all over the country. But many local races from the Stockade to the former Fryhofer's Run to so many others. So I really want to thank and commend Josh and his team. And I think you'll find it's a really good partnership. So thank you again.

Thank you. I appreciate that. If you want, what I'll do is I'll just give some top level information, since I believe is my first time in front of all of you. And then certainly, I welcome absolutely any question you have. So again, my name is Josh Morales. I'm the owner and operator of AR Event Productions, Albany Running Exchange, AR Event Productions. We just, our first event just celebrated its 24th year. So we've been at it for a long time. We've been part of over 3,000 races in the past 20 plus years, and we work about 150 races a year, again, as the mayor said, around the country, and we have done a few things outside of the country. And I do want to also emphasize that while I alone am in front of you right now, I do have a great team behind me at the company. We've got five full-time employees and we have 50 part-time staff. So I've got a really big team and pretty much every event in the capital region, over 300 finishers, we are part of that event. So the workforce team challenge being the largest, we've been part of that for 13 years. Your event, I believe, is the second biggest in the area. And every event, you know, of any import, we play a large role in. as well as events again across the country. So last year, we came into your event. It was my first year as being part of it. And yeah, we did. We did get in, you know, relatively close to race day. So it really was important to us to effectively replicate the overall experience people have had, but where we could really try to tighten some things up and certainly There was definitely a learning curve also because there wasn't a tremendous amount of information we were able to get from the prior director. So in a sense, the vendor's really helpful to us. And for the most part, we pretty much brought on all the same vendors. As the mayor said, we did move packet pickup to RPI. i felt that was that was low-hanging fruit in a sense um i know in the past it had been a drive-through packet pickup the past few years and bringing it indoors allowed us a to engage people more face to face um we've been working turkey trots for 20 years all over the place and that night before packet pickup or a few days before when people see each other we found there's a lot of value there especially compared to the kind of the craziness of race morning when everyone's just running around looking for a toilet and finding parking and things like that As she said, we did work with a company who brought in a whole line of merchandise, which was really cool. I mean, they had things like stuffed turkeys with the race logo and a little t-shirt on the turkey to every other piece of merchandise imaginable. We had guest speakers, we had music playing throughout it. And we had photo opportunities. We had step and repeat banners, feather banners. So what we really wanted to do also was to increase the organic... uh social sharing of people that are really sharing the branding of your event um and i'll jump to one thing and then take any questions uh to be more effective with everyone's time um i'm not sure if you've seen the contract that we see are they aware of the contract we sent where it was like a one year or three year deal is that is that privy to everyone yes it's in the backup josh yep oh okay no problem perfect so But what I really want to highlight with that then, and then I welcome again any question, I mean, your event's been around forever. We see so much potential with it. And what we would love to do is to be able to start working on the next year, the day after the current year race ends. Last year, as I assume you're aware, we were able to donate $40,000 to the charity. So that was split ultimately three ways, not totally in thirds, but it was split three way, 15, 15, and 10. And the year before that, my understanding is it was 20,000. And I'll tell you, and I don't know if they have that financial report, but of that 40,000, we did actually take $26,000 from the event profit towards it. So we got about 13,000 donated from participants. Pioneer gave an additional $2,500 separate from their title sponsorship, from their signature sponsorship. That was earmarked strictly for the charities. And then when we saw where things landed afterwards, we were very happy to have the room to give an additional roughly $25,000 or so to effectively double the prior contribution. We would love to, A, exceed that amount given to the charities. and B, frankly, get more help from sponsors, from the participants. And our ability to do that really is predicated on having more of a runway to promote people engaging in a fundraising component, getting sponsors on board. So that's the one reason I want to emphasize why if we get more time, then we feel more comfortable that we're not going to have to provide as much support from the risk of the ultimate budget of the event.

um so that's it for that uh questions well first of all i want to thank you for stepping away from your vacation to speak to us tell my wife yeah thank you yeah i'm sure council members do we have any questions for josh Well, I think you've covered it. No. Okay. Good evening council members. My name is Frankie and I'm a resident of Troy. I just wanted to thank you for bringing resolution 72 back to the table for a veto override tonight. It's certainly disappointing that the mayor has chosen to waste time blocking public comment on something so straightforward as the definition of an emergency, but I appreciate your persistence in securing the public hearings despite the mayor's opposition. I also want to add that it raises serious concerns for me when a public servant like the mayor officially rejects the opportunity to hear from the public, from the residents they're paid to serve. It makes me think to myself, maybe their goal is not actually serving the public. And then I wonder if they're not serving the public, who are they serving themselves their cronies corporate interests. These are the types of questions that undermine Community trust in our local government and it all starts with a refusal to listen to public feedback. i'm grateful that this Council prioritizes meaningful engagement with the Community and that you understand the critical need to listen to your constituents. you're very mindful and serious about your roles as representatives and i'm continually impressed with the professionalism you bring to this work, thank you for all your efforts on our behalf it's appreciated. hi hi hi there we go hi i'm franza sweet from district six um i just wanted to echo frankie's uh sentiment that bringing the um the override the veto override of and putting this back on the table I wasn't able to be here at the special meetings because I had a, like the mayor, prior commitment. But I think that this proposed law is very important. It's good to bring us in line with the state. If that's even just that is the only thing it does, that would be good. And the fact that it would curtail some of the mayor's more extravagant emergencies, I think is a good thing. So thanks for bringing it back. Thank you, Francis.

Good evening, everyone. Is that good okay there we go. Just wanted to very quickly say Stephen maples second avenue second street just really quickly wanted to express. Some great. Just that i'm grateful for. for for the uh the two companion pieces from uh councilman campbell cohen um regarding side paths this is just very smart policy um and will and will create a incredible benefit to have that flexibility in materials uh as we build out our uh our our bikeways our pathways um all of these paths, the paths that are both for recreational use and for transportation, it will be an incredibly valuable thing to have in our toolbox. Ordinance 17, an ordinance amending chapter 141 of the Troy City Code, Councilmember Campbell-Cohen.

For folks who aren't looking at it, this ordinance does two things. It amends the building code to allow shared use paths to be made of alternative materials besides slate and concrete. And it also updates the sidewalk requirements in the city to conform with modern state and federal engineering standards, including the Americans with Disabilities Act. We've already talked about it quite a bit, so I don't want to tread old ground, but I again want to thank all of the people who provided key input to help shape this legislation, including District 6 residents, Mario Drogan, James Rath, and Kevin Carpenter, former District 4 Councilmember Aaron Vera, City Engineer Chris Marini, and Corporation Council Rick Morrissey. um it was a pleasure to put this together and it didn't take too much time i wish every issue that we took on was this so straightforward thanks very much thank you any other questions comments all in favor aye opposed seven i zero knows the ordinance passes

For folks who haven't read this one, it's a companion legislation to Ordinance 17, and what it does is it amends the streets and sidewalks code to provide basic and universally understood definitions of both multi-use paths and sidewalks, and then it universalizes those definitions for the whole city code. All of the people who were involved in the first ordinance also contributed to the second, so thank you to all of you again. um and yeah I'm just grateful for um the council support and for everybody who provided their input and expertise to get this done thank you any other comments questions all in favor all right opposed seven eyes zero knows the ordinance passes

Discussion? Council President? Council Member Favreau. I mentioned this before. My first turkey trot was in 2004. So this is a race that I've been a part of for a number of years, and I've seen it grow, and I can't wait to see it grow even further with Josh and his team at ARE. Great.

I'm just, the information that we got from Josh and in his presentation, he mentioned a three-year contract. Are we authorizing a three-year contract here or a one-year contract?

What's the time again?

So the proposal from ARE is either for a one-year contract or a three-year contract. It can be either one. With a three year contract, they're proposing that they can. They're confident that they can develop more more funds for the charitable contributions. In fact, I think they're guaranteeing an increase to 50. So I haven't really looked it over carefully yet, but generally a lot of city contracts are three years, often with extensions for two up to two one-year extensions so uh I'm not I'm not a I can go either way I just want to look at it closely uh so I think you know the proposal the attachment there is not to authorize either one but to authorize to authorize either one as as we end up choosing okay unless you want to unless you want to you know pin it down I guess you could

I think we I think we really should um I don't like leaving it up in the air and who's going to make that decision and based on what um so should we amend the you can just say it for a one or a three-year contract do you want a one-year contract or a three-year contract one you have to make an amendment Okay, we have dueling people who want to speak. I was just going to say, I think we should do it for one year, and I do think we should put it out for an RFP next year.

Council President, I have a very similar perspective. I think I have total faith in ARE, and this isn't commentary about their work, which I've only heard positive things about, but I do feel that the nature of this work is not so exclusive and proprietary that it's not possible that anyone else could want to do it and do it well I think it's very likely that they would win the bid um but um want to make sure we don't get in the habit of single source um where it where it could be competitive sure

and i am of the opinion that i think it should be a three-year so so we are a mixed mixed bag here um there is no motion on the floor uh so i guess we leave it as is unless i get a motion i'd make a motion to amend it to be a one-year contract second discussion we have a motion on the floor to make it a one-year contract um discussion on that Council President, Council Member McLaren.

When would an RFP for something like this go out? Immediately following the turkey trot? That's when I would expect it would go out, yes. Because I know they have in their paperwork, they talked about January 15th of the following year is when you need to notify them that they will be doing the one that year because they would need to start planning. So...

right I think that date might be a little bit more flexible okay that is indicated I mean they'll that by that time they'll have run the turkey Trot for two years running right uh so they'll have the most experience of anyone uh who will be in the running for an RFP so okay Council President council member struber is there any reason that we could not put out an RFP for the 2027 turkey Trot like now I don't think there's any legal reason we could not. We just normally wouldn't do that while we're working on getting this one. Sure.

I'm just thinking the timelines and, you know, if we're waiting until after the turkey trot starts to start this process, then it... Well, I mean, the turkey trot comes at the end of November.

Usually you could have an RFP done. And if you put it out right away after the turkey trot, you could have results in early January.

Okay. So you don't think that it would cut timelines too short, no matter who won it. Like they would still have the time to build up what they need.

I don't think so, but I think we can look into it further. I mean, I don't, I don't think anyone, I mean, Josh took over the turkey trot last year in September.

Hi, Francis Sweet, District 6. This is completely not political, actually. Amazingly, it's not an activist thing. I just wanted to commend the Department of Public Utilities because I have been dealing with a problem for over a month with a leak in my house that needed the main valve turned off at the street. And that turned out to be broken. And they referred me to, they did a ton of work trying to get to it. They referred me to the lead line replacement because anytime there's work, it has to, on a lead line supply line, it has to be referred out. The lead supply people jerked me around a bunch for a few weeks. finally referred me to their boss who handled everything in they called me in two days they referred it back to dpu they came today they fixed everything it was wonderful and i just wanted to thank that team so thank you francis
