Um, hello. This is Millie Pukita with uh planning staff, not planning commission, planning staff. Um, and so I come today to talk about the reszone 2025151. Applicant Michael Dury is requesting a reson which is multi- multiple use 40acre minimum to MG manufacturing general of a 160 acre parcel. Uh so this reszone request is for a property west off of Burmester Road. Um the surrounding zones include uh manufacturing general, manufacturing distribution, commercial highway, um agricultural 20 acre minimum and MU40 multi-use. Uh staff found that no there are no concerns with compliance uh with the Tilla County general plan um as the property is in the general manufacturing zone and the applicant has an access via an easement and it's 33 ft wide to the property which is highlighted in yellow. Um staff has found that in order for the reszone to comply with the land use ordinance and the tule county transportation plan, the 33 foot wide easement has to become an 84 foot wide rideway to ensure compliance. Um, in addition, the parcel looks to be subject to wetlands and staff determined from the wetland um evaluation study that was submitted by the applicant um that it was not sufficient proof um as the study also states that um only visual observations were made and it also uh states that a wetland delineation report will need to be performed as well as a geotechnical study.

Uh so given the requirement for additional reports, planning staff recommends that the proposed reason be tabled at this time until the requested information is provided for uh reason zone 2025151 application. Thank you. Question. Do you know how he proposes to get the extra footage for road? There have there has been we have discussed with the applicant. Um there is intent for the 33 foot wide easement to be dedicated. Um however, there's been some push on um dedicating the full 84 foot that the engineer of the county is requiring. Okay.

And so where is that access? It's not on the paperwork. So um the access is um on the north side of northwest no sorry northeast corner of the property. Um, so so across from Hickley Road. So yeah, really just a continuation of Hickley Road is where this easement is. So it's on where that A20 um zone. It's just that top. So who owns the property that they would need to request the extra easement from?

Um it is a different applicant that the property that's parallel to Burmeister. Um, if I'm remembering correctly, the applicant owns the top two. Um, that's as much as I know for getting the remaining requirement. Well, yeah, that road just was what concerned me. No, it does me too. Concern I have because I I saw the barbwire fence and couldn't go through it. Right. It was closed. I don't know if it's supposed to be that way all the time or not. I opened it and drove through. Oh, you dropped it and drove through.

So if you look at the um I also did the have the property on Higgley Road in the middle of Inland Port. That's light manufacturing. And uh so Higgley Road is approximately I think that's 33 feet wide all the way down. And then this would be an exact continuation uh through Burmeister through uh the the fellow that owns uh the property that I have access. His name is Scott Godfrey. Uh he owns Godfrey Trucking. It's called Burmeister 150 LLC. So that would go straight through. It was a proud achievement of ours. We been working on it like 11 months to go straight through to the 160 acre parcel with uh the heavy manufacturing. So our question was really uh even Burmeister is like 40 feet and I'm like why would we be required to do 84 feet as like a highway at the end of Higgley? Why would I mean it seemed like we our uh access easement was granted I think 1982 or something and all we did was move it from the south end of his property to the north end and then so that it would be a continuation of Higgley and then all a sudden it's this odd requirement to be so much wider. It would kind of look funny too. I don't know. I mean, everyone wants a wide road, but it's seems uh seems kind of out of place. Um, we have some additional concerns with just Higgley where the Inland Port has recently acquired that property from Arthur Higgley, you know, wanting him to um or wanting them to originally they told Trish that they would they were going to redo Higgley Road and then when they came up for a reason, they said they weren't going to touch it. So, and

we're kind of responsible to that because that's limiting some of the traffic that we can get to our property. So, that'll be something we'll have for another discussion. But our we were very proud to obtain to work with Scott Godfrey. He owns a trucking company, you know, Godfrey Trucking. He knows he said 33t would be plenty and he was happy to comply with that. So, but obviously we got to have the, you know, work with the rules, but I don't understand why it would have to be wider than what Higgley Road is, and it just be the same type of business that we're bringing. Just trying to bring more small businesses and employees.

So, I'm I I messed up. So, let me clear something up here. I should Thank you. Okay. I should have invited you up as the applicant separately to give you the time you needed. That's my fault. I opened a public hearing. Technically speaking, we're not supposed to answer questions during public hearing. So, let me do this in as a matter of formality and owning my own mistake. I'm going to refer to Michelle. Okay. You'll need to work with our office, Mr. Jury. Um, we've had talks with the Inland Port. Higgley Road will need to be an 84 foot ride wide ride of way at buildout as well. That doesn't mean 84 ft of asphalt. That's just an 84 foot wide ride of way. Um, typically you only construct about 40 ft of asphalt. There's those boundaries don't allow for that. And then it gives there will have to be some work on that. So, it'll be some imminent domain. Just depends on it happens as things develop along it. So it wouldn't happen all at once, right? Because Burmeister I think Burmeister you you might right the pavement might be 40 but that easement total and the pavement it's like 65

Burmeister we have a 100 foot right away. No no no but I mean what he's talking about yeah the pavement's 20. So yeah I mean it's like Higgley is like 20 pavement. Yeah. So even when we had to do our county road improvements on Higgley, we had to add a little bit, you know, and then we had to do the swell and all that to to come to in compliance. But we do we are going to dedicate we're going to build the road at our cost and then we're going to dedicate it.

So that was my question is why it needed to be so big and unfortunately we don't control that part of the ordinance code. Um Michelle so what the master transportation plan is what govern so how what what would be his next step then he needs to work with our office to get that okay to get all the for us I think his next step is to get those two steps

well let's let's go over those other two questions too of the because we we did have a I I have become a wetlands expert because of my other property with division of natural resources and US Army Corps of Engineers but we had a a walked through from the wetland wetland engineer didn't see any vegetation that would be determined wetlands, but I I don't understand why that's not a subdivision um requirement before you can build a reszone. I don't I'm not understand why what aquatic resources delineation report would be required for a reszone when it's really what you could actually build on the property once it once it is zoned. to ensure that you have buildable property before we rebuild.

But I was just trying to understand well number one I wanted to understand um who did the the Burmeister road improvements because it looked like they did a little patch job and to bring that into some sort of compliance but that still isn't 84t wide but they did add a little bit of asphalt.

No, I I just Thank you. I mean, it kind of sounds weird, but I I really liked him doing this. I mean, I enjoyed it. Um, for all the weird reasons to be honest with you and one of the main ones is to be in the know, right? I learned more than I ever wanted to about this stuff. Um, relevant or not. Um, but honestly, if when I was when I applied and Michelle, I don't know how I don't remember how she asked the question, but she asked something like, "What was one what's one of the biggest problems in the county?" And we talk about growth. And I said, "Growth isn't the biggest problem in the county. It's how you manage the growth that's the problem in the county." And so, I think we've done a great job. Honestly, I really do. Um it sucks sometimes because because the people um educated or not don't understand that you know the general plan is not a law. It's not a rule. It's not a code. It's a user guide, right? But they think it's the law and they don't they don't understand how the process works. And so it's been fun educating myself, educating you and through the process and educating them. So just continue the same. Again, I'm nobody special, but it was just really fun to learn and and to stay on task, right, to make things happen. We live in a great place. I moved out here 26 years ago for a three-year plan thinking, who the crap want to live in Twill County, and I'm here with my dream home, and I'm not leaving. So, I just appreciate you guys.
