City Council - Regular Meeting

Good evening. Welcome to the June 1st, 2026 meeting of the Stillwater City Council. This time I will call this meeting to order, and I'll ask that you all stand and join us in the Pledge of Allegiance. I pledge allegiance to the flag of the United States of America, and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all. All right. First up tonight under proclamations and presentations, we have a proclamation in recognition of PTSD Awareness Month. I'm going to read this proclamation and then my friend Gary Kennedy, who works with a lot of different folks, veterans and first responders here in town, is going to come up and say a few words as well about PTSD Awareness Month. Whereas post-traumatic stress disorder is a mental health condition that can develop after experiencing or witnessing traumatic events affecting veterans, first responders, survivors of violence, and many others in our community. And whereas PTSD can impact individuals and families in profound ways, often creating challenges related to mental health, relationships, employment, and overall well-being. And whereas, increasing awareness and understanding of PTSD helps reduce stigma, encourages individuals to seek support and treatment, and strengthens compassion throughout our community. And whereas, the City of Stillwater recognizes the importance of organizations and individuals who dedicate their time to supporting those affected by trauma and service-related challenges. And whereas community leaders and organizations, including Gary Kennedy and Vet Chat, continue to provide encouragement, fellowship, and support to veterans and others affected by trauma, reminding us that healing is strengthened through connection and compassion. Now, therefore, I, William Joyce, Mayor of the City of Stillwater, do hereby declare June 2026 as PTSD Awareness Month in the City of Stillwater and encourage all residents to support mental health awareness and recognize those who provide hope, healing, and support throughout our community. Okay, that's fine. My back's probably the best anyway. Good evening. Thank you again very much for having me here. My name is Gary Kennedy. I just recently moved here a year and a half ago from Texas. Don't hold it against me. But I started HEART. HEART, which is an acronym for We dealt with a lot of those in the military. I'm retired, was a police officer as well, 14 years, and in the Army for 21 years. The mayor mentioned Vet Chat. Vet Chat is a networking for veterans and first responders that may not know that they have different benefits that are out there for them. And so that's what we do. We meet the first Saturday of each month. at the American Legion, and we are trying to work on two-fold by bringing them out and also trying to boost up our membership of the younger generation of the veterans. Just real briefly, one of the things we're doing for the month of June is we're doing two fundraisers. The 8th of June is going to be at Hideaway Pizza, their buyback program. And then the 15th as well at Texas Roadhouse. These two restaurants have graciously helped us a couple of other times. We understandly at the same time greatly appreciate them too. So Heart started out in 2012. Just a brief thing. We started, I'm sorry, 14. And one of the ladies that I knew that was real good friends with my mother, they started They talked all the time. It was worse than the beauty shop. But anything, anyway, she had come to me for a year. She'd been trying to tell me, she said, I need to talk to you, Gary. I need to talk to you. So I said, all right, let me hang on for just a second. Well, three months went by, and she finally called me after like the 12th time, and she said, I need to talk to you. I said, okay, what's the deal? She says, I have my 91-year-old World War II veteran that lives next door to me. And He's dealing with a lot of problems because his wife contracted the Alzheimer's disease. In less than three months, she had passed away. Well, they had been married for 72 years. And the thing about it is I tell people that when you've been married that long, you can do more than just finish each other's sentences. So she had the Alzheimer's, passed away, didn't know what to do with it. Being your lifelong companion, he goes in the backyard and shoots himself. And so we thought at the time, how can we reach out to the older generation of World War II before they're all gone, as well as the younger generation of Desert Storm like I was. So HEART became, and now HEART is, like I said, it's an acronym. It stands for Healing Emotions Above Reasons and Thoughts. We just want to be able to get there, to work with them, to talk with them. We don't do any counseling. We just do communication. Because as you know, veterans and first responders, the last thing they want to do is talk about what's wrong with them. They don't ever want to tell their story. So the stories are out there, and that's what we're trying to do is help them out. Since moving here to Stillwater, I've jumped in. My wife will tell you I don't stay still. The police department here is one of the chaplains, and I started the vet chat, and there's a number of things. Christy Morrison is always pulling my arm to come talk on radio and TV, so I enjoy that as well. Again, thank you very much for your time.

Item 7, 7A, receive public comment regarding a request for a map amendment to rezone from multifamily intermediate to multifamily urban at the property addresses 214 and 220 South Cleveland, CC-26-96. Do we have good notice on this item?

Yes, sir. Good evening, Mayor, Vice Mayor, counselors. My name is Henry Beebleheimer and I'm with Development Services. And tonight we're talking about a map amendment for 214 or 220 South Cleveland Street. To clarify, both addresses are on there is one parcel that we just had two different address points for it. So we did both just to be cautious. They're requesting to rezone from multifamily intermediate to multifamily urban residential. Here's the aerial view of the property, which is outlined in pink. This property is an existing sorority house. It's Kappa Delta. It is proposed to remain an existing sorority house, Kappa Delta. They're proposing to expand the existing structure. So in RMI, which is the existing zoning district, there's a maximum lot coverage of 40%. The right now lot coverage is the percent of the lot that has a building on it, basically. Right now, this lot is right at 40%, so it's at the maximum lot coverage, which means in the current zoning district, you would not be allowed to expand. So when they talked to us about what are the options for expanding this, we're like, well, if you rezone to RMU, which has a lot coverage of 60%, you would be allowed to expand the structure. So this is an existing sorority house to the north, to the west, to the south, and to the east. You have existing Greek houses as well, fraternity and sorority houses. You might remember from the text memo we did earlier this year, fraternity and sorority houses are allowed in both RMI and the RMU zoning district. This property is zoned RMI, residential multifamily intermediate. As you can see on the zoning map, it's surrounded by RMI as well, with RMU to the east. There's Greek houses in both RMI and RMU, a majority of which are in the RMU zoning district. The comprehensive plan does call for moderate density residential in this whole area. A fraternity or sorority house would be considered a missing middle housing as it's between a single family house and an apartment complex. It's something, you know, in the middle, which is very appropriate in a moderate density residential comp plan. I'm open to answering questions if you have any.

Councilors, any questions for staff?

Do I recall correctly somewhere in this part of the packet that they're planning to expand into their parking lot?

Yes, sir.

So is that going to mean that they're not going to have enough parking to take care of all the residents?

They have submitted documentation to show they would have sufficient parking even if they were to remodel. It would remove some of the parking from on-site, but they have a parking lot off-site and they've leased some sites from OSU as well. Okay, thank you. Yes, sir.

Yes, sir. Tonight we're looking at a specific use permit at 211 North Perkins Road, unit number 36. That is relevant because you're not allowing a medical marijuana dispensary throughout the entire Rosewood Hill Shopping Center. It's just that unit number 36. As you can see on this aerial view, that unit is outlined in pink. This is on the east side of Perkins, about a quarter mile south of Hall of Fame. It's just at the northwest corner of that Walmart Supercenter on Perkins. Here's a street view. This is from the parking lot looking north. You can see the existing medical marijuana dispensary at that location. They're coming before you for a new specific use permit as a specific use permit is valid while the applicant is running the business at that location. The applicant of the previous specific use permit is selling the business to the applicant of the new specific use permit. I'm saying that word a lot. So that's why they're before you tonight. A new permit is required to

Yes, sir. So the address we talked about earlier was specifically relevant because there's a second medical marijuana dispensary being proposed in the same Rosewood Hill Shopping Center. This is in unit number 17, which, as you can see in this aerial view, is on the south side of that shopping center. Here's the street view looking south where you can see the existing beauty supply store This is proposed to become a medical marijuana dispensary. They would be transferring their license from a different location in Stillwater If the specific use permit were to be approved again The property is owned CS or commercial shopping which does allow for a medical marijuana dispensary with a specific use permit And I'm open to answer any questions if you have any counselors any questions

Item 7D, receive public comment for a specific use permit, SUP 2603, to install an electric message sign in the transect 5, transect zone 5 of the corridor redevelopment area planning district addressed at 311 North, oh my gosh, addressed as 311 South Duck. CC-26-99, did we have good notice on this one? Yes. Assuming that I said the address correctly. Henry.

Yes, sir. So this is a specific use permit for 311 South Duck Street to install an electric message center sign in the transect 5 zone of the corridor redevelopment area planning district. Here's an area view of the property outlined in pink. This is just south of the southeast corner of Duck and 3rd Avenue. Here's the street view looking east where you can see the existing Murray Law Firm sign, which is what we'll be discussing tonight. Here's the proposed sign. They're proposing to still have this static portion of the sign, which is on the north, not the north, the top of the sign, which is the Murray Law Firm. Then you have that four by eight electronic message center sign. The applicant has agreed to meet all the requirements in the code. There's a list of requirements for electronic message centers. For example, one would be like the auto dimming whenever it's getting darker out. All of those rules are there to protect both the drivers as well as those neighbors. One point of clarification I would add from Planning Commission, there was discussion of the waving flag, whether it would be allowed for 4th of July. At first, staff, being me, said that the waving flag would not be allowed as videos aren't allowed. I was wrong. Videos are allowed as long as they're on a loop of less than 10 seconds. So just to clarify, that would be allowed in the code.

I heard you just don't like American flags.

i i heard that too um so yeah here's the zoning map where you can see this property is zoned transect five of the quarter redevelopment area planning districts and i'm hoping to answer any questions if you have any counselors any questions just to be clear you're perfectly happy with american flags yeah i love them

I seem to recall there was something in the ordinances about the maximum percentage of the sign that can be electronic.

Yes, sir.

Are we OK on that? Do we meet that here?

Yes, sir. The maximum percent that can be an electronic message center is 40%. When you include the base in the calculations, the sign does meet that 40%. OK.

Item eight is resolutions. 8A resolution CC-2026-9, a resolution of the Stillwater City Council adopting an operating budget for the fiscal year 2026-27. We're not going to have any sort of presentation on this. We've already had our two public hearings and done all of our budget discussions. So this is just the resolution adopting the budget. Before we do that, because this is always so anticlimactic, thanks again to city finance staff, all of the city staff really, all of the directors and everybody who put so much time into making sure We have one, a balanced budget, and one that actually provides for all of the needs, or as many of the needs as we can, given the amount of revenue we collect. So I appreciate all the hard work that's gone into this, and hopefully the short time we spend on it tonight is not seen as a reflection of the importance that everyone here at the city holds for the annual budget. With a vote of five to zero, ordinance 3605 is advanced to second read. 9B is Ordinance 3607, an ordinance granting a non-exclusive cable television franchise to Seabridge Acquisition LP doing business as optimum through a cable television franchise agreement to construct, operate, and maintain a cable system in the city of Stoward, Oklahoma for the purpose of providing cable service, setting forth conditions accompanying the grant of the franchise, providing for regulation and use of the system, and the public rights of way in conjunction with the city's right-of-way ordinances, and prescribing penalties for the violation of the provisions herein. Counselors, questions or comments on this one? I had a couple that I sent to the city attorney. We had a conversation about this a little bit. I don't know about the rest of you guys, but I hear from folks every once in a while who don't appreciate the level of service they get from Optimum as a cable provider here in the city of Stillwater. And I wanted to make sure that we were kind of addressing that to the extent we can in discussion with the city attorney and just jump in and tell me when I'm wrong here. But we talked about the federal regulation of cable services. franchises and the fact that it's not just a choice we just make one time or another. There's also no other cable providers that actually serve Stillwater from this perspective. We do have other fiber providers in town that provide television service and internet service, but in terms of another cable company, there's not another one that would come in here and take this contract. There's all kinds of federal law that determines how this renewal happens. The city attorney's office has spent a lot of time negotiating this with Optimum or whichever the actual legal name is here. And a couple things that I think are important in the ordinance that they've gotten put in or have emphasize is that they're requiring to have a local office. That's not necessarily something they have to do under federal law, and I don't think they really wanted to have a local office, but thanks to the negotiating process, they will have a local office here that people can go in and actually get problems addressed. There's also some provisions in this agreement that allow for liquidated damages in the circumstance where they're not living up to the federal regulations around customer service obligations. The city does have a little bit of ability to help folks get them to follow the rules that they're supposed to be following. Appreciate the fact that the city attorney's office has done some work here to make sure that our residents are being Provided for as best as possible under these cable franchise agreements again. It's non-exclusive but there's really nobody else that's coming in and asking for one and so thankfully we do have plenty of other options again in the in the cable and fiber and wireless realms here in Stillwater. But given all that, I appreciate the fact that City Attorney's Office has worked so hard to get this thing to the point it's at. And if there's other further questions about any of that.

Well, I'll just comment that since we're talking about service levels with Optimum, I've been an Optimum customer since Cox and then Suddenlink and then Optimum, since I came to town, my service in the last 10 years I was at my last address was great. I've taken that service to my new address. It's great. I've had excellent experience with Optimum as they've continued to upgrade their system. And I see all the same stuff on Facebook all the time, but I've had a very positive experience with this particular provider.

Good. Yeah, and that's, I think, I also do hear positive comments as well, so I'm not... Certainly don't mean to say that it's always a bad service, but for folks who are concerned about it, there are provisions and there are opportunities for them to address those through the franchise agreement and through the federal regulation process. On second reading, we have ordinance 3606, an ordinance amending the employee retirement system defined contribution plan for the city of Stillwater, Oklahoma, providing retirement benefits for eligible employees of the city of Stillwater, Oklahoma, pertaining to contributions by participants, providing for employer pickup of required contributions, providing for repealer and severability. Item B is Ordinance 3608, an ordinance amending Stillwater City Code, Chapter 29, Motor Vehicles and Traffic, Article 1, in general, by creating Section 29-23, use of handheld cell phones or communication devices in a school or construction zone, repealing all ordinances to the contrary, and providing for severability.

If I may, I will just make a few comments in response to a couple of questions that came up at the last meeting. So just bringing this additional information back, there was a question about how this new section of law compares to the laws that have already been passed that prohibit texting and driving. Current texting and driving laws prohibit using a handheld electronic communication device to actually manually compose, text, or send, or read electronic text messages while the vehicle is in motion. So it does prohibit texting, while this new section further establishes that if you're in an active school zone or construction zone, you just must be hands-free. So it would prohibit even holding a cell phone or communication device in those areas. The fine for violations under both sections is the same, $100. So there's no difference in the fine. Again, this was really a stricter standard in those high-risk areas. intended to limit distracted driving and provide additional protection to vulnerable pedestrians where we want full attention of the driver. One other question that came up was a question of just citing under the state law provision or why is the city adopting this into city code? The short answer is so that officers can cite violations of city code and then prosecute them in city court. There is specific authority in the new law that authorizes the city officers to enact ordinances, excuse me, the city to enact the ordinances and officers to enforce it under those specific provisions of the new law, which is why our code provision does mirror the state law provisions, and that's what's being proposed. Again, that just promotes sufficient local enforcement and prosecution for us to have a city code provision. If there's additional questions, I'm happy to answer.

We have two big events in celebration of Independence Day this year. Join us on Thursday, July 2nd for the 250th birthday bash at Block 34. Then come to Boomer Lake Park on Friday, July 3rd for our annual fireworks show. That leaves July 4th open for a full day of Saturday celebration with friends and family. As the temperatures get warmer, we encourage residents to utilize our many parks and two water play areas. Flash pads in the Boomer Lake Park and Southern Woods Park are now open daily from 10 a.m. to 8 p.m., They are free to use and are only closed during times of inclement weather and maintenance. And I will say Southern Woods splash pad was packed on my way here today. While we're out enjoying the parks, let's remember to do our part to keep them clean and safe by using the trash bins. Grab your sunscreen, bring the kids, and let's splash into the summer.

Among the many items on the ballot, this primary election includes choosing candidates for governor, lieutenant governor, state senators and representatives, U.S. representatives, and an open U.S. Senate seat. We encourage every eligible voter to get involved in the civic process, no matter what's on the ballot. It's a privilege and a right to be part of the democratic process, and you can vote. seven to seven on election day you can vote eight to six thursday and friday uh before and on saturday i think it's eight to two at the payne county expo center yes early voting expo center this year different place for early voting in payne county and also cushing right in cushing and cushing at the chamber of commerce one of those same times and anybody can vote like if i'm in cushing i can get on there and vote yes you can i don't have to i'll have all the ballots for the county council harden

With all the rain we've been having, our lawns and weeds are growing fast. We'd like to remind Stillwater residents to regularly mow their properties. By doing so, it will lessen fire hazards when vegetation dries out in the summer months, unfortunately. It reduces the amount of snakes, rodents, and insects taking up residence in your homes, increases visibility for drivers and pedestrians, and ultimately boasts community pride and property values. So please mow your lawns.

I have the same. We got a decent amount of rain over the last couple weeks, and so the yards grew quick. Everyone's invited to come enjoy free food and drinks, games, prizes, and live music. Be sure to bring lawn chairs or blankets, and bug spray wouldn't hurt either.
