Good evening everyone and welcome to the Monday, January 26, 2026 St. Charles County Council meeting on a recovering from snowmageddon chilly evening. We will start off tonight by our invocation with Pastor Michael Pope of Emanuel United Church of Christ in Weldon Springs and Council Dave Hammond will lead us in the pledge of allegiance. Michael. Oh God, with many names but who cannot be fully understood or fully known by any or all of them. We've come into your presence tonight to enter into these hallowed halls of government with a profound awareness of you, ourselves, and our neighbors. In the beginning and apart from you, nothing existed except chaos. and all our discussions, deliberations, and decisions ultimately fail without you and your blessings. [snorts] But in you, every good and perfect gift is received, flourishes, and reaches its full potential. We are a county that is often deeply divided in our beliefs, cultures, values, economics, and politics. But we know that we are better together than apart and that the sum of the whole of us is greater than the individual members that make up our diverse communities. We truly want to be united in you, standing together and working together, which is your will for us according to your prayer. Otherwise, we are easily divided and we are easily conquered and we easily fall. Therefore, we implore you, oh divine wisdom, to let us have the mind that was in Christ Jesus, who prayed for our unity and our salvation. Indeed, we belong to you, eternal and holy one, and through your Christ, we
belong to each other and learn to accept one another as equals. May we be conscious of our place in history and the roles that each of us play in building, sustaining, and advancing our lives, our families, and our communities. As you can see on the screen, Councilwoman York is joining us remotely tonight. Otherwise, we have a full house from there. Our first item tonight is conditional use permits bill 5455. There's a clock in front of Mr. Swanson that will give you three minutes in which to speak. I think we have all the regulars here tonight who understand the rules of the order. So with that, I will move on to our first speaker. Our first speaker is Arie Dino regarding employee fraud, censorship, and miscellaneous. [snorts] [cough and clears throat]
Good evening, members of the county council. My name is Arie C. ACO, county public advocate. [snorts]
First of all, I'd like to say my gratitude and my thank you to the hundreds upon hundreds of snowfighters uh at the state, at the county, the municipal, and even private contractors. They are out there putting their lives uh in harm's way and doing a great deed for our community and and getting us around town and and hopefully they're still out there battling the snow. So, I want to say thank you uh especially our county snowfighters uh snow fighters. They've done an outstanding job. [clears throat] Now, when it comes to censorship, uh I've been bringing that up and I'll be bringing it up uh also in addition at uh oncoming meetings. Censorship should not be condoned or allowed at county council meetings. If you can't take the truth and the facts, then get out of the kitchen and get off the council. You can't censor somebody for stating facts and information that is has validity and has the facts to back them up. If I make a statement up here at this pod podium, you know what? If somebody disagrees and says I'm wrong and says that I may have liabled or slandered them, they can march on down to the corner at the county circuit court, pay their filing fee, and sue me. And I'll take it to a jury trial. and I'll present my facts in front of a jury, the peers, fellow residents of our county when there's especially fraud in our county government. Now, the former and former uh have been accused of misappropriation of county assets and county resources. In my opinion, that's embezzlement and it needs to be investigated. The St. Peters police were asked to step in by the county police department in lie of an internal affairs investigation and our own detectives are of our county police. Those St. Peters police, Mr. Chairman,
didn't make a recommendation to uh to our county prosecuting attorney, the county prosecuting. Are you going to stop my time? Stop his time. [clears throat] Yes, Mr. You I was going to raise a point of order. Yeah. Point of the mic. Excuse me. Point of order just about the content of the the uh speaker speech. I believe that it is violative of your own rules um in that it is specifically identifying um certain county employees whether former or current.
Okay. Can you move on without identifying? You've already I have I haven't said their names. You we we went through that last month and the month before. Got it. Let's go. So, I think there was about 5 seconds on my clock. I'll give you 50. Let's
Thank Thank you. So, the St. Peters Police Department Detective Bureau failed to present their findings to our county prosecuting attorney. I spoke to our county prosecuting attorney and he says he knows nothing about this incident. He needs to have that information to take it to the county impanled grand jury of our peers to make sure that the right charges are regardless if you're a police official or not or you have a badge or you don't. You need to be treated fairly on an even kill playing field. Both of these individuals have filed uh county merit commission appeals that are pending uh in coming months and I'll be attending those public sessions to see exactly what they were saying. are exactly why what they're appealing. Now, when it comes to fraud, if anyone in the community or anywhere else about county fraud,
your time, Mr. Please contact me. Thank you very much. Next speaker, final speaker. There you go. So, that brings us to the oral report from the county executive. Uh, Mr. uh, Mr. Chairman, I think Mike Herbert's going to do community development report to you. Excellent. It's good to see you. Hey, this is hockey people kind of weather, man. You got to love this.
This is my weather if I was still playing, but no. So, uh, good evening. I'm Michael Herbert. I'm the director of the Department of Community Development. I've been asked to give you a quick overview. There's no way I can do a quick overview of community development. There's just too much going on. But I will try. Uh, this will be a 30,000 foot view, not a 10,000 foot view to try to keep you out of the weeds a little bit. So um so the um before we dive into department's core services and functions I want to start by um introducing the department and the foundation on which we're established. We are are formally created under chapter 132 of the county code of ordinances. Uh we facilitate and support growth through effective planning um building and site regulation and code enforcement. Our mission is to help our customers navigate all relevant codes to facilitate safe orderly development and maintain community health, safety, and quality of life in unincorporated county. And then our vision is to b u emphasize balanced growth that preserves the county's character while supporting investment and economic development opportunity. So the or the department is organized by three divisions. Uh building and code enforcement who's headed up by uh division director Rick Meister. Uh development review which is headed up by uh development division division director Lee Hiller. And uh planning and zoning is headed up by division director Robert Meyers who makes a few appearances here and there during the council meetings. Um so as part of the development process uh and something the task that I take very seriously as part of my job as director is to try to help these make sure these
divisions are continuously working together to be efficient to oversee the regulatory process to work with other departments um and go through the process to make sure we're reviewing everything properly quickly uh and and and appropriately for the the process. objects and for our residents core services and functions. Uh first off for building and code enforcement they ensure uh that they're following um the ordinances of title five and title four the ordinances of St. Charles County, Missouri building services, uh providing permitting, plan review, and inspection services for construction and renovation to ensure compliance with the St. Charles County building codes. Code enforcement, address deferred maintenance and nuisance issues to ensure compliance with the property maintenance code of St. Charles County. Um, typical examples of code enforcement, again, not trying to get into the weeds here, but uh involve deferred maintenance on usually on structures and houses. Also, u unlicensed vehicles or or unworkable vehicles. Um, uh, rubbish uh and weeds and tall tall grass. Um items that are not code enforcement uh are vehicles in the right of way, um noise, things like that. That would go directly to police department. Um and also anything dealing with animals that goes to public health human services. Uh professional licensing. Uh the department administers contract and trade licensing programs including registration, verification, and compliance oversight for licensed professionals performing work within the
county. And then municipal contracts partners with u municipalities providing services in blasting, building permitting, uh damage assessments, on-site wastewater management or septic and property maintenance. Our municipal contracts currently include building permits with um Welden Spring, Augusta, and Newelli. Um uh septic services, we have 14 out of the 18 jurisdictions we we contract with. Property maintenance involves Welen Spring, Flint Hill, Augusta, and St. Paul. And uh blasting is with eight out of the 18 jurisdictions. And then we also do damage assessments as needed and dur after emergency events. So uh 25 statistics for building and code enforcement. We have just under 6,500 permit applications were reviewed. 11,211 building inspections were performed. Just under 3,500 plan reviews. Around 1,800 code enforcement complaints were received. about uh nearly 4,600 code enforcement cases that were undertaken. Uh 12,472 total code enforcement inspections were performed and just under 25,000 phone calls. Core services and functions of development review include ensuring new development meets chapters 405, 410, and 412 of the unified development ordinance as well as the design standards of St. Charles County. Um second is reviewing an instructure infrastructure capacity, storm water management and environmental
factors through insight improvement plans, subdivision plat review, erosion settlement control, land disturbance permits and the MS4 storm water quality program and then coordination with developers and other agencies to manage infrastructure impacts and protect existing communities. ities through education and special projects. I'll talk about two of the projects on the next slide. Uh but another great example would be back to the MS4 program where we work with um collaborate with the highway department, with parks department, with uh health and with the facilities to ensure um a variety of storm water pollution prevention efforts are undertaken as well as providing education and outreach to our residents. So 25 statistics for DR. It's a busy slide. I apologize. But uh what I did was I kind of grouped them as they're related. So the top row is basically subdivision improvement plans, site plans, and plat. And we had four uh subdivision improvement plans submitted, 18 subdivision improvement plan reviews, 84 commercial site plans, 16 site inspections, and 157 subdivision plat reviewed. The second row uh centers around grading and land disturbance activities. Uh we had 145 grading plans, 170 minor land disturbance permits, 31 major land disturbance permits, 552 land disturbance inspections, and 686 building permits. And that crosses over obviously with the building code enforcement division.
The third row, the middle row is all about storm water. So, uh, 54 water course projects were reviewed, 33 natural water course permits were issued, 83 detention basin reviews, um, 139 detention basin inspections, six dam projects and 20 flood studies or lowars, letters of map revision were conducted. The fourth row is about uh, enforcement. Dr. car had 59 complaint investigation cases that were opened, 30 violations that were found, and then 19 development project violations. Those that occurred while we're reviewing projects, um, and then 30 inspections to do notice to correct or not notice of violation. And then finally, the special projects. So the the division director of re development review oversees the sanitary sewer lateral emergency repair program. We work with city of St. Charles and St. Peters uh to to conduct that. Um and last year we had 12 repairs that were conducted, five in St. Charles and seven in St. Peters. Um development review also assist with the county's NID program. Um, basically we help subdivisions explore the their options for maintenance or upgrading their either their street or their sanitary sewer system to meet public standards. As part of that, we did not have any projects come to us uh open up last year. We did have two subdivisions that both approached us about upgrading their private street to public. Uh and then we gave a presentation to to one of those.
The core service and functions for planning and zoning uh ensures that new development uh meets chapters 405 and 410 of the unified development ordinance of St. Charles County. and they oversee four main tasks as part of that. First is current planning. They evaluate proposed developments and land use request including reszonings, cups, zoning enforcement, site plan, and subdivision plant review. Long range planning, they review and maintain the county master plan for long-term land use and development planning for supportable growth. flood plane regulation that follow the county's flood plane development ordinance to protect life and property, reduce disaster impacts, qualify for federal disaster assistance, and allow county property owners to participate in the National Flood Insurance Program, which helps to keep insurance rates lower across the county. And then finally, grants administration. This is basically focused on housing uh and social assistance programs as well as flood plane management uh through county funds [snorts] um state funds and federal funds. County funds examples are the community assistance board, the CAB board or the domestic violence board. Um state example is our CDBGR program which is a feed through of FEMA and then that the federal program is CDBG out of the department of HUD HUD department. So the statistics for planning and zoning um again over four 5200 plan review activities 128 flood plane development permits we had seven fireworks stands last year and
that number yes is going down because uh cities have all started permitting flood firework stands. So that has been going down over the last few years. We had uh 74 plats reviewed, 39 site plans reviewed, 14 resoning applications, and 98 zoning enforcement cases that were investigated. We also, as part of our grant management, had 60 contracts and intergovernmental agreements that the department overseas. So, it's quite a bit of work there. Um real quick I just wanted to touch on the community engagement collaboration efforts that the department under undergoes. The first is uh enhancing transparency, efficiency, accessibility and data driven decision making for elected officials and the public. Second, we encourage public participation in planning and policy uh updates. Third, we provide data, maps, uh, public facing data, maps, and resources for residents and the development community as a whole. Fourth, we utilize GIS for mapping, analysis, notification process, and informed planning decisions. Fifth is our citizen serve online portal. Um, this allows us to be paperless and provide digital permit contracting license applications as well as plan submissions, inspection, scheduling, and uh, property maintenance or code enforcement complaints, all from somebody's office or or living room, whatever works. It also provides us the ability to quickly summarize uh, permit information or violation case information when needed. Six, we uh collaborate with residents,
builders, developers, community organizations, and regional state agencies on population, housing, and transportation questions. We get a lot of those, and so we're a lot put trying to put a lot of that data together for people. Uh seven, we support multiple advisory boards and commissions. that includes the planning and zoning commission, the board of zoning adjustment, uh the building commission, and the uh commission on housing assistance, just to name a few. And then finally, uh onetop development assistance program. If you're not familiar with this, this is a pre-application meeting that we put together with members from each of the three divisions as well as uh the highway department, um parks if they're involved, um transportation planning, and public health. Uh sometimes it's designed to save applicants time and money by having a meeting up front to talk about how our process works, the requirements to be aware of so hopefully they're not trying to figure that out after the fact of submitting. So we try to glean the process a little bit cleaner as part of that. Um, we encourage any citizen or business interested in developing property in the county, the unincorporated county to take advantage of that. And that's available on our website to to check into that to schedule that. Finally, want to do a real quick update on where we're at with some of our development projects currently. The master plan 2035, as you're aware, is underway. The master plan steering committee has met four times so far and included public engagement and uh ga information gathering process. We are currently working with the consultant to create the master plan draft document and the future land use map for review and by the steering committee and then the county council in the next few
months. UD UDO update will include needed updates and language changes to tie in with the master plan planning process and expected to complete within the follow the year. CDBGDR, if you're not familiar with this, it's two 2019 flood event that damaged over 90,000 acres and 714 residential structures. So, we got a $15.8 million federal grant for the purpose of a a buyout program. um prior prior we have 27 properties that the council approved actually at the last meeting that we're moving forward with. We have another 22 that are still under review. So right now we're at 49. Um we'll see if that goes up or or down from that. Um the priorities involved in that include dam have to be damaged in the 19 flood obviously located within a floodway because that's what we're trying trying to take take it out. Principal home is is this isn't a vacation home or weekend home and then uh income qualify as part of the requirements and then court authority. Uh this is ongoing. I kind of consider this my unofficial fourth division, if you will. Um, the port authority was formed in 2019. The board was put together through 2020 and they held their first board meeting in January of 21. Um, the strategic planning process was completed in January of 22 and currently they're working on funding and staff needs as well as identifying key projects. Uh 2025 highlights include uh completing the foreign trade zone application process. Uh we're still waiting for the Fed to give us the approval on that, but uh everything looks good there. A
feasibility study is underway. We're looking at potential sites for potential development projects that could occur that the port could be assistance with. And then a ferry study group. uh we were part of a study group to looking at how can we improve and enhance the fairies that go from uh Granite Grafton to and Calhoun County. Uh so the county and the port authority were part of that. So those are some of the efforts that are underway with the port authority. So So that's the 30,000 view. Uh hopefully I didn't have to go into the weeds too far, but I'm available to answer any questions if you have any.
Who has a question? Mike, on the property management codes that we passed just recently, when are we going to be able to initiate those on uh some of the um complaints we have out there? Yeah. So, the because there's fines involved, we had to wait 30 days from approval. So, that should be by the the end of this month here. We should be ready to do it this this week. We'll start doing that. That's right. Actually, I was going to ask our highway engineer, John Lions, to come up and take a vow for his folks and and then tell us a little bit about uh about the last three days. It's all I know is it took me three times as long to to clean my driveway. And uh they I guess they had three times the work they're used to as well. So, uh, they did a super job. [applause]
Uh, well, actually, I just wanted to say, uh, things actually went really well. I hope everyone had that experience with the county roads. Um, I think this is probably one of our best responses we've had in in a long time, despite how much snow we got. I think that's a testament to the fact that we've got some good uh staff training all the new people we got on. We finally have most of our staff back. Uh we're only down a few truck drivers uh this season and I think that really showed uh this event. Um really our biggest hang-up was just the cold temperatures. Salt and chemicals weren't working that well. So everything had to be plowed off manually, so things took a little longer, but still on average we were through routes in less than 12 hours. Uh no accidents, no major breakdowns. I'm just I'm really happy with the way things went and really proud of my staff. So, um that's really all I got. Things went well. Do you feel like you've got everything done? I know like county election authority parking lot still. Are we going to clear off the rest of that? You're all looking at me like you have no idea what I'm talking about. That's
Oh, sorry. I just look at you for everything that's counted. [laughter] It looks like Chris Christine didn't I've seen show up tonight. [laughter] Yeah, I asked that question. It was It's like the one I get at home a lot. What the heck are you talking about? So, all right. Well, our staff are still out. They're still uh putting salt down. We are a little worried about some refreeze tonight, too. I suppose I'll throw that out there. Obviously, again, it's going to get cold, so you see uh some shiny roads, be careful. It's only going to be so effective. So, But luckily, we're not going to have school buses out from what Mr. Swanson's saying. So, looks like all school districts have canceled in Charles County.
So, that'll give us another day to get everything cleaned up. I'd like to say thanks to everybody for uh listening. I know you probably heard a million times, stay off the road, stay off the road. But it seems like uh the MDOT response worked a whole lot better this time than the last time. Is that fair to say? I think it was just great. I mean, we had plenty of notice. I don't think there was anyone that didn't know this storm was coming. Everyone seemed prepared. I know we had plenty of time to get roads pre-treated. Um, you know, I didn't see a lot of traffic on the roads when I was out and about those nights, so just made everything easier. Excellent. Well, great job. Thank you, Jeff. Anything else? I'm just curious if you ever have where a storm could get out away get away from you that you have you've got the contractor you could go to if you needed to.
We haven't. I mean, that's something we've talked about in the past. You know, by the time you Our routes can be kind of complicated. Um, you know, there's just so many jurisdictions and and starting and stopping points in some of the more urban areas and and frankly some rural rural roads take a while to get used to. You know, by the time we had a contractor trained on where to go, where not to go, um, we've just always felt it was best to stick with our own staff. Okay. Thank you. Yep. Thank you. All right. I don't know why we don't have anything that my office reached out and we're waiting to hear back from from the property owner's attorney. So, the the balls in their court, so to speak. Um, do you want to ask some discussions about this? Do you want to talk a little bit about what this particular project is? Maybe John, this is back to you again. Um, this is all your meeting today, man.
So, this is a uh safety improvement project for Joseph Road. Part of it, part of it is also a bridge uh replacement project. Um so safety improvements include widening uh reducing curves and you know straightening shoulders and and primarily this location where um this business is at is a extremely sharp curve that has I believe eight accidents in the last two years. So it's was on our radar as a specific location that needed to be remediated. Um, so we've moved the corner uh away from the existing intersection in order to straighten that curve so it's not so sharp. Uh, that's the primary improvement that's happening at that location. Improved sight lines and and uh all the associated safety that goes along with those improvements.
Does anybody else have any questions about this project? I'll just make a comment. I know this area very well. This is a massive safety improvement that is happening over there. Getting rid of these 90 degree turns. John and I have talked about this at length. I've talked to the property owner and everything else. We're kind of at an impass at this point. Um this project needs to move forward. It's just shy of $6 million um to get all this done and it needs to happen. So I I don't see any reason to delay this. When we talk about road improvement, road improvement, road improvement is what everybody wants. This is what needs to get done. Mr. Baker, uh, we only received one bid for a $5.2 million project. I believe it was two.

Bill number 5457, an ordinance amending ordinance number 3-157 granting conditional use permit C598 for underground limestone mining to New Frontier Mater New Frontier Materials Operations Alpha LLC property owner and applicant. Council Brazil. Uh yes, my uh point on this last time was uh they weren't driving trucks at night and so we did confirm that the uh conditions is no loading trucks after 6:00 p.m. up to 6:00 a.m. So, and they're just going underground just for more gravel. So, I don't have a problem with this.
