I will call the meeting to order and the first item is to announce the hearing procedure. We thank you for your attendance and participation. The purpose of the public hearing is to gather information from the public to help the commission formulate recommendations. In order to ensure a fair and orderly meeting where everyone can participate, the commission requests that you act respectfully to everyone in attendance and follow the public hearing procedures. The chairperson will call the public hearing item. The planning department will present the staff recommendation. Commissioners may ask questions of staff. Then there'll be a presentation by the applicant andor representatives. Commissioners may ask questions of applicants. The chairperson will open the public hearing. The chairperson will call for public comments from persons in support of the items followed by persons in opposition to the item. The applicant will have a chance for rebuttal comments and then the chairperson will public hearing. Commissioners may ask questions and discuss the item and then take action. Speakers must speak from the podium and state their name and address for the record. The chairperson reserves the right to establish a time limit for all speakers to ensure that everyone can speak. The designation of a spokesperson for groups sharing a common point of view is encouraged. All right. Then we'll call [clears throat] the first item. Um Haren Perez, planning and zoning administrator. Um item number one is going to be uh for case number CU250, The Villages, Inc. Um a request for a conditional use permit to to establish a group residence general for a maternity home. It's located at 7220 Southwest 10th Street in Mission Township. It's about 20 uh 2255 acres. Um here is the general location of the site and it's identified by the blue star. Um the proposed use they're wanting to um have this residence dedicated to serve up to six homeless adult women and their children. Up to 16 individuals would be present, a maximum of 12 residents which include um the adult uh children and children in the uterero. Four on-site staff for daily operations, no living staff, they would have 247 staffing whenever residents are present. Um they have a comprehensive support from administrator, case manager, client advocate and therapist. program uh addresses a critical community need by providing a safe and stable environment for birth and transition to independent living. While no single golden factors controlling all factors were considered in the writing of the staff report one character of the neighborhood the property is located within the city of Topeka's three mile ETJ and it's primarily surrounded by a mix of residential, agricultural and undeveloped land. This setting provides a quiet low density environment suitable for the proposed maternity home while maintaining compatibility with surrounding uses. Two, zoning uses of nearby properties.

The subject property is zone RR1. Um, it's surrounded uh properties include agricultural land to the north and south with I70 highway also bordering the south. To the east, the land is currently vacant and to the west a boarding home exists. The proposed use aligns with the zoning classification and is compatible with neighboring property uses. Three, sustainability of the property for uses to which it is restricted. The property is suitable for the proposed use as a maternity home under the RR1 zoning designation which allows this use with approve with approval of a conditional use permit. The underlying zoning will remain unchanged, ensuring that all existing zoning restrictions and standards continue to apply. Four, extent to which the change may negatively impact surrounding properties. The proposed maternity home is expected to have minimal impact on surrounding properties. All existing RR1 restrictions remain in effect and additional conditions imposed by the conditional use permit further mitigate potential effects. length of time the the property has remained vacant as zoned. The property functioned as a single family dwelling in 1975. By 1993, it became integrated with surrounding properties manage managed by the villages inc. Six relative uh gain to the public health, safety and welfare versus hardship to uh land owner. Approval of the conditional use permit will not diminish public health, safety, or welfare. In fact, the proposed maternity home provides a significant community benefit by offering a safe, supportive environment for homeless, pregnant women and their children, helping them transition towards independent and a productive living. recommendations of professional staff. Planning staff finds the cup request reasonable and consistent with zoning regulations and the comp comprehensive plan. Eight, conformance with the comprehensive plan. The proposed conditional use permit is consistent with goals and the recommendations of the comprehensive plan. Here um we have the site plan and then we have uh some floor plans. So we have a floor plan of basement the first floor on the south side. Um and then we have the north first floor and then the second floor. So we have several bedrooms um office um and uh kitchen uh and so on so forth. Here's the vicinity map. 15 letters were sent to property owners located within 1,000 ft of the site in Shauny County and 200 feet in the city of Topeka. No responses were received. Staff recommends approval subject to the following conditions. One, the use shall be limited to 12 residents. Two, the applicant shall operate in accordance with business plan submitted on October 21, 2025. Any significant changes to the scope or nature of the business as outlined in the plan shall require an amendment to the conditional use permit. Three, all required state and local licenses, inspections, and approvals must be secured and kept current with the appropriate agencies if applicable. And that concludes uh the first item.

Uh, good evening. My name is Mark Burnhid. I'm the CEO with the Villages and um we're excited about um about getting the maternity home opened and uh and kicked off. Um this actually used to be the former office for the villages uh for many years and then we built a new office on Yurish Road, 615 Yurish Road. So this house has been vacant for a couple years now since we moved in December of 2023. Um it's a perfect use um for this house. It's sits up on a hill a little bit. Very very quiet, serene. Um we'll have six bedrooms for the six mothers and and their babies. We are not going to allow any other uh or any mothers that have any additional children. So it would just be the be the mother along with the baby um when the baby's born. The mother will be allowed to stay there up to one year after after she gives birth to the baby. And during that time, the goal, as mentioned, is to work with them to transition them into independent living. So, very excited about about getting this kicked off.

What's on the rest of the 400 acres? So up on further up the hill, we have um five residences um that were group homes. Um we are actually ending a program that we were in with the office of refugee and resettlement. So we're actually going to be looking at bringing those houses back online to house children. And we uh the villages has been there since 1969. So, as you mentioned, does sit on about 400 acres. Also, off the subject, but we also plan to be bringing back our ropes course, ropes challenger course um in the springtime.

What does that involve? Um it's going to be a series of challenges that groups go through um in the trees essentially using the ropes, uh climbing walls. Um it's not uh it's it's it's done in groups. It's not done by individuals, but in groups come out for kind of a group bonding time um and work through these work through these exercises.

Item number two is um CU2506 Kevin and Britney Taylor. A request for a conditional use permit to establish a medical care facility type 2 for in home plus care facility. It's located at 738 Northeast 43rd Street in Soldier Township and the size of the parcel is.98 acres. Here's the general location um of the site identified by the blue star. Um the proposed use it's it would be a home plus facility for up to eight residents, homelike care environment with private and semi-private rooms, shared kitchen, dining, living areas, ADA compliant bathrooms, 247 assisted living support, medication management, meals, caping laundry activities and outings coordination with health care providers. Staffing would be two full-time CMA LPNs, four full-time CNAs, two part-time staff members assigned to nights and weekends. Here is the site plan. As you can see, um they have identified um parking spots for visitor visitors um and staff as well. and also um a sign and it's um identified by the yellow rectangle um on the site plan. Here's the floor plan. Here's the vicinity map. 56 letters were sent to property owners within a thousand feet of the site in Shauny County. No responses were received. Um while no single golden factor is controlling, all factors were considered in the writing of the staff report. The

subject property is located within the three-mile ETJ of the city of Topeka and is surrounded primarily by single family residences. The neighborhood's residential character is quiet and low density, providing a compatible environment for a small home life medical care facility. The property zone are our one and all adjacent properties. So, north, south, east, and west [clears throat] are similarly zoned and used for single family residences. The proposed medical care facility type 2 is allowed in RR1 with a conditional use permit approval and is compatible with the current land uses in the surrounding areas. The 0.98 acre property contains an existing single family residence. Um, it's suitable for the proposed medical care facility type two. The proposed facility is anticipated to have minimal impact on the surrounding neighborhood. All existing RR1 zoning restrictions will continue to apply and the conditional use permit conditions include including limits to occupancy trash screening. Signage regulations and parking requirements further mitigate potential impacts. The facility will provide personalized care in a way that is compatible with a nondisruptive to um nearby residents. The property has historically been used for uh residential purposes. Its longstanding standing residential use supports compatibility with the proposed medical care facility type two as a small homelike living environment for residents. Approval of the conditional use permit would enhance public welfare by providing a safe home life a homelike setting for up to eight residents requiring assisted living services. Um planning staff finds that the cup request request re reasonable and consistent with zoning regulations and the comprehensive plan. The proposed uh cup is consistent with the goals and

recommendations of the comprehensive plan. Staff recommends approval of the request as submitted subject to the following. One, the use shall be limited to eight residents. Two, the applicant shall operate in accordance with the business plan submitted on October 24, 2025. Any significant changes to the scope or nature of the business as outlined in the plan shall require an amendment to the conditional use permit. Three, the applicant shall ensure that all trash and recycling containers are fully screened from public view at all times when not placed at the curb for collection. For signage will be limited to one 4x6 sign located on the property near the entrance of Northeast 43rd Street as shown on the site plan. The sign must comply with all applicable Shauny County sign regulations and must be removed if the business seizes operations. Five, parking shall be provided at a ratio of one space per three beds. All parking spaces must be clearly identified on the site plan. Six, all required state and local licenses, inspections, and approvals must be secured and kept current with the approp appropriate agencies if applicable. And that concludes item number two.

I don't have a presentation per se, but I'll come up here in case you guys have questions. Um me and my husband, we decided that we wanted to do this. Um it's really based on it's it's named after it's going to be called Bee's Place. It's named after my own grandma who passed. Um we took care of her in the last couple years of her life before she passed. and my mom's been um a long-term care nurse for my entire life. So, it's something that I'm really excited to do. So, do the commissioners have questions?

I'm just curious about extra parking. So, it's [cough] one parking for every three beds and there's eight beds and I'm guessing two of the parking spots will be I only saw five parking spots. Um yeah, so there's five official parking spots. You can't we can park um the driveway is very long, so we can create additional parking if needed. Um residents will not be parking any vehicles, so it would be clearly for only visitors. Um and at this time until we reach full capacity and it also depends on um what the needs of the residents are. So st there are no staff requirements for a home plus in Kansas. So depending on what the needs of the residents are, staff will fluctuate between one and two full-time staff at any given time. So

They do have to have approval by the fire the local fire district and in this case actually the fire marshall and so they have a code footprint that's been reviewed by the fire marshall and signed off on as a part of that development. So do do you have experience in geriatric care or what's your background? I do. Yeah. So I actually went to school I did my um administrator in training. Um I'm actually the head of operations for a pharmaceutical company now. So I didn't go that route but yeah I do have um prior experience in that. I've worked in geriatric uh facilities before and activities in other areas. So, so what what levels of care are you going? This is going to be independent living up to

Yep. So, it's it's very much like assisted living. It's just daily living activity. So, um anybody who needs help with something like toileting, um uh meals are going to be provided obviously. So, it's it's assisted living but in a homelike environment. They're not going to be in their own apartments. It'll all be within the same residence. So if if they're independent, will they be able to come and go or they will not be able to come and go themselves? If they'll be able to come and go as far as Yeah. Like they're not going to drive out of the driveway. [laughter] No. No. And that's something that actually is not regulated either, but that's something that I feel strongly about. I don't think that at this level of care that's appropriate. So will you be doing any memory care?

Um, I'm Kayla Traver and I live at 746 Northeast 43rd. So, I'm just two doors down from the proposed site and I just have some questions. Um, I moved to the neighborhood a couple of years ago with my family and um, we love our neighborhood. Um, the neighborhood we were part of before was loud. There were a lot of emergency vehicles coming and going. um we weren't that far removed from a business area and it um it just was not peaceful for my kids and my husband and part of the appeal of moving here was just for that peace of being in a neighborhood that is full of owner occupied homes, families. Um and I think what you want to do is a beautiful thing. I think elder care is important. Um, I just have some concerns about it plonking down in the middle of my neighborhood in terms of what kind of um, just emergency services are we going to hear coming and going? How many vehicles [clears throat] are going to be coming? What happens to our property values when there's a business so close to my home? Um, and so and also just knowing that the Seaman School District is a desirable district that at times has had housing concerns, making a business in a home that could be provided for a family. I mean, there's just questions that I have um about

wanting to do what's best for um the families of my neighborhood, for my own family, my kids. Um, and so I guess I just wanted I wanted to bring that up. Um, I think again I think what you want to do is good. I just have some concerns about it for my own neighborhood and and and my family and I felt like I needed to speak to that. Um I don't live down there, but since we've purchased the property, obviously we've been down there quite a bit, and it is a a pretty heavily trafficked road. My next door neighbors, um Kim and Tim, they they come come and go about 12 times a day. So, I'm not sure I'm not sure where they're coming and going from, but um also when you turn on to 43rd Street, there is a Dollar General there, um a gas station, and then a church across the street from that as well. So I do feel like it is while it is a residential space which is the purpose of a home plus that is why um

this type of facility facility has been put in place to really get away from the fact that um large facilities aren't in my opinion the best the best way to care for all individuals um especially if they're not ready for that level of care yet. So um as far as emergency services go I can't honestly speak to that until I begin. I can't imagine and and would hope that in the level of care we're going to be in that there's going to be a lot of emergency services. Again, these are people who need um activities of day living. They just can't live in their home anymore and they just need somebody there to support them. So, not long-term care at that point. I think that was maybe all you mentioned. Thank you very much.

As was discussed at our meeting uh just briefly last month. The way that I was anticipating this might go is that we would have that hearing in January. Um, our meeting would be January 12th in that evening. Um, we do have one item scheduled that day. Uh, it's a plat. And so, uh, we would hear that first and then move forward to the solar regulation regulations. Um, One thing that we could consider if you don't want to do it at a regularly scheduled session, we could hold a special meeting and schedule a separate meeting all together where we hear just the solar regulations so that we ensure that we're not delaying other hearings or causing a lot of havoc for the people who are coming for the plat. um that would mean taking up a second evening of your time. Um and so I wanted to get your input. Do you want to move forward on January 12th? I don't anticipate the plat, you know, as as most plats go, they're typically not controversial. This one is a a grandson moving some property lines for a property that he owns next to his grandma's. And so it, you know, it it would be a pretty quick hearing [clears throat] all in all. And the main thing would be depending on what kind of response we get for the solar regulations, we may have a hundred people show up for that and then a few people show up for the

I mean we've had some pretty big meetings in this space. So I think what we would do is just keep it here. Um we don't really know we don't really know what the response would be. We will publish notice in the paper and I will do a media release to to put it out there and we'll have stuff published on our website. But if you think about it, you know, we had I can't say how many speakers that we had. I would say we had probablyund 100 to 150 people show up for the wind and solar stuff that we did a little over a year ago. Um, but over the course of the last year, we've had several topics that have drawn in quite a few people. And what we do is we are able to seat about 40 to 45 people in here. And then we can set up the overflow and allow the lobby and have a TV going out there with it live streaming so that people can rotate in. I just feel like it's easier than going through the process of trying to find a spot not really knowing what response we'll get.

So, it's this is Susan with Greenlight Action. There's an opportunity coming up to support private property rights and energy independence in Shaunie County. Do you support local land owners having their choice to lease their for solar energy projects. And then the option was one for yes or two for no. And that was one text message that had gone out. And then the one [clears throat] that Myin had received, it was a text message with a link and then it pulled up a picture and then the header said Shaunie County supports choices for our energy future. The Shauny County Planning Commission is considering a new ordinance that would replace a total ban on solar development, which I would like to point out if you are listening, that's not accurate. We don't have a total ban. We just have a moratorum. The ban was for wind, not solar. Um, so we had a moratorum on solar, which is not a ban. Um, this is a positive step towards preserving private property rights and the choice to build responsible solar to unlock benefits for our land, farmers, and families. But the ordinance is not perfect. There are critical updates the county must make to its language to ensure it adequately enables the choices our community deserves. We are encouraging you to write to the planning commission both to thank them and to ask them to raise the acreage cap

to enable large or utility scale projects in Shauny County. Eliminate the ban on accessory battery storage so that we can supercharge the benefits of solar. Help prevent blackouts and outages and stabilize energy prices. Lower proposed setbacks to meet in industry standards and avoid ruling out good project sites. Streamline the reporting requirements for solar operators in order to eliminate red tape while still holding them accountable.
