Gaat u staan. I swear allegiance to the flag of the United States of America and to the republic before which it stands, one nation under God, indivisible, with freedom and justice for all.

17:43Speaker 1

Ja, dat mag.

17:44 – 18:19Speaker 4

Okay, I'm just going to finish the list. Commissioner Miller, present. Commissioner Kearns, present. Commissioner Kubiak, present. Commissioner Rokkebach, here. And Commissioner de la Toren, present. Thank you. And I believe that our next point is the election of the chairman of the Montecito Planning Commission. And we also added the first and second vice chairman in case there were any deviations. Zo, daar gaan we.

18:19Speaker 3

Het spijt me, wij.

18:22Speaker 4

18:30Speaker 2

Ik steun dat voorstel.

18:34 – 18:48Speaker 4

And that's why we put them all on the agenda.

18:48Speaker 2

I would like to make a proposal to nominate Karen Kearns as the first vice president.

18:55 – 19:18Speaker 4

I would like to support that proposal. Who is for? For. For. For. And for clarity, make a proposal to nominate... Commissar Rokkebach as the second vice president. Ik steun dat.

19:21Speaker 1

Wie is voor?

19:23 – 25:27Speaker 4

Wie is voor? Ik, ik, ik. Ik. Ik. Geweldig, dat was... Dat was verrassend eenvoudig. Oem, we zijn een collegiale groep. Geweldig. Uw. Okay. Don't worry. We, we, we, we, we are fine like this. I wanted to give our new member the opportunity to present himself to the committee. Of course, thank you, Ul Dante de Loreto. I am an Ul resident of Santa Barbara. I have been away for 40 years and I am happy to be back and honored to serve this community and this council. Ul Montecito is a very special community. I feel very involved in the future and I am grateful for this opportunity. Thank you. Welcome to the club. Okay, shall we move on to ex parte? So, Mr. Chairman and committee members, the next point is the status report of the agenda. I believe I understand this. Let's start with the agenda. Here we are. I have the wrong document for me. Yes, UL, can we please get the status report of the agenda? Mr. Chairman and committee members, we will continue the status report of the agenda. I only wanted to welcome the newest committee member and the change of chairman, first and second vice-chairman. UL, welcome aboard and we are looking forward to working with you. So we look at the UL status of the agenda today. We have one point on the hammer pieces and then we have one point on our standard agenda, which is a parcel limitation. And the staff is ready to present the point on the standard agenda. And then I can move on to the projection report, Mr. Chairman. Yes, please do that. Chairman and committee members, it has been a while since we have met, so I will continue the next hearing. We have moved a number of hearing data, so I want to continue that for a while, so that it is on everyone's agenda and we understand how the coming months will look regarding the committee's hearings. Our next hearing will take place on 30 September. The hearing is a special hearing and it is a workshop with the Department of Planning and Development with regard to the ministerial flow amendments that they will present in a workshop on 30 September. And that meeting starts at 9 am and lasts until 12 pm that day. That is an opportunity for the staff to present the amendment package for the ordinance to the Commission, ask questions to the staff and after that hearing is the next hearing on October 7. That hearing is appointed as the hearing for the Montecito Planning Commission to take action on the ordinance package for the ministerial power line amendments. So we have also planned a next hearing the week after, on 14 October, in case we are not ready on the 7th. There are a considerable number of amendments and changes to the ordinance, so we want to give the Commission the opportunity to take all those changes. If we run out on the 7th, we will hold a hearing on the 14th. That is not necessary. So if we are done on the 7th, we will just cancel the hearing on the 14th. So again, that is September 30th and then October 7th and October 14th. So you know, we went out for a while, but now we are going to meet afterwards. And at the end of the forecast report, Mr. Chairman, I would like to ask for a motion to cancel on October 21st. Since we have already met in the first two weeks of October, we ask to cancel the 21st and then we will replace that meeting by a meeting for the Planning Commission of the County. And then they will pick up the change package for the flow of ministerial tasks. And the reason for this order, to talk to everyone, is that there are parts of that package in the coastal zone in the Montecito Community Plan that the Montecito Planning Commission recommends to the County Council. So let's let the NPC for the County PC appear, so that they can receive the recommendations of the Montecito Planning Commission in the coastal areas. So, in advance, our next hearing will be on November 18. There are a number of things on the agenda for November 14th. There is still an adjustment of the parcel border. There is a construction according to the current design. And then there are still the changes in the order for the closeness bonus for middle income and housing for special needs on the 18th. And then we would meet again on December 16th. At this moment there is only one point planned for that date, which is a development plan for some constructions on Park Lane. Mr. Villalobos and I discussed this this morning. Usually we want to organize an annual launch for the planning commissioners. And so we can reserve that day to do that. So that's a joint launch with the county planning commission. So we're thinking of doing that on December 16th. I know it seems a bit early, but the rest of the year will go very quickly. That is decided by the prognosis report. So, Mr. Chairman, if we get a motion and then action to cancel October 21st.

25:30Speaker 2

I propose to cancel the meeting on October 21st for the above reasons. I support the proposal.

25:38 – 28:42Speaker 4

Everyone for. For. For. For. For. Thank you, Mr. Chairman and committee members. That is decided. May I ask only one question? This is in the future, during the hearing on November 18 for this EUL. Anonymous builder. Are you that? What is an as-beeld construction? Mr. Chairman and committee members, I just don't understand that language use. I got a little confused. It is that is UM. Planners jargon. So, going on, many of them. Yes, we have that. We have all of them. We will have a list of words that we will hand out to the committee members. Normally, when we say as-beeld, it means that it has already been built. So, this is a permission afterwards that is requested to legalize what has already been built. So, I don't have all the details, but that is usually what an as-beeld means. Is that not a matter of profession? No, that's not it. It is just an application that has been submitted by the applicant. And it comes before the Planning Committee because of that. So chairman and committee members, I don't have all the details in the projection report. Just architect jargon. Yes, so that's architecture, yes. So I'll let the personnel make contact, but it's probably there. Of course we'll find out. There is a request that leads to a permit and they just bring the whole thing in accordance with the rules. Okay, thank you. Of online. I don't see your hands online, but I just wanted to point out a letter that had to be in your package. It was a general letter with public comments from a Mark Bandaraga, I believe, about your FEMA cards. In fact, I'm sorry, it was about as much as FEMA cards. Apparently not. Yes, so chairman and committee members, that's on the agenda. We'll come back to that. Yes, that agenda item is for all things that you and the commissioners think are interesting for the other commissioners, such as meetings or workshops that they have attended or other information. Oum, if there's nothing, that's fine. I don't have anything.

28:42Speaker 2

I don't have anything.

28:55 – 29:18Speaker 3

I think I just want to add that the mysteries of how water moves keep surprising me while I look at where sound screens are built along the 101 and where not. So, I speak my amazement out about the mysteries of the world. We are both surprised. So, and I think our confusion will last a while. Ew.

29:25Speaker 2

Ik ben ik ben de draad kwijt.

29:27 – 30:58Speaker 4

So, for the voting, those who were absent can remain silent and then the present voters will vote. Do you want a main vote or just a local vote? I think the local vote is fine. Het spijt me.

31:14 – 33:07Speaker 4

So, let's move on to the hammer pieces. Your Excellency, thank you. The hammer pieces will be read out by me for the notaries and we will ask for public opinion and if it is not there and if none of the commissars has any questions, then we will just wait for a proposal on that. E.H.M., good, so this is a hearing on the request of the owner, Scott L. Whitman, To consider case number 26, text 19 for a time extension of 6 years from 15 September 2026 to 15 September 2032 for sale card case number 20-TRM1 and to confirm that the time extension is not conform to CEQA guidelines section 15378-B5. I have a question first. So, chairman and commissioners, for the procedure, if there is a question about this specific point, then we have to get it from the list with hammer pieces and then we would just ... The personnel is here if there are questions for them. So I think that the right way to put it is a point of order. I would like to move this to the standard agenda, please. Move it to the standard agenda, then you can ask questions and then we would ask for public input and then vote. So if it is the wish of the commission to get this from the hammerhead list, then we can do that and we just make it a standard agenda point. I would like to make a proposal to move it to the standard agenda. Yes, that does not have to be a formal proposal, but I just get the instructions from the chairman and commissioners that we get it from the hammerhead list.

33:07 – 34:15Speaker 2

Yes, so a question can be asked. My question is relatively simple and that is, is a time extension of six years a standard request or are there certain terms that are approved for different types of extensions? So chairman and commissioners, EHM, the staff will now come to the table and they can respond to that question. Can you repeat the question? Can you please repeat the question? Is an extension of six years standard or are there different standards for different extension requests? E.H.M., Commissaris Kearns, a time extension of 6 years is granted by the head of the E.H.M., the State Subdivision Card Act. E.H.M., they may request a time extension of 6 years, so I suggest that they go for the maximum to have enough time to meet the required approval requirements, E.H.M., prior to the registration of the card. So...

34:16Speaker 4

Thank you. So, Chairman and Commissars, I think the question is whether that is what is legally granted for extensions under the map law.

34:30 – 34:43Speaker 1

E.H.M. Commissar Kearns, 6 years is granted. Thank you. Okay.

34:43 – 34:59Speaker 4

Oh, pardon, excuses daarvoor. Ik wilde niet voor mijn beurt spreken. Er is dus een voorstel gedaan. Is er een tweede?

35:00Speaker 1

Ik ondersteun het voorstel.

35:04Speaker 4

Wie is voor?

35:06 – 39:05Speaker 4

Voor, voor. Dank u. And I think we can move on to the standard agenda. Thank you, chairman. While the staff is preparing, I will read it for the notaries. The following is a hearing on the request of the Tilton Family Trust, owner and applicant, to consider case number 25LLA3 and determine that the project is exempt from the California Environmental Quality Act, according to section 15183 of the CEQA guidelines of the state. Are there any spare parts with reference to this point of a commissar? I think I sometimes wander there if I understand the map well. So I really enjoyed my time on the field. Well, assuming that there are no further comments, we can continue with the presentation. Good morning, Chairman and Commissars. My name is Kevin de los Santos and I am presenting the proposed Colzen-percel border adjustment project. The project location consists of two percels on 928 and 960 Park Lane West. Both percels fall under the sun for nature control and are located in the inland part of the Montecito plan. Both percels are owned by the same owner. The project is a request for a parcel limit adjustment of 0.61 acres between parcel 1 and parcel 2. The current parcel configurations can be seen on the screen. The existing parcel 1, in red, is currently 53.89 acres large. The existing parcel 2, in blue, is currently 4.41 acres large. The only construction on parcel 1 consists of gardens, landscaping, access roads for the fire department and a chicken coop. There are no residential buildings. The existing Parseil 2 contains a family home, a built-in garage and a swimming pool. The owner of these Parseils requests the proposed border adjustment to transfer the existing gardens and landscape design of Parseil 1 to Parseil 2. A zoomed image of the affected area can be seen on the screen. Existing plot 1 is still in red. Existing plot 2 is still in blue. And the new proposed plot limit is in green. After the limit adjustment, the proposed plot will be reduced to 53.28 acres. It will transfer the gardens and landscape zone and there will be no residential buildings left. The proposed parcel 2 will be larger and will have a size of 5.02 acres. It will receive the gardens and the established area and will keep the existing family homes and additional buildings. Again, the purpose of this parcel extension is simply the transfer of the gardens and the established areas from parcel 1 to parcel 2. There will be no new construction. As discussed in the report of the staff, the project is in accordance with all relevant guidelines of the comprehensive plan, including guidelines for services, visual resources, protection of power areas and biological resources. The project complies with all applicable development standards of section 21 of the Municipal Code for Perseal Limits and it complies with the Montecito Land Use and Development Code, specific to the standards for the Resource Management Zone. And the project is exempt from environmental assessment under CEQA because it is consistent with the requirements of section 15183, projects that are consistent with an comprehensive plan or destination plan. This exemption is on the project of application because the proposed border extension is consistent with the closeness of the zone and the Montecito Community Plan. The project will not lead to new project-specific significant consequences. Bedankt. Ik heb een vraag. Heeft u een vraag?

39:05Speaker 3

Dat klopt. Ga uw gang.

39:06 – 40:39Speaker 4

Gaat u eerst maar. Kunnen we teruggaan naar de kaart? When I looked at this map, I wasn't the best at reading maps, so have a little patience with me. But I understand that a part of the area that is currently in red is being moved by the green line. But I'm a little confused about where the green line goes outside the red border, but then moves in, I call it wind direction south, although I'm not sure. It goes from the blue line to the south. And so it is a bit unclear to me, there seems to be a line that is nobody's land, or help me to understand that line. Mr. Chairman. Good question, Mr. Chairman, Commissioner, everything north above that green line becomes Perseal 1. So what this nobody's land seems to be talking about, will become Perseal 1. So that blue line on the left above the green becomes the outer Perseal border of Perseal 1. So that becomes red above the green. So, does red get a small schiereiland, say, less or more? Yes. Where that exists, there is a heritage service of Park Lane West. It gets that area, you and that part, that strip land. Okay, a heritage service for parcel 1. There is a heritage service for parcel 1, for both parcel 1 and parcel 2. There is a heritage service, a 12 meter wide heritage service that parks Lane West for access to both parcels.

40:39 – 41:24Speaker 3

Okay. My next question is, although the quantity is ground-minimum, does it change from less than 5 acres to more than 5 acres? And in my time at the Planning Commission I began to understand that round numbers in terms of surface area in Montecito sometimes have a special meaning, which means that what is possible on a plot of 5 acres is not possible on a smaller plot. Could you, in a holistic way, tell us if the transition from below 5 to above 5 will change the possible development or planning in the future?

41:26 – 41:50Speaker 4

Uh, Chairman and Commissars, good question. In this case, no, it doesn't. The minimum size of the parcel is 40 acres. And so the increase to 5 acres has no effect on future density requirements. That parcel of 5 acres can still not be subdivided into a new parcel. So it has the same density as before at 4 acres.

41:51 – 42:17Speaker 1

Yes, and to add to that, we have two legal codes here. The one that is not conform to the size, which is already too small, becomes a little bigger. The too large parcel becomes a little smaller, and that is allowed according to our code. There is no way to make 40 acres of both plots, which is the minimum. But it moves at least in the right direction and that is why it is allowed under our code.

42:20 – 43:16Speaker 4

And both cables are in the hands of the same owner. Mr. Miller, I think you can also see that plot 2 is currently being built with a large one-family home. This action does not create any new development potential in any way. So what they can do now, they can also do with this action. I think that's what you're asking for. What I don't know about this subject is that we now and then have those superficial limitations, such as, you are not allowed to have a swimming pool under X, or I know a lot, the number of chicken cages. I don't have that list in my head, but I was just curious if this was a wish to have more chickens or if that was something that was decided here. Yes, no pun intended. Really, you can see many small paths in the green area. It seems that they probably just expanded their garden and now they want to own both properties, so they want to add everything they have built to their house.

43:20 – 44:52Speaker 4

But the applicant, I have, I have a question. Improve it if I'm wrong. I have, I have a follow-up question if you don't mind. EHM, coming back to this, let's call it the northwest section of the map. I understand that we have to follow the planting, but we don't do that clearly. We actually take part of that planting in per se. One is that because of problems with the right of crossing on the road or is there another problem? It might be easier if someone can point it out. Oh, it's the part we were talking about. It's going to the left. Yes, it's that Schiereiland part over there. So it's clear that it's all continuous planting and that's the reason we're following the green line, which is very logical. I'm just not sure why we exclude that part. It was easier for me to point it out. So this is EHM, there is a heritage here. Is this what you're talking about, right? So this parcel must remain accessible for possible future development. So the way this is drawn was to ensure that the red parcel remains the heritage, so this is about where a future home would be, up here. So that's why it's drawn like this. And then there is also a heritage service for a path here. So this line is still strangely drawn to face those two problems.

44:52Speaker 1

But what if that becomes part of Perseal 1?

44:57 – 45:16Speaker 3

No. No. Repeat that again.

Correct. No inheritance, but a legal access. It is part of the own land to Park Lane.

45:34Speaker 3

There is now an inheritance because it crosses by sale 2, but it will not cross by sale 2 any longer.

45:39Speaker 4

Do you say something?

45:42Speaker 4

It will have its own legal entrance.

45:45 – 45:57Speaker 1

Yes, I think the way they have designed it is how they want to facilitate access. I understand your point, because because they own that land, they do not need registered inheritance.

45:59Speaker 3

Yes, and mortgage lenders hate inheritance, so yes, I understand why they want to clear that aspect and want a legal entry from Park Lane.

46:07 – 46:22Speaker 1

Yes, and when we did the analysis of enriching services and enriching access, that's what we looked at. Understood, okay. Just for clarity. Okay. Would the applicant like to give a presentation?

46:26 – 47:44Speaker 2

Good morning, chairman and committee members. My name is Heidi Jones from Meraki Land Use Consulting. I am happy to be here today. What you don't really see in these evidence pieces are the amazing gardens and landscape architecture. When I went to visit this site, I was under the impression of the orchards, the planting and the gardens. It is really decennia of work and love, and it is logical to combine this with the parcel of the one-family home. So, they belong to each other. So, that's actually the simplicity of it. I have here David, the exhibit with the leveling plan, of which I think it can be useful for the conversation about access. We had to show that Perseal 1 could keep access and I think this exhibit, oh no, this is it. So, you can see here, this is a kind of fictitious leveling plan, as it were, to show how a road could be adjusted and how access to Perseal 1 can remain. So that follows in the same way the line that Mr. C.U. showed, if that is useful for the context. but in essence it is a very simple CAFO limitation. I have not prepared a presentation because it is very simple, but we are here for questions and we think that the findings can be determined for approval.

47:47 – 48:20Speaker 4

Thank you. I have no further questions. Neither do I. Is there any public comment on this request? Chairman, we have no requests online. And since no one from the public is present, we have no requests for this agenda item. Now we close the public comment and move on to our own questions and consultations, if we have any further questions about the requests or the staff. Otherwise I will take a motion in consideration.

48:20 – 48:32Speaker 2

I propose to approve the findings of the staff as set by the staff. Second. Roll call.

48:42 – 49:08Speaker 4

Yes, okay, okay, main vote. Member of the committee Miller, for. Member of the committee Kearns, for. Member of the committee Rokkebach, for. Member of the committee Deller, for. And chairman Koepiek, for. Motion taken 5-0.
