Okay, good evening and welcome to the September 16th, 2026 meeting of the San Francisco Board of Appeals. President John Trusvino will be the presiding officer tonight, and he is joined by Vice President Rebecca Soroyan, Commissioner Jose Lopez, Commissioner Robin Abad Okubio, and Commissioner Lily Wong. Also present is Deputy City Attorney Jesse Minardi, who will provide the board with any needed legal advice. Note he is transitioning to another team, so he will be replaced by Deputy City Attorney Taylor Jasuski, who will be observing tonight. Welcome. Both of them will be here next week attending the hearing. At the controls is the board's legal assistant, Alec Longway, and I'm Julie Lamar, the board's executive director. We will also be joined by representatives from the city departments that will be presenting before the board this evening. We expect Javier Rivera, manager, private sector permits, San Francisco Public Works, Bureau of Street Use and Mapping. And up front, we have Maysoon Wazwaz, program officer with the Arts Commission. The board meeting guidelines are as follows. The board requests that you turn off or silence all phones and other electronic devices so they will not disturb the proceedings. No eating or drinking in the hearing room. Appellants, permanent holders, and department respondents are each given seven minutes to present their case and three minutes for rebuttal. People affiliated with these parties must include their comments within these seven or three minute periods. Members of the public who are not affiliated with the parties have up to three minutes each to address the board and no rebuttal. Time may be limited to two minutes if the agenda is long or if there are a large number of speakers. Mr. Longway, our legal assistant, will give you a verbal warning 30 seconds before your time is up. Four votes are required to grant an appeal or to modify a permit or determination. As I noted a second ago, many of the people involved in three of the items are not fully proficient in English. We will have interpreters for them. The role of the interpreters in this process is critically important. And if they are not here, if they're not able to do their job effectively, then we cannot do our jobs effectively. I just want to stress the importance of the interpreters and when they come we will proceed with that, with the portions of the item for the oath at that time for that matter. I received no financial benefit from that donation. I do not believe that that donation will impact my ability to be fair and impartial in this matter.
Okay, thank you. So at the hearing on August 12th, President Trasvini indicated that he did not see a need for further presentations. So first we need to ask, is there any public comment on this item?

Thank you, Ms. Lamar. We did have a full hearing on this matter. In fact, we continued the matter to give the Board of Supervisors the opportunity to take action on a matter that was very relevant to the topic at hand for Homestead. And the Board did act and consistent with their action. As we discussed at the last hearing, it was our intention to move to grant the appeal and revoke the permit on the basis that it was improperly issued because the tree, because the permit holder did not submit a tree protection plan. I want to make sure that my colleagues who were not here have the opportunity to either say something. Also, the other colleagues as well, we did deliberate it on a little bit. So I will yield to any of my colleagues who would either like to discuss it or, in the absence of discussing it, making a motion along the lines that I just described.
I'd feel comfortable proceeding with the motion that you described.
I share Commissioner Lopez's sentiments about moving to proceed with the motion as stated.

This is appeal number 26-037, Ji Yin versus the Arts Commission, appealing the six-month suspension of Ji Yin's street artist license. On June 29, 2026, the Arts Commission suspended Ji Yin's street artist license until December 31st, 2026, FOR ATTEMPTING VIOLENCE AGAINST ART VENDOR ZHANG YU WANG, LICENSE NUMBER 9021, ON NOVEMBER 28, 2025. THIS CONDUCT IS A VIOLATION OF THE STREET ARTIST ORDINANCE AND ITEM NUMBERS 2, 3, AND 20 OF THE CODE OF CONDUCT. THIS IS LICENSE NUMBER 10086, AND WE'LL HEAR FIRST FROM THE ARTS COMMISSION.

Thank you. All right. Hello, members of the board. My name is Mason Wazwaz. I'm a program officer with the San Francisco Arts Commission's Community Investments Program. Along with administering grants to artists, I also manage the Art Vendors Program. I've been in position for just over two months, so be kind. Joining me today is program associate Kingsley Sun, who supported the entire investigation and disciplinary process, and also our community investments director, Denise Pate, there, and our deputy director of programs, Evan Glenn, who I wasn't sure was coming. Before we get to GAIN's violation of the code of conduct, I would like to point out that it has been seven years since the last incident that brought us to this board. The agency is proud of the successful governance of the program that has produced minimal violations. We are discouraged by this recent incident as this process is a last resort and only used when absolutely necessary. I can assure you that no staff member joins the Arts Commission to discipline artists. We are here to support their work and their safe participation in the Art Render program and rely on our policies to do so. To make sure we all understand how our disciplinary procedures work, I am going to briefly go over them. Step one is the report. A report must be filed either verbally or written. Staff are prepared to help with translation or interpretation services if necessary. Step two is the investigation. Article 24 of the Police Code, a voter pass initiative which designates the program as the will of San Francisco voters, mandates that Arts Commission staff investigate the report, gather evidence, and interview named parties. The investigation cannot be referred to the police unless an art vendor files a police report. Staff cannot do this on behalf of an art vendor. While Article 24 is part of the police code, Arts Commission staff do not have police authority and cannot subpoena evidence, require witnesses to meet with staff, or demand that people turn over evidence. Investigations are completed within the capacity of the Arts Commission staff. Step three is the issuance of notice. This approved policy mandates that serious violations, including a violation of a violent or threatening nature, must move immediately to a disciplinary hearing. Next slide. The notice to artists and the artist's code of conduct govern disciplinary procedures for the program. Once accepted into the program, artists are sent the code of conduct and, by using a license, agree to abide by these policies issued pursuant to Article 24, Section 2408B that requires the Arts Commission to adopt rules and regulations governing appeals from a denial, suspension, or revocation of a street artist certificate. The Code of Conduct defines what constitutes the violation. The Notice to Street Artists defines the steps needed after confirmed evidence of a violation. The Code of Conduct was updated earlier this year, and item 19 changed to 20. However, the text is the same. The code of conduct has been in place for eight years and the notice to artists for 30 years. Both rose out of the need to address unsafe and inappropriate behavior in the program. Next slide. Step four is the public hearing at the Street Artist Committee, a subcommittee of the mayoral appointed Arts Commission. Step five is an optional rehearing process. Step six is the formal notice that triggers a possible filing with the Board of Appeals. Step five. I mean, slide five. In addition to the policies referenced here, the Arts Commission uses a racial equity lens to manage the art vendor program, which includes a high standard of language access and efforts led by staff, such as gaining a free license for vendors with the support of the Financial Justice Project.
Next slide.
The Street Artists Committee recommended a six-month suspension for Jie Yin's license 10086 at the June 23rd meeting. This was determined after statements made by the named parties and other witnesses. During the investigation, witness Xu Huaxi stated that she intervened to stop Jie Yin when she saw Yin attempting to hit Zhongyu Wang. At the June 23rd Street Artists Committee, Yin stated that she saw the conflict escalating and attempted to intervene in the physical altercation to protect her daughter. Next slide. These actions and statements made by GAN violate items 2, 3, and 20 of the code of conduct. Rushing towards a fight while yelling is a physical and verbal threat that presents an immediate danger to public health and safety. It is not respectful, courteous, nor considerate to other vendors conducting business in the market, nor to the public walking through the plaza. It interferes with customers and other artists. It also affects the atmosphere of the market and makes it unsafe for business as usual. In's action, as self-described during her interview, appellant brief, and statements at the June 23rd Street Artists' Meeting, violate these three provisions of the Code of Conduct, which requires disciplinary action, as stated in the Notice of Art to Artists. Next slide. The committee found in violation of the Street Artist Ordinance, Police Code Article 24, based on her violation of Numbers 2, 3, and 20 of the Code of Conduct. This is in accordance with Section 2408, Section A, which allows the Street Artist Committee to deny, suspend, or revoke an artist certificate after a public hearing and for a good cause shown. The Arts Commission has complied with all aspects of the program's governing legislation and believes that a six-month suspension is aligned with program policies and goals. As such, we ask that the Board of Appeals uphold the Street Artists Committee's decision to suspend GAEN's license. Next slide. And please pause. One of the victims I got beat up as well and I become victimized again by scraping my license and I have to rethink about what happened again and again. Because I don't know why the other party keeps making non-stop, unspeakable remarks. There were three hearings in total, and the other party didn't make any comments twice. And then they kept going up the tree, and kept struggling with the video. How did this video come about? Was I beaten up? I wonder why the other party keep on repeating untrue and
he or she was not here three times out of the three hearings. And then once they appear, they show a video. I have no idea where the video come from. And I have to stress again, I am the victim and I did nothing wrong. I think I will stop here. Thank you for listening.

So I think it can be done one of two ways. Either he can do translations for the whole space and then we double the time. Or if the parties are comfortable sitting near each other, because I don't know how they feel about each other, he could do simultaneous translation on the side. The simultaneous would be a little bit faster because we don't need to pause. But I think it's up to the interpretation and the parties on which one they would prefer.
I agree, and I would ask the people who need interpretation how close they can sit comfortably with each other. And if the interpreter can arrange that, if it's not possible for the interpreter to do his job all with one, then we can move to an alternative.
SPEAKER 2. I suggest that everyone who needs to be translated can come closer to the translator. If the translator is able to translate in the same voice for most of the time, it will save a lot of time. Otherwise, the suggestion just now is to ask the person speaking in English to stop after a few words. Okay, thank you.

Shall I assume that you were not part of the previous time this matter came before us? Correct. At that hearing, we ruled that there was insufficient evidence to uphold the penalties. My question to you is, of the evidence that you have presented, what is new since the time that the commission presented its evidence?
I think I was under the impression that we were doing a de novo review, which would be taking everything fresh or from today. I don't know if that's still part of it. I don't know what's actually new.
Okay, well, we do have a de novo hearing.

But my question was, what was new? Because the last time we were here, we said it was insufficient. And you've answered me that you're not in a position to be able to say one way or the other.
Sure.
OK, great. And my other question relates to the commission's presentation in writing, where it says that the Yins' actions included threatened and attempted violence. Can you describe with some specifics what the threat and attempted violence was?
My understanding is that Jie Yin, when she heard that her daughter was in a potential conflict or altercation, was running towards the altercation to intervene. And my understanding is that she had to be held back. So there's an implication that... she was perhaps going to intervene in an also violent way. And we have in our code of conduct, intervening in an altercation in any way, whether it's verbally or physically, is against our policy.
And can you point to me which code says intervening in any way is a violation? Sure.
Hold on a second. We have number two is be respectful and courteous and considerate to fellow artists. Number three, basically for all the artists that we're talking about today, we're saying that they're violating Codes 2, 3, and 20 of the Code of Conduct. Right. Okay. Number three is do not physically or verbally threaten or assault another artist or act in a way that can present an immediate danger. And then...
Well, then that gets to my question of what constituted the immediate danger?
I think rushing into a fight seems sort of immediate.
OK. And also, it's the department's position that the intention to intervene is immaterial.
Sorry, can you repeat that?
That people can intervene for all sorts of reasons. But in the department's view, the intention is immaterial.
Yeah, we're trying to look at the action.

Good evening. Welcome to the city. I have three questions. If you're not able to answer them, I certainly understand. I'll do my best. My first question was, I'm so sorry, I wasn't really clear as to why you conceded a portion of your time to Ms. Zhongyu Wang. MS. Zhongyu Wang. MS. Yes.
MS. Yeah, I think that was a decision made by my program officer or our senior program officer, Anne Truckee. And I think the idea was that Zhongyu Wang would be able to provide more context around what they experienced in this altercation escalation with regards to Jia Yin. MS. But she is not here this evening?
Who, Zhang Yimeng? No, no, the individual who said, no, the person, your program person that suggested that. They're not here, yeah. They're not here.

OK. All right. And then I also wanted to understand, so you said two months. Were you actually able to attend, I believe, the June 26 Arts Commission hearing?
There was a June 23rd hearing, and there was a July 27th hearing. I attended the July 27th hearing.
Hold on one second here. We were given a transcript from June 23rd with summaries of all the discussions. Were you able to attend that one? No. I didn't attend June 23rd. Did you have a chance to review the video of the Arts Commission discussing and deliberating about the case before today?
I didn't view that particular video. I did read the transcript.
You read the transcript, but you didn't have a chance to watch the video? Correct. OK. And then my final question is, in the artist's code of conduct. And don't get me wrong, I understand we are where we are. But the first paragraph says that a violation of these rules may result in the denial, suspension, or revocation of your license.

So it says may.
So where does the theory that intent doesn't matter or must come into play here? It's at the top of page two, the artist's code of conduct.
I'm not sure I have an answer to your question. I think I just was told that we're talking about actions specifically, but...

Sorry. Okay. Thank you for coming here. Welcome to the city. Can you explain a little bit more about the intent to run in? There's an altercation. I think human beings are naturally inclined to be interested in what's going on. So can you verbalize or explain to me a little bit more, help me understand how Jie Ying's Moving towards an incident where her daughter was involved triggers the assumption that she was violating the code of conduct.
I think it's also that she was held back. So it seemed like there was- But that's not her choice, right?
Anybody could hold her back just because.
Right. I think there was a concern that she was going to engage in the altercation.
But there was a person independent of all this that made the decision to hold her back for whatever reason, wasn't on her. And the actions of that person is the underlying factor of the assumption that she was, she needed to be, or like, sorry, just help me understand that a little bit more.
Yeah, I mean, I think my understanding is with the program that You know, no artist shouldn't be getting involved in an altercation in general. If there's concern, there's other steps they can take, like calling the park ranger or the police, as opposed to getting involved themselves. So we're also looking at that as well.
And was there consideration given that it was her daughter that was involved versus just anybody on the street? I think a mother's relationship with their daughter is a little...
I know, but I mean, we have to be sort of neutral in looking at these things, I think. I know.
I think that that's also why it's a may versus a must. So there was no consideration of relationship.
I think we were trying to stay neutral to thinking about relationships, yeah.

We have completed the testimony in this matter. First, I want to thank our interpreters for helping us with this process. And I also want to commend and thank the Arts Commission for conducting what appears to be a very effective program in the arts.
The arts are very important to San Francisco. And vendors contribute a lot to our culture and to our city.
At the beginning of this proceeding, the Arts Commission representative stated that it has been seven years since the last incident to be brought to the Board of Appeals. I think that's wonderful, and I think the board would appreciate having no docket and no matters having to come before us. But inevitably, there are disputes, and there are rights to bring matters to us.
When that happens, we review the actions that have produced a dispute and the actions of the department. In this particular case,
We told the Arts Commission that there was insufficient evidence to sustain the charges earlier. While the Commission representative states that we should forget about that and forget about the earlier proceeding. I disagree. That's why I asked the commission representative what new evidence is there. I appreciate her difficulty in being able to answer that because she is new. But the department should have been able to give us that information either collectively or in the brief as they thought about bringing these charges again.
The department has a significant burden in this case.
I won't say whether it's high or low, but it is significant.
And in my view, the department has not met its burden. And I note in the commission proceeding that the commissioners weren't sure about the evidence. And their remedy was to reduce the extent of the suspension.
But when there is doubt, the remedy is to say that the prosecutor, in this case the department, hasn't met its burden. It's not to just lower the suspension because of that doubt.
So if we don't get enough evidence, we should give the Arts Commission its responsibility. Reducing the suspension time is not a reasonable plan.
I don't hear new significant facts tonight. I did not hear new significant facts tonight.
And the principles of law that the department asks us to accept are also incorrect.
According to the department, An attempt to get involved is the same thing as participation in a violent altercation. We don't know exactly what's on, or we don't have to decide what was in Ms. Yin's mind, but we do know the testimony is that she did not reach the altercation that was already going on. She did not reach?
She didn't reach the altercation.
The department also asks us to agree with the notion that getting involved in any altercation is a violation of the code of conduct. If that were the case, then a vendor would be forced to just observe criminal conduct by a customer, a member of the public, or another vendor against an individual. There are other parts of the code, particularly Code 2, that cannot be taken as literally as presented by the Commission tonight. So in my view, I would grant the appeal.
And I see Commissioner Abad Okubiyu would like to be recognized.
Thank you, President Chasvinia. I would concur that I don't. see that the department has presented anything new. I know we're supposed to be conducting a de novo review. In fact, what I recall from our previous hearing on this matter is that in the course of that hearing, some additional evidence, videography was presented. It doesn't appear to be referenced whatsoever in the analysis presented by the commission. I'm also a little bit confused as to why the commission, I guess Ms. Trickey isn't here, would opt to give time to one of the people who are before us tonight, who's who.
He needs to interpret, so if we could take a break. Sorry.

So in any case, I am inclined, along with President Trasvina, to grant the appeal with the suspension for this case for reasons that I suspect are going to apply for the next two cases that we're hearing formally separately, but they're all embroiled in this one incident.
So today, the Arts Commission invited Ms. Wang to participate because they don't have any new evidence. From this perspective, I decided to agree with Transvenia and say that I agree with the appeal.
I do want to just state for the record that Ms. Trickey is on leave, and she did request that the hearing take place at a later date. That request was denied. Thank you for the clarification.
I'm inclined to agree with my colleagues that the motion, I'm sorry, the appeal should be granted based on the fact that we continue to have insufficient evidence to support the penalty or suspension of the artist's license. And I also am troubled by the fact that we seem to still have conflicting accounts of the event itself. I understand that it's difficult to ascertain exactly what happened, but we don't have more clarity
And finally, if there's no difference in how they're jumping in between two individuals, but there's
unequal application of the rules to those individuals. I think that's fundamentally unsound.

I recognize that it's hard to be in your role, and it sounds like you've done your best to try to use your language skills in the best of your abilities in this situation.
So, first of all, I would like to mention the commission representative and his colleagues. I know that if he can speak both languages, his participation in this matter is very meaningful.
I think I'm in the same boat as my fellow commissioners. I don't see clarity in this situation. And when I asked my question, it really felt like there was arbitrary application of the rules in the same situation.
So I agree with my colleague. I think the judgment we used this time is not consistent. It's a little unclear.
And as I was reading the briefs, the only new thing that I saw was that they were being heard again at the Arts Commission. So as I was reading the brief, the only new evidence that I saw was from the Arts Commission's own investigation. the process of the investigation.

I think this is a complicated task to investigate these matters. It's arguable whether the Arts Commission is in the best position to conduct these investigations. But I want to thank the representative this evening and everyone participating in this investigation, because I do think that it's been done thoroughly. With that being said, I do not see evidence of violence or attempted violence in the record.
Perhaps things would have been different if the person in question had not been held back. But basing that determination on the permit holder's testimony and essentially that alone, when it can be subject to any number of intentions and interpretations, I think is difficult. Based on that, I'll make a motion to grant the appeal on the basis that the evidence in the record does not support a suspension of the permit.

On June 29, 2026, the Arts Commission suspended Yingzhi Jie's street artist license until July 1, 2028 for violence against art vendor Zhang Yuwen. This is license number 9021. on November 28, 2025. This conduct is in violation of the Street Artist Ordinance and Items 2, 3, and 20 of the Code of Conduct. This is license number 188. Okay, so we will hear from the Arts Commission first. OK. Thank you, everyone. Slide 9. Yeah. OK. Before I move to appeal 26038, Ingsiger's violation of the Art Vendors Program's code of conduct, I will review the general details of the incident. On the slide are the parties involved in their actions as confirmed by witnesses. Confirmation means that a third party, not a member of the same family unit that does business together, confirm the party or action noted on the slide. Jen Fu Wei, the gentleman on the left, was part of the altercation, but the Street Artists Committee did not take action on his license in the June 23rd meeting. In the middle of the slide, Jie Yin is the mother of Yingzi Ge, and they are in a family unit that sells the same items and does business together. On the right side is Zhang Yu Wang, who submitted the incident report and is in a family unit with her husband, Xingzhi Yuan. Next slide. On the left, Zhang Yu's husband Yuan was named by Yingzi Ge and Jie Yin as an actor, which was contested by Zhang Yu Wang. No third party confirmed that he participated in the altercation. On the right are Zhang Yu Wang's son and daughter-in-law. These individuals are not in the program. and therefore are out of the Arts Commission's jurisdiction. Staff were informed by the city attorney that because Article 24 of the police code does not govern individuals without a license, only a restraining order filed by another offender would potentially impact an unlicensed individual's ability to be at the market.
Next slide.
The events took about an hour, with the initial altercation lasting about five minutes. The undisputed violations of the code of conduct are the initial physical altercation and the later verbal altercation. All parties with appeals before the board today admit that these altercations took place and their roles in them. By participating in the art vendor program, they agreed to terms of the code of conduct and by their own admission have violated these terms. Next slide. The Street Artists Committee recommended a two-year suspension for Ng Zi Ge's license 10088 at the June 23rd meeting. This was determined after statements made by named parties and other witnesses. During the investigation, Ng Zi Ge stated that she engaged in physical violence with Zhang Yu Wang. A witness, Xu Huaxi, confirmed that she saw Wang being struck by Ge. At the June 23rd Street Artists Committee meeting, Ge stated that she started the verbal interaction that turned into a physical altercation. Next slide. The actions and statements made by N'Zuga violate items 2, 3, and 20 of the Code of Conduct. Laying hands on another artist, no matter the reason, is assault and presents an immediate danger to public health and safety. Embarcadero Plaza is a high traffic area, and when a violent situation occurs, there must be a response to the impact to public safety. It's not respectful, courteous, or considerate to other vendors in the market or the public walking through the plaza. Using physical violence interferes with both customers and other artists. No customers want to exchange money or purchase items near violent altercations. No artist can manage their business or sales near a potentially escalating fight. By her own admission, Goh violated these three provisions of the Code of Conduct, which requires disciplinary action as stated in the notice to artists. Next slide. The committee voted to find Guh in violation of the Street Artist Ordinance Police Code Article 24 based on her violation of numbers 2, 3, and 20 of the Code of Conduct. This is in accordance with Section 2408, Section A, which allows the Street Artist Committee to deny, suspend, or revoke an artist certificate after a public hearing and for good cause shown. The Arts Commission has complied with all aspects of the program's governing legislation and believes that a two-year suspension is aligned with the program policies and goals. As such, we ask the Board of Appeals to uphold the Street Artist Committee's decision to suspend Goode's license. Thank you.
In my presentation, I mentioned that Article 26038 violates Before I talk about the actions of the Art Corruption Project, I would like to review the general situation of the incident. Then the Art Committee suggested that Ying Zhige be sentenced to two years in prison. This decision was made at the meeting on June 23. This decision was made after the committee listened to the testimony of all the state officials. During the investigation, it was determined that and involved in the physical violence that affected Wang Zhongyu. To beat up other artists, regardless of the reason, a kind of violation that would cause public health and safety to leave the country. Ambacatero Parasol is a very busy place for traffic. When a violent incident happened there, will certainly have an impact on public safety. They also don't respect other art prisoners. They are not polite and don't consider their safety. They use physical violence to interfere with customers and other artists. There are no customers who like to use money to buy goods, and there is a violent collective conflict next to it. There are no artists who can run their businesses or sales well, close to a place where money may fight and upgrade. Through his own confession, the son-in-law violated the three rules of conduct. He was forced to take disciplinary action. This is based on Article 23 of the U.S. Constitution, Article 24 of the U.S. Constitution. This is in accordance with Section 2408A, which allows the street art committee to refuse to stop or cancel the signage of an artist. Through the process of public hearing, there must be a good enough reason. This is what the above shows. The Art Committee will draft all the relevant plans. The law still believes that giving him a two-year suspension sentence is consistent with the policy and goal of the plan. As such, I ask the Chamber of Commerce to support the decision of the Chamber of Artists to suspend the son-in-law.

Through all the interviews, no one admitted to being the person that started. No one told on anyone and pointed out anyone in this situation. They just started telling about what happened. But no one ever said this person started it. So are you explaining that the department doesn't know who started it? We do not know who started it. OK, great.

And are there any efforts by the department to have restorative justice in disputes?

Can you talk about two years being the penalty? Can you speak on the behalf of your department of how Sorry, do you mean the street artists the committee's decision for this one? Oh, yeah. My understanding, and you can tell me if I'm wrong, is that the staff was recommending just a revocation of the license altogether, which would mean they would never be able to enter the program again. And the commissioners felt that was too strong and wanted to do a two-year suspension, which would then mean that artists could actually reapply to be a part of the program.

Good evening, everybody. I am Yin Zhige. I've never denied that something happened between Ms. Wang and myself.
However, the notice of decision is violence against art vendor Zhong Yu Wang. 我一直不同意这个认定。 I don't admit to this. I don't accept it.

According to the interviews, the argument occurred over tent setup. And again, setup is a common time for art vendors to argue. In this instance, one vendor touched another's tent and it escalated to a physical altercation. Ying Zhige says that Zhang Yuwang pushed her first. However, Zhang Yuwang claims she did not touch Ying Zhige, that Ying Zhige started hitting her. Again, no witnesses saw the beginning of the fight. That can confirm who struck who first. We have one witness, Xu, who confirms that they saw Ying Zhijie striking Zhang Yuwang and Ying Zhijie herself in her interview admitted to striking her as well. Ying Zhijie in her interview admitted to pushing and using physical violence against Zhang Yuwang, including hair pulling and kicking. Zhang Yuwang's husband, Xingzhi Yuan, licensed 9022, when interviewed, said that he witnessed Yingjie Ge physically strike, kick, and pull Zhang Yuwang's hair.
So this is what I heard from the committee when I assisted to do the hearing on 6-23, June 23rd. But I don't think this particular audio has all the relevant background in the investigation that corresponds to it or should be corresponding to it. So you can see on the slide what I actually said.
So this is what's recorded in the interview.
Ms. Wang first pushed me.
And then she used a spray bottle to hit me. I said that at the time I was scared. And basically tried to defend myself.
So then the staff asked me who laid hands on who first. 我的回答是 Miss Wang laid hands on me first.
And my answer was Miss Wang laid hands on me first.

So at the event, at this audition, staff heard the committee say, we have one witness, Xu, who confirms that they saw Yin Zige striking Zhang Yuwen.
But then at the end, what they said to the committee was,
I didn't see him hitting each other. I just saw Wang Zhongyu rush over and hit me. He said, I was hit. Look, my hair is in my hand. Because we can't lie. Because I saw Wang Zhongyu run over and hit me. I was hit. My hair turned over. That's how it happened.
Okay, so she said when she ran to the scene, she saw Zhong Yuwen saying like she was hurt and there was the hair in her hand.
Yeah, first time. So the altercation was over. So she didn't actually see anybody hitting anybody? She saw the injuries.
You didn't see who started it?
So I want you to pay special attention to the first statement. That when I first saw them, I did not see them actually fighting with each other.
So this particular statement during the audience on 6-23 was not completely translated properly. 在对秀女士进一步询问后,委员有以上对话,他们当时的理解是秀没有看到actual fight.
So then in the conclusion, they decided that Xu did not actually see the fight.
Respondent Brief现在却说,我 does not dispute that Xu saw good hit and kick one.
So in the respondent's brief, I said, I do not dispute that she saw Ge hit and kick Wang. I do not accept this statement because he declares that he did not see the actual fight.
Our commission, using Wang's husband's testimony, supports my accusation.
So the Art Commission is using the statement from the husband of the other party as part of the testimony.

And it's not really taking into consideration my mother's defensive response and account.

So the respondents brief now include that the staff recognize that there's a family issue and that there's material interest in the evidence. I'm not asking for you to believe my mother.
I just want you to consider why we're not applying the same standard for both parties. Respondent said that whoever started the first altercation is actually immaterial.
Sorry. But the staff recognizes that in the violence case, the aggressor did fight back.
But when the staff discuss about the previous violence case, the aggressor and the found back, so difference like, you know, character like this. So this means that there is conflicting versions of what happened, really.
And the committee did not conclude that I was the aggressor. And then after this, I actually moved our booth to avoid this in the future from happening. At the end, I do recognize that it's part of the Arts Commission's responsibility to ensure the safety of the event.
But I think a two-year suspension really demonstrates very zero tolerance and sends a strong message to set an example.
And so if I get a two-year suspension, then I would have to reapply for the certificate. How do you practice this?
So we cannot use this general deterrence as a model for the cannot really be used to inflict a punishment on one particular person.
So the staff did not really recognize my account as a defensive response. So Shu did not see the actual fight.
And then the actions have not responding to what the respondent actually responded to or commented on. And the committee really was not able to determine who started the altercation.
And the committee really was not able to determine who started the altercation. So that's why I consider that the declaration or the conclusion of violence against that vendor, Zhongyu Wang, is not worthy of a two-year suspension. Oh, yeah. And I would like to conclude by saying, please grant my appeal, reverse the decision, vacate the finding and the two-year suspension, and reinstate street artist certificate number 10088.
And because I have some more time, I'd like to say a couple more things. So since February until now, I don't think I have received any fair treatment. We haven't had any chance to do anything since February in terms of business. So from my understanding, this is my first time attending the hearing. So from my understanding, to hear all these from different parties. So my mom was the one who get beaten up. And then... So even from the evidence Ms. Ge submitted, like the photos of her hand, and to me, when I first saw those photos, I feel like, because since it's over here, it's like when you hit someone very hard, and then you get those injuries. And so when I know what had happened, I told my mom, because she didn't report to the police the first time. And then also, because she said she doesn't speak English. And then she was so scared and shocked. So my comments to this is my mom is going through this hearing over and over several times. And it caused her, I would say, she couldn't sleep at night. But what I just want to point out is my mom was the one who get hit, beaten. And my mom is at her 50s. And then the other parties, they have more people, and then they are young. So I think those are the considerations as well.

Thanks, Kingsley. OK. Gu's statements and brief have conflicting information. No witness saw Zhongyu Wang use the spray bottle. Wang said in her interview, I could have used the bottle use the bottle I was holding but didn't. Staff only present evidence that can be verified by a third party who is not part of a family unit that does business together or has other material interests in supporting one person's version of events. Gu's brief states that witness Xu Huaxi did not see the beginning of the altercation but does not dispute that she saw Gu hit and kick Wang. Good statement that the disputed issue has been the circumstances in which that physical contact began and occurred is incorrect. The art vendor program only governs use of the license by holding art vendors accountable to the code of conduct. No items in the code of conduct address intent but actions taken. The matter before the board is whether a violation has occurred. Ngo has never wavered in her statements that she violated provisions of the code of conduct through physical altercation violence. In Ngo's submitted medical report, the practitioner encouraged her to file a police report. In her original interview with staff, she says she contacted lawyers who advised her not to file a police report or follow up with the Arts Commission. It's difficult to understand why a lawyer would advise Goode not to file a police report unless that lawyer consulted did not think Goode had a strong case or did not believe Goode's version of events was accurate. Youngsuga stated multiple times that she has moved her booth away to avoid further conflicts. However, she and her mother, Jia Yin, also went to Zhengfu Wei's booth to film a verbal altercation between Zhongyi Wang and Zhengfu Wei. This doesn't seem to be avoiding any further conflict. And we urge the board to uphold the Street Artists Committee's decision. Thank you.

I want to ask our commission, what evidence in records shows that I went or interfered with Ms. Wang's booth or business? Second, the respondent says, I later went to Jianfu Wei's booth to film another dispute. That is not what happened. My new booth was already near his booth. Later, Wang and her family came towards my area. They were recording us, so I recorded as well. The video was taken in a nearby public area, and Jiang Fuwei's booth does not appear anywhere in the video. The fact that the video captures something involving Jiang Fuwei does not mean I went to his booth to intervene in another dispute. Third, the respondent speculates that my lawyers may have thought my case was weak or did not believe my account. But the Arts Commission never asked what I discussed with my lawyers or why they gave me that advice. That is not a fact established by the investigation. It is speculation, not evidence. These examples show my concern with how the evidence has been handled in this case. Relevant evidence was sometimes left out, while other evidence was interpreted in a way that was unfavorable to me and went beyond what the record actually shows. That is why I ask the board to look carefully at the complete record and decide my appeal based on what the evidence actually shows. For these reasons, I respectfully ask the board to grant my appeal, reverse the decision, vacate the finding of two-year suspension, and reinstate my street artist certificate. Thank you.
So this is the evidence to prove. I did have a second interview with our commission. Yes.

Thank you, everyone, and particularly our interpreters, for helping us have a fair and even proceeding. I want to be brief. I've got five points. But I do believe bottom line is that the department's position is untenable. First, when this matter came before us before, we said there was insufficient evidence. I haven't heard any new evidence tonight. So just on that basis alone, I would say that the department has not met its burden. Second, there appears to be an uneven application of the code in this matter. It seems undisputed. Well, the department says, oh, there's strict compliance. We don't care about the intent. I don't see how that could possibly be the case. If, for example, as Commissioner Lopez said, what about self-defense? Are we to believe that... The commission's message to a vendor who sees another vendor getting beaten up by a member of the public is like, oh, you can't get involved in that. You have to go look for the park ranger or just do nothing. Is that it? And then second, on other parts of strict compliance, there are code sections that talk about always being courteous. Well, are they going to have the courtesy police out there on this? Those are extremes. But what is very pertinent to this case is that I believe it is undisputed that what began is the tent hitting the appellant's tent. That, to me, is a violation of Code 11. None of your equipment, display, or other belongings should intrude into any walkways or into another space. Yet there is no action being brought against that action of having the tent hit the first person. And if we believe the commission's words, it doesn't matter whether it was accidental or not. It happened. And yet there is no case being brought on that aspect of this. Fourth, the department continues to say that the appellants admitted violating the code of conduct. They did not. They stated they took certain actions. But they've never said they violated the code of conduct. And to maintain it, even to this date, I think is a stretch. Finally, the last item I want to bring up is that, as the department has stated, there have not been any other cases in seven years. That is great. That speaks to a... well-run program and good conduct by the vendors in general. Obviously, there's this case. And yet, on the first case of what they call violence, they want a permanent revocation of a permit. Permanent revocation. How much loss of income would that impose upon a vendor? That is an extraordinary penalty. And yet that's exactly where they went for. And finally, just finally, I would say we've heard from all of the vendors involved how difficult this process has been and how prolonged it has been. And I would have hoped that the department, having heard from us, that there was insufficient evidence, that they would not have immediately gone back in and brought the case again. When a DA is thrown out of court, when they bring charges and they throw a case out of court, a judge says, for whatever reason, the DA doesn't go back and file. The DA says, well, let's go get new evidence. Let's do more investigation. Let's bring something new. That's inappropriate. That is appropriate. In this case, I don't see any consequence or any result of bringing this case again, except for the agony for everybody involved, victims on both sides, on all sides. And that, I think, as a department reviews whatever three decisions we make tonight, I hope they take that into account. Commissioners, Vice President Saroyan, do you seek to be recognized?
MS. Yes. President Drozdvinia, I concur with everything you've said. I don't see a reason not to grant the appeal. I think from my observations at the record below, at the commission hearing, the Arts Commission hearing, it was unclear and inconclusive who started the altercation and the testimony was conflicting. So I'm in a position where I think that there is unequal application of the penalties at hand. And I might recommend that perhaps there is some kind of consideration of an interim type of resolution, mediation, counseling. some tiered level of Resolving disputes before jumping to a revocation or suspension in and in a community So I am inclined to grant the appeal So I'd like to move to grant the appeal based on insufficient evidence in the record to support the two-year suspension Do other commissioners want to be heard?
I believe Commissioner Lopez would like to be heard.
I see this case a little bit differently than the last one, because I do see in the record the appellant making statements that she was involved in a physical altercation. I think there's a dispute as to who started that altercation, but I don't think there's a dispute about whether an altercation occurred. So just putting out there that I think, and I agree with what Vice President Soroyan has said about you know, having alternatives to suspension or revocation. I think that aligns with President Tresvina's question in a prior matter about restorative justice processes. But I'm just not sure how my fellow commissioners would feel about this. But I think given that, unlike other matters related to this incident where there isn't proof of physical contact or even attempted physical violence, I'd be comfortable with a much, much shorter suspension. Because to my mind, I think given that this isn't a criminal matter and it's really a privilege to have these permits, I'd be open to the the application of the commission's authority and policies in saying, hey, if a physical altercation occurs, a suspension of some time would be appropriate. I'm just putting that out there. I'm not sure if there's support on the board for that, but I wanted to share that because that's something I would be open to.
Commissioner Wong. Thank you. So I think I'm still stuck on whether or not there was anything new brought up. We've heard this case before. We heard it again tonight. I think folks have just shared variations of a story that I don't know what the truth is. It's probably somewhere in between. But you're right, Commissioner Lopez, that there was clearly something that happened. I like that President Trasvina and Vice President Sororan brought up alternative solutions that are a little bit outside of this. I think culturally giving face to both sides is important. And I think that there's clearly, there was an incident that happened and there are people that are getting brought in that's beyond the initial parties, right? I do think that there's a ripple effect to other artists and other individuals, whether it be their family members or other artists. I'm not sure if imposing suspension would address that versus some kind of mediation, restorative justice, something where the parties can actually have that conversation and remember that they're both humans. And in heated times, especially when it comes to their livelihood, it can cause that, but then also recognizing that everybody makes mistakes. So I know that we can't tell them to do this. I'm saying it as a suggestion. Again, culturally saving face, recognizing trying to find peace is something that I would ask that you think about. But right now, I'm not sure if I can impose, or I can agree to impose, what's the word I'm looking for? Yeah, like impose anything upon them. Because I don't really know the details of what happened.

Thank you, Commissioner Wong. Yes, I'd agree with you colleagues that we haven't heard anything new this evening. And it was the department's opportunity to press a more vigorous case and to explain how a two-year suspension What are the logics of how that is proportional to the incident and the gravity of the incident? I don't have a clear sense of that from the commission representative. Maybe the committee of the Arts Commission did, does have some kind of rubric they're working from. It wasn't brought forward. It's difficult to understand that. But aside from that, Because we haven't heard anything new, I am greatly inclined to grant the appeal to the suspension and would want the Commission and its committee to see this as an opportunity to evolve how it addresses and deals with these issues. I think the investigation itself does seem like it was pretty thoroughly conducted. And sometimes, no matter how thoroughly you investigate something, the truth is somewhere in the middle. And you're going to get conflicting reports. But aside from something that seems very heavy handed, a lifetime ban on getting a permit or a long-term suspension. It seems like with a program as necessary and important and sensitive as this one, that there should be an exploration of greater nuance in terms of response and not just penalties. So yeah, I wouldn't agree with you colleagues, or I think most of us agree, that granting the appeal of the suspension is something that I would support at this time.
Thank you, Commissioner Budd. We do have a motion by Commissioner Soroyan. I just want to add a couple of things, and that is notwithstanding my comments earlier, this is a generally well-run program. The testimony from the department is there has been vendor peace for the most part, at least maybe over the last seven years, maybe longer. And that's something to be not forgotten in this. As we focus on the specific facts of this case, overall, there appears to be vendor peace. There is certainly more language services and materials and translations than I've seen in almost any any department in the city. So I do see that the department does take into account the vendors' needs in a variety of ways. However, there are matters that when it comes to this disciplinary, this investigative process, there have been some shortcomings. So I would encourage the department to go back and review what they're doing and try to come up with ways in which to not just go back and re-look and see whether the education aspect and the making sure that people understand the code of conduct and what it actually means. and have the city attorney's office there to say, well, do we mean strict compliance in every time, or do we not? Because that's a legitimate issue that Commissioner Lopez brought up. And finally, I would hope that every vendor there has learned something from this episode or these episodes. I would hope that the party of all three cases will, if the situation ever came up again, they would know what not to do and about escalation and about working with each other. So I do think that while it's been painful for the department, the vendors, the witnesses, et cetera, I think people will have gained something from this so that the department will continue to have a record of not having a lot of complaints filed penalties impose penalties appealed penalties overturned commissioner Lopez
Thank you. I can count, so I won't make an alternative motion with respect to reduced suspension. But I wanted to tack on a couple of other points or advice for the department just to summarize, I think, some of what we've heard. I think alternative forms of dispute resolution, whether that's restorative justice, bringing in other people from the vendor community, mediation. And then I think if things do go down this path again, clear evidence would, I think, in my mind, support. you know, something along the lines of a revocation or suspension potentially, with the understanding that there's been testimony that it's been hard to collect witness statements from people who don't want to speak, which is understandable, and there's limitations associated with that. But the fact remains that without clear evidence, I think it potentially could be hard to find for penalties of this nature. And then I think the suggestion of a rubric for what type of violation or activity could lead to different forms of penalty, whether it's suspension or revocation. I think that's a great suggestion that I heard from Commissioner Abad. I just wanted to just collect some of those things because I think they're great suggestions. And I think to the line of questioning that I had about where Whereas this approach codified or captured in writing, I think it may make sense to revisit some of the code of conduct materials as well. With that, I'll move to grant the appeal on the basis

Appealing the three-month suspension of Zhongyu Wang's street artist license. On July 31st, 2026, the Arts Commission suspended Zhang Yu-Wing's street artist license until October 31st, 2026 for making verbal threats against an art vendor and for disrupting the business of the market on November 28th, 2025. This conduct is a violation of street artist ordinance and item number 2, 3, and 20 of the Code of Conduct. This is license number 9021. We'll hear from the Arts Commission first.
So again, here's a visual reminder of the parties involved. Oh, almost.

Thank you. There it is. Three of whom have disciplinary actions regarding their licenses before the board today. Next slide. These parties are members of Zhang Yu-Wang's family. Only her husband, Xingzhi Yuan, is licensed. Next slide. The Street Artists Committee recommended a three-month suspension for Zhang Yu-Wang, license 9021, at the July 27th Street Artists Committee meeting. This was determined after statements made by Jen Fu Wei, Zhang Yu-Wang, who filed the incident report, and other witnesses were presented. During the investigation and noted in attachment C, the incident report, Zhang Yuwang admits that she went to John Fu Wei's booth and to talk to him about her injuries. In a video submitted by and included in exhibit G of the brief, you can see Zhang Yuwang on camera making what appears to be verbal threat toward John Fu Wei. Next slide. These actions and statements made by Zhongyu Wang violate items 2, 3, and 20 of the Code of Conduct. Verbally threatening another artist presents an immediate danger to public safety. It's not respectful, courteous, or considerate to other art vendors in the market or the public walking through the plaza. Yelling at another art vendor and bringing family members into the confrontation interferes with both customers and other artists. It affects the atmosphere of the market and makes it unsafe for business as usual. No customers want to exchange money or purchase items near violent altercations. No artist can effectively manage their business or sales while an ongoing verb altercation with potential escalation to physical violence is happening in the plaza. Wong's actions as self-described during her interview, the video evidence, and statements at the July 27 Street Artists Committee meeting show that these three provisions of the Code of Conduct have been violated and therefore require disciplinary action as stated in the notice to artists. Next slide. The committee voted to find Wong in violation of the street artist ordinance police code article 24, based on her violation of numbers 2, 3, and 20 of the code of conduct. This is in accordance with section 2408, section A, which allows the street artist committee to deny, suspend, or revoke An artist certificate after a public hearing and for good cause shown. The Arts Commission has complied with all aspects of the program's governing legislation and believes that a three-month suspension is aligned with program policies and goals. And as such, we ask that you uphold the Street Artists Committee's decision to suspend Wong's license. Thank you. So where does it start?
It starts here. OK. OK, so . On the 16th, there will be three participants, Zhang Yuwang's family, his husband, Xing Zhiyuan, and Xing Zhiyuan's production. Our Art Commission's recommendation is to give Zhang Yuwang a three-month license to produce the art of 9021. The decision will be made on July 21st. This is for the evidence of Jiang Jianfu at that time. Zhang Yuwang's report and other witnesses were present. At the time of this investigation, in the attachment C report, Zhang Yuwang admitted that he had gone to find Jiang... and talked to him about his injuries. There is also a video that Ying Zhige posted. This is added to Exhibit G in our report. You can see that Zhang Jiuan was threatened by Jian Fuwei on the line. These actions and these words are not in line with Article 3 and Article 20. Threatening other artists is a threat to public safety. They are not respectful or polite. I didn't expect that other businessmen in the market, and perhaps customers in the Plaza, to another businessman, to shout at him loudly, and then to ask his family to deal with him, to deal with other customers and other artists. This will affect the market situation, and will make the business situation unsafe. There are no customers who want to exchange money or buy anything. When these things happen, there are no artists who can do their business or trade. If someone is threatening with a mouthpiece or quarreling loudly with others in this market, As for Ms. Wang's event, the one she explained in her interview and the one she explained in the video, which will be held on July 27, We need to have some results or consequences for him. In our meeting, We agree that Wang has illegal artistic rules, including Article 24 of the Police Act. Good evening, commissioners. My name is Tad Skye. I was not a witness to this incident. I've been a street artist since 1974 when the program began. For many years, I was the volunteer manager at the arts and crafts market at the Embarcadero. I've seen many of these incidents where people get in an argument over the booth is too close or one thing or another. It's usually fixed up right then and there. that it's rare that it becomes physical. For some reason, this did become physical. The Art Commission staff, I believe, did a fantastic job interviewing people over and over, trying to get their statements. Unfortunately, most of the witnesses, and I came to all three of the previous hearings, most of the witnesses only showed up after the incident had begun. There was one vendor who was right across from them who probably saw the beginning. He refused to comply to answer emails or anything. So in the end, with all the witness statements, the Art Commission decided it was sort of a she said, she said. Originally, they decided to suspend G's license. They thought that was too severe. After listening to all the conflicting testimony, they decided to give varying levels of suspension based on the amount of energy that went into the situation. So that's why one person got three months, another six months, and another two years. A two-year suspension is not a revocation. You can reapply easily. Furthermore, if your license is suspended, that doesn't mean you lose your job. You can sell at night markets, craft fairs, and other things. Obviously, the Embarcadero Arts and Crafts Market is a great place to sell. I did speak as a character reference for Ms. Wang at the last meeting. My knowledge of her is that she's a very gentle, generous person. And there's no way I could see her starting that fight. But of course, if she was defending herself, That's possible. And as to defending yourself, of course you can defend yourself if somebody attacks you. And you can get in between two people. I many of times have gotten in between people. Usually it's not artists. It's usually some person outside the market or some person stealing from us. So that's certainly acceptable. In this incident where her son showed up an hour later after he heard that his mom had been brutally attacked and had hair pulled out and visible signs of being beaten up, he was way over the top, absolutely, his language and his action. But he was not a street artist, so that shouldn't be taken into an account. I think she was basically saying, if I have physical problem, I have to go to a clinic or a hospital or have to pay some kind of a bill, I'm going to come to you and give you the bill. That's my interpretation of what she said when I'm going to come for you. Not that I'm going to come and beat you up. I'm going to come and you're going to have to pay the bill. So that is my statement. But the Art Commission, I think, did a very good job in presenting the case, which was very difficult to figure out. Thank you.

Let me give you the context. The incident happened on the 28th of November. It was right after Thanksgiving, and that was post-Francgiving sale, and my son really to go to buy, to shop. And he gave me a call, but he was not aware that I actually had returned to the market. I am open for business already, right after Thanksgiving.
Yes. I couldn't answer the phone call. So he called my husband. I couldn't answer the phone call because my husband told my son that I was beaten.
So he called my cell phone. Given what happened to me on that day, I got my hair violently pulled. I was attacked. And I did not pick up his call. And he ended up calling my husband. And from my husband, he learned of what happened.
Yes, my husband told my son to ask if we had called the police, if he needed to come. Then my husband told him that the matter was over and told him not to come. My son was just worried about me because he knew I wouldn't speak English. So he drove over to see me. That's how he got to the market.

Thank you all, particularly our interpreters, for helping us hear a lot of testimony and try to come to bring us to the ability to make a decision here. A lot has been going on on this matter. It comes down to one statement. As I understand, the department's view is there's one statement involved. There's a lot more going on. But the statement is, if I have a problem, I will definitely come to you. That the department considers as a threat. What occurred an hour before, what has occurred, all the dynamics, is not that statement. At best, the statement is ambiguous and innocuous. That statement in the department's exhibit B, 1140 AM, threats made an hour later, it didn't even make it into that paragraph. There's no mention of the statement. There's other statements, son and daughter-in-law, filming, et cetera, but not that statement. That, to me, suggests that that statement's importance to this, that statement's constituting as a threat isn't. Reminds me of what we learned in law school about the charges against Al Capone. They got him for tax evasion, and not all the other somebody was involved with. Yes, there's a lot of drama, a lot of activity, a lot of violence, a lot of charges for the whole incident from 10.30 past 11.40. But what we have in front of us is one statement by someone who had been considered a victim who had been considered to either had gotten involved in combat, verbal or physical, or was a victim of it an hour before. And for the department to now say, based upon these interviews, that she was bringing a threat for legal action or physical action or some other action, that does not appear to me to be substantiated by the statement. There are many versions, there are many interpretations that could be made of the statement. The statement was made in one language and became presented to us in another language. So I would say that the department has not met its burden and I would grant the appeal and I will yield to Commissioner Abad who seeks recognition. Thank you, President Trasvina.
I think I'm looking at this a little bit differently than the last two cases that we've heard this evening for a couple reasons. One is I'm looking at all the evidence that we've received, testimony that we've heard tonight and in the previous one, to be honest, inclusive of that video. And in my mind, and I don't know if perhaps the department or its committee compartmentalizes this in a different way. But the entirety of that morning, what happened starting 10.30 through this latter incident where there was yelling, there was the N word, there was the F word, there was the C word, sort of considering that all as grounds for contemplating what an appropriate and a proportionate penalty might, could, and should be to discourage this kind of behavior in general. And for the parties involved, the family involved, to feel and understand that these words, these behaviors, the pushing, the yelling, should have consequences. And so I'm aligned with the commission's ethos of wanting to discourage that and to dole out penalties that are proportional. So Ms. Pate and other representatives from the Arts Commission kind of made conflicting statements about where we should place emphasis and what we should contemplate. Was it the video? At one point, we were told that that's what we were thinking about. And then earlier, we were talking about a statement. And so irrespective of all of that, I'm kind of thinking of this all in its totality, the behaviors of the appellant. I do think that in this case, which is different from the last couple that we've heard, that we do have more concrete evidence and that multiple stories corroborate the pushing. material, there's like evidence, video evidence, of violent, aggressive, abhorrent behavior, to be honest, in language. And so I do, in this case, believe that a suspension is appropriate, that the commission made the right call in this case, given the evidence. Do I think three months is enough, given what we hear in that video, the language that was used, the derogatory language? I know that Mr. and Mrs. Dong's son is not a vendor, but he was a party to creating a vicious atmosphere at this site. And that language, that behavior has had reverberating consequences on the community. So I would not vote to deny the appeal.
Commissioner Bodd, can we just clarify, is that video part of this case? Yes, it was part of the packet.

Yeah, I think I agree with Commissioner Abaddon that this case is a little bit different because we are hearing it new. So it's not that we're looking for new evidence. I don't know which step to take. And I'd like to hear more from my fellow commissioners because I can see that, we can all see that something happened, right? And we don't want to, or there's clearly an incident. Violence was clearly a part of it. The code of conduct was violated. I think the Arts Commission staff has done all that work to lay that out. I am hesitant to put a fine on Ms. Wong when there were other parties involved and that we had denied or we had granted their appeal because of process, right? So that's kind of where I'm not sure. I can see denying the appeal because There was violence. There was actions that violated the code of conduct. But I also don't think it's fair if, on her side of the story, she was a victim. And I don't, I wouldn't feel comfortable imposing a penalty on a victim, even though I don't know what the real story is.
Other commissioners like to be recognized?
I'll go. I'm inclined to see it in the way that Commissioner Abad described. I do think that there's a piece of hard evidence in the video. I do think that it's appropriate for a vendor to be responsible for the actions of a family member at their location unless there's kind of railing evidence to suggest that the family member or that the the permit holder has taken steps to distance themselves from the family member and disallowing them from coming back to the site or asking for support from the department in keeping the family member away. I don't think that anything to that effect has been presented here. That being said, And I do think, by the way, that a three-month suspension is appropriate in the sense that it's not overly debilitating and still sets an enforcement message to the permit holder. In my heart of hearts, I also don't think it's appropriate, given the collection of activity and the number of parties involved, for only one party to have a penalty. And to refer back to a previous hearing, that's kind of why I wanted to allot suspension of something like three months in a previous hearing. where I similarly felt that there was enough testimony in the record to suggest that other folks may have admitted to some activity worthy of sanction. But that's just a total aside. So I'm left with that. I'm left with generally agreeing with Commissioner Abad's position, but then at the same time feeling some unease at only having one party face a disciplinary action when there were other folks involved. And so I'm not sure what to do with that.
Before I yield to my fellow commissioners, including Vice President Soroyan, I do want to ask the city attorney a couple of questions. One is, is there a basis to depart from – well, let me ask another way. Is the – It's my understanding the department's view is that it doesn't have jurisdictions. This code of conduct does not apply to non-vendors who have received the code of conduct and are aware of it. Is that a correct understanding, that the code of conduct doesn't apply to other than vendors? I'm sorry, other vendors? Other than vendors. Other than vendors. I believe that's correct. And my second question is, if we are to consider the actions of the son, daughter-in-law, the previous hour, As we consider the appropriateness of the sanction for the words that were stated, do we run into any notice problems for the appellant who is appealing based upon a penalty for a statement and we impose penalties based on other things?
I'm sorry, perhaps because the hour is late, I didn't quite understand. Could you rephrase it one more time?
Well, the appellant was found guilty of code violations for the statement. She appeals that finding and that penalty. She comes to us. And it appears that we are making a decision on that charge and penalty based upon other activities that we have evidence of over the evening that the commission has already said do not apply to her. That is the conduct of the non-vendor. And I'm wondering are there any notice or other due process problems in making a decision based on those non the elements unrelated to her?
She could on elements unrelated to her.
The elements that I forget the last. That's right.
No, it has to be based on the charges that she's aware of. So it can't be beyond the scope of that. She has to have the ability to respond prior to this hearing to any charges that are to the charges that are made against her. There can't be new ones that are brought up this evening.

Commissioner Soroyan, I'll yield to you. I've spoken a lot already.
I actually have a lot in common with what everyone said. I'm very disturbed by the video. And I see why the commission made the recommendation that it did. And I think it's proportional for a threat. But I also recognize that we've been here now for five hours. And I think that we owe it to everybody to make a fair and partial decision. And I'm not sure that I have the right solution at this juncture in time because I also recognize that there were two other matters where we – granted the appeals. So I am also in a line with Commissioner Wong that I don't want to act unfairly here, but I do see more so than I saw in the first two matters that there is concrete evidence of a threat. It's in violation of the Code of Conduct for the Arts Commission, and the penalty seems proportional. And I'm not sure I have a solution.
Commissioner Abad. Thank you. Right. What distinguishes this case from the others for me is that we do have evidence it aligns. And there's alignment across different stakeholders in the situation. Certainly, the Arts Commission's statement, I guess, is the basis for their suspension is the verbal threat. But we're seeing more. We're hearing more. That's part of our packet. That's part of the body of material that we are charged to consider. So all those taken together really do distinguish this case from the two prior. The commission also made recommendations for much higher penalties for the last two, yet they didn't meet their burden, as you mentioned, President Transvenia, to really prove, A, that there was basis to, that there was, it seemed disproportionate. We didn't discuss that too much in our prior deliberations for the last two. items. But, you know, it was a two-year suspension for someone who was defending themselves and who didn't have a family member come later and yell at everybody, threaten them. You know, I'm looking at the video transcription now. I remember your faces. I'll come back for you, expletive after expletive. So there's kind of a double There are a couple different reasons why I was uncomfortable voting for, you know, to maintain suspensions in the prior two cases, whereas this one, to me, is pretty solid, pretty hard-hitting.
Commissioner Bottage, I just want to follow up on that. The statements you just referenced, as I understand it, were not made by
the appellant.
They were made by her son, correct?
Correct. And I think echoing what I think Commissioner Lopez had mentioned, it does seem appropriate to send an enforcement message to a vendor whose family, whose associates, you know, are a party to creating an atmosphere of intimidation and abuse in our public realm.
So if I could follow up. This is why I asked. For each case, what is the new evidence? Where is the evidence? What we're trying to do here, yes, we see a difficult situation. We see an abusive situation, a violent situation, whatever you want to call it. We do see that. It's on video. We've had a lot of people, well-meaning people coming, spending hours before us telling us what occurred. But what we have in front of us is a charge. The last time these issues came before us was that there's insufficient evidence. I think tonight we're saying, well, there's insufficient evidence for this, but we're trying to repair the department's case. I believe what we have done up to now is we look at the case. We say, is there sufficient evidence? If there is, then is the penalty correct? Or if there's insufficient evidence, then we send the commission away. And then, as I said maybe half an hour ago, if that happens, you come back with new evidence to bring your case. You don't come back with the same case with the same evidence and expect a different result. If we say, for this matter, the words of the appellant do not constitute a violation, the Commission has heard from four of my colleagues, and I will add, too, the activities that were elsewhere expressed on the video and by others are reprehensible or shouldn't be done. There are remedies to deal with that. If the department wants to come back later and bring the charge, maybe they can't bring it against the son. Maybe they can go back and look at the law and say, oh, we're changing our view. We can hold a adult member of the family or a minor member of a family of a vendor. We can hold that vendor responsible. If they bring that legal case to us and that factual case to us, that's the genesis of bringing new evidence, bringing a new case. And that I think we would all look at with open eyes, open minds, and make a decision at that time. But for tonight, as I initially thought, and I think the answers from the deputy city attorney confirm my view, that we can't take into account the N word, the C word, the MF word, the other words that were stated by the appellant's son. That's not the charge against her. If it was the charge against her, She should have been informed. When you get to the Board of Appeals, you're going to be on the hook for all that other stuff. And instead, at the commission and tonight, it was about the statement. If I have a problem, I will definitely come to you. That is not a violation. The other things, if they aren't violations, if they aren't against the law, If the statute of limitations hasn't run, then they should be. They should be. Because it's clearly abusive to a variety of people. And I would say on those matters, we should... we should suggest to the commission to come back and bring us those. And then we can have a discussion about that. But as for this, I maintain that the disposition of this matter should be granting the appeal. And I see Commissioner Wong would like to be recognized.
Yeah. So I appreciate that because I do think it's grounding us into what we're really looking at. I am looking at the Code of Conduct 2, 3, and 20. I think that those were the same ones that were brought against the previous two appellants, as well as this one. And similar to the previous two, the evidence is mostly hearsay. And both parties are saying something a little bit different, so it's hard for me to say whether or not that code was violated, right? Because if you listen to the previous two appellants, then Ms. Wang was in violation. If you listen to Ms. Wang, they were in violation, right? So it's just a lot of finger pointing. I almost wonder if there's a potential like creative solution, if there's any kind of mediation, restorative justice practices, any access that the department maybe has and that until there's a like not a kumbaya, but like some meeting where they come together and they just kind of like do some kind of restorative thing that they're kind of paused. It's not a suspension. It's a until an action happens. It's a pause on it. And I don't know if we can impose that, but I do kind of wonder if there's some kind of creative solution where we say that they have to do something, and until they do the thing, they can't bend.

Thank you, President Trasvigna. It's my understanding, and maybe the department can correct me if I'm wrong, that we weren't in possession of the video at the prior hearing. It was shown during testimony, but it was untranslated, and it was sort of, you know, it was like an iPhone under... Projector kind of situation so it is fresh and new material in this packet and it was as as I think everyone can tell was something that was very compelling to me in the way that I Looking at and considering this case so in that way It is a free fresh there is something new and again that distinguishes this item from the prior to because we we had We had a bit more material. As to the point of the Arts Commission's, not accusation, but what they're basing their appeal on being specific to the statement. I guess my question is around what, as I understand, we're contemplating this de novo, right? So does that mean that we are constrained to granting or denying the appeal based purely on why the Arts Commission says that they would want to exact a penalty? Or are we thinking more broadly about you know, the policy goal, the cultural goals that we have about how these programs are conducted and how participation, what appropriate and constructive participation in them looks like. So I don't know. Maybe that is a question I should pose to our city attorney about De Novo. just so that I'm clear on the concept. I do think there is fresh material, which is very, very compelling from my point of view.
Well, if I could intercept your yielding to the city attorney while they're conferring, everything here is new material. This entire matter, unlike the other two, which were sent away for new material, this one is the first time. So in fact, if there's a precedent, it would be, OK, the first time you're up, you didn't get it. We need more. Now we're going to say we need more and come back with charges. As I said, if the department can determine legally that a vendor can be held responsible for their family members, then that's what we need to hear the next time. So that was my view. If we granted the appeal, it would just be like the last one. We're not granting it. We're granting the appeal for today, but that still allows the department to come back to bring another case for those statements and that video as well as anything else they want to bring. But now I will yield to the deputy city attorney for his response.
Well, I'm not sure if this is a response. It perhaps is, but it's certainly a point is that it is true that the code of conduct, so any finding of a violation of the code of conduct has to be a violation by somebody who's bound by the code of conduct. So it does have to be the appellant in this instance. And so you can't find sort of a vicarious violation, let's say. It has to be something that's done by her. I'm not sure if that answers the question, but that's the issue that... we saw. I think in terms of notice, so long as the allegations of the violations of what the specific codes are made, as well as the specific factual basis, then I think there's probably enough notice in terms of number two, number three, number 20, and then the underlying facts. within the actual documentation and the findings. But I think I would like to stress that this is an issue of whether the appellant violated the code of conduct and not whether a third party or a related party did.

Yeah, the way that I see this, and I I agree that because this is a new hearing, the fact that the video is in the record is enough evidence. And even if this was a re-hearing of a matter where the video hadn't been entered into the record before the night of our hearing, we have it in the record now. And so I think it's fair to consider that I do my my reading of the Arts Commission meeting from July does say essentially the The item that was discussed that's agendized is participating, or the charge, if you will, is participating in a violent altercation, which to me is the hour before actions. comma, threats against a vendor, which is, I think, the piece that President Trasvina seems to be most focused on, comma, and disrupting the business of the market, which to me is where I would park this activity of the family members. And even though, even though, the code does not apply to the actions of a family member that doesn't have a permit under or a city permit for the vending. I do think that there's, I think, testimony in or statements in the record from the interview records that show that the appellant called her family member and told them about what happened. And I don't think it's unfair to say, hey, if you're bringing people into the conflict in that way, particularly within minutes when emotions are very charged, I don't think it's unfair to expect that someone may react in an emotionally charged way and maybe show up. And so I think That's how I consider that to be actions by the permit holder in this case. There was also discussion about the family members' actions in the interview records. There was briefing by the appellant about not attributing the actions of the family members to her. And so it's not like it's something that's being presented for the first time this evening. I do think through the interview records, through the agendized items in that July meeting, I think In my mind, it's kind of in the arena, that type of activity. And so that's how I'm seeing it.

I mean, I think that your reading of the Artist's Code of Conduct, we have the authority, because it's a de novo review, to... disagree with where the Commission or what the violation of the code was and I think you're right if It's in three or acts that present an immediate danger to the public health and safety I think we could be squarely within three if it's not an actual It's not constituting a verbal threat, but we are in that arena and perhaps If we agree that It's a violation of code number three. I think we're all a little tired. It may make sense to realign or reformat what the violation is and even what the penalty is. I'm open to considering another penalty that might be less than three months.
Thank you, Vice President Soroyan. I'm going to suggest that we are stretching ourselves to try to find a solution that is fair, just, and legal. And we are looking for a way to tie the son, adult son, I believe, to the vendor. Hoping, and as I understand Commissioner Lopez's answer for, this is the notice that the vendor was provided. I'm guessing, even if the vendor were fully proficient in English, I think it would be a stretch to say the vendor understood your learned interpretation of the law. Second is, as I read the letter from the department, it says Wang made verbal threats towards art vendor, not art vendor Jianfu Wei. pretty clear, what are they talking about? They're talking about her statements. They're not talking about anybody else's statements. So I would suggest that alluding to what Commissioner Saroyan said earlier, it is getting late. And it is late. And perhaps there are a set of questions as we try to come up with a fair, just, and legal solution here that we take the time to continue this matter and decide what legal questions we want, what further information we want from the department and from the appellant. It could have been that the appellant would have brought her son-in-law to defend himself. Maybe there's some, I'm not gonna suggest that there was a reason for that kind of conduct that we see, but there might be an explanation, or maybe there would be none. They should have, the appellant should have, if the appellant is gonna be held responsible for her son's statements, then she should have the opportunity to decide whether he is part of her case. So I will suggest I'm not going to make a motion, but I want to suggest to my colleagues, I want to find out what they think of a continuance, and if they're open to a continuance, then to enumerate the kinds of things we need to know from the city attorney, from the department, from the appellant, so that we will be prepared at the next meeting, or subsequent meeting, to make a decision that is legal, fair, and just. Vice President Soroyan.
All right, similar to the first agenda matter, I'm going to make a motion to, I'd like to suggest a motion to continue this matter perhaps next week or the first meeting in October so that the Arts Commission could consider what other section of the artist's code of conduct this violation might fall into. And I think we'd also like to know what other, maybe this is from the city attorney too, What kind of penalty might we consider other than a suspension?
I think the city attorney would like to comment on your well-reasoned suggestion. Mr. Minardi. Yes.
Thank you, Vice President Sorayan. So, well, in terms of you, the penalty at issue is a suspension. Yes. And so you could, if it's upheld, the suspension of three months is appropriate. It could not be more. but it could be less so as you had suggested earlier that is an option for the board right now I would say that it would not be right for the the decision is the decision so the Arts Commission shouldn't be coming back with additional penalties or proposals in that respect as it's it's it's it's it's before you as is but as you had mentioned before you could reduce the suspension to a shorter time period or if you were the board were to grant the appeal of course there wouldn't be a suspension okay
And Vice President Soroyan, would your goal be achieved if the Arts Commission were able to bring additional and different charges in this matter to itself first and then potentially an appeal to us?
I'm not sure. I mean, I think we have the ability with our de novo to review to make that decision. I think what I might suggest or ask is if there might be additional evidence for both parties, the appellant or the commission, to give them an opportunity.
I think that what we are looking for, or my colleagues are looking for, is a way to bring all this other activity beyond what's here into this case.

Yeah, I'd just like to clarify that I don't think that, in my mind, the deputy city attorney's guidance with respect to applying the code or the code of conduct to non-permit holders is not something that I'm concerned about. Because I do think that by calling in a third party whether explicitly inviting them over to the site or in an emotionally charged situation, presumably if someone's a family member, knowing that they may be capable of the type of behavior that we saw on video, reporting to them what was happening within minutes of it occurring with the expectation that they're capable of showing up within minutes to engage with that type of behavior, I do think that that's something that falls within the prohibited activity of disturbing business at the site. I think to find otherwise would open the door to being able to say, hey, I'm not going to engage in threats or violence, but I'm going to call my friend. and have them come in on my behalf. And that just makes me uncomfortable to set up that type of precedent to overly focus on squarely direct behaviors of only the permanent holder.
And I would agree it is an uncomfortable outcome. But when you have a commission who holds the vendors to the syllable of the code, no looking at intent, absolutely, it's right here. They've made that very, very clear. Now to say, well, we've got to get them on something. And sure enough, it's bad stuff.
