Okay.
How many people are on this one? Are we? Yes, we are waiting for Administrator Cagnoni. You ready?
Yes, we have a quorum.
OK. All right. I call to order the Code and Regulations Committee meeting for June 22, 2026 to order. Clerk, please call the roll. Here. Here. OK. All right. So for committee reports, we have several items tonight, beginning with number one, the 13th Avenue and 17th Street Traffic Commission recommends the approval requiring that traffic on 13th Avenue be required to yield prior to entering the intersection of 7th Street. is there a motion to approve there's okay it's been moved in second uh is there any discussion hearing none all those in favor say aye those opposed and i meant to say i am sorry all right this matter is approved All right, item number two, 14th Street and 10th Avenue Traffic Commission recommends that a restriction be approved requiring traffic on 14th Street to yield prior to entering the intersection of 10th Avenue. Can I get a, is there a motion to approve?
So moved. Second.
All right, it's been moved and seconded. Is there any discussion? Hearing none, all those in favor say aye. Aye. Opposed, same sign. OK, this matter is approved. Item number three, Guilford Road, Prospect Street to Alpine Road. Traffic Commission recommends that a restriction be approved prohibiting commercial vehicles on Guilford Road from Prospect Street to Alpine Road. Is there a motion to approve? Second. Second, OK. Is there it's been moved in second. Is there any discussion? Yes, I'm sorry. I should have been looking up alderman from the Alderman Beach UPS FedEx Amazon
Big trucks?
Can we?
Little trucks?
Yes, I will have to refer to Mr. DePinkins.
Yes. Local deliveries, Amazon, moving trucks, stuff like that would still be allowed. Commercial vehicles are vehicles making it their direct route for commercial access, making it like a through street for commercial access. But this is for local deliveries, Amazon, UPS, they would still be allowed.
Yes, correct The signs are up there was no ordinance in place to actually enforce it so this is a bookkeeping type of request so I I've had issues with individuals saying that it's being used as a cut-through for commercial vehicles. I let my constituents know that there are some commercial vehicles that are delivering in the neighborhood, and that would be allowed, but do we have that ordinance as well on Highcrest right now? If not, could we look at doing that?
I will verify. Either way. Yes. I'll verify and get back with you. Thank you. By nature, all through streets are truck routes, unless marked otherwise. So I will check on that for you.
Thanks.
Is there any other discussion? Questions, comments? Okay. Thank you. Hearing none, all those in favor, say aye. Aye. Opposed, same sign. All right.
The matter is approved.
All right. Item number four, no action items. The Traffic Commission recommends that no action be taken on the following items. One, request to establish a four-way stop control at the intersection of Phaeton Drive and Wagnett Drive. Request to establish a stop control at the intersection of Pioneer Drive and Winthrop Lane. Request to establish traffic control at the intersection of Wisconsin Avenue and Holland Street. Is there a motion to approve?

The contract purchaser plans to develop an industrial subdivision on this land. Is there a motion to approve? So moved. Second. OK. Is there any discussion? If this were approved, would this be a part of some of what we've been discussing today? Would this go into that area?
Yes, it would, Madam Chair. This would be a part of the annexation of the property, and the next two items are also involving this property as well.
Would they go into the TIF district?
They're proposed to go into the TIF district, yes.
Okay, all right. Any other discussion, questions, comments? Yes, Alderwoman Tarina.
I'll just quickly say that I did have a meeting with Mr. Good that spoke tonight and I thought it was a great meeting. I just appreciate the information that he shared, the plans. I think I definitely felt more at ease with the project after the discussion with him. I think he made it very clear about rail service, being close to highway, being close to Any other discussion comments See none all those in favor say aye opposed same sign I
I voted. Oh, it says same sign, oppose. So I oppose. All right. So item number six, annexation agreement for 14XX Edison Road, 15XX Edison Road, 16XX Edison Road, and a portion of 8631 11th Street.
Motion to approve.
Is there? Second. OK, good. Is there any discussion? OK, hearing none, all those in favor, say aye.

Zoning Board of Appeal recommends approval from County AG to I-3 Airport Industrial Zoning District at 14XX, 15XX, and 16XX Edison Road in a portion of 8631 11th Street. Venture One Acquisitions LLC is the applicant. Is there a motion to approve? So moved. Second. OK. Is there any discussion? All right. Hearing none, all those in favor say aye. Aye. Opposed, same sign. No. That motion, that matter is approved. Item number 8, 52, or 25, 20, Driftwood Lane. Zoning Board appeal recommends approval for a variation to reduce the required front yard setback from 30 feet to 20 feet and 5 inches in an R1 single family residential zoning district at 2520 Driftwood Lane, Christian Solar's. You tell me. What is it that you don't want me to read? Oh, OK. All right. All right. Thank you so much. Is there a motion to approve? Second. Second. Thank you. Is there any discussion? Hearing none, all those in favor, say aye. Aye. Opposed, same sign. That matter is approved. Number nine, 8539 East State Street Zoning Board of Appeal recommends approval for a zoning map amendment from R1 Single Family Residential Zoning District to C2 Limited Commercial Zoning District at 8539 East State Street. Is there a motion to approve?
So moved.
Second. Is there any discussion? Hearing not, all those in favor say aye.
Aye.
Opposed, same sign. All right. This matter is approved. Number 10, 714 Broadway. Liquor and Tobacco Advisory Board recommends approval for the sale of tobacco products in conjunction with a tobacco store in a C4 urban mixed-use district at 714 Broadway. Is there a motion to approve?
So moved.
Is there a second? Second. Is there any discussion? Okay. Hearing none, all those in favor, say aye.
Chair, Madam Chair.
Oh, yes. I'm sorry. I missed you. Thank you.
So this one is essentially, like, they're not selling tobacco. I think they're just selling paraphernalia.
So Alderman Maturina, they are going to sell tobacco. It's going to be, they're basically, the cigarettes are not going to be sold, but they're going to sell the cigars, flavored cigars, and they are going to sell vape material as well. Staff did deny this. The initial plan was very vague when we first wrote the recommendation. Then when we got the revised plan, it showed that they were going to have a lot of glass bongs, pipes, et cetera. And then the applicant decided to withdraw that portion of his application at LTAB. And LTAB asked if that would change our recommendation, and we said no because it's kind of weird to have a tobacco store that's only selling something that's 10% tobacco and the rest, all these other associated type of uses that normally would be part of a tobacco shop. So that and the hours of operation seemed a bit strange to us.
like on the weekends, I don't repeat, I don't have to, the document's in front of me, but only open on the weekend until two o'clock in the morning. To me, the business plan, business model doesn't fit with what I think the direction of the building up of that community should look like. So for that reason, I'll be voting no.
Is there more discussion? All right. Hearing none, all those in favor, say aye. Opposed, same sign. Aye. Motion. This matter is denied. All right. Item 11, 501 East State Street. Liquor and Tobacco Advisory Board recommends the approval for the sale of liquor by the drink and the sale of packaged liquor in conjunction with a cafe, restaurant, and bar in a C4 urban mixed-use zoning district at 501 East State Street. Is there a motion to approve?
So moved. Second.
Is there any discussion? All right. There's no discussion. All those in favor, say aye. Aye. Aye. Opposed, same sign. OK, this matter is approved. Item number 12, 6075 East Riverside Boulevard. Liquor and Tobacco Advisory Board recommends approval for the modification of an existing liquor license to include liquor by the drink with video gaming terminals in conjunction with a restaurant and banquet hall in a C1 limited Office zoning district see to limited commercial zoning district and see 3 general commercial zoning district at 6075 East. Riverside Boulevard is their motion to approve.
Madam chair, I just like to let the got a late notice that the applicant wanted to extend his hours until 2AM so if someone would want to amend that.
Is there a second? I'll second. Is there a discussion?
Who made the motion?
You did.
I said no, sorry. Oh, you. I shouldn't have said that, but I did not make a motion.
All right, I'll make the motion. Is there a second? Hearing none. Okay. All right. Is there discussion?
Absolutely. Chief Sanders, can you, has there been previous activity or criminal activity past maybe the hours of midnight at this, sorry, are we on 13 or are we on 12?
We're on 12.
I'm on, okay.
So sorry. OK, is there any other discussion for item 12? 6075 East Boulevard? East Riverside Boulevard. OK, seeing none, we've got discussion. All those in favor, say aye. Aye. Opposed, same sign. OK, this matter is approved. Item 13. oh okay did anybody make a motion to amend the hours yes second okay all right so we need a motion to um on the item as amended and that is with the 2am OK. Can I get a second?
I just think we just need a vote.
Oh, we just need a vote? OK, all right. All those in favor say aye. Aye. Opposed, same sign. I'm saying aye. OK, that matter is also approved. OK, now can I go to 13? OK, thank you. 922 Kilburn Avenue Liquor and Tobacco Advisory Board recommends approval for the sale of packaged liquor and the sale of tobacco products in conjunction with the liquor store in a C2 Limited Commercial Zoning District at 922 Kilburn Avenue. Is there a motion to approve? Second. Is there any discussion? Alderman Bell? Is there any discussion? No. OK. All right. Hearing none, all those in favor, say aye. Aye. Opposed, same sign.
Aye.
Can we do a roll call?
I'm sorry. Chair, I had my hand up.
Oh, I'm sorry.
I'll be more intentional, I apologize.
Thank you.
I guess for this one, only why I segmented it, because it's like, if it doesn't go through, it's just going to come back anyway. I don't understand the power of committee sometimes, because all it's going to do is set it through with denial, all the other awards are going to reverse it, and it's going to pass anyway. The same thing we do every week. However, this one was interesting to me, because there actually, I was looking at the I think it was exhibit D, and I was looking at the amount of liquor in the area, and it actually wasn't a lot. You know, that seems like it. That's like, how could that be a thing? Because it feels like they're going to put more on every corner on the west and south side. But, so I think I'm, as of right now, I'm going to be a yes, but I could change.
All right, any other discussion?
As stated previously in many city council meetings, as it pertains to west side liquor stores, we'd love to see some type of fresh food access. It may not be from the customer going to get a bottle of liquor or tobacco. But it could be the individual who lives down the street and doesn't have access to a grocery store nearby. So it's been made clear that it's not a desire. So I'm going to be voting no on this one for other reasons as well, but don't need to state the reason. Thank you.
OK. Any other discussion? OK. Hearing none, all those in favor, say aye. Aye. Opposed?
Aye.
All right, this matter passes.
So wait a minute, say it again. Oh, OK.
OK, so it's failed. I'm sorry. This matter fails. Did another one fail that I? OK, which one was that? That I said it passed, but it really didn't.
Oh, OK. All right.
Madam Chair, point of clarification. Is this item still go to council? Thank you.
Okay, thank you for that clarification. I believe we're on item 14, am I correct? Okay, 3222 and 3208 South Alpine Road Unit. Liquor and Tobacco Advisory Board recommends approval for the sale of liquor by the drink in conjunction with a restaurant in an I-1 light industrial zoning district at 3222 and 3208. South Alpine Road unit. Is there a motion to approve?
So moved. Second.
All right. It's been moved and seconded. Is there any discussion? Yes. Oh, you're not holding your hand up. Oh, OK. Thank you very much. OK. Seeing none, all those in favor, say aye. Aye. Opposed, same sign. OK. This matter is approved. Item 15, 7054 Walton Street. Liquor and Tobacco Advisory Board recommends approval for the sale of beer and wine by the drink in conjunction with a restaurant and video gaming tournament in a C2 Limited commercial zoning district at 7054 Walton Street. Is there a motion to approve?
So moved.
Second? Second. Okay, is there any discussion? Alderwoman Tarina.
Thank you, Madam Chair. I will not be voting yes for this one either. I attended the zoning board meeting, as I typically do, and I wasn't comfortable with the business model from this owner, and this is another sort of like, cat style restaurant like just to get chicken and go and i don't see why a place like that needs liquor and gaming so for those reasons i will not be voting yes for this item thank you is there other discussion okay here none all those in favor say aye aye opposed no
This matter fails because we did not have three votes. Okay, thank you. Number 16, proposed amendment regarding committee chair and vice chair selection. Is there a motion to approve?
Madam Chair, this item was requested to be held out.
Yes, it was. Thank you very much. Number 16 is held out. All right, resolution. A request for authorization to allow the zoning officer to file text amendments for multiple sections of the zoning ordinance. Is there a motion to approve? So moved. Is there a second? Okay, is there any discussion? Seeing none, all those in favor say aye. Aye. Opposed, same sign. All right, so this one does pass.
Thank you. And there is, oh.
