Thank you. We'll go to the second public hearing, which is VACA 26-002. Public hearing a possible vote to recommend the approval of an application to vacate certain easements in town East subdivision located at 1692 U.S. highway 60 East. Good evening.
Chris Taber again. The Town East Center LLC is requesting the vacation of three easements located in lots one, three, and four of the Town East subdivision. The application by Town East Center LLC requests that three easements be vacated within the Town East subdivision. Each of these easements was created through the recording of the plat for the Town East subdivision in November of 2023. So quickly, I'm going to kind of show the overall easements, and then I'll go into a little bit of detail about each one individually. So there's a kind of a darkish orange line right here that extends across the entirety. That is a water easement. That's a five foot water easement for main with no main in there. And then the two red lines are the access easements that I'll be referring to. The first vacation concerns the 4,490 square foot portion of a 30 foot wide front cross access easement on lot three. The creation of the easement was necessary to ensure access was available for lots three and four of the town east subdivision. The purpose of the vacation is to adjust the placement of the easement in order to increase the overall buildable area of lot four. The new alignment has already been recorded and is in place to provide the legal access required for the lot. The second vacation concerns the 3,000, second, this one, this is the second, and this is the front one up here. The second vacation concerns the 3,000 square foot portion of a 20 foot wide rear cross access easement on lot three. This easement is not required as the front cross access easement already exists to serve the necessary properties. Vacating the easement would allow the property owner more flexibility in future development of the lots. And the third vacation request is for a five foot across water line easement extending through lots one, three, and four of the town east subdivision And this easement does not contain any city infrastructure, and there is no plan to place a water main there in the future. All of the lots in the town east subdivision have access to water from a main running along the south side of highway US-Sisty. The Community Development Department recommends the approval of the requested easement vacations.
Are these from the city? Is the city asking to vacate or is it somebody?
So these were recorded through a platting process. It's an older plat that was done in front of the PNC and so it was recorded through a platting process and so for vacation the city is required to participate as well.

Don, excuse me, Don Berry, professional land surveyor, Lee Engineering. We're the applicant representing the client who's developing the town east subdivision. These easements, as Chris said, were created by the Platte. They're no longer serving a viable purpose in regards to allowable development. And we're asking that they be vacated so that the client can redevelop the property.

Today we will do another P&Z 101, and Catherine will be doing that for us.
Oh, maybe go back one. OK. Good evening, everyone. We are on month two of PNZ 101. And so tonight, we'll be talking about commission duties. So on the slide, you can see this is a portion of Chapter 89 of the Missouri revised statutes. These do lay out the mandate for municipalities to be allowed to oversee functions for planning and zoning. We did talk about this a little bit last month, but some cities have a planning board and a zoning board. As we discussed, Republic does combine those into one for the Planning and Zoning Commission, but it does allow the separation if you'd like to do that. and then it also does require an ordinance to create that commission On this slide, we show the state statutes that allow the municipalities to adopt city plans as well as appointing commissions for planning. This second paragraph details what the required contents are for a city's zoning plan per the Missouri state statutes. As far as the functions of the Planning and Zoning Commission, we've broken it down on the slide in the box labeled related functions here. And then further into the applications that we have as the City of Republic that fit within those So the first responsibility that we have listed for the P&Z Commission is the responsibility of being responsible for physical development within the city In terms of the applications that we might see or that you've probably seen in your time in the P&Z Commission This could include preliminary plats vacations and special use permits The second responsibility is making and adopting the city plan. We achieve this through adopting of a comprehensive plan, adoption of a land use plan, and ordinance amendments to the zoning and land use portion of the ordinance. Republic adopted the SOAR 2040 comprehensive plan in 2021. The land use plan is contained within this document, and ordinance amendments are reviewed through P&Z and are related solely to land use. Section 89.070 of the Missouri State Statutes details the duties and appointment of a zoning commission. So this is the zoning portion of that planning and zoning set of commissions. Similarly to a planning commission, as we looked at on the previous slide, the zoning portion has certain functions that are separate. These generally include the creation of a zoning map, as you can see ours here on the screen. right hand side of your screen or a portion of ours that is these generally include the creation of a zoning map and maintenance of that zoning map this is achieved through re-zones plan development districts and ordinance amendments this slide slide number five shows an excerpt from the republic municipal code as it relates to our specific planning and zoning commission and the powers that the group has there as follows so to make amend extend and add to the comprehensive plan for the physical development of the city as defined in this chapter in this case it's chapter 400 of our municipal code to exercise control over plotting or subdividing land within the city as defined in this chapter to make and adopt a zoning plan and recommend or disapprove proposed changes in that plan, and to promote public interest in an understanding of the comprehensive plan and of zoning and planning. So as you can see, with our combined planning and zoning commission, we really tie these things together. So that does conclude the commission duties for P&Z 101.
