I can do that. So, uh, BZA 2525-23, Julia Blount and Beachfield Properties LLC. Uh, Julia Blount and Beachfield Properties LLC 10859 3B Road, Plymouth, Indiana 46563 and 1619 North Oak Drive, Plymouth, Indiana 46563. a variance of use to allow for a car wash at a property located at 2155 Oak Road and 2131 Oak Road, Plymouth, Indiana 46563, identified as parcels 5042 31 202 uh 004 triple 019 and 50 42 31 2028 triple 019. Uh 5042 312027 triple000019 and finally 504231 20200 90019 zone C3 corridor commercial district thank uh so for the request the variance of use is to allow car wash on those four parcels zone C3 corridor commercial district. As you can see here, highlighted in yellow, those are the four uh parcels. Um, Miss Blount owns the northern business, the main parcel, the parking lot to the south of that, as well as the grassy area to the west, and then Beachview Properties owns the house in the southeast corner. The proposal is to put a car wash on the property. um understanding that you have a site plan in front of you, that's not what what is being approved tonight. It's whether or not the use is being permitted or not. So, they were able to provide us uh one of the site plans that we've kind of come towards at this point in time uh with the big white box in the middle uh being the car wash and the

loop center on the south side, but we'll get into the details in a little bit. um looking uh northbound at the central portion of the property where the main entrance is and then looking south and then we travel to the far southeast corner and looking north and we pan westward uh through the uh house parcel uh looking back past the house and the detached garage on there. And then for context, what's across the street and acting at the intersection? Then we move north and begin to pan from west to north. Then we move up to the intersection in the northeast corner. Uh looking west along US30 and to the intersection itself uh do west along the north property line and then uh southbound and looking at the uh traffic. And then as we head westbound on the property, we are now in the northwest uh corner of the property. And then we begin to pan uh southernly as we come across. And then we relocated to the northwest portion of the property looking east. Having remember all the cardinal directions when pictures taken. Um and then we pan north uh along the property line here. that would be in line with the northwest corner. Currently, we're in the middle of the property where that back grass lot is. As you can see, it continues to go back uh towards the railroad tracks beyond this uh tree line. So, as you can see, there's several arrows that are going on within the property. Um, as you can see, they enter on that central uh driveway. And then you have the stalls that go into the car wash portion, which would be the

southern portion of the building. And then you have an interior and exterior uh vacuum options. The exterior being up towards a road. The interior wraps around the building. So you would head north west and then wrap around heading eastbound into the building itself. And then coupled with their operation is a oil and lube center on the south side of the property. Okay. Um so getting into your portion this evening is about the uh zoning classification itself. On the lefth hand side you have the standard development standards uh impervious coverage setbacks those sorts of things. But on the right hand side, you have the list of permitted uses and special uses. Um, the building commissioner and I had an extensive conversation about kind of where would this uh potential use begin to fall. And when you look at just this zoning classification, um, the zoning administrator has the ability to determine whether or not it meets one of those classifications. And when we looked at it, it makes sense for it to begin to fall in towards uh, automotive repair. uh and services. And so there's that classification to it. But upon further research within the overlay district, there is a designation for a car wash. And that overlay district does not touch this area. And so because when the overlay district was created, the thought and consideration is that they were well known that that was the only place that they wanted to put a car wash was within that section of overlay district and nowhere else. You can't default that they didn't think of putting it in the base zoning district. And so that's kind of where this project begins to come about of why it's here specifically. So from an analysis standpoint, the applicant is seeking to permit and approve the use of a car wash. The use is not listed within the standard zoning district, but is mentioned within the overlay district. So it creates a complication within the use table. The applicant is uh proposing a tunnel car wash, a climate controlled indoor vacuum facility, outdoor vacuum stations, and an oil change and loop center. The operation will be open 7 days a week with Monday open 7 days a week with Monday to Saturday operations from 7:30 to 8:00 p.m. and Sunday hours from 8:30 to 7:00

p.m. There will be a maximum of eight employees on the site and the site plans were discussed with multiple revisions over several months ultimately concluding with the site plan shown within the application. So the decision criteria which you have to base your decision on this evening includes the general welfare, the adjacent property, practical difficulty, unnecessary hardship and comprehensive plan. So for criteria number one, the proposed car wash, uh you should not be injured to the public health, safety, and general welfare, but the design is not the most safe design, but is a result of accessibility coordinations. Uh criteria number two, the use and value of the adjacent property may be impacted um by this use. The no criteria number three, the strict application of the ordinance would not permit the proposal, but the plan commission will be hearing in 2026 amendments to permit car washes uh by right uh within the property zoning classification. as a result uh would not have gone before the BCA should those amendments have been adopted by city council prior to uh the company's application. Uh for criteria number four, the strict application would not permit this proposal. And criteria number five, the comprehensive plan through the future development character map supports regional commercial. The plan indicates that it's a hub of retail and service-based businesses, beckons visitors to explore on foot, creating bustling atmospheres that drive economic prosperity. Uh the secret lies in its smartly designed layout where future development is encouraged to prioritize smallcale to sight designs promoting internal vehicle uh connections that minimize traffic impacts on major roads. Uh the savvy approach ensures a seamless experience for both patrons and businesses fostering a thriving ecosystem of commerce. So for the recommendation based on the information provided and reviewed by staff, staff would recommend approval of the company being able to construct a car wash. That is up for board termination. Well, you know, we've been asked for I don't know how many years. our marketing department tells me since we started in Southbend uh 30 years ago, but we've been asked to be in your your community for a long time and and frankly we I always thought it was a little too small for you know for what we do and I was afraid to uh to build $15 million worth of operation in a smaller community. This is not your typical car wash you know that they would build for $3 million. I mean our indoor the big space that we have is just nobody in state of Indiana, Michigan or Ohio u they're building a couple in Chicago but nobody does that portion it's it's a very expensive um just requires a lot of customers and so as we were successful building in Niles Michigan which this one actually mimics that exact location um I thought well that's a really small community so I guess you know uh could we could do well Um, and then this site came about and we're always about location. I mean, naturally, you know, if you're going to have to spend that kind of money, you can't be hiding behind something. It's not going to work. And, uh, so, um, Julie's location became available. Actually, my wife and and so she she told me to make sure you talk to her and then she was under contract with something else when, you know, we first considered it and that didn't happen and then it was available to us. And so, we're delighted that that it's available. And so to fit everything we wanted to do, we had to also combine the southern part. Um, and it would be helpful for me to maybe for those of you who don't really know the operation. So the cars as they come in as they come into our operation they stack up what against an unlimited um two lanes of it is the unlimited members and one lane is the pay as as you go station. So uh typically about 80% after

about a year of operation about 80% of our business sometimes 85 depending on the location is the unlimited membership and that gate opens in less than in under 5 seconds we say two uh but worst case scenario five um it it reads your license plate and knows that you're a member gate opens and you go through so stacking is never this is a lot of stacking you know relative to what we have in other locations but so stacking is never an issue. So you go through and you basically this being the car wash you come out. Now you have a couple of options. You can leave, you can vacuum outside or you can go back around and we always make the floor in the same direction so that we don't have cars colliding. So like we wouldn't want to have come out here and instantly go into this building because that would create a bottleneck. So we did a lot of space for stacking which never gets filled up but just you know it just makes more sense. We got this idea by the way from Germany. Uh and you come in and you go through and that building is uh basically for members only. So you have to be a member to go inside there and uh in there you get everything. You get free towels online and in fact we encourage you to take it home. It's got a logo on it. It's an advertising uh people do. So uh free free towels, free window spray. Every station every station has its own dedicated uh window spray. It's on dedicated vacuum on both sides. It's on dedicated mat machine that we import from Germany. So when you have your mat get dirty, you put it inside there and you can shake it and you know it just does all that for you very quickly. And every station also has a air tool. So you can split you can blow air underneath your like mirrors trap water underneath the seats if you want to paint up with a vacuum. You know vacuums don't fit underneath their air air ducts or whatever. So we give you all all of those tools to practically I don't want to call it detailing your car

but and it's a climate control. So as you can see outside today I mean this is not a place that you can go outside and vacuum today. We provide that uh and then to enhance it more because we know that oil change is another one of the routine maintenance things that you do you combine it with an oil change and if you do get an oil change you get a free car wash. All right. So, my name is Andy Beckman and uh I own the property to the west of Sherwood Tire. I've been Julie's neighbor for 30 years there. Um, I've used Haji's car washes in South Bend and and I'm in favor of the car wash there. I'm not opposed to the car wash. The only thing that I'd like to bring up is in the the picture there, there is an easement to the north of what Sherwood Tire is right now. That easement's 20 foot. Um, I've used that property or Julie's property to to go in and out for the 30 years. The road that we use is 20 foot wide. The easement says 20T ingress egress. I guess I always assumed that was the road. Apparently, it's 20 ft. That's from the fence, 5 ft of grass, which leaves only 15 ft down of pavement. So, I've worked with with Robert and Ty to to put a proposal together with [ __ ] and maybe we can get that wider because a 15 foot road with a car that's 7 and 12 to 8 foot wide trying to pass each other is already over the limit. You would be in the grass or you would be somewhere else. Um, and if you had a fire truck having to get back there or anything else that was large and cars coming and going, it would be very difficult. um with just a 15 foot road. So I think that's the only thing I can say that that I think needs to be changed or we can do something about

This is a request for advance development standard uh to allow a sideyard setback reduction from 20 ft to 8 ft at 2155 Oak Road, Plymouth, Indiana. Uh so what we're talking about is so we just proved the car wash or you just proved the car wash and the specific location that we're talking about is here highlighted in blue but more specifically we're talking about this red box. The dash line represents the 20 foot setback on the sideyard. The project brings that within 8 ft of the property line which is the solid uh black line on the bottom of the page. So, we took the few pictures out that represented this portion of the case. So, as you begin to spin, this is the area that we're talking about on reducing it from 20 ft to 8 ft. And then from the rear, kind of seeing what that looks like from the rear portion of the property.

So, they'll enter this is where they'll enter from the uh so they would enter approximately where the sign is, right? um more or less across from the frontage private road that leads back to all the businesses across the street there. Yeah. So um I think there might be a slight skew in terms of alignment uh with those

It's simply the setback on whether it can go from 20 to 8. Right? So, bird's eye view over that space again. But that's what's confusing. Go back. So you would enter at the center portion of the property, travel back approximately halfway and then turn south uh into either a the parking zone or to the west or east towards the uh loop center. And we're only talking about this the side step back, not the entrance way. Correct. That's right. I just want to make sure everybody's on the same page.

Yep. So with that space for the analysis, the applicant is seeking to reduce the side guard setback from 20 ft on the south side of the property to 8 ft. The applicant is seeking to permit a car wash under a separate proposal and a part of the property development is in creation of a loop center with three bays. This specific proposed variance is for the southern uh property line setback and the reduced distance to that loop center. Uh the corridor commercial district requires a sideyard setback of 20 ft. The current house which is where the approximate location of the loop center would be is 15 ft from the property line based on beacon. The accessory structure is less than 5 ft from the property line and the adjacent commercial structure to the south is approximately 60 ft from the property line. All sharing a minimum 20 foot setback requirement. So the decision criteria that you base your decision on tonight is based on the general welfare, the adjacent property and practical difficulty uh for that process. So for criteria number one, the proposal should not be interest to the public health, safety and general welfare. Uh for criteria number two, the use and value of the adjacent property should remain minimally impacted because of the setback reduction. Uh but for criteria number three, the strict application of the ordinance would not permit the proposal and the proposal is self-imposed and is not a result of practical difficulty. So for recommendations based on the information provided and general description of the proposal, staff would recommend denial. So for board determination staff would recommend denial for this process. And that's everything I have for this one. Any questions for staff?

Gotcha. um if you could put up the whole picture of the and I will explain why there is a practical difficulty that's really the main issue with this uh and there's a financial hardship if we don't we don't ever have we've never built a facility with less than three bays of oil change again having spent this kind of investment uh you know if we were going to be doing this u making it a two bay um very inappropriate it would stack up our customers it would just delay the processing time it would not be the way that we operate. We're the only old change that I know of in the entire state of Indiana or Michigan. So when you come inside of our loop center, that's how time oriented we are. When you come in on the on the back side of the wall, we have a timer. We actually even have a video screen that shows a picture of the what they're doing downstairs that the customer sees. There's a split screen. They see the basement and the upper section. So, um, to be very time oriented, we don't want to make it look like we're just finished and we didn't do hardly anything. They can see everything by looking at the downstairs and upstairs. And so, the timer is here. Customers don't see the timer. We do. That information gets sent to corporate. And we expect a 10minut cycle. We run over that. 12 minutes is really what we're averaging. Uh, you go to any other oil change, 45 minutes is about what you would expect to see. So, we're being that time oriented, having a two bay oil change would would be a no-go because I don't even know how we would process cars, you know, with only two bays. Uh, and so the reason this building is not shifted north cuz we have, if you see, we have plenty of land here. We could shift the entire thing north by at least 20 ft and get out of this is because there is an easement that runs through right here and it's adjacent to that edge of our building. It's literally attached to it. It's a 15t easement for utilities. There's a

existing um I don't know how big the pipe is. The the uh there's a storm and and uh gas and gas and electric

and but I don't know how big that pipe is. It's a big pipe that brings water from across the street and it brings it to the west know somewhere back here I guess is where it dumps. So we can't physically shift the loop building because if we shifted everything this would come out of here. um and we can't because you know this easement goes straight back and eventually turns back and goes goes that way. Uh so that's the practical difficulty for the site is that that's an imposed condition that we would honestly not have to obey because and we could leave Andy's uh access you know uh untouched because there's perial land. So you see this huge landscape area that we have that could be shrunk to a shallower area and it would allow us to do that. So to me um you know going back to the conditions that why a variance is is is makes sense um those are the reasons that I would feel um the combination of not being able to operate with the two bay uh oil change um not being able to push it up any further north um and this massive investment that we're going to make that would just not be justifiable you not having a three bay change it's it's integral to our operations. 25% of our revenue comes from the oil change and 75% from the car wash. And that 25% adds up quite a bit because we don't really have any extra overhead. It's, you know, once once you build and you have the general manager of the operation, a lot of the overhead is already absorbed. And so having that additional profit center, it's just it's like having a meer or any other site where you have multiple profit centers inside of it just that's how they can justify building a big site like that. I have no other.

So, uh, the only problem I have or I see or question um, as assistant chief in the fire department is the easement. So, I didn't know if there's any kind of easement to the buildings. Are you talking about the north? You're talking about the north easement, correct? And we're talking And that's why I said we're talking about the south easement right now. Right.

Um, so, and to make sure I understand, you're talking about uh just getting emergency vehicles back around another another way,

The setback on the southern portion of the property and the setback on the eastern portion of the property. The north side of the property is an easement that's been

So it's a part of that um structures definition is what the proposal is for is an accessory structure.
