Very good. Uh, Dan is not with us, but we do have a stand in. Yeah, I'm going to be filling in for Dan tonight because he couldn't be here. We do have three bid packets for street paving projects. Are there any other bids? Okay. Uh the first one is from EMB Paving Inc. in Rochester, Indiana. Okay. There are various portions for this, but the total bid price is $1,847,750 69 and I'm not going to go through all the required forms. We can review that the completeness. The second bid is from Milestone Contractors LP from in Southland, Indiana. also have the various. The total for 2026 street paving projects is 2,32,643.98. Should I be Yes. 2,32,643.98.
So 2032 643.98. And the third bid is from Reef Riley Construction in South Bend, Indiana. The total for 2026 street repaving projects is 2,167,900.2 $2,167,900. And I would recommend that you authorize city engineer Dan Cyers to take these bids under advisement to review and bring back a recommendation to you. So move.

Uh Samsung could be the Samsung. Okay. Um this is the lot in question. Basically, it was the roof off and the ceilings collapsed. That was
on March 20th and that is today. So, and when I spoke with Abraham, he was in agreeance that he would take it out. We demo the unit. It was still there. So, by law, we have to have a hearing on it. So he this was just recently he agreed to take it out, right? This wasn't part of that first patch that we talked about last year. This is I noticed this on March 20th when they had the So this is new
the water leak and I called him and he said not a problem. He would demo the unit but legally we have to go through the procedure. So this is the hearing looking to I guess approve the demolition order. Affirm the order. Affirm it. Is that what we would need to do, Jeff? Yeah. And did your notice indicate the hearing? It would be today.
Okay. Then once again, this is an evidentiary hearing, not a public hearing. So if the property owner were present and wanted to present any evidence, you would give them an opportunity. Since he's not present, then the only evidence you have is from Dennis. And uh you have the option to affirm, resend, or modify the order. I don't think he's online. I I'm surprised actually. He was notified. So So he's notified.
He is notified. He's he's signed for the receipt of the certified mail. He is aware of it. So is that but then it goes to a public hearing after? No, there is no public hearing. It's only the evidentiary hearing. It's an opportunity for the property owner to contest the order and to present evidence why you should not affirm the order. That's what's happening right now. So if we affirm it then then he has a certain time frame to actually complete the process. I mean he's indicated he's going to do this but we want to make sure he does it and that's why we're doing this. Right. I'll make that stuff.

good evening. Uh I just uh wanted to come up by not thinking they had any questions over the amendments to the rules and regulations uh that should have been in your packet. Just some minor changes from what I see, right? Yeah, it was mainly just updating. Um it had been quite a while since they had updated. We had the rescue department in there that we haven't had since the early 2000s. Um and then just some clarifications on on other things. Um but nothing that was drastic. The only question I have is does the volunteers call under the same rules and regulations?
Uh to a point, yeah, there are things within the regulations that do pertain to them, but then there's others that pertain just to career staff. And are we combining them here into that situation? I see if volunteers are doing I don't know. Yeah. No, I mean these are the rules that we've had for for years. And so I I didn't make any changes that had anything to separate or combine or anything. Everything as far as anything with the volunteers and the career being separate or together on different policies in here are the same as they were before.
So I mean there's two entities. I just did, you know, where the volunteers had their own rules and regulations and then full-time and part time. They to a point they have their bylaws that they go by that is a lot more of um attendance and uh some training and things like this. A lot more of these rules and regulations more on conduct and um okay and just job related things. Okay. So, you're looking for a motion to approve these changes, right? Correct.

I I told Chief Weir that I would give a quick update. Um after the last meeting, you were presented some information about uh budget and uh expenses for personnel. Um clerk treasurer Lynn Gorski had some questions and concerns about those numbers. So we did have a meeting with Chief Weir, assistant chief ammonizer. uh myself uh member Culp and clerk treasure Gorski uh we reviewed some of those numbers. You know the I I I think it's fair to say that the bottom line is it's really impossible to say with staffing with some officers being potentially out and the time it will take to replace them. Um it's really really difficult to say whether the current budget will be able to accommodate a 26th officer for the full year. We won't know that until near the end of the year as the clerk treasur can indicate whether there's enough in in the uh the funds to cover those expenses. So there is a possibility that if you approve a 26th officer that it would require an additional appropriation before the end of the year. Because of that, uh, I am recommending that if you approve for the chief to hire officer, as some of you have indicated that you support, uh, that you do it subject to the council approval. You ask the the council later to approve that same request because they're the ones who are going to have to approve an additional appropriation and they will have to approve the 2027 budget to accommodate that 26th officer. Dwayne, you were at the meeting. Is that a fair assessment of the
It is. Um, but and and as I stated in the last meeting and I stated there, you guys need it. I get it. But I think is being a being conscious with the money that we have doing an extra appropriation without knowing where we would stand. That's hard for me to say yes. And the other thing is I'd really love to see what's going to happen with the high school first before we do anything else. That's kind of where I stand with.
Yeah. And and just an update on that, the agreement with Plymouth Community School Corporation for the school resource officers actually expires at the end of this school year and we'll have until August, the beginning of the next school year to negotiate a new contract to determine how that uh arrangement will proceed in the future. Do we know if they're going to stay with two officers or want because when I had a We have a meeting scheduled with the school corporation so we'll be able to answer those questions after we have a conversation with them. I I don't know right now what their intentions or or preferences are. And our meeting is next week if I remember right.
Yeah. Yes. It's coming up pretty soon. That'll be with um um Ward Buyers who is their director of security. And I I don't know who else from the administration, but Ward will essentially be leading that effort to the school corporation. I would think at the very least we should get some type of verbal agreement so we can proceed with our our 27th budget cuz that's going to be due July, right, Lyn? Started from June. Yeah. Oh jeez. Really?
That's like soon. Well, we actually need to start ref. Yeah. I I would prefer to not put an officer on for the rest of this year, but look at it to put it into the budget for 27.
I'm going to second that. Um could could we retain this until we hear what the school's going to do? So if that's what you choose, in my opinion though, yeah, we could do that and if that's what you want to do, we could. But because we are fastly approaching the June talks, my suggestion tonight either we we say yes or no, get it off our agendas work. So, but we're going to be diving into this in very short order. Any we have more than just one problem here. You also for him 26, Chief Holl wants three and there's problems there or two that we need to resolve. So it it's just not a single thing.
No. Well, there's things too. Yeah. Outside of those go down the tubes, you know, and and and and it's not against anybody. It's just that we don't know where our dollars and century are going to be, you know, if we to me, I can be dead wrong. if we table it, let's see where the school goes and and what they have to offer and and then let's reentertain it and and let's get it going cuz John's even made comment. We're they're going to be down two officers. They're going to hire one. So my concern is is if we don't know cuz my understanding is is that you have $44,000 left in that budget to run to the end of the year. By the end of the year, that's what you have. We normally turn in 5% of our budget. That's less than 5%. We're down to 4%.
But that's with paying a 26 officer. Yeah. Right. So, we still have money left. And then I don't understand I still don't understand where the school resource officers come into this play. That is budgeted. They're paid the same no matter what. for 181 days. John, we still pay their wages. Their wages were included in this 25 officers that we already have. Nothing is going to change as far as money towards another officer out of the resource officers. You understand what I'm saying?
Yeah, I understand. I what I'm going to say with that, if we wait till that comes into fusion, the bottom line is is maybe we'll have more money. Maybe we'll get But that goes into the general fund that's paid out different. That's correct. And it's already budgeted out of your budget now. Just like old field, just like all the other ones. They're all out of that. But then we're back to the appropriation. Yeah, you would. And for me to take money out of an additional appropriation, I want to see where we stand with diplomatiz. That that's all I'm asking, John.
And that's so I got a question regard. So the money we received from the school corporation doesn't go into his his budget.
The money that's received for 14 different departments that are in the general fund go into the general fund reserves. Okay? Those general fund reserves and or the general fund tax draws are what are able to make your appropriations for spending. So that whole bucket of money that's there for the general fund is divided by 14 different departments. Yeah. Right. So So it's there but it's not in the police budget. It's in the general fund that funds his budget and not for the indigation.
I tend to agree with Don that um we should wait for the school's negotiations and see how the year plays out and plan for it. look at it. What's our budget once we know the amount of money or taken from our from the state?
I thought so. I know it would be disappointing, John. And I also think we should have a 26th, but another thing that came to light was that we're the officer that was leaving is not leaving now. And part of my in my brain, I was thinking there's going to be a lag time in um salary for that position. By the time you get the 26th hired, we'll have gone through a couple months. That's two months worth of salaries. That narrows that end of the year thing a little bit more. And that's the only thing that uh that and um I agree we but I want we want to really go into the 27 budget process having all these answers and so that we can advocate for our 26th officer beginning of the first of the year. So, um, because the officer is not leaving, it's mining. You know, that was part of that money that I could see us squeaking by through the end of the year, uh, with our current uh, and if we do pass it tonight, then, like Jeff said, we're going to ask the council at the next meeting to go along with the additional appropriation potential. And then they're gonna probably say, "Well, we don't know what, you know, I mean, it's this is a difficult time to make this decision right now." Up until I heard that I didn't that just came I just got that information about an hour ago. So that's I you didn't know that probably either. Yeah, he's not leaving. Anyway, that's where I stand. So with that being said and and what I've been hearing what we're hearing the conversation we agree down the road we we want a 26 officer but we believe I I believe I'll I'll speak for myself. I believe we're
best to put it into budget for 27 take a look at it. I know there there would be an impact maybe uh hit the reserves a little bit you know if you want to do these type of things but I I feel that this will give us time and then we can start advertising for an officer in the fourth quarter with a higher int intense intentional hiring for first quarter 27 correct we can start that process approved we typically approve the budget what month is that September yeah we're in the middle of a process now because we started the process.
But I would I would I'm going to make a motion that we deny the request for the 26 officer for 26 but put it in towards the budget for 27. Is that a motion? That's a motion. We have a motion. Your first to come from Nylish Patel from Red Rock in uh request one um to extend or yeah the extension of his demolition order because of a court date and the second request from them is uh in regards to high water and sewer bill.

Okay. 2550 North Michigan Street, Indian. Thank you. All right. I'm here for the extend the holiday because of the heart rate for the addiction. Okay. for the restaurant. So, I need at least couple month. Um, Dennis, can you come up please?
This uh remind everybody of the dates that are pending right now. Request that Mr. Patel asked the city to extend back in November. He agreed to have a demolition permit issued by May 1st. Okay. Have a $500,000 bond to the city, which Have you done that by chance? Have you done the shy bond yet? Uh yeah, we apply and you applied for it.
Yes. Because see whatever the letter says on November 24th, I don't receive that copy that time. So I think if you guys mail it to me or something or I handed it you guys hand it to me that day to you that day. It was very No, I handed it to you on November 24th at the meeting. Okay. Yep. I think we talked we talked about this. You admitted you didn't read it very well. No, I have that letter and I called earlier to Mr. But you are Tell me again. You you you've applied for one. When did you do that for the letter or the shity bond?
Oh uh I can provide you within week. I have that letter. I apply uh in one of the South Bank company. Okay. When did you do that? Today. Today. Okay. In the morning. Yeah. Okay. Let me show. That was supposed to be done within 30 days. I'm just reminding the group here. That was supposed to be done within 30 days. He was supposed to have the property completely secured. at the time that we agreed to the request uh a dem demolition order issued or demolition permit issued by May 1st. Demolition started by June 1st and so
we do not have the assurity bond. Yep. So as far as I'm concerned he's not fulfilled his part of the agreement. So the Oh, he secured it for the most part. Yeah, for the most part. But he did not do the shy bond and he didn't do the uh but and he's and he's asking today May 1st is going to come soon enough and there's a reason you can't get a demo under contract by May one. What's that reason? Oh, for the We're waiting for the court like a restaurant. You have a court date on May one, right? May 1st. Yeah, it's and that's yeah big
and that's why we call the demolition guy we almost ready but as soon as we have a court order in our hand then we can start like one two three here if you want to apply I can apply tomorrow like permit um is there a reason he didn't start the eviction notice soon no the court extend couple time there is some other reason I don't know but they say they have like a small court to the other court they move then one time they request something something like the guys from Mikamino so they extend like a so the court allowed extension to May one
y and but you've actually started this process back in okay yeah Um,
uh, wow. Right in November. Uh, March 19th of this year is when it's dated, is when it was ordered. So, according to the court records, the complaint was filed on February 26th. Um, claim filed on February 27th. It was um was actually Sunrise Hotel of Plymouth, Inc. filed the motion for continuence for the reason that they had not been able to obtain service on the defendants and uh services required before they can proceed. So that was I'm sorry, Joe. Services on what?
Service or process. They have to um deliver the notice, the summons to the defendant before they can proceed. And because that had not been accomplished yet, um, typically that's done a personal service where it's sent to the sheriff's office and then they have a process server um, who delivers it personally. Sometimes they get delayed and there's no reason indicated, but um, it was filed properly. The summons was filed properly on February 27th. um because it had not been served, they requested a continuence of the hearing. It is currently scheduled for May 1st.
It show continued a couple times. No, there's just one continuence. Um originally the hearing was scheduled for March 20th and it was continued because uh service had not been confirmed. When was the original eviction eviction not uh February? It's on Was that the February date? Yep. That's when Well, that's when you first leave.
Was it done by court services? Was it done by any private individual? The attempt uh service by sheriff And it looks like just today service was returned service date of April 9th.
Okay. One thing that was mentioned also was that one of the reasons why you can't get a contract with a demolition company is because they weren't allowed inside the restaurant commercial building, right? Is that correct? Are is this your uh Yes, that's what you want. Do you mind coming up? Is there my question I guess would be is can you give a price? Oh, yeah. I'm sorry. Okay. My question is, can you give a quote and get it under contract with Mr. Patel without going inside that and seeing inside that part? It'd be advantageous for the accuracy of the quote to go inside and actually assess the property, see what's going on. Exactly.
Okay. So that's that's what you've told me that you were not able to get uh which would make it hard to get under contract. Um so that's his problem. And after May well you'll have a preparing date in May 1st. Then I don't know how long it takes to evict after that. Depends what the court says and it may not it might be 30 if they rule in that way and they could rule differently. 10 like Mhm. on my location. Yeah.
Okay. So, we in my my head here, I'm I'm thinking that we've got and then you're going to ask us about the um the utility bill as well, but we'll hold off on that one for right now. Separate. In my mind right now, I think what we're trying to decide is uh is he will we he's asking for an extension based on not being able to supply a a quote and get under contract the demolition. Also, we know that he hasn't been in compliance with the shity bond. I have an application. I don't know. I just Does that make Does that seem legit? Like this is a
It's just an application. Is the dollar amounts correct? Because I see it's 168,000 contract price. What's for the just the uh hotel? We were asking for a $500,000. Right. Right. Is that on here as well? I didn't application. He doesn't have it yet. But it is okay. So that part of the problem could potentially be a fine probably. Is that right? According to the agreed upon letter, he had 30 days to get us that. He did not. And what's the consequences of that? Then all fines were retroactive.
Okay. And and that would be what would occur if we uphold the order. Correct. It's kind of a pretty good limit here honestly. Uh because we can't and I understand the circumstances with the court date. Um, I probably shouldn't, but I'm going to make a suggestion. Get closer to the mic, please. Probably shouldn't, but I'm going to make a suggestion. He has the application. Even though he was supposed to have it in 30 days, he did apply. I would table this until the next meeting.

yeah, when I was a first time council member that I did that too, Dave. Sorry. I got called out on it. Yeah. Had to do it. All right. So, um, all right. State your what you're asking today for that, please. There is the last couple. One is a 2300 and other one is a $4,9187. We never seen that deal. Correct. How have you been when the property is active like you know what I mean? So we Sorry.
That's right. So we mail these invoices email or mail. They're mail to New Jersey address. Okay. So, they were mailed to New Jersey. I don't think he's disputing that he got the mail. He got the bill. He's asking, I think, correct me if I'm wrong. Mhm. Um, because you had a water leak. Sorry. You had a water leak, right? And that caused your bill to skyrocket. No, it was a Yeah. One time, uh, the restaurant guy called me. There is something leaking over here. Uhhuh. And one time like a police department. Same time the police department notified that.
Mhm. And they called the restaurant guy and they called me. Then I came same night I drive came over here. I called them like a utility department and told them to just cut up because as soon as they closed the restaurant that night and we can fix it that night and they said no they cannot stop that water they can come next morning. So we check there is a half inch pipe. It's came out from the like joint something in the utility room upstairs and we fix it in in a minute. So that probably corrected and that's your bill after that month has gone back to normal
right but I don't think so that's the problem. My think like that's something wrong with the mirror is that keep running when we chat everything cut off last time I called the utility guy they came up there at the property little it's still spinning okay everything off still it's spinning so um he's claiming maybe there could be a problem with the meter
we historically test all the high meters uh every five years. Uh this was checked uh in April of 2023. Yeah, 2023. So, and it passed inspection it was uh did meet all AWA standards. Um I think where the the confusion is or not confusion but this particular case the uh the um the main meter um is on the 6-in line feeding the uh the hotel and the restaurant and then there's a meter in the restaurant which is a deduct meter off the main meter and then the restaurant pays for that much and then that amount is deducted off of Mr. Patel's bill. Now, um it it uh indicated a leak. Uh Mr. Patel said that he was there today and it's uh it does not show a leak. So, um we have not been able to find any water um other than the one that he alluded to as far as when the police officers contacted him that uh there was a break in one of the apartments that they fixed the next day. Um for that to um it is a lot of water usage. um the uh um if it was fixed and uh we can't find any other sources. Mr. Patel said he's went through all the buildings. He cannot find anything. There is not any indication of a high usage on the u on the restaurant part. So I uh we have assisted uh with Mr. for Patel's um uh permission uh we did attempt to locate his line out throughout the facility to give them an idea where where um the line goes and and also provided a um just tonight a uh company which can do leak detection. But um if the meter is not indicating a leak
uh today um it would kind of be a waste of of funds to try to find a leak that potentially is not there. I have no idea where the water could be um or where it's went. Um I have no idea. So your opinion the meter's okay. My opinion it is. Yes. Um we can't have it tested again. That would not be a problem. Um the problem is is we're spending money on a meter that's going to be eliminated here switching. So, did you pay that bill even though it's high or no? Last bill I pay. It was it $2,300 or something? I pay.
Okay. After that, that's so high bill. So, I came to you guys in a meeting, right? Remember? Yeah. We have a personal meeting like explaining everything and you say, "Yeah, you can put it in board." I bring that bill to you like $4,900 in your office. Mhm. Yeah. So that is the bill last one. Well, I didn't say I said you'd have to bring it to the board of works. Right. Right. Right. No, I understand. Yeah. Yeah. So when I came today in the morning, I check there's no spinning. The meter stopped. It's not spinning. So maybe it's corrected now. I have no idea. Last time nobody go there. Nobody's closed, right?
So it's it's confusing. We would like to take another look at the meter. Um, there's a leak detector that's built right into the meter and if the uh the uh indicators uh spinning, just like Mr. Patel said, we kind of showed him how it works. And uh if it's not spinning, obviously there's no leak. So where the water went uh beyond me. So
what was that? And if it wasn't outside, it went down the drain. Yeah. Right. Is it a possibility that the leak leak that you had was running for longer than you thought is causing that higher bill? It it seems odd that two months back to back it would be high because even the 20 what? $2,000 that's even higher than normal, wasn't it? My normal bill used to be $1,500 to $2,000 when it's operating the motel. Yeah.
But now it's closed. last bill I pay $2,300 something and now last latest one is at $4,900. Now, according to this letter, you show that you paid $4,900, but then on March 31st, we received a notification from our our bank that you stopped the payment, right? Because of the we put it on like uh I came on 26 March and we put the like for meeting like uh complain and something. You put a stop payment on after you had the meeting with me. Is that what you're saying? No. No.
Um, so at least might be it's my suggest just give it to me the credit for like a sewer bill maybe sewage bill or say that again like a whatever the wastewater credit problem. The only way that though that we can issue a wastewater credit is if we determine that the water didn't go down the drain. If the water went down the drain regardless the water is processed. But if a leak was found and it's leaking into the ground or a storm sewer or whatever going out to the creek, then that would qualify. But at this point, we don't we don't know leak. We don't know where it is or anything.
Okay. If this could wait um another meeting um I I would have somebody come in and test the meter uh make sure that of the accuracy. I'm pretty confident that it's it's you know accurate, but um I think it probably cost $500 $600 to have it tested. Um we'd also go out and uh take a look at the meter and the leak detection on the meter before they even come. But that's just I don't know how quickly you want to get this resolved. I know it just keeps adding up. So you mean tomorrow morning maybe? Yeah. So we do
we do we have a policy to disconnect and you've got one bill that hasn't been paid but you have paid the bills after that. No nothing's been paid after that. Okay have that stop payment payment made by Friday and it has not been paid
so March. So right now because there's a penalty added to that account. So the letter was issued on March 31st because he stopped payment on this on March 2. The AC came out of his account on March 27th. He stopped payment on that and we uh received notification from the bank that caused a $2459 return payment fee. And now that that and that was supposed to be paid by uh this past Friday, April 10th, it has not
plus the penalty or the AC $4,9187 plus the return payment fee was to be paid by Friday, April 10th. It has not been paid. So on May 5th, go ahead. Or April 5th, sorry. I mean, and if we were to determine that is this kind of normal, if we determine that it did not go down the drain, we would issue a credit at some point, but the the consumer still has to pay the bill. If we can show that the water did not go down the drain, then a wastewater credit would be issued. But it's not a full credit. It it goes to their normal usage, their highest usage within the last 24 or 12 months. Okay? So if he used a,000 was as high usage for wastewater and this bill come out 4,000 then it would be reduced down to 1,000 that units. as an example.

Very good. The second one is a new one. Um, as you all know, we are occupying the firehouse and we have our um second largest exhibit of the year called Small Wonders. And we have um with the firehouse come some occupancy uh limitations and we have a lot of artists who participate in this exhibit. It's a regional exhibit. We have artists that come from maybe Indie to southern Michigan. So, um it's a really cool opportunity to bring people downtown, but we thought as a way of keeping the exhibit at the firehouse and then doing our closing reception, which is what we do with all of our um exhibitions, is to put a tent outside in the parking lot to help with overflow. Um the occupancy is set at 47 per floor and we'll have probably, if I'm guessing, 65 to 70 artists plus family if they want to bring them. um and friends. And so um we thought it might be kind of cool to do a tent out in the parking lot to kind of help with um keeping
the date again. That's May 29th. That's Friday night. And the reception itself will take place from 6:00 to 8:00 p.m. But we will need some time to set up the tent and to tear down the tent. And of course, weather permitting what that looks like. I couldn't tell you, but um it could be the day before. and we just want to make sure that that's done efficiently, I guess, safely. Um, but I think that that's about it. What's the size of the tent?
Well, that's a great question. Um, we have two tents that we use for the festival um that are 10 by 20. And my thought was to probably use both of them. They both would fit in the parking lot with no problem. Um, the other option that we had is if this turns out to be something that we do kind of regularly because it looks like we could have the potential of occupying the firehouse for a couple of years that um we may invest in something a little bit larger and then use it for the festival as well. So that we're looking at potentially maybe a a 20 by 30 tent u but not much larger than that. For this one it's 10 x 20.
This one is probably two 10 x 20s. So 40 by, you know, or 2 * 20 by 20 is what it would be because we'll put them side by side. Yeah. A square. And there's there's room there. There's no issues. Um we'll weight them down. We have plenty of tent weights. There's also some grassy area where we can probably tie in, but ultimately they'll be fully weighted down. We've got um we have that whole whole system down pat with the festival. So So what time would you Yeah. So the the event's six to eight. I get that. But correct. Talk. When would you set up? When would you tell?
That's kind of what I'm saying. I that I Well, if if it were a perfect day, it'll probably take us an hour and a half to set up. Okay. So, we would do it, you know, around 4:00 that afternoon. But if it's a terribly rainy day and I'm kind of watching weather, we may have it set up earlier. So, I'm I'm kind of asking for a little flexibility in this. That's no problem. But what about um you know there's got to be some signage um you know for it's a public lot correct I mean who knows who might park there right leave it there for a couple days and all of a sudden you're trying to set a tent up and there's going to be a true
yeah and I you know that that cuts into our parking too because we're utilizing the firehouse and that's you know we have artists and people who are taking classes who are doing that so that would you know blocking off the parking lot would impact us directly however um I talked talked with the Brass Rail today. They gave us their blessing and you know it's a Friday night. It's lots happening downtown Plymouth and in the in summary Dave Langon was like sounds awesome. It's bringing people downtown. So and you know we really encourage our folks to get out and go and eat locally when they're coming in for these receptions. But nevertheless, yeah, you know, we're to do our best to to really minimize the time that we're using the parking lot. I think you need to maybe work with Jimmy and do something to notify people that use that lot
uh beforehand that Yeah, absolutely. If you got people living downtown that potentially could be parked there that might go on vacation or something like that. So, we could adopt the same procedure that we have for the festival where we have the no parking signs that we put out a couple of days in advance. We have a request this evening from Mike and Karen Yoshowski in regards to the hill on the north side of their property that uh abuts Oak Hill Cemetery and they would like to discuss this with you. Mike or something you want to come up and okay he's not a boy shy I need
good evening I'm Karen Oeski 10240 Mukshaw Road Plymouth Indiana we are right next to the cemetery I appreciate you guys letting me come again but we still have the issue with the cemetery water running off down the hill it's washing away they wanted to put grass on it that has nothing's been done to it, but the grass that is there is washing away even more. These are the newest pictures from our rain from Feb, March, and April. And it shows in there the runoff. You can see the the lines coming straight off um the water, dripping down, running into it, mud and everything else filling our driveway. We've got a quote from uh Chain of Lakes. He gave us a quote of $6,000 to fix the driveway and put a SW down the side right next to it. But it's not going to do a whole lot good to put the SW there. All the goes and erodess even more. As you can see from the tree roots, they're roen and sticking out even more. Got the old pictures that we've brought up from our other meetings. If you want to compare them
a couple years ago. Oh yeah. Yeah. This is our third time here. Two or three years ago, right? Yeah. No, maybe three or four at that point. Yeah. Those are all the pictures from previous
when we started. We did when we first moved into this place in 99. We had a beautiful driveway that was all gravel. We've done our drive driveway three different times. This will be the fourth time of doing our driveway because it's full of mud. Grass washes off from the hill into our driveway. So, we'll have grass throughout which you can see in the PE pictures that there are grass that has come off that's washed off from that hill. They did put the swill in the cemetery and I greatly appreciate that because now I don't have a river totally in my yard every time it rains. So, it does help. It runs down to the side and out the front of the road it piles there because we don't have a covert. So then when we get tons of rain like we did in March, it fills into the front of our drive as well and puddles up. There you go.
So, can I ask, have you outside tonight, have you talked to anybody in the We've talked to Mike. He's come and talk to my husband. Um, no, I talked to Mike last fall and he got Mike offered to come over and dig that side down, but it's still it's just going to the driveway is actually if you look go into the driveway, it's actually tilted. The driveway is actually tilted. If you look at the pictures, the driveway is actually tilted from the hill going towards the house. And what that is is that's all the dirt that has run off.
Okay. years ago when I first had the problem. I think Mike had just started there and Jim was there and he hauled in two dump truck loads of clay and dumped on that hill that can get the water to to quit running off. Well, all that clay over the years is washed into the driveway also. But no matter what, that driveway, the the swell that they cut in there runs that water down from the hill. Okay? But on the hill itself, it still runs down off that hill. It's like the rain tonight. Okay. The rain was running off of the hill going down through the driveway. Mhm.
Okay. Everybody we talked to says the only way you're going to stop that is to put up a retaining wall. Well, one, that ain't our property to put up a retaining wall. And two, the cost of it is going to be ridiculous. The only one we got to come out that would actually look at it was uh Brent from Chain of Lakes. And what he's suggesting is cutting that down where it's at, angling it to the towards the hill just a little bit. Okay. And he's going to put a swell on the edge of the hill between our driveway at our driveway and the cemetery property. Okay. So that would the would that work be done on your property?
Yeah, that's all going to be on our property. The only thing we're going to do and Mike knows is right there at the hill where it rolls down that they may cut into that hill just a little bit in order to do this will nobody goes there, nobody does nothing. Okay? You know, it's sort of like us are out of mind, out of sight. So, I was a little confused and I'm just going to speak um if what your request is tonight. Exactly. Try to help out some with with the cost of it because if if not that I don't know if you're asking permission to do this work. No, no. Asking for the city to help a little bit because we've been going through this for so many years now.
Okay. And and what they're going to do when he puts the swivel in at the end of the driveway, we do not have a culvert, which they don't know if there's actually one in there and it got buried over the years or what because the neighbor has one and the water runs from north to south going down to Lake Mukshaw down there. Yeah, that's what they talking about putting in a culvert at the end of the drive. So the water that runs off the swill at the top of the cemetery will go down into there and then it'll run across. Okay.
And go down through the ditch, which Councilman uh Eert stopped out today and I talked to him some and showed him what the issues was. Did he promise you anything? No. What I promised was to listen to let the engineers review it and get their input. And see, and that's the other thing. When this all first happened, the engineer was there, whoever it was when Jim Hamemer was in years ago. That would have been Rick. Yeah. And each We'll get back to you. And that was all right. All them years ago.
Okay. Now I know where you're at on this exactly. So my suggestion, and you guys can do whatever is, uh, Dan couldn't be here tonight. He's our new city engineer. Uh, let us get our eyeballs on this. let's work on this and let's let's get his recommendation on first of all he can take a look at that plan and tell you oh that's a good idea maybe not such a good plan or whatever uh let's let's put some work into I asked you earlier if you had talked to Dan yet and it sounds like you have no okay Dan Dan Sers is our city engineer so uh if you that's my recommendation let us go do some work on this because like you said it's getting summertime it's time to
get the dirt and all the other stuff done with. Well, with the April showers that bring on the May flowers, we've got rains have been Yeah, that's the last few years we're seeing, you know, unprecedented amount. We see seven and a half inches last month, Donnie. 7.46 or something like that. So, but if you don't mind, that would be my recommendation to the I mean, I went out on site today and looked at it too and I met with my colleagues out there. Um I mean the concerns too with me was to identify the property line as well because on there now yeah the the trailer right next to the tree
is the property line the property line goes right in front of the tree. So I identify that whole line because it looks like there's a lot of driving in the pictures there is stakes when they did the survey where it shows where actually that about back here is where yeah in the middle there's a stake and it comes over here and it goes on an angle and then it brings back again and there's in those pictures you can see where the steak that the surveyor put in. Yeah. So, I mean, which we're not going back that far. We're only going to go up to the house. Yep. You know what I'm saying? You know, the the driveway we end at the house, basically.
So, how far is that soil going to cut off of your house there in the length of the driveway is going to go to go right there cuz you got trees here. Are you saying the No, no, no, no. You already have up on this hill, you already have a swell cut in there. Yeah. I don't want right in here. Gonna go say from about the hump right here, you know, just in front of this big oak tree that's there and come back this way down on the on the cutting existing driveway. You're shrinking it down. Well, I mean, not a bunch. It's it's going to be right at the right at the edge. That's why I said we're going to take just a little bit of that hill on the edge and cut down through that. So, that hill is on your property? No.
No, it's right next to our property. So that's what we're approve. It's all city property. That's why I wanted to have
way. Yeah. Because to shake that bank and everything to get the cup that you need to drain it well be from the east to the west. I did talk to Jason Peters out of the county just because that um and he said confirming with me that homeowner is responsible for putting and having a culvert meet county specifications. Um and then I still looking at the railroad track and Oak Hill. I'm still concerned that there's going to be flow both directions that could pond in that. So there's going to be have to be a lot of calculation on it. Well, would you agree we should have further investigate?
Yeah, I mean Dan, the only other thing would be is I don't and I can't remember what it is is how far a driveway is supposed to be off property there. I know the city we have over on that. I can't remember what was maybe 16 ft or something like that. I can't remember off the top of my head, but I don't know what that count. So that may play a part in it as well. How close that drive was specifically allowed to be on the So that you mean we have to move our driveway then? I'll just say there are ordinances that have and I don't know what the counties is. I just know that we have ordinance in the city. So I don't know what it's the county county is different
could be different but technically you're supposed to have a drive so well in the property in the city. I'm not sure what the county is cuz that was an afterthought after I talked to Jason. I didn't talk to him. So well to move it to the south that's going to be in our yard or in our house we get ahead of ourselves. I'm just saying those are the things like if you give us a little time we can investigate all those things and we city planner we got the city engineer and and then let us do some Yeah. We want to make sure it's done right. You want to know that. So we talk that contract a little more and stuff like that there.
Okay. Uh this is kind of that's why I asked in the beginning if you've talked to anybody yet, but doesn't sound like too many. You know, everybody we talked to I hate to say this like this, but everybody we talked to just blows us off. You're the only one right here. Well, for us to sit here and tell you it need experts to look at it. But yeah, and like I said, the only one, like I said, last fall, I talked to Mike and he talked about digging that one side out and I told him, "Well, we got to find out what it's that's property line as part of it." And then, yeah, the we're going to have to do he's going to have to do a calculation, the slopes and everything to make that.
Yeah, we work. I promise you. We're going to we'll we'll get on it. I don't know how soon, but pretty soon. How's that for an answer? Yeah. Well, this is our fifth year now going into this that we've been dealing with it. Time to get it taken. I think I believe in last I mean it's been four years probably since we talked about this. I thought we had it resolved back then, but obviously not. So, no, cuz it still, like I said, it still runs off and you know, like you said, we everybody we tried to get coming out and, you know, nobody wants to come out, you know, and their thing is is we got to put a retaining wall up. We got to do something with the hill in order to do if we do our drive again, it's going to do the exact same thing leaving the hill the way it is. And the hill's not ours.
Okay. So, we can't touch it. Yeah. How do you know what the statute is on our end as far as like I know there's rules you mess with that run off on the on the property. Right. Take this.
I'll let you take you know you know my uh gap. So the the legal principle that would apply here is called the common enemies doctrine. And it it basically says that you can do anything on your property to affect the flow of surface water as long as it does not focus it into a concentrated flow. Um you know I I don't think that's really the issue here. I I think it's it's a matter of and and just speaking for myself and when I was on the council, we dealt with this before. it was a matter of being good neighbors and trying to find a solution for everybody. So, I I think that's the appropriate way to handle it. Um once Dan is back, um Dan, our city engineer, his background is in drainage engineering. So, uh he's going to know a whole lot more about this than any of us.
And having him weigh in on it, I think is gonna be important before. That's what I was saying. And if we give us a little time to put some professionals eyes on it, then we can let you know next steps. That's I'm just a facilitator here. This these guys are the voters. So, uh I and that's what I shared with you earlier today, Mike, is that we need to have an engineer take a look at it. Technically, I don't think we need to take any official action on it. So,
no, I mean what what was submitted um didn't request anything specific. I think they just wanted it to get it in front of you for your attention. Uh, very excited to see it. A lot of great information. We had several members from our steering committee provide comment and feedback. We got that shipped off today so they can begin making those final amendments so they can kick it over to us. So here in the coming months, we'll do any final touches that we need to in order to prepare it to come in front of the planning commission and then ultimately in front of you. Thank you. Very good.
