That is correct. Two motions were made. The first motion was to approve the item. The motion failed in a 3-3 vote. Then another motion was made to deny the item, which also failed in a 3-3 vote. Both of these votes failing resulted in no recommendation moving forward to City Council, so the item moved forward automatically to City Council for their final decision.

Okay. And so what's before us tonight talks about a minor vehicle repair on one lot. Would this lot have been eligible for the minor vehicle repair had it not been changed back in October or whenever council approved it?

Good evening, Commission. This is a residential replat. As you can see here, here are the boundaries of the proposed replat. The purpose of this replat is to combine two parcels into one lot. As you can see here, the proposed new lot lines in the dark black border of the replat. We received one letter in favor of this repot from within 200 feet of the surrounding property within the same subdivision. No other responses were received. Staff is recommending approval is submitted, and I'd be happy to answer any questions. Thank you.

To rezone 0.9 acre from agricultural to single family residence seven and to expand specific use permit number 582 for private recreation facility from 1.1 acres to 1.6 acres. The petitioner is the City of Plano and Trails of Glenwood, the number one HOA. This item is for legislative consideration. Item number 2B, Trails of Glenwood Phase 1, Block M, Lot 1R. Private recreation facility on one lot on 1.6 acres located on the northeast corner of Los Rios Boulevard and Fitz Daryl Drive, zoned agricultural and single family residence seven with specific use permit number 582 for private recreation facility. Thank you. Good evening, commissioners. Tiara Clark, planner with the planning department. This rezoning request is a two-part request. Here's an aerial of the two parcels along Los Rios Boulevard. The image to your left represents the 0.5-acre city-owned parcel requesting a rezoning from agricultural to single-family resident seven. And the image on your right represents the existing Trails of Glenwood HOA amenity lot and the proposed expansion of the specific use permit to allow private recreation facility uses. So just the history of the city-owned lot. It was annexed in 1999 and zoned agricultural. In 2003, it was acquired by the city. And as you can see, based off of the historic aerial images, it was part of a larger property, about six acres. And then in 2004, Los Rios Boulevard was constructed, as seen on the lower historic aerial image. And then just a bit of site history for the amenity lot. So it was also annexed in 1999 and zoned agricultural. It was then rezoned to single family resident seven in 2005. And then the Trails of Glenwood subdivision was platted in 2007 and that specific use permit for the HOA amenity center was also approved. In 2008, the HOA amenity center was constructed as shown in the historic aerial image. So as mentioned before, the purpose of their request is to sell the parcel to the Trails of Glenwood HOA for future expansion of their private amenity center. And therefore, they have submitted a two-prong request. And so the first is to rezone the city-owned parcel. from agricultural to single family seven to match the surrounding zoning of the neighborhood. And the second part of the request is to expand the existing private recreation facility SUP boundaries to include that 0.5 acre city-owned parcel, which will then be replatted and combined into one single lot. And so if replatted, the subject property will then be designated as neighborhoods and open space network on the future land use map. And just as a note, through the sale of this parcel, there will be a de-restriction to make sure that that 0.5 acres is still developed with private recreation facility uses or open space uses. And so as part of state law, the city requires that we notify residents within a certain boundaries of the subject property. So within the subject property, there were no notices returned. And so within 200 feet, excuse me, of the subject property, there were four responses returned. There were three in support and one in opposition. As for the citywide responses, there were a total of 12 responses returned, five in support, six in opposition, and one which was neutral to the request. And so this is the replat that was submitted, which is just showing the combination or combining the amenity lot with the city-owned parcel, which will maybe be replatted. And so just a bit of analysis. Um, so this site does have a few constraints. Um, one, uh, it has been underused since 1999 and, uh, you know, it's also sort of isolated by Los Rios Boulevard and it, it does have a smaller size and a unique shape. And so, um, the city's parks department has no plans to develop it at this time. Um, and in terms of, uh, Surrounding residents uses for parks. There are other parts within the area that residents can utilize And so with the sellers property there wouldn't be any effect of Any existing or plan improvements associated with Oak Point Park specifically, which is directly across from Los Rios Boulevard and And with that, the SUP expansion will allow for the Trails of Glenwood HOA to expand their private amenity center. And then rezoning this parcel to SF7 will sort of make it compatible with the surrounding zoning in the area. And so in summary, item 2A is, again, a two-part request. It's to first rezone the 0.9 acres from agricultural to single-family residents. And just as a note, the 0.9 acres comes from the 0.5 acre of the city-owned lot and then 0.4 acre of the right-of-way center line. And then the second part of the request is to expand SUP 582 to include the adjacent city-owned property within its boundaries. And the companion submittal, which was item 2B, is the replat to combine two properties into a single lot. And staff recommends that item 2A be recommended for approval as submitted and item 2B be recommended for approval subject to city council's approval of this zoning case.
