Yes, sir. Good evening, Chairman and Planning Board members. We do have two resign requests this evening. The first one has been submitted by Mr. Stacy Eastwood. The request is to amend the existing zoning of his property. This is partial number 88208 and it's currently zoned general commercial conditional district, which allows the following uses the sales of golf carts, utility trailers, metal carports and barbecue cookers. The request from Mr Eastwood is to amend that to also include RV and boat storage. The property is 2.88 acres and is located on the northern side of U.S. 264 East, east of its intersection with Olpactolus Road. And again, the current zoning of that property had to go through a rezoning process back in 2008. And again, it's for the sales of golf carts, utility trailers, metal carports and barbecue cookers. And similar to a request that we had a few months ago, the request this evening will not affect the uses that are currently allowed here. And I'll get to that in the conditions as well. But please keep that in mind as we're going through the request. The location of the site, it's located east of the city of Greenville, just east and then north on US 264 before you get to NC 30. The existing land uses in the area. Again, the subject property is currently zone general commercial there in red to the south. There's a sand mine. You see a portion of that gray. There's the sand mine and to the north. If you see that little red there, there's an existing wedding facility as trip farms. Otherwise the gold oranges color that is all the residential in the area. And there's also a lot of undeveloped and agricultural there in the green. Some pictures of the property. This is looking at the use from US 264 East as it currently sits. Interior to the property, the existing structures. This is looking west towards Beaufort County on the US 264 east and then looking east back towards the city or actually that was west towards or east towards Washington. And this is looking west back towards Greenville. A couple other uses in the area. A few residential uses. That one's directly adjacent to the property to the north of the property directly to the rear and west. There are some agricultural uses. That's the sand mine. It's kind of set back off the highway, but across the highway. A residence across the street. That's the entrance to Tripp Farms that I just mentioned. A couple of non-residential uses as well. This is Southern Smiles Dental Office in the area. This is a commercial warehouse that's currently under construction in the area, as well as a contractor that has done a general commercial. So just to give you an idea of some of the other uses in the area. The Envision Pit County 2045 Land Use Plan does designate this property as agricultural. This designation includes prime farmlands that are vital to the agricultural production within the county. Activities include agriculture, forestry, limited low density residential and commercial or institutional uses. These are typically located near strategic agricultural lands and surrounding areas. The uses include agriculture, agribusiness, forestry, limited commercial, single-family properties, and occasional low-density small-scale residential subdivisions. Utility access is onsite septic and community water service or private wells, and density is generally less than one dwelling unit per acre. The existing zoning, um, you see a majority of the area is an RR rural residential. Um, the property we're looking at, as I've mentioned already is general commercial. And then just South that property with the Sandman is zoned R a rural agricultural. Um, the general commercial zoning district is primarily intended to accommodate a range of retail service office, limited wholesale and moderate density, multifamily residential uses in areas that have access to major thoroughfares and the necessary utilities to support such development. And a conditional zoning district allows for the approval of a specific use with reasonable conditions to ensure the compatibility of the proposed uses with the use and enjoyment of neighboring properties. Again, the proposed use is to add RV and boat storage to the existing uses in the area. The Pitt County Zoning Ordinance does have development standards for oversized vehicle parking. I believe several members of the board were on the board when we went through a Texas amendment a few years ago to add this language. So we'll go through some of the standards but includes but not limited to that all oversized vehicles shall be parked a minimum of 50 feet from any adjoining residentially zoned property and shall be a minimum of 100 feet from any residence, church, school, or public institution. The entire perimeter of the facility shall be screened from adjoining properties by a buffer yard that complies with the requirements of Section 10H of the zoning ordinance. Security fencing a minimum of six feet in height shall be provided along the entire perimeter of the facility. In residential districts, parked vehicles shall not remain idling or generate other noise while parked that disrupts the activities of adjacent land uses between 10 p.m. and 7 a.m. And parking spaces are not required to be paved, but shall be graded, properly drained, stabilized, and constructed with an all-water service to minimize dust and erosion. And just to speak to that, the property is currently grass, so we're considering that in compliance with that, meeting that standard. There are some prohibited activities within this use. The storage and keeping or accumulation of any wrecked, scrapped, dismantled or inoperable vehicles, machine equipment or parts thereof basically cannot be used as a junkyard or scrapyard. The storage, keeping or accumulation of junk materials such as scrap metals or materials, debris, waste paper, rags, battery waste or used building materials. Fuel cells are prohibited and automobile repair service is also not allowed. This is the sketch plan we got with the request. This is the rezoning area. Again, it's already zoned general commercial, this site. A couple of existing structures on the property, an existing drivable driveway, and then the proposed uses. So like any other conditional rezoning request, we do require a sketch plan be submitted up front. If it is approved, additional details will need to be shown on there, the screening, the fencing, and things like that. But at this point, we don't require anything but a sketch plan just to show a general idea and layout of the lot. So that's kind of what we received at this point. As far as staff's recommendations, the Pitt County Planning staff does find that this request is consistent with the Envision Pitt County 2045 Comprehensive Land Use Plan. The area requested for rezoning is designated as agricultural, which allows limited commercial uses, and the property is currently zoned General Commercial Conditional District for the sales of golf carts, utility trailers, metal carports, and barbecue cookers. Additionally, the subject property has frontage along a major thoroughfare, US 264 East, and is within close proximity to several non-residential land uses along US 264 East, including two active sand mines, the wedding venue, a dental office, the commercial warehouse that is currently under construction, and a commercial contractor. Planning staff also finds that this request is reasonable and in the public interest because the property is located within close proximity to several non-residential land uses. Additionally, the site is located along a major thoroughfare, again, US 264 East. There is limited residential development directly adjacent to the site, and the proposed use will be screened from adjacent residentially zoned or used properties. Again, staff does recommend the approval of the request, subject to the development standards that I just went through from Section 8VVVV. of the zoning ordinance and the following additional conditions. The previously approved uses are still permitted in accordance with the original rezoning request. Again, regardless of the outcome of this request this evening and the Board of Commissioners public hearing, that was approved in 2008. No zoning compliance permit shall be issued until a site plan prepared in accordance with Appendix B of the zoning ordinance is submitted to Pitt County Planning for review and approval. A landscaping plan is required and the property shall be screened from any adjacent residentially used or zone lot and public right away by a 10 foot wide landscape buffer yard planted in accordance with the requirements of section 10 H of the zoning ordinance. A solar erosion and sedimentation control plan prepared by an engineer shall be submitted for any development of this property that results in lane disturbance over one acre. The site must also comply with the Pitt County stormwater ordinance for nutrient control. Nutrient loading and peak flow calculations shall be reviewed and approved prior to any improvements involving more than one half acre. The site must comply with any emergency management requirements for fire protection. And the last two, they must obtain any required permit from Pitt County inspections to occupy any proposed structures and comply with any applicable environmental health requirements for waste disposal. and obtain a commercial driveway permit from NCDOT and comply with all requirements for access to the subject property. Public comments will now be entertained by the board. The planning board would then make a recommendation to the Board of County Commissioners who are currently scheduled to hold a public hearing on Monday, August 17th at six o'clock in the evening. And I will turn it over to you, Chairman, for public comments. And if you have any questions of me, I'm happy to answer those as well.

All right. The second rezoning request this evening was submitted by Mr. Jason Hardy. The request is to reason 1.55 acres of his property. It's parcel number 06093 and it's located on the western side of Blackjack Simpson Road, just south of its intersection with Spencer Loop Road. And the request is to go from rural agricultural to general commercial conditional district to operate a barbershop. Site location there, you see it's just east of NC 43 South and then south of Mills Road in the Blackjack area. The existing land uses in the area. Um, you see again, a lot of agriculture out there in the green as well as residential with the orange, um, goldish color. There are a couple of, um, what we classify as government utility uses, um, to the north. Those are cell towers as well as blackjack fire department. Uh, the blue there, there are several churches in the area. And then just to the north, the two red, those are a couple of country stores that are located in, uh, currently existing in the area. Some site pictures. This is the site looking at it from the road. And just a note on this, the use is in operation now. Staff became aware of this and we've talked to the property owner and advised that they need to go through this process. They did not realize they had to go through it, so staff has been working with them. The applicant has been very cooperative. So like I said, I'll get to our recommendations shortly, but you will notice the sign there. And at this point, we're trying to get everything in compliance with the zoning ordinance and any other requirements. Um, so it is an operation. Just want to clarify that you see the current, um, parking area there. This is looking north on Blackjack Simpson Road, and this is looking south just to give you an idea of the uses or the area. A few other uses. There's a lot of agricultural land out there, as I mentioned, as well as some residential. There's a few of the different residential uses, uh, the Blackjack Fire Department station that I mentioned. as well as a few pictures of churches out there. And the country store is kind of what we classified these as. They've been out there for a good while now. Another church in the area. The Envision Pitt County 2045 Land Use Plan, similar to the last request, does designate this area as agricultural. Again, this includes prime farmlands that are vital to the agricultural production within the county. Again, some of those activities include agriculture, forestry, and limited low density residential and commercial or institutional uses. And I did want to note this subject property is located just south of this commercial crossroads to the north. And those are areas in the county that we identified through our land use plan process that aren't again, this is the future land use map. So it's areas that we could see future growth for development, commercial or otherwise. And this is one of those areas. It's not located within it, but just south of it. Did want to note that. Again, the location for the agricultural district is near strategic agricultural lands and surrounding areas. The uses are agricultural, agribusiness, forestry, limited commercial, single family properties, and occasional low density, small scale residential subdivisions. Again, onsite septic system and community water or private wells, and generally less than one dwelling unit per acre. The zoning in the area, everything out there is currently zone rural agricultural except those two country stores located just to the north up at Blackjack, Gromson Road and Mills Road. Again, the general commercial zoning district is intended to accommodate a range of retail service office, limited wholesale and moderate density multifamily residential uses in areas that have access to major thoroughfares and the necessary utilities to support such development. And again, a conditional zoning district being for a specific use in this situation, it is for a barbershop. Again, the sketch plan we received with the application shows the property there. The owner does, if everything goes through, is planning to parcel this subject property out. Currently, it's all one large parcel, but they're going to parcel this out so it's its own property in the future if this does get approved. The existing structure there, existing gravel driveway, and then the existing septic area. Again, if this is approved, we will require a more detailed site plan prior to any zoning permit being issued. Planning staff does find that this request is consistent with the Envision Pitt County 2045 Comprehensive Land Use Plan. The area requested for rezoning is designated as agricultural on the future land use map, which allows limited commercial uses and is directly south of an area designated as a commercial crossroad. That was that Blackjack area I pointed out. And additionally, the subject property is within close proximity to several non-residential land uses, including two churches, two country stores and a volunteer fire department. Staff does find this request is reasonable and in the public interest because the site is just south of that commercial crossroad and is located within close proximity to several non-residential land uses. Additionally, the proposed use will be screened in adjacent residentially zoned or used properties, and the proposed hours of operation will be compatible with surrounding uses. Staff does recommend approval of the request with the following additional conditions. No zoning compliance permit shall be issued until a site plan prepared in accordance with Appendix B of the zoning ordinances approved by the Planning Department. A landscaping plan is required and the property shall be screened from any adjacent residentially used or zone lot and public road rights away by 10 foot wide landscape buffer yard planted in accordance with the requirements of Section 10 H of the zoning ordinance. Parking spaces, access drives and loading areas shall be paved and maintained with concrete asphalt or similar material of sufficient weight and thickness and consistency to support anticipated traffic volumes and weights. The proposed hours of operation are Monday through Friday 8 a.m. to 7 p.m. and Saturday by appointment. A soil erosion and sedimentation control plan prepared by an engineer shall be submitted for any development of this property that results in land disturbance over one acre. The site must comply with the Pitt County stormwater ordinance for nutrient control. Nutrient loading and peak flow calculations shall be reviewed and approved prior to any improvements involving more than one acre or one half acre, excuse me. The site must comply with any emergency management requirements for fire protection. Obtain all required permits from Pitt County Inspections to occupy any proposed structures and comply with all applicable environmental health requirements for wastewater disposal. And finally, obtain a driveway permit from NCDOT and comply with all requirements for access to the subject property. Again, public comments will now be entertained by the Planning Board. The Planning Board will then make a recommendation to the Board of Commissioners who are currently scheduled to hold a public hearing on Monday, August 17th. So from Stan's perspective, that's just going to be for personal use. If in the future they ever decide to expand for a since it's going to be commercial, if it is approved, if they decide to put a some other dog room or otherwise on the other side, they would need to come back and amend the zoning district, kind of like our first rezoning this evening, since this is specifically for the barbershop. Our recommendation of staff was to rezone that entire corner instead of just the portion of the shop, which you saw, I think it had a shelter and then shop and then the barbershop as well. So just doing like a little sliver for the barbershop itself didn't make sense for us for mapping purposes. So we recommended just doing this whole little portion of the one and a half acres. And again, we've advised Mr. Hardy currently has no intention of using that beside personal storage. But if for some reason any other commercial use on the other side or otherwise became an option, they would need to come back before the board prior to this. So if the board wants to clarify that the remaining portion of it be used for personal storage, I don't think staff has a problem with that. But that's kind of how we're looking at that. So leave it up to the board.

Yeah, so it met that already. Luckily, we didn't have to deal with that from a variance perspective. The owner has also gone through environmental health because it was applied for as an AG building. He's amended that to make sure it wasn't for commercial use. He's also worked with inspections to make sure it meets all their codes as well for that use. So again, truly, staff believes it was an error without realizing what standards were required and they've done absolutely everything we requested to go through in order to, um, comply with all three departments, environmental health with septic zoning, as well as inspection. So, um, and again, staff feels that meets the uses in the area is a good addition for the area as well. Um, we have not heard any opposition to the project at all whatsoever. I think everybody here is in support of it. They didn't speak otherwise. So, um, to answer your question, yes, it complies with the setbacks as well as all the other requirements.

Thank you Mr. Chairman. Good evening Mr. Chair, members of the board. Tonight I'm going to go over a few informational items in your packet and I'm going to expand a little bit on our work program moving forward. You might have seen at your seats tonight you got a copy of our strategic plan. It's a good document. The county has worked on that for about the last year. It was approved by the Board of Commissioners and a lot of these items on our work program come directly out of that strategic plan, which has been very valuable. The first item in our work program, which is also included in your board packet, is the development of a unified development ordinance. Wanted to expand a little bit on that because we haven't talked a lot here at the planning board level about the unified development ordinance. Backtracking a little bit back to the strategic plan, in February of 26, Pitt County adopted its first ever strategic plan And in May of 26, it approved the first year of implementation by the Board of Commissioners. The plan establishes goals and objectives in four priority areas, including balanced development, which is primarily planning-related focused. One objective that is identified in that balanced development section is the development of the county's first unified development ordinance. On June 2nd of this year, the Board of Commissioners adopted the FY physical year 26-27 budget, which included funding to implement the Unified Development Ordinance. Let's talk a little bit about what a Unified Development Ordinance is. It's a tool that's used by local governments to manage growth and development. It consolidates development regulations into a single document, making the requirements easier to understand, administer, and enforce, while ensuring the future development aligns with the community's vision and goals. Looking across the state, we did a brief survey based on the information we were able to find on what counties have unified development ordinances currently. Currently there are 34 counties in North Carolina that have adopted a unified development ordinance with five counties currently developing their unified development ordinances. There are three counties out there that have some semblance of a unified development ordinance, but it's not truly a unified development ordinance quite yet. And then 57 counties still have no unified development ordinance. And if you look at your map on the screen, a lot of these areas that have unified development ordinances are located around the triangle area, the triad. down in Wilmington and then up in the Northeast, um, finger counties, uh, filling pressure from the Norfolk Virginia beach area in that area. So, so why do we need a unified development ordinance here in Pitt county right now, our planning department currently enforces seven different ordinances. those pertain to addressing flood damage prevention, manufactured home park ordinance, our repairing buffer protection ordinance, our soil erosion and sedimentation control ordinance, our water supply watershed, and then of course our zoning ordinance, which we also have two kind of standalone sections of that for outdoor advertising and shooting ranges so a lot of different ordinances that we're trying to administer as standalone documents this will combine it into one Unified Development Ordinance, one document. So why is that valuable? Currently we again have multiple ordinances. We have the seven ordinances. This will unify it and put it into one document moving forward. Sometimes we run across inconsistencies within those ordinances because they are separate. They don't communicate all the time. So hopefully by combining them we'll go through them and make sure they're properly and they they're working together. A lot of times it's difficult for citizens developers to look through all the different ordinances to see what applies in their particular case. So hopefully this will be more user friendly moving forward. It will flow better and be a lot better to understand one thing that we are looking to do right now. The majority of our ordinances. were created back in the 90s and is black and white text so we hope to incorporate some images some diagrams that sort of thing to make it more easily understood to the average citizen Also the potential interpretation issues as staff much like the citizens trying to understand it staff sometimes may not get the interpretation correct because there is some differences in there so hopefully combining all these will make it easier for staff to interpret and enforce and then a lot of times finally the ordinances are sometimes created as a reaction to state laws. So hopefully we can look at what is required moving forward and throw in there some strategic long-term thoughts on how we want Pitt County to develop moving forward. So we'll take that opportunity throughout this process. Next is the tentative timeline. I don't want to get too concerned with how long this process is going to take on this chart here. This is showing a little over two years. It's going to be a big undertaking by staff and the consultant that is brought on. But we need to work those details out with the consultant that we select through this process. But I do want to kind of go over the steps. So we've already drafted our RFQ, request for qualifications for the consultant. We hope to get that out by the end of this month and advertise for that, receive those proposals, and select a contractor or consultant for this project. After that, we'll establish steering committees. We'll probably be back to this board asking if anyone wants to serve on these steering committees. work groups and then we will move on to the public outreach and survey. We intend to heavily involve the public get their input especially the development community as well as citizens and all along the way we'll be providing updates to both you as the planning board and the commissioners throughout that process. We'll then go into the drafting of the ordinance and again, have public hearings, public input, that sort of thing before we formally adopt it and move forward. So some of the other any questions on the unified development ordinance before I move on? I know that was a lot of information, but basically we're taking our standalone ordinance, combining it in the one unified document. So any questions from the board?

Yes, so there's a lot of legislation right now being proposed that affect a number of things. Parking lot standards just got approved. Also has some stormwater language involved with that. And there's other bills that are being proposed, especially regarding data centers and restrictions on those. So all along the way, we'll be monitoring those bills and make sure that we have the most up-to-date state regulations included along with some ideas that staff has and any ideas that come out of those work groups will be incorporated in it.

And I do want the I want to point out that the commissioners on Monday night presented basically the same PowerPoint to them and got feedback from them on any emergent issues that they saw that we needed to make the consultant aware of that we wanted to look into. They advised that they're concerned about solar farm regulations. You guys have heard the same concerns about those, so we'll be sure to incorporate that in our discussion and work groups along with the data centers that i mentioned and mining operations so we'll look at those standards i'm not saying we're going to change anything at this point but we will assess them and see if we're current and if there's anything we need to change to preserve the surrounding areas from those uses also they mentioned subdivision interconnectivity for emergency response Making sure that our regulations are up to date on those and that we're ensuring the best flow for emergency response. The other thing was recreational space. So our subdivision ordinance hasn't been amended at all since the inception of our. Cultural Arts and Recreation Department. Now that we have that, the commissioners expressed desire to have some sort of regulations that would allow for park space and new subdivisions and acknowledging that. The other thing was agricultural preservation throughout the county. So trying to preserve our agricultural culture here in Pitt County. So those are things that have already kind of been directed by the Board of Commissioners to look at. Again, we'll look at any and all comments that we receive and try to see what we can do to incorporate them into the document as well.

All right. Moving on, back to the work program, we also have slated to develop a farmland preservation plan in coordination with our pit, soil, and water department. That's kind of on the startup end of this fiscal year. We'll get going working with them, coordinating with them on development of that plan as well, as well as working with our cultural arts and recreation on the development of a greenway plan. um we have a greenway plan that is very old right now and it needs to be updated so we'll assist them and kind of transition that plan over to our cultural arts and recreation department also community development administration will continue that activity that is Working with rehab and homes that are dilapidated for low to moderate income households. Also, our homelessness program has various activities that will continue to work on and develop those as well. Lastly, the Whitehurst station water line extension, our department was involved in that first phase of that project. We'll continue to seek grant funding and funding in general to provide water service to the individuals around the Whitehurst station that are relying on wells right now. There's no public water, so we'll continue to work with them and Greenwood Utilities on extending water service in that area. so that is it for the work program there's other activities included in your packet that we have that are kind of ongoing but these are the main bullet points here if anyone has any questions be glad to answer it or we can talk after the meeting if you would like.
