Good evening. I'd like to call this meeting of the Pinetop Lakeside Council to order. We do have a quorum. I would ask that you make sure your cell phones are on silent. Please stand, and I would invite Commander George Baum up to lead us in the Pledge of Allegiance, please. And remain standing for the invocation.

Before I ask Councilmember Halls to give our invocation tonight, I'd like to read something in memory of our former town council member, Maisie Jean Hastings. With great sadness, we acknowledge the passing of Maisie Jean Hastings, who passed away on Friday, June 26th, at the age of 88. Maisie faithfully served the town of Pinetop Lakeside as a member of the town council from November of 2018 through January 6th of 2022. Prior to her election, she served on the Planning and Zoning Commission from December of 2016 through July of 2018. Maisie was known for her intelligence, kindness, and genuine love of conversation. She enjoyed traveling. and often shared stories from her adventures with those around her. She also had a special fondness for cowboys, which reflected her warm personality appreciation for the American West. In addition to her service to the town, Maisie served diligently as board president of the White Mountain Senior Center Community Center, a role she deeply cherished. She was also instrumental in the Books for Kids programs where you see the little free libraries around town. Her commitment to serving others and improving the community left a lasting impact on many. On behalf of the town of Pintop Lakeside, we extend our heartfelt condolences to Maisie's family and friends. We're grateful for her years of dedicated public service and the many contributions she made to our community. She'll be remembered with appreciation and respect. Before we observe a moment of silence for Maisie, we'd also like to extend our heartfelt condolences to the Egan family and the Miller family on the recent loss of their loved ones. Please keep both families in your thoughts and prayers during this difficult time. At this time, I would invite everyone to join us in a moment of silence in remembrance of all those we have lost and in support of their families. Council Halls.

Our Father in heaven, it's with gratitude that we come before thee tonight and we thank thee for this great country that we live in. And this year when we celebrate 250 years of independence, we thank thee for guiding those men and inspiring them to help establish the principles and liberties that we enjoy today. We are thankful for the blessings and privileges that have come because of that and we recognize that we could lose that and we pray that that will bless our leaders to make wise decisions, that will bless our citizens to uphold principles that will continue to lead us to have liberty and we can all be involved and work together to maintain those things that thou hast given to us. For our families, for our religion, for our communities that we love. Heavenly Father, we pray that thou will please comfort those families who are grieving the loss of their loved ones. Bless them with the love of those around them, and that that will send thy spirit to comfort them. We thank thee for those that serve in our law enforcement, our fire, and those here on the town council. We pray that that will guide our decisions, can be for the best of our community, and we can work together and work hard to make this a great place to live. Items on the agenda will not be heard during call to the public and individuals are limited to two, excuse me, three minutes. We have two requests for call to the public tonight. FIRST OF ALL, MR. KIM BUCHE.

GOOD EVENING, MAYOR IRVIN AND TOWN COUNCIL. THE JOINT MEETING BETWEEN THE High Top Woodland Irrigation Company on June 23rd, 26th, the irrigation company mentioned a meeting with the city of Show Low, and they had mentioned it one time prior to that. I sat in on a meeting, and they replied, no, they haven't had that. So I'm just wondering if they're even going to have one. Has this meeting happened? Have they received support from the city of Show Low? It'd be nice to know. Does the county have any stake or support in the irrigation company? In the license agreement between the irrigation company and town of Pinetop Lakeside, Exhibit A under the agreement item number two concerning license fee, did the town default on their agreement to the payment of $3,000 a month? Because I know that the irrigation company had asked what happened to that fee. I think we were a couple of months behind. And this is part of a 3% sales tax that's collected from all local restaurants in the area. Now, in the last meeting of the city with the Sholo Irrigation Company, has now requested a $6,000 a month fee as an increase. increase of three thousand dollars does this require a six percent sales tax to the local restaurants and do you do realize that uh locals are also being penalized uh how do you expect to account for those funds if approved of this huge increase and my if and i'd like to know if my information is correct on the 18 000 shareholders and if they're paying uh 30 a month or 30 a year because that's a 540 000 sum depending on the month or if it's a year. Has the irrigation company opened up their books to show transparency? I haven't heard of that yet. I know that's been asked, so I'm just asking some questions here. And Show Low Irrigation Company wants the city of Pinetop Lakeside to write grants to increase their funds. They also would like the city to post-maintain free collection boxes, QR codes for the residents of Pinetop Lakeside, and they also want a three-year agreement. The irrigation company requested that the town of Pinetop Lakeside do all the work, and that's what it sounds like to me. How will the town council use taxpayer fees and resources to absorb the employees' time, expenses to perform these duties, and financial budget? The irrigation company indicated that they will not help with these issues. They want to wash their hands of responsibility. They need to replace the head gate at Rainbow Lake as the most important on their list. They claim that they're broke. They don't have it, so they're searching for money. They have no intentions of raising rates that I know of to their shareholders, which I think is bad news. They are not concerned about the repairs that save on water loss. I haven't heard much come out of them about that. The water master has not given a ruling on the adjudication process. I did a little research from the last meeting of the Sholo Irrigation Company. Someone had mentioned the water levels were coming up. This is the research I found. It's the U.S. Geological Survey's CP measurement of base flows in multiple locations. But you can read the rest of the letter, and I'd appreciate it if I could get some answers to some of my questions. It would help me more define what I'm looking for.

Good evening, everyone. It's going to be a busy week next week at the community center, so I thought I'd bring you up to speed. Wednesday will be our fourth attempt at doing bingo. So far, very successful. We're making money. We'd like to do better, so tell your friends and neighbors and your families to come and serving a full meal, salad bar, and dessert. So in any case, Thursday, as you may know, you're invited to serve our annual or monthly meatloaf and liver meal. So hope to see some of you there, Jeff, especially you. Friday is food truck day. Tabor, Josh is going to bring his crew. We'd appreciate it. I'm on the injury reserve myself right now, so don't have to make up for much of me. In any case, then Saturday is the luau, our annual fundraiser. I think this will be our fourth year. We got a fire permit this year, so we don't have to cook the pig in... the kitchen, and we'll be digging a fire pit and cooking in a traditional way. Entertainment, we have, it doesn't sound, it sounds kind of funny, but we have the Show Low Hospice Group coming in, and they performed at the community center previously. Hawaiian dance in theme, and they're really, this one lady has three children, three daughters, like six, five, and four. And they were really cute. They were worth the price of admission. So I don't know how many tickets we've sold here, but I've got some with me. So anyway, that's it. Busy weekend, busy week, as always, at the community center. So see you. Thank you.

Hi, I'm Charlie. I'm the general manager of Silver King Smoke Lodge. It's our second location. We're originally from Superior. Been around for about five years. We are Texas-style barbecue. We also do craft beer, craft cocktails. It's for all ages. It's not a bar. It's a restaurant. But yeah, so we just wanted to come up here to open up a second location. My grandma lives up here, so I've been visiting up here for 10 years. And the opposite seasons work for us because when it's hot down there, everyone comes up here and we've actually had a lot of our locals from Superior come up here. So it's been kind of cool to see that mix, but yeah.

What are your hours, Charlie?

So right now we're Thursday through Sunday. We're trying to get more staff. Ideally, I want to be Wednesday through Sunday and it'd be 11 to 8 and Sunday will be 11 to 6.

Okay, we'll move on to item D2, which is a public hearing discussion and information regarding the final budget for the fiscal year 26-27 for the town of Pinetop Lakeside. i can mayor can you hear me okay you're good thank you go ahead perfect well thank you um mayor and members of town council um good evening um tonight we bring forward to you the final adoption um and resolution of the fiscal year 2026-2027 budget we have provided the budget and posted the notice of public hearing according to state statute And over the last several months, we've reviewed the budget and inputs with both the team as well as council. And so far there's been no changes since the tentative adoption back on June 18th. And so I'd be happy to answer questions that the council may have or anyone from the public.

Moving on to item D3, which is consideration of legal action to adopt ordinance number 26-403, amending town code title 17, chapter 17.108, section 17.108.050B, relating to political science. Jennifer. Jennifer.

Good evening, Mayor, Council, and residents of Pinetop Lakeside. For agenda item D3 tonight, the staff is presenting ordinance number 26-493, which amends Town Code Title 17, Chapter 17-108, sign regulations under subsection B regarding specifically political signs. BACKGROUND SUMMARY ON THIS. THE CURRENT CODE CONTAINS PROVISIONS REGULATING POLITICAL SIGNS ON PRIVATE PROPERTY AND THEY ARE INCONSISTENT WITH THE FIRST AMENDMENT RIGHTS AS WELL AS ARIZONA REVISED STATE STATUES 16-1019. THIS AMENDMENT ALIGNS OUR REGULATIONS WITH STATE LAW AND CONSTITUTIONAL STANDARDS WHILE MAINTAINING REASONABLE CONTENT NEUTRAL RULES FOR PUBLIC HEALTH, SAFETY AND WELFARE. Some of the key components for Exhibit A, one being political signs up to 16 square feet in residential zones and 32 square feet in non-residential areas are permitted during election campaigns. All political signs must comply with Arizona Revised Statutes 16-1019. Signs still may be freestanding, wall-mounted or fenced, no roof-mounted signs. Prohibitions remain on utility poles, traffic signs, traffic hazards, or vision obstructions. And sign-free zones along key corridors, such as White Mountain Boulevard, are retained where consistent. The Planning and Zoning held a public hearing on June 11th. One member of the public spoke in favor. The commission approved with three votes in favor and one abstaining. The town attorney Bill Sims did provide legal guidance via Zoom and no additional public hearing requests have been received. There's no financial impact to this as well. And then the staff recommends approving the ordinance 26-493 as recommended for the Planning and Zoning Commission. Happy to answer any questions that you all may have and provide any additional information.

Thank you, Jennifer. Appreciate your work on that. Item D4 is consideration of legal action to adopt resolution number 26-1823, appointing a new town attorney pursuant to town code chapter 2.10, section 2.10.010. Christy.

Good evening, Mayor and Council. This is a bittersweet item for me tonight because I've thoroughly enjoyed working with Attorney Sims over the last six years. He's taught me a lot. The Town Council appointed Attorney Sims in August of 2014 and he's been a really great attorney for the town. He has let us know that he will be retiring. He was going to retire in June, but he is going to stay with us until December, help us get through the election and anything else we could need in the and just moving over to a different attorney and help them get used to how we work here. And so I sent out a request for qualifications and a request for fee proposals at the beginning of may and i got um three back originally and then one came in late so that one was not considered one was significantly higher than the two that we're considering tonight that i'm bringing to council for um consideration so that one is not um on not really discussed on here tonight. We did have a work session last month where I provided counsel with a pretty good rundown on everybody that sent in their RFQs, gave everybody a copy of that. Hopefully you all have had a time to review that. I also sent out earlier today the reference letters, two for each attorney that's on here tonight. Hopefully you all had a chance to read those. If not, they are on your desk there. Both very qualified, very highly respected firms. Couldn't go wrong with either of them. Unfortunately, there's always one you have to make a recommendation. And so my recommendation or staff's recommendation would be to appoint Pierce Coleman as attorneys for the town of Pinetop Lakeside. They have extensive knowledge in municipal government in every aspect of municipal government. They have lots of attorneys that have been city and town attorneys in the past for several years at other municipalities. So I think they bring a wealth of knowledge. If you have any questions, I'd be happy to try to answer them. And if you decide you guys don't want to make the recommendation tonight, they'll both be willing to do interviews with you as well.

Thank you, Christy. Before we open up for conversation, I would just like to thank you for the work that you've done on that. You presented quite a packet to us at a recent workshop. Thank you. And then the time that you took to get the recommendations, I think that was really helpful to me to make a decision.

Maybe a comment. I still look at prices that they're, and to me, uh... if they're both equally qualified i work for the government for many many years i mean you know if they're all both equally qualified we generally take the lowest bidder to my seeing they are both qualified and uh... the other one uh... the fitzgibbon's law firm actually would save us money or for the same price of getting uh... their associates, we would get their primaries, their principals, I'm sorry, representing us. So I don't mean some of those kind of things just cause me to wonder why are we going to spend more money in the situation that we are if they're both equally qualified.

Yeah, I work with the principal, both of the principals of Pierce Coleman quite often through AMRRP. So it's not guaranteed that we would need to use a principal in either of those firms unless there was something that they were expertise in. Like for Pierce Coleman, they have Steve Coleman, for example, is a professional. He practices basically employment type a lot. He's the guy you want to talk to about that. I don't think we necessarily need to use the principle every time, but legal services are one of the few professions that receiving the right advice can save us money in the long run. I know that there's one that's a little bit cheaper, and I do think that they're both very qualified and very well. I just know that when you have a law firm over here that has 14 attorneys that all have expertise of things, when I look through the list of stuff that the town could need in the very near future, they come back stronger to me for our organizational needs.

I move to adopt resolution number 261823 appointing Pierce Coleman as the town attorney for the town of Pinetop Lakeside pursuant to the town code chapter 2.10 section 2.10.010 and authorize the town manager to execute the agreement on behalf of the town. I'll second that.

I do have one quick question. Is this a one year agreement then?

We don't have an agreement yet. So this is just you guys approving us. We're going to, we'll get an agreement and then I can make it for a year trial. And then actually both of them were really good to work with. They can come and be, can I go back and talk about this a little bit more? Is that okay? So we, one of the requirements is I'd like to have an attorney if they can't be here in person to at least be on the phone or on zoom. And both of them are really willing to do that. And to come to our meetings in person if it's something more serious at no charge to the town. They both did say that we could do this hourly for a year, how they wrote up their fee proposal. And then after a year, we can change or we can say, okay, we think we could go with a set rate and then we can do another agreement after that. So I would probably start with a year, yeah, if that helps.

Or if we want to drop them and go to somebody else, we can do that. Exactly.

OK. We will move on then to item D5, which is interviews and consideration of legal action to approve Resolution 26-1824 and Resolution 26-1825. We've got three openings on our Planning and Zoning Commission. And I would like to invite Jennifer to come up and present this item.

Thank you, Mayor. Thank you, Council. So for tonight's agenda, Item D5, we're conducting the interviews and consideration for the appointments for the Pinetop Lakeside Planning and Zoning Commission. A little bit of background on this. Our Vice Chairman, David Wesley, recently resigned on June 11th. 2026 due to moving outside of the eligible area, thus creating an unexpired term ending July 27th, 2027, resolution 26-185, or sorry, 1825. We're also filling the two-term positions which expire July 27, 2029, Resolution 26-1824 to restore the staggered terms per the Town Code Section 17116010. The notice of the vacancies were properly published and posted. So we have three applicants tonight. We have Phil Rhodes, Jeff Stearns, and Kathy Strong. They all reside within the town boundaries and are eligible. The staff recommends reviewing the applications, interviewing each candidate interviewee, and appoint qualified individuals in accordance with the town code, either proceeding by a motion, or we do have a written ballot at your discretion. The interview process for this tonight would be, Madam Mayor, we'll ask the first question, and followed by the other council members. The interview questions are at your seats. Once the candidate has finished, they will sit down, and we will call in the next candidate to begin. And they will go in alphabetical order, starting with Phil Rhodes. So just as a reminder, we do have the one vacancy for the unexpired term, 7-27-2027. It's a lot of sevens. As well as the two vacancies for the full term regular positions for three years that expire 7-27-2029. So I'm available to answer any questions for this.

I see three qualified applicants for three positions that we need. Unless the council feels differently that we need to go through all these interview questions, I would just like to invite each one of them to come up, introduce themselves, tell them what they're hoping to give to the town of Pintop Lakeside, and then we can have a little further consideration of that. I strongly believe that if you're going to be part of a society, be part of it. Lead the follower, get out of the way. I mean, that's kind of a life motto of mine. If I can help, I want to. You know, conversation, teamwork, getting ideas together is always preferred over what we call a dictatorship. I mean, one person can sit and bark orders, but if you get a few five, six, seven people going, yeah, you'll have some arguments, but you'll get to the bottom of what you want to do and come as close as you possibly can to getting it down to where it'll work.

Mayor, vice mayor, council, administration. So I have spent some time. First, let me talk about why I'm interested. So I spent many years in corporate America, various positions, both domestic and international. During that period of time, I'm very fortunate, had a lot of opportunity to acquire a lot of skills, qualifications. Since then, I've retired, enjoying retirement very much. But I think during that period of time, I have an obligation to give back to the community. And planning and zoning has been great because it's a give and take. I am applying my skills and qualifications, but at the same time I'm learning because, quite frankly, as a neophyte with respect to planning and zoning, didn't understand a lot associated with it and the intricacy associated with it. Frank's been great, now I work with Jennifer, I really enjoy that, and I enjoy working with the members of the group here in the town. So it's just an opportunity to take some skills that have been learned, apply them, and at the same time have the opportunity to learn. I always enjoy learning new aspects and new subjects. Good evening. Thank you for everybody listening. I hope I don't sound repetitious for what everybody else has said anyway. I am not retired yet, but I'm very close to it, so I'm trying to be more a part of the community around me. I've moved up here. I've wanted to live up here my whole life. I've been in Phoenix, and you don't really want to get involved with anything in Phoenix. It's just too crazy down there. And up here, I've got wonderful neighbors. Everybody I've met has been so kind and and gracious that I just want to be part of everything and part of what helps shape it going forward. So it was suggested that I look into this. This is how I can learn. This is how I can start to try to be a part of it all.

Thank you. so moving on we we have the option to go into an executive session to discuss that should the council feel that it's necessary otherwise we have as jennifer said one seat that fills a term through june of 2027 and then the other two would go through 2029. so any discussion from the council counselor heisler does anybody have any preference on the term they would fill at this point Go ahead, Councilor Heisler.

Let's see. Could I just ask? Of course. Could you just give just maybe a one-minute answer, your vision for the town going forward? I haven't heard much of that.

Things that you've liked that have been done or that you haven't liked that have been done and where you see moving forward.

Where would you like the direction of the town to go as far as the zoning and planning?

Well, okay, I spent my life basically planning. If you have a plan, you can always change it. If you don't have a plan, you just go on to the Valley of Darkness and hope nobody shoots you. I think we're going to get more people up here. I was down in the valley two weeks ago. It was only 103. I thought I was going to die. It was terrible. We're going to have growth. And if you look at, I don't want to, I'll go ahead and use names. Tucson is a prime example of a municipality that didn't plan. And in my previous, my business before I retired, I'd be down there quite a bit calling on customers and whatnot. And my gosh, You get lost even with a map. I mean, it isn't laid out in a very logical way, at least in my mind. I think that, you know, we're kind of hemmed in, reservation, , not a lot of room to maneuver. We've got a lot of real estate in the area, and some right in the middle of the area. That isn't even part of our of our group. There's still County. And to me that's that's something we should probably attack, look at, try and get those businesses, those people involved. So we're getting a little bit tax money, a little more support. I don't know enough about. You know how the Council works to really come up with a. A firm idea right now. I've been up here about almost three years. I was an overguard for about 15.

It's just, I think we need this kind of a group, and we need to work together to make this thing come together.

I'd love to hear from the other two. Just things you've seen as far as past decisions that you agree with or disagree with, or things that you've seen.

I don't know that I'll... I don't know that I'll go there, Councilman Halls. What I'll say is my time at Intel Corporation, I was identified as one of the top individuals associated with strategic analysis planning implementation. And in fact, Intel went so far as to sponsor me to go and study at Stanford. with Professor Robert Bergelman who is an expert in this area. He was an associate of Andy Groves who started Intel Corporation and they sponsored me to go and further credentials associated with strategic planning. So I have opinions associated with the town, but I've learned to be very disciplined in the area of strategy to ensure that those opinions can be substantiated by data and information. I do think that we are sorely in need of a strategic plan. I think that that's a major undertaking for the town. I'd be very interested in leading an effort associated with that and applying those skills and qualifications. I think that there is There's a myriad of considerations for this town. Growth is one of them.
