If you're going to testify in today's hearing, please remain standing and raise your right hand for swearing in. Madam Clerk, I've reviewed the minutes from the approval of last month's agenda and do approve it. Thank you. Everyone in the audience, if this is your first time here, basically how we handle this is that staff will go first. We call them in the order in which you came. Then we'll deal with the cases that are still left on the agenda after you all leave. You will have an opportunity to ask any questions of staff or tell me anything you wish. And then based upon what I hear today, this morning, I will make a decision. And if I find you in violation of the code, I will give you a reasonable period of time to come into compliance before any fines are assessed. There is also an administrative fee that gets assessed, which I don't have any authority or the Special Administrator doesn't have any authority to waive. And with that, we'll call the first meeting in order.

A complaint was received on February 10th, 2025, and a violation warning was issued on April 21st, 2025 after inspecting the property. The property is still in violation upon re-inspection and a notice of violation and summons to appear was issued on June 8th, 2026. The notice of violation and summons to appear was delivered to the property owner on June 8th, 2026 at 7.45 a.m. The notice of violation and summons to appear was sent certified mail to the property owner and verified by BCPA on June 8th, 2026 at 8 a.m. Photos were taken of the violation throughout the process and the property was shown in violation of Code Ordinance 150.11 and 155.313. City records were also searched and no permits have been completed. The property is not compliance at this time. We recommend 30 days to come into compliance or face a fine of $150 a day thereafter.

I am going to accept into the record the staff report, find that the matter is properly before the special magistrate, And based upon the evidence testimony presented here this morning, I am gonna find that the property and property under violation section 150.11 Florida Building Code as adopted by the city of Pembroke Pines in section 155.313 of the city code, going to give you 30 days to come into compliance. If you don't come into compliance with that timeframe, a fine of $150 a day will start to accrue for each day in noncompliance thereafter and The $150 admin fee will also be assessed. If you take care of everything within the 30 days, all you have to do is pay the $150 administrator fee, and you'll get an order from staff, and you can talk to them, or after you get it, we'll have instructions on how to take care of paying the administrative fee once you've come into compliance or within the 30-day period for compliance. The property was found in violation on 1-22-2026, and a judgment order was issued for the property to be in compliance on November 4, 6-24-2026. The property was re-inspected on 6-26-2026 at the date after the judgment order compliance date, and the property was still in violation. Someone still appeared for a hearing for an order imposed and finally was issued on 6-26-2026. The summons to appear for an hearing for an order imposed on fine and lien was posted to the property on 6-26 at 9-13 AM. Summons to appear for an hearing for an order imposed on fine and lien was sent certified mail to the property owner verified by BCPA on 6-29-2026 at 8 AM. Certified mail was verified by UPS tracking receipt and it showed that the mail was delivered. The photos were taken of the violation. And as of yesterday, the property is still in violation of Code Ordinance 155.313 and 150.11, work done without permits, kitchen being remodeled. City workers also searched. As of yesterday, no building permits have been obtained. We are requesting to certify the lien.

Okay, Mr. Sanchez, there was a previous hearing before the special magistrate where you were found to be in violation of the city code, doing the work without the permits. At this point in time, procedurally what's happening here is that the length of time has passed, generally it's three months, and we're now at the point where It's my, the staff is asking me to make a determination whether or not you're in compliance or not. If you're not in compliance, then what normally would happen is I would certify the amount of the accrued lien, which is up to $9,600. I would certify that amount and then staff would take steps to record an order stating that in the public records and it becomes a lien against your property. because you've not completed the permitting process. Do you have any questions or do you understand?

Yes, sir, I do have, and I want to clarify a couple things and put it on record. When this first appeared, the association told me that yes, you have to put in a permit and this and that, and I said, okay, can I take the cabinets down? The association said yes, and I said, okay. So then the next, the day before, I took these cabinets when this picture was taken. The day before, I took the cabinets down, and then the next day, I actually had an inspection for impact windows. So when the inspector came in, he started inspecting the windows, and he saw the work, and he said to me, he said, hey, are you guys doing something? I said, yeah, I'm just bringing the cabinets down. I just want to make sure that I got the right measurements so I could put in a permit and everything like that. And then he turns, oh, no, we can't do this, we can't do that. And that's when I originally found out that this was going on, that I was going to have. So then when the permit was, when the original paperwork was sent to me, I was out of the country working on a project overseas. And then I don't live at this property. I live in Plantation, Florida. So I wasn't going to the property. I was going to the property maybe once, once a month or something like that. When I got to the property, I went through opened the mailbox, ooh, this was there, contacted the city. The minute that this happened, the next day, I came here and I spoke to Joel, the supervisor, and I said, hey guys, just wanna make sure that we're all on the same page. I wasn't aware that I needed a permit to take the cabinets down. I do know that now, I'm pretty aware of everything that needs to be done. But then I spoke to the supervisor over there. I spoke to Joel. I spoke to everybody trying to make sure to say, hey, I didn't do this on purpose. If I would have been doing this on purpose, I would have never taken the cabinets when I had an inspection the next day. Correct? I get it. But so what happened was, is that I do travel a lot. I missed this one. I finally got in contact with Mr. Harris. I've been emailing him. I didn't know it was going to be here this day, but I emailed him from this date. From that date on, I already got a permit in place. I got everything here that is required by the city. Right. And all I'm just waiting for is for the permit to be approved and I can start the work. But as of right now, if they go back and take a picture, that same picture that's there, nothing has changed. I stopped everything.

No, I understand. So, you know, again, you probably may know this already. The homeowners association saying yes is the homeowners association saying yes, not the city saying yes. Yes. The city of Pembroke Pines does have a requirement in that if your homeowners association requires prior approval, they ask that you provide a copy of that, which I'm hoping you probably already have. So you're just waiting on the permit?

Do you know if there's any comments that you've received back from staff that they need to be update or anything or or you know what's the time frame for the issuance of the permit because normally you go through a review process and if there's any deficiencies in what you've submitted staff will provide you with a letter saying hey you didn't include or you need to change this yes sir so um you know in the meantime what's happened here is that You were probably given an initial time period of 30 days to come into compliance. The, you know, so you're three months past that deadline. So you're actually almost into month four from when the hearing took place. And, you know, I understand that you've been traveling, but, you know, we've got to, We've got to bring this to a conclusion. Yes, sir. So does staff have any? What I'm inclined to do is to certify the amount. Which means, as I said, the process gets completed. Doesn't mean that you can't and you shouldn't continue to deal with staff and to get this resolved. But I do not know whether or not here you can hold off on actually recording the order for 30 days to allow the process to be completed. If it does, then he can pursue whatever lien mitigation process. So that's what we're going to do. I'm going to certify them out. An order will be prepared, and I'll sign it, but it'll be placed on hold for 30 days. If within those 30 days you complete and get the permit, then you need to follow up directly with code enforcement staff to ask for a potential reduction in this accrued fine so you don't incur a lien and all those things associated with that. If you don't, at the end of that 30-day period, they're going to record that order And it will become a lien against your property. It means that you just now then have one additional step once you complete the process of getting that resolved and then having the city release that lien. And there's an additional cost associated with that that they can tell you or give you more information about. Do you have any questions?

And then you can also get your permit and then sit down with staff about how you get the what's called lien mitigation and pay the come to an agreement on payment of the outstanding fine and release of the lien. Even if that happens, you can still work with them and there's going to be an added cost to actually getting the recording cost will have to be paid to get the lien released when that happens. And based upon the evidence testimony presented here this morning, I am going to find that the previous order of the special magistrate finding the property owner to be in violation of Section 15011 and Section 155313 of the City Code of Pembroke Pines has not been complied with. As a result, 60 days of noncompliance, $150 a day, and continuing to accrue at $150 a day plus the $150 admin fee for a total of $9,150. I'm going to certify that amount. Request staff hold the order for 30 days to allow the property owner to resolve all the outstanding issues. If it's not, then staff can move forward with recording the order in the public records of Broward County, and that'll become a lien against the property. Again, work toward compliance. If you can get it all done with that 30-day window, then you save yourself having to do a couple additional steps. But once you come into compliance, you can resolve it with city staff directly.

Initially, I researched the company, Sunshine Pools, and it was in good standing. As the pandemic went on, the kids took over, and it became Modern Lux Pools. They said, oh, don't worry, we'll hold your $10,000 deposit and put it with the new company. They went ahead and moved along with the work very slowly, but it was some progress. And once I gave them the last payment, they disappeared on me. I didn't do any unpermitted work. So what's procedurally where we're at is You know, you were given, you know, three or four months ago when the original hearing took place, the special magistrate, whoever it was that was sitting here because they rotate or we rotate, gave you a period of time to come into compliance.
