A complaint was received on November 17, 2025, and a violation warning was issued on January 22, 2026 after inspecting the property. The notice of violation and summons to appear was delivered to the property owner on April 20, 2026 at 11.05 a.m., The notice of violation summons to appear was then certified mail to the property owner and verified by BCPA on April 21st, 2026 at 2 p.m. Voters were taken to the violation throughout the process and is shown in violation of code ordinance 150.11 and 155.313. City records were also searched and no permits have been obtained. The property is not in compliance at this time. We recommend 30 days to come into compliance or face a fine of $150 a day thereafter.

That is what the city staff is saying to you, that you've put in a front door to the house, as well as the metal gate that is shown in the photograph that's currently up, without obtaining a permit. State of Florida has adopted what's called a statewide Florida building code. And it requires basically, except with, there are some exceptions, but whenever you do anything structurally to a home, you need a permit, period. Because I'm assuming this was a hurricane-resistant door?

Speaking with the code officer, one thing that we'd just like to add to the record regarding the gate, and you can confirm, we got reports, you get reports from the association regarding the gate. Again, Brian Sherman is the city attorney. But this gate is different than any other gate that's in the association, which is why the code compliance officer believes it was replaced. And again, there's no permit. The gate was originally permitted, we agree, as far as the original. But when it was replaced at some point with a different gate, the evidence is the fact that no other gate in the association is like that gate. Therefore, it was replaced without a permit.

Based upon the evidence testimony presented here this morning, I am going to accept into the record the staff report and find that the case is properly before the special magistrate. and find that the property and property owner are in violation of section 150.11 of the Florida Building Code as adopted by section 155313 of the City Code of Pembroke Pines and that there is a door, front door of the home that has been installed without the benefit of the permit. Withhold determination with respect to the metal gate issue subject to the comments on the record and give the property owner 30 days to come into compliance by applying for and obtaining the permit for the front door or face a fine of $150 a day for each day of noncompliance thereafter. Admin fee? $150. There's also a $150 admin fee that I don't, you know, it's part of the process. You'll have to pay that. If you take care of everything, you won't have any fines except for the $150 admin fee. No problem.

Good morning. Supervisor, Code Officer Eugene Nelson, Code Compliance. Pembroke Pines Police Department. A routine inspection was done on 4-9 of 2024, and a violation warning was issued on the same date after inspecting the property. The property was still in violation upon a re-inspection, and a notice of violation of summons to appear was issued on 1-31 of 2025. The property was re-inspected again and still in violation, and a summons to appear for hearing and order imposing a filing was issued on 5-1 of 2026. The property is not in compliance at this time. Summons to appear for a hearing and order imposing a fine lien was posted to the property on 5-1 of 2026 at 1050 AM. The summons to appear for a hearing and order opposing a fine lien was sent certified mail to the property owner, verified by BCPA on 5-4 of 2026 at 2 PM. Certified mail was verified by USP tracking receipt and showed that the mail was delivered. Photos were taken. of the violation throughout the process and of yesterday's property still shown in violation code ordinance 155.313. It's an unfinished room addition permit for the garage. We're recommending at this time that we certify the lien.

Hello. Good morning. Please state your name for the record and your relationship to the property. Ernesto Dennis. I'm the permit runner, and I'm helping them get the permit to correct these violations. So this violation started out as three violations. One was for the carport being enclosed. The second was for a fence, the white fence that's on the right side of the property, and the shed structure that was behind the property. This was back in 2024. Now, out of those three violations, two of them have already been corrected. As you can see, Mr. Nelson agrees to here. The last one that has yet to be corrected is the carport enclosure, because we have had a lot of issues with getting the permit The owners have decided that they wanted to convert the carport officially, legally, and permitted into a master bedroom, along with moving the laundry to the back of the house and adding a bathroom to their house. This has taken quite a long time. I've been following up with Mr. Nelson, sending him the updates with the permit process. We've had a lot of issues along the way. At this point, as of right this morning, we have, out of the seven reviewers, which is plumbing, structural, electrical, mechanical, et cetera, et cetera, we have Five of them approved. Two of them have not completely approved the reviews, which is building and plumbing. They also asked us to get a concurrency certificate from the county of Broward, which we have gotten as another permit that we have to do with the with the county of Broward directly, which we just got approval for on the 18th. So we are in process of getting this fixed. We've already fixed two of the three violations. The thing is that it has taken quite a while. We have been following up with Mr. Nelson, as I'm sure he can agree to. So we would like to get an extension to be able to get this work done. I can't guarantee that the work will be done in 30 days. But I can tell you that most likely the permit will be approved in the next 30 days, and then obviously continue on from there. The homeowners, they're sitting right here, and they're pretty worried. They haven't dealt with something like this before, and they don't want to have a fine or a lien accruing on their house. They have shown that we've been working on it. So yeah, that's our case.

All right. So procedurally, The property has already been found to be in violation. And I don't think anyone's disputing that there was work done without a permit. And I appreciate the comments that you've made about taking care of the violations. So procedurally, what's being asked of me here today is to make a determination whether or not the prior order of the special magistrate finding the property be in violation. is in compliance or not. I think, again, everyone agrees based upon what I've heard here that it's not in compliance. So what I would normally do at the request of cities, I would certify that I would make a determination that order's not been complied, that a fine of $8,400 has accrued, because it has, certify that amount and then the you know this I'll sign an order it gets recorded in the public records and technically that becomes a lien against the property that isn't to say and does not mean that the property owners should not continue to work toward compliance and then once they get into compliance they can meet with the code staff and work out a lien mitigation agreement or unless there is you know an agreement can continue the matter for 30 days to see if they can get the permit but here's the point is the fines are going to continue to accrue so you know either way you're going to have to deal with that at some point and unlike other cities here in Pembroke Pines the lien mitigation request are dealt with directly by city staff. And they don't necessarily come back before me, except when there's an agreement. And then when everyone here is gone, one of the last things I'll do is hear a bunch of cases where I'm modifying some prior orders to that effect. So the point I'm trying to make is that I can grant the certification. It just means that, you know, you will now just deal directly with staff and you won't be coming back before the special magistrate. And assuming everything gets complied with, then you would work directly with staff to get the lien mitigation taken care of. Is that okay? I mean, unless staff has...

The property's been in violation for 55 days and accruing at $150 a day for a total of $8,400 plus the $150 admin fee. The notice of violation and summons to appear was posted to the property on March 31st, 2026 at 1.15 p.m. The notice of violation and the summons to appear was sent by certified mail to the property owner, verified by BCPA on March 31st, 2026 at 2 p.m. Certified mail was verified by USPS tracking receipt. Photos were taken of the violation throughout the process, and as of yesterday, the property is still in violation. They don't have no tree removal permit, which was void, and the tree removal permit is inactive. And city's recommending 60 days to come into compliance or face a fine of $150 a day thereafter. They replaced the two trees, but they still doesn't have an active permit.

It's a violation of section 155.674 of the city code of Pembroke Pines. I'm going to give the property owner 30 days to come into compliance. If she fails to come into compliance within that timeframe, There will be a fine of $150 a day and also impose the $150 admin fee. Make sure that she's communicating with Officer George and with staff on the tree permit application. So if she needs additional time, she can get that and not incur any fines.

Well, I have, everybody in my house has a car. So that's where we park. That's why the grass is not there because the vehicle park's right there. The van is the company van. I drive the van for the company. First I was harassed for ladder racks. I took the ladder racks off. left me alone for a while, and now I'm harassed for, because the van is parked at the property.

Okay. So I'll stop you there, and I appreciate your comments and your statement that you believe you're being harassed. So let me If you don't already know, kind of give you some insight into why you're here. So years ago, the people who sit up here, the elected officials of Pembroke Pines, decided to adopt a set of regulations. And one of those regulations says you can't park commercial vehicles in the residential neighborhood, period, whether they have ladders or not. You know they just that's that is the law in the city of Pembroke Pines Frankly, it's the law in a lot of cities in Broward County They're also as a rule. It says you can't park on the grass You know that's why we have driveways. That's why we the city's a lot require people to put in garages in their homes and driveways and then the result of parking on the grass for an extended period of time is the bald spots where the grass is dead, and now you're in violation of another section of the city code that says you're supposed to maintain your yard in a proper manner. So it's kind of a circular argument that if you're parking a car regularly on your grass, It's going to die eventually because it's not getting sun, it's not getting water, et cetera. So I'm tasked with the responsibility of hearing from the code enforcement officer, from you and anyone else, and making a determination based upon what I hear, what I see from all the parties as to whether or not there's a violation of these codes or not. So I'm looking here at the photos and I see At least one, if not potentially two. I'm not sure about that. The pickup truck that's in one of the background pictures, if that's a work vehicle. But the larger vehicle, the box truck, can't be parked there. I don't make up that rule. I'm here to see and hear everything and make a determination whether or not there's a violation or not. Photos show that there's a box truck. You have essentially... I'm not trying to put words in your mouth, said to me, yeah, it's there. And, you know, I previously took down the ladder, et cetera. That's great. I'm not unsympathetic to the fact that you are a business person and you work. And, you know, it makes it easier for you to be able to park your commercial vehicle there, the business that you work for, as opposed to having to go and get it and retrieve it somewhere else, et cetera. But those are the rules. So if it hasn't been made clear to you by city staff as the special magistrate, I'm telling you, you can't park it there. I don't make up that rule. That's the city commission. And if you don't follow the rule, then we're here. And ultimately, you may end up filing with a fine.

So if there are other people in your neighborhood who are doing the same thing, you suggest you are free to contact city and file a complaint and they will follow up I will tell you again maybe not you don't know this but number of years ago the Florida legislature adopted a statewide law we all have to follow it including you it says that these officers are not able to initiate a code enforcement case unless they observe a health safety welfare violation, unless they receive a complaint. And so that's changed the dynamics. So if you believe that there are other people in your neighborhood that aren't being treated in the same manner as you, you can file a complaint. They'll follow up. And my educated guess is that your neighbors will eventually come before either myself or one of the other special magistrates in short order, just as you are here today. So that would be my suggestion to you. If you feel that others in your neighborhood are doing the same thing and you're wondering why there's not anything being done to them, file a complaint and things will be done to them. So again, I'm not. The assistant city attorney is here and may be able to, or I suspect wishes to answer your question about if you were to strip the box truck of its signs, if it still would be a violation of the code.

We're happy, honestly, that you can't give the answer, knowing that, and again, for the record and for everyone here, that special magistrate can can't give advice from from the bench but uh mr ravino and his staff are more than happy to take a look at it as far as if any can be removed there are other restrictions as far as height um size of the vehicle i don't know if that falls into it so i don't want to give incomplete advice that is a possibility there is a way to make it comply it'll all comply with all the other rules as well but we're happy to have that discussion separately off the record okay so

Let's get back to there are three violations. The box truck, which you just heard from the city. An accommodation may be available to you. I can't speak to that. You'll have to talk to them. But there's also the issue of the parking on the grass and the the damage to the grass. And again, I'm not trying to be unsympathetic or not sensitive to your issues. I assume that some of these cars may be relatives or your children. I get it. Knock on wood, my home has actually an oversized driveway. So I don't have that issue, because I do have multiple cars, like it appears here. You'll have to move the vehicles off the grass, and you'll have to potentially re-sod at least a portion of the swale area so the grass grows back, and obviously keep vehicles off of it so it stays healthy. Do you have any issues you have any questions staff is recommending 30 days to complete that process? Which obviously the first step would be to move the vehicles you can also obviously talk to staff about this What can potentially be done with the box truck to bring it into compliance? So it can be parked there. I can't say yes or no to that at this point and then again cars off the grass And the grass repaired. 30 days, enough time?
