The facility will offer men's, women's, and youth leagues, youth training, private party rentals, and incidental beer sales. The Commission also approved a conditional use permit for a new worship center at 16537 Highway 33, converting a former cannabis dispensary.

So a major main reason why we continued the item from the prior planning commission meeting was to have an opportunity to ask the applicant, and afford them an opportunity to address the commission with any comments or questions that may exist. They are here this evening, the applicant and his team are here, to address the planning commission by answering any specific questions they may have of the commission. And so that's the first and foremost component. I don't feel the need to represent the same staff report There are no changes to the staff report. You may recall during that meeting there were comments shared by the city's deputy fire marshal, and I think at the time that we were trying to get more of his answers, he was already gone. Nonetheless, we have received a number of four or five small conditions, or small in terms of word length, that he recommends that the Commission apply to potential approval of this conditional use permit. I thought I grabbed them, but I grabbed the wrong stack of papers. But I've got the five I can read briefly at some point.

We are converting an existing building from formerly being used as a cannabis dispensary. It's been vacant for a time into a new worship center. And we're utilizing a use permit process to give the commission the ability to review that proposed new use as it relates to this site and to review draft conditions that could apply. And it's a small commission. worship center very small And so it's located at 16 5 3 7 highway 33 at the south end of town.

First one would be that due to the proposed change in use and occupancy, the project shall comply with the intended use and occupancy requirements of the California Building Code and California Fire Code, which is an A3 occupancy for places of worship. That's a standard type condition, and that's number one. The second one is project design plans must be submitted for review and approval and should be completed by a licensed design professional. All commercial projects require plan preparation by a licensed architectural professional. The third one is a building permit shall be secured for any tenant improvements. Fourth one is no parking signs shall be added along the south fence line as this serves as a fire lane. Dimensions of the parking stalls to the fence line should be included in design submittal. And the last one is operation is subject to inspection of occupancy requirements. And that's it. And so. I have these in writing to add to the project with potential approval of this use permit.

Fire, planning, and then we have, minor comments from our public works department. There's an existing deferred improvement agreement between the property owner and the city. It doesn't apply to the applicants because it involves a requirement for the property owner, not the applicant, the property owner, to connect the city sewer and water services when the city brings them to that part of town. So at that time, as I read it, I believe they have 60 days When those improvements are completed, it starts a sequence of events that are outlined in the Deferred Improvement Agreement that specifies how the property owner is to react to that. Okay.

I considered it, but as I read through it, I thought it doesn't apply to this use, it applies to to the property, and it's a water sewer issue that the owner's on the hook for, not the applicant's.

And that will mainly like be apart from five times daily. And it will be like, as you know, like before the sunset, it will be like three times and after the sunset, two times. And it will be like all done within like, I think like during the summertime by 9 or 9.30 p.m. And during that winter season, it will be like done by 6 p.m. And also like we have some kind of like annual, like event or like Christmas, we have something like we call Eid. So we'll have that kind of like gathering there. And also like we weekly, we have a like weekly prayer, mainly like that is the big gathering, the weekly big gathering that we are anticipating. And it will happen like weekly mainly during the like afternoon's time, like I don't know, 1 p.m. or 1.30 p.m. So this is the main purpose of this place. And we are also very thrilled to be part of this community and also practicing our own culture and everything here.

I'm under the impression that the applicants still need to apply for a building permit. I'm sorry, a business license, not a building permit, but a business license. And I don't have confirmation that that's been done yet. Can the applicants address if that's been done? Yeah, do you know if you've... Have the applicants applied for a business license yet? Okay. Apparently you need to. I want to emphasize that one of the conditions of approval that's already in here, it's been in here already, states that the project shall comply with all applicable state and municipal codes, including the current building codes adopted by the City of Patterson and meet the requirements of the Public Works Department, City Engineer, Building Inspector, community development director, and fire chief. But the first phrase of that condition, existing condition number 22, is that it shall comply with all applicable state and municipal codes, one of which would be requirement for a business license. I want to just emphasize that we're calling that out. That's something that needs to be taken care of. So I don't want that to be misunderstood in the event there's any confusion over that.

Okay. I'm sitting down. So I've known this building since I was 12 years old. This building served Del Monte and Baldwin Trucking for dispatch during the fruit season. Is that what it was? It's a very small building. Carlos modified it a little bit, but that building only housed three people. And so with the septic tank system that's there now, and you're going to start putting 30, probably more like 50 people a day going through there, that's a problem. Secondly, as far as the water source goes, that's a real problem. You know where the water comes from? Well, no, it doesn't. It comes from the neighbor over on Poppy. There's about a 1,200-foot black irrigation line going down along the canal and then going in to feed water to the building. And that's like...

So the question is, do we have to have an agreement from them to provide water?

I'm not aware of any requirement for an agreement. The main issue, potential issue with that is the site's ability to meet any fire requirements but we have taken a during this process we have reflected back on the prior approvals where a more intense use was proposed and approved by the planning commission this use is less intensive because it's a sporadic use throughout the day and while there's a potential for a high number of people there it's for a limited duration of time And so additionally, in correspondence we received from the city's chief building official, when given the opportunity to consider matters like this, like water and like other building and tenant improvement related issues, he's confident he can address any of those during the tenant improvement design stage when they get to that, if they get to that, if it's even needed at all. So the chief building official did not have concerns about water or fire abilities of the site. So that was further confirmation to us that we weren't going off on a tangent.

Okay, and he's now been alerted if there's an issue and That's a property owner issue, not so much a use issue. That's part of the building. That's part of the building, yeah.

And that's where the city's chief building official who oversees all building life safety matters in conjunction with our deputy fire marshal was not concerned and knows, believes that that can be addressed immediately. if it's even needed at a subsequent stage. And if it can't for some outside of the envelope reason, they just wouldn't be able to proceed, even if they've got a use permit. If they can't meet any life or basic necessity requirements, that would stop them. This allows for the use, but they still have obligations to fulfill from any building or state building code or state fire code requirements. So that's sort of the city's backstop to protect against any limitations that could otherwise cause issues of life safety or sanitation or what have you.

Yeah, the building safety is really not part of our – somebody should – I mean, it's got to be a safe building for somebody to use it. But if the other part of that is use, how many people, then we have a condition here about – They measure the number of people per square foot.

So the request before you is the approval of a conditional use permit to allow A, the relocation of an existing use down on South 1st Street, an indoor soccer facility. And two, an ancillary use of on-site alcohol sales and consumption for or within that facility. So both indoor recreational uses and alcohol sales require a conditional use permit approval before the Planning Commission. They are located in the heavy industrial zone, so we want to make sure that they are compatible with any surrounding uses and future developments within that area. Give you a little more description on the site. The project site contains a 7,000 square foot metal building that will house the indoor soccer turf facility, bleachers and seating for spectators and players, interior restrooms. His old facility or current facility on South First has restroom facilities outside of the metal building. These will provide him with restrooms indoor. They will, of course, undergo any sort of ADA upgrades that are required. And also, it will provide him with... snack bar area, and of course the ancillary alcohol use that he's seeking. The property is fully fenced and gated, providing a secure access for the building during non-operating hours. The surrounding land uses for that area are all industrial businesses with residential uses further down North 1st Street. So not necessarily neighboring properties, but further down North 1st Street there are some residential uses. The operational characteristics that Mr. Cortez is proposing are the facility will be owner operated, so he will be the the main operator for the site. He will be having, as he currently does in his existing facility, men, women and youth soccer leagues throughout the year. He's also proposing to include more youth training and conditioning. He's got a bigger facility, so now that would be something he's able to coordinate a little bit better with a bigger facility. One other item he's also proposing is private party rentals. We know that's a big need here in town. We don't have a place where people can have parties for their children, so he's proposing to do that as well. Another operation includes a snack bar and, as I mentioned, the alcohol sales and an area for him to sell some soccer-related items for either the players or just people in general that are looking for some nothing major, just either cleats, jerseys, shin guards, socks, those items. For those that aren't familiar with how indoor soccer operates, it's a six-on-six game. There's no out-of-bounds because the walls serve as another player for the teams. So, it's very fast-paced. I recommend the Commission, if you ever do have a chance, go take a look at the facility. They're very fast-paced, very exciting games to go watch. His hours of operation, they tend to change. Summer, spring, they go a little bit later in the winter and fall because of the time change. They start earlier in the day, but he does run games every single day of the week. Depending on the age and the league, they all have a different day that they play. Parking and circulation, he is proposing to have 30 parking stalls. which exceeds the 23 required by the Patterson Municipal Code for his type of use. The circulation along this site is designed as one way and wrapping around the existing building, which should promote a safe vehicle flow in and out of the facility. As mentioned, the alcohol sales component would be incidental to the primary recreational use. And this is to help offset his increased operational costs, since it is a larger facility with more operating costs included. To help, staff has included some conditions in the report to help offset some of those safety measures. That may come with the alcohol sales. So some of those are limiting the consumption of two drinks per person, prohibiting alcohol consumption before games. a designated consumption area for those that do wish to purchase alcohol. He is proposing to have a security guard on site, video surveillance throughout the site as well, both indoor and outside of the building. And, of course, he will have a fully approved ABC license before we are even able to sign off on his business license. We are also conditioning the project to a required six-month and one-year review. So at the six months of us signing off on his business license and him operating, we will be before you again for a review. And then at the one-year mark, we will have a CUP review as well. So all these measures are incorporated into the conditions of approval for the project. Environmental review, this type of project qualifies for a categorical exemption under Section 15301, existing facilities. So he's not adding to the building. All of his modifications are all going to be as part of a TI. So staff recommends that if planning commission make the required findings and approve conditional use 2510, subject to the attached conditions of approval within the staff report. My name is Gloria Zaragoza. I wanted to speak on behalf of the indoor. I'm a coordinator of a nonprofit called Kick for Autism. So what I do is I coordinate a soccer program for kids with autism. Victor, or Victoriano, what he does for myself is he rents the facility to me at no charge. I started this program about... Six or seven months ago, and the purpose of this program is to help kids with learning disabilities, mainly autism, but obviously open to other disabilities. I myself am an autism mom, so... I have tried putting my son into a regular league, regular games, and obviously it's not the same because a lot of kids with autism need that one-on-one instruction. So the program focuses a lot on this one-on-one. So it's not practices and games. It's more of a... Trying to get like the basics of soccer like kicking the ball dribbling the ball scoring The basic so I wanted to just give that input that he the facility has helped out a lot by basically giving a sponsorship to the program and by allowing us to use the facility to give those kids opportunity to play. And a lot of them are at different levels. Some are more mild, some are more severe. So we do have the kiddos who are more like interactive. Some are more, they just, want to just run around, which is still great because we get them to be active. So I feel like it would be a great asset to get this new facility because it would be a bigger space for them. I've had two programs run so far working on the third, but we're holding off since Victor has been working on transitioning because a lot of kids with autism aren't very well they don't do very well with transition so we've been holding off on trying to start the new program just to see how it all goes and obviously if it doesn't go through we'll start the new program at the beginning of next year but we are hoping that everything goes well so we're hoping for good things that the facility has done really well because outdoor soccer compared to indoor soccer for kids with autism helps them greatly because a lot of kids with autism do what is called stimming, which is pretty much what you can say is just running around. They are not so focused on staying in the borderlines of the field. They just want to elope and just run around and not even try to focus on kicking the ball. So I know as an experienced mom who has put her son in soccer, he just wants to run off and me and dad just chasing him around the field as the game is going on. Yeah. Not so fun, but we have gotten him to be active. So having the facility indoors, obviously it's a closed facility. So having him be indoors has helped us get him to focus more on, okay, like let's kick the ball. We're in the facility. He still obviously tries to run out, but it has helped a lot.
