The next item on the agenda is section F, public hearing, agenda item F1, project name 805 commissary, city staff Michael Lackman, associate planner, planning and zoning permit number 25-550-01, major modification, property located 2958 Sturgis Road, a request to increase the number of mobile food facilities stored on site, FROM 30 TO 60 AND ASSOCIATED SITE IMPROVEMENTS FILED BY DESIGNATED AGENT KEVIN COHAM ELEVATED ENTITLEMENTS 5716 CORSA AVENUE WEST LAKE VILLAGE ON BEHALF OF THE PROPERTY OWNER ALVARO MILGOZA 2958 STURGIS ROAD. PER MEASURE M A STAFF PRESENTATION HAS BEEN PRE-RECORDED AND THE LINK HAS BEEN POSTED TO YOUTUBE. THE STAFF WISH TO GIVE SOME INTRODUCTORY REMARKS AT THIS TIME.

Yes, I do. We received some comments and questions from Commissioner Nash, which I would like to address at this moment in time. So question one, the staff report recommends a class one categorical exemption for existing facilities. However, this modification is doubling the intensity of the use from 30 to 60 mobile units on site. At what threshold does the expansion of operations trigger a more comprehensive environmental review? So this project has been reviewed and meets the CEQA guidelines under Section 15301 existing facilities. Therefore, it is exempt. From CEQA, the project is not increasing the existing building footprint and all physical alterations are minor. Therefore, the addition of catering trucks is not intensifying the use. Question two, has the Environmental Resources Division or the local wastewater authority reviewed the potential impact of 60 food trucks discharging commercial grease, fats, and oils at a single location versus the original 30 units? So yes, the project was reviewed by all relevant divisions of the city of Oxnard, including Environmental Resources and Stormwater. and thus the project meets all requirements of both departments. Question three, if the applicant exceeds the newly proposed 60-minute threshold, how will code enforcement monitor and verify compliance? Is there a requirement for a logbook or digital tracking system of permitted vehicles to be made available to the city upon request? So all mobile food facilities are required to obtain city business licenses as well as licenses to operate through the Ventura County Environmental Health Department. I've been in contact with the Ventura County Environmental Health, and they will not permit a greater number of mobile food facilities at this facility than what is allowed via this major modification, which the proposal is 60. Question 4, how will the applicant manage peak hour queuing to ensure trucks do not idle or back up onto Sturgis Road? So, the applicant can speak on this a bit more, but based on information provided by the applicant and the location of the mobile food facility area, the switch out between employees' personal vehicles and trailers and trucks takes one to two minutes, essentially. Additionally, vendors operate on their own schedules, and the facility is open to vendors 24 hours a day, which leaves very minimal peak times. Question number five, is there a designated on-site staging zone to handle multiple arriving or departing trucks simultaneously without blocking the 12 new employee parking spaces or the drive aisles? So there are two staging areas located directly adjacent to the existing warehouse building. Additionally, like previously stated, The switch-up between employees' personal vehicles and trailers and trucks takes one to two minutes based on information provided by the applicant, which should ensure no backing up at this facility. Question number six, what ventilation or fire suppression upgrades are being made inside the facility to safely accommodate the indoor storage of motorized vehicles and trailers? So the project will need to go through building permit plan check post-entitlement to accommodate the alterations, including the storage of motorized vehicles inside the building. Thus, the building will be required to be up to both building and fire code to handle these vehicles. Question number seven, are the overnight parking spaces equipped with electrical hookups to keep refrigeration units running in the trucks? Then I was asking about generators and whatnot. But yes, the parking spaces are equipped with electrical hookups, so there should be no generators on site, and any would require city building permits. Question number eight, doubling the capacity to 60 units means a massive influx of solid food waste, organic debris, and cooking or recycling. Will your exterior trash enclosures and grease traps be upsized to handle this volume, and what measures are being taken to prevent increased vector rodent and pest issues in the immediate area? So the project has been reviewed by our environmental resources team, and a new trash enclosure is being proposed that will meet the standards set forth for this use by environmental resources, including the intensity of the use. Again, the site is also subject to the Ventura County Environmental Health Regulations, which will ensure the site is compliant with food safety regulations, including rodent and pest issues that could potentially arise. And last question, will the food waste be diverted to a recycling program? So yes, the new trash enclosure proposed includes space for bins that will be utilized for food waste pickup through our City of Oxnard Environmental Health Department, which will be performed by Environmental Resources and subsequently dealt with. And that's all the questions I have.

So essentially, from my understanding, what the applicant is stating is that they just want that if there is like an intensification of food trucks or reduction for some reason, that that ratio would stay the same for all future modifications.

Yes, thank you chair Arrejo We did receive some questions from the planning commissioners Regarding the addendum and the general background to to the project site Yes, this is the 16th addendum to the EIR Projects Typically will be reviewed through the sequel process when they come in for development we anticipate no more addendums to the EIR and MOVING FORWARD BECAUSE MOST OF RIVER PARK NOW HAS BEEN BUILT OUT. SO THIS ZONE CHANGE SHOULD BE THE LAST ONE. And the future development on the property will be analyzed when that comes in. So we would then look at traffic impacts and any other future infrastructure impacts at that time. So for the time being, the addendum did not uncover any additional significant impacts outside of what was originally stated in the EIR. AND WITHIN THAT ADDENDUM EACH OF THE SECTIONS ANALYZED PROVIDED A LITTLE JUSTIFICATION AND REVIEW FOR WHETHER OR NOT IT'S SIGNIFICANT AND EACH OF THOSE STATEMENTS BASICALLY SAY THAT THERE ARE NO SIGNIFICANT IMPACTS DUE TO THIS PROJECT. See you. Again, to reiterate that the parcels that will be developed, it's just the one major parcel, the big one, of the three that has a proposed ENA on it. The other smaller parcel has the digital billboard approved on it, and the other one has partial of the lift station. Referring to the PowerPoint slide number four, should the commission be concerned that It used to be commercial regional and then moved to public facilities and now it's going back. Could you just elaborate on the reason why there was the switcheroo or the switchback, I guess?

Sure. So in 2000, well, 2002, the specific plan was approved with Commercial Regional. In 2008, there was a proposed public facility for storage offices. THAT WAS APPROVED AND ENTITLED BUT NEVER CONSTRUCTED. AS YOU CAN IMAGINE 2008 WAS A TOUGH TIME FOR EVERYBODY. SO I BELIEVE THE FINANCIAL ASPECT OF IT WAS INFEASIBLE. AND THE PROJECT THEN SAT VACANT AS PUBLIC FACILITIES FOR I GUESS NOW ABOUT A DECADE OR SO. SO REVERTING BACK TO COMMERCIAL the the housing department can elaborate on the process that they went through for the surplus land act that was approved by the city council back in february 2022 so the the decision that because it's a city-owned parcel was that they were going to designate it through the surplus land act AND PUT IT OUT FOR BID TO HAVE DEVELOPMENT ON IT. AGAIN, I THINK ELSA COULD PROBABLY GIVE MORE INFORMATION ABOUT THAT PROCESS. BUT ULTIMATELY THE PARCEL WAS NO LONGER NEEDED FOR PUBLIC THERE ARE OTHER PARCELS WITHIN THE RIVER PARK SPECIFIC PLAN ZONED FOR PUBLIC FACILITIES THAT I BELIEVE ARE JUST USED FOR THE STORAGE THAT WAS ANTICIPATED FOR THIS SITE. SO THEY ABSORBED THAT THROUGHOUT OTHER PARCELS IN THE CITY. AND IF THERE'S ANY PUBLIC FACILITY IN THE FUTURE, THIS WOULDN'T PROCLUDE THAT FROM HAPPENING BUT THE CITY THEN WOULD HAVE TO GO THROUGH. PROCESS TO OBTAIN LAND AND FIND A WAY TO BUILD A PUBLIC FACILITY THROUGH DIFFERENT MEANS AND BUDGET.

Yeah, essentially what happens under the Surplus Land Act is there's a requirement that the council make that designation that it's no longer needed for agency use. So my assumption is because it sat there vacant for so long with really nothing else going on at the property. So the process is that the council declares it no longer necessary for agency use. Then a notice goes out to potential affordable housing developers to see if anybody wishes to purchase the property. Then there's a process of good faith negotiations, et cetera. And all of that process has been followed. Now we're at the stage of entering into an ENA with a potential developer for the site. So again, you'll hear more about that in the future when there's an actual project for the site. But this tonight is really only about the designation.

But this parcel was actually going to be developed as a storage and office space for the parks department. And at that time, I kind of went ballistic because I was like, why are you taking this prime piece of real estate right next to the 101 and putting in a storage shed, basically? for the lawn mowers. It was just insane. So I'm very happy to see that this is now going to be used for more productive land use. And I'm certainly going to support this project or this amendment. So thank you.

Actually, looking at this project, I was, I wouldn't say I wasn't against, but I wasn't totally for it just based on the documentation that I read. As some of the members of the Planning Commission know, there was a permit the first time, at least in our six years of being Commissioner Dr. Lopez here, that A PERMIT WAS DENIED AND APPEALED TO THE CITY COUNCIL. ANOTHER ONE HAD A TIGHT VOTE, BUT THAT WAS THE ONLY ONE WITH A MAJORITY AGAINST. AND SO I LIKE THE WORDING THAT COMMISSIONER NASH USED OF A MORE PRODUCTIVE USE. I'LL STILL HAVE A SIDE EYE IN REGARDS TO WHAT ACTUALLY IS GOING TO BE THERE. YOU KNOW, THE TREPIDATION FOR APPROVING ANYTHING THERE WAS THAT IT WAS SO CLOSE TO THE INTERSECTION AND WITH THE entrance and exit there, the cars could go out in terms of that Starbucks there. We'll see what happens here in the future, and it's less of a concern just in general, but of course we're only looking at a recommendation to the City Council and not on any business, and so I will look forward to voting in favor of recommending this to the City Council. Good evening, commissioners. So just in regards to upcoming meetings, we anticipate that the September 17th meeting will be canceled. And then we will have the first meeting in October. At this point, we're tracking two items. that will be for that meeting. And then for the second meeting, we also anticipate having an item for that one as well. I also want to note that the South Oxnard Connect ISMND, or sorry, ISND, is out for public review, initial study, negative declaration, instead of mitigated. POTENTIALLY SIGNIFICANT IMPACTS FOUND SO THEREFORE THERE WAS A NEGATIVE DECLARATION PREPARED BUT THAT IS OUT FOR PUBLIC REVIEW. October 5th, and we anticipate that coming to the Planning Commission for Recommendation to City Council in November. Also, I would like to give a thank you to our Recording Secretary, Kristen, as this will be her last meeting with us. Luckily, she's still going to be here with the city. She's moving over to the clerk's office, but just want to thank her for her hard work and dedication here, and she will be missed.

I was, I had the opportunity to go to my, as all of you know, parliamentary procedure is one of my things that I do outside of work. I had the opportunity to go to a conference. Definitely learned a lot. I don't think I have to put a lot of those in use in this commission because we work much more collegially than the scenarios that have been posed AT THE CONFERENCE. AND SO I JUST WANT TO USE THIS TIME TO JUST THANK SPECIFICALLY AND GENERALLY FOR MAKING MY LIFE AS CHAIR AS EASY AS POSSIBLY EVER WILL BE IN MY LIFE. AND SO THAT WILL BE A HIGH BAR THAT I DON'T THINK A FUTURE ORGANIZATION THAT I MAY OR MAY NOT CHAIR IN THE FUTURE WILL MEET. AND SO I GREATLY THANK THE PLANNING COMMISSION SINCE ME AND COMMISSIONER DR. LOVAS HAVE BEEN HERE UNDER CHAIR ON TO RIGHT NOW. SO THANK YOU VERY MUCH. But you can also come in person here in the city council chambers. And of course, I definitely want to say I'm gutted that our Madam Secretary is not going to be here. She is my first, sometimes my only point of contact with the Planning Commission before She has to forward whatever shenanigans I have to give the staff to deal with. And so I greatly appreciate the last few years. It sucks to say informally, but I wish you the best. And so I like to always say that I'm personally sad, but I'm professionally happy for you.
