A request to allow the sale of beer, wine, and distilled spirits, ABC license type 70 on sale general, restricted service at an existing hotel, true hotel. The proposed hours of sale are daily 7 a.m. to 1 a.m., filed by Marcus Frisco of Hawthorne, California, on behalf of property owner Maticus Hospitality Group, Incorporated, again, of Hawthorne, California. Per measure M, a staff presentation has been recorded, and the link has been posted to YouTube. Does staff wish to give some introductory remarks? Mr. Murillo. I apologize. Thank you, Chair. And good evening, Commissioners. Yes, to reiterate, today I'll be presenting the alcohol special use permit project number 26-510-03. It's a request to allow the on-site sale of beer, wine, and distilled spirits, ABC license type 70, restricted services, an existing true hotel, once again located at 180 West Esplanade Drive within the general planned commercial development zone, C2-PD. While there was no community workshop required for the location of this alcohol SUP, there has been comments and concerns provided by the commissioners. In summary, comments regarding the service and consumption for the business operation for the True Hotel have been brought to attention. Multiple concerns regarding how the occupants may navigate permitted or unrestricted areas for consumption have been addressed within the conditions of approval for the project. This is seen primarily within the signage section WITHIN THE POLICE CONDITIONS PROVIDED WITHIN THE RESOLUTION. THERE ARE DIFFERENT STIPULATIONS IN PROVIDING SIGNAGES THAT WILL BE PLACED ON SITE, PROHIBITING ALCOHOL TO BE TAKEN AND CONSUMED ON CERTAIN PARTS OF THE SITE, AS WELL AS MULTIPLE SIGNAGES TO ADDRESS AND PROHIBIT UNDERAGE CONSUMPTION OR POSSESSION OF ALCOHOL. THESE MAY BE FOUND UNDER CONDITIONS NUMBER 32, 34, AND 35 OF THE PROVIDED RESOLUTION DRAFT. Other comments made aware to staff was in regards to the correlation of permitted service hours of alcohol with the amenities being provided by the hotel, which is being more specifically towards the pool operations of the site. The applicant has provided in correspondence that the pool will be open from 7 a.m. to 10 p.m. However, the outdoor consumption within the hotel premises will be subject to the limitations posed by the applicant and their business operations. If there's any other questions, I'll be happy to further explain during deliberation. Thank you.

I believe it's 1 p.m. 1 p.m., okay. 1 a.m., 1 a.m. 1 a.m., okay.

No, but it is pretty much industry standard and the ABC hours actually go to 2 a.m. But, you know, I mean, we just this is convenience and this is for doing activity hours and they don't really go well past that. So 1 a.m. is about it.

Yes. As far as the hotel's policy go, are you allowed to bring food in from the outside to your room? And then also the same thing for alcohol. Can you bring outside alcohol into the room from the outside?

Well, we would definitely discourage, but people come with various celebrations in mind, whether it's anniversaries and they may have their own bottle of, you know, vintage or special wine or whatever for the occasion. And we can't police that. So, I mean, we're not going to be checking bags. And yes, there are outdoor third party deliveries of food. that would come, but those vendors would have their own restrictions if they tried to deliver something else.

So policy-wise, you're at the front desk. I see somebody coming in with a case up here. There's not going to be anything said because it's not in your policy to say something. Is that correct?

Correct.

A request to allow the sale of beer and wine ABC license type 41 on sale beer and wine eating place at a proposed restaurant. Kura revolving sushi within an existing 2682 square foot tenant space. The proposed hours of alcohol sales are daily 7 a.m. to 11 p.m. filed by Hyde or Hida Iwagami of... What does it say, the city? 92606, on behalf of property owner TUVF Esplanade LLC of Culver City, California, city staff Christopher Murillo, assistant planner. The link has been posted to YouTube. We'll go first to any comments from Mr. Murillo.

Yes, thank you, sir. The next project, alcohol special use permit, project number 26-510-04, as I mentioned earlier, is an ABC license type 41 request. Alcohol on-site, alcohol sales and consumption at a bona fide eating establishment located at 347 West Espanol Drive. While also there was, since this is in the esplanade, this doesn't require any kind of community workshop hearing. However, prior to meeting, commissioners have had questions in regards to the subject project. Similar to the True Hotel Alcohol SUP, the project had comments entailed primarily based around the operational standards that would be implemented by the restaurant to ensure that alcohol sales will be related to the businesses as part of the food establishment established on site. And no aspect of alcohol sales is to be outside of the food establishment. These comments have been accounted for in the conditions of the draft resolution. Much of the devices to counteract such consumption of alcohol outside the restaurant will be addressed primarily through the signage that will be implemented as part of the resolution conditions. Additionally, to address the concerns of alcohol sales in relation to the restaurant food sales, this will be conditioned as well as the restaurant would have to provide quarterly sales of gross alcoholic beverages in connection with the establishment restaurant operations of the site. If there's any further questions, I'll be happy to answer during deliberation. Thank you.

Terrific. Good evening. My name is Steve Rawlings. I am a consultant for Kura Sushi. I assist them with permits to sell alcohol up and down the state of California. Just for the record, we concur with your staff's recommendation and do agree to all of the conditions of approval as presented to you this evening. If you're not familiar with Kura Sushi, they're a very fast-growing sushi company. They have like 600 total, Taiwan, Japan, and then 82 in the U.S., and 27 and growing rapidly here in the state of California. They're certainly very excited to be here in Oxnard. As the name says, it's revolving. They have a conveyor belt that runs through there. I will say this, the alcohol is served by a human. It's not on the conveyor belt. They do have little robots that go around with water, but again, the alcohol is served by a person there. It's very popular. We don't stay open late. It closes at 11 o'clock, and there's no set-aside bar or anything along those lines, so I don't think this is going to be any issues in terms of public safety and all the other communities that they are serving, we haven't had any issues. So with that, I'm available for any questions that anybody may have.

Okay. And I'll just read you this question I have. Given the automated low touch nature of a revolving sushi concept, how will table ordering systems be programmed to prevent miners from accidentally

intentionally adding alcoholic beverages to their tables digital cart before a server manually inspects their identification well they if we're bringing a you know beer and wine there then anybody who looks like they're under the age of 30 does have to present an identification which is very similar to any any restaurant and then obviously if THE PERSON THAT ORDERED IT IS NOT AN ADULT OR OVER 21, WE WILL NOT SERVE THEM THE ALCOHOL. WE HAVEN'T HAD ANY REAL BIG ISSUES WITH THAT TYPE OF ACTIVITY.

YES. I ORDER, CAN I ORDER ALCOHOL BEFORE I DEAL WITH THE FOOD OR DO THEY GO HAND IN HAND?

No, they would allow you to take a drink order, but it's a restaurant. It's not intended for people to come and sit at a bar and drink, and I would say 99.9% of the time somebody's going to start ordering food. Just like a lot of restaurants, they'll come before you first and take a drink order, bring the drinks, and then get the food order later.

All right. Now the other end of it. Had a great meal, want to sit back and have a one or two. Does that work with the program you have in play, too?

Not really. I have personal experience with this because Kurosushi opened up in my hometown. So myself and a buddy of mine went down there one evening, and it was like a Tuesday evening. And there was a line out the door. So we grinned and bared it, waited, you know, our 45 minutes, got a table. Once you're done, they need the table. So there's no, you know, sitting around.

Thank you, Vice Chair, Dr. Surrett. Any others from the commission at this time? One question to staff. Were there any extra permits needed because of the revolving nature of, with the food and everything? Or is there any conditions of approval that are specific to the revolving nature of the restaurant?

Yes. Per the previous use of the tenant space, there was a T-Mobile wireless facility retail use. There are multiple plan checks in progress right now, one for the tenant improvement to establish a restaurant use for the career revolving sous-cheap. This can entail establishing the back of house kitchen area, consuming area for the restaurant food, and then also there's a signage plan check in place.

Oh, let me be more specific with my question. Was there anything extra special in regards to the mechanical nature of, I'm not sure if there's something in regards to the machine or the electronics that the city needed or put into the conditions of approval because of that, or was that not a concern or anywhere in the permit?

On planning behalf, not necessarily. There's no any kind of exterior improvements, no kind of facade changes being proposed. However, all the improvements interior would need to be coordinated with building a safety. I'm not familiar if there's going to be any kind of utility upgrades. Is that what you're meaning?

Okay, thanks. I think I answered my question. I just want to make sure of the, I've been in one. I just want to make sure that it went through whatever safety checks and you mentioned OSHA and That's good enough for me. So thank you very much. I appreciate it.

The building safety permit will address most of those issues concerned.

Mr. Friday I just want to make a comment actually both to the true hotel and correct that I Move forward and I have I support this project. I like that you guys take in consideration Law enforcement and I was reading including that beat officer that patrols that area and That says a lot. So I'm very pushed forward for security, make sure everything's safe and our officers in our city doesn't get into danger due to more alcohol use. So I like that by taking in consideration the officer that actually patrols that area. I WAS REALLY HAPPY TO HEAR THAT WHEN I WAS READING THE REPORT FOR BOTH, FOR THE HOTEL AND FOR THE RESTAURANT. SO THANK YOU FOR THAT. THANK YOU FOR TAKING THEM IN CONSIDERATION AND IT PLAYS A BIG, BIG ROLE JUST FOR FUTURE PROJECTS AS WELL.

Thank you very much and congratulations. Moving on to agenda item F3, commercial AT&T stealth wireless telecommunication tower facility. Planning and zoning permit number 24-530-01, special use permit wireless property located at 1150 Commercial Avenue. A request to construct an 80 foot high stealth wireless telecommunications facility designed as a clock tower structure including an associated equipment enclosure and ancillary equipment within an approximately 466 square foot lease area. The application was filed by designated agent John McDonald of Irvine on behalf of AT&T and property owner Viola Properties of Oxnard. City staff one Carlos Torres. Per measure M, a staff presentation has been prerecorded and the link has been posted to YouTube. Does staff wish to give some introductory remarks at this time?

Yes. I just wanted to good evening, Chair and members of the Planning Commission. I would like to start by addressing some of the questions that Steve Nash provided to us before the Planning Commission hearing and some of those questions relate into the type of materials they use for the wireless facility. If there are any other besides the typical ones such as the fiberglass reinforced plastic and framing panels and as well the exterior insulation and finish system. And those are the very typical materials that the wireless facilities use because of the lightweight, durability, weather resistant, and radio frequency transparency characteristics. So we didn't request the applicant to provide all the type of materials because typically, again, for the radio frequency transparency, you know, those are the very typical ones that they use. although the actual framing of the wireless facility is going to be made out of steel, steel framing. Other questions that are related to Mr. Nash that he asked, he was asking questions about like the actual maintenance of the clock tower faces. We do have specific conditions of approval in the resolution that requires the applicant to maintain those clock faces. And there are in good working order and repair conditions, or replace or damage any malfunctioning components within four days when they actually see that the damage occurred. In addition, some of the other questions that he asked was more related to graffiti. We also do have a condition of approval in the resolution and this is condition number 30 and 35 that relates that if there's any graffiti on either on the equipment base or the actual tower that the applicant needs to fix and repair accordingly. In addition, some of the other questions that were asked, He was asking the reasoning behind why was the clock tower designed selected versus having a stealth tree configuration. Due to the constraints to the property, if we were to allow a fox tree, part of the requirements is that you have to provide three additional natural trees within the site. In order to provide that, you also need to provide a planter for the tree. And typically those are like nine feet wide or I mean actually five feet wide by 20 feet in depth sometimes. So in order to provide that additional spacing for the trees, there will be the requirement to remove additional parking spaces. Right now, the actual property has a lot of constraints with parking requirements. So therefore, this particular facility, having the equipment right on the first floor and then have the actual tower with the equipment above works more or better. Additional questions that that seemed nash-ass was if there was a collocation potential and future expansion For for the facility a part of the requirements of the submittal We asked the applicant to look for other collocation facilities within the area in this case there was a There was a there is a report in justification analysis that was provided to the city that shows some other facilities within the area some of those are within point 18 miles of a mile and and some other ones are roughly about a mile away. Those facilities are utility poles. Those are very small, like roughly about between 25 to 30 feet, and some of the equipment doesn't have the ability to add additional equipment to those type of utility facilities. In addition to that, He was asking if there was a way for other carriers to be collocated within the site. And in this particular case, the tower will allow for additional carriers to go in there. And obviously, at the time that these additional carriers will submit their application, we will review it to make sure that it's concealed as well, all the equipment that they're going to be proposing. And some of the other questions were regarding to safety and noise pertaining more to a generator. Even though this particular facility is not proposing a generator right now, We did include a condition of approval on the resolution, and it's Conditional Approval Number 37 that basically requires that if they propose a generator to comply with a noise ordinance. And obviously, as part of that review, we will check to see the timing and the hours they're going to be testing this equipment. And also, there was a question regarding to, and I'm going to read this question, basically states, per Oxfam Municipal Code Section 16-494, if AT&T decommissions this specific microsite or upgrades that technology that renders the tower obsolete, the financial assurance is a bonding mechanism that exists to guarantee the clock tower is removed at the owner's expense. Just a Wanted to let you know that this particular section of the code pertains to wireless facilities that are within the right-of-way. This particular facility is within a private property. So it doesn't, is not applicable.

Good evening, Commissioners. My name is John McDonald. I am here on behalf of AT&T. I don't have a presentation, but I did want to provide a little bit of background on to why the Stealth Tower was selected. Like Carlos already stated, we can't go with a faux tree. There's not enough space. But we did work through some other design options. We worked with an architectural feature where we tried to match the adjacent buildings. We also tried a water tank option. uh with like a little sign for Oxnard on it um and and over the last two years after going through all those options um and working closely with planning staff um after refining the the options it was decided that the clock tower would be the best option so we've kind of refined this over the last two to three years and and this is um the option that seemed to be most suitable for the area

And then I can answer any questions anyone might have. Thank you, Mr. McDonald. I appreciate that. We'll move on to questions of either the applicant and staff. If possible, please indicate who you're directing your question to. Commission members. Commissioner Dr. Lopez.

My question was going to be to staff, and it was really on that last point on the abandonment and removal framework. You mentioned that, you know, if it was in the right of way, it'd be different, you know, in terms of the condition that it's on private property. So does that mean that the private property owner would assume responsibility over its removal if it ever reached that point, or how would that be handled?

So in this case, if because of the wireless towers in private property, Yes, the applicant, in this case AT&T or the property owner will be liable to either maintain the integrity of that tower even though they were to remove any of the wireless panels. Perfect. Thank you so much for that.

About graffiti, I know the area very well. Personally, I drive there a lot. There's a lot of graffiti currently right now. I actually drove a few days ago. Are you guys planning to, do you get planning to take it off yourself or call the city? How are you gonna handle it? Is this for me?

So typically AT&T has techs that will go out and repair any sort of graffiti once they're made notified. But they have to be made notified. One of the issues is that these sites don't have techs go out. They go out maybe once a year, once every other year is the typical cycle unless the site goes down for any reason. So AT&T wouldn't be aware until someone notified them, either the property owner or someone from the city.

Mr. McDonald, so who do people notify? Like let's say I notice it.

So I'm letting you know right now, letting him know right now.

Where can I call? Or can we make this public so people, when they watch this video, they know what number to call so they can...

Sure, I don't have the number on hand. I don't have it memorized, but it is a number that's located. Every site has a phone number you can call to contact AT&T, and that's for anything regarding the site, including maintenance or graffiti, or if someone looks like it's broken into the site, and that goes directly to their ops team.

Okay, so Mr. Carlos and McDonald's, you don't mind later on shooting me an email or call the city and leave that number in there? You're applying and it's a big issue in the city, graffiti, and we try to uplift our city. And you guys are a big company, so I would appreciate if we can get the number so we can disclose it and give it to people. I know it's placed in there, but you represent AT&T and you don't even know the number. So I would like to get the number and maybe we can disclose it. For now, I'm going to disclose the number For our city, that's a private property. That's the reason I'm asking. Our city has a graffiti program with us. So the number is 805-385-8010. That's our city graffiti program. But since it's a private property, that way we can contact you so you guys can fix it. Am I making myself clear? How are we gonna fix the graffiti problem?

I think as part of the plan checking, I will assure that they provide a phone number, and we can provide that over to you at the time.

Yeah. The reason I'm asking is because I want people to know in our community. We try to eliminate our graffiti in our city. We want to athlete our city, and I appreciate the business coming, and it'll help the community move forward, but also we need to keep it clean.

CHAIR ARRAJO, IN TERMS OF OTHER LOCATIONS, WE DO HAVE ONES THAT ARE STEALTHED WITHIN EXISTING BUILDINGS. like steeples, different locations, or like the hotel at the beach, and I'm blanking on the name. Zachary Dunes has one. Zachary Dunes, yes. Like that facility has a wireless facility located within it, and there's a few other kind of taller structures within existing buildings that have this. As a standalone structure, I'm not aware of any that immediately come to mind, but there may be some historical ones that were approved. Primarily though, most of the more recent ones have been trees.

Thank you very much, Mr. Pearson. And just as a slight follow-up to Commissioner Friday's graffiti comments, correct me if I'm wrong, there's usually a condition of approval in regards to that. Thank you, Chair. First I want to thank Mr. Torres for your excellent responses to my questions, and that applies to the earlier projects also. I know I submitted them kind of late, so you were under the gun a little bit, and you really, really performed well. So thank you. As far as the clock tower itself goes, I'm anxious just to see what it looks like. It's always difficult to see what these things will look like on paper, because I'm not a huge fan of the stealth trees. They just look fake. They are fake, obviously. hopefully that this can be a prototype for future towers, which will only continue to get higher and have more antennas on them. And if we can keep them inside of four walls, that's something that I'm in favor of. So I'm prepared to support this project. Thank you. Thank you, Chair.

I echo Commissioner Nash's comments to staff and the responses for the questions that were submitted and just great questions, Commissioner Nash, all around. You know, with these or similar applicants in the past, I'm always curious about the maintenance, you know, and in this case I was also curious about the clock tower design. and ensuring that it remains operational and working. Let's see. I appreciate the applicant sharing that they worked on this for the past two years and considered not only local architecture of the surrounding buildings, but also other designs, including the water tower. not heard that in the last six years that I've served on the commission. So greatly appreciate that level, I'll say of, of attention in your all plan development. And like Mr. Nash, you know, I certainly do appreciate, you know, AT&T and hopefully other carriers doing more to to improve connectivity. You know, there are still pockets here in our community, there are bigger pockets in some of our neighboring cities where you're driving and your reception just goes and it really does become, you know, public safety, you know, concern if in an emergency. So all that being said, just appreciation to the staff and certainly the applicant and also prepared to support when we get to that point.

I do want to make a comment, and I totally agree with Dr. Lopez and Mr. Nash. I look at the package, I look at the pictures, Mr. Carlos and Mr. McDonald, and I like the tower. It goes with our city, and thank you for taking that in consideration. That's part of what we, I personally speak for us to, to keep moving forward in our city and keep making it beautiful and the construction goes with it. And I do agree also with like their fake trees. So I'd rather get the tower. So it looks nice in the photos that we got. So thank you for that. And I also move forward with this item.

Yes, I don't have any concerns. Good project. I know the FCC has a lot of requirements, so we don't have to ask as many questions, and everything looks great to me. I do like the tower, and I think the first one I saw was at the Mandalay Bay, the old Zachary Dunes, or the Zachary Dunes now was the Mandalay Bay Hotel. And so I did like that the first time it came before us back in the day. And so I like the design. I also like the fact of the height. And I like the fact that other carriers with similar technology like T-Mobile can be co-located on the same tower, also giving them a bigger footprint as far as coverage goes. So I always liked those when that is entertained as a possibility. So I think it's a great project.

This commissioners, as you noted, we haven't had as many meetings recently, but We do have some upcoming items. So for August 6th, we are anticipating one item that may change, but we're anticipating, I should know, or be able to confirm by Monday. But then on August 20th, we do have a couple of items as well as on September 3rd, I believe is the next meeting after that. So I do anticipate that we will have our next three meetings at this time. Other than that, the fire station item, Fire Station 3 was approved by City Council. I think that was last week. It went on June 30th, and then the second reading was on July 7th. So just as an update to the commission.

And so with the election time coming, I THINK IT'S A GOOD TIME TO REMIND THEM. SO, ANYWAYS, I'M NOT SURE IF THAT WILL BE DONE BY IN THE NEXT SIX MONTHS, BUT IT'S JUST ON MY MIND FOR THE COMMISSION TO POSSIBLY CONSIDER.
