Welcome everybody to the Overland City Council meeting for December 8th, 2025. Can start with roll call, please. Councilwoman Ruckman here. Councilman Robleski here. Councilman Fernis here. Thank you. Please be seated. All right. Thanks for joining us as we close out 2025 from a council standpoint. Um we'll start uh this evening with a community announcement. Miss Middle, you take the mic. I'm ready. Nice. Congrats to her. Thanks. Thanks for organizing that, Sherry.

Okay. All right. And if you have a copy of the agenda here, I think we have more public hearings than we've had ever. Um, but I think we're going to get through these pretty quickly here. So Jason, if you want to take that away and then we'll hit questions for each one as we proceed.
Excuse me. Please take notice that the city council of the city of Overland, Missouri will conduct a public hearing on December 8th, 2025 at 6 PM in the council chambers of Overland City Hall located at 9119 Lackland Road, Overland, Missouri 63114 for the purpose of reviewing and receiving comment with respect to the following matters. Amend chapter 400, Fences and Landscaping. Adopt section 400 387, solar energy system regulations. Amend section 4250 plan development PUD fees. 2323 Lackland Road. Amend conditional use permit automotive repair facility and 1001 Page Avenue conditional use permit convenience store gas station ownership change. All interested parties may attend and be heard at the public hearing. So, the first one is um PUD fees section 4250. Um we're proposing to amend the PUDS or increase the PUD fees from $150 to $1,000. And this is to cover the cost associated with the preparation of these planned unit uh developments both from legal fees and from city staff time. Okay.
Any questions from the audience on this one? Question from the board. Okay. Uh, excuse me, fences and landscaping. So, um, under this, uh, a under these amendments, so we will be proposed to amend section 400.060 definitions with a revised definition of fence, um, a new definition for fence permit, screen planting, screening, and sharpointed fence, and sight proof fence. The definition will remain the same. Uh so under 400 360 uh a permit is required. Uh new fences will require a boundary survey to be stamped and sealed. Uh replacement fences uh will not require them. However, um they can be required based on the determination of the director of community development if she or he feels that though they're necessary. Uh fence permit fees will increase from $15 to $35. Uh there are currently and will continue to be two inspections. One are for foot f footings and peers. The other is the final inspection. Uh 4360 materials and f materials of fences and screen plantings. So fences shall be composed of decorative masonry, brick, stone, textured or pigmented concrete, plain wood, vinyl or chain link, rot, iron or steel. Um cloth, canvas or chicken wire. Other um impermanent material is prohibited. Um, screen planning shall only be composed of hedge or thick growth of shrubs. Uh, short pointed fences as defined in 40060 are prohibited. Stockade fences are prohibited in all zoning districts. All fences shall be constructed so that the horizontal and vertical support posts are hidden from both the neighbors and the general public's view as determined by the director. Electrical fences are prohibited with the exception of battery charged fences and those
fences buried underground or invisible fences to the extent permitted by se section 67.301 of the revised statutes. Uh no fence or screen planting shall impede or divert the flow of water uh through any property unless doing so will not adversely impact any adjoining property and will contribute to the improvement in an overall drainage system. Uh all fences hereafter shall be erected so that the rough side or the or the construction material used shall be on the property facing side. Uh new fence installation shall not abut an existing fence. There must be two feet between fences to allow for maintenance. Uh so front yards um no fence shall be erected or constructed within the required front yard of any lot. Uh decorative fences are permitted uh in the front as so long as they're no higher than 18 inches and no closer than two feet to the property line. Uh screen plantings may be located within the front yard but not higher than four feet above grade and no closer than 10 ft to a public roadway. Uh fences will be allowed in the rear yard, excuse me, up to the property line except when abudding a fence. Um and screen plantings should be constructed and maintained in accordance with section 4450. Um sideyard is similar to um rear yards. They can be installed up to the property line except there's an existing fence. Then there has to be two feet. Again, screen plantings in accordance with 400450. On corner lots, fences on corner lots and through lots may be located within the front yard area, but shall only be located along the line created by the exterior wall of the principal building where the primary means of ingress and egress into the structure is made. uh such f such fence may in no case be closer than five feet to the property line and the direction of the primary ingress or egress into the structure
shall be or interpret shall be at the interpretation of the director. Um so these are just kind of illustrations of corner lot fences where they can be located. Uh a through lot fence and then like an interior lot fence. So in kind of in the middle of the block with houses on each side. So for height um fences constructed of masonry brick um plained wood vinyl or combination there may may be constructed up to six feet above the surrounding grade. Fences corrupted constructed of nonvalcoated chain link may be constructed up to four feet above the surrounding grade within the essentially the residential zoning districts. Fences constructed of vinylcoated chain link may be constructed up to 5 feet above the surrounding grade within the residential zoning districts. Fences constructed of vinylcoated chain link may be constructed up to six feet above the surrounding grade in essentially the commercial or industrial areas of the city. Uh fences surrounding tennis courts uh may be of non vinyl coated chain link um and shall not exceed 12 feet in height and screen plantings not to exceed 6 ft in height unless otherwise required uh may be located in the side or rear yard. Excuse me. for special fences. Uh, fences within the C12, M1, PDR, PDC, PDM, and PDMXD zoning districts shall be subject to review by the planning and zoning commission. Offenses in all other districts shall be subject to review by the board of adjustments. fences, green screen plantings um are to be maintained in accordance with the
provisions um not only in the zoning code but also in the building code. They must be kept in good repair. Uh screen plantings must be trimmed and free from weeds, trash and debris and failure to maintain fences or screen plantings in accordance with this section shall be deemed a public nuisance in violation of chapter 255 of this code. Um, so this provision shall not apply to all fences, excuse me, shall apply to all fences unless otherwise specified. Um, and then the corresponding zoning district regulations performance standards. Fences legally installed prior to the adoption of the section and not in conformity with this section are hereby declared a legal non-conforming accessory structure or use. Um, however, such non-conforming fences shall be kept in good repair, structurally sound, free from nuisances, and shall not be allowed to deteriorate to an unsightly condition. Existing fences which require 50% or more replacement due to deterioration, nuisances, or otherwise may be required to conform to this article. And then all screening and landscaping. Um, this is section 4450. All of the provisions in section 4450 remain. We simply added in section A9 um that um that violations as may be declared a public nuisance subject to abatement in accordance with chapter or excuse me section 225 of this code. So that is it related to fencing and landscaping. Okay. Any questions from the audience on anything fence related? questions from the board. All right, onward.
So, the next item is solar energy solar solar energy systems. This is an entirely new section. Um however we did amend we are amending or proposing to amend section 460 definitions to include a definition for array uh building integrated photoactic system ground mounted solar energy system roof mounted solar energy system and just solar energy system in general. Um so solar energy systems will be accessory uses only. In other words, they can't just be the only thing on the lot. It has to be a house or a build or a commercial or property or structure there. So, you can't just put um a solar energy system on a lot by itself. Uh they should be permitted in all in all districts pursuant to a permit. Uh survey or site plan dealing location of the system, whether it's ground mounted or roof mounted. Shall also indicate the location of overhead utility wires. That'll be required. uh they'll have to provide building and design plans uh for the system and then they'll have to obtain any other permits that would be required either from the state or the county or even from the federal government with respect to these systems uh prior to our approval of the system. So then there there are essentially three types. There's a roof mounted solar energy system uh and these are the regulations related to those. There are ground mounted systems. Um, again, these are the regulations related to those. Um, on the ground mounted, they shall not be installed and operated prior to the construction or use of the lot. Uh, they may be located in the rear yard. Uh, and on a corner lot, they must be located in the rear yard of the lot on the interior side in accordance with 400 320A,
excuse me. Um, the ground mounted cannot be over seven feet in height. Uh all exterior electrical and plumbing and storm water lines connecting to a principal or accessory structure to be located underground. Uh they must be substantially screened from public view. Um shall not not occupy more than 30% of the rear yard. Uh and shall be included in any calculation of lot coverage and impervious surface unless specific storm water mitigation plans are submitted to the submitted and approved by the director. Uh they can be no closer than five feet to the rear or side lot line and they cannot be located in a transition strip or recorded easement area. And then the um the building integrated photo galactic systems may be located on a roof plane or wall in compliance with all the zoning regulations as well as the building code requirements. Um, all solar energy systems must be installed to avoid um concentrated radiation, heat or glare onto the neighboring properties or traffic. Um, maintenance. They must be maintained in good safe working condition. Uh, they must they must remain free of all high grass, weeds, and noxious overgrowth and failure to maintain the systems um shall be considered a nuisance under section four or excuse me 225 of the code. Um, the safety disconnect and electrical disconnect shall be located near the electric meter on the exterior of the building being served or other location as approved by the director in consultation with the community fire protection district. The electrical disconnect shall be clearly identified to facilitate emergency operations by the city and the community fire protection district. So the systems cannot be used to display advertising. Uh the manufacturing equipment information, warnings and
indications uh related to the system can be uh placed on the equipment upon the uh for site inspection. Upon completion of the installation of the system, the contractor property owner shall contact the city for final inspection. Uh the system cannot begin operating till has received approval from the city. Inspection is the purpose of verifying that installation is code compliant, but in no instance shall such approval wave any other applicable governmental approval regarding electrical and fire safety requirements. Uh any solar energy system that is out of service for a period of six months will be considered abandoned must be removed within 60 days. And so that is all I have for the solar energy system.

So, the next item is um for 2323 Lackland Road. It's a conditional use permit in the C1 uh neighborhood commercial district for Dave's Auto and Proformance. Um this is an existing auto repair facility. They're proposing to amend their conditional use permit. Uh currently um all vehicles are um currently under the existing CUP that was issued in 2014. All vehicles parked overnight must be the front building line. Cars will be parked on the side and rear lots. The proposed amendment would allow for overnight parking in front of the front building line as well as behind the front building line. Uh so there is no change in the hours of operation. Uh outdoor storage is prohibited and there's no change from from the previous CUP and planning and zoning recommended approval. And this is the aerial of the building. Uh the lot ordered in red is the lot where this building or this business is located. Okay. Any questions from the audience on this one? Any questions from the board? All right. On to the next one. And so the the final one is 101 Page Avenue is a conditional use permit. Uh change in business operator. This is in the PDC uh district. Evergreen Fuels LLC is the business name. And this is an existing gas station and convenience store. Uh the days and hours of operation are Saturday through excuse me, Sunday through Saturday 6 pm, excuse me, 6:00 a.m. to 12:00 a.m. Outdoor storage is prohibited. Overnight parking prohibited. Planning and zoning recommended approval. Again, this is an existing. It's simply the operator of the business that is changing. Nothing else.

Okay, on to staff reports. The last Rick report of the year. Come on. Then you've already heard the last Rick report of the year,
Mr. Crowder. little as I approach the podium un pride for Overland because last Saturday evening we had a tremendous success. We had a beautiful dinner, the home of the year owner and his girlfriend were so impressed. 57 guests for dinner. We went into the auditorium to a beautiful concert. The superintendent told me, "Well, let me let maybe back this up a little bit. I thought after the announcements, I'd go up and sit in the audience and listen. I couldn't find a place. Finally, in the back row, there were two places left and it holds 500 people. We're still counting the money." And the reason I say that, you think, "Well, why couldn't you get that over with?" Here's why. As of now, it's $1,300. But here's an example why we're still counting. I was at mass yesterday morning and the usher sat in the last pew and the organ's already playing and an Overland employee who I most certainly am not going to name comes over and taps me on the shoulder says, "We wanted so bad to come to that concert." And he tucked a folded bill in my shirt. was a $100 bill that went on all evening and we had a beautiful, beautiful, successful evening. And uh one lady on her way out and I'm going to have to mess I'll start laughing here, but it is funny Marty. She says, "Our mayor don't play no drum." I want to say because we had a scheduling conflict. The OBA happy hour tomorrow evening is moved to the Lions Hall, 2358 Lackland. And I understand we're going to have some legendary
chili, chili mac and good things to eat. 5:00 until question mark. After this pride fit that I'm having, I think I'm going to have General Motors make me another truck with metal doors to which the magnets will adhere. Merry Christmas. Happy New Year. Merry Christmas, Mr. Crowder. One question. What is the name of the catering that does the Christmas dinner? As you like it, catering, Jessica, they are housed in the cafeteria of the also school. Thank you. And uh just to add to that, uh we do have that orchestra lined up for a summer concert this coming year. I don't know if it's going to be an annual thing, but as part of the city parade, we have them lined up uh to do a big concert and they if you were at the concert, you saw the people there and a lot of people you don't recognize because they do draw folks in. And uh so in order to do that, they're going to play for free, but we are going to have to line up some type of staging. We're have to figure all that stuff out because that's a lot of folks. We don't want them falling off the stage. So, we'll get that worked out here soon. So, they'll be set in May. All right. Chief, your report for the evening. Uh, next Thursday on the 18th, uh, our police recruit that is in the St. Louis County and Municipal Police Academy will be graduating. Uh, they'll start, I believe, on the 22nd. So, I'm sure he's happy about that. Um, also, uh, Christmas in the streets will be on the 20th. Uh, that's Billy Mayhal and the, uh, St. Louis Youth Sports Outreach. He does a phenomenal thing for the community. I'm pretty sure everyone knows who he is here. Um, so that'll be Saturday, December 20th. And, uh, it's always a good time. Perfect.
Thank you. All right. Uh, reports, comments from the council this evening? I do. Um I I spoke to the mayor. Um I'm going to start putting together a list of local overland um whether it be businesses or individuals who would like to put their phone number out for overland, whether it be for snow removal. And then I think I wanted to do the same for like lawn care for maybe the elderly who can't afford a bunch, but there are kids maybe that are willing to do it for a little bit less expensive that we can either put on our website or on Facebook or what it may be. But if you know anybody that's willing to do that, please send them my way.
Perfect. Thanks. All right. I have a couple things uh this evening before we conclude this portion of the meeting. Uh Mr. Crowder, I know you're going to like this. So, a couple months a we had the connect for success presentation. We hired somebody. So, just today, so starting next semester, we're going to have a writtener student uh essentially do like a work and learn. So, they part part of their day in class, part of their day is working. and we found a spot for them here in this building. So, they'd be working kind of in an admin capacity the whole time. So, we've kind of covered the the summer uh crew. So, we hire written students during the summers to help out. Now, we're doing that during the school year and hopefully we'll have another student rep here at some point. Uh if we find somebody with some interest in that portion um comment number one, comment number two, um we've had a lot of success. We're actually undefeated here. I know we worked a lot on the the juicies and the bar enforcement. Uh all of that's now behind us. We've won at every level and uh thanks to Joe's firm for all the hours they put in there. And as part of the judgment uh by the way, Juicy's has to pay us back for all of our attorneys fees. So uh we'll work on collection there and see what we can do. But that was part of this enforcement that we've done and hopefully other potential uh bar owners can take take notice that we're not going to deal with a bunch of nonsense. So, and the last item, it's more of a social thing. Uh it's Lesl's 90th birthday. So, if you know Les,
uh tell him happy birthday. He'll probably tell you a couple jokes. Uh good guy. I miss him having him up here. He was up here for a long time with me and he celebrated his 90th and I asked his wife Norma how long they'd been married and she said 68. I thought she meant 1968. 68 years. So and then Les quickly said it felt like 168. So could couldn't let her have the the spotlight there. So with that said, we do have an executive session that should be pretty quick here. Uh, so I'll seek a motion to adjourn into executive session for legal purposes in accordance with RS Mo 61021 subsection 1. Make that motion. Second.
