Well, I like to express my disappointment that you can't accept the agenda or the packet that you folks received for this meeting. It's not on the agenda. It says agenda. You click on it. I mean, we can't go through all the recordings and listen to what the whole township does. It would be easier just to read the minutes. So at this point, I was going to zoom in. Thank you. I'm beginning to think there's something about me. Yeah. I don't want to take it personally, but it's beginning to be suspicious. Anyway. Thank you for taking one of my six recommendations and placing a link from the township website to the proposed Manistee Regional Fire Initiative website. I'm disappointed that the information regarding the days of recycling bins are empty was not available on the tax and is not available on the taxpayer website. The dates were posted on Facebook on July 3rd, nearly three weeks ago. Since the website went live over four years ago, the postings have been arbitrary with no policies, proceedings, or public input. The website information is based on what, when, and which board member asked for a posting. What the public deserves to know or might want to know is not taken into consideration on a timely, consistent, transparent manner. Such inconsistency create a public trust deficiency. Let me add three more examples for the website public trust deficiency issues. The public notice for the July 2nd McMillan's EVA hearing was posted in the Manistee News Advocate on June 12th. On June 17th, it was posted on the website's event calendar. and on the website door. When I clicked on event details on the website calendar, there was no information regarding what, who, or why the variance hearing was being held and when the ZBA packet would be available for public scrutiny. Both the advocate and the township hall door posting included all this vital information. On the website, the information regarding the public hearing can be found on the 43rd page of the 46 pages of the McMillan packet. It is under the ZBA Agenda and Meetings tab. As postings are not date or time stamped, I do not know when the public notice was placed on the website. I was assured by a board member its posting complied with the Open Meetings Act. During the June meeting, the board went into closed session regarding the continued blight of the DeVos property. The DeVos consent judgment posted on the website is dated August 2022. The board went back to court and received a new consent judgment in March of 2024. I'm assuming the consensus of the board referred to in the draft June meeting minutes relates to the March 2024 consent judgment. Taxpayers received their summer property tax bills earlier this month. From the Treasures page on the website, there is a link to pay property taxes online. However, on the same page, there is the adopted township budget for fiscal year 2025. No fiscal year 2027 is posted. As a board member pointed out to me at the June meeting, the board had, and I quote, HEARD AND RECEIVED MY MESSAGE REGARDING THE TOWNSHIP WEBSITE. IT APPEARS TO ME THE BOARD HAS SELECTIVE HEARING AS ONLY THE MANISTEE REGIONAL FIRE INITIATIVE RECOMMENDATION WAS ACTED UPON. MY EXAMPLES ARE A SMALL SAMPLING OF THE NEED FOR A MORE TRANSPARENT, CONSISTENT, ACCURATE, TIMELY AND USER FRIENDLY WEBSITE. A CAUSE I HAVE BEEN ADVOCATING FOR OVER FOUR YEARS. The O'Neill Township Board has the authority and the responsibility to determine the policies, procedures, and postings for and on the taxpayer-supported website. As a citizen, I have the right and, in my view, the responsibility to advocate for a township website that supports and communicates with the public the actions, decisions and priorities at the Township Board. It's good to have access to the Parks and Recreation June 25th meeting on the Manistee Public Television. As the May 20th and June 17th board meeting recordings are not available on public television, I'm hoping July's meeting will be posted. Not being able to attend for these either in person or on Zoom. And without approved and draft minutes being posted on the website, it is very difficult to be an informed citizen. Democracy requires an informed citizenry. Please include a summation of my comments in the details of the July minutes. Thank you.

Um, a couple of action items, uh, the North point fitness park stations, uh, the installer installation was done the 8th of July. There were a couple of things that did not go as they should have been, and they will be fixed tomorrow. So we should be all set tomorrow. What I'd like to get approval from the board is to move forward with an inquiry to MCCF to do the groundwork to make it ADA accessible. And I spoke with Laura this morning and told her that we would be doing one of the minis, the 5,000, and then use what's left in the budget for the fitness stations to do that, as long as I was able to get approval from the board to move forward. I asked her whether it would have any impact on any of the existing items that they're considering, specifically DNR, and she said, no, it will not. So unless there's disagreement, I'm going to go forward with number one, getting some estimates, and two, moving forward with an inquiry. Okay, you want approval?

Second item, recall that we had this hemlock woody algae problem that we're trying to assess at Glenn. I included in the packet a letter from invasive species and Their note essentially says that based on the photos, the drone photos that we sent to GVSU, it does appear that we may have a small infestation somewhere in the canopy. Their suggestion is to come out and do an assessment and that would happen. in the fall winter time and then they would come back to us and give us some estimates to work with them or somebody else should we choose to do that next year. So again, unless there's disagreement, I'm gonna work with them and say, yeah, let's go ahead and get that estimate as soon as you're able to do that. Okay. Okay.
Sounds like it's a pretty good program. They cover a lot of the costs.
Yeah. Yeah. So I can't see any reason why we wouldn't. So I'll go forward with that. Those are the only things for board consideration. Just a few items of note. Michelle and Jean are heavily involved with the events right now. 30 day challenge is active and running. As far as our membership, we lost conservation district representation when Tyler got his other assignment back in February. It's our understanding the conservation district has replaced him. So Brian Allen is going to approach them to see whether we could get them again to join us in an advisory role. It was really helpful to have them involved. The Langland Park ABA walkway was completed on July 2nd. including making Avenue E access to the pier almost ADA and should be ADA in the very near future with some work that I'll do on it. Both projects were covered within the budget and the MCCF grant, and we had $1,100 left over. There's no refund due to MCCF because they're recognizing the costs that we incurred with Stradorski prepping that Avenue E. So, Pretty much wrapped up with that other than a little bit of work that I need to do in the front section of that so that it's not a two or three inch bump. Gazebo painting at Langland's done. The light in the webcam, I'm stuck on that. We put it in an application to consumers. I haven't heard back and I just had that chance to follow up. Uh, North point, um, we may look at the cost of ADA, um, parking lot striping. We learned last year that the striping we have isn't really ADA compliant. And if we could fit that into the cost of the MCCF grant, we'll do that. Otherwise we'll come back to it sometime in the future. Uh, Glenn, I mentioned, uh, we. HWA thing. Also, we've got some dogs must be on lease signage going there and at North Point if Gene has not already installed that. We continue to work on the road and inventory. Five-year plan. We're really close on the five-year plan, meaning all of our deliverables. I submitted the inventory yesterday and waiting to hear back from Jody on that. We're going to be adding three more projects. Matt can elaborate if he wants, but one of them is the updated trail plan. Second is at the community dock, Outlet Avenue, perhaps the Sunrise House or something like that, and some DNR launch upgrades. All of our five-year plan projects need to be on the website by August 15th to meet the You know, Katie's request in terms of being on time. So, Matt, we need to put some meat on the bones as far as those three new ones are using the format that we have on the proposed projects portion of our website. And then as far as unresolved items, I'm just going to mention again that storage remains one, but it now is a pretty significant one. The ADA walkway out at Langland is a lot. I mean, it's a lot. And getting that in and getting that out each year is going to be costly and storing it is something I think we need to figure out. We can continue to put it behind the township, but if there's other things that... or other options. Just want everybody to know that we need to think about that because that's going to be a big deal going forward. That's all I've got.
I noticed there was like three or four sections sitting next to the pit toilet out there. Have those been moved yet?
no, I've been downstate dealing with some dog health issues. I'm going to put them on the back of my truck or grab a trailer and put them behind. I just have been out of pocket for the last two weeks.

One of the sections that has been installed and moved out over the last couple years was significantly damaged. And so having a couple extras is a good idea. The good news is on the damaged one, we needed to have one cut at an angle and the installation crew from the manufacturer cut off the damaged part. So we got lucky. But the fact is, is it's a good idea to have a few extras.
Okay. And Beck, we did Avenue E. Did you guys look at the south? peer access where there's one little spot that you can't get a wheelchair across? Is that something we could maybe do on that side as well?
I have not looked at it, but yeah, sure. Absolutely.
I looked at it and it's something that we could easily do. It's kind of, in my mind, it's similar to what we did at Avenue E. We would just kind of recreate what we did at Avenue E over on the other side. So I think it's even smaller. It is a shorter run. Yeah, I mean, in my estimation, it's something we could probably do. Potentially.
There might be something for the committee to maybe look at. If not this year, next year, maybe.

Okay. In the minutes, we should note to the Commissioner Donson that he texted me earlier and said he wasn't going to be here today.

So my report was in the packet. I didn't know if anybody had any comments on that. Briefly, tax bills were mailed at the end of June. If you haven't received your bills by the end of July, you can look up your account online for free, which I mention every year, but I don't know how many people are actually taking advantage of that, or a new bill can be emailed or mailed if you haven't gotten it. And again, we have multiple payment options, so Payments have been trickling in. Obviously, they'll pick up as we go through August and into September towards the due date. We did have the auditors were in in first part of, actually, it was a lot of part of June. Anyway, they finished up. They provided a draft report. I gave them a few comments. I'm waiting to get those comments back. And we should have that finalized, I would think, sometime within the next month. I don't know if we want the board to have them come and present. We typically do, and I can request that, but it might not be until the fall when they can accommodate it on their schedule, but I can certainly request that if somebody come over. So it was an unmodified opinion, which was a clean audit.

Yes. So we've been struggling with this whole thing. He has to get a permit from zoning for the road, okay? Because they call... I'm going to give you this. And I got Jody's number on there. So Tom got Jody. And the way it is now, it's a minor road. And even though it's connected to a two-track, he has to improve the whole thing. No, not from his point forward, from the other point to get to his point to start, according to the way the ordinance is now. The Planning Commission is working on this. So what I want you to do is I'm going to give you this, and she's going to tell you which part of the ordinance applies to your road and why it does. And then I would tell you to get back a hold of her and ask to talk to the next Planning Commission meeting. Because we have a bunch of these and we need to address them. And the way it is in here to me is not the right way. Because it would say you have to put in a 16 foot wide road base. And I think it's 12 inches of gravel. Which for one house. Well, it accesses three properties. See, it doesn't. Yeah, it's for his house now. But so if you did it the other way, then there's no fire truck to get in. And there's a whole bunch of issues here that we're dealing with that don't come into play on anyone else's roads. So that being said, I'm referring you to do that first. You can still ask for the permit from them, but I'm just telling you it's more expensive than I thought it was going to be.
So all the private roads, kind of like your roads. There's a dirt road, and there's four houses that are on it.
I didn't say this is fair. I didn't say this is fair. I put in after that road, so unfortunately, there's a bunch of these grandfathered-in roads. I agree. There's two tracks all over the place. They changed it when the zoning came out, and his road was probably put in before the zoning. We don't go back and make... I know your argument, because I had the same argument with myself.
Well, I'm just kind of looking at it like if you have an undeveloped right-of-way that the township has, a paper road, if you want to call it. Paper road. Paper road that's there. And you said there's three other properties that can access it. Basically, it's mine that I already have right now, and then the property that I purchased. And there's one other individual that already has a county road that dead-ends into their property. So... they don't have to be considered one of those because they already have access based on the fact that they have a county road that goes into their driveway, basically. Really, this property only pertains to myself unless there's another lot on the west side of the property that could be subdivided even more than what they already have houses on, which I don't think there is anyone that could do that. This really isn't about anybody other than just Getting me access to my properties. That's it. It's nobody else's involved in this at all.
Which they call a private road, even though it's a public road, but the private road standard is less than a public road standard, even though it's public property. I'm going on what she's citing me and what it says in here. And I didn't read this thing more than once. You have to read it a dozen times. but it has to be brought up to private road standards at a minimum, which is less than public road standards, even though it's on public road. That's the 16V? Yeah.
And according to her email, she's making that comment because it appears the road services three parcels, if I'm reading her email correctly.
So I'm saying call her and let's talk about, because there might be this other avenue which is only going to access one, but on the map it shows three. Now, We can get something from the other two people that says, hey, I'm not using this. I have another access to my property.
Like I said, what other two people are those? I don't know. I mean, when I look at the plant and stuff, I'm not seeing anyone other than myself in the purchased property that I have that would even... Here, take this. Okay.
The other thing Katie says in her email is that we're talking about this at our planning commission meeting in August.
And that's why I'm urging you to not appear. My opinion only. I wouldn't apply for the permit right now because this is what exists. Okay? Because you're going to not want the result you're going to get. Now if they change something and it's better, then I guess I wouldn't spend my money. That's me personally.
Well, yeah. I mean, you want to We'll throw all the avenues first, and then you're forced into some. And then find out you're forced into some.
So what I would say is I kind of remember when the private road thing went in, and it may have been amended since. I know, yeah. Private roads, undeveloped, platted roads, July 5th, 2005. Part of this had to do with over on the other side of the lake where Mr. Acton owned his property. Do you remember that?

But the point is, Given the conditions that the architect in Chicago left us with, with all these roads and unplanned and undeveloped, I think there's, I think the planning commission, hopefully the planning commission come up with a more reasonable standard or pardon some exceptions or something so that it's not an undue burden, yet it's protective of the township. And, you know, maybe there has to be, if that's your only access and it's not brought up to standard, maybe there has to be a fire waiver or something. there may be a way to thread that needle, but I'd leave that to the planning commission, like Dave suggested, and to have that conversation with them and really, you know, go make, go pitch your case. You can go talk to Katie and not, not actually apply for it, but just kind of give them more information so they can make a better decision on the planning commission can be informed.

I'll tell you in a quick second, it is August. I think we usually meet the third week. I want to say it's August 20th. Let me double check.
So if you're looking at this, Lenny, go to second page, number three, minor roads. That is the least, number three, it says minor. Yeah. That is the least regulation what we have for a road. And that is, it's not 12 inches of gravel. 12 inches of compact sand, which you already have 12 inches of compact sand. Six inches of gravel, which isn't as bad, but it's 16 feet wide. which we talked, I think, before you said like 10 or 12. Was that correct?
Well, yeah. If it's only a 30-foot easement that you have to work with, yeah. I mean, I think, you know, basically a driveway is 12 to 16 feet. Right.
Yeah. And confirming the meetings Thursday, August 20th at 7 p.m. Next year? Yes. Thursday, August 20th. Okay. Yeah.
Well, I know it's not the answer you wanted to hear today, but I, we had, like I said, I kept reading this and she said that there's no other, there's nothing under minor. Right. So technically could they develop a different thing? Number four, be what we're talking about. Yes. That needs to be simple. It's to protect everyone there. I mean, if you built back there and you just had a little two track, could the fire truck make it back there? Maybe not. We will want to cross that bridge.

I mean, I'm going to make it where it's safe. We agree with that. Now, if that standard works, minor, now you don't want to wait, you'd have to figure out is it six inches of gravel isn't so bad, 16 feet, my driveway is actually that wide.
So I did that.
So as far as if there's any small trees that have to be removed to do this, that's no problem then?
I don't see a problem with that. I would just caution everybody to get a survey. I've been waiting to get a survey based on what... We wanted to tell you the total cost or at least an estimate so you can now guess how much it's going to be.
Let's just explore that because we've gotten multiple questions over the years about this paper road and I want to do something with the kind of cut trees that are over there. Don't you have to have a permit to go in there and cut trees on the road? I think you do. It's township control. Well, we don't have a permit. I've I mean, I don't, I don't, I don't think we want, you know, going out and clear cutting these paper roads without us knowing about it. Well, I agree. They should ask for permission, right? So there's gotta be, if that's a, if that's a gray area in the ordinance, I'm looking at your Sunday for planning commission.
I know we might need to address that.
Yeah. It also might be something that Tom might have to weigh in because again, there's a lot of legalities around these paper roads, but they're everywhere.
Well, in the past, we've asked people to come in and ask permission to do it, and then they've gone in and do it. But now, has anyone clear cut? Yeah, they've done that on a couple of them, actually.
Like I said, I mean, moving forward, I already have a surveyor already lined up. I'm going to survey the five acres that I purchased and this right away. Right, so we know where it is. Going forward, I know exactly the boundaries going into the property.
So you can spell out, so at some point you can spell, hey, I want to cut these trees and here they are.
So you'd be improving it from basically the south part of that parcel. Because that looks like it jumped onto their property as a driveway. You'd just be going up there. A straight shot out.
And the county said I would just have to pull access permit, you know, coming off of Clark, just a It's just a basic $25 fee to access that, right?
Okay. Attend this meeting. Let's see if we're going to steer it in the right, because it does need to be addressed, but we've got, I don't even know, hundreds of these probably. They're all over everywhere.

And I think her having that information, having a conversation with you could be useful and contribute to the discussion of planning commission. Right.

Right. I mean, moving forward, this is kind of going to set precedent.
And I, I agree with Dave. I think the, I think there's a way to thread the needle between what's on the books right now and what's practical and still allow for fire protection. That just has to be properly.
I mean, I don't want to go to the house and not have, or no, in the future. Right. But you don't necessarily want to build something that's going to serve other properties and it's at your expense. Like I said, really, there really isn't anybody else. It's really going to serve when you look at, at it. I mean, in the train that it is, it's basically going to, Going to that five acres.

Before they go, the actual, we won't get it done this year. Well, that's why my email said what it did. It's like, I think we still have a window to get it done because we have an opportunity to go off cycle. But I mean, I need that stuff, Blake.
Why don't they take the engineer's
They will not. Because they want to know. Jim, part of the problem with that is the engineers make an estimate. We don't have full construction drawings. They're not going to want me to write a grant for a number that we can't substantiate by a contractor actually doing the work this year. And I had a conversation with them back when you and I talked. three weeks ago or whatever it was. And it's pretty endless. It has to be a proposal. So that's why I need the construction drawings so that we can send those out for bid to get the numbers back so that we can get moving.
Well, you don't get this until the end of August. That's okay. But your grant is up to 45 days.
If you do a mini-grant, they may take up to 45 days, but I think the foundation understands the sensitivity of the time frame here. I'm not saying that means they would answer it quicker, but the potential exists that they would.

Yep. Wrong party. Sorry. Invasive species committee. We have meeting Monday. We had a preseason survey in June. PLM came out and treated in June at our meeting. We reviewed the post survey and everything's really nicely under control there right now it would not be anticipated that there would be any type of herbicide applications for the remainder of the year unless something unusual happens we are going to be exploring um doing some hand pulling or doing a dash program but we would need a permit and the odds are probably more likely that we won't get the permit yet this year. So it wouldn't happen until next year. But looking at that for an area that does have some invasive, I think it's starry stonewort that we're closely monitoring and would like to attempt to try hand pulling it instead of using herbicides. So we'll know that. The other thing which I'm waiting, I followed up with Tom, you may remember Invasive species made a recommendation to the board last month that we treat the township property that had, that had Phragmites shown on them. That was across from a gentleman's property. I brought the map to the meeting. And so we approved it subject to what Tom said. Tom walked, he and I had a long conversation. He walked me through, said in his opinion, Yes, we can go ahead and treat it. I said, Tom, I'd really like it in writing, not just because I don't want to say to the board, hi, Tom said it's okay. But we have had a lot of discussion about what does the language in the assessment district resolution allow us to do? And that's part of what the around the lake kind of comment. So I followed up with him day before yesterday because I hadn't had anything come back to me in writing and he promised he'd get get done this week.

So right now we have a land division form. But if you're doing a property adjustment, which is like two neighboring properties, you before could just go in to the county kind of and you do a brownie line adjustment and they just do it. This is in place of a land division form because it's not a land division. You're transferring a piece from this property to a neighboring property. But we do this to make sure they fill it out. What you end up with means zoning, not that you take too much. Yeah, or you take too much off of one and you make a nonconforming parcel.
So is this, what compelled the person to do this?
When they call and want to do it, Equalization will have this and then make them fill it out and give it to whoever. There's nothing in the zoning ordinance that requires that? No, not for boundary adjustment.

So a question, okay. I understand what Tom is saying that because, I mean, right now we have two things going on. We have, assuming that the fire district thought process wasn't in place, we would still have to renew or ask for renewal of our township millage. But since both are kind of like simultaneously having to be dealt with, we have to allow language to cover the fire district and have to disclose who the payment's being made to. So I understand his communication. What my concern is, kind of like the baby getting lost in the backwater, if the community chooses to vote down the fire district, then what do we do? And so they vote against This is saying we have the right to levy up to 2.5, which if it's approved and the district fails, we're okay with our 1%. But my concern is if it fails because of the tie-in with that, do we have time to deal with that?
Sorry. We're doing it for really? The millage doesn't expire. Right. So we would have a bite at the apple in August, which we would likely have to pay for that election, though, because there's not going to be anybody else. Or you could put it on November. However, you'd have to have a really quick turnaround so it could get on the winter tax bill. So we've got two more bites even after this August.

So just for a little further discussion, there's a lot of chatter going on in the community about this whole initiative and some of it's accurate, a lot of it's inaccurate. A lot of fear. This initiative didn't just happen because people decided they wanted to raise taxes. It's been building for years, if not decades. And finally, there was enough leadership amongst the fire service and by and to try to make something change and make it different and presumably better. Basically, what it's doing is it's lifting up the townships, which have gotten by relatively inexpensively because they don't have full-time staffing. That's what this boils down to, to get to where they can have full-time staffing, but it can be done as efficiently as it can be. This isn't unique to Tennessee County. It's done all across the state. Some places approve it and some places don't. This is just giving the voters a chance to to weigh in on that. There's an informational session coming up. I think it's July 28th at the Senior Center. I encourage everybody to go and listen to that and ask their questions and make sure you're getting the good information instead of the maybe misinformation.
Right. Well, I think about demographic too and the fact that 85% of what you guys do is CMS ones. Yes. You know, it's something that you want to have accurate and good information to make it, to make it, to make an informed decision. And sometimes I know, I mean, just for an example of our recycling area, some of the stuff, it's just some craziness. Sometimes people will say things, I don't know why, but they just feel like they can do it.
