Thank you commissioners Tonight the next item on tonight's agenda is the us in the state's tentative map Here is a project location map Gives you an idea of where it's located around sellers and Delta Road are close to Delta Road At 53 21 sellers Avenue This brings us in closer, gives us a better idea of where we're located. We are at 5321 Sellers Avenue with Sellers to the east and the city property line to the east. Chris Moore Drive is farther to the west with a property in between. Undeveloped county lands across Sellers to the East are also near the property. And the property is also primarily surrounded by scattered rural residences and undeveloped land. A little background, the property is designated rural residential, or RR, within the general plan. It is zoned R40, which is single family residential. The property is about 5.4 acres and will be subdivided into five separate parcels that will remain undeveloped for the time being. Each parcel will be about 0.95 acres in size, so all of them will be about the similar size. Here we have the tentative map. As I mentioned, there's no development proposed as part of this application. Future residences would require a design review. And as you see here, each parcel is about 41 and a half. so close to that .95 acres. There are proposed private streets or roads that would be developed in the future and would be required to be installed when the properties are developed. The map complies with the development standards of the R40 zoning district and all other development standards. environmental. This project did go through a unique environmental process. They had to go through what's called a 15183 checklist, which basically states that if a project complies with the general plan and zoning designations. You don't have to go through the full environmental review that a different project may require or a project that doesn't necessarily comply with the underlying general plan designation. SO WHAT THAT MEANS IS THE CHECKLIST GOES AND REFERS TO THE GENERAL PLAN AND ANY NEWER ENVIRONMENTAL STUDIES AND STATES THAT, YOU KNOW, ANY POTENTIAL IMPACTS THAT THIS SUBDIVISION MAY HAVE WERE PREVIOUSLY ANALYZED AS PART OF THE OKLAHOMA GENERAL PLANS EIR and the subsequent focus general plan update environmental documents. But with that being said, the modified initial study or the 15183 checklist did do studies and found that the potential impacts were previously analyzed and accounted for. With that being said, staff recommends that the Planning Commission approve a resolution recommending the City Council approve a tentative map for the project titled Hacienda States, that's TM 2025-002, and find that the modified initial study slash 15183 checklist identifies that the Oakley general plan policies and or actions that apply to the development of the project have been determined in the general plan EIR to substantially mitigate environmental effects as conditioned. I'm sorry, are you saying if the project has a detention basin or? No, the project, let me see here. There isn't a, like a larger subdivision would require a detention basin. I don't think we have one in this situation where it would require or trigger that.

I can help address that. I've had some more experience with stormwater control in a past life. The stormwater detention basins are typically required when there's a project being developed. In this case, we only have the subdivision. So the parcel is being split up into five lots. In the future, if these lots were to be developed with single family residential, Even then, the chances that a detention basin or pond would be required really depends on how much impervious surface is built and whether there's enough impervious surface to handle what's called self-retention. So if there's enough of it there to absorb the runoff and flows and percolate into the ground, there wouldn't have to be any special stormwater. But that's really a question that would be answered when development comes forth on the property. And that is not happening at this time.

So yeah, right now we are just looking at the subdivision, the five lines, as you would say. They're not proposing any development, as Ken mentioned previously. Typically, it depends on how they come back and propose their project. If they're just going to do one lot at a time, typically we'll do a staff review of the house, but that's typically what we'll do for single houses. But again, it just depends on what they propose to do in the future. The conditions of approval do typically cover like, hey, if you are going to do development, here's everything you would have to do to do your development. So all that is covered. But for now, it's just the subdivision itself.

I can give a really quick staff report. First of all, good evening, Chair, Vice Mayor, members of the Planning Commission. I'll just read the summary and background here. This is a really straightforward item. So the Transplant Committee coordinates the regional transportation interests of East Contra Costa County communities, including the cities of Antioch, Brentwood, Oakley, and Pittsburgh, and Contra Costa County. and unincorporated communities of Bethel Island, Byron, Discovery Bay, and Knightson. Elected officials and planning commissioners sit on the committee. On May 6 of 2025, the planning commission adopted resolution 5-25, appointing commissioners Harvey and Oliveros as the representative and alternate, respectively. Those appointments were for a two-year term. On July 7, 2026, Commissioner Oliveros announced their resignation from the Planning Commission. Since Commissioner Oliveros served as the alternate representative for the Planning Commission, the Planning Commission may appoint a new alternate to complete the two-year term, which will end on May 5, 2027. So staff recommends that the Planning Commission nominate an alternate, second that, and take a vote. And there is a resolution that would be signed to make that official. Once that is done, staff will notify transplant staff of the update and provide them the updated Planning Commissioner's information.

Yes, sir. I have three quick staff reports from staff to the Planning Commission and public. So as you know, we have the vacancy to fill for Commissioner Olivares' resignation. And I'm happy to report that we did receive a few applications for the new planning commissioner. And we are tentatively scheduling that to go in front of the city council at one of the September meetings. We'll be finalizing that date soon once that agenda is posted. And they will hold interviews and hopefully appoint one of those members who would then be able to start as soon as possible. Also, as you remember, on July 21st, there was a joint planning commission and city council meeting to discuss data centers as a general term for a multiple of uses. And at that meeting, staff was directed to come back with a focused second work session. We have prepared the materials for that, and that is now scheduled for September 15th at 6.30 p.m. right here in the City Council Chambers at Civic Center and City Hall. And lastly, I would like to announce that the regularly scheduled meeting for October 6, planning commission meeting for October 6, will not be held. We will have at least one of our planning commissioners out. I will personally be out. Another one of our planners will be out. So we will be instead moving that meeting to the third Tuesday of October or October 20. same time 6 30 p.m right here in the council chambers and those are all my reports thank you thank you are there any reports from commissioners i would like to share a few things

On August 18th, I was unable to attend, but I notified City Next Day. On August 6th, I was able to participate in a water tour for Oakley and was able to understand more about our water infrastructure. within Oakley, and it was very fascinating and informative. And I gained a lot of confidence in our water system. Our employees are amazing. We have beautiful staff, very caring. It was a great experience. On the 13th of August, I was able to attend right here in City Hall when Josh Harder for District 9 did a meet and greet and spoke to a great number of people about funding and a lot of things that are going on right now in California, especially for fixed income people. And I was able to ask HIM SPECIFICALLY ABOUT THE CONSTANT ATTACKS ON OUR DELTA WATER AND HOW TO FIGHT IT. AND HE IS VERY SPECIFIC ABOUT HR 1311 AND HOW TO FIGHT THEM TAKING OUR DELTA WATER.
