And then, um, okay, so we're done with that. Item number six is a request from the C LLC for approval of the preliminary plat of Blooming Heights Plat 5. Elliot, would you brief us on this item, please?

Yep. So, this is a preliminary plat for an area a little bit under 15 acres north of where Redbud permanent currently dead ends um in the western part of the city. You guys might remember that this came for reszoning uh middle of last year. I think Julyish is about when that about when that happened. So, um that reszoning went from a reserve to R160 single family residential which is our base single family zoning district. um that is compatible with the comprehensive plan. And so this is the lot layout within the area described. [clears throat] Out lot Z there. If you look at grading plan is primarily detention basin. So most storm water for the site is being uh handled within the plat boundary. It's pretty close to um Middle Creek. So that's going to be a uh engineered and improved detention facility prior to outletting into a natural natural drainage. So um 17 lots in total. Uh they're working with some some easements on this on this plat because of the uh the sewer that's in place. Um largely the grading remains the same aside from that detention basis. So um pretty straightforward. I'm happy to answer any questions you guys might have. We've got the applicant in the room tonight as well as their development engineer.

Hello, Brad Cooper, Cooper Crawford Associates. Just here to address any questions you may have. Um it's a R160, but we are actually developing this with much larger lots than that. Um ranging from 85 to 90 ft wide in length and all of them are fairly deep. U I think we've addressed all of staff's comments and agree with all of them and look forward to approval and uh getting construction drawings approved and beginning as soon as uh spring weather allows. Any questions or deliberation from the commission or um sorry would any members of the public like to make a comment on this item?

Dennis Eisley 2986 South Verilla Road. Um here in the text of tonight's meeting it says big picture context. There could be a potential benefit from the city's street connectivity if a road would proposed turn left towards Aola Road. That would definitely make my piece of land where that is worth some more money. And uh if the city would thought of some things like this a long time ago, think if we'd had a road from Orchard Hills to Lakewood school would have helped things a lot. They need to think ahead a little bit on some of this stuff. Um, coincidence, I've had since it was reszoned, I've had four calls from diligent peoples wanting to buy my ground, but now they want to dead end it to my ground. So, it's not that road's not open to there. Um, next thing I got in Brainyville in this place is they've got a a uh overland easement agreement on the east side of the property goes down and it goes over against my fence there. I just want to be sure that there's no water runs over the fence. It can run into the creek. That's fine. But this overland, it should be piped and not overland. It just wash the dirt and everything right into the creek. I'm sure Lake would have something to say about that, too. But and then his drawing of his take trees out here. Well, there's trees all along that fence where they're going to put that water. I don't know how they're going to get by

without taking them out. If you look at the the uh picture of the property right by the county's website, it shows all the trees along that fence. And another thing, the the road that they've proposed, if you look at it, ends in a flood plane. How would you go on with that road later? How you going to deal with that? Uh, let's see. The next thing's property lines. I've had problems with the developments on the south and now this and it looks like they're a little bit showing their line a little bit on my side of the fence. Well, state laws say the fence has been there long enough. Last time I had to argue and argue because they put the stakes on the wrong side of the fence. be simpler if they they know where they go.

Thank you. Can you go back to the uh well actually that that whole picture shows it fairly well in terms of the drainage easement. Uh in the rear of lots three through six. Um currently Bloomman Heights plat three has a flared in section that stubs into this property and into that tree line. We're showing the tree line over those lots. We don't intend to mess with those trees any more than we have to. Um, now that's not to say that some of the lot owners in the future wouldn't mess with them, but we're also putting in two intakes, one on the lot line of three and four and one on the lot line of five and six. And we are picking that storm water up and taking it out to our storm sewer system in the street that will then um outlet into our outlot Z, which is our detention and retention pond. the easement that we're showing along that line. It we will keep everything on our property, Denny. Um that's just for the uh Noah's Arc type flood or anything that could not get intercepted in those two intakes, it would have an opportunity to go in that easement and we'll grade that easement out to make sure that it does. Megan. I can give a little bit more uh perspective on the road stuff. Um that was an internal discussion we had with staff um thinking that there could be some benefit to that. Um there wasn't full staff agreement between uh planning um engineering and uh public works and everybody if we should or shouldn't do that. So, um, we decided, uh, that what they were proposed were fine, mainly because our, uh, comprehensive plan and our our planning for transportation in an area doesn't really identify a through connection in this spot. Um, it's saying that our through connection will be more focused up on uh, Beardsley continuing on to the west and over. So, ultimately, we kind of deferred back to that planning effort. I forgot that address, Mom. I think the flood plane situation in Tony's uh staff comments, there is a stretch of flood plane that comes up there on our uh east side of lot 11 as part of our approval and our final plat approval. We will have to get a LMA, a letter of map amendment from FEMA. Um we cannot obtain that though prior to our final plat and an address for lot 11 to to get that done. That's it's kind of a formality of of the final approval of our our plats or deliberation from the commission outlots Y through Y are those just I'm assuming those will be those maintained by the HOA. What's the I'm assuming they're flood plane. You can't build it. They get them going.

Yeah, those are up against Middle Creek. So, and to try to hopefully take the mortgage companies out of the issue going forward for the buyers. Uh, a lot of times we will put those in out lots and those outlots will be connected to the joining lots that they abut. Okay. So, the home the homeowners will own those areas, but in reality, their homes will not be in a flood plane area. So, random question. I know we've had issues with erosion in residents houses backing up the washes like that. Sorry. Does that create any issues? I don't like we've had to fix creek behind some houses over here on Orchard Hills, right? A bit. Yeah.

Yeah, I guess in the context of this meeting. This is more of a heads up, I guess, about moving forward of what's uh, you know, we we we're requesting some feedback from the commission about, you know, that document and if there's any details in there that we need to maybe pay a little bit more attention to moving forward. Um, since I joined the city almost nine years ago, we've not like formally elected a chair in April. Um the date and time has never changed, but there's nothing hard and fast that says that we can't move um when the commission is. There's also um there were some details about committees that

can or that may exist. They don't have to. Um I think it was just important to let the commission know that those that that piece of text, that document exists. Um, and without anybody or I'm sorry, without the full commission in the room, I don't really want to talk too much about it right now. Sure. Um, and I'm thinking April since that's what's in the document, that's probably a good time to do it. Um,

Um so if that looks good or if that could be modified in some useful way and then uh just the make the election of the chair vice chair and secretary. So

Uh nothing real specific. I apologize not being there in person. Uh felt a little under the weather today, so decided to keep myself away from everybody. Um I guess the main thing I would say maybe uh kind of council related as well, we are getting into the swing of budget season and with uh so much discussion and focus on property tax. I would encourage any residents uh commission members themselves to uh you know go to these council meetings, watch them on YouTube um and kind of participate in that process because that's where we decide how property tax dollars get spent. So, I think it's important for everyone to understand how those are uh allocated and why we do that.
