Roll call.
Mr. Birrigan? Here. Mr. Cristofaro? Mrs. O'Hara? Here. Mr. Punchak? Here. Ms. Owls?
Should we mention that Councilwoman DeCristofaro is not going to be here because she has to recuse herself from items three and four, and item five is not going to be discussed. Okay, item three, executive session, closed session. A discussion by council, vote or other action pursuant to RIGL 42-46-5A2, sessions pertaining to collective bargaining or litigation or work sessions pertaining to collective bargaining or litigation or potential litigation. One, Pound Hill Realty LLC versus Town of North Smithfield, case number PC 1999-1811. Would someone like to make a motion to go into executive session?
I'll make the motion to go into executive session. Second.
We have a motion and a second. Roll call.
Mr. Yes. Mr. Yes. Mr. Yes.
Back into open session. We'll seal the minutes and indicate that one vote was taken.
I'll do a roll call. Mr. .
Mr. . Yes. Mrs. O'Hara.
Yes. Okay, item five. Nope, item four, open session discussion by council, vote or other action pursuant to RI General Law 42-46. 5A2, sessions pertaining to collective bargaining or litigation or work sessions pertaining to collective bargaining or litigation or potential litigation. Pound Hill Realty, LLC versus Town of North Smithfield, case number PC 1999-1811. So last week we presented an offer to Poundhill Realty. They came back with a counter offer which we have rejected. Moving forward, We have authorized Attorney Robenheimer to go back to Poundhill Realty with our very final offer and an associated time frame for Poundhill Realty to get back to us. With that being said, depending on the response we receive, The MOU will potentially be made public on Thursday and it will also determine whether or not a vote is taken Monday for the overlay.
I got everything?
Okay, item five, discussion by council vote or other action on a resolution supporting enabling legislation to ratify proposed amendments to article two, section two, and article three. Nope, article four, section one of the North Smithfield Home Rule Charter establishing staggered four year town council terms and transitional term limit provisions subject to voter approval. David.
Mr. President, that can pass off the agenda. I think I reported to the council that I did have consultation with the General Assembly. And I spoke with legal counsel for the minority leader, indicated that he spoke with the Speaker of the House. And they indicated that they would not ratify in advance a proposed charter change at this time. But if it is approved by the voters, they would certainly look upon it favorably at that time.
So ultimately voters get input by voting for this or not voting for this.
Exactly right.
With that being said, yeah, so we just, no action, okay. The last item on the agenda is adjourn. I'll take a motion to adjourn. All in favor? Aye. Aye, thank you.
