So I'm not gonna really talk much about the the people who are involved in that know what that process is pretty much. So I'm not gonna go into that. Everyone else is here is here for code enforcement. So, the way it will work is the, the code enforcement officer will stand at this podium over here. When your case is called, you'll come stand at this podium over on this side of the room. The the city puts on their case first.
At the end of their case, you are permitted this is a quasi judicial proceeding, so you're permitted to ask questions of the code enforcement officer. You're not required to. You can just go ahead and say why you do not think that, you're in violation. Or if it's anything other than a tree case where there is a time to cure before the fines kick in, you can say, well, I know I'm in violation. However, I'm gonna need this much time and this is why, you know, before the fines would apply.
So that is oh, and then usually I go back to I give each side one last time. I give the property owner the last word, and then I close the hearing. And with very, very rare occasion, I just make my ruling at that point in time, and the hearing is closed and we move on to the next hearing. At this point in time, anyone who is going to speak, that even includes attorneys under the rules of the city of New York court, I'm the clerk's gonna ask you to stand, and the clerk will administer the oath.

I've had an opportunity to speak with the residents this morning, and we've worked it out. They're asking for a continuance to allow them an opportunity to obtain a culvert permit so they can traverse the right of way and also to so that we can join the two lots together and be in compliance.

The property has been inspected on multiple occasions, most recently on 12/09/2025. I have not had contact with the property owner prior to today. I have two photos to present as evidence. The photos are true and accurate depiction of the property located at 8690 Bumford Avenue.

Yes. The roof was missing shingles. It was in a state of disrepair. A proportion of it was completely removed by a welder or I e someone. The facial bowl was in a state of disrepair, corroded, falling apart, as well as the soffit area.

I'm here on behalf of the current and future property owners. My my office is primarily transactional. I received this property in the course of assisting in the sale of the property to a bonafide purchaser for value in an arm in an arm's length transaction. When researching the property, we discovered this that it has the dubious honor of being the highest violations in the city, I believe. And and and we set about establishing the the steps necessary to conduct a code a code lien reduction hearing, which at this point has been submitted for the city's consideration.
My my retainer the the gentleman who retained me, the buyer, has facilitated the probate of this estate. This this property was held by Dwellwell Inc, as the city correctly acknowledged. Dwellwell is an inactive Florida corporation, which was owned solely by a deceased lady. We assisted her her husband in probating her estate, quieting title. There were numerous deep defects in the official records and Also conducting repairs on the property.
My client has facilitated the submission of a permit for the roof repairs described and I believe work has been completed at this point with respect to additional code enforcement violations, namely debris cleanup and and patching, the missing shingles that that the honorable gentleman was describing. We expect that permit to be issued within the next several days. Once that permit is issued, I understand miss Ray is waiting to condense these liens into the administrative cost pursuant to the ordinance that was established in September. We'd ask that this matter be continued until the January hearing date so we could hopefully have this all wrapped up.

On pulling the permits for now, the windows, they told me if I do the window permit that, it makes a Conix box become a a material box for all the stuff that was damaged in my house from hurricane Ian.

I can you refresh my name memory on her last name?
Vicky Shank? Shank. Vicky Shank, came out, inspected the property saying that she could not remove the trees prior to the hurricane, that if I wanted to, I could remove them at my own expense. I may or may not get paid for those trees. And I asked her if she could put that in writing. She could not.

I may, I may make an enlighten everybody. The building official is here. As a courtesy, the building official allowed mister Spelman to, keep the context box without permitting if he got a window permit, which he needs anyway to install windows. The reason we're here today is

However, apparently, there's some problem today mister Spelman's having with his windows. Now I'm gonna be honest with you from a city standpoint. This case has gone on way too long. However, he can still obtain a, the original permit for the CONEXPOXX, and that will close the case out. So one way or another, by January the next hearing is 01/22/2026. Correct?

One way or another, the city is prepared to move forward with a violation for not for not having the permit for the CONEX box if either mister Spelling doesn't obtain the window permit or get the permit for the CONEX box. I just want that known upfront Well, this

Building official has made a courtesy for him, an accommodation to supersede that in order for him to store the windows in that box. So he has an active building permit.

That's was fine. But for our purposes here for the city, that was the reasonable accommodation made for you obtaining the window permit. He would forgo the permit on the Konex box for now as long as you're in good standing with that permit. That

So it's all connected. And they're gonna be dealing with this with actual contractors who can do the the structure and, I mean, it's not like something that I can go pull down. And so they're doing all this. Resilient Sarasota is going to fix the whole, you know, all of it.
What is the timeline for doing that?
They currently are deciding which way they're going to go, either do the repairs or if like it's right on the line of just taking the whole house down.
Do you know when they're gonna make that decision?
They told me before the end of the year they'll make that decision and then they'll be they'll get started in January either way. So I don't know if you wanna if we can continue it till the next meeting and, like, we'll I mean, I have more answers by then. I do have a statement.

However, just having an active permit would satisfy that that you're acting in good faith to complete that culvert permit and just extend the gravel or shell drive Yeah. One of them is you're going to need septic, you're going to need a well, you're going need the plans for the actual building. There's a host of things you have to do. It's not something that gets done in like a week or two.

You have to put up a self fence and then you are allowed to, you know, temporarily store construction materials because that's necessary to build a house. But it's again, it's it's they're all those conditions are built into that permit.
