Good morning. Thank you for hearing me. My name is Casey DeHelion, and I'm the next door neighbor to the said property. I actually speak on behalf of the entire neighborhood. This has been an abandoned house that we've all named the Jumanji House. I have children. The next door neighbor on the other side have a baby and a toddler, and this home is growing like crazy inside and out. It is rotting. The pool there is an abandoned pool that is full of swamp water. I have, for the past seven or eight months, contacted a management company sticker telling them, please either drain the pool or, put, chlorine in it or something because it is causing mosquito larvae to eat alive.

Everyone in the neighborhood, it's also causing mold spores to overwhelm everyone's backyards. I have ripped out all the plants on their side to help my fence to be intact, pressure washed everything. Within a few months, all the mold just grows right back. If I leave a cup of water out on my pool patio, within two days, I have mold spores growing all over the top. So the first thing is the mosquitoes.

It's horrible. I've contacted this company many times just asking, please, just drain it or, put chlorine in it. And, unfortunately, I did not have any, success. So what I'm asking of the city is just to help us in our neighborhood to be safe because we have kids. The screens are blown out so anyone can get it, including a small child. There's no fence, and it's been abandoned for many, many years. So it is actually a danger to the city, the neighborhood. It really needs to be condemned and demolished, honestly. So thank you.

So but you can also talk about if there's factors that mitigate why the maximum fine should not be imposed. If, again, if you're acknowledging that there is, you know, a violation.

The case is addressing the violation of two dash five eleven MPC, the fines and liens for 4,000 square feet worth of trees being eliminated. We have the arborist that was there, Jeremy Rogus, for $6,000 fine in regards. We also had a debris case, which was cleared.

So and after that, even I spoke with Anthony, this guy, he tried, like, threatening us to get more money. And we find out, like, he could not put a lien in our house, on the lot, actually. And then we spend another 3,000 actually, $4,000 for the truck guy, truck company to remove the the the debris because he's supposed to pay this guy.

So that's the agreement. And the guy, he didn't get, like, any money from this landscape guy. And the truck guy said, if you don't pay, we're gonna put a lien on your house. And then we received, like, a letter from his lawyer and explain everything about that. So our situation just escalated and we never, like, expect something like that. We paid for the lot. We just pushed the house and a lot of money, like, we spent on that, like, we didn't expect it, you know. And I apologize for this inconvenience, like and we came to the city, and we was looking to do everything's possible on the right way. So I spoke with Anthony, and he told us, like, what to do with. We clear everything.

It says, if the number of trees removed is undetermined and it's a residential zone lot of 10,000 square feet, then the fine is $15,000 So apparently what the arborists did was they actually said, well, you didn't clear the entire lot.

You cleared you affected 4,000 square feet of the 10,000. So they kind of have prorated, I guess, this maximum fine based upon that. They've actually yeah, it's pretty close to just the proration of that. So that's what the did. I just wanna make sure you understand what the did with their recommendation of the lower fine. Yeah. And so that's happened. Yes. Completely understand. But we hired him and we told him do not do it without permit. He started to pull up the permit, you know. Well, we've had situations where the wrong lot gets cleared. And again, the way the code is written, it's really just against property owner. And then that person has to typically go to court and go against whoever cleared the they didn't ask for their lot to be cleared. It just happened. So this is a little less severe than that.

Even though they switched the vehicles and if you park another one on the front line, it still leaves it in violation. In order for this not to be in violation, you have to be parked on a paved and or approved service, which if it's not concrete or asphalt, it has to be mulched, shell, that type of material, and it would be on the side of the driveway. And as I noticed the other day, I came back out there. You have several other vehicles out there too, but you just switched the vehicle, and you're still parking on the front lot.

I'm actually scheduled to have my hand amputated. It was actually scheduled for September 9. It's now been scheduled for November 10 and reconstructive surgery on the eleventh. I've been in contact with mister Vuducci several times. I tried calling. I've left several messages to the code officer that issued the code violation.

It's been nothing but a negligence case to where my son has now, on his behalf or on my behalf, out of his pocket, is re retaining an attorney on my behalf to file a case against the city of Northport. And I'll get into more of this, but you cannot pull a permit on this container. And I told him my son is a a trucking business LLC to where he can move this container. He he's out of Dallas.

When I went into code enforcement and I asked them about permits on this box, I asked them to show me the code for the permit for this box. There's there's no code that they could show me. The statement that I got from the guy was, well, you can pull a permit on it because we can't find anything, but you can pull a permit on it. We just don't like them, and just make sure that it's it's temporary. And I asked him at that time.
