Put solid waste. I got into this position. First, I was a recycle driver for five years for the city of Northport, and then I became the planner scheduler after taking an interest in educating the residents on how to recycle properly. In my position, my day to day, usually, I start out by visiting the new residents that schedule garbage and recycle containers to be delivered, and I will go see them and educate them on our solid guidelines. More or less, I'm more focused on the recycle part of it.
After that, I will drive around the city and I actually inspect recycled containers manually for contamination. And then I will take calls from drivers if there's any issues with repeat garbage in the recycle, and I will go educate those people as well. What I love most about the city Of Northport is there are residents are from all over the world, and I get to learn about the solid waste guidelines, where they come from, as well as educate them on the city of Northport solid waste guidelines and how to recycle properly.
I decided to become a firefighter. I used to work in, hospitality and group sales, and I always had friends that were firefighters. And I decided one day that I wanted to change my job and serve people, so I went ahead and went through a EMT and paramedic program, went to fire academy, and then I saw Northport were hiring. Hiring and I really liked what they had on there between their ISO rating and their beliefs and values and everything. So I applied, they gave me an opportunity.
Every day is different but for the most part, we start off the same. We'll get our gear onto the apparatus and make sure everything's operational like our air pack. Then we also check the inventory, make sure we have all of our medical equipment. Everything's operational. That way,
we can respond to any emergency. Now

We have the minutes of the meeting of 06/26/2025, and then there were two meetings on 08/28/2025. Are there any corrections to those minutes? Hearing no corrections, those minutes are approved. Alright. The way this works is for those of you who showed up here, we take your cases first.
We don't make you sit through the entire agenda. We take your cases in the order that you signed up. In a moment, the clerk will ask anyone who's going to speak to stand and the clerk will administer the oath. The way it will work is this podium over here, excuse me, is where staff, code enforcement officers present their case. They go first.
You will be standing over here. You'll hear the the first words out of the code enforcement officer's mouth, their name, and that they've been sworn. Again, if you the first words out of your mouth can be your name and this is a statement that you can that you've been sworn, that would help. Once the code enforcement officer is done presenting the case, you're entitled to ask questions of the code enforcement officer. You don't have to.
You can just present your case as to why you believe you are in compliance that you're that, you're not in violation. Or the other thing that happens is, except for tree cases, there's it's a two step process where there's a finding of violation, but then there is a period of time before the fines begin. And sometimes, property owner just wants to talk about how much time they need to to bring the the property into compliance. And then typically, go back one more time if the if there's anything else that the property owner has said that the that the city wants to to address. Sometimes they have something, sometimes they don't.
And then I I turn to the property owner and they have the last word. It is asked that you don't be repetitive in your testimony that you, that anything you say, it's something new. Alright. At this point in time, the clerk will ask anyone who's going to speak today to stand, and they will administer the oath.

am Anthony Brehawn, code enforcement inspector for the city of Northport, and I've been sworn. We have case number 2501037. It was initially inspected on 05/2825. The case is addressing the violation, storage of certain vehicles, and truck parked in the city right away in the front of the property. The property was inspected on multiple occasions, most recently on 09/1625. I have not had any contact with the property owner prior to today. I have two photos to present as evidence. The photos are true and accurate depiction of property located at 4362 Kindle Avenue.

Prepared to talk about the truck. I was not aware there was anything. There was nothing mentioned in the paperwork I got about the trailer. So the truck was parked in front of the house. I had temporarily one of my sons moved back home, and we did not have enough room in the driveway. So the truck was parked in front. Didn't realize it was a violation because everybody all around does that, so until I got the notice. But since my youngest son has moved out, that's his truck, he's taken it with him, so that has been resolved. I was not aware. Nowhere in the paperwork did it mention the trailer, so I was not aware that that was also a violation. So I'm gonna need some time to do something with that.
Yeah. Do you want can you briefly describe to her, like, where that trailer could be that would where it would not be a violation? Yes.
Yes, ma'am. Your trailer or anything like that, boats, trucks, they have to be on an approved surface like your driveway. They can't be parked on your lawn, and the city right of way have to be on approved surface, which will be your driveway.
So the driveway only fits a few vehicles. So you're saying I can't have a boat or a trailer at my house unless I get another driveway? I just want to understand.
Well, it has to be is it impervious surface?
An improved surface. So an improved surface can be anything. It has to pretty much come off your driveway such as shell, rock. It could be mulch. Anything that comes off of your driveway, that is considered an improved surface, then you're able to park your truck, trailer, boat, anything. And it has to encompass the full width and length of your vehicle as well. It cannot just be where the tires run. It has to be, like I said, width and length of the vehicle. So you can have it coming to the right there where like, up towards where your garbage cans are. You can have little shell there with your trailer sitting on it, and that's perfectly fine.

Yeah. I have a lot. First of all, I I would have made the first hearing, but I wasn't aware of it. And I've been in this court court before over the same property probably almost a year ago. I bought this property to build my retirement house. It's a building site. It's I'm not just storing stuff there. I have my building permit. I spent over $30,000 on this project so far. Them tents, are very temporary. It's just to keep my stuff away from the sun and the rain while I'm there working. The travel trailer was simply a place for me to get out of the weather. You know? I'm retired. I'm old. You know? I can't be over there all day in the sun. I don't live there. I own a house on Topsy Terrace off the Chamberlain. Now the truck don't have to be there.
It's just a spare truck for my business. When a truck breaks down, we use it until we get it fixed. The wooden building I built back there, I have about $10,000 worth of tools in there. I've had the Millarport Police Department over there twice over vandalism and theft. I had to secure my I I I gotta be able to secure myself while I build this house. The fence was a very temporary fence I put up. I got from Tractor Supply because I couldn't get the kids out of there from camping and building fires. You know, I resolved this. I thought Yeah.
I'm playing defenses. We're not talking about defense today. Right? No.

Okay. So let let's talk about the the case number 2500922First. So so the RV for it to be a violation, it doesn't have to be that someone's living in it. It's just that it's parked on this this property which is, currently in an unimproved lot. So that's what that violation

Well, I see office trailers on building sites all the time. I've been a licensed pool contractor since 'eighty seven. I've been to thousands of building sites. I use it as an office. I don't live there. I go in there when I go over there and work to get out of the weather. And that's all.
Okay. So I guess what I need to hear from you is you have a building permit and that permit allows you to do certain things. And I need to hear specifically this permit allows me to do this, that, this is an example of what that permit allows. Understand what I'm saying? Not really. Well, example, if the permit says there can be an office trailer or something like that on the site, and you're saying the RV is my essentially my office trailer, I need to see in the permit where that's allowed.

I'm I'm I'm about a month, two months away. I got building more material materials coming in now. I'm gonna start building this wall. This whole project started two years ago. I waited over a year to get my building permit and thousands and thousands of dollars.

I have them. I would have brought them with me, but I I didn't even know I was I would come up here. Yeah. I went down. I this is the third time I've been down to the front office. They took my number every time and said I'd be contacted and nobody contacted me. So I came back today and I found out you was having court. So I said, can I go? And she said, you have to go. Right. That's how I ended up here. You know, I'm not trying to start a junkyard over there, guys. I'm building my retirement house as an owner builder. You know, I I'm not doing it with I'm doing it without a mortgage. I won't have utility bills because there's no electric on my road.
I have no neighbors. They've rezoned that whole area commercial now, so no more houses are gonna be around me. Planning and zoning department told me that I ain't gonna have neighbors for decades. You know, I just I'm not trying to create a problem for anybody. I'm just trying to build my retirement with And these
and before before we go further, as you know, if I if I take the next step in this process, then, you know, I I no longer have jurisdiction over it. So as we're talking about what we want to do next, just bear that in mind. Okay?
No. I I understand that. But apparently, this is the same violations were, brought against the property owner previously. So that's what I'm trying to figure out. Where are we now in as opposed to the
last I'm only months away. You know, I I I would have thought I'd been half done by now if I hadn't spent so much money on getting my building permit, reengineering. They sent me back to my, Florida engineering, after I got everything approved, and they wanted a structural survey because it is a wood frame house with a crawl space. It's a cracker house is what it is, small house. And so and I spent another $3,000 to get this the survey they wanted, structural survey. So it's been delayed by all this stuff.

But obtaining the building permit and the violations that are here before you today are two different matters. One being one being, generally, you don't have RVs on a property that you're in, of course, a building, specifically because it's not a lot that's been assessed as a home, at that time. After you get your COO and you get going, sometimes things change. But where you are now, I don't believe you're at that point. Also, the shed or whatever you're storing your materials, and if someone was to leave a trailer that was full of tools, it's one thing, but to have an actual building on the ground at the premises could potentially pose a problem.
Well, I didn't have an enclosed trailer, and I've been vandalized and stolen from over there many times. And I just wanted to secure myself.

So he's saying that that shed that's back there is a temporary shed where he stores his tools because he's building this home himself. And and then the RV, he's characterizing that kind of equivalent to a construction trailer, like an office trailer. It's a place where he goes to get out of the sun when he's building. So do you understand kind of what my questions are? All right. So go ahead

Your only option at that point in time is I believe to go to city commission and ask for relief. So that's why we're talking about continuing the case because that's the only way I keep a hold of these two cases, right? So what I'm inclined to do is, again, but I want to be I mean, I think the building commissioner kind of told you, want to also be real serious here. What we want to see probably come December 11 is, you know, footage dug, you know, the bits of You

This case is addressing the violation of MPCC 59 dash one parenthesis six parenthesis two prohibited parking of heavy duty vehicle. The property has been inspected on multiple occasions, most recently on 09/2325 at 10AM.
I have not I should have said correction. I have had contact with the property owner prior to today. I have two photos of the present as I have two photos to present as evidence. The photos are true and accurate depiction of the property located at 6222 Bolander Terrace. First picture is 02 okay.

I'm Josh Preston, code enforcement inspector for the city of Northport, and I have been sworn. Case number 25Dash00339 was initially inspected on 02/19/2025. This case is addressing, multiple violations. First being Northport city code 42Dash23 accumulation of debris where a large amount of rubbish has been placed in the right of way. Second is Northport City Code seventy-twenty 1 driving through the city right of way where there is a RV camper placed in the right of way. And Northport City Code 50 nine-one prohibited parking where we can also see the camper has been parked in the right of way for quite some time.

The property has been inspected on multiple occasions, most recently as of 09/23/2025. I have not had contact with the property owner prior to today, and I have two photos to present as evidence. These are a true and accurate depiction of the property located at partial ID number 1128227004.

The street, I think part of it's, you know, across the street, part of it's on the lot probably $10 a day with a maximum of $1,000 will commence on 10/20/2025. If not brought into compliance by 10/19/2025.
Again, there's evidence that there is driving through the right of way going into this lot to the left, as you're looking at the photograph. So I'm gonna find a violation of section 70 dash two one in Norfolk City code for driving through the right of way. A fine of $10 a day with a maximum $1,000 will commence on 10/20/2025. It's not brought into compliance by 10/19/2025. And then, I'm gonna find that there's a violation of, section 59 dash one b one is Norport City code for, prohibited parking in the right of way.
