Order code enforcement hearings and also oh, thank you very much for turning my microphone on. Code enforcement hearings for the city of Norport. If everyone could please stand and join me in the Pledge of Allegiance. Are there any corrections to the minutes of the February 2626 code enforcement hearings? Hearing no corrections, those minutes are approved. All right, in a moment, those of you who are here, we will take your cases first. And we will take them typically basically in the order that you came in. We have two parking ticket appeals.
We're going to do those first. And then we'll move on to the code enforcement cases. And in a moment, the clerk is going to ask everyone who's going to speak to stand. And the clerk will administer the oath. The process or the procedure is the city staff will come to this podium here.
The property owner or the person filing the parking ticket appeal will come to this podium over here when your case is called. The city will go first. Even in the parking ticket appeals, the way I understand it will work is the city will put on a prima facie case that, you know, they issued the parking ticket correctly. And then and then the the person who's appealing will have a chance to say why it was not issued correctly. Typically, what will happen is you can ask the witness.
In the case of parking tickets, it'll be a police officer. In the case of the code enforcement, it'll be the code enforcement officer or the arborist. You you can ask questions. You know, you can't interrupt. But when they're done talking, you can ask questions. You don't have to ask questions. They can also ask questions of you. And I also understand that public speaking is, I think, there's surveys have been taken that it's the people's greatest fear for the most part. But we won't bite. Take some deep breaths, stay calm, you'll get through this.
It's not that bad of a process. And then usually, we go like two rounds. And I give the property owner, or in this case, the parking ticket person, appealing. They'll get the last word. I'll close the case, and usually, I will rule at that point in time. So, that is the the process for how it'll go this morning. At this point in time, the clerk will administer the oath.

Alright. So now oh, yeah. Do we have to read them in? Or Oh, okay. So before we go on to the parking ticket cases, we do have some compliant cases that need to be read into the record.
The following five cases have come into compliance since the agenda posting date of April '26. CE case 25Dash02476, CE case 25Dash03352, CE case 26Dash00415, CE case 26Dash00462, and CE case 2600500.
Alright. Now I'll call the the first parking ticket appeal case. And I don't have the person's name, but I have the the ticket number and the and the where it was given. It's case number 26Dash022710. Was given, I guess, at 1726 Scarlet Avenue.
And if you know who you are, if you'll come to this podium down here. Also, and I forgot to mention that you'll hear the people from this side, the first words out of their mouth will be their name for the record and that they've been sworn. And again, for the property owners and the people on this side, if that can be the first words out of your mouth, it makes everything go a little bit smoother. So the city may begin to put on their prima facie case whenever they're ready.
Thank you. Good morning, Your Honor. Michael Golan, Deputy City Attorney. I've been sworn. We are here today for the parking ticket for 1726 Scarlet Avenue. I have Officer Kerr here as my witness. He issued the ticket. And we're prepared to proceed, but we need the camera up on top

Good morning, your honor. My name is officer Kerr. I'm with the Norfolk Police Department.

And you were the officer patrolling the area at in Scarlet Avenue. Is that correct?

And did you issue a ticket at 1726 Scarlet Avenue? I did.
Okay. Very good. And let me just pull up that ticket for myself here. Do do do. Do do
you remember what day that was? Is that Friday, the March twenty seventh of this year?
Yes, it was.
Okay. And do you recognize the car in this picture?
Yes. And that picture was taken when my city issued cellphone by me.
Okay. And
does it accurately depict the the circumstances of that day when
you issued the ticket? Yes. It does. Okay. And what is
it what does it show that why did you issue that ticket?
It shows a vehicle obstructing the sidewalk, which is needs to be clear. In this case, the width of this sidewalk, with the double width needs to be clear for either two wheelchairs to pass one another or a wheelchair and a pedestrian to pass unobstructed without having to leave the sidewalk.
Okay. Is this sidewalk, is this an HOA area?
The overall area is, however, not every residence is part of the HOA.
Okay. And were any warnings given out to the property owner prior to these tickets being issued?
Not at this specific address. No.
Okay. And is your opinion that the the vehicle is either on or across the the sidewalk? Yes. And is that a violation of city code?
It is. Okay. Thank you.

Sure. You can read it to me. Section 745A says, It shall be unlawful to permit any vehicle to stand, stop, and or park in any of the following places except in compliance with the direction of a police officer. And Subsection A9 says, On and slash or across any sidewalk. Okay.

You can yeah. I'll tell you what. The easiest way to probably get it in the record is just cross over here and they'll grab it. They'll there's no elbow on this side or there is on So this and then once they'll they'll put it in the right position and then you can kinda describe what I'm seeing.
So this is a better picture, I believe. If you stand back further, it shows how much space is actually there. I've encroached into the sidewalk eight inches. I know there's rules, and I have relatives that are in wheelchairs, and it's more than ADA compliant. It's well over 30 inches.
There's over 50 inches right there. So I'm just asking, like, is there any type of process where you're like, it's not that bad? Because I told my daughter to back her Jeep up because, like I said, I have relatives, and I know people walk through the neighborhood with strollers. And the odds of two wheelchairs or two strollers coming at the exact same time is pretty much zero, but there is a chance. But I'm asking the police officer to look at that and say, well, that's not egregious unlike this one.
Yeah. Well, I'll let yeah. And I'll let you ask that question. I just need a clarifying question. Again, this is my first parking ticket appeal hearing I've had. So is the way the code is written, does it say that you can't obstruct the sidewalk so that there's less than a certain number of inches, or does it say you just can't obstruct into the sidewalk?

Okay. And okay. And the standard about the two wheelchairs or a wheelchair and pedestrian, is that not written into the code? It's just that's kind of That's a federal understanding?
That's a federal ADA guideline, your honor.

The question was, is there any type of, like, not due diligence, but in your mind, as a professional, okay. That's not egregious. That's not inhibiting anybody. I mean, speed limits are at 35. Do you write have you ever written a ticket for 36 or 37? That would be my question. Because that's the federal law as well, the speed limit. Or do you use better judgment and then make a call
from that?

Well, I don't know. I'm asking you if you
I think he's asking about your experience.
Yes. Based on my experience, in this case, there were 21 other addresses with varying degrees of obstructing the sidewalk. At this address, there's not another vehicle parked in front of that car directly in front of it. This car is by itself. There's a clear lane in front of it. It could have been pulled up five feet. It could have been parked in the road. It could have been parked on the grass, but it's parked where it's parked. You got a $15 city citation ticket instead of a $116 state statute ticket. That's the reason why it was written under city code and not under state statute. Does that answer your question?

Yeah. We were out of town at a conference in New Orleans, so my daughter stopped by the house. So she was only there for maybe a half hour to check on the pet, so that's probably why she didn't pull all the way in. But I always tell her to park so you don't inhibit that sidewalk. So somebody in a wheelchair because the gentleman across the street to the left of us, his child is in a wheelchair. So I always make sure you leave more than ample room. So I that's all I gotta say. Like, judgment call. I mean, like, any other police officer, like I said, if I'm doing 36 or 37 and a speed limit that's 35, would I get pulled over? Well, here, I got pulled over for barely going over the sidewalk. That's all.
So I have one other question. You there was a testimony that it's it's in an HOA, but this is this is a is this a public right away? Yes. It is, your honor. It is? Okay. Alright. Alright. Is there anything else you wanna that the city wants to

Okay. Well, yeah. I mean, I can based upon the testimony that I've heard today, I am going to find that that the parking ticket was issued validly. Again, I I see that obviously it's not, you know, covering the entire sidewalk, but it is encroaching into the sidewalk to a degree that it would impede the ADA compliance. The appeal is denied. Thank you. The next case is case number 26022700. And the address is 2134 Boxwood Street.

And today, I have with me officer Kerr, who issued a parking ticket at two thousand one hundred thirty four Boxwood Street in Northport. Officer, if you would state your name for the record and let us know if you've been sworn.
My name is officer Kerr. I'm with the Northport Police Department. I have been sworn.
And did you issue the ticket at two thousand one hundred thirty four Buckwood Street? Yes, I did. All right. And was that on Friday, 03/27/2026?
Yes, it was.
Okay. And the pictures we see on the screen, are those accurately and fairly depict the vehicle as you saw it the day you wrote the ticket?
MR. Yes, they do. And, again, those were taken with my city issued self owned by me.
MR. Okay. And the violation was based on City Code section was it based on 7,480 on or across any sidewalk prohibiting parking there?
Yes. It was.
Okay. And in your opinion, this vehicle was either on or across the sidewalk? It is. And in
this case, this area on Boxwood has a more narrow sidewalk, a three foot sidewalk, so there's less room for clearance.

I do have one question.

Is it your opinion that I am on the sidewalk or across it?
Across the sidewalk.
Okay. So, I'm not here to defend myself. I recognize that this is an administrative hearing and not a court of law. I'm not sure my words will even be heard, but, I'm assuming that this is all being recorded so that I may appeal. In law, according to, article three section two of the constitution, a case must meet four elements to even be brought as a controversy. One is injury. Were you injured by my vehicle parked where it was?
Myself? Yes.
No. Did you observe anyone to be injured by my vehicle parked the way that it was? Any person injured? Right. Did you observe anyone being injured by my actions?
No. Okay.
So it fails to meet the the first leg, which is injury. The second is causation. So, again, to repeat, there was no injury. There is no ability to redress because there is no injury or harm done, and there is no legal interest on behalf of the city or the officer because no injury or harm was done. So is it the opinion of this tribunal that I am on or across?
I have not ruled yet.
So I'm asking. I'm I'm just asking what your opinion is before you make a ruling. You
'll hear when I make my ruling.
Okay. Furthermore, since you don't wanna answer my question, and we are not in a court of law, I don't expect this to be heard either. But the rule of lenity says that the law should be interpreted in favor of the nonmoving party. I am the nonmoving party. I am the defendant. And in my opinion, I'm clearly not on the sidewalk, and I am not across the sidewalk. Because if a bridge doesn't go from one side to the other, you simply have a pier, and you do not get across it. And that's all I have to say. Alright.
I'm guessing you're gonna wanna say a little bit about health, safety, and health care.
Well, I I wasn't prepared today argue the constitutional argument Right. Of this ticket, but I could say that the, you know, the officer noticed the violation and enforced the city's code with as he saw interpreted it today. We're here to prepare the the at least part of the vehicle is a cross, if not on the the sidewalk.
And is the word instructed, is that the word that's in the No, sir. That is it? Okay. Alright. I gotta give you the last word.
My citation says honor across. It doesn't say anything about obstructing. And again, from my perspective as the nonmoving party, I am clearly not on and definitely not across.

All right. Right. So I'm going to say a little bit about the argument in that municipal ordinances are drafted to promote the health safety and welfare of the general public. So there doesn't have to necessarily be an injury for there to be for a fine to be appropriate. So I am going to find that there is a violation of this section that the private aphasia case put on by the city was appropriate and that the parking ticket was properly issued and the appeal is denied.

Unsettled. You ready? I am Tony Brihan, code enforcement inspector for the city of Northport, and I have been sworn. Case number 26Dash00193 was found down was additionally inspected on 01/2326. This case is violate addressing the violation of two dash five one one MPCC fines and liens for trees.
A permit was not secured before the removal of the trees. This property is at 0 Gaskin Circle, Northport. The number of trees removed is undetermined at this time. I have seven photos to present as evidence. The photos are a true and accurate depiction of the property located at 0 Gaskin Circle.
And then do you want the arborist to testify at this time? Or
Ryan is the arborist head. He was the one who actually came out and seen the property.

Having
no prior permit pulled for this land clearing, it would fall under a code section, speak to a $15,000 fine where undeterminable trees were removed.
And
that's per every 10,000 square feet or portion thereof. This appears to be a complete land clear, so it would be the code section to speak to $15,000.
So this is a residentially zoned lot?

Your honor, Billy Kitty, code enforcement, supervisor, field supervisor. I pulled up the property in question. There was a voided tree underbrush permit, so there was no active or issued permit.
Alright. That was, so when was, so again it was, it and help me understand here. So tree underbrush, you can't just get an underbrush permit, correct? Yes. This was this was applied as a a combined tree and underbrush permit?
The only type of permit that you can secure on a standalone lot without the intention of development at that time would be underbrush. The category is tree slash underbrush, but there is no associated building permit under review.

Okay. She wants to know if if but there was the intent to or based off of that, a request of the underbrush to be approved or or whatnot on the process. But she just wants to know that, yes, we did they he did try to do that.

Now? In coordination with again, Billy Sworn. There is temporary entries in the system, but nothing has been submitted yet temporarily in the system. So there is some things that we can see, but other than that, it hasn't been submitted yet to the city.
Can you tell if go ahead and translate, then I've got a question. Can you tell if this was an underbrush permit only or okay. So the answer to that is yes. Translate that.

So it appears that Tony was there on the January 23 to witness the land clearing had taken place.

didn't take place. Underbrush permit was applied for after the fact on the 01/30/2026. So it's an attempt to apply for a permit, but an underbrush would only allow for trees under three inches in diameter or any understory growth that would be associated with underbrush activity. No tree removal or land clearing or disturbance of the soil shall take place with an underbrush permit.
And do you need him to repeat any of that? When you translate, just ask him to repeat.

So, yes. This would be a satellite imagery from above looking down. In some instances, we can see, like, canopies of single singular trees.
Mhmm. When
I visited the property, it was just, like, Tony's picture showed just completely gone. There's there's nothing left.
And
you can see the surrounding properties supporting what was most likely reflective of what was on that property.

does the property owner have anything else they wanna say?
She's gonna check her phone to see if he sent her something or anything. Okay. Yeah. He's just he was telling her about the permit. Can I ask what voided it? Just so I could give him as far as that because I'm I don't think he knows it was voided.
I understand. The date of Tony's findings was on January 23. The the property was completely cleared, so there's no ability to do an underbrush at that time. So it was gone. Right.

I'm No. Just gonna explain to her what he said. So he just sent something like a it just says two room underbrush and an issue date of 01/23.
This but I think what he doesn't appreciate is and and again, I I want some clarification from the city is that that permit would not have allowed the removal of any trees.

sir. Okay. So, I'm going to make some findings here. One is that again, that there that there was this underbrush permit that was in the process of being issued. But again, it would not have permitted the removal of any of these trees.
And we're to make a finding that the lot is zoned residential, that the lot size is 11,000 square feet, that it is essentially a clear cut of the entire lot and based upon the criteria that's set forth in code section two-five 11, based upon the unknown number of trees being removed, the standard fine of $15,000 will apply.

Okay. The next case is CECase2600235. The property owner is Robert and Juanita Fulton. The property address is 1076 Savia Street.
Good morning. I'm Josh Preston, code enforcement inspector for the city of North and I have been sworn. Code case CEDash26Dash00235 was initially inspected on 01/27/2026. This case is addressing the violation of IPMC three zero four, exterior structures 304.1 for roofing. There is part of the guttering that had fallen down in front of the house.
It appears that the wood in the fascia areas deteriorated now for the guttering has fallen. This property has been inspected multiple occasions, most recently on 04/22/2026. I personally have not had contact with property owner prior to today. We did happen to appear to speak this morning prior to the hearing. I have one photograph presented evidence. The photograph is a true and accurate depiction of the property located at 1076 Saviou Street in Northport. Anything

Alright. Do you have questions or and and there's one thing I did not say at the beginning. So we're now other than now that we're past the pre cases, it's just a one shot deal. This is a two step process. So today is the day that I either determine there is a violation or there isn't a violation.
If I do determine there's a violation, a fine does not begin until some point in time in the future. So sometimes the person who's standing where you're standing will sit there and say, I realize it's a violation. I need x number of days to bring it into compliance. So I forgot to say that at the beginning, and we're now in those section of hearings that deal with that. So if you have any questions or if there's just anything you want to say.

So I mean, do you know what it would take to bring this into compliance?
Well, judge, right now I'm gonna have to make a decision because the structure was found to have a leak of water that comes from on the hut. I heard that. So the decision just to fix one thing, you're gonna have to fix two things now, and I'm gonna need it on time.

Alright. Well, then I'm gonna now I'm gonna ask. So what I'm seeing here with the gutter, is that is that the violation or is that just the evidence of
a weakened roof structure? That supports the the violation of the Okay. Exterior structure deteriorating state. As we spoke this morning, we have since learned of other issues going on inside the house, which I understand. However, we're approaching hurricane season that this is going to end up damaging somebody else's property next door, which is why it came in as a complaint.
