09:00. I'm gonna call to order the the meeting of code enforcement hearings for the city of Norport. It's 9AM. It's 02/26/2026. If everyone would please stand and join me for the pledge of allegiance.

We have a couple of public comment cards. These are just general comments. They're not necessarily related to any particular case. And when I call your name, if you'll come to this podium over here, and you'll have three minutes to say whatever you wanna say. So the first person I'm gonna call is Brent McCarthy.

Okay. I live across the street from 3808 Albatross Lane. And in December, I called Northport and I said, hey, there's a dumpster overflowing and people are coming from all over the county dumping stuff in there and throwing stuff in there and sometimes they don't even hit the dumpster. But there's rats having parties there. People are living over there. There's a home with a they started a home. It has a slab with block walls, and then they stopped. Well, they left the dumpster there, and this was almost two years ago. It was about a year and three quarters or whatever, but it's been sitting there. The grass is not grass anymore.
It's woods. It's a jungle. So I have to get to look at that every day. So I don't know why we can't do something with that dumpster, at least empty the dumpster. I mean, it's a health risk. So I would like for somebody to do something about that dumpster to get it the heck out of there. I've talked to a dumpster company. They said they would come and dump it and hold it for us until somebody wants a claim on it because the dumps the company that did the concrete work and the block work, the construction company that owns that lot went bank is going bankrupt. The people that own the dumpster went bankrupt. So this has been sitting there for almost two years.
I brought it to the attention of Northport in December thinking that it was already in progress saying, hey, how come nothing's going on? Well, they it wasn't nothing in progress. It just so that started the the ball back in December. They've been going on for almost two years. So I guess as my comments is I'd like something. I think it's a health risk for the neighborhood, and I think something needs to be done. So when you get to that case, 3808, I'd certainly like to hear, have something done about that. And I'm not sure if I should stay and listen to see what you're Sure.

Are there any corrections to the minutes of the code enforcement hearings of 01/22/2026? Hearing no corrections, those minutes are approved. The process here will be those of you who are here and signed the green card, your cases will be taken essentially in the order that you signed the card with one exception. We do the tree cases first. So so the case that is a tree case will be first, and then everyone else will be taken in the order that you signed your green card.
In a moment, the clerk is gonna ask anyone who's gonna speak to stand and she will administer the oath. This is a quasi judicial hearing, so it's a little bit like a court hearing, not exactly. We don't have hard rules of evidence. But if you stray from, you know, evidence that is not really related to the case, I will probably stop you. But as long as you only talk about what's going on in the case, you can pretty much say whatever you wanna say. The city goes first. The code enforcement officer presents the case. At the end of that, you have the right to ask questions of the code enforcement officer. You don't have to. You can just put on your case at that point in time.
You can tell me why you think you're not in violation or that you're in compliance or if it's anything other than a tree case. There is a two step process where there's an initially, there's a finding that there is a violation, but then there's a period of time still before the fines begin. So sometimes during your case, a property owner will sit there and say, I know I'm not in compliance. I know I'm in violation. Here's what I need to do to bring it into compliance.
This is how much time I think I'm gonna need to do it. And then that helps me set the order and set the order. And then typically, I'll go back to the city after you're done and the property owner will have the final word. Usually, this goes, you know, four times and that's it. Doesn't have to go four times. If everyone's done, we end it there. And then I typically rule at the end of the hearing so you'll hear what my decision is. So at this point in time, the clerk will administer the oath.

This case is addressing the violation of two dash five eleven MPCC fines and liens. Property has been inspected on multiple occasions, most recently on 02/2326. I've not had contact with the property owner prior to today. I have two pictures to present as evidence. The photos are true and accurate depiction of property located at 3225 Homewood Avenue.

Name for the record and the
Urban name of the Forester, City of Northport. Upon record search, there was no prior land clearing or tree removal application pulled prior to this clearing effort. We that's a great picture right there. It kinda indicates the square footage approximately of what has been impacted on the property. The way that code section reads, it is a $15,000 per quarter acre or portion thereof. And looking at that orange box, just trying to keep it fair as possible, it seemed as though that was about approximate representation of the clearing effort that has taken place on permitted.

That area was mulched with with a mulching permit. The only thing left was a small line of trees across

in the power lines. One of the trees one of one of the palm trees fell down and knocked the power out. And after that, we decided it was probably a good idea to get them out of the power lines. And then there were some dead pines that were real close to the road that were in danger of falling in the road. We had Ken's mulching service do the
I think mulching for the permit right now is what's going on. Is that what's going on? Whoever is doing that? And
he they got the permit because I don't know where to go or what permits to get. So they got the permits for the mulching.

So so what I'm gonna suggest is that we take a recess of this case and you go out, you know, in the hall and kinda discuss this a little bit more because there may be a resolution to this that I don't need to get involved in. So
I'm not sure if he's a original one that did this or sent me this in the mail or what, but he was supposed to call me back after sending me pictures of the satellite view and never did give me a callback. And that was couple of months ago.

But what I'm suggesting is that because you haven't actually met before, Let's use this time to do that. But if you come back and you said we've worked something out, then that makes my job a lot easier. So if I'm I'm gonna suggest that, yeah, you did we we should discontinue this case. Mhmm.

My name is Susan F. Valentine. I was sworn in with the group. Okay. Okay. So I managed to get one what's it not the biggest barrel, dollars 95 for your recycling for cardboard and one half done. And we've only had a couple of days, and it's been 70. So that's part of the reason. And the other part of the reason is they put me on new medication, so it's difficult to adjust to the medication. Not an excuse, just to let you know what's going on, okay?
I didn't call you because I didn't want to call you, leave you a message late in the middle of the night again. So that's fine. I knew I was not in compliance. I would appreciate the extension. I'm trying. I really am. But unfortunately, at this time of year, we don't have 70 degree weather. And that's all I can say.
So let me just try to confirm. This photo was taken the February 17, so the day after the compliance, date. Are you saying that there have been some things removed that are in this photograph?

I'm George White, court enforcement inspector for the city of Northport, and I have been sworn. Case number 25Dash02460 was initially inspected on 05/1225. The case is addressing the violation of three zero four point one point one of the IPMC, unsafe conditions for the roof. The property has been inspected on multiple locations most recently on 02/1326. I have not had contact with the property owner prior to today. Two photos for the that's present as evidence. The photos are true and accurate depiction of the property located at 8521 Shamrock.

Okay. In regards to this, I came in on December 26 and I spoke to Kevin from code enforcement and I told him my circumstances. I'm on disability, so I don't have a lot of money. I don't get any, really, any money from FEMA. And Kevin told me that if I could show him proof that I was trying, you know, like getting roofing estimates or whatever, to come back in a month, which was back a month ago in January.
I think it was January 23 I came back. And I showed him that I had gotten in touch with the United Way and put an application in there, and they were supposed to, help me out. And then they also, put me in touch with SBT, I believe it is, that's gonna help me with a FEMA appeal. But I did come in and I have spoke to code enforcement two times and showed Kevin the documents that I did I was getting help.

the Cohen Enforcement Division. I do remember talking to you. The last conversation we had was you were awaiting a permit through a contractor through the United Way. Can you just update us where you are with it? Because I might have missed that.
The the only thing I I know is SBT has gotten a hold of me. And before United Way will actually get together is I had to do the FEMA appeal.

I that's as far as we've gotten so far. So I don't know.
So the the roof, your honor, is in pretty bad shape. It was actually looked at as well, and I believe we spoke with the building official one of the times you were in right now.

So here's what I would propose today. If you could find the case in violation, and then as long as she can get something for us by the next hearing, which we're off a month, which will be the following month in April 23, I believe. And then it'll either some permanent will have to be pulled or she's gonna have to show us something that's concrete that she has something going on with the she showed us a letter that was several months ago. No. I mean, I just signed the documents on the FEMA appeal, like three days ago because he had to get estimates.
Well, I'm gonna I'm gonna make a suggestion and I wanna hear, you know, input from both sides on this. And and that is what's going through my mind is as opposed to actually finding the violation today, we continue this case to the April hearing. But here's and here's the important part of this. You're gonna need to put some paperwork into evidence at that point in time. You know, wherever you are

You know, in the process, the city needs to know where you are in that.

got I won't I you know, I'm not gonna tell you what I'm gonna decide, you know, in April because it's gonna be dependent upon what I see in April. But, you know, I'm a because of what I'm hearing from the property owner, I'm kinda more inclined to do that than to kind of really pull the trigger at this point in time. And because then, again, I start getting more boxed in with what I can do. I don't have as much flexibility. So I'd like the Citi's comment on that.

I do. I have one of them. I don't and then I also, like I said, I just signed I can also print off the the documents that SBT gave me that shows that we're doing a penal appeal.
So this is gonna be my other suggestion is, yeah, just every time you're you've you've taken one more step

Alright. I am Josh Preston, code enforcement inspector for the city of Northport, I have been sworn. Case number 25Dash03148 was initially inspected on 10/22/2025. This case is addressing the following violations of Northport City code 66 dash 62 c fixture in the city right away. For a building code one zero five point one permit required for a culvert and apron and North Port City code five nine dash one c one allowed parking.
That particular one has come into compliance, and I'll explain that in a in a moment. The property has been inspected on multiple occasions, most recently on February, and I have not had contact with the owners prior to today, and I have seven photographs to present as evidence. The photos are a true and accurate depiction of the property located at partial ID number 0951140414. So reference, the violation has come into compliance. The properties have been conjoined now, and it was conjoined to partial ID number 0951140413, which has the primary Right. Structure on it. So that one has come into compliance
with Yeah. The The allowed parking case goes away.
Yes. So now we have the the culvert issue and the permit. Now that you have also applied as of the February 23, they applied for the PZCC permit for that culvert 26Dash00584. It's been applied for but not issued, so they're still waiting additional information on that. So we still have the violations hanging out there until that is

so the in the meantime, the PVC culvert that they put in the four inch tubing and the rock apron, they that needs to go away. That needs to get out there before.

to add? The I we just didn't know that that wasn't allowed there. So we're in the process now working through that. So I just found some as as I was driving, I saw some signs for COVID. So I'm gonna contact the company for them to to work on that for me.
Alright. So let me ask you this. Do you have some idea of how long it's gonna take you? Because it

Applied for it, but they're still awaiting additional information. Okay. So what I would ask on behalf of the city is we find it in violation Right. And then give it the two months till the next hearing Right. Which should give them ample amount of time to come into compliance.
Right. So do you understand what it what they're asking? Yeah. So again, this is one of these two step processes where I can find a violation today, but the fines don't begin. In this case, it would be two months from now. So that gives you time to break into the compliance. If you bring into the compliance by that date, then there are no fines. So is there anything else you want to say? Is that I mean, are you pretty much agreeable with that? Yes. Yes. Sir. Yes. Alright. Okay. We
are aggressively working on it.
Okay. So the the fixture in the right of way is really also kinda related to the building permit Correct. Thing. Correct. I think I'm gonna just go with the Florida building permit one because I think it that's kinda like double dipping a little bit by so I I'm just I'm gonna dismiss the the violation of sixty six sixty two c of the Norport city code.
But to jump down to the bottom, I am gonna find a violation of section one zero five point one of the Florida building code for no permit for this this culvert, you know, for this driveway that's that's been installed here. And
Your honor, if you if you don't mind, my only reservation with that would be if for some reason the permit is not issued, then that violation that you would like to dismiss would actually remain a violation because that needs to go, period.

So but I'm gonna finish the Florida building code violation. So a fine of $50 a day with a maximum of $5,000 would commence on on 04/18/2026, if not brought into compliance by 04/17/2026. I am also then gonna find that there is a violation of the 60 I'm not gonna dismiss 62 sixty six dash sixty two c for this this, you know, culvert that's in the right away without a permit. And, again, a fine of $10 a day with a maximum $1,000 will commence on 04/18/2026 if not brought into compliance on 04/17/2026. And then and then do you yeah.
For kind of with the same logic, do you still want the driving through the right of way? Are you still asking for that based upon the same logic that because of that, all that goes away. They've

They've got to restore the swale to what it was before.
They can't
get the permit. So Correct. Okay. So I am gonna find a violation of section 70 dash 21 in Norfolk City code for driving through the right of way. And likewise, a fine of $10 a day with a maximum of $1,000 will commence on 04/18/2026, if not brought into compliance by 04/17/2026. So you get the permit in place, and that also resolves those other two things. Because if you have a permit that for a culvert in a driveway, yeah, obviously, have permission to drive through the right of way. So Okay. But it's but it's on an improved driveway. So so, yeah, all that will go away if you get that that permit in place. Alright?

The case is addressing the following violations. Northport city code 42Dash23, accumulation of debris being the bamboo fencing, water tanks, tarps, etcetera. North Port city code 70Dash21 driving through the city right away.
There's RVs and etcetera back behind the the fencing and the IPMC three zero two Dash eight motor vehicles. There's RV stored on the vacant property without a principal structure. The property has been inspected on multiple occasions, most recently on 02/24/2026, and I have not had contact with the property owner prior to today. I have six photographs to present as evidence. The photographs are a true and accurate depiction of the property located at parcel ID number 112822706.
