Y'all may be seated. I don't see that we have any general public comment cards. Are there any corrections to the minutes of the 12/11/2025 hearings? Hearing no corrections. Those minutes are approved. Alright. So the way this works is for those of you who showed up, we take your cases in the order that you signed the green card. So the, you know, the early bird gets the worm here. What the way that the city begins the case, they present their case. They will stand at this podium.
When your case is called, you'll come to this podium on this side of the room. Once the city is finished presenting their case, you're allowed to ask questions. This is a quasi judicial process. You don't have to ask questions. You can just state why you don't think the city proved their case if that's what your belief is.
The other thing that happens many times in these cases is except for the tree removal cases, which is just one hearing and it's done. Every other type of code enforcement case, it's a two step process. The first step is determining whether or not there's a violation and then setting a time period before the fines begin. So many times an owner will say, okay, I admit that I'm not in compliance right now. And we talk a little bit about the timeframe for bringing into the compliance because the purpose here is to have compliance.
It's not really the purpose is not to punish. So we can talk a little bit about how much time you need to bring the the property into compliance. In just a moment here, the the clerk is gonna ask anyone who's gonna speak. If there's any attorneys in the room, it applies to you also. And then we will start calling the cases in which they're they're they are and yeah.
When you signed up. Also, so typically, city goes first. You the property owner will go. The city gets a chance for rebuttal and then I usually turn to the property owner last. And the only thing I ask is this not to be repetitive to, you know, it says new information or information that the other side has brought up. And now the clerk will swear everyone in.

Alright. The first case we're gonna call is CD case 2502017. The property owner is Eric Moore. The parcel ID is 0986024727. Right there.
And the other thing that I forgot to say and you'll hear the you'll hear the code enforcement officer say this, they'll say their name for the record and they'll acknowledge they've been sworn. I don't see any people coming in, but it's helpful if the first words out of your mouth is your name and that you've been sworn in case we get some late arrivals. And whenever the city is ready, they may begin.
I am Anthony Griehorn, code enforcement inspector for the city of Norport, and I have been sworn. Case number 25Dash02017, initially inspected, 08/08/2325. The case is addressing the violation of a land clear. Two Dash511 NPCC funds and liens. Property has been inspected on multiple occasions, most recently on 01/07/2026.
I have two photos present as evidence. The photos are true and accurate depiction of the property located at 0986024727 parcel ID. I have this picture here. This is the first picture. Also have this picture here. Okay. Shows the land clears inside. No trees.
And then what's the lot size? Usually, it's the you bring up the property appraiser's website to

We spoke with Ryan Arbers. It was determined there was a total land clear. They account for 15,000 for the dollar fine, which we're unable to determine the amount of trees removed on a portion thereof. In this case, it looks like the fine will be for 15,000 could be assessed to account for the unpermitted loss of Canopy.

so there the criteria I just wanna make sure you understand the criteria so perhaps you could ask the right questions or or you can you know, you can address that. So the way the city the way this code is written is that if the number of trees that is can be determined, then there's a formula for assessing the fine essentially based upon the size of the tree. Right? If it's unknown, then there is a presumption and ordinance assesses a fine of $15,000 per 10,000 square feet of lot size. So and typically what we do is the first it's the first anything under 10,000 square feet, it's that number.
And sometimes I've seen it where until it goes over 20,000 square feet, they don't they don't add to that. So that's the criteria that this is all based upon. So based upon knowing that, do you have either questions or just things you wanna say?

Well, I we bought this lot for our future home, our permanent home several years ago. Today was the first day I've been out there in a year and a half. I haven't been there in a year and a half. And I took a couple pictures today to show a couple the the amount of growth. I'm not an arborist. I have no idea how they function and how determine the amount there. But after hurricane Ian, which I bought the lot right before that, after hurricane Ian, we went out there when we could actually get to it, and there were two trees, pretty good size, broken down on my lot. They were busted right in the middle, and one of them was out into the road. So a guy that I know does clearing, he said, hey, man. I'm gonna be working up in that area if you want me to take a look at those.
And I said, yeah. Go ahead. Because at that time, none of the building and plant I lived down Cape Coral. Building and planting was closed down for six months over there. But if the tree was in the road, I'm saying, yeah. Let's at least get that out. I thought I was doing something good to help out. Right? Well, when he got up there, he called me and he said, yeah. There's a couple. There's one on your neighbor's lot that's broke down onto yours, and then there's a couple I I forget exactly. I I think you said two or three. I don't remember. But he said the rest of them are these Brazilian
Peppers.
Peppers. And he goes, those gotta go anyway. You want me to just clear it out? And I said, well, if it's doing the right thing, let's just do it. I had no idea. Obviously, I'm here. I did something wrong,
but Right.
I had no idea. I thought, honestly, I was doing the right thing by clearing it out and get helping the city out a little bit by moving trees out. He said, could put them all to the front of the road for you, and they'll come by and take them over. Thought, well, this being somebody's wave, you're hauling stuff out anyway because he was doing a a couple other houses down the road or a couple other lots. I said, just put me dumped up and take them out. I'll pay it for it. And he gave me this receipt to show what it basically, what it was there, But that's it.
So so, yeah, let me ask let me ask. And I get to ask questions too. So let me ask you a couple of questions. So are there vacant lots on either side? This is a vacant lot. Correct?
It's a vacant lot.
And are there vacant lots on either side or are there
houses

Vacant lot. Okay. Is it your well, let me ask instead of asking a direct so based upon what you instructed this this person to do, this contractor to do, how many trees were removed from the property?
He removed three, but one of them was from the lot next door. And I I took a picture of the lot today because, again, I've been there. The lot my lot's here. The next one's about the same size. But halfway through, if there are no pine trees, The pine trees are on the to the right of it. So it shows the density that approximately you could kinda judge what the density would be on my lot. Now on the lot to the left of it, it's a little more dense, and that's where the tree had fallen onto my lot. And there was another one from his lot that was in the canal too. And the guy said, had had one of those little arm crypt things that he could pull it out with a backhoe, and he did.
And and and these trees that were removed, are they they were the trees that were damaged?
Correct.
Okay. And what's what was the approximate diameter? Were they both pine trees?
They were pines. Yeah. I there's a there's a tree that looked when when I drove by today, there's a tree that I took a picture of that's almost exactly what I had that snapped in half like mine were. And I could show you what that is. That will give you an idea of the dimensions.
Yeah. I mean, unfortunately, unless well, I can if you hand your phone, they can put it on the below the Elmo, and then everyone can see it. And that's kind of the only way it becomes part of the record because this is all being video. Can you put that underneath the Elmo?
That tree right there is exactly two lots away from my property.
Okay. So this is not your property, but you're That's saying what mine looks like. Yes. You know, the two pine trees. Correct. Alright. Okay. Okay. The camera got that. You can hand the phone back to him. Alright. And then I and I so then I forgot. Did did you tell me the approximate diameter of these pine trees?
I'm gonna say six to eight inches. I don't know. Oh, you're talking about the base?
Yeah. Well, at chest height.
I don't know chest height, but at the bulk height, it was about this big around. So that'd be probably halfway up, maybe three quarters away up. I don't know. So I'd assume they'd probably be eight inches, 10 inches. I don't know. Okay.
Do you have this code enforcement have any more questions? I first of all, are you do you have anything else you wanna say? Yeah. I can't afford this one. Alright. Alright. I'm gonna let the city ask questions or present any additional testimony they want to.
The the only question I would have is is

Yes. I I was sworn. Did the individual who actually did the tree clearing, did they take any measurements or anything?
I asked him. He said it was three years ago. He doesn't even remember. Okay.
So the only thing I would say, your honor, is that as the property owner indicated, he's not an arborist. We did have an arborist who would be, you know, considered an expert in this matter go out. So to rely on someone who has an expert opinion regarding the trees, to be able to determine that versus an individual who would not have those qualifications, I think, is something you need to take into consideration. They went out. They made these determinations.
They're able to make a determination versus hurricane damage versus clearing size, and that is how they came up with these reports, the fines based on the code. Property owners are impugned with knowing what our code and our laws are. So I would ask that you take that in consideration for your ruling.
I hear what you're saying, but this does not look like some complete clears that we see come come before me. So

Yeah. But I'm talking about when I've seen the photographs, that doesn't look to me like a complete lot clearer, I guess. So can you put the photos back up again? Sure. And also He did take all those pepper trees out. Yeah. Okay. So so

November trees count because yeah. I know they're invasive. So are they not considered a tree for tree removal purposes?
Morning, guys. It's Trevor Burducci. I'm the manager for this code enforcement division for the City of Northport. So the process would have been, if in fact, if you want to do a brush clear or they some typically call it an understory, you still come in and get a permit for that. Right.
Before that's issued, the arborist goes out to survey the property to explain that they don't take any trees down. When when that's completed, the arborist goes back out to make sure that that didn't occur. The whole history of the tree code, the revised tree code, is to prevent a clearing of any kind before the city has eyes on it. There's absolutely no way the city can have eyes on all these lots, hundreds of lots beforehand. We rely on the property owner to do the right thing. And I'm not saying that you did the wrong thing intentionally, but that's not frankly, doesn't really happen.
It's your normal process
with the judge. This is
a little bit different because of the hurricane, though. You know? Correct.
But I'll speak about that, too.
Okay. I can also tell them. So if this was an improved lot, there was a period of time when there was an emergency ordinance that was passed that allowed people to remove damaged trees and take damaged trees down. Unfortunately, that did not apply to unimproved lots. It only applied to improved lots. But go ahead. I'm sorry.
Yes. You're right. And again, because there's a great amount of time between when whichever hurricane I'm assuming you're saying it's Ian. Ian. Well, I don't know whether that's four years ago. And when did you discover this? Or how did you discover this?
You know? This is in I think it was in August. August. August. That took started.
Okay. Was just discovered in the middle of last year, '20 '5 in August. Obviously, a large amount of time has passed.
So so, again, let me kind of let me ask that question my last question a little bit different. And I'm just going to give a hypothetical here. Let's say you have a vacant lot. The only trees that are on the vacant lot are Brazilian pepper trees. Are you saying that you don't have to get a tree removal permit that you have to get a brush clearing permit to remove Brazilian pepper?
That's correct. If you intend to remove them with machinery. If you're going go out there with hand tools, you don't need any kind of permit at all. But if you're going to use machinery, you file for the permit. The arborist goes out before the permit is issued, checks the lot, make sure that what's there is what they're saying is there and what they're going to remove, meaning the property owner. Then the arborist goes back out for a final inspection after the work is completed to make sure no other work was done except for the work, the scope of work in that underbrush permit, which would be no trees.
But the failure to obtain a brush clearing permit, that's a different code section, isn't it, than the treaty?
It is. We're not what I'm my point I'm trying to make is, the gentleman said that he had a contractor removed the extra understory, the underbrush. Correct?
He removed the what do you call the pepper tree thing.
So it sort of proves the point that it's a complete land clear because we have no way of determining. If we had went out there even when you were gonna have the guy do the brush clear, if those other trees were there, they would have been the arborist would have been able to determine if they were in fact cut down or blown down or broken half as a result of anything other than some sort of man made occurrence. Absent of that, we're going by what it's what is in the code that is undetermined. Correct? Correct. Completely, what whatever was there isn't there now. We have no way of knowing, so we start at the top of the fine, which is $15,000.
But the but the I mean, the photos,
there's still trees on this lot. Right? I mean, that's what the photos show. Right?
We we just pulled up the damage. So, obviously, I get I
get there's a distinction between number of trees removed is undetermined versus a complete lot there.
Which is what the code says, which is what we have to prove, which is what we prove.
That's right. I guess, yeah, I'm not I don't find it as complete law clear. I mean, the number of trees removed may be undetermined. But of course, the property owner is giving some testimony about that too. So, alright. Anything else? And and let me ask one more question. So there's not a separate violation for the brush clear without a permit in in this case? There is? There is. Okay.
That's correct.
That's that's all part of 2Dash5511? Well,
you if you want a brush clear only, you come in and you file the permit. 105. The permit. Again, we go out and check.
But what's the what's the code section?
It's 105.1.
But then we would be ignoring the trees that were cut down, which was even testified to by the property owner.
And once again And what's the fine for an illegal brush clear?
Usually, what we'll have them do is pay is get the brush clear because no trees were taken down. And sometimes, depending on how severe it was, they'll double fee them or maybe even triple fee them for that. That's that's determined by the arborist, the natural resources division.
So that's like an after the fact permit, and then they okay. I see. Alright. Alright.
What we're stating today is we cannot determine
it
it may have been two trees. It may have been 20 trees. Four years ago, today, we can't determine what that number is. That's why we're where we are today. And I think I mean, I don't know if he's I think we've proved our case in the sense that we can't determine how many trees have been taken.
Can you determine off the satellite imaging from before?
Well, and again, I don't dispute that you've put on a prima facie case and you put in evidence that proves that prima facie case. But there's a person over here that's also testifying that I have to listen to. He's the property owner and he has some actual knowledge. Again, I understand he's not an arborist. He's not but but he contracted with somebody. And so, I mean, I have to take that into account also. Anything else the city wants to say, then I'll I'll give property owner
One other thing I'd like to say is because we didn't get a chance to look at it beforehand, we don't know even if it was two trees. That's just hypothetical. We don't know what if they're heritage trees or champion trees. That would determine the amount of the permit based on the the circumference of the trunk of the tree as what the the permit fee would be. It's a $100 an inch.
But he gave some testimony that they were two
pine trees.
They were absolutely pine trees.
Right. And they were and he and, again, he didn't give testimony as to what their diameter was at breast height, but but he gave some testimony of what they what the diameter was where they broke. Alright. Anything else?

I'm gonna give you the last

Yeah. I do the same thing.
I would've this would've been a $15,000 fine. But based upon the testimony of the property owner, I'm gonna make a determination that there were two trees that were removed here. And, again, the city has the option of going and, you know, making him do an after the fact brush clearing, you know, permit and assessing whatever fee for that is. But again, based upon the testimony of of the property owner that's and, again, he didn't give the diameter. He said about eight inches where they broke, and he showed where they broke.
I'm gonna make a determination that at breast height, those two trees were 12 inches. And two trees tree. 12 inches is not worth it. Is $2,400. Shoot.

Okay. Okay. There we go. Good morning. I'm Josh Preston, code enforcement inspector for the city of Northport, and I have been sworn. Case number 25Dash02527 was initially inspected on 08/14/2025. The case is addressing the violation in Northport city code 42 dash 23 accumulation of debris, which consisted of boxes, drip tarps, and pallets placed in the driveway. The property has been inspected on multiple occasions, most recently on 01/16/2026. I have had contact with the property owner prior to today. I have two photographs present as evidence.
The photos are true and accurate depiction of the property located at 1512 Helfaston Street here in Northport. This is a continued case from last month, your honor. The property owner met me the morning of the hearing on the December 22 and asked for a continuance. And she told me that she would have the work done, have this re removed prior to today. However, as of the sixteenth, nothing has been touched. So I would ask to move forward with this case.

Okay. I have been working on on the property. It has been touched. The items that were there, my property started from Ian, and I had a trailer that was on the property and that had the items that are in front of the house in the trailer. And a previous ordinance you put into effect, I believe, was the Monday before Ian was hit that you couldn't park in the fifteen feet in front of your property, that, that was now the town ordinance.
So they told me I had to remove the trailer from that spot because I had moved the trailer. I had tree damage also, and I had to move the trailer off of my second lot. And I had put it out onto the right of way, so I had to get that removed. I then proceeded to go through about getting the trailer removed. Josh worked with me with the with that.
We tried to get rid of that as quickly as possible. Unfortunately, I had items in the trailer, which then brings me to this case in front. In between Ian and last year, I have had five surgeries. So I had knee surgery on my left knee, my right knee, my left hip, my right hip, and each one required three months of recoup time. I'm also limited with what I can carry and cannot carry and lift and cannot lift.
I've bought mechanical things to move, to slide underneath as many items as I can to move them and hang carts to move as much as I can. And I just purchased some of those rolling stools to sit on to be able to move and sit. I've been cutting up boxes and removing stuff from boxes and relocating as much as I can. Unfortunately, when the temperatures are below 70, my hands go arthritic and I cannot work and I cannot stand for longer periods of time because of the hip replacements. I'm trying my best.
Josh has worked with me for a continuance to allow me additional time. I will continue to work and continue to get rid of it. Believe me, I do not want to have this in my lot. I can't park my vehicles. I have to work around that. So I'm doing as much as I can.

As I said, yeah. The final will not begin immediately. So so I am gonna find that there is a violation of of chapter 42 dash 23 of Norport City Code for this debris that's in the front of the house. But you're going to have some time. You're going to have twenty five days to get it done. And so a fine of $10 a day with a maximum of $1,000 will commence on 02/17/2026. It's not brought into compliance by 02/16/2026. If you get this, stay in contact with Josh. You get this in compliance. Call him out.
You don't have to come back at the next hearing, which is the hearing that actually imposes, you
know, the fine. So what what date is this fine fine start? Because him and I just talked this morning, and he's

me also just talk a little bit about where, you know, where we're at here. So this is the second hearing. So I've already made a determination that there was a violation of these these ordinances and I've set a time frame in which to for the fines to assess. So unless there the property owner has an issue regarding improper notice I'm not really here to revisit the merits of the of of the violation because that's already been determined. Okay.
Does does she understand that?
So, your honor, she's saying all the responsibility of taking care of this property has fallen upon her shoulders as the husband that has no part in it and does not he took it upon himself to fix this house and tend to this property, and he's been very ignorant to not do anything about it. This is not a new case, and, this address is also not a new case in this court due to his, hoarding habits and his way of lifestyle. And she's just having hardship tending to this property all by herself, having to work and as well as try to take care of this
property. Well, I okay. This is it true that this property has no roof?
Correct. Yeah. We we bought all the materials for the roof, the trusses, and the husband took the material somewhere that we do not know of. He has held all the permits and claimed he will do all the repairs for it, and we currently do not know his whereabouts nor his plan to fix this property. They are going through a divorce due to the reason that we cannot rely on him to get anything done and it is dragging her down along with it.
So she's not sure where we can go
from here. So for there to be proper service on this case, the notice of violation needed to be mailed to the address that's on the property appraiser's property report card and and then it also has to be posted on the property. So at this point, that's all I'm really interested in listening to because as I said, we're not going to go backwards and and talk about the violations. That that's already happened. So, again, is there anything regarding the notice that she is complaining about?

I thought I did a pretty good job of describing what the notice requirement is, but they're asking, I think for city staff to say, because what as you understand what my position is, I'm not going to rehear this case unless she's saying, you know, notice was improper. It would be considerably less. However, as the city attorney stated, we're willing we're ready to move forward today. They can still do all that, but as of today, the city is recommending that the property is found in violation. Violation.

So she is stating that they do have permits for the house to get done. So that's all she wanted to state in this case. I explained I explained to her that that doesn't change what needs to be done or what her options are for this case. That's just something she wanted stated.

pull my trying window permit, which they told me they would let the Connex box slide as a construction temporary thing because all my drywall has to be replaced in the house. City trees fell on my house. They were asked to remove those trees. Act of God finished that job off not once but twice from Hurricane Ian and Hurricane Milton on October 9. The second tree went through my roof to where I've been spending thousands of dollars.
My biggest mistake was moving to the city of Northport. And in order to get my window permit, which I already had my inspection from the My Safe Florida home to put hurricane windows in my house, it is a requirement and no red tape that I have to have insurance on my house. I cannot get insurance until the city removes the three standing trees that are dead from the bark beetle, which Brian Pippen has been out there saying the trees are dead.
That's not what this case is about, though.
It's regarding the connex box. I can't get a permit on the window permit to to make this connex box go bye bye until they get these trees removed. They want me to jump circles and hoops. It's taken them three over three years to remove these trees. I have pictures of them removing a tree on 05/02/2025, but they didn't finish off finish the job doing the job.
How long have the Konex box has been there?
The Konex box has been there since I bought the property, the lot where I did a kill and combined 05/02/2025.

And I've spoken to all these people to where they said, yes, you can pull a window permit, which I have a permit sitting there to do the permit. My guy showed up yesterday for finalized measurements on the windows, which all my window measurements are here for the windows. And the next step is, if I don't have insurance on the house, which my insurance is supposed to take effect February, they're going to cancel me again because USAA has already canceled my insurance on this house because they failed to remove the trees. The city has neglected to do their job and they want me to jump in.
I've heard all this. But my question, so what's the what date does the city have for when the context boxes first appeared on the Your honor,

It's just, your honor, this this is a very simple situation. Mister Spellman put these connex boxes on his property without a permit, and that is why he is in the situation he is in. He has decided to do all this work on his own, owner builder, so all the struggles he is going through No, ma'am. While, unfortunately, is a situation that he has caused. The window permit being rolled up into the Konex box is a courtesy that our building official extended to him to try to help alleviate some of the problems he is going through.
That is not something everybody has extended. So the bottom line of this is that the city only has to prove he had put the CONEX boxes on without a permit, which we have proven over and over again. That is the only situation that we have here. This has been going on for an extended period of time. It began in July 2025. All of these other things about the insurance, everything else that's going on is entirely irrelevant to the fact that he put these items on his property without a permit.
I beg to differ with the insurance because I had insurance four months prior to hurricane Ian in 2023. And the city was notified that these trees, my insurance was canceling my insurance on the house because they posed a potential fire risk to my house and a and a hazard. Okay? And they did. They fell on my house causing skylights into my house to where
I had
to get it.
I'm a simple person.
And a reasonable person, I would think. The only
thing that so what what I'm trying to get clarification from and the really about the only thing I wanna hear from the city right now is, is there any condition under which someone that has an ongoing, I mean, I don't know if he has an active permit or not to do construction can have temporary storage device, you know, things on their property? And if so, what is there's gotta be some limit under the code for that. What and what is it?
Your honor, before I can solve this by sort of answering that question in a roundabout way. Yeah. As miss Kimberly had stated, the courtesy was, for whatever reason, mister Spelling was having difficulty getting the permit for the on its boxes. Primarily, probably because they have to be at on a certain place in the property. They have that they have conditions that we tied down, that they look aesthetic, things of that nature. For whatever reason, from my opinion, that would have been the simplest thing to to obtain, but he's not able to do that. Okay.

for him. And and I moved the it's not like I haven't been doing anything. It cost me some kind of social security income.

He said he had no place to store the windows. The reasonable accommodation was we'll let you if you get the window permit, we'll let you store materials, albeit windows, drywall, whatever all that entails, in the CONEX box. In lieu of getting the permit for the CONEX box, provided that you get the permit for the windows. Right. That still has not occurred today, and I can explain why because mister Spelman is in is deficient in the paperwork to obtain the permit. Okay. And that is something he has to do, not the city can do. That's a straight Everybody has tried to help him. We understand there's a problem here. However, it has gone on for a very long since July, did you say? Yes. July. Yeah. Well, his testimony
is it's been there since May.

So So the other accommodations have been our staff. And again, they could be there temporary as long as this permit gets issued. So $550 a day with a maximum of $5,000 will commence on 02/17/2026, if not brought into compliance by 02/16/2026.
Also, I don't mean to cut you off, but Mr. Hoffman just informed me that he's fast tracking the revisions for the permit for the windows. It may get in before that date you just mentioned. If that's the case and it gets approved, none of this will matter in terms of any funds. We're trying to get you going here.
