Okay, public hearing open. One extension, alternative expenditures limitation home rule. Is there anybody in the audience that would like to speak on this behalf? Being that there's no one, any council wants to say any comments? We go to number four. Yes, Mr. Doyle, did you have something?

I just, Mayor, that I think that the city should do legally its best part to support the home rule and and get it out there to the general public so they'll know how important it is for the city and for them thank you thank you sir anybody else thank you we move to item number four resolution one consideration possible action of resolution number r

2026-07-008 a resolution the council of the city of nongales arizona pursuant to article 9 section 20 Subsection 9 of the Arizona Constitution ordering and calling an election to propose an extension of the Alternative Expenditure Limitation on the November 3rd, 2026 general election ballot direction publication and notice as required by law setting forth the informational pamphlet requirements including the filling deadline and cause of arguments and establishing the conduct of elections. Setting forth the voter's registration deadline and early voting, providing for Voter's Rights Act translation requirements, designating the election format. Setting forth the Canvas deadline and post-election notification requirements and including the sorority clause. Any other comments? All in favor? Aye. All opposed? Motion passes. Now I close the public hearing and we move on to orders. Item number five, orders. One, consider and possible action of orders number 2026-07-039, an order of the Mayor and Council of the City of Nogales, Arizona, approving Intergovernmental Agreement 26-001753-I between the City of Nogales and State of Arizona, acting through the Arizona Department of Transportation, for procurement of one 2,000 gallon water truck. Any discussion? Go ahead, ma'am.

I just have a question for our city manager. Looking at the documents here, it looks like everything, the contracts and all the procurement information is going to Judy Gerardo, From Public Works. Is she in charge of this as far as like looking at the contracts and that?

At this moment, I'll clarify the process. I'll look into it and clarify the process to make sure that it's going to the right person. And it's basically these two items are cleanup items. You previously approved them. All you're doing is adding the IGAs, but I will look into that aspect gladly.

Eric Stewart, Public Works. Mr. Mayor and Council, no, thank you, City Manager. I was just going to basically support what the City Manager is saying. This is an old document ADOT's trying to get us to approve so they can go ahead and process the payment and so forth so that it can be reversed. Thank you.

Oh, so we're going to be reimbursed.

We budgeted to purchase these and we'll be reimbursed.

I think we pay a 6% match on this grant.

So this is just a formality with ADOT. And they're working with an older document, I think, that started about a year ago. So that's why we have other names on the document.

Item number two, consideration possible action of order number 2026-07-040, an order of the Mayor and Council of the City of Nogales, Arizona, approving intergovernment agreement number 26-0011754-I between the City of Nogales and the State of Arizona, acting by acting by and through the Arizona Department of Transportation for a procurement of one 2026 Elgin Broom Bear Street sweeper. Second, Ms. Montiel. Go ahead. Anybody have any questions? Ms. Barra, did you have a question? Okay. With that said, same thing as this. This is an item that we already passed, but- That is correct. Corrected some details. All in favor? Aye. All opposed? Motion passes. Okay, on item number six, by the applicant and the council, I move to remove this item from the agenda.

Mayor, for clarification, the item is being pulled at the request of the applicant and staff. We are in full agreement. There's no daylight between us. And we're engaging in boundary clarification before we move further on pulling it, not tabling it. So we want to make sure we're ready before we come back.

Okay. No need to vote on this. Anything else? Before I adjourn, I want to make it official. This Wednesday, we have the league tournament starting, parades at 3 o'clock. At noon, we'll be at Chitipinos with meet and greet teams and umpires. You're all welcome to join us. Opening ceremony is at 4 o'clock at Pleasure Field.
