Now we have remembrances and acknowledgments. I would like to start off by congratulating H&I for a huge Strawberry Social. I think it was the best one yet. And I don't know if everyone realizes that the profit from the Strawberry Social goes back to the town by ways of beautification, landscaping, planters, hanging baskets, mulch. it all goes back to the town of Newburgh. So that is earmarked for the town every year. And that's something that is ongoing. So thank you for a fantastic Strawberry Social. Okay, Andrea?

Yes, so Engineer Legal has reviewed the six quotes received from the June 3rd quote opening. Koberstein Contracting was found to be the low responsible bidder in the amount of $91,845.06. This amount is below the engineer's estimate of $96,850. Engineer recommends town accepts engineer's bid recommendation.

So this is the owner and contractor agreement. So, Coborstein Contractor has provided and met the insurance requirements associated with the project. Town intends to finance the project with the $10,000 from IDOH tactical urbanism grant and using remaining 2014 sidewalk bond funds as approved through the finance committee. The engineer recommends town execute the construction contract with Koberstein contract to authorize the work. This also gives them the notice to proceed.

How soon can they start?

Well, the notice to proceed will be today. They'll have to order some materials, but the goal is to complete the work before school starts back up.

Yes. So in your guys' packet, you have a road closure request for this is 18 East Jennings Street. They're going to do some tree work. and they're asking that that intersection of French Island and Jennings be closed for about a half day for that work. They have not given us a date yet. They know it's probably gonna be the week of June 22nd, but they just wanted to get permission first, and then they would let us know when they can schedule and get a date in.

All right. As long as it's done before the fireworks. I need a motion for the approval of the Jennings Street road closure for tree work.

Just so you all know, I've been working with Susan in the sewer office and Reynolds towards an escrow agreement on the retainers. They're allowed under statute to ask for a separate escrow account with a bank as opposed to the sewer department holding it. but the lender they chose couldn't do it wouldn't do it the way that it needs to be done in a three-way agreement so we're working to find it then they're working to find another lender but that we're going to hold just so you know in case you get asked about it they're going to hold the retaining agent to sewer department until that agreement's in place then it'll go to a bank to be held pursuant to an escrow agreement okay it's just in process yes good any questions on that

All right, going on to Kenwood Court Ditch Repair. I need a motion for the approval. Oh, you want to talk about it first?

Kenwood Court. Manhole Ditch Repair. So this is a... This is a Newberg Sewer Department project out in Kenwood Court, which is in South Broadview.

And so this one is a permit only. There's no sewer agreement, so the permit is in your packet, but it's ready for approval.

Okay, and that's for the ditch repair?

Yeah, and there's a... Manhole repair, it's in an eroded ditch, so we're going to do some ditch repair. We're working with the county on shared funding, but right now we're just getting the construction permit going and then we'll get the rest of it together.

So you have two items on your agenda, number 10 and number 11. Number 10 is the sanitary sewer agreement, and number 11 is the construction permit. We'll take them separately, but I can describe them together. Okay. This is a project. Durham at Berkshire is a Macon, LLC, Danny Eubelore project. This is, it's a fairly standard sewer agreement. The plans have been approved. The item packet's been reviewed and we've prepared a sewer agreement and a construction permit for the project.

We might have had a couple waivers, if I recall, from senior utility committee that was going around the cul-de-sacs. Okay, I couldn't remember if it was that one or not.

There's nothing special in this agreement. You know, it's pretty standard. They didn't ask for recoupment. So it just provides for, you know, construction. The Senate permit just lists the pipe and the manholes that they're going to install. Yeah, I didn't think there was any recoupment on it.

That's what I was concerned about.

You have my report in front of you. As I scan through it, I just want to highlight a couple things. First, I want to thank everybody that was a part of the groundbreaking today before I get into my report. Commonwealth, our staff, our contractor, they've done a great job. We had a good event out there and a lot of publicity will come from it. A lot of the media was there, so watch the TV tonight and it's a good project for the community. But in my report under personnel, I just want to highlight item number three. Russell and I have kind of narrowed down our search for that temporary staffing contract. And we're going to work with legal and hopefully get something before you at the upcoming meeting. And that's something that came from personnel recently. Under the next line item, you get under item number eight under residents. Juliana, we kind of, I don't know if I want to defer to Drew a little bit, but we've got the line connected and we're waiting for stuff to settle and some geotechnical work assessments to come through. So you haven't really heard much the past few days because it's kind of settling in The line has been repaired, but once we get some of our study work completed, we should be able to shift gears and get into restoration of the yard, the driveway, the mailbox. Anything else? I mean, I know we've got a lot of stuff going on out there. Do you have anything to add?

I think the main thing is that the pipe is connected. A brand new pipe from point A to point B, so that is a huge step in the right direction. It was very challenging. The contractor did a a great job in dealing with those challenges and issues. So I want to applaud them for their efforts. They connected it on Friday afternoon, came back and backfilled it. They're very communicative with all the residents out there. So now it'll just be like Chris said, just working with the residents, getting restoration work complete.

We were in communication with some of the residents. Saturday morning, the route that the backfill trucks were taking, there was some feedback on, and the contractor's been very responsive in addressing some of those issues. I would like to go on the record on that.

I heard he's been very forthcoming with all of the residents.

Oh, yeah.

And that's great.

And then I actually talked to the main gentleman Friday or Saturday at the community day for the bank. He's also a reserve sheriff's deputy, and he got to meet my dog. So we were talking dogs out there about a week before around Memorial Day, and then he actually got to meet one of my oldest dogs. He seems very pleased. I mean, he's not happy with the situation, but he's happy with our response.

So continuing on under miscellaneous, I'll stop at item five. We're working with Morton to have a little bit of a ribbon-cutting dedication media event this Friday at 2 o'clock. We'll do that at Town Hall. And we'll send out some information about our completed solar projects. And there should be some information by Friday afternoon to where you'll be able to go online and see what the different apparatuses are producing. So we will have that available on the town site in time for that event. Item six, the boat dock has been inspected. They haven't been able to clear the lower plaza yet because we've had too much rain, but everything passed with flying colors. I wouldn't want to push it further than we did. The only damage that was sustained is in the cleanup part, we broke a cable and that was with our backhoe kind of clipping one of the, And that's a cable that you can buy at a hardware store. So I mean, nothing happened to it from the actual flood event. The extra design anchor system that we had can take that. There is some additional, the debris boom needs to be emptied out further. But they're going to work on that when they clear the plaza. And they're hoping to get that done in time for the uh ohio river sweep that's friday but we'll see it depends on what mother nature throws at us the next couple days on that so the boat dock performed the way it was supposed to yes yes as designed You don't want to have a new car and put it at the red line within three months, but we went up to the red line. We did. I wouldn't have been, we were within a foot of probably with the max. We wouldn't want to push that. Okay. So going forward, we're gonna pull it a little bit, we're gonna be more conservative with it. The biggest complaint and the biggest user of that dock is the fishermen. There's still some recreational folks, but the fishermen's who we hear from, and some of the fishermen had reached out for Memorial Day weekend that still go out when the water level is what it is, or was. So we've got some conditions in place to where hopefully that won't get to that scenario again. But when your river drops or jumps 10 foot overnight, it's not like they give you a warning alarm when they update that forecast.

No, that's true.

We're working through that. Then item number eight. I'm going to attend the Main Street Organization event coming up in Indianapolis on the 16th of July to learn more from OCRA about Main Street Organizations. And then on item 11, we will have the federal BRIC grant application for Ellerbush Road in late next week. It's due the 19th, but we'll be reviewing it this week. We might actually submit it before that date.

How long will it take for us to get notification of that or when they're going to award it?

Good question. That's a good, yeah. They didn't really say. I would assume before the end of the year. But I was surprised that we heard back from them as quickly as we did when we did the pre-application certification. So I think they want to get this money out the door into the shovel ready project. So I would say hopefully before the end of the year.

So then you've got item number 13, which is the art support grant, the mural. The mural's almost done. We're going to work on some lighting. And we'll stay tuned for like a dedication day once we get the lighting up. And we're getting a lot of public positive feedback. I think the changes that were done to the design have made everybody kind of get on board and behind this. we'll try to get a date you know quickly after it's uh completed to do a not necessarily a ribbon cutting but a media event dedication and recognize our partners with orange moon for the work they put in out there the other day i saw um two families actually

eating lunch underneath the patio, the structure, and they were all taking selfies with the Newburgh sign.

And that's the goal. I think it's going to engage that area of that park more so than it usually would get just with the picnic tables and i think that's kind of the goal but we've got to get the lighting solution just right and get that in there to where it can be seen at night and there's actually a a database of public art in the evansville region that we're going to once it's completed we'll get that added to that list as well as some other stuff in in warwick county to make sure that's updated

Item 14, Friday, as a part of the MPO, we're going to host a regional mobility committee meeting in this room. There's different partners from the MPO that participate in that, but I just want to draw your attention. There'll be about 40 folks in this room for that meeting. And then item 15 has presented itself. I've been working with Bob Cleveland, who is with the Sons of the American Revolution. and Ann as well on the American Elm Liberty Tree Program. It's a goal of planting 250 elm trees based on the original Liberty Tree out of Boston by July 4th, 2026. And I put the website on there for additional information. I have a call in to an arborist to kind of make a recommendation. I'm not personally as familiar with the Elm, but they would like to put it somewhere in the Lock and Dam Park. So I want to get some information from the arborist. And then I was hoping for, I didn't know if I needed a formal motion to start working on this. But once we have an idea from the arborist with the tree canopy where the best place or two would be, we would call in locates from 811 and ensure that there's no facilities in the area. But we would try to then work with the sons on a time to plant it. The only thing about planting a tree this time of year, this is a mature tree. It's already several feet tall. It's not ideal. Ideally, you want to do it between November and March. That way you don't have to water. So we'll just have to water every day to kind of keep it going. But I guess I ask your approval to kind of move forward with that and give them a location somewhere in that part.

I can't remember what we did. Each and I put a tree in the park and I can't remember if it was a formal motion.

It's probably better to have a record of it.

I don't have the actual location yet. If they're wanted in by the fourth, I can't go to the parks board. But I'm going to keep them in the loop once I have the details.

um i think having i think having an arborist chime in on the best place to put it and knowing you know how we use the part and stuff i kind of think we have all that information making that a formal decision i think hopefully i don't think it would go in before the next council meeting is what i'm getting at but i just need to it doesn't need a formal motion but i just need to be okay to kind of move forward with this does anyone have a problem with uh to continue looking into it or do you want a motion

Aye. Aye. Now, the big question is where? And Chris and I have talked about that. I am not opposed, and there have been people on the council in the past who were extremely opposed, and that's why we don't have any trees on the south side of the park at the old Ockendamp I am not opposed to planting a tree there. I'm not either using the consideration that the kinds of events that are held there and where it's placed so that it doesn't have to be cut down in five years because we didn't plan well. Um, but also we've lost trees at the bottom of the steps next to the gazebo. There were several large trees there that had been there for more than a hundred years. And at the top of the hill, we also lost several big trees up by the houses, the lockmaster houses. So those were my three suggestions for places where this tree and other gift trees could go.

And I think that's one of the things, like hopefully if Chris gets with that arborist, give him those three suggestions, which one you think would work best. I know there has always been pushback on that south side of Lock and Van Park, and I think a lot of it comes to flooding, and if it does get to that high water level, is that bad for the trees, right?

Yeah, that's why I wanted to initiate an arborist, because in my experience with planting in the river area, you have to also do like a stormwater, You have to check the soil from time to time because of the river flooding. And certain species aren't very hardy when it comes to the flood. And I don't know much about the elm tree as I do others. And I just want to make sure, since this is a gift and it's significant and it's a descendant of the original Liberty tree in Boston, I want to make sure we put it in the right spot where it will be here for 100 years.

so yeah so if chris got the motion to move forward i think then we'll give you guys an idea roughly where the arbor stinks and then we can go from there i think all right and then the only other thing under item 16 then on item 16 there was an attachment that i put in

from the economic development group that was kind of informative about some of the tax rates for the various counties in Indiana. And it kind of shows you where Warwick County lies on that list. So I just wanted to draw your attention to that in the packet.

um if you guys have my packet um i apologize i'm getting it too late but friday was a bit crazy which i want to say a huge thank you to everyone that came out to the five-year anniversary for the splash pad i know ann stopped by i think she tried to talk to me and i was running around the chicken with my head cut off but we planned on it going from opening to close we had to shut it down by two o'clock we went through 400 donuts i don't know how many cookies i think i ordered five or 600 lays. I mean, we just, we went through all of it so quickly, which was great to see. And lots of kids came up and said, thank you. And, um, I know a lot of parents appreciate it. So, um, huge thank you to everyone that came out for that. Um, just so you guys know, next week we are closed on Friday for Juneteenth. So town hall will be closed. Um, this Friday is the river sweep, um, from 7 00 AM to 12 PM. So if you want to come out and help clean up the river stuff on by, um, And then also in your packet, I have a special event form that is coming from the Isaiah 117 house. They're wanting to do a lemonade stand at the Iran Trailhead. This went to Parks Board at the last Parks Board meeting, I think last week. They made a positive recommendation for council to approve it. So I'm asking for your guys' approval. I think they'll have the lemonade stand there from 10 a.m. to 11.30. They're gonna have a small table, nothing big. They don't need anything blocked off or anything like that. So just a request to you for them to be in that park with their lemonade stand. All right.

I think it'd be interesting to follow that lemonade stand with similar things during the summer. We'll find other organizations. But setting a precedent, I don't know what we want to do about that. That would be interesting. It just struck me as being a really fun idea for a group that even just maybe aren't trying to sell anything, but they're just wanting to get their name out. that we might have a few hours on a Saturday morning where a group could set up.

Yeah, yeah, we can definitely reach out. I think we know a couple organizations that would probably want to be out there.

I know that some of the rescue groups have expressed an interest to have, like, a couple rescue animals that are adoptable at the trailhead on a Saturday. I can circle back.

Yeah, we'll look into that. Oh, and then one other thing I forgot, I have it on here. I did hear back from the playground contractor today if everything goes the way it's supposed to go and weather plays a part, we're looking at second week of July for that playground to be open.

That's excellent. That is second weekend in July or a second week in July.

I know I'm so excited. So, um, sidewalks are going in today. Then after that is turf and after turf is fence. So yes, as long as the weather holds up, we're going to do that. And then, so we'll work on probably a grand opening.

um i know chad's park is working on one too so we want to make sure that we don't conflict with ohio township so we'll we'll coordinate with them now we still have the heavy trash pickup the 19th yeah yes that's next friday right next yes the yard sales this weekend well the museum starts thursday and then the town is friday and saturday and then we're gonna uh we're working with the museum and our partners at goodwill to make a truck available. I think they're going to be at the museum Saturday afternoon. If people have stuff they don't want to sell, we're going to do a post and get some information out about that. But Goodwill hadn't posted it yet. They should be posting it in the next day or so and then we'll kind of fall behind them in the museum and get the word out.

Yes, I just have one request. A while back when we submitted the application for the rebate for the solar panels, we had to incorporate the services of a CPA, we talked about that, Harding, Schmansky & Company, and we had a motion on the table that the bill was not to exceed $1,200. Well, we did get the bill and it exceeds $1,200. So I need a request for a motion for $1,550 additional to cover the expense of this. And let me tell you, this was not an easy task. When we got the paperwork back from the CPA, it was 32 pages long. And we tried to submit it electronically, and we could not because we're a municipality and we've never filed, we are not flagged to be able to file a 990-T, which is what the application is. So we had to actually do a hard copy of it. But this took a while to figure out. And Pat did a fantastic job on this, so we want to make sure we get them paid for their services.

So not much to report. Our basic numbers were 165 calls for the year. We've got six new members joining tonight on top of the five last month and the two that puts us up to about 15. So are these cadets or are they? These are people who are willing to volunteer to firefight. Oh, excellent. Yeah, we've got... The numbers are kind of getting up there right now. I had to tell everybody, we've got to pick a step up now. We've got to make sure we're getting all that into the proper training and everything. We're actually starting the Firefighter Academy next Monday, which will go for about seven months that we're doing here at New York. So that's awesome that we are getting so much. you know with an interest in wanting to do it i know there's there's been a lot of social media publicity and stuff uh negative positive all around but all our seem to maintain positive and it's bringing us numbers so good um talking with our pr guy i'm going to actually kind of ask him to help some of these other volunteer departments in our county So we can try to boost their numbers as well. The other cadets, there's still eight, and there's actually, next year, after the completion of this school year, five of them will hopefully want to step up and be a cadet for the fire department. Excellent. So other than that, last meeting, you guys approved the requested funds for lower. I appreciate that, bringing that to you guys. I received that information that you guys approved it in the next category. so we're looking at uh august delivery date so uh bigger a little bit bigger than what we had provided by the township but it's definitely feasible for what we need and a starting chief mentioned prior to the meeting and we've had several river responses already this year so a little bit overdue but i take the fault of that for kind of putting it on delay but we will be able to get back on there and get the presence out on the river i know you've We've been following the Ann Arbor County Sheriff's Department and some departments in Edmondsville have gotten watercrafts out there and are providing services, so we'll be able to do the same thing right out on our front doorstep. So we do look excited for that, and I'll keep you guys updated as I get information.

Yeah, the Parks Board met last Thursday evening. I was participatory over the telephone. It was a long meeting and it centered around an issue that most of us are familiar with now. Optimal Access has an ARC installation that they are going to be required to move from their a residential parcel and they're looking for a home for that installation. I thought there was a very amazing problem solving conversation about this. The Parks Board did not make a recommendation, but there was many suggestions made on how that business can partner with the town and perhaps work something out for this piece of artwork. I just want to hats off to the people. I wasn't in the room. I could just hear it all, but really a good, good attempt to try to work with a business that we all respect, their mission, and while at the same time not opening Pandora's box to commercial signage in places it shouldn't be. So that was the main thing.

So their proposal was still near the trail, not near the highway?

There's no proposal at this point. They're reviewing options. There was a number of things said, but I think the way it was left, if I heard the discussion right, and Andrew, you were in the room, so you can correct me, but if there was a way for them to become a sponsor for, for instance, one of the parks, like at Lou Dennis or wherever, where this can be mutually agreed upon, then that opens the door for signage, because we put signs when people sponsor things in certain places. Is that fair to say?

Yeah. So the original proposal was to put it essentially in the Iran Trailhead as close as possible to kind of the trail where it was, right? You know, on our property, but almost a new crossover Yorkshire, right? And I think parks boards back and forth, right, on are you setting a precedent if you're just letting, you know, nonprofits put signs up, right? And I went through where, you know, they got awarded it as an art piece, our ordinance states it's a sign right so then just back and forth so one of the things that we would like to see in the park and that they brought up are these things called communication boards they're for autistic children or children who are non-verbal and you have them up in their pictures right and it can show just tired or show more or show thirsty or whatever. And so it's ways that kids can point and choose and to communicate right with somebody. So discussions where optimal rhythms would love to see these in some more of our parks. We would like to see them in the parks. And can we do something where we collaborate with them, where we get these communication boards, they're a sponsor of that and their art piece can be part of that communication board as well. So those are works. I mean, it was a lot of, I mean, it really, it was a long meeting, but it was a lot of good back and forth on, trying to work with, especially a business in town, a community that services the most people in need. So it was a good conversation. I think Marianne and the rest of Parks Board are really going to try to think about things like that. Casey, her name's Casey? Yeah, Casey, she's going to work with them as well. So we'll hopefully have a suggestion or a conclusion at some point.

any questions for paul and i should ask was that all paul uh that was that was uh 90 of the meetings okay yeah that's it yeah all right plan uh we met on june 1st we discussed the house enrolled at 1001 and its impact on our zoning laws The biggest consideration for the board is the requirement to hold a public meeting and discuss ways we can amend the zoning code to encourage housing development. And this is something that is required by the state. We have to have that done by what, January 1? That's what I thought. So we'll be getting more information on that. Then any questions for me?

then paul or chief for the police yeah so police commission hasn't met chief's here if he wants to say anything i just want to say one thing about just to keep the council updated and this sort of overlaps with my parks role too we're very um interested and engaged in trying to provide appropriate security, especially to protect our investment at Lou Dennis. So there's a project that Chris is really on the tip of the spear here for cameras in the park. The chief's involved in this. And what we want to make sure is whatever we do there is scalable if we need to do it elsewhere. And so you don't need to Chief, you don't need to address that, but I just wanted to say that because we didn't talk about it tonight.

It'll be at the next... I will have a recommendation probably to you and the council by the next meeting because the rate increase on the dollar amount is just on the cameras only, but we feel like we've got that worked out. Okay. And then I'm going to be at the Park Pals board meeting Monday, and I want to talk to them first and then... I should have an agenda item for the council to review for the Lou Dennis security hopefully at the next meeting.

And then to kind of talk about that and I'm working with Eric as well. There's some emergency signage, and I totally forgot to put it in the report that we've created, but just kind of shows what, if someone's there, there's a sign, it has the address of their location, it has the best numbers to call, it has, you know, so is it during the day? Is it an emergency? Is it after hours? We're working on that and we'll have it hopefully in all six of our parks and then probably different areas, especially the bigger parks like Loo. So once we get what exact numbers we want called and where we want those locations, I'll let you guys know. But that's another little, a small security part of the bigger overall.

We're looking at the trail system too. There's some internet upgrades at some of the wastewater facilities that need to be made. with some of the lift stations that we could potentially piggyback on for a potential camera upgrade there.

But we want to get the main piece at Lou Dennis kind of going first to protect the $2 million investment. and then like dr perry said the functionality of the system that if we went this route you can easily add to it to where you're not reinventing things and it would only end up going to the police department for the all the stuff would be stored there at a server and okay i don't want to get ahead of the discussion and well once it's figured out bring it back to us any questions for paul or the police

Steve, stormwater.

Stormwater met June 1st. It was really our main meeting, but because of Memorial Day and some other things, we had to move to June 1st. We've talked about Juliana and what was all involved with that project. The other thing that we spent a lot of time on is talking about strategies and our vision for stormwater projects in the future, because we've outkicked our our budget, pretty much. Being an old town with old infrastructure, it's difficult to stay ahead of the stormwater issues. And so we're looking at ways to be able to move forward with projects and still do it in a fiscally responsible way.

Well, it's hard to be proactive on a system that is this old. Yeah, yeah. You know, unfortunately, you have to be reactive at times, like with Juliana.

but so we'll be we'll be working on that going forward and it probably won't be the next meeting but but we're that's that's what we're looking at right now and and that's been helpful with that as well so well that's something that needs to be done yeah so thank you for doing that and we i would say that we have a really good

stormwater board now it's a full board and i'm very impressed and pleased with the board well it's nice to have a full board yeah yeah yeah all right and streets well you have a short report printed before you a new format and lots more information that you can read at your own pace There may be things from time to time that I will point out to you that are, I think, of interest particularly. need to do that yeah so i talked so um i was going to sit down with noah um on friday when i was doing my report we were going to kind of explain what the re you know what you guys wanted to see in the report and all that kind of stuff and then um friday was a little busy with i didn't expect the splash presidency is busy and great because it wasn't that great so unfortunately i was able not able to get to him until monday um but i kind of explained to him that

ideally this would be in the packet friday so you guys see if you have any questions you can answer them plus he had he had some computer issues that have been addressed as of this morning he uh there were some software issues where he couldn't do some of the microsoft stuff like the teams meetings and stuff so i don't think he could have word processed this that but now his computer is fixed okay so how is the combining of the maintenance and the street department working out

I think it's great so far. I talked to Artie, Artie's on vacation this week, but I talked to him before he left. He's really excited. He's been, him and Clint have been over there learning the splash pad stuff right okay i mean before we've always just had one person in charge of this huge splash pad right and now to have somebody else who can be there if something does happen right is is great i know they're excited to learn this maintenance side of things right as opposed to street and and then noah's learning you know their weekly monthly you know what do they do what is their system how are they setting up and i think

working together and then hopefully novo coming in it's all going to really come together we're also working on like some of our supply ordering we're able to centralize and get um it's going to end up saving us money but the way we can purchase like our cleaners now we don't buy two separate groups we have one central point that's going to be installed soon to where there'll be a larger apparatus where you mix and it'll help us save money long term

I think it is so much more efficient, and I'm just glad we did it.

All three new hires started in the last, what, week, two weeks?

And they've done a lot of, they're in the process of doing some updates and cleaning at the street department. Once he gets everything done over there, we'll probably invite everybody to come through if you haven't seen it. Okay. But I was out there yesterday for a good couple hours and just in the past couple weeks, the progress that they've made, it looks completely different in there. And they're not even done.

They've thinned the herd on some of the inventory that was just outdated and stuff. They've got everything kind of lined out to where it's accessible. And we're going through some of the safety stuff right now. I need to talk to Nanette on one thing I just remembered. But it's great to see everybody kind of invigorated. working as a team and the fact that that I can send an email or she can send an email to Noah and Artie and know that it's going to get delegated and you have not just one person addressing it, but you have a bunch of eyes looking at it. I feel it improves our response time and will be more effective that way as well.

All right, Steve, do you have any... Any miscellaneous business?

I do. Motorized vehicles on the trail have gotten out of control. The scooters and the bicycles and everything else, they're being ridden more and more recklessly and they're being ridden faster.

And racing.

And it's become much more dear to me what can happen when people get out of control on scooters. And I would like to ask our town attorney and our chief of police to work together to come up with something that can be enforceable on this. motorized wheelchairs, I don't see any real good reason for anything that has a motor on it to be on the trail. I think that makes it easier for the police department to enforce, police the trail. But I think it's something that's important and I think we should look further into it to be able to make it enforceable.

Okay, Chris, do you have, I mean, the only comment I have is, I mean, we've been talking about it off and on for a while and the. I've sent memos on this in the past, but the way the law is currently, no motorized vehicles is the rule. What that means under Indiana law is, for example, e-bikes, certain e-bikes are allowed, certain e-bikes are not allowed. Scooters are allowed. Certain scooters are allowed. So the question has always been, do we want to alter that state, that general rule? and not allow you know pedal assist e-bikes and scooters and if that's what we want I mean I that can be done by ordinance can you so you can go against what the state has the state is a default default okay on a on a paved trail e-bikes other than the e-bike the e-bikes that are like throttle and It's the class two maybe, but there's different classes, three different classes of e-bikes. Certain e-bikes are not allowed, but other e-bikes are allowed to go wherever bicycles are allowed to go unless there's an ordinance against it. So we just need to identify what it is we want to do. And it's not always the bikes, it's the riders, but you know, I just need direction and I can ride it however we want, and I can work with Eric.

I think there's more communities that have, because of the difficulty, particularly with the bikes and the scooters, which is allowable under state law, and what's not, that more people have gone to just a local ordinance that says, we're not going to deal with it.

I think the thing that you all want to be mindful of, I think, is that maybe some notice to folks that these ordinances are coming or when they get out because i think there are people that probably have e-bikes and have purchased those e-bikes and you may get some pushback on that but but i think you know we gotta draw a line somewhere right um and that's you know i'm not not my call i'm i'm open to whatever you all instruct me to do but it's a discussion that you all should have chief do you have a comment so part of our issue that we've always run into is

just because it looks like something doesn't necessarily mean it is, we start running into a violation of somebody's Fourth Amendment right to stop them, right? And that's obviously an issue because you cannot tell how many volts or whatever something is as it drives by you. So that is where our difficulty really comes into play. Recently, we have been dealing with some of the juveniles specifically. There has been some action taken against some juveniles recently. I think it also twisted into, well, I'm not going to go into that because there was a juvenile ball. but it it can escalate into other things right so um i mean if one of them doesn't stop now all of a sudden we're Are we in a pursuit? We're not allowed to pursue a motorcycle. So do we view it as that at that point? Okay. You know what I mean? I didn't realize that. So we start running into some weird stuff that all of a sudden just blows our doors open up to the liability if something bad happens. A kid runs, you know, they don't stop at a stop sign. And they get plowed down. by vehicles driving by. Now, granted, I mean, there are consequences for somebody's actions, but I don't know if that deserves that type of scenario.

Well, it's as dangerous for the people riding the bikes or the scooters as it is for the people...

Yes, and bystanders that could be riding there. So that has been our difficulty during this entire time. I've had numerous discussions with... I would say somewhere around 15 to 20 juveniles over the course of the last two months. Granted, it was not being stopped. It wasn't any type of enforcement style of action going on. It was just they happened to be at a park, and I rolled up, and we had a chat. But, I mean, it is so difficult to be able to determine what is legal and what's not. Sounds like a slippery slope.

So do you think a rider line of all, I mean, here's, I think one of the things that Chief's pointing out is that the ordinance is step one, and it's a good step, but without enforcement, it's useless. We talk about this with a lot of ordinances, and you can pass ordinances all day long, but they don't do anything unless we enforce them. and that's the i think the thing that we have to work through so i can put some things together we've got different examples and different things other folks have done that can get you an ordinance but You just have to think through what I mean.

So just so I'm clear, Steve, on what you're saying is you're talking about essentially advocating for it to be pedestrian only. Is that what you're saying? I'm saying bicycles, regular bicycles. Oh, bicycles also.

Are okay.

And not to money this any further, but sometimes you can't tell an e-bike from a regular bicycle.

that's what i'm saying is that i think that if because there's three categories for for e-bikes if you said i i think you can tell an e-bike from a regular bike You can't always. But most of the time you can.

So what we're running into is now the new technology is these little things that essentially looks like a dirt bike. Like straight up. I mean it's mind numbing how often they keep just flooding the market with this stuff. And they're a thousand bucks. I mean they're not cheap either. So it is this has been one probably the top five most frustrating Scenarios that we've dealt with over the last many years.

I mean it's The e-bikes is a challenge because I think on one level a class one is a pedal assist that will only go the pedaling only goes so fast and it turns off right and I've ridden those back when there's certain people that can't really ride a bike without the help of the e-bike. But it's hard to tell those from the ones that can just go.

So how do you enforce? I don't know if it would be something as simple as every bike. no matter what your definition of a bike is, it has to be registered. And there's probably actually a 100-some-odd-year-old ordinance that says you have to register a plate of bike. Oh, I remember plating my bike. You have to register your bike.

So I was just looking quickly at some other towns and stuff, and so some allow e-bikes on their trails, but they have a – and I know this will probably – this goes into the limiting what well it does a mile per hour so they limit it at that you know so could you do something like that you know what i mean like i think you know or could we make a sign that shows three different bikes and or i guess there are some places that i've just leaned into the current law and and got information out that says these are allowed these are not allowed so people are buying the ones that are allowed right people are you know knowledge about but

it's not ideal i mean i believe it suggested it's carmel and it came out in the aim stuff that i forwarded on a while back the way they worded their ordinance kind of not just captured the e-bikes but it captured the unit those battery-powered you are uh Not a unicycle, but it's got like one wheel. And then they've got the other thing that's a bigger version with one wheel that's like a board and a wheel. Segway. But the way they worded their ordinance in the language, it was like a catch-all to kind of capture what's out on the market now and then potentially get ahead of what could come out tomorrow. Did it ban... All you bikes, I don't think it banned them all completely, but it basically the way the light and it's been slept a few times since I read that. But I believe the way they worded it in the ordinance, it became like a catch all, not just to address what's on the market now, but what potentially could come down the road. But also, I want to back up. You've got enforcement. You've got the ordinance. but we also need to use the tools on social media and our website to do an education component of that too. That way we really hit it from all three sides.

We need to pick a policy before we start the education because we don't want to go through the trouble of educating on the current law, which is what I had been advocating because that's the current law, if we're going to change it and then pull the rug out.

But wasn't the intent when we first did the trail that it says no motorized vehicles?

I would say that probably was the intent. It's just not the way the law fits with that.

But then there's, you know, when the trail was done, e-bikes didn't exist, right? And so, you know, because the trail was done, what?

I mean one one approach would be just okay yeah that was the intent no motorized and we'll just we'll do that and then maybe there's an adjustment later if you get people who complain or you know or have certain things and want to use them and you can maybe Maybe we start there, make it easy, and then it can always be adjusted. But for now, it's no motorized vehicles, period.

I would like to point out, though, so Andrea made mention about the miles per hour. So, yeah, certain e-bikes or whatever are only supposed to go up to X miles per hour. However, most of these manufacturers as well are making their products to be, they can be jacked basically that goes over what the limit is supposed to even be on that. And then we, I mean, I've run into issues like this. I always have. I can't hardly even pick up a bike on a radar. So there's, and I'm not trying to make excuses for anything whatsoever. But what we have in place is almost near impossible for us to actually enforce. And it just has been.

So we did an ordinance that was no motor. We recodified what no motorized vehicles was intended to mean. and we're going to probably need to make sure we have good signage and good education about it so people know because most of most folks will abide by the rules if they know what the rules are and then you're down to just dealing with the people who are going to break the rules right you know and so the the trail signs came down in iran right because they had been broken over the years or whatever so we're working on new trail signage out there because we don't really as far as i mean

I think the Rivertown Trail Committee, when that was active, had this set of rules, right, for the trail itself. They're really not anywhere, right? They're not in an ordinance. They're not anywhere. They're just kind of there. And a lot of it was really, this is what I'm trying to think of, respect on the trail, right? You know, bikes on this side, walkers on this side. So, you know, maybe we get some, the signage up, the rules up, you know, maybe we do some education on, If you are on a bike, whether it's an e-bike or whatever, maybe people don't know you're supposed to pass or notify like, hey, I'm coming, right? I mean, maybe until we figure something out, that education component could be hopefully something. You know, it's saying no motorized vehicles, and hopefully if I saw that, I wouldn't do it.

Well, the thing is, the signs say that now, and that's down here on the trail, right?

Well, that's not there anymore. Oh, it's not there anymore.

I know I've seen it, so it's down there. But they're not following that rule now.

Well, no motorized vehicles legally on a paved trail means... I mean, e-bikes are allowed legally. You need to specifically exclude them.

So we need to have an ordinance to exclude them. Correct.

Whether it's the time of year or... There are many more motorized scooters and bikes on the trail than there have been in the past.

And the school's out right now.

And it's been on the list for us. I mean, we've been talking about it. It's just we need to know. I just need to know what. And I'll start there, and we can kind of go from there. But I think we can write the ordinance if I know what the policy is going to be.

Maybe we can reach out to some communities who passed those and just be like, we have, but I guess my thing is like, on the enforcement part, like, have you been able to enforce this? Has this stopped this?

The track, the trail coalition kept pointing to Carmel for the most recent update that people are starting to. Kind of utilize what they're the Monon trail that runs through there. And that's the trail advocate group and there's some emails floating around just amongst us that. If we want to revisit, I would suggest maybe starting there.

1 of the problems we have heard these stories is that. People will be on with any bike say, right? Maybe it's a class 1, right? So it's allowed legally. But. other residents pedestrians on the trail see no motorized vehicles and so they start telling them that's not allowed and you end up with kind of back and forth about what are the rules and who's enforcing them and people are confused and so it's gotta pick a lane and then get education out and I mean I can write the ordinance start with identifying what's not allowed

We have the same problem on Gray Street, and I know you all are always interested in what's going on on Gray Street, but Gray Street adds motorcycles and golf carts to the mix, and this morning there were all kinds of bicycles, scooters, things going up and down Gray Street, along with the garbage trucks and construction trucks and so on. So Gray Street's kind of like Free Range Jennings on drugs. Because There are no lines. There's nothing. Everybody's just all over the street. There have been more golf carts lately. Not very many two weeks ago. But last night there were two, which doesn't sound like much. But anyway, we have a very similar problem, but not the same kind, maybe, of safety issue that you're talking about. But we certainly have a safety issue. Six blocks straight away, no stops. And I did not want to rain on the joy of the beginning of the meeting, but I just want to mention Jager, Wayne, Sherry Sherman's great-grandson, who was five, who was laid to rest today.

The only thing I was going to add to that part is the golf cart thing. The state last year passed a law, and through a lot of education recently, there is a low-speed vehicle which looks exactly like a golf cart that is actually legal in the state of Indiana now.

And they're licensed, aren't they?

So we've been dealing with this as well recently, and I will tell you right now, the majority of law enforcement in our area had absolutely zero idea that this law even had been passed.

So if you pay attention to the guy out on 66 near Savannah Drive or whatever, he's selling... like you wouldn't believe. So you're probably going to start seeing substantially more vehicles that look like golf carts that are actually 100% legal in the state of Indiana as long as they're on a road under 35 miles per hour.

Which is going to create another level of confusion because they look like golf carts and so Newburgh is one of the Most places in Moore County have adopted ordinance allowing golf carts. Newburgh has not. So golf carts are technically not allowed in the town of Newburgh, but these will be, and it'll be similar to this e-bike thing, right? What's allowed, what's not.

Wow. I noticed a yard barn place out off the corner of Sharon. has a scat of golf cart looking vehicles for sale. That's who he's talking about.

Didn't you say he sold more year-to-date than they did all last year already? Correct.

And again, like I said, this law was passed last year by the state, and nobody had any idea, at least from our region. And this includes Vanderbilt County Sheriff's Office. to other communities. So just FYI. So let the fun just begin.

Talking about Gray Street, I go Gray Street every morning to go to work. And I thought I didn't follow because she was on the wrong side of the street, but she was on the opposite side of the street that she should have been all the way down Gray Street. And when she went to turn left, which is where I was turning left, she was in the left-hand lane turning left. I was in the right-hand lane with my turn to turn right. I'm thinking, Where is she going? I mean, she was in the wrong lane. I'll see her in the morning. The only thing I wanted to say was, pay attention to all the activities that we've got going on July 3rd. We've got the Jubilee 250 down at the riverfront, we've got the fireworks, we've got food trucks, we've got kids activities, we've got What else do we have down there? We have the parade.

We have the dedication of the new monument for the Revolutionary War soldiers on the 4th. And think back about the last two or three weeks. It's been amazing. Think of all the wonderful things that have brought people to Newburgh. The Strawberry Fest, for one. But, oh, hey, I have an idea. Don't do donuts on Donut Day. Do donut holes. Those kids didn't need any more sugar.

That's for sure.

The thing I did notice was that the shelter houses were like 100% full of parents. Whether they were working on their computer or they were, you know, they were in there doing something. But they were in the shade and using the shelter houses. Yeah.

And then, I mean... I know I sent Park Board that, and I sent you guys that. We asked a question about what people wanted to see in the park as part of a door prize. And the second response that came in was more shade, and those are things that we're working on. Okay, good.

Yes, all of these claims have been provided to council five days prior to this meeting for review. I'd like to request that these claims plus any sewer adjustments be approved for payment in the amounts of, for Civil Town, $354,519.88, three, five, four, five, 19, and 88 cents. That has three payrolls in it. For sewer, $1,344,234.07, one, three, four, four, two, three, four, and seven cents. I'll make a motion to approve all claims properly signed, including any sewer adjustments to be paid.
