Good evening. Welcome to the regular City of New Braunfels Board of Adjustment meeting. We are a five-member board appointed by the City Council. And pursuant to state law, this board hears requests from property owners for variances and special exemptions from locally adopted ordinances. This board may also hear appeals of decisions made by the city staff in administering these ordinances. The general procedure for this, each case, is the board will first hear from city staff who will provide a summary of each applicant's request Then the applicant or agent will be asked to come forward and advocate for this request. Next, the board will request public comment from anyone who would like to speak in favor or in opposition to this request. Those who are speaking in favor or in opposition will be limited to five minutes. However, the chair does reserve the right to adjust these times. The board will keep all discussions to the issue at hand and cannot deviate into unrelated topics or areas that do not contribute to the merits of this request. After the close of the public hearing, the pending case will need to have a motion and a second to the motion from the board members in order to proceed to a vote. In order for a request to be approved, state law requires that four out of the five members of the board vote to approve the variance requests. The request fails if no motion or second is made for approval. If denied, the same or similar request cannot reappear before the board for at least six months unless new substantial evidence that was not available at the time has been produced by the applicant. Any aggrieved party may appeal a decision made by this board, and appeals are made to the district court or county court at law. This is the time that citizens to address the board of adjustment on any issues or items on the agenda. It is a violation of the Texas Open Meeting Act for the commission to respond to ask questions or discuss any items that are not on the agenda. This is to hold a public hearing. in consideration of a request for two variances. This is 26-729, a variance from section 144-3.3-2B1III to allow an accessory structure to encroach 25 feet into the required 25 foot corner side setback and two, a variance from section 144-3.3-2B1IV to allow a garage to encroach 20 feet into the 20 foot required garage setback from the right of way within the R2 single family and two family district currently addressed at 307 North Ginther Avenue.

Good evening, board members. Mary Lovell, senior planner with neighborhood and community planning department. On this first slide, you can see an aerial view of the subject property and the surrounding neighborhood. The property is zoned R2, single family and two family district. That allows one family home, one residence and duplexes as well. It is surrounded on all sides by similarly zoned properties that are also developed with residential uses and their accessory units. The lot itself is 8,056 square feet and the property currently features about a 1,900 square foot two-story home. This home was originally constructed in 1920 according to the tax assessor records well before our current setback rules were adopted. Moving on to the proposed site plan, on the left side I have the full site plan and on the right side I have more of a zoomed in version to show just that proposed garage. The applicant is looking to construct a detached garage for the home, which will be approximately 350 square feet in area. And this would be to accommodate two cars on this lot. And For that, they are requesting the two variances, which were announced at the beginning of the meeting, but I'll summarize those. 25 feet into the 25-corner side setback, which would allow the structure to sit on the side property line, and there is no curb on this side of the street, and it is about, well, actually there is a curb, and it's about four feet, according to this site plan. So that property line does fall four feet inwards into the property. And while this rule normally protects adjacent homes to the rear, the home behind this property is already built closer to the 25 feet front yard property requirement under today's code. The second variance is to allow the garage to encroach 20 feet into the required 20 foot garage setback. And that setback is so that if you were to park a car in the driveway, it would not stick out into the roadway. So basically that variance would result in a zero foot setback as well. So the applicant notes that a strict application of the current setback regulations on this 1920s corner lot deprives them of a reasonable buildable envelope to place an accessory detached garage. The applicant also states that the unique lot configuration with two street frontages, West Bridge is at 30 feet wide and North Gunther Avenue is at 60 feet wide. That combined with the original placement of the house, it creates an undue hardship of the land. These are property photos to give you a ground level perspective and show you what is already built along East Bridge Street. As the applicant had pointed out in their application, if the variances are approved, it would allow them to park their vehicles inside of a garage rather than on the street. So moving those parked cars out of the street would just provide more safety for the area and ultimately be more in harmony with the residential character of the neighborhood that doesn't have a lot of cars along the roadways. Furthermore, there's a precedence for this type of variance in this immediate area, and in the staff report, we called those out. Specifically, therefore, detached garages and additions in various types of setbacks, rear setbacks, side setbacks, and even the corner side setbacks. That would be 351 North Gunther, 10 Harry Court, and 254 North Santa Clara Avenue. Public hearing notices were mailed to owners of 20 properties within 200 feet of the subject property. And to date, staff has received two responses two responses in favor and one in opposition. On the map, property owner number 11 has two properties, so that's why it looks like there's three properties, but their card accounts for those two properties. And so 13% in favor, 5% in opposition, and that pretty much concludes my presentation. If you have any questions at this time, I'm happy to answer and the applicant is here to present. Yeah.

The variance, the second one, a detached garage in the side setback. That was a reduction of, I believe, eight feet and to allow the height to exceed the main dwelling unit. And a variance to allow a home addition in the corner side setback. I don't recall the exact encroachment on that one.

Yes, that would provide additional from my understanding from the applicant our conversations that would also provide additional parking to also allow cars not to be parked along Gunther or West Bridge Street. However, the one of the normal allowances for a single family residential property is to have a garage and storage of your normal lawn mower and things like that. And at this time, there's not such a place on the property. So it seems like a customary type of use to have on a property. So I believe that's the reason why they want the garage.

No, I'm not. I'm the builder, and I have a restoration company here in New Braunfels, Days of Old Restorations. So I've been working with the Williams for quite some time, doing the addition that they did on this house, and will be working on the garage if approved for this. A couple things I wanted to point out. This street, And I don't know what view that was in. Right here. If you look at Bridge Street, it dead ends into Santa Clara that's there on the left and Gunther. So it's almost like it's an alley. All of the homes on the right side of Bridge, front Mill Street. So they're using the app for like an alley to get back into their garages and they're There's a garage on the second house that's very close to the street. And down the street, she took a picture of one, that yellow one right there in the bottom left corner. It's right there on the street. And so we kind of feel like what we're trying to do here fits into what else is going on on the street. And the street was built, I guess, in 1920. These homes were put down where they are all encroaching on the city, setbacks, just by nature of the age of the homes when they were built.

And we understand about the parking and that's why on the front of the house, we were gonna leave the parking pad out front. So if they have additional cars come in, there are a couple, just two that will be living there, but they have a big family in the neighborhood and they also will have six grandkids. So they spent a lot of time here and they wanted to have an outside area in the back for a pool and living area for their family. I design and build old homes, old style looking homes and to match it. So the plan with the garage is to build it in a manner that it matches the same materials for the house. So it looks like it's been sitting there since 1920.

We did, and again, it came to how much space we lose in the yard to build the pool and the living area in the backyard. And with seeing the yellow one that I showed you that was right on that property, kind of felt like this would fit into that street. It's pretty much people that are just living on that street that are going in and out of there, because both ends are, there's Mill Street that runs across, that is all the heavy traffic, and Gunther runs into Town Creek, so there's not a lot of traffic on there.

Yeah, I have some concerns. My big concerns is the right-of-way width. It's currently 30 feet wide. You know, like the homeowner across the street, I think they're pretty spot-on. I think the building should be eight feet back from the right-of-way, just like the other existing homes on the street. Really like what y'all have done with the property. I think it looks awesome. I think the house looks really good. But that's a really narrow right-of-way, and I don't know. I just think it'd be challenging to get cars in and out, like right on the right away, four feet from the back at curb. So that's my concerns.

All right, with that being said, we will move down to CS26-0176, hold a public hearing in consideration of a request by NB Signs and Design on behalf of WBC Industrial LLC for an alternative sign plan to allow seven freestanding multi-tenant monument signs to deviate from the established sign standards for property within the C3 commercial district currently addressed at 827, 839, 851, and 863 IH 35.

Good evening, board members. Colton Barker with City of New Braunfels Neighborhood and Community Planning. One day I'll remember the department name. Before you this evening is an alternative sign plan. This is not a sign variance. Rather, it is the appropriate process for considering signage that may not fully comply with the city sign code. Because of this, a hardship is not required and an approval may be granted by a simple majority of the boards, which is three votes for. The alternative sign plan process is intended to provide flexibility for applicants to design signage that complements a development's unique character, allow increases in sign area or height and place of multiple otherwise permitted signs, and accommodate additional signage when there are unusual site constraints. The subject property is the Walnut Business Park, a nearly three acre multi-tenant commercial development located along IH 35, just east of the intersection of Walnut Avenue and IH 35. The property lies within the C3 commercial district, fronting the I35 frontage road and Lindy Avenue. There are other commercial properties to the east and west and a residential mobile home park to the south there in the orange. Here are a few photos of the property from across the I-35 frontage road facing the flow of traffic, well, with the direction of traffic rather. And then we can obviously come back to these as we need. And here are a few from across Lindy Avenue of the property. The alternative sign plan proposes seven freestanding multi-tenant monument signs designed to improve site aesthetics, enhance wayfinding and safety, and reduce visual clutter to better serve the business within the development. The signs are located along I-35, set back more than 40 feet from the roadway, and at least 15 feet from the property line, which you can see in this site plan here. A monument sign is proposed at each entrance to identify the businesses within the corresponding section of the development. Each sign will be single-sided, externally illuminated, and include up to six tenant panels. I'm proud of this one. Staff made this little rendering just because sometimes I need to be more visual with it, so I put little stars kind of where they're all gonna go, and then little versions of the sign there as well. THIS IS THE OVERALL LAYOUT OF THE PROPERTY. AS SHOWN, THERE ARE TWO SIGNS AT EACH ENTRANCE. FROM THE I-35 SIDE, THERE'S NONE COMING FROM LINDY. THERE ARE TWO ENTRANCES HERE, BUT NO SIGNAGES PROPOSED AT THOSE JUST ALONG I-35 HERE. THE SIGN ORDINANCE ESTABLISHES ALLOWABLE SIGN TYPES AND SIZES BASED ON A PROPERTY'S ZONING DESIGNATION AND STREET FRONTAGE. GIVEN THE SITE C3 ZONING AND FRONTAGE ALONG I-35, SEVERAL ALTERNATIVE SIGN OPTIONS ARE PERMITTED UNDER THE ORDINANCE AND CAN BE SEEN IN THIS COMPARISON CHART. STAFF RECOMMENDS APPROVAL OF THE ALTERNATIVE SIGN PLAN WITH CONDITIONS.
