that they're trying to, I think, question is is the purpose of the club and and have defined it to a very narrow group of people it's also limited to ocean boulevard it's not the whole city so they did not want this type of activity that's that's the bottom line so if the public wants to
yes, see it taken further than what we got here. If this passes, then their step would be to talk to council and ask them to consider requesting that we go to some other
Y'all make y'all's recommendation, whether it's thumbs up or thumbs down, and it is then placed on the council agenda to be discussed further by council. You're also allowed to speak at the city council meetings, just like you're allowed to speak here at the planning commission meetings.
And city council, after they reviewed this, could ask and come back to us and say, we need to rethink something?
They could, but then the other thing that you've also got to factor in is that there is a shelf life for a pending ordinance doctrine. Pending ordinance doctrine can't just go on for perpetuity. So there is a shelf life to a pending ordinance doctrine. So one option could be that they may approve this ordinance as written. That doesn't mean that they still cannot continue to look at other options, but you've got to get something in place for the shelf life of the pending ordinance doctrine makes it fall off. As I've stated at the previous meetings, one of the things that y'all do as a planning commission are zoning amendments. They come back here before you, so no changes can be requested to a zoning order. That's one thing that y'all address as a commission.
Anybody else from the public? I was here the last meeting. Jim Henry. Primarily, I'm a resident in Ramsey Acres, so we're not alone in the ocean. Recently, Pine Island Drive has had a lot of work proposed on it. There's that new Grisham, Pine Island, 380 some odd unit construction. There was going to be a methadone clinic, but one of the council members voted against that, because they didn't want drug addicts in the neighborhood, even though they populate Ramsey Acres. That's a side issue. But it looks like there's going to be additional improvements such as sidewalks and other such things. There's supposed to be a 10 foot wide walking path. But apparently due to the cost of restructuring.
What does this have to do with the drinking place? I'm not talking about that. Okay, that's what the public hearing is on. No, this is public.
I was here last meeting. You did not allow me to speak. Excuse me, sir. While he's trying to stay. This is public.
I'm the public. I can speak. But you need to speak relevant to the agenda item that the board is currently talking to.
I sent out information for the last meeting regarding my opinions on this bill or whatever the hell this thing is. It creates a two-tier structure. What? The drinking overlay.
Okay. Are you happy now? Sir, it's not whether I'm happy or not, it's whether that means speaking before the call.
Can I ask who you are and your role?
My name is Kenneth May. I'm the director of planning and zoning.
Okay. I don't know if I sent you an email this morning about plug-in solar. It's a two-tier structure. The grandfather thing is atrocious. It's the old boy network. What happens if ownership changes in a business? The name stays the same, but it's new owners. Will they inherit the 150 or above cap?
There's currently one that's operating above 150, correct? Possibly.
No, but I'm just saying, if you're treating old businesses with preferential treatment and new businesses, you're assuming their clientele is not competent enough to be
particular property itself.
So it's basically a- Well, I'm just reading what I saw and my concerns. And again, I'm in Ramsey Acres. We're an older neighborhood that was annexed in 1974. We had a murder on Third Avenue South at the one bar up by 501. It closed down, changed names, and reopened. It's not the number, it's the activities. So you're proposing that we- You don't need it. You need better police. You need better enforcement. We have a fire marshal. They set an occupancy limit.
I think maybe you should address city council on this.
I already sent stuff. I sent out everything to everyone. I never hear back.
You can go every city council meeting. There's 30 minutes before. There was one this morning. I do. 30 minutes after. I do.
We had a homicide.
An assault turned homicide at a drug house. This is the planning commission. Yeah, I know. We have nothing to do with homicide.
You don't even know what the definition of the area was. Sir. You only seem to care about what is adjacent to the ocean. and the impact on the press in the news cycle.
People are frustrated in other parts of the city. We were tasked by city council to come up with an ordinance based on their direction, which is what we've done today.
In the general question to the planning commission, can I access your database to see all the submissions, all the things that were brought by the public versus what's being mandated by city council?
You can submit a FOIA request.
For the whole database?
You can submit a FOIA request for the information that you're seeking. For the whole database? You can submit a FOIA request for the information that you're seeking.
Okay. All right. That is five minutes. Thank you, sir. Anybody else from the public that would like to address the planning commission today? Seeing nobody else from the public, I will- I'll do it.
Victor Sharma, the Bowery, Duffy's, and Peaches Corner. What are we trying to do here? Where are we going to put nightclubs if they want to come?
You want the money, you don't want the responsibility.
Wait a second, one second. Where would we, if I wanted to open up a nightclub, Is there allowed in highway commercial? I'm not too sure why we want to get rid of everything on Ocean Boulevard. It's a destination point. That's my opinion on it. I mean, we're a tourist area. If we want to go out tonight, any of us, there's no clubs in town anyway. I mean, if somebody wants to put a few million dollars and open a club, a nice one, such as Margaritaville wants to open, I know that there's going to be a hotel. There's going to be more than 150. The arcade I'm on the fence, even though I have, the Bowery has been there 80 something years, you know, I understand it. I just, I wasn't trying to make it into a destination point area. I mean, it's just hard to swallow what we're trying to do. Are we moving them to Third Avenue South where that bar is now? Are we moving them, where are we moving them? I mean, I have nothing really more to say. It's just, it's hard to understand what we're trying to accomplish here, you know?
can correct me if I'm wrong here, but if somebody wanted to come and open up a nightclub, let's say on the pavilion site, they turn that into a PUD, they can pull themselves out of this if the PUD is approved? If the PUD is addressed as such. Yes. Okay. So there's other, there's ways if somebody wanted to open up a nightclub. Yeah, there's always a
I'm familiar with that. I don't know what the thought process is. We're trying to bring people here to a tourist area. We want to give them something to do. My opinion is we want to join 6th Avenue South Family Kingdom all the way to 16th North and make it lively. I don't know. I'm on the fence. I'm here to listen. I wanted to be a fly on the wall, but I can't shut up.
I think the chairman is indicating that there is the opportunity to do exactly what you're saying, but it also then gives council and staff the opportunity to look and make sure all the details of what they're wanting to do, address safety concerns and occupancy concerns and all of that by doing a PUD. So it hasn't been removed. from the opportunity to be able to do it is simply, is making sure that all I's and all T's can be crossed and dotted when that is done, rather than just carte blanche being able to go in and open it up without any sort of... No, I'm with you.
I've got ten lots on Ocean Boulevard from 9th Avenue North to 6th Avenue South that are vacant for the last years because I don't know what to do with them. I mean, I'm with you all on it. I want to see the safety and stuff there. But, you know, if I wanted to put a club on, I would call them to the job. Well, senior frogs, 90% of the business has got to be in the food, which they'll go by. I want some nightlife.
Just clearly here, what has been said, it will help you understand that. We've said it a couple times. Victoria with the Hospital Association called it out specifically. There are not loopholes. There are planning problems. ordinances that do allow, if you want to look at a special situation that may not be exactly in line with this, through a PUD, which is a normal ordinance, it's not a loophole, that you can go and then seek it through that process. It happens quite often, people, through PUDs that are not aligned to our current ordinances. But because it's a PUD, we're able to do just what the Hospitality Association says, we can then make sure that the business does the things and make sure there
I'm not fighting you.
I'm not trying to do that.
I'm with you. I just want to try to figure out what we're trying to accomplish. I'm trying to make it a bigger tourism area. That's all for us to do when we go out at 10 o'clock at night. It's a lot different than it was before. Before we were mom and pop hotels, everybody ate out. There was no efficiencies. Now every hotel is an efficiency at 10 o'clock. You watch the streets on the boulevard at 11.15, 11.30. By 12 o'clock, there's nobody on the streets anymore. Where I'm used to it is 1.30, 1.45. Then you start doing it. Things have changed. The world has changed. I understand that. I'm just trying to adopt with it before I start building anywhere I got on the boulevard. That's why I'm here, and I just wanted to basically be told things happen. Thanks. Thank you.
Seeing no other hands, I'll close the public hearing and bring it back to the commissioner.
that were made by hospitalization. But I think we've also seen that there's been some problems on Ocean Boulevard, which I think this is designed to address. It is a little bit of a broad sweep, but there are going to be ways to address it, the form of a HUD or what have you. It also allows for economies of service. We're finding that the amount of food sales is sufficient, Restrict slash bars like that are allowed still. So we're not eliminating nightlife on Ocean Boulevard and Myrtle Beach. But we are taking kind of a broad swath, I admit, to address this particular issue that is a very, very important issue for all tourism in Myrtle Beach. And I think we just need to be Given the circumstances, I think it's best interest for the council to approve. So I've got a motion by Zeb.
Second. Second by Phil. All those in favor? Aye. All those opposed? This is a recommendation to city council, so I don't know exactly when it will be on the city council board.
This will now go to city council. Across the street sets the agenda. It may be on the very next council meeting. It may be on the council meeting after that. Just keep an eye on the council agendas because this does have to go to city council for their approval or denial.
I'd like to add, it would be possible in minutes that we show that this is a recommendation that is spelled out that way to the city council. It always is. It always is.
All right. Moving on to communication from staff.
We have been in talks with to have a list of questions to hand out to you guys in regards of the chapters you recently received. And we're still working with them. So hopefully by next meeting I'll have the questions in your packet. And then you should also be receiving a new draft section that they've been submitting us.
And I will add this too. you've come across in good times here on the commission or from dealing with something outside that you think is an area of our code that needs to be addressed. Just put it on a piece of paper, email it to us, give us something to look at if there's certain areas, certain things that you think need to be addressed. And it might be, here's the reason why it is the way it is, or maybe that's something that we can look into. But you don't necessarily have to wait for that questionnaire. If you've got some ideas and some concerns right now regarding certain matters with the zoning code, please feel free to share them with us. And we'll try to get those talked about through before we come together with a bigger final presentation.
I do have a question about some of this. I had a question on the line. Because it just came up and I want to see it. Because regarding to Article 14, it's page 17, 1406. 1406C. I've seen it the last city council meeting. The parking space, .9. 21st Avenue. Workshop. Workshop. That has not gone before that. But I've seen it in line with that. What caught my eye was when I was seeing that, page 17 talks about that if there are two more utilizations of the same site, it's going to allow them to have a 10% reduction. Is that a similar concept thinking with that?
motels and they're all going to use the same parking space is this new code that they're looking at kind of trying to fix that in alignment with that it's i wouldn't say alignment was the proper word that i would use but it is it is one way to kind of promote shared parking in regard to it and that's kind of that you're trying to look at on that but again that's lost proposed i'd have a correction years now right yeah i know this is just we're drafting it now but i want to make sure i was
think in the right way. Like I said, it's not exactly, but it's a similar concept. It's like a restaurant, a motel, and a retail store all in one place. And we have opportunity where we do that in my discount based on that. Which is basically in a way that they proposed at the city. In other words, that they're looking at. Absolutely correct.
I'm sorry I missed the last meeting. Is there a new ordinance to address parking besides the
No, he's just talking about the zone and rewrite. Zone and rewrite. The zone and rewrite. Nothing proposed before you offer any action right now. That's just part of the zone and rewrite. Again, that's just a draft.
The first meeting where they came in, like they did with us, the group, the 21st Avenue, the city council, the whole, seemed to be favorable looking at it, reducing it.
When did we get that draft? I don't recall seeing that draft. Could you re-say that to me?
Yeah, we'll make sure to get you what you need. Thank you. But again, everything's looking... It's a hard read. It's a hard read. That's a hard read. I sat there on some of them.
Okay.
I'm glad y'all learned it.
Any other communications from commissioners? All those opposed, motion carries, and meeting adjourned.
