Good afternoon. Today is the September 10th meeting of the Unsafe Building Hearing Authority. Please just keep signing in. We'll wait a few minutes to give everybody a chance to sign in. Hearing authority members are Gretchen Cheeseman, Mayor Dan Ridenour, and James Heimlich. City staff members here today are Taylor Reed, Melinda Coffey, Hannah Collins, Danny Hahn, and Richard Rawlings acting as administrators. John Moynihan is our city attorney, and Courtney Walker is acting as reporting secretary. The unsafe building law, IC 36-7-9, is hereby entered into the record. For new cases set for hearing today, a reasonable effort has been made to notify owners of this hearing and the orders being reviewed. The owner of record and any entity with a recorded substantial property interest, was notified by posting on the property, certified mail, and published in the Star Press. Notice of this hearing for status hearing cases was sent via regular mail following the last hearing at which an action was taken. We will call each case set for the hearing today and take action on these cases in order listed on the agenda, starting with the properties that have an owner and or representative signed in. If you are not the property owner but wish to testify about a property on today's agenda, please identify yourself as an interested party when the property is called. The city staff members as agents of the enforcement authority will present the city's evidence about the condition of the property. You will then be asked to present your evidence. We ask that you stick to the issue of the current unsafe order when presenting your case by providing plans and a timeline to become compliant. Both the city and the property owner will be allowed to question witnesses and summarize their positions. The authority will make findings of fact and act accordingly and or set the case for a status hearing at a later date. Findings of fact and action taken will be mailed to the property owner via regular mail and filed in the Delaware County Recorder's Office. If civil penalties are assessed today, an invoice for payment of the civil penalty will be included with the hearing record. You have the right to appeal any action taken at this hearing. Appeals must be made to the Delaware County Circuit Court and must be initiated within 10 days of today's hearing. All who expect to participate in the hearing today, please stand and raise your right hand and be sworn. I've had several offers, but this one I didn't. solidified so that's my question on how do I handle this do I have to fix everything because they're also saying my porch the decking on the porch three-quarter inch pressure treated plywood they're saying it's unstable you can walk on it all day long and I've done that multiple times so I'm confused granted I would replace it myself because the surface is a little bit rough But at the same time, I mean, it's not like you're going to fall through or anything like that. I mean, it's treated wood. So in the two by eights that are holding it up, they're all fine. The center blocks, I wouldn't have done it that way myself as far as the corners and holding up the post and things of that nature. They're not sinking or anything like that. And it's not sloped. And it's not a danger. And it's not a danger for the roof to come collapsing down as well. So I guess it boils down to you guys want to do an inspection and go yeah, okay Why don't we affirm the rehab order and continue for 30 days require an inspection prior to the next hearing Do I need to work on it in the process I Will fix a roof as far. The building hasn't been worked on yet because I needed to see about an extension because she's on social security and it's going to be some extensive work to replace a roof. And so I need to see if she can get more time to save up the money to do the repairs.

We are timeline is scheduled to finish the project by the beginning of February, February 4th, 2027. And I can show some pictures of where it currently is just to show you that we have been maintaining the cleanliness of the property and when we are in partnership with the Muncie Land Bank who has also been watching the property for us as well to maintain the exterior cleanup portion of the project.

So we gave her until this coming Monday, which I believe is the 14th, to be out. We actually even provided her assistance to help her move yesterday. So I believe they may have gotten everything out of the unit. She's just been very difficult to work with. So we've been trying to work with her because of her disability as much as possible. However, it's just been a very difficult process. So we're hoping that they got everything out yesterday. And then our plan is once she hands in the keys, maintenance will be going into that unit to mitigate every issue that needs to be done.

It has for a couple years. I know a lot of people think that when they receive these notices that they're being picked on, but you guys are just trying to help them get smaller things done before it comes large. And they... lose their homes really. I just want to say that the Granville Neighborhood Association had received a grant and we elected to give it to homeowners instead of spending it actually on the neighborhood or the park or something, we elected to split it up and give it to homeowners for repairs to the outside of their homes to help improve the looks of the neighborhood. And I've talked with Angie. She knows that if she can get some of these smaller repairs fixed, the Neighborhood Association will reimburse her up to $1,500. Now, she does have to make the repairs and pay for it and give us a receipt before she can receive the money. So she would have to have it done and then collect her money back. But we can reimburse her up to $1,500. And... I think I forgot what else I was going to say.
