2025. I will now call this town council meeting to order. If you would please stand for the pledge of allegiance to the flag of the United States of America and to the republic for which it stands, one nation under God, indivisible, with liberty and justice for all. Right. Welcome everybody to the June town council meeting for the town of Mount Ary. Uh at this time we will now relinquish the floor for presentations to our mayor, Mayor [Music] Husher. Test test. All [Music] right. Good ne good evening everyone. Uh appreciate everyone coming out tonight. Uh we're going to start our presentations tonight with a young man down here named Sawyer Miller Sers. If you would come on up here and bring your family with you, that would be great. So, every year we have a contest. It's called the if I were mayor contest and uh Sawyer was one of the winners of the contest this year and he's already been to Annapolis and he's uh met some ranking officials down there including the governor's wife who came out and gave him a uh a presentation as well and while he was there he was able to read his uh proclamation or his essay and uh this is what it was and they uh they gave it to him. I can summarize it here. I can make you read the whole thing. What do you want? Can you summarize? Yes, I can summarize.
First of all, Sawyer uh suggested that we needed to establish something like a food bank and be able to bring uh food to people who are in need uh who are down in the economy and and need some substance. Uh so that was his first suggestion. Uh second of all, he started talking about clothes and any clothes that are not uh being used by individuals could be turned in and and possibly used at a thrift store or also be donated over to individuals who are in need. Uh third thing he talked about, it's a big deal here in Mount Ary is uh clean water. Uh making sure that the town had clean water. I don't think you knew the acronym for PAS, but essentially he mentioned plastics and we have plastics in the water and that's what we're trying to fix. And then the last thing he talked about was a community center, the need for our town to have a community center where we could get people together and uh and serve as individuals in a better way and work together as a town uh you know in a much better way. So that's the summary of that and I think that alone deserves a hand. Can you hold that for me? All right. All right. And what we have is a certificate of achievement uh for Sawyer. And what it says is certificate of achievement from the town of Mount Ary to Sawyer Sellers. The town of Mount Ary hereby presents a certificate of achievement to Sawyer Sellers and commends you on winning the Carol County. if I were mayor contest. The town acknowledges your great accomplishment and we wish you continued success in all your future endeavors. And that's signed by myself as mayor and the entire town council. go. Let's see where you got a gift card. The other thing is you got a gift card here. So you can treat your family out to dinner as long as they don't order too much on the menu anyway. So but uh there's $75 for the Mount Air in uh congratulations. Okay. And if we get the town council up here, we'll do a picture with you all. That would be great. Okay. We'll just jump right up here. Do you want Oh, and I forgot to tell you there is one more thing. We have that picture of down. Cool. That's a picture of his teacher, Miss Homer, along with uh along with the whole family with very stylish. Cool. Thank you so much. All right. Uh, second proclamation is for a gentleman who has done a ton around the town that, uh, if you're not involved in the Linggonor band, you probably know him in some other manner. You also know his wife as well, Beverly. And, uh, so, Mr. Lloyd and Beverly, if you could please come up here. As everybody knows, behind every man is a woman who makes it possible for everything to be achieved. And with that, we offer you this
[Applause] All right. And then for Mr. Lloyd, after 37 years here uh teaching, we have this proclamation for him. The town of Mount Area outstanding citizen proclamation honoring Linggonor Director of Bands W. Kevin Lloyd. Whereas Kevin Lloyd instructs the marching symphonic and concert bands, percussion, jazz, and guitar ensembles and courses in music theory and music technology. His groups have earned over 25 state, regional, and circuit championships, and made appearances in the St. Patrick's Day parades in New York and Philadelphia. Maryland Governor's inaugural parade, National Cherry Blossom Parade, Parade of Nations, Parade of Heroes, and Walt Disney World's Main Street Parade. And this goes on for a while. And by the way, we appreciate all those vacations that Mary and I took down at Disney. So, thanks so much. Uh whereas Kevin Lloyd was the inaugural recipient recipient of the Golden Lance Award for Character and Education, the 2004 Washington Post Agnes Meyer Teacher of the Year, the 2005 School Band and Orchestra Magazine as one of the 50 directors who make a difference in American schools. The 2016 Maryland Music Educators Association Outstanding Teacher Award. the 2017 finalist for Frederick County Teacher of the Year, the 2018 Community Citizen Award from Linggonor Graange. In 2024, nominated for the Grammy Music Educator Award. In 2025, Linggonor High School Band Booster Association established with Kevin Lloyd Legacy Scholarship in his honor. And whereas Kevin Lloyd performed with the
Pittsburgh Opera Theater, Milbert Symphony Orchestra, Allen Ambush uh Jazz Quartet, Miltonberger Jazz Quintet, concert tours in Europe and Japan, created over 100 professional plays at the Contemporary American Theater and Maryland Ensemble, 20 New York City credits for production for the men. here actors a loft or loft uh primary stages theater of the New York of the new city of the Abington uh where he was nominated for excellence in sound design award in 2011 and whereas Kevin Lloyd holds a bachelor's and a master's degree in music from the West Virginia University with additional studies at John's Hopkins UN University and Lyola College of Maryland and has taught at Frederick C Community College, Shepard University, PTOAC State College, and the University of Maryland on top of 37 years of teaching for Frederick County Public Schools. Now, therefore, on behalf of the town council and the mayor of Mount Ary, we present this proclamation expressing our sincere appreciation to W. Kevin Lloyd for his service to the youth of our community. Thank you so much. [Applause] Perfect. Do you have anything you like to say? Thank you so much. I I would like to thank um a number of friends and students and people that uh um have supported our program over the years for being here. Um, as anyone in leadership knows, it takes a village to make anything happen. And I've been so blessed to work with uh an outstanding faculty at Linggonor High School. I've
had wonderful administrators. I've had an incredible um band booster association, the best students anybody asks for, and uh a wonderful staff of friends here, Jeremy Brown, Lindseay Sver, who've helped me uh build the program that we have. And of course, my wonderful wife, Bev, and our daughters, Aaron and Kelly. Um, I've joked with people many times and and said, "If you're thinking about marrying somebody, get on a school bus and sit down. And if they get on the bus with you and sit down, that's the person for you." And Bev has Bev has taken hundreds and hundreds of trips with me over the years and been by my side, and I couldn't have done it without her. So, thank you all very much. [Applause] Anybody Anybody who's here who's here for Mr. Lloyd, you're welcome to come up and be in the picture. Or if you want to take the picture, that's fine. All right. Uh, you know what? proclamation uh is a little more somber. Uh here to present is Isella Bravo uh from the Frederick County Executives offer office. Uh executive Fitzwater couldn't be here, but uh she sent you and appreciate you being here and uh and you are the community liaison. Um and and so it's great to have you here and if you don't mind reading the proclamation. Thank you. Good evening and thank you for inviting me here this evening. I do have a proclamation. Whereas post-traumatic stress disorder, PTSD, occurs after a person experiences trauma, including but not limited to the stress of combat, rape, sexual assault, child abuse, bombings, accidents, and natural disasters, and affects approximately 8 million adults in the United States annually. And whereas PTSD is associated with chemical changes in the body's hormonal system, autonomic nervous system, and is characterized by symptoms including flashbacks, nightmares, insomnia, avoidance, hypervigilance, anxiety, and depression. And whereas raising awareness of of this condition is necessary to remove the stigma and to encourage those suffering to seek proper and timely treatment that may save their lives. And whereas between 10 and 30% of service members will develop PTSD within a year of leaving combat, while others may not develop symptoms until years later. And whereas the brave men and women of the United States armed forces who proudly serve the nation and risk their lives to protect our freedom deserve the investment of every possible resource to ensure their lasting physical, mental, and emotional well-being. And whereas despite its treatability, many cases of PTSD remain
undiagnosed and untreated due to a lack of awareness of this condition and the persistent stigma associated with mental health conditions. And whereas combat related PTS PTSD stress among our men and women in the armed forces is significantly pronounced given that they are often exposed to highly traumatic events for weeks, months, and even years. And whereas all citizens suffering from PTSD deserve our consideration and those who are affected by t PTSD from wounds received while protecting our freedom deserve our respect and special honor. Now therefore, as the county executive of Frederick County, Maryland, I here I hereby proclaim June 2025 as post-traumatic stress stress disorder month in Frederick County and to commend this observance to all of our residents. signed Frederick County um Maryland County Executive Jessica Fitzwwater. Yeah, PTSD is certainly a serious issue for those who've gotten out of the military who have seen things that uh that a lot of people haven't seen in common jobs uh that that you know are that are performed outside of the military. So, uh, we will take this proclamation, put it by the front door and recognize this month, uh, for our veterans. So, thank you so much for bringing this to us and, uh, thank you to all of you who have served in the military. Uh, we honor you and appreciate everything that you have done. So, thank you. Okay.

Um, that will be the limit. When the timer is up, uh, we are finished, uh, with the public comment. So, uh, for that individual. So, whoever's first, if you'd like to come up and just hop in line, JD. Sure. I'm JD Kelly and I'm going to talk really fast. I'm gonna I'm here to tell you guys all about the Manory Mile and that I've got the uh process started with getting the road closures from Anita's on Ridgeville Boulevard all the way down to Main Street. The event is on August 9th at 9:00 a.m. Um, it's a money maker for a foundation that I don't think a lot of people in this community know about. Um, uh, if you are in need of a help, you can go to ww.roarycares21771.org and if you have been hit or blindsided by any kind of medical trauma. Um, our town is uh, with
the zip code, you can apply for help, financial help. So, say for example that you've been hospitalized for a long time and you can't afford to pay your electric bill. This is what this foundation is about. I think it's getting to the point now where it's underused. We have a lot of money. We've done this race for the going on four years now. And um we've gotten sponsors and the people of the community show up to do this race that they can sign up on run signup. You just Google Mount Mile, go to run signup. you. It's $29.92 and it gets you a beer, uh, a nice medal, um, probably a Chick-fil-A sandwich at the finish line. So, and all that money is set into this foundation aside from the cost that it gets to get this race going. And the money comes right back here into our zip code 21771 for people who have been blindsided by medical issues. So, did I get under my time? You still have You still have half your time. You talk about anything else? have any questions about it? No. During public comments, do I have your blessing to do the race? Larry, definitely. So, um, but I've seen this group in action, too. You know, there have been times that people uh fell on hard times because of medical conditions and couldn't pay their water bill. And and this fund has provided an avenue to get those water bills paid. So, thank you for uh organizing it, setting it up. Uh looking forward to it. All right. Thanks. I think it was right down Main Street still, right? Yeah. Yep. Perfect. Perfect. Okay, you could reset that, but I only need three minutes. Hi everybody. Good evening. I'm Guy Cuccino. Um I'm at 1304 South Main Street just up the street. We uh own my surgical practice and label Medi Spa. I've been in the county well in Mount Ary for 20 years now and um been have my practice here for 20 years and at South Matri since 2012. And I'm here uh basically to clarify our intentions for the request to reszone from neighborhood professional to limited commercial because I think there's just been a lot of concern and apprehension and rightly
so as a community member and you know a father of four children. I moved to this town because I just love the composition of it, the feel and the character. And as you know when we bought 1304 South Main Street, we kept it in the traditional style of the of the neighborhood. We kept the overhanging porch. We've just beautified it with some new lighting and flowers and we take the appearance very very seriously. So, the reason why we want to reszone is not to expand, not to change it, and certainly not to move. We want to be here for the duration of my career, which, God willing is like 15 more years if I can hold out. Uh, but the spa should be there um in perpetuity and serving the neighborhood. Um, we can no longer uh have enough parking for my staff. So, we have literally outgrown the ability to continue to grow the practice. Um, we had a zoning study done, engineering, uh, wastewater management, runoff, and essentially what we want to do is be able to expand the back parking lot just to the offset slightly larger. It would be less noticeable from Main Street because we're going to put up a privacy curtain of uh, vegetation. So, in essence, it's going to be, I think, more beautiful um, and also provide better ingress and egress for people, more handicap parking spots. And really, that's it. But I just want to allay any fears that we're going to be putting up um some multi-level high-rise. Um and as everyone knows, I'm proud to serve the community. Anytime someone cuts their face or their kid or whatever, um I'm always here. So, I just want to let you guys know that's what our intentions were and I hope that you can uh help us afford that vision. Thank you. Thank you. Hi, my name is Bill Ranshoff. I live at 1208 South Main Street. um just two doors down from Dr. Cappuccino. I think they've done a great job. I think they've done everything neighborhood professionals should be. It's kept the character of the neighborhood. Uh but they're not going to be there forever. And so I I don't think, you know, the the property next to me is being proposed to go to neighborhood professional and based on what's happened, I guess I don't really know what that means. I mean, does that mean in 10 years that that the property next
to me, I'm going to be asked if that can go to to limited commercial? I'm happy they've had a lot of success. If they just want a little bigger parking lot, I would think you could do that another way. I I would think you could give them a little exception to to put in a bigger parking lot and and maintain the neighborhood professional zoning. But to to go to make that limited commercial and then the the Baker property and the vet limited commercial, that it seems to me is uh the kind of um creep that that some people have have been concerned about. I don't I don't begrudge them for for trying to do this, you know. I like I said, I think they've done a great job, but I think you all need to decide what what kind of town this is this is going to be, you know, and so um if if we're going to start converting everything to to limited commercial and move that downtown, you know, I think you risk making Main Street look like look like Ridgeville Boulevard, which still has some nice houses on it, but but just isn't isn't what Main Street is and has been. Next up, we'll go to our Civil Air Patrol report with Captain Par. Don't see him in the audience. Yeah, it's uh it's Captain Laval now. And I don't see her here. So, but she did send her report and we all have the copy of that. Yeah. Okay. Just wanted to make sure that that I saw when I saw Par. So, I didn't know if maybe he showed up. All right. Next up, our Mount Volunteer Fire Company report with Matt Herd. I haven't seen him here either, figured somebody that is here. We'll go to our Matter Police Department report with Chief Janev. Good evening everybody. For trainings that attended, I'd like to note that uh our senior officer Bridges attended a carpet tech training. just to expand on that a little. We're going to try to set
something up in the upcoming future here is officer Bridges is now certified for anyone that's over the age of say this over the age of 60 I mean most respectfully is that for car these days that a lot of people don't know how to operate their cars as far as lighting their seat belts such as other features in there too especially they have these big screen TVs text. But anyways, we're going to put something together with uh again officer Bridges being this car tech training. Anyone that has any problems or anything like that, we'll set up a date and time that off bridges can uh take them through a little course, little checkpoint thing that he'll go over with them. And again, just because I shared, you know, an age, it's not specifically set for anyone age anyone any age. A lot of these young I know we did our teen driver event once we set it up we'll put it out there on social media and I would hope that some people would show again for all for that. So again once we have that information I'll be glad to share that. So, it's kind of exciting to have somebody else trained in some other enforcement. And not only that, recognizing some other people of different age groups, especially our elderly. For recruitment, we're in the process right now of doing four entry level applications that they're going through their testing procedures. They will be scheduled sometime in the upcoming of this month for their polygraph examinations. and we are in the finalizing of a part-time applicant for our evidence property technician. So, we're pretty excited to have this uh individual uh coming aboard with Mary Police Department for our K9 deployment with Canadian Officer Efforts and Hazley as partner. Uh seven K9 scans were conducted here in town and six of those
scans were positive alerts with narcotics being recovered and pending investigations. One of the scans had negative results. I don't want anyone in the town to be alarmed of such the amount of scans because I know in the past we've had a limited on that. But it is just showing that a lot of this transient traffic that we are having through the Mon area. These things are happening and our town residents need to be aware of it. So if you do see something again, say something, give the Monter Police Department a call. We'll send the officers there to investigate it and that could be anything. We'll investigate it. Again, don't take matters into your own hands because there are some people that have wanted to film other things. If you want that phone or your testimony subject to court proceedings, that's fine with some of you as a witness. Please call the Mon Police Department with that. Uh for our overdose summary for the town, we have zero opioid overdoses reported for the month of May. For our call volume, we went from uh last year 480 calls for service to 641. Again, not to alarm the residents of the town, but it is a 33.54 increase of calls. That is also a result of selfinitiated officers becoming involved with that. That's how that calling goes up. And uh currently, as I spoke in reference to Matt Herd and his absence for the fire department, the four counties uh fines club, they have their carnival this week at the carnival grounds. And Friday will be the fireworks rain day. Hopefully it doesn't rain. It'll be Saturday. Uh June 10th is the law enforcement torch run for the Special Olympics. Myself and a couple of other officers from the Monterey Police Department will be doing that leg run also. And that will be taking place at the Tonytown Police Department since they have everything approved from state highway. So either officers will be
running or biking from Tony Town all the way to McDaniel College. The Mount Area Police Department is happy to announce we will be sponsoring an athlete and that's Mr. Eric Federman. Other than that, sir, I don't have anything to add and if anyone doesn't have any questions, I would most respectfully ask to be excused to go. Absolutely. Any questions? I just have a comment more. So, I just want to say thank you and pass along my thank you to officers for the carnival and the um I say the extra duties of uh directing traffic this Saturday or Sunday whenever the power went out down here at the at the Frederick County side for the traffic. So, thank you. Yes, I appreciate that. We will be looking into that a little further because it seems to be contin head on over to the carnival and I'll see you there the rest of the week. Got it. Thank you. All right. Next up we have our mayor council and staff reports. Uh, I'll start with Mayor Husher. Okay. Uh, thanks. Couple of quick things. The, uh, everybody knows that right after I put us on voluntary water restrictions, it started raining and it hasn't stopped since then. So, in order for everyone's yard to dry out, I am lifting the voluntary water restrictions so we can go back into a drought. Uh and so uh get your yards mowed while it's uh still dry. Uh but those restrictions have been lifted at this time. Uh want to say congratulations to the class of 2025. I attended the Linggonor graduation last week and uh tomorrow I'm attending uh
South Carol's uh graduation ceremony. Uh great greatl looking bunch of kids. So, uh, congratulations and and we look forward to all the things that you accomplish. Uh, this didn't make it into my report, but, uh, but prior to the July meeting, we have a a July 1st parade. That's our spirit parade. Uh, that'll be occurring during the day, and it'll start at the um, elementary school, Mount Area Elementary, and go all the way out to the carnival grounds uh, and culminates in the raising of the flag on that day. that that big flag. And then uh July 3rd is our fireworks. It's also Barney's birthday. So uh but uh but that's how we know when to shoot off the fireworks. It's Barney's birthday. So uh July 3rd for uh fireworks and I think talk about the carnival some. So that completes my report. All right. Next up we have the board of recreation and parks and the sustainability commission with myself. Um I was just put on those commissions. I have not been able to attend a meeting yet, but the parks and wreck commission will meet on June 19th via Zoom and the sustainability commission meets on the third Wednesday of the month here at town hall on at 7 p.m. Every other I know it's an odd month I believe for sustainability even month for sustainability. So every even month uh here at 7 p.m. Uh next up we have our planning commission with council member Kelly. Okay, thank you council president. Uh the planning commission met on May 19th. Uh very full agenda that day. Uh there were no uh Carol or Frederick County leaison there. So we did not get a report. Uh four items were up for decision. Uh first was introduction uh and discussion for a special exception to operate a daycare out of a uh residence. This was sent to the board of appeals with a unanimous vote for a favorable recommendation. Uh however, that hearing is being rescheduled uh from its original date of May 29th. Next was an introduction and
discussion for the approval of an addition of a boutique area to Hair Impressions. This was unanimously approved. Next was introduction discussion for approval of the concept site plan for Kingsports LLC. This is lot 15C at Twin Arch Business Park. This was also unanimously approved and now goes to the final uh site plan phase. The plan includes development of almost 7 acres for flex office/warewarehouse space as well as a parcel of over 9 acres that will be deed to the town adding 8 acres of usable open space to the town's inventory. Uh lastly, uh this there's introduction and um discussion for approval of the final site plan for Southside Plaza. I want to give a couple details about this. This was a unique uh sort of resolution to this uh or possible resolution. This was ultimately passed unanim unanimously with some conditions. The conditions came about because uh the plan was in danger of not being approved. Uh and this was the third review uh of uh of some type of plan uh uh for this uh new medical plaza. So uh the final plan was submitted without without changes the commission had requested twice before in July and September. So chairman Gent added the condition that the applicant resubmit elevations of the two buildings and incorporate brick veneer and/or block elements for a stone or brick-like appearance. Uh these revised elevations will be submitted to the town planner for view with three planning commissioners in in an effort to satisfy the requests that the exterior of the building harmonizes with nearby existing structures. Uh so um I just want to give some kudos to Chairman Gent for a creative uh solution for not stalling the plan and now uh it is in the uh property owners representatives hands uh and they're very capable of making sure the building is harmonized with the uh surrounding existing structures and uh we hope to keep it moving forward and that concludes my report. All right, thank you very much. Next up we have the streets and roads commission. All right. Thank you. On agent and livability for
Cole and the Flat Iron Task Force with a very eager council member Mund. Sorry, sir. I'm just trying to get it rush on through so we can so maybe be able to get to the carnival or Jimmy Ceone tonight. So, hey. Uh but uh for co I was unable to attend the Cole meeting which was held on May 29th due to a previous family engagement. The next call meeting will be June 25th at 5:00 PM here at town hall that some council members and the mayor might not be able to attend because we I believe we're coming back from MM MML that Wednesday. I will try and be here, but I can't guarantee it. All depends on traffic and what time the afternoon class gets out. Uh for the I want to say the streets and roads, we met on I'll try and keep this short because this was a new one. uh to me too. H heck, it doesn't have anyhow. What date was street? Do you know? Anyhow, we met this month. I thought I had it down. Sorry about that, Lucy. You can yell at me later. Uh several items were discussed on old business like the pedestrian crossing signs at North Main Street down here. Uh they will be installed eventually via the state highway. Councilman De Moto has worked tirelessly on that effort and it's paying it's beginning to pay off. Uh they're doing we seem to have met all the requirements for it. They're getting ready to if money is available with the state, the state will install them at no charge to the town. So hopefully there's some money available for that. Uh discussions of Southside Plaza continued on with the entrance way to it. the repair of the guard rail at Ridgeville by um I want to say the Devita Center over over that way. It's kind of hard back heading back to the end of East Rid Ridge Ridgville was discussed was caused by an accident about a year ago. We kind of came to the conclusion that one way
or the other it will be re repaired or reinstalled either via the town at a backfill cost from the person's insurance company or we'll just unfortunately have to may eat it eat that cost for repairing that. Uh that concludes my report for streets and roads. I will review it better next time. Again I apologize Lucy. The next meeting will be July 29th at 7 p.m. here at town hall. Thank you. All right. Thank you very much. Next up, we have the EDC and the Recycling and Sanitation Commission with Council Secretary Evans. Thank you, Mr. President. Um, the Recycling and Sanitation Commission met on the third Wednesday of every odd month, right? Yes. Yeah. Okay, got it. I'll get them third and fourth. Um, we are looking to revitalize the e-waste recycling program. That didn't happen last year. I think it last time it happened was a couple years ago. Um, so we're looking to kind of revitalize that and get more interest in that and maybe have a new recycler that will come in and do that for us without charging us an arm and a leg to do that. So, I'll keep everyone posted on that as that progresses. We did purchase 200 medium-sized 35gallon rollable totes. Um residents can trade those in trade in their bigger totes for these. Uh they're much easier to manage for smaller properties or um families that don't have a lot of trash. U those will be in end of summer, early fall. Actually, we talked today we're going to go with the early order. They should be in by the end of July. Perfect. So they will be in sooner than later. Um and that was all that was discussed during the recycling and sanitation meeting. uh for EDC. They meet on the fourth Wednesday of every odd month. Um kudos to Councilman uh Demoter for his
initiative, the small business roundt that's going to take place on September 9th at 6 p.m. Um I'll keep everyone posted on more information as that develops. Um I'll work with uh Chairman Miller and Ashley Kier to market this and hopefully get some good interest from businesses um to make it a successful initiative. Um, we're looking with Chairman Miller. We're looking to have CDC, EDC, and MAMZA work collaboratively together um for more business engagement, not only on Main Street, but you know, throughout the whole town of uh Mount Ary. There is a talk of a business survey. It's in the very early stages. Um there was positive feedback to get this done. So, I will keep you posted on that, how that how that progresses. And then some of the events which have already been mentioned um I'll mention again July 1st is the spirit parade on Main Street ending at the carnival grounds with the raising of the flag. July 3rd is Mount AR's glorious fireworks. August 23rd is celebr celebrate Mount Ary. September 9th is small business roundt. September 27th is October Fest and now we have Mount Airy Mile as well on the docket. That is all I have for my reports this month. Um, thank you. All right. Thank you very much. The next meeting of the commission will be held later this week on June 4th at 700 p.m. And the beautifification commission uh the last meeting was cancelled and the next meeting of beautifification will take place on June 17th at 7 p.m. And then I wanted to uh Mayor Hushower mentioned this and you've heard it earlier, but I did want to promote the
4ount Lions Club carnival again. and that's going on all week starting tonight, June 2nd through the June 7th. Uh there are rides, there are games, there's a lot of food, there's live music every night. It goes nightly from 6:00 p.m. to 11:00 p.m. and then there will be frier works on Friday night with a rain date on Saturday. So, so it's a good way to kind of get started with the summer and it's for a good cause. the four county Lions. Um I'm a member of the Lions Club and they support a lot of um um topics um support for the community, food and security, they support the vision impaired, they support environmental initiatives, scouting initiatives, and veterans assistance initiatives. So um all of the proceeds will go to good things for our community. So, thank you. All right. Thank you very much. Next up, we have our town attorney report with Mr. Tom McCarron. Uh, since our last meeting, provided general advice from time to time as requested uh to the town. Uh, also uh have worked on the matters to be discussed in closed session tonight. Uh, I did attend the uh planning commission meeting. Uh and then finally, since the last regular town council meeting, the court issued its decision in the uh Pleasants Development um litigation concerning the uh back property. The court uh has upheld the town council's denial of the sketch layout plan. And that is my report. All right. Thank you very much. First up is ordinance 2025-3 to revise and amend the zoning map which was tabled uh previously. So uh it is now back open. I will make a motion to adopt. Do we have a second? Uh I'd like to second that with a table amendment. Okay. Um so my table amendment is on page four. of the ordinance for all of the properties listed under tax map 0600 South Main Street. There are four parcels 1422, 1423, 1428, 1429. My table amendment is to redline strike out all of those properties so they would not be reszoned. Okay. is the original movement. Tom, it would be up to me to accept, but then it would need to be seconded from the council. Correct. Correct. Okay. So, as
I've stated before, I'm not going to be a a sole decision maker. So, I will uh accept the table amendment uh and leave it open to the council, the the remaining members of the council uh to second. So, may may I second that as well or I think it should come from somebody other than you. Okay. Very good. So, uh, right now we do have ordinance 2025-3 with a table amendment that's on the table to strike tax map 0600 bas basically the south main south Main Street properties. Um, like I said, I will accept, but it it will need to be seconded to move on. So, do we have a second? A second. Okay. So, now Tom, we'll move into discussion. Point of clarification. So, you're moving to approve the ordinance not only with Councilman Demoter's table amendments, but also the table amendments that are reflected in red line in the ordinance that you have in front of you. That's correct. That is correct. Yes. Okay. Um I guess I mean we should probably explain the red line. Yep. Okay. So the 2025 uh-3 ordinance uh when it was tabled it was basically made to have a public hearing uh due to the fact that the original public hearing we had some public outcry uh that the council was not aware of nor was the planning commission when the recommendations came through through that public hearing um we listened to anyone that wished to speak we also talked with the I'm sorry it was a planning commission workshop with the council uh we talked with the planning commission. We had a nice back and forth uh and through that process, a lot of these recommendations that were in the original uh with the consensus of the council were redlined at that meeting or or zoned to be redlined. So, uh I'll go down them real quick real
quick. So, with uh the Twin Arch Business Park, it's partial 0339 from low density residential to industrial that there was a consensus of the council to keep that. um the Watersville Road due to the owner not wanting the NP uh that has been stricken as as well as a consensus of the council. Uh partial number 1109 uh which is on East Ridgeville Boulevard from R2 to Neighborhood Professional that has been upheld. Uh and then if you take the south main street extended east side so it is partial 1116 1121 1118 1119 1118-1 1117 and 1301 that were going from residential existing to community commercial. All those have been also been removed from this ordinance. Uh, and then you look at the South Main Street extended west side. Uh, all I'm not going to read through all of them, but all of the ones on the west side have also been stricken from the ordinance. Um, now we have it on the table that tax Map 0600 South Main Street. Uh there was a a table amendment and a second to also remove the possibility of partial 1422, 1423, 1428 and 1429 to go from neighborhood neighborhood professional or residential existing to limited commercial for the first three and then neighborhood professional for the last two. So that is the ordinance that is on the table. It has been seconded. Uh I will now open up for any discussion. Mayor, I jump in. Um I do have a question. If say for example
um just say uh Dr. Cappuccino's property um were to remain as zoned uh currently. Is there an avenue to ex extend the parking lot within the current zoning? Uh I would say possibly maybe through some kind of variance. However, um if I have correct memory of this, we may have looked at this about two years ago and determined it is in fact not eligible uh for a variance um because of the restrictions of the zone itself. Now, you could introduce legislation to change those restrictions. Um, but just saying as it's currently on the books, um, if and if my memory serves me from two years ago roughly, uh, I I'm not I think we looked at it and determined it was not it was not u a proper subject for variance. Yeah. Yeah, that's that's kind of the way I was remembering it as well. So, um um so just so the council is aware he's you know we kind of put him in a position a a delayed position. So if there's a um understand that and I know Dr. Guy Capuccino is here if if you want to come up you might remember more than Tom. Do we know what the restriction was on the zone to I think it's not allowed. It's going to be very vague, but I believe that the the limitations of the zoning ordinance itself uh hemmed it in in some manner such that you would need a text amendment probably to that in order to um that a variance alone wouldn't do. But again, that that my memory on that is very vague. Was it like a square footage thing from from what I
understood? The my understanding because we went in circles on this uh the county said yes sir, no problem. And then it was came back to the town and just due to the restriction of the zoning and what the offsets had to be given the nature of our zoning it was impossible and we looked at it a number of different ways. Um so that's why we you know made the motion to go for limited commercial because that would in fact allow us to do that. Okay. So do you have any other questions for me? That's the best as my memory serves as well. It was before we were here or at least some of us were here. So I just wanted to kind of see what the limitation was. Yeah. We we did try because that was the most expeditious way. Um and we were pretty much unequivocally told it was impossible. Yeah. Okay. I think Sorry. I think that is correct, Council President, because I think I was here and I think Tom's kind of correct. I talked to the town planner on this when it came up too and it's pretty much that it's more restrictive. the the zoning classification that's applied to the property is the issue with them being able to expand the back parking lot. And on a side note, before we I do have another table amendment, but we can discuss that once we're done with this. Okay. Um so basically a text amendment for that particular zone is an avenue to where it's not actually impossible. Maybe the officials at the time deemed it impossible if they weren't willing to do it, but Well, when is not possible? It's not possible given the wording of the current ordinance, right? But a text amendment, if you were to amend that in some kind of way to permit what's being requested, you you know, it's certainly something which this legislative body can do. Correct. What's happen which this legislative body can do with subject to a mayor's need to know or I just want to make sure before we go down this maybe Tom can help. If we did a text amendment, if my memory serves me
correct, uh, for this property, it would either have to be somehow written that it would specifically have to apply to this property, but we can't do that. Then it would have to be then it would be applicable to all property within this town. Correct. So we might have unintended consequences down the line at other neighborhood professional businesses that are that are in this town. So we have to be careful before we start drafting tax amendments to solve or take care of an potential issue that has been looked at currently and that would be the worst part of it. Yep. So I just wanted to make sure I was thinking on that properly too, sir. Thank you. No worries. If if I can just close out with a comment, the fact that it gets stricken tonight from this ordinance doesn't mean that the master plan has changed. It's still in the master plan that way. And there are things in the master plan that people are agreeable to on the fence on, and then there's things that that people do not like. Uh and so the council can deal with those as they come up. But I I guess my only point to that is that, you know, it doesn't get approved tonight. It may not get approved at all, but it it's still in the master plan that way. So, so it's a subject that is going to have to be dealt with at some point. So, may one more comment and then I have to go, but with all due respect, this has been going on for years and I'm out of time. I'm out of time. I'm out of employees to park. And I and I understand and the unintended consequence is a is a valid one. I mean, there's a lot of neighborhood professional that could then open up who aren't going to be as solicited as I am to the appearance of the neighborhood. I understand the difficulty of this situation. But I just need to tell you,
I've been exceptionally patient. I was asked to do surveys. I did. I was asked by engineering fees. I did tens of thousands of dollars. I'm out of time. Yeah. you've gone through the process and the steps that have been requested of you on this and I understand that. Just one more comment on all these properties in general. It was my understanding when we started this re-evaluation of all these properties that it was based on one of the facts that we have a tendency as a council that does not that that we would not go against the property owner's wishes of the reszoning of the properties. And as far as I know, throughout the three years that this master plan has been in development, all these property owners, to my knowledge, have have come in and physically requested the resoning classifications that the that the planning commission has put forth in the master plan. So therefore, if we at the last minute strike these out, as the doctor indicated, he's wasted tens of thousands of dollars. He's gone through all the steps that the town has required. Not sure if he would be able to stay because if he can't expand his business or do on more business because of parking. Uh, so I would say we reject this amendment and just go as the planning commission has recommended on all these properties here. Discussion, council president, I I have some some comments, but I wanted to see if other council members wanted to say anything. Discussion, please. So, so for me, I mean, it's it's always a balancing act between, you know, people have property rights. You have the right to own
property, sell property, uh make improvements to your property. But it's a balancing act between property ownership and those rights and then the the wishes of more broadly the citizens of the community and and the vision for the for the town of Mount Ary. And I think um I've made all these points at the various workshops and other meetings and I'll just do a quick summary here. Um I think Mount Ary is it is at a key inflection point. Okay, we've done a very good job of controlling um significant growth in our town, but there are development pressures all around us to include pressures on our main street. And I think we need to um look at our main street corridor holistically, both the very end of South Maine to the transition areas into residential zones all the way up to North Main Street. Um we've got townhouse town houses and villas coming at the end of North Main Street. We've got a police station on the south end. We've got a traffic roundabout that's going in. I want to see what impacts that's going to have on our town. And so, um, I think we need to continue to nurture and safeguard our main street because if you lose the character of your main street, you're just another suburb. You don't have your main street. Um, our master plan emphasizes, I think it says in the executive summary, we will always solicit and listen to our residents on all matters of growth and development. The resident is our most important stakeholder in our future. And I heard nu numerous comments from all of the stakeholders and surrounding property owners um that were not supportive of these
resonings um for quality of life issues and other issues. And then lastly, the point about residential creep creeping from South Maine into our residential area. I think at some point you have to say um we we want to prevent that. I think the zonings that we have now with neighborhood professional provides that buffer that we need. That was the general sentiment from the residents who live on South Main Street. And then a very last point, um, through this process, I looked at all the various zoning districts, um, that were potentially involved in these reszonings on Main Street. And I put together a matrix just for myself to help me understand how these related, how they compared and contrasted. I found some inconsistencies across these zoning districts that kind of happen over time. I think when your your your your code gets cobbled together and over time you make changes, you don't realize how they're impacting your entire system. So, I think there is a my my last point is there is a need to harmonize our town code regarding the zoning districts and how they're defined. And we need to get rid of some of the inconsistencies. And more broadly, I believe we need to focus on rebuilding our town code in this regard in terms of development. We've done a great job taking the citizens views from all of our community surveys and building that into the master plan. The master plan has done a great job of identifying a vision statement and very key performance objectives as to the outcomes that we want out of the master plan. Now, we need to look at the town
code, which is your rules and regulations for how you develop properties and zone things. And I think we need to make improvements to that town code because if our rule book isn't written in a way that we get the outcomes we're desiring, then we're just going to keep on being unhappy with some of the outcomes. So that's something I think we we could all work on in in the coming coming years within the town. So thank you for the time. Any other questions, comments, discussion on the amendment that we have in front of us? I would just like to say one thing from all that. It seems like the master plan was totally fine with him. there's inconsistencies that he does not agree with between the code and the town master plan which is allowable which is concerning but I also got the feeling that we'll not be allowed or he will not look favorably on anything in the master plan or anything that we have done that three years the planning commission's been involved in until the town code is rewritten and that could be so we would have to stop all development moving forward forward in in this and as again as I said also I listen to the residents but yet there also has to be a balancing act between property right owners property rights and what the zoning code is and adjoining properties that is what the zoning code does in my view and limited commercial and I've done the matrix several years before when we were discussing this in there and I did the same looks and there are inconsistencies But sometimes we have to put our trust in the planning commission and the town council and the town staff to interpret
the code as they listen to the residents also. And I'm going to say this right now with the planning commission we have and some of the town council members up here. I don't think the town's going to have a better chance in the future to restrict or to harmonize development within this town with the current planning commission that we have now. They look at things very very strictly and they don't have a problem telling no to somebody or or come back. So again, I urge the council to reject this because mainly on the fact that every property owner here has come forward and said they are in favor of the town reszoning. We're doing this at the property owner's request and if we don't do it at their request and we're going against what this whole reevaluation started as as looking at what the property owners wanted. So again, I urge the council to reject the text amendment or the table amendment here. Thank you. Any further discussion? Two quick two quick points if I may. Yeah. Just a um maybe a little bit of a rebuttal if I I think if then I was on the outside looking before, but I think if the council waited for a perfect master plan, it would you'd never have one. Yeah. Okay. I think there were they're a bit as a whole, it's a it's a great do a great vision for the town. And of course, there's pieces I think that not everybody's going to agree with. Um um lastly um uh there was a second thing that I just forgot as I was welcome to this side. You'll get you'll get better shot. Welcome to this side. Yes, that was the
main point I wanted to make. I think that I um you know as it was said the plan commission did a great job with it and if I again there wasn't going to be a perfect document and there never will be. So, um, uh, I think that, and some of us up here did speak at those workshops about these certain things, these specific things that we're discussing, and I think that's that's why we're all discussing it now. So, um, Carl, real quick, I know you said that every property owner requested that their property be reszoned. I I know for a fact, um, that there are certain property owners in this very room, uh, whose properties are being reszoned that they did not request. I just want a clarification on that. Oh yes. No. I'm when I say that I'm referring to the properties that we are discussing at the table amendment, not the order. You're not talking the entire order. No, no, no. I've totally aware of what you said in the history of it. I'm just referencing to the to the tax to the four that were that we were discussing. Just wanted to clarify. Yeah. No, no problem. Sorry if I mis misconstrued that, sir. Sorry. Uh any further discussion? That second point quickly was was the fact that it's not necessar it's never and I've spoken about these types of things before in public. It's it's not it's really never about the current owner and the current owner's intentions for me. This is permanent going in perpetuity. And that's the big that's the big decision here. That's all. Yeah, I would I would understand that. Uh any further discussion? Okay, before we get to a vote, uh I do want to say uh one thing while we're in the discussion portion, and that is for the public uh and our citizens, homeowners to understand that the people that are making these decisions, whether they're recommendations from the planning commission or their elected officials up here, your mayor, your town staff, um not necessarily town staff,
but everybody else, we all live in this community, too. We are all volunteers. Yes, the council gets paid a little bit, but uh I promise you we're more volunteers than we are paid. Uh we don't have to be here. We choose to be here. And everybody, regardless of what their recommendation is, their decision is, it's done because of what they truly feel is best for this town. Um, so I don't want people whether they're on the planning commission or any commission or at this council table to feel attacked based on what they feel is best for the community. There's a reason why one person does not make a singular decision. Um, and that is because it's a an entire group of people that either elected by you and if you didn't go through the voting process, then that's, you know, on you. But uh or there are people that are appointed by the mayor. And if you feel very strongly one way or another, I would highly recommend that you put your email in to the mayor and volunteer your time to be on a commission. But I I have to say that whether it's during public comment or whether it's online, attacking any volunteer, especially in a commission, especially the planning commission because they put in more work than any of us. Um based on what they feel is correct for this town is uh is unacceptable. Um it doesn't happen often, but when it does, it needs to be pointed out. So um I would much rather you come after me, come after the mayor. He's got thick skin. Uh call town hall. Barney, John, any of us. Uh, but I I'm pleading do not go after a planning commission member or any member of any of our commissions based on what they feel is best for this town. So, with that being said, um, any further discussion? All right. Hearing none, right now we have a motion
on the table for ordinance 2025-3. It currently has, uh, the red lines that I discussed, which the copies are in front of you. It also has a table amendment uh to strike the tax map 0600 for the South Main Street for parcels there as well. Uh that is what we'll be voting on right now. Uh so all in favor council but just to make sure we're just voting on the table amendment right now. Correct. No. Okay. Because I do have another table amendment and can I add that now or later or should we just vote on the table amendment? We're not voting on the table amendment. The table amendment was seconded. Therefore it is a part of the ordinance as we are voting on it right now. So if you have a table amendment, you have the right to obviously say it. Uh I would have to accept as the original movement and then if it's not seconded, it would die there and we're back to this. If it is seconded, then it takes the place of what we're looking at now. Okay. Then I would like to offer a table amendment. I just wanted to get the process. I'm used to doing the amendments first. What I watched I just want to make sure I got the opportunity to say that. Uh so thank you, council president. Uh just looking the amendment that I have is bear with me a little bit here because it's for the South Main Street extended properties. I've got three properties in mind uh primarily based on the fact that the landowners came and came before this body and requested the changes to their property as zoning. I'll start with two on the west side first. Um, if I'm understanding the tax map correctly, tax map 090E E06000, South Main Extended, parcel number 1395, also known as the uh I believe the Reed property. Um she has sent a letter into us
strongly suggesting that she is in support of the council reszoning of property from residential existing to limited commercial. Same thing for parcel number 1386 tax number 18 371812 which I believe is the Hegwood property. Um further down, same thing that he came in at the public hearing and supported uh the change over from residential existing to limited commercial. The third and final property for people that have come before us and requested approved our zoning change. Also, it was uh at a letter from a prospective buyer's attorney. So, I would just feel obligated to at least include it because they asked for that. Uh the Vaslo property basically tax map 0602 parcel 116 tax account number 0713-015244 they would like or it was suggested by the planning commission to be resent from residential existing to community commercial. While I do believe that some form of commercial will eventually end up at that corner, I cannot in good conscious recommend a community commercial designation for that property. So, I would like to downzone that from community commercial to a limited commercial classification based on the fact that the limited commercial through the approval through just what's allowed on the property is a little bit more protective of that area and the remaining residential properties there. Also, if there's any suggested changes through the appeals process, there's some more hoops that a prospective builder would have to jump through for the board of appeals and the
planning commission on that. So, um I believe also the limited commercial is a better fit for the remaining residential properties down that way. still offers some of the benefits of a neighborhood professional district but limits the size of the h of any building there and everything else there. So I believe it's a better fit than community commercial for that corner. So that's my amendment sir. Just for clarification. Yeah. Yeah. Try I told you it's kind of me. No no you're fine. What was what was the second partial number? Uh should be the Hwood property. Uh 1386 I believe it's 1808 South Main Extended. It was I got it. I just didn't hear the last. Oh no. I said I some sometimes I can't read read my own writing. Can we just get all four parcels real quick? Oh yeah. Yeah. Go ahead. Yeah. No. What are the four parcels again? It was three. It was three parcels. Three. Okay. Yeah. It was um Let me get the correct Thank you. It's what's known parcel number 1395. tax account number 18368412. Uh that's uh the Reed property. I can dig up the address numbers for you too if that's basically 139586 and 1386 and then the Vaslo property which is 11616. That's all I wanted. Yeah. So I just out of out of all fairness to the property owners and everything else since he came before and suggested I do take into account the long-term effects and that's why the Vaslo my suggestion was from community commercial down to li limited commercial. It's a lot less intrusive uses of that fine um down in that area allowed under the under the limited commercial. All right. All right. So, we have a table amendment right now, which means that we are on
hold from the previous table amendment as it sits right now. Uh, so what we would need uh is me to accept as the original movement and then we will need a second um to enact this table amendment as we did the original. Uh with that being said, the original amendment that has been second, it is still untouched. Okay. Remains uh as as it is. Um, so again, I'm not going to be a a sole decision maker for a body. So, as the original movement, I will open it to a second um and let another We have three other council members here that can can decide. So, it is accepted if it's seconded. Uh, so I will do that and open it up for a second. All right. Hearing none, that table amendment dies. So, now we are back to the original um ordinance that we were about to vote on, which is the 2025-3 with the red line copy that you have in front of you along with council members council member Demoter's uh table amendment to strike uh the four parcels on South Main Street as well. Any further discussion? Just to clarify under my own thing, if this vote, if this table amendment dies, we go back to the original ordinance. Your your table your table get seconded. No, but I mean this this one I mean if this table man second so it is as we're not voting on the table amendment right now. We're voting on the entire ordinance. If the ordinance dies, then we would have to motion uh for something different or we just let it sit as is in the master plan. Okay, Tom, is that correct? Correct. Thank you. Okay.
