Okay. Good afternoon everyone. Um I call the May 5th planning commission meeting to order. Uh could we get a roll call please? Ingresol here. Shack. Beam here. Seagull here. Casper McDougall here. Krabenhoff. Are there any agenda amendments or is there a motion to approve uh the May agenda? Chair Beam, I would like to move item 7A to the beginning of the agenda to welcome our new ward one commissioner Wayne Ingresol. Uh Wayne, it's my understanding you have been on this commission in the past. Um oh, there it's on. Yes, I was on I can't remember the years John Ralph appointed me when he was on the city council and then I when I was on the Klay County board, I represented the county as Paul does now. right. Are there any citizens to be heard on items not on the agenda? Okay. So to start with public hearings, um there's a request of the city of Morehead for text amendments related to the use regulations and citywide zoning map amendments related to mixeduse parcels. Is there a motion to open the public hearing? So moved. All in favor? I I uh city planner Houston, please provide the commission an overview of the item. Thank you, Chair Beam and commissioners. Along with uh recent texts and map amendments as part of the onward Morehead comprehensive plan implementation process, the city is now requesting complimentary zoning map amendments focused on mixeduse parcels. Out of the 618 mixeduse parcels reviewed, only 129 parcels required updates, which is always good. Um, of those 42 um, parcels were made new non-conforming uses and all all but one of those was a sing their single family dwellings that are formally in residential zoning districts near major commercial corridors like Main Avenue or First Avenue North. These single family homes may remain single family homes for as long as they are standing or may have the ability to increase their density now as MU3 has no density caps and permits two family and multifamily units. If these parcels are able to meet other zoning requirements like parking, they may be able to add additional dwelling units. whereas before the size of the parcel would have dictated how many dwelling units um would have been allowed on that

parcel. Um in addition to those changes, we found 11 previously non-conforming uses that were made conforming uses um like we did find some apartments um that were previously in a low density area. uh self storage development and some other commercial um uses like the last time I did find some more parcels that had inconsistent future land use designations which will be addressed at the end of this um process where we're updating all the zoning um citywide. And then in addition to this round of zoning map amendments, um I staff is continuing to clean up and update the zoning ordinance with very limited time. Um I just addressed a few small changes um that were needed to be addressed immediately. Going back to the mixeduse district, uh single family is the only type of housing that's not currently permitted. Um but we were missing duplexes and twin homes. So that was always meant to be in the zoning table. So I did add that back in. And then also clarifying some of the new cannabis law um language in the use table. We did uh when I did the first I think this is will be the third tweak of our cannabis legislation um changes because again this is all very new to us and we're finding scenarios that we did not consider. So, I had to um just clarify some of the language for what's called a micro business and a messo business. Um the correct language is in the body of the text, but I forgot to put it in the the actual use table. So, that was one correction. And then when I created the provisional use

permit requirements, um I originally added some information that was contrary to the statute. So since I've recently read that statute a few more times, um we needed to make some changes. Whereas previous I had some language in there about smoking outdoors, smoking and vaping outdoors, and that's actually not permitted. um you can only consume those types of edibles indoors. So that was just a few little minor word changes in our zoning code. And I think that was we did not receive any public comments and staff is suggesting that the planning commission recommend approval to the city council. the tech text amendments related um to the use regulations I mentioned and the zoning map amendments related to mixeduse parcels. Um, Robin, I'm just curious on uh number four and with the MEO businesses uh you referring number three uh exterior or exterior cultivation is not permitted in the gateway overlay district. Are there other instances within town it is allowed outside? I'm sorry I think I could I didn't catch your whole question. So you're asking about exterior cultivation right in the gateway. it right and you talk about the gateway. I get that. But do you allow exterior cultivation in other parts of um um light industrial or Yes. in light industrial and heavy industrial if they're not along the gateway. They can do um exterior cultivation. You can also

do exterior cultivation if you have a mezzo or a micro business license and you're not adjacent to residential and you're in a single tenant building. And we have had a a person um propose that use and it's right off of Highway 75. So it's it's like it's by the railroad. It's not by residential. So they do plan they they would like to do exterior cultivation. They're going to try anyway. Um that's up to two acres. Pardon? That's up to two acres, right? Under the micro business, it's up to two acres and you can do more under the mezzo. Um but he because he wants to do retail sales also, they'll do the micro business license for that for that type.
